In Attendance: Cari Gerlicher, Dan Hatten, Joel Scharf, Hugo McPhee, Joe Sheeran, Dave Bentrud, Bob Jacobson, Stephanie Revering, Eric Werner, Susan Engel, Rodney Seurer, Andy Skoogman, Mike Matsin, Mike Goldstein, Mike Risvold, & Jeff Tate Meeting Called to Order: 1030 Agenda Additions: None Approval of Agenda: Motion made by Director Hatten and seconded by Past President McPhee; motion passed. Opening Invocation, Chaplain Dan Carlson VP Goldstein stated he could not be here today due to a family emergency. VP Goldstein led the invocation. Treasurer’s Report, Susan Engel/Treasurer Gerlicher See detailed financial report. A month ago we were showing we were above planned, however, this month we have noticed a relic. The magazine is fine in terms of its profit but unfortunate in this month the revenues went up its small amount and it truly is a timing thing. We looked like we were above budget even though we should be below and it does turn out that we are $3,000 below budget. Past President McPhee asked if there was a plan to wean ourselves from the expectations from the foundation. If we are relying on $35000 from the foundation and they are not meeting that goal is there a plan to figure that out? Executive Director Skoogman stated the foundation is meeting that goal. Goal for 2018 is to not have the $35000 in the budget for revenue and anything that can be given to us is a great addition. President Seurer commented that it will be important for the next president to attend the foundation board meetings. One of the items they wanted from us was the need to know what the money will be used for when they reach their goal. VP Goldstein stated one thing to consider with the foundation is that we lose continuity because we change presidents every year so perhaps we have the 3rd VP attend the meetings or a Director so someone is there for more than a year. Susan wanted to point out that the bond fund is doing really well; however, when the stock markets go up, bond funds go down. We are still up but we lost $3500 in November and may continue to see it go down in December. It is not a cash thing but we are not selling it and it is an accounting thing.

Director Risvold commented that investments seem to be more difficult to guess when it comes to budget. Can we represent it more on the budget? Susan stated the portion of the payments that were on the building, the other thing that is known is the cash dividends that go into our account and that are interest income in our budget, and the 3rd piece is interest gains/loss that is budgeted at zero. It goes up and down. Susan Engel presented the financial report and asked for motion to approve: Motion made by Past President McPhee and seconded by Director Bentrud; motion passed. Treasurer Gerlicher presented the bills for October and asked for motion to approve: Motion made by Treasurer Gerlicher and seconded by Director Hatten; motion passed. Secretary’s Report, Stephanie Revering: Minutes from the November 17, 2016 meeting were submitted. Motion to approve made by Secretary Revering and seconded by Treasurer Gerlicher; motion passed. President’s Report, President Rodney Seurer: In Carver County met with Chief Scott Knight and Sheriff Jim Olson. We invited them to our association in Scott County. Met with Stearns County Chiefs Association where they had their legislatures attend and they felt that the body cams were going to come back again in the legislature. Our lobbyist stated he didn’t believe it was going to come back. Stearns County is being innodated with media data practices with regards to the reports. They spent over $110,000 in transcribing and redacting these reports. It was discussed about the data practices act and the cost to the agencies and time and energy of redaction. They also discussed the incident at Crossroads Mall in St. Cloud and have debriefed incident and will be considering more training. Committee Reports:

• Legislative Committee, 3rd VP Jeff Potts Law Enforcement Coalition + POST Meetings update That group got together again since our last board meeting. Nothing has changed. We are meeting with Senator Lymer and Rep. Cornish December 22nd.

Ø We are now in our 4th month of Advanced CLEO Ø 25 students Ø Have completed training at Breezy Point and two trainings via St. Cloud State

Andy wanted to throw an idea out there..take our leadership academy and do distance learning and do it over a month-6 weeks. The instructors go to St Cloud and teach it live and students could either watch it online or go to St. Cloud. ETI Update Director Werner stated they had a meeting last month. Registration has been opened and we added a different tier due to the Wetterling presentation. The main speakers are taken care of and we are having our first podcast. We are in very good shape. Director Hatten has resigned from the committee and thank him for over the 10 years that he served on the committee. Joe commented that we already have 31 registered.

• Communications, Joe Sheeran Winter Magazine: Magazine coming out the first of the year. Q & A with Dr. Soot. 5 tips how to keep out of hot water with regards to HR issues. Presidents report regarding mental health task force. Commissioner Doman talked about the overview of the council and Chief Blair Anderson’s role. Also, Dan Carlson discusses his 10 years as the association chaplain. And New Brighton Public Safety Director Tony Paetcchenik discusses great ideas in policing. And Chief Knight discusses the Ryder Cup.

Peer Support System, Bob Jacobson/Carlson/VP Goldstein IACP is impressed with what we are doing so they want an article for their magazine and should be in the January addition. It gives people a model to go by and other states could possibly use it. Executive Director’s Report, Andy Skoogman Drug Take Back letter response: They did respond to us. DEA issues remain for a number of the pharmacies. They did ask for our support to allow pharmacists to prescribe narcan. Not a lot of strong support for the pharmacies to take the drugs from people. Update on 2017 ETI sponsorships + sales: Last month we are at $46,000 now we are at $53,000. This does exceed lasts years revenue and does surpass our 2017 goal. 85 exhibit booths have been sold. Approval of facilitator contract for 2017 Strategic Planning session + location of session: A proposal from Kathy Permy was submitted. Kathy knows our organization and has worked with us a long time. Yet, at the same time, another facilitator was mentioned as well. They will provide a proposal by the end of the year. If we want to go with Kathy we can afford to do that. Do we want to wait another month or do we just go with Kathy? President Seurer commented that he was a part of the last strategic session and she was very good to work with. The locations for the session we looked at Breezy Point, Grandview, and Rutgers. They will make the choice based on price.

Update and discussion on 2017 Critical Issues Forums: Nothing new other than we do have with board members participation we have about 34 people we just have to solidify our topics and make that decision by the next board meeting. Regional Rep meeting (January 11, 2017): We are piggybacking the regional rep meeting and peer support meeting together. Old Business Firstnet: Director Risvold stated it had been narrowed down to 2 companies. Since then they eliminated to one and that other company is now suing FirstNet. It appears thru media reports that AT & T is the partner with FirstNet. It now appears the announcement will be in February. New Business None. Being in the middle of a TV-style gun battle as a lawenforcement officer is rare—and even rarer when you are achief. Nonetheless, Chief Tim Fournier of New Hope, Minnesota,found himself in the thick of one when a gunman opened fire ina crowded city hall following a swearing-in ceremony, injuringtwo police officers. In the days that followed, Chief Fournier wasthere for his troops. Surrounding departments were thereoperationally to take calls and fill in for officers who neededtime off or who were placed on post-shooting mandated leave.However, there was no formalized system to guide ChiefFournier through this incident on a personal level: no checklistin place to see if he needed anything; no peer to talk to; noteven someone to drive him around so he could help managethe actual incident, while also focusing on his agency’s day-to-day operations.

1.1 A bill for an act1.2 relating to public safety; requiring peace officers to receive training in crises1.3 response, conflict management, and cultural diversity; reforming and increasing1.4 funding for peace officer training reimbursement; providing reimbursement grants1.5 for pathway to policing programs; authorizing the Peace Officers Standards and1.6 Training Board to collect peace officer race data for a limited purpose; appropriating1.7 money; amending Minnesota Statutes 2016, sections 171.20, subdivision 4; 357.021,1.8 subdivision 7; 363A.08, subdivision 4; 626.8432, subdivision 1; 626.845,1.9 subdivision 1; proposing coding for new law in Minnesota Statutes, chapter 626.

1.10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.11 Section 1. Minnesota Statutes 2016, section 171.20, subdivision 4, is amended to read:

1.12 Subd. 4. Reinstatement fee. (a) Before the license is reinstated, (1) an individual whose

1.13 driver's license has been suspended under section 171.16, subdivisions 2 and 3; 171.175;

1.14 171.18; or 171.182, or who has been disqualified from holding a commercial driver's license

1.15 under section 171.165, and (2) an individual whose driver's license has been suspended

1.16 under section 171.186 and who is not exempt from such a fee, must pay a fee of $20.

1.17 (b) Before the license is reinstated, an individual whose license has been suspended

1.18 under sections 169.791 to 169.798 must pay a $20 reinstatement fee.

1.19 (c) When fees are collected by a licensing agent appointed under section 171.061, a

1.20 handling charge is imposed in the amount specified under section 171.061, subdivision 4.

1.21 The reinstatement fee and surcharge must be deposited in an approved state depository as

1.22 directed under section 171.061, subdivision 4.

1.23 (d) Reinstatement fees collected under paragraph (a) for suspensions under sections

1.24 171.16, subdivision 3, and 171.18, subdivision 1, clause (10), must be deposited in the

2.1 special revenue fund and are appropriated to the Peace Officer Standards and Training Board

2.2 for peace officer training reimbursement to local units of government general fund.

2.3 (e) A suspension may be rescinded without fee for good cause.

2.4 Sec. 2. Minnesota Statutes 2016, section 357.021, subdivision 7, is amended to read:

2.5 Subd. 7. Disbursement of surcharges by commissioner of management and budget.

2.6 (a) Except as provided in paragraphs (b), (c), and (d), the commissioner of management

2.7 and budget shall disburse surcharges received under subdivision 6 and section 97A.065,

2.8 subdivision 2, as follows:

2.9 (1) one percent shall be credited to the peace officer training account in the game and

2.10 fish fund to provide peace officer training for employees of the Department of Natural

2.11 Resources who are licensed under sections 626.84 to 626.863, and who possess peace officer

2.12 authority for the purpose of enforcing game and fish laws; and

2.13 (2) 39 percent shall be credited the remainder shall be credited as follows:

2.14 (i) the first $....... to the peace officers training account in the special revenue fund to

2.15 fund the operations of the Peace Officer Standards and Training Board; and

2.16 (ii) any remaining receipts to the general fund.

2.17 (3) 60 percent shall be credited to the general fund.

2.18 (b) The commissioner of management and budget shall credit $3 of each surcharge

2.19 received under subdivision 6 and section 97A.065, subdivision 2, to the general fund.

2.20 (c) In addition to any amounts credited under paragraph (a), the commissioner of

2.21 management and budget shall credit $47 of each surcharge received under subdivision 6

2.22 and section 97A.065, subdivision 2, and the $12 parking surcharge, to the general fund.

2.23 (d) If the Ramsey County Board of Commissioners authorizes imposition of the additional

2.24 $1 surcharge provided for in subdivision 6, paragraph (a), the court administrator in the

2.25 Second Judicial District shall transmit the surcharge to the commissioner of management

2.26 and budget. The $1 special surcharge is deposited in a Ramsey County surcharge account

2.27 in the special revenue fund and amounts in the account are appropriated to the trial courts

2.28 for the administration of the petty misdemeanor diversion program operated by the Second

2.29 Judicial District Ramsey County Violations Bureau.

3.1 Sec. 3. Minnesota Statutes 2016, section 363A.08, subdivision 4, is amended to read:

3.2 Subd. 4. Employer, employment agency, or labor organization. (a) Except when

3.3 based on a bona fide occupational qualification, it is an unfair employment practice for an

3.4 employer, employment agency, or labor organization, before a person is employed by an

3.5 employer or admitted to membership in a labor organization, to:

3.6 (1) require or request the person to furnish information that pertains to race, color, creed,

3.7 religion, national origin, sex, marital status, status with regard to public assistance, familial

3.8 status, disability, sexual orientation, or age; or, subject to section 363A.20, to require or

3.9 request a person to undergo physical examination; unless for the sole and exclusive purpose

3.10 of national security, information pertaining to national origin is required by the United

3.11 States, this state or a political subdivision or agency of the United States or this state, or for

3.12 the sole and exclusive purpose of compliance with the Public Contracts Act or any rule,

3.13 regulation, or laws of the United States or of this state requiring the information or

3.14 examination. A law enforcement agency may, after notifying an applicant for a peace officer

3.15 or part-time peace officer position that the law enforcement agency is commencing the

3.16 background investigation on the applicant, request the applicant's date of birth, gender, and

3.17 race on a separate form for the sole and exclusive purpose of conducting a criminal history

3.18 check, a driver's license check, and fingerprint criminal history inquiry. The Peace Officer

3.19 Standards and Training Board may request each license applicant and renewing license

3.20 applicant to provide their race for the exclusive purpose of determining the aggregate racial

3.21 composition of peace officer licensees and license applicants. Each form shall include a

3.22 statement indicating why the data is being collected and what its limited use will be. No

3.23 document which has date of birth, gender, or race information will be included in the

3.24 information given to or available to any person who is involved in selecting the person or

3.25 persons employed other than the background investigator. No person may act both as

3.26 background investigator and be involved in the selection of an employee except that the

3.27 background investigator's report about background may be used in that selection as long as

3.28 no direct or indirect references are made to the applicant's race, age, or gender; or

3.29 (2) seek and obtain for purposes of making a job decision, information from any source

3.30 that pertains to the person's race, color, creed, religion, national origin, sex, marital status,

4.5 (b) Any individual who is required to provide information that is prohibited by this

4.6 subdivision is an aggrieved party under sections 363A.06, subdivision 4, and 363A.28,

4.7 subdivisions 1 to 9.

4.8 Sec. 4. Minnesota Statutes 2016, section 626.8432, subdivision 1, is amended to read:

4.9 Subdivision 1. Grounds for revocation, suspension, or denial. (a) The board may

4.10 refuse to issue, refuse to renew, refuse to reinstate, suspend, revoke eligibility for licensure,

4.11 or revoke a peace officer or part-time peace officer license for any of the following causes:

4.12 (1) fraud or misrepresentation in obtaining a license;

4.13 (2) failure to meet licensure requirements; or

4.14 (3) a violation of the standards of conduct set forth in Minnesota Rules, chapter 6700;

4.15 or

4.16 (4) failure to provide information in response to a request from the board made pursuant

4.17 to section 626.845, subdivision 1, clause (12).

4.18 (b) Unless otherwise provided by the board, a revocation or suspension applies to each

4.19 license, renewal, or reinstatement privilege held by the individual at the time final action

4.20 is taken by the board. A person whose license or renewal privilege has been suspended or

4.21 revoked shall be ineligible to be issued any other license by the board during the pendency

4.22 of the suspension or revocation.

4.23 Sec. 5. Minnesota Statutes 2016, section 626.845, subdivision 1, is amended to read:

4.24 Subdivision 1. Powers and duties. The board shall have the following powers and

4.25 duties:

4.26 (1) to certify postsecondary schools to provide programs of professional peace officer

4.27 education based on a set of board-approved professional peace officer education learning

4.28 objectives;

4.29 (2) to issue certificates to postsecondary schools, and to revoke certification when

4.30 necessary to maintain the objectives and purposes of sections 626.841 to 626.863;

5.1 (3) to license peace officers who have met the education and experience requirements

5.2 and passed examinations as required by the board;

5.3 (4) to develop and administer licensing examinations based on the board's learning

5.4 objectives;

5.5 (5) to consult and cooperate with continuing education providers for the development

5.6 of in-service training programs for peace officers;

5.7 (6) to consult and cooperate with postsecondary schools for the development and

5.8 improvement of professional peace officer education;

5.9 (7) to consult and cooperate with other departments and agencies of the state and federal

5.10 government concerned with peace officer standards and training;

5.11 (8) to perform such other acts as may be necessary and appropriate to carry out the

5.12 powers and duties of sections 626.841 to 626.863;

5.13 (9) to obtain criminal conviction data for persons seeking a license to be issued or

5.14 possessing a license issued by the board. The board shall have authority to obtain criminal

5.15 conviction data to the full extent that any other law enforcement agency, as that term is

5.16 defined by state or federal law, has to obtain the data;

5.17 (10) to prepare and transmit annually to the governor a report of its activities with respect

5.18 to allocation of money appropriated to it for peace officers training, including the name of

5.19 each recipient of money for that purpose and the amount awarded; and

5.20 (11) to assist and cooperate with any political subdivision or state law enforcement

5.21 agency that employs persons licensed by the board to establish written policies as mandated

5.22 by the state pertaining to persons licensed by the board, and to enforce licensing sanctions

5.23 for failure to implement these policies; and

5.24 (12) to collect aggregate data on the race of license applicants and license holders for

5.25 the sole purpose of identifying the aggregate racial composition of those seeking to become

5.26 and those currently serving as licensed peace officers. The board shall request this information

5.27 at the time an applicant submits a license request and when a license holder applies to renew

5.28 the officer's license.

5.29 In addition, the board may maintain data received from law enforcement agencies under

5.30 section 626.87, subdivision 5, provide the data to requesting law enforcement agencies who

5.31 are conducting background investigations, and maintain data on applicants and licensees

5.32 as part of peace officer license data. The data that may be maintained include the name of

6.1 the law enforcement agency conducting the investigation and data on the candidate provided

6.2 under section 626.87, subdivision 5, clauses (1) and (2).

6.3 Sec. 6. [626.8460] TRAINING IN CRISES RESPONSE, CONFLICT

6.4 MANAGEMENT, AND CULTURAL DIVERSITY.

6.5 Subdivision 1. In-service training required. Beginning July 1, 2018, the chief law

6.6 enforcement officer of every state and local law enforcement agency shall provide in-service

6.7 training in crisis intervention and mental illness crises; conflict management and mediation;

6.8 and recognizing and valuing community diversity and cultural differences to every peace

6.9 officer and part-time peace officer employed by the agency. The training shall comply with

6.10 learning objectives developed and approved by the board and shall meet board requirements

6.11 for board approved continuing education credit. The training shall consist of at least 16

6.12 continuing education credits within an officer's three-year licensing cycle. Each peace officer

6.13 with a license renewal date after June 30, 2018, is not required to complete this training

6.14 until the officer's next full three-year licensing cycle.

6.15 Subd. 2. Record-keeping required. The head of every local and state law enforcement

6.16 agency shall maintain written records of the agency's compliance with the requirements of

6.17 subdivision 1. The documentation is subject to periodic review by the board, and shall be

6.18 made available to the board at its request.

6.19 Subd. 3. Licensing sanctions; injunctive relief. The board may impose licensing

6.20 sanctions and seek injunctive relief under section 214.11 for failure to comply with the

6.21 requirements of this section.

6.22 Sec. 7. APPROPRIATION; PEACE OFFICER TRAINING REIMBURSEMENT

6.23 GRANTS.

6.24 $10,000,000 each year is appropriated from the general fund to the Peace Officer

6.25 Standards and Training Board for peace officer training reimbursement to local governments.

6.26 This is an ongoing appropriation that is part of the base budget.

6.27 Sec. 8. APPROPRIATION; PATHWAY TO POLICING REIMBURSEMENT

6.28 GRANTS.

6.29 $1,000,000 each year is appropriated from the general fund to the commissioner of

6.30 public safety for reimbursement grants to local units of government that operate pathway

6.31 to policing programs intended to bring persons with nontraditional backgrounds into law

6.32 enforcement. Applicants for reimbursement grants may receive up to 50 percent of the cost

Preliminary proposal to improve the use of data to inform decisions about policing in Minnesota

The problem: Across the U.S. and here in Minnesota, there is increased public attention on policing and police-community relations, particularly within urban communities of color. While community members call for increased police transparency and responsiveness, police departments recognize the need for better data to manage operations, train officers, and achieve better outcomes. Recently, local jurisdictions began tracking basic demographics of those involved in traffic stops1, and some now employ early intervention and peer intervention systems designed to identify and eliminate behaviors predictive of biased policing2. However, data is not collected in a standardized way, resulting in inability to compare across jurisdictions, and perceived lack of transparency and responsiveness to community persists.

The needs:

1. More consistent, accurate, current, and relevant data on all police jurisdictions in Minnesota 2. More consistent, accurate, current, and relevant data on police officers in Minnesota at a jurisdiction-level, to

include background, training, performance, critical incidents / complaints, and discipline3 3. Increased capacity and better tools to use these data for decision-making regarding public policy, department-

wide management, and officer-level supervision, training, and performance improvement

Potential response: Wilder Research is interested in bringing together community, police, and other relevant stakeholders to address these needs, and will consider all relevant suggestions. Initial potential responses include:

1. Enhance available data. a. Wilder Research could build off our experience with Minnesota Compass (mncompass.org), convening a

diverse advisory group to help identify a set of “key measures” relating to policing / police-community relations, and then display these data through a website with accessible and interactive graphs and charts. The site would likely include existing data, but could also feature newly created data gathering systems or processes. This would allow police departments, community members and policy-makers to easily access information about policing in communities throughout Minnesota.

b. Wilder Research could develop a standardized data tracking system, allowing multiple jurisdictions to report their data, retrieve necessary reports, and benchmark against similar jurisdictions. Wilder Research would work carefully with community and police stakeholders to ensure appropriate data dissemination mechanisms.

2. Put this data to good use. a. Wilder Research could consult with police departments, using their data profiles to conduct needs

assessments and make appropriate recommendations to drive improvements in police effectiveness, efficiency, training, supervision, procedural justice, accountability, and community relations. With this sound base of information, police departments will be able to more effectively manage their risks and improve transparency, while community members and advocates, as well as policy-makers, decision-makers, and funders will have access to accurate, relevant information to help us all improve policing practices in Minnesota.

b. Wilder Research could consult with Police Community Oversight Boards and other advocacy groups to assist them in using data for community advocacy and transparency.

Ultimate goals: We hope this project will contribute to…

1. A reduction in the use of excessive force by police officers and increased accountability for those who do use force. Similarly, we hope this work would result in increased constitutionality of policing practices, specifically a reduction in unconstitutional search and seizure.

2. An increase in equity in police interactions with individuals based on their race/ethnicity, income, area of residence, etc. and a reduction in racial bias in policing. (This will also involve identifying definitions of “equity” and “racial bias” that most stakeholders can agree to.)

3. An increase in the use of best practices in hiring, supervision, training, performance management, and accountability among police officers and supervisors individually and for departments as a whole.

4. An increase in access to and use of data to inform decisions about policing in Minnesota.

Next steps: We are in the process of reviewing literature and identifying sources of existing data on policing in Minnesota.

We are also refining our ideas through discussions with key stakeholders who represent multiple perspectives on this issue in Minnesota. Our immediate next step is to continue meeting individually and in small groups with interested law enforcement representatives as well as various community advocacy groups and other interested stakeholders. During these conversations, we will seek feedback to refine our vision and plan for if and how to obtain and make available data on policing, as well as, importantly, WHAT data should be collected, compiled, and/or reported. We hope to have many of these initial conversations completed in early 2017.

We may also involve the Minnesota Compass (mncompass.org) Public Safety Technical Advisory Group, which will convene in 2017, to determine if and how this initiative may be related to the Compass work and platform.

Last, we will pursue any and all funding opportunities including through the MN Legislature, an appropriation from the Governor, a special project through a state or local agency, and/or private funders. Ideas (or donations) are welcome!

Dear Colleague, Yesterday I informed my Board that I would be retiring on June 1. Much thought went into this decision but I know it is right for me and for the association. This notice allows me to remain for the legislative session as well as to assist in the selection of my successor and help in their transition. It has been said that a person must know “when it is time” and it is that time. I have had a 39 year run with the MPPOA as a member, board member and its leader. It has also been said "Respect the journey, but know when to let go". I have had an unwavering commitment to the association and its membership and it won’t end because I’m no longer in its employ. My greatest honor has been to be an advocate for the working cop. I am very proud of what has been accomplished, both for my members and the association, and I leave an organization that is on solid foundation with a sterling reputation and a very bright future. A search committee from the Board of Directors has been appointed and an executive search professional has been hired to aid in the selection of my replacement.
