On March 29, 2011, pursuant to the authority granted by Section
91,103 of the Los Angeles Municipal Code, the Department of
Building and Safety (the “Department”) investigated and identified
code violations at: 611 North Western Avenue, Los Angeles,
California (the “Property”). A copy of the title report which
includes a full legal description of the property is attached as
Exhibit A.
Pursuant to Section 98.0421, the property owner was issued an
order on March 29, 2011, to pay a code violation inspection fee
after violations were identified and verified upon inspection. The
code violation inspection fees imposed by the Department are as
follows:

Pursuant to the authority granted by Section 7.35.3 of the Los
Angeles Administrative Code, it is proposed a lien for a total sum
of $1,957.92 recorded against the property. It is requested that
the Honorable City Council of the City of Los Angeles (the “City
Council”) designate the time and place protest can be heard
concerning this matter, as set forth in Sections 7.35.3 and 7.35.5
of the Los Angeles Administrative Code.
It is further requested that the City Council instruct the
Department to deposit to Dept 08, Fund 48R, Balance Sheet Account
2200, any payment received against this lien in the amount of
$1,957.92 on the referenced property. A copy of the title report
which includes a full legal description of the property is attached
as Exhibit A. A list of all the names and addresses of owners and
all interested parties entitled to notice is included (Exhibit B).
Also attached is a report which includes the current fair market
value of the property including all encumbrances of record on the
property' as of the date of the report (Exhibit C).

(2) use, operate or manage the Property; and (3) collect the Rents

Duty to Maintain, Trustor shall maintain the Property in
tenantable condition and promptly perform all repairs,
replacements, and maintenance necessary to preserve its value.
Compliance With Environmental Laws. Trustor represents and
warrants to Lender that; (1) During the period of Trustor's
ownership of the Property, there ha3 been no use, generation,
manufacture, storage, treatment, disposal, release or threatened
release of any Hazardous Substance by any person on, under, about
or from the Property; (2) Trustor has no knowledge of, or reason to
believe that there has been, except as previously disclosed to end
acknowledged by Lender In writing, (a) any breach or violation of
any Environmental Laws, |b| any use, generation, manufacture,
storage, treatment, disposal, release or threatened release of ary
Hazardous Substance on, under, about or from the Property by any
prior owners or occupants of the Property, or (c) any actual or

Default. The word "Default" means the Default set forth hi this
Oeed of Trust In the section titled "Default”.
Environmental Laws. Tha words ■Environmental Laws" mean any and
ail state, federal and local statutes, regulations and ordinances
relating to the protection of humen health or tha environment,
including without limitation the Comprehensive Environmental
Response, Compensation, and Liability Act of 1980, as emended, 42
U.S.C. Section 9601, at aeq. CCERCLA"), the Suparfund Amendments
and Resuthoriiation Act of 1986, Pub. L. No. 99-499 ("SARA"), the
Hazardous Materials Transportation Act, 49 U.S.C. Section 1801, et
SBq., the Resource Conservation and Recovery Act, 42 U.S.C, Section

California Health end Safety Code, Section 25100, et seq., or other
applicable atBta or federal laws, rules, or regulations adopted

Event of Default, The words "Event of Default" mean any of the
events of default set forth In this Deed of Trust In the events of
default section of this Deed of Trust.
Guarantor. The word "Guarantor” means any guarantor, surety, or
accommodation party of any or all of the Indebtedness.
Guaranty. The word ’Guaranty" means the guaranty from Guarantor
to Lender, Including without limitation a guaranty o( all or part
of the Note.
Hazardous Substances. The words "Hazardous Substances” mean
materials that, because of their quantity, concentration or
physical, chemical or infectious characteristics, may cause or pose
a present or potential hazard to human health or the environment
when improperly used, treated, stored, disposed of, generated,
manufactured, transported or otherwise handled. The words
"Hazardous Substances' are used In their very broadest sense end
include without limitation any and all hazardous or toxic
substances, materials or waste as defined by or listed under the
Environmental Laws. The term 'Hazardous Substances" also includes,

Hazardous Substances. The words “Hazardous Substances" mean

NON-COMPLIANCE FEE WARNING:
In addition to the C.V.I.F. noted above, a proposed
noncompliance fee in the amount of S550.00 may be imposed for
failure to comply with the order within 15 days after the
compliance date specified in the order or unless an appeal or
request for slight modification is filed within 15 days of the
compliance date.If an appeal or request for slight modification is
not filed within 15 days of the compliance date or extensions
granted therefrom, the
determination of the department to impose and collect a

PENALTY WARNING:
Any person who violates or causes or permits another person to
violate any provision of the Los Angeles Municipal Code (L.A.M.C.)
is guilty of a misdemeanor which is punishable by a fine of not
more than $1000.00 and/or six (6) months imprisonment for each
violation. Section 11.00 (m) L.A.M.C.
APPEAL PROCEDURES:
There is an appeal procedure established in this city whereby
the Department of Building and Safety and the Board of Building and
Safety Commissioners have the authority to hear and determine err
or abuse of discretion, or requests for slight modification of the
requirements contained in this order when appropriate fees have
been paid. Section 98.0403.1 and 98.0403.2 L.A.M.C.
