BOARD OF DIRECTORS

North Kern Water Storage District Minutes of the Meeting of June 18, 2019

A Meeting of the Board of Directors of North Kern Water Storage District was held at the District Office, 33380 Cawelo Avenue starting at 7:00 a.m., on June 18, 2019. President Andrew declared a quorum was present and called the meeting to order. The following Directors were present: Kevin Andrew, Winn Glende and Mike Mendes. Others present: Richard Diamond (General Manager), Ram Venkatesan (District Engineer), Marinelle Duarosan (Controller), Heather Williams (Hydrographer), Christy Castaneda (Administrative Assistant) and Erica Celedon (Accounting Clerk) of North Kern Water Storage District, Allan Doud (District Counsel), Ron Eid and Larry Rodriguez (GEI – Consulting Engineers). Guests included Todd Turley (Agreserves), Dana Munn (Watermaster), Preston Britain (Pacific Resources) and Josh Camarena (Full Circle Farming). Absent from today’s meeting were Carole Fornoff and Joel Ackerknecht.

President Andrew called the meeting to order at 7:04 a.m. and opened the floor for public comments, at this time there were none. (19-72) Upon motion of Director Glende, seconded by Director Mendes and unanimously

carried, to approve the minutes from the May 21, 2019 Regular Board meeting. (Ayes: Andrew, Mendes & Glende, Noes: None, Absent: Ackerknecht & Fornoff, Abstain: None)

(19-73) Upon motion of Director Glende, seconded by Director Mendes and unanimously

carried, to approve the minutes from the June 13, 2019 Special Board meeting. (Ayes: Andrew, Mendes & Glende, Noes: None, Absent: Ackerknecht & Fornoff, Abstain: None)

Watermaster – Mr. Munn reported that the Isabella remediation Phase II project construction and

blasting continues.

The Corps of Engineers is coordinating small tours of the Isabella project. These tours are going to take place approximately once a month. The Contract for conservation storage in Lake Isabella is with the Bureau of Reclamation (USBR) not the Corp of Engineers. The USBR has the signed contracts and resolutions. North Kern and Buena Vista WSD legal counsel are preparing the validation actions pleadings and CEQA documentation.

The current B120 median forecast predicts 197% April – July runoff. Mr. Munn stated that for this time of year this a substantial change (increase) compared to the May 1st 170% B-120 forecast.

Kern River Watershed Coalition Authority – General Manager Diamond stated there was no update at this time.

Kern Groundwater Authority – President Andrew stated that the Authority continues to work

with the Kern County Water Agency to capture all white lands. Larry Rodriguez stated they were working on finishing up the Coordination Agreement.

Operations Report – O&M Superintendent Rizo reported on District operations stating that the District’s share of Isabella storage is estimated at 72,000 AF. Kern River natural inflow and outflow are averaging 6,100 cfs and 5,100 cfs, respectively. The District Kern River demand is 1,025 cfs.

CRC produced water of 14 cfs has been diverted to the 9-2 spreading pond in

anticipation of a possible spreading operation to Poso Creek. Califia Farms continues to pump into the Lerdo Canal.

Financial Matters –

(19-74) Upon motion of Director Mendes, seconded by Director Glende and unanimously carried, to receive and file the Treasurer’s Report for the North Kern Water Storage District for the month of May as printed.

(RR19-75) Upon motion of Director Mendes, seconded by Director Glende and unanimously

carried, to receive and file the Treasurer’s Report for the Rosedale Ranch Improvement District for the month of May as printed.

(Ayes: Andrew, Mendes & Glende, Noes: None, Absent: Ackerknecht & Fornoff, Abstain: None)

The Financial Statement, Summary of Water Sales, Deposits and the Accounts Receivable report

for the month of May were reviewed and accepted as printed. (19-76) Upon motion of Director Mendes, seconded by Director Glende and unanimously

carried, to approve for payment the Accounts Payable for the North Kern Water Storage District for the month of May as printed.

(RR19-77) Upon motion of Director Mendes, seconded by Director Glende and unanimously

carried, to approve for payment the Accounts Payable for the Rosedale Ranch Improvement District for the month of May as printed.

Consulting District Engineer – Consulting District Engineer Ron Eid reported:

A. High-Speed Rail Authority: Mr. Eid mentioned GEI continues working on an amendment with California Rail Builders to increase the reimbursable amount going forward. Further discussion will take place later on the agenda.

B. Poso Creek RWMG: Mr. Eid stated there was no public meeting this month.

Work on the Plan update continues. They are coordinating with group members on projects that can be potentially submitted for Prop 1 funding when it becomes available.

C. Grants for Projects:

GEI has prepared two grant proposals to the Bureau of Reclamation. Both were due in March. These grants involve additional canal lining of the Calloway Canal, deep well instrumentation and drilling, and equipping three new wells and connecting those and other existing wells to the Friant-Kern Canal.

The District was awarded an amount of $750,000 for construction of replacement wells and additional well connections to the Friant–Kern Canal. Environmental work has been moving forward and archeological surveys are also completed to support this award. The Bureau is currently working on drafting a contract for this award.

We also previously received notice that the District was awarded an amount of $75,000 to fund the SCADA software and Land IQ ET improvements. The Bureau is currently working on drafting a contract for this award.

D. Water Delivery Improvements: Calloway Canal Lining portion and Well Instrumentation is completed. GEI continues to provide support to ProUsys to purchase and install equipment. The RFP Draft bids were open at the end of May. Further discussion will take place later on the agenda.

carried, to approve the First amendment to Utility Agreement 1.0 with California Rail Builders for the High Speed Rail CP-4 Project.

(19-80) Upon motion of Director Mendes, seconded by Director Glende and unanimously

carried, to approve Task Order with GEI Consultants for Engineering Support for the High Speed Rail CP-4 Project not to exceed $80,000. (Ayes: Andrew, Mendes & Glende, Noes: None, Absent: Ackerknecht & Fornoff, Abstain: None)

(19-81) Upon motion of Director Mendes, seconded by Director Glende and unanimously

carried, to Authorize the General Manager to reject the Bid from A-C Electric Company and direct staff to rebid the Water Delivery Improvement project. (Ayes: Andrew, Mendes & Glende, Noes: None, Absent: Ackerknecht & Fornoff, Abstain: None)

(19-82) Upon motion of Director Glende, seconded by Director Mendes and unanimously

carried, to approve waiving Competitive Bidding Requirements for an emergency Project at the Calloway-CVC BNSF Railroad Crossing Location. (Ayes: Andrew, Mendes & Glende, Noes: None, Absent: Ackerknecht & Fornoff, Abstain: None)

(19-83) Upon motion of Director Mendes, seconded by Director Glende and unanimously

carried, to approve the automated demand response program agreement with Polaris Energy Services. (Ayes: Andrew, Mendes & Glende, Noes: None, Absent: Ackerknecht & Fornoff, Abstain: None)

Groundwater Ad Hoc Committee – (19-84) Upon motion of Director Glende, seconded by Director Mendes and unanimously

carried, to approve the documents with respect to Management of White Areas for the Sustainable Groundwater Management Act (SGMA). (Ayes: Andrew, Mendes & Glende, Noes: None, Absent: Ackerknecht & Fornoff, Abstain: None)

1. Adopt the SGMA Management Agreement and authorize management to and staff to identify owners of White Land in the vicinity of North Kern and work with the owners of these Lands to enter into this agreement.

2. Authorize execution of the SGMA Jurisdiction Agreement between the Kern Groundwater Management Authority and North Kern.

3. Authorize execution of the Kern Groundwater Authority for the Tulare Lake Basin Portions of Kern County Second Amended and Restated Joint Powers Agreement.

carried, to authorize the Committee to approve the Task Order with GEI Consultants for Rosedale Ranch Improvement District Management Area Plan Development and a letter of agreement from Shafter Wasco Irrigation District that confirms their understanding. (Ayes: Andrew, Mendes & Glende, Noes: None, Absent: Ackerknecht & Fornoff, Abstain: None)

*The District is waiting for a memo from Bob Hartnack on the Miller-Haggin group work. Produced Water Ad Hoc Committee – No Report at this Time Negotiating Committee – (19-86) Upon motion of Director Mendes, seconded by Director Glende and unanimously

carried, to approve an agreement with Kern County Water Agency for Lake Isabella Dam Safety Remediation project repayment subject to non-substantive changes approved by District counsel. (Ayes: Andrew, Mendes & Glende, Noes: None, Absent: Ackerknecht & Fornoff, Abstain: None)

The above legal grounds were determined to exist based on advice of counsel, and discussion of such matters in an Open Session would cause prejudice to the District. The Board went into Closed Session at 8:37 a.m. The Board reconvened back into open session at 9:30 a.m. and it was noted no reportable actions were taken in closed session. A Special Meeting of the Board of Directors of North Kern Water Storage District was held at the District Office, 33380 Cawelo Avenue starting at 12:00 p.m., on July 11, 2019. President Andrew declared a quorum was present and called the meeting to order. The following Directors were present: Kevin Andrew, Winn Glende, Mike Mendes, Joel Ackerknecht and Carole Fornoff. Others present: Richard Diamond (General Manager), Marinelle Duarosan (Controller), Scott Kuney (District Counsel) Ron Eid (GEI – Consulting Engineers). RESOLUTION NO. 2019-XX RESOLUTION OF THE BOARD OF DIRECTORS OF NORTH KERN WATER STORAGE

DISTRICT COMMENDING FERNANDO RIZO FOR HIS DEDICATION AND LOYAL SERVICE TO THE DISTRICT AND THE KERN RIVER

WHEREAS, Fernando Rizo started his career in the water industry (and on the Kern River) in 1977

when he joined the Kern Delta Water District as a Canal Tender and learned to “run water” through Kern Delta’s canal system to meet the needs of farmers in the District. As a Canal Tender Fernando always strived to stay above the “Barlow line”; and

WHEREAS, Fernando grew professionally at Kern Delta and took his field expertise into the office as a Hydrographer and learned how the Kern River “worked”/how flows were allocated each day pursuant to the water right priority structure and associated agreements dating back to the 1888 Miller-Haggin Agreement (a foundational document with respect to California Water Law); and

WHEREAS, from his mentor Ed Joiner and other “old timers”, in his Hydrographic role Fernando learned the critical importance of having accurate records of water diversions and use and the timely reporting of these records to “Central Records”. Throughout his Hydrographic career Fernando demonstrated an extraordinary commitment to the integrity of Kern River records and prioritized the transmittal of records over weekends, holidays and vacations; and

WHEREAS, Fernando brought his significant Kern River experience to North Kern when he was hired in 2005 as the District’s Hydrographer; and

WHEREAS, in addition to continuing his exemplary work managing and tracking the Kern River to ensure that North Kern received it’s full entitlement of River water supplies, during his fourteen years with the District Fernando embraced many additional responsibilities: many of the District’s personnel functions (“no one ever got fired for showing up early”); management of the District’s property, vehicles and equipment; billing for water deliveries, sales and annual District assessments; regular interaction with Central Records and District landowners/customers; and management and oversight of District operations and maintenance functions - without exception, Fernando performed the duties associated with the above functions with a high degree of proficiency; and

WHEREAS, Fernando was a pioneer in the evolution of canal water flow measuring tools, from using the classic Ott #2 meter to the computerized “River Cat”; and

WHEREAS, to support the Kern River, Fernando was a loyal attendee at the annual California Cooperative Snow Surveys Conference and we hereby grant him the distinguished Kern River "Snow Flake" award; and

WHEREAS, Fernando’s willingness to embrace change (as demonstrated above) and do whatever was asked of him confirm his unwavering commitment and dedication to the District and the River - the totality of Fernando’s work on behalf of the District and River is highly commended; and

WHEREAS, Fernando retires as a key member of the District’s management team.

NOW, THEREFORE, BE IT RESOLVED, the Board of Directors of the North Kern Water Storage District heartily commends Fernando Rizo for his long and loyal service to both the District and the Kern River. Fernando’s outstanding service to the District stands as an example to all employees. On this occasion, the Board extends its best wishes to Fernando in his retirement: “may the road be smooth and long and may you always stay on two, three, or four wheels”.

Operations

1. Lake Isabella storage levels are estimated at 336,000 AF. The District’s share of storage is estimated to be 72,000 AF. The Natural Inflow is averaging 2,800 CFS and the Regulated Outflow is averaging 3,400 CFS. The District’s Kern River demand is 785 CFS.

2. The District is continuing to receive Extension Contract water from the City of Bakersfield in the amount of 215 CFS per day. This water is being delivered at the Head of the Pioneer Canal and the Head of the Calloway Canal. 20,000AF of Extension water will be fully delivered by the end of July. Friant deliveries remain at zero.

3. District spreading averages 350 CFS daily. Private land spreading also continues within the RRID totaling 12 CFS. Additional spreading includes Wonderful 21 CFS, Neufeld 2 CFS, Paul Farms 10 CFS and the Suburban lands, off of the CT-1, totaling 15 CFS.

4. The 14 CFS flow of CRC produced water continues to be diverted to the 9-2 spreading pond. Califia continues with their 1 CFS into the Lerdo.

of the Water Delivery Improvements Project RECOMMENDED MOTION: “Authorize the General Manager to execute Task Order 19-09 with GEI Consultants to continue to provide bid phase, and grant administration support for Phase II of the Water Delivery Improvements project for a budget amount not-to-exceed $25,000.” DISCUSSION: GEI Consultants (“GEI”) provides bid phase and grant administration support for the Calloway Lining and Water Delivery Improvements Project. GEI was providing the necessary support based on previously approved Task Order 18-15 ($50,000). Since the budget authorized on the prior task order has been exhausted (primarily due to the work related to rebidding the Water Delivery Improvements Project), staff requested GEI provide a new task order (Exhibit “A”) to replenish the budget so they can continue to provide the necessary support. Staff recommends Board approval for the General Manager to execute Task Order 19-09 with GEI Consultants to continue to provide bid phase, and grant administration support for Phase II of the Water Delivery Improvements project for a budget amount not-to-exceed $25,000. Task Order No. 19-09 Grant Implementation Services add-on to Grant Implementation Services for State and Federal funding of Calloway Canal Lining and Water Delivery

Improvements

This Task Order defines a Scope of Services, Schedule, and Budget for work to be completed by GEI Consultants, Inc. for North Kern Water Storage District (North Kern) per the terms and conditions of the Professional Services Agreement dated November 16, 2017. This request is for an add-on budget and scope to the existing Project for GEI Grant Implementation Services for the Calloway Canal Lining and the Water Delivery Improvements (WDI). The work is in support of North Kern’s three grant agreements with the US Bureau of Reclamation (Reclamation) and one with the CA Department of Water Resources (DWR) for the Calloway Canal Lining and WDI that includes 5,544 linear feet of concrete lining of the Calloway Canal and implementing Water Delivery Improvements throughout the District. This modification is to cover expenses through the second bid-phase and construction administration for Phase II of the WDI portion of the project and grant administration and reporting of all four grants listed above through the fall 2019 reporting. SCOPE OF SERVICES The scope of work covered by this Task Order is for GEI to provide construction administration services for the second bid-phase and construction administration of NK WDI portion of the Project and for GEI to provide grant administration and reporting services for all four grant agreements listed above.

Task 1 Administration/Reporting ($10,000) – This consists of administrative responsibilities for effective execution and coordination of the Projects in compliance with grant requirements. Reporting will include preparation of invoices and progress reports as specified by each funding source into the fall of 2019 as the District completes modifications to the federal and state agreements with the WDI component.

Task 7 – Bid Phase and Contract Administration ($15,000) – Develop and administer second bid-phase for WDI component and assist in administering the contract, if awarded. GEI is to assist the District in advertising for bids, awarding contract, and documenting communication throughout the contract for WDI component. The activities can generally be categorized as bid-phase and contract administration, where the latter includes many tasks, if a contract is awarded, such as the Notice to Proceed, a pre-contract meeting, correspondence with the Contractor, submittal review, progress payments, periodic meetings with the Contractor, Contract Change Orders, etc. GEI will assist District in fulfilling this task as needed to prepare the second bid-phase and will support the construction administration if a contract is awarded on the WDI components.

SCHEDULE

GEI is working with the District to develop a revised schedule for a second bid-phase for the WDI component. With this add-on, GEI will continue to support the funded project through the fall of 2019 as the District works through the WDI contracting.

BUDGET

The add-on budget to GEI Project No. 1610902 for this Task Order is $25,000. Billing for all work completed under this Task Order will be in accordance with the terms of the Professional Services Agreement and expenses billed at cost. The cost is to be tracked using task number under an existing GEI project number. The total budget amount shall not be exceeded without written authorization from the District.

AUTHORIZATION This Task Order is authorized as an add-on budget to an existing GEI project as an attachment to the above-identified Professional Services Agreement through the signatures below.

The District will be applying for a grant of $1,500,000 and if successful these funds can be used as a cost match for the Reclamation grant ($1,500,000) that was applied for in March 2019 (results expected in July/Aug). The District will be submitting this project as a component of the Poso Creek IRWM Regional Water Management Group’s applications to DWR. The grant applications are due in August 2019. and Project Development for Prop 1 DWR Application Project

This Task Order defines a Scope of Services, Schedule, and Budget for work to be completed by GEI Consultants, Inc. for North Kern Water Storage District (NKWSD) per the terms and conditions of the Professional Services Agreement dated November 16, 2017, except as amended herein. This Task Order is to complete a Preliminary Engineering Report (PER) and provide Project Development in support of DWR’s IRWM Grant funding and drought planning for the Calloway Canal Lining and Water Delivery Improvement (WDI) Project. NKWSD is to submit this Project as a $1,500,000 state grant component of the Poso Creek IRWM RWMG application to the CA Department of Water Resources, Prop 1 IRWM Imp Grant Proposal. In March 2019, NKWSD submitted this Project to one of Reclamation’s grant funding programs for Fiscal Year 2019. Reclamation will consider the Project for up to $1,500,000 in grant funding, however, results of the application may not be known until into July. If not funded in 2019, the Project can re-apply in 2020 for federal funds to match the potential State IRWM funding. All funding agreements with the Federal and State programs have a required minimal 50-percent cost match, with federal funding allowed to match with state and local funds. For the federal and state funding programs, the District will have until about 12/31/21 or 12/31/22 to complete this Project. SCOPE OF SERVICES The scope of this Task Order is to support the definition and Project development for the submittal of the DWR grant application and drought planning by completing a Preliminary Engineering Report (PER) and supporting the development of the Project. funding agreements. The PER will define the status of various components needed to define and develop the Project, such as, project description and footprint to be used in environmental documentation and permitting, basis of design, cost estimates, benefits, feasibility, scheduling of work, and contractual construction components.

SCHEDULE GEI will begin the PER and Project Development following the District’s approval. The PER is needed to support the DWR application that is due in early September 2019. Recently, NKWSD has submitted this Project components to a Federal funding program for 2019. Reclamation may announce funding recommendations in July, however, if not funded in 2019, NKWSD can re-submit to Reclamation’s 2020 funding programs.

BUDGET The budget estimate for this Task Order is not to exceed $25,000. The cost to complete the PER and Project Development are the priority for support of the DWR application due in September 2019. The anticipation is the PER will not require all this budget right away, remaining unused budget will be available later in 2019 to support the Project development for drought planning. In addition to support of the DWR application, the expenses on each District’s Project development will be considered for local match to the Poso Creek IRWM’s Drought Funding. Billing for all work completed under this Task Order will be in accordance with the terms of the Professional Services Agreement and expenses billed at cost. The cost is to be tracked using a GEI project number. The total budget amount shall not be exceeded without written authorization from the District.

This Task Order is authorized as a GEI project and made an attachment to the above-identified Professional Services Agreement through the signatures below.

Sustainable Groundwater Management Act (SGMA) Status Update

July 2019

Kern Groundwater Authority (KGA) KGA continues to work through various “Umbrella GSP” tasks, continues to provide the lead on addressing the management of remaining “white areas”, on water budget development and coordination with other GSAs. Also see attached KGA Memorandum – Accomplishments and Forward Work Plan (June 26, 2019)(Exhibit “A”).

Groundwater Sustainability Plan (GSP) (must be submitted to State by January 31, 2020)

1. Preparation of North Kern GSP: North Kern is working with Shafter-Wasco ID on the preparation of a joint “Chapter” GSP under KGA. GEI Consultants is under contract for this effort and recently provided a nearly complete administrative draft of the Chapter GSP to the North Kern Board for review - this draft was reviewed with the Board on July 11th.

2. Rosedale Ranch Improvement District (RRID): Based on discussions with the Board on June 13th, GEI is separating RRID as a distinct “management area” in the North Kern-SWID GSP.

Communications 1. Landowner Advisory Committee: Based on Board review of the administrative draft GSP on July 11th, the

next Committee meeting will be scheduled for the week of July 22nd.

Kern River Miller-Haggin Groundwater Group

1. Certain Kern River interests are working collaboratively on developing additional information to assist their implementation of SGMA. A summary of the work efforts of this group will be reviewed with the Board in closed session on July 16th.
