NFPE CIRCULARDear Comrades,
We wish to share the developments in many
fronts with you through this circular. Our Circle
Secretaries are requested to kindly circulate this to
all their divisional and branch secretaries. It is a very
crucial time on several fronts as detailed below and
the NFPE is confident that our Circles and Branches
would rise upto the occasion to face the task at hand.
1.Pay Commission: The VI CPC has completed its
task and expected to submit its recommendations any
time to the Government. The extended National
Executive of the Confederation of Central Government
Employees is scheduled to meet in Mumbai City on
2nd and 3rd March 2008 to chalk out our strategy if
the recommendations are not satisfactory in general
but on the questions of Minimum Wage, Date of Effect,
DA Formula, Pension and Health Care in particular. It
has already been decided in the earlier National
Executive that any negative position on the above would
have to be met by our violent reactions. The Secretary
General NFPE, General Secretaries and Comrade
C.C.Pillai Working President Confederation would be
attending the Executive.
2. NFPE State Conventions: The State level
Conventions, which was in reality a joint Circle Council
meeting of the Circle Unions had been successfully
held in Andhra, Kerala and Karnataka Circles. The
enthusiasm generated was enormous. There was a
first hand interaction between the General Secretaries
and the Secretary General on one side and the rank
and file leadership on the other. Now the following shall
be the date of such Conventions in the Circles noted
against each. Our Circle Secretaries are requested to
organise them with full force by issuing notice to hold
respective Circle Council availing one-day special
casual leave for the meeting. The Circle Coordinating
Committees of Postal Unions consisting of circle
secretaries and circle presidents would be constituted
and the new President, Convener and Treasurer of the
Circle C-O-C of Postal Unions would be announced in
the Convention. These Conventions would go a long
way in trimming our organisational functioning and
National Federation of Postal Employees1ST Floor, North Avenue Post Office Building, New Delhi - 110001
therefore the role of Circle Secretaries is very important.
NFPE is confident that these Circle Conventions also
would be equally successful as like Andhra, Kerala
and Karnataka. Change of dates for other circles would
soon be intimated.

3.Postal JCA: The All India Postal JCA has already
submitted the Postal Sectional Charter of Demands
to Secretary [P] on 15.02.2008. We are confident that
in Circle / Regional / Divisional level also the same
charter of demands would have been submitted by
holding demonstrations. Now the second phase of JCA
Programme viz., Post Card Campaign to Honourable
MOC and Secretary [P] is on. All are requested to
galvanize the movement by holding powerful
demonstrations through out the country in front of all
major work spots and organise successful post card
campaign. It should generate sufficient pressure on
the Postal Directorate to settle our issues well in time
as otherwise an Indefinite Strike would become
inevitable.
4.Membership Verification: The Orders for reverification
of membership of Unions under CCS [RSA] Rules 1993
is under issue. The entire leadership at all levels has
our due role to play in ensuring our dominant position
amongst our different unions. Innovative programmes
have to be initiated at branch level to attract new
membership into our fold. They can organise door to
door visits of new members; cycle or two wheeler
yatras; supply of pamphlets on NFPTE/NFPE's
sacrifices and history; an announcement for
rededication to work for protecting the interests of
membership etc would help in the task. Every branch
union should have a minimum target to enroll new and
additional membership to increase the overall
percentage of our affiliated unions at all India level. No
branch union should fail in this task of enrolling new
members. The task is urgent and most important.
5.Meetings with Secretary [P]: Two meetings with the
Secretary [P] were held recently in which General
Secretaries and the Secretary General discussed
many urgent issues. On the question of posting FTP
LSG officials compulsorily in delivery offices as SPMs

the Secretary told that he had already instructed tomodify that order to leave the officials who did notcomplete tenure undisturbed. On the issue of promotionto qualified JAOs, he assured that while the cadremerger is an issue between two departments thepromotional interests of the JAO qualified would beprotected. The Secretary [P] was requested toexpedite recognition of Federations also and heassured that this will be processed at the earliest.6. R-IV CWC: The Central Working Committee of R4Union was held at Bhusawal [Maharashtra] from 20thto 22nd February 2008. The CWC is organised at avery important time of ensuing verification ofmembership. The CWC has resolved to strive to reachmaximum membership in this union. ComradeD.K.Rahate [NFPE President]; Com. K.Ragavendran[Secretary General] and Com. Giriraj Singh [GeneralSecretary R3]; Com.K.K.Sharma [Vice PresidentNFPE]; and P.Suresh [General Secretary R4]addressed in the open session besides specialdignitaries like MLA etc. The CWC was well attendedby almost all divisional and branch secretaries of R4and many from R3 Maharashtra.7. GDS AIC: The AIC of ED Union will be held at Rewa[M.P] from 24-26 February 2008. The SecretaryGeneral NFPE, General Secretaries P3 and R4 areattending. The anti-NFPE projections of this union haveto end. It is unfortunate that the AIC Agenda is couchedin such an anti-NFPE agenda. Even though invited,
the name of the Secretary General NFPE is omittedin the posters and invitations of the AIC. Unless thistrend is discarded by the ED Union and come to respectthe requirement of recognition of NFPE by theGovernment, the required united functioning betweenthe regular and ED employees would be affected.8.NFPE Finance: Still the finances of the Federationare in critical condition. Quota to NFPE is notforthcoming from branches from many circles. This isnot healthy functioning. All should remit quota @ 0.70for PA/SA'; 0.50 for Postmen/Mailguard/Group 'D' permember per the constitution. The expected donations@ 10/- per member has also not come from manycircles. The legal expenses are still to be borne byus. The running of the federation has become verydifficult at a very crucial time of the movement, whenwe are expected to lead many battles in different fronts.Divisional and Branch Secretaries are once againrequested to take up the task as an urgent one andcomplete it in quick time.

morning due to heart attack. He left with three
daughters and one son. He is an active trade unionist

PO INSURANCE FUND TO BE SECURITISED
Banks, Fls, Corporates May Soon Get To Invest In
Post Office Papers
The government plans to freeze the existing corpus
of Post office Insurance Fund and convert the over Rs,
10,000 crore in this fund to dated securities over three
years, thus, banks, Fls, insurance companies, primary
dealers, mutual funds, provident funds & trusts and big
corporates may soon be able to invest in these securities,
as long term investments.
As first reported by ET, all future accretion to Post
Office Insurance Fund will be invested in markets as per
Irda regulations. In December 2007, the Cabinet had
approved the proposal to allow Postal Life Insurance Fund
(PO LIF) and Rural Postal Life Insurance Fund (RPOLIF)
to enter markets through investments in public sector
mutual funds. The cabinet had appointed UTI MF and SBI
MF as managers for the Postal Life insurance Fund.
At the same time, the government has decided to
follow a three-step process to ensure proper utilisation
of funds First, the funds will be given to fund managers
under passive or non-discretionary mode for investment
as per Irda (Investment) Regulation 2000. Secondly, an
Investment Board will be constituted headed by member

Council on 7.3.2008 are reproduced from the

CONFEDERATION OF CENTRAL GOVERNMENT
EMPLOYEES AND WORKERS.

Dear Comrade,
The Standing Committee of the National Council
met on 7th March, 2008. The meeting was presided over
by the Secretary, Personnel, Shri S. Misra. The meeting
discussed the left out items in the agenda of the 14th
December, 2007 meeting. In the initial remarks made by
the Staff Side, the following issues were raised.
1. The non-holding of the meeting of the National
Council and Standing periodically as per the provisions
of the constitution of the JCM and demanding the
intimation of the date for the next meeting of the National
Council.
2. Grant of revised bonus on the basis of the
enhanced ceiling limit.
3. Final view of the Government on the
implementation of the Board of Arbitration Awards.
4. The discontinuance of the practice of referring the
non arbitrable items for the further negotiation with the
Committee of Ministers;
5. Arbitrary and unilateral reference of the anomaly
committee items to the 6th Pay Commission which has
deprived the staff side to present their case before the
commission
6. Amendment to the terms of reference of the 6th Pay
Commission without any intimation to the Staff Side.
7. The delay in the grant of recognition for several
organizations that had made applications for verification
and reverification.
8. The impending strike action by the CGHS Employees
Association and the requirement of the Government's
intervention and negotiation to avert the strike.
9. The delay in taking decision in respect of the risk
allowance for the employees of the new ordnance
factories.
10. The necessity to take an immediate decision in the
matter of removing the ceiling on compassionate
appointment in the light of the detailed note submitted by
the Staff Side.
11. The reduction effected in the rates of impatient
treatment and consequent denial of hospitalization for
the CGHS beneficiaries.
The response was as under:-
(a) Meeting of the National Council will be held soon
(b) The discontent of the employees in the matter of
STANDING COMMITTEE MEETING DECISIONSdenial of enhanced bonus has been brought to the notice
of the Govt. and the same is being considered.
(c) The crux of the discussion between the official and
staff side on the implementation of the arbitration awards
have been placed before the Cabinet Secretary for taking
a final view. No further discussion with the staff side is
contemplated.
(d) The Pay Commission has assured the Govt. to
submit their report within the time schedule i.e. before
6th April, 2008
(e) Steps have been taken to expedite grant of recognition
to the Service Associations. The Staff Side will give a list
of organizations, which has completed all formalities and
awaiting recognition for the effective monitoring of the
DOPT
(f) The Chairman asked the Health Ministry to hold
discussions with the representatives of the All India
CGHS Association and if necessary with the Staff Side
with a view to avert the strike action. The reduction in the
rates were effected on the basis of the grouping of cities
which have been reviewed and city-wise rates have been
notified in respect of seventeen stations and in respect of
the rest, the notification would be issued soon. The Health
Ministry officials informed that action has been taken
against the hospital for the unfortunate death of an
beneficiary officer (who was not hospitalized and treated
for kidney failure) at Chennai. Some of the Staff Side
members will be meeting the Health Ministry officials on
10th of 11th and assurance has been held out for a
meeting with the Health Secretary very soon.
(g) The risk allowance issue concerning Defence
employees stands referred to the Department of
Expenditure. The DOE was asked to dispose of the issue
in the light of the requirement that the new ordnance factory
employees must not be denied the benefit of risk
allowance when the other are being given on the basis of
the approved 41 risk factors.
(h) The Chairman apprehended that the 6th CPC might
not take cognizance of the reference made to them on the
anomaly issues.
(i) The Chairman assured that whatever procedure
had been adopted in the past in the case of non arbitrable
items would continue to be followed.
(j) The detailed Note given by the Staff Side in the matter
of compassionate appointments is said to be under
consideration to remove the discrimination between the
Railway employees and others. . The Staff Side said that
they would furnish the number of pending applications
department wise soon.

Less than 48 hours from now, the suspense on
salary slips for nearly 40 lakh government employees
should come to an end. Budget 2008-09 is expected
to provide the first indications of whether the Sixth
Pay Commission will turn out to be a bonanza.
And if the provision for railway employees is an
indication (Rs 5,000 crore for 14 lakh em-ployees),
government employees may be in for a 20%-25% hike.
In the current fiscal, the outgo on account of pay and
allowances for the government is being estimated at
Rs 46,379 crore. However, if one factors in the arrears
and pensions with retrospective effect from January 1,
2006, the actual impact could be as high as three
times this figure, experts say.
Assuming that the Pay Commission report is
implemented by August this year (once it is submitted
in March), the government will have to account for
arrears with effect from January 1, 2006.
The pay hikes could also trigger revisions in
pay scales for other sec-tors like school teachers and
universities. The changes in pay scales of these
categories will, however, not reflect in the Budget
outlays as it would be provided through grants.
Add to this state governments' liability, which
will be about Rs 21,285 crore, roughly one and a half
times the size of central government's liability. Whilestate governments are not liable to adopt therecommendations, pressure will be on them to factorin similar increases for their employees.
"The Sixth Pay Commission will have amultiplier effect in the economy; those salaries thatare benchmarked against central government will alsoincrease. The relativities are disturbed," a seniorgovernment functionary said.
For the railways, of the Rs 5,000 crore allocated,Rs 500 crore is for pension and the remaining Rs 4,500crore for salaries, wages and other allowances. For astaff strength of 14 lakhs, therefore, the additional Rs4,500 crore expenditure amounts to an average
monthly hike of over Rs 2,000 irrespective of the variousgrades of employees and officers.
Usually, a central government employee's totalremuneration includes a basic salary, a 51% dearness
pay merged with basic and a 41% dearness allowanceof the total.
While 90% of the railways are constituted bygrades III and IV employees, a similar proportion is
true for the remaining set of central governmentemployees. For the civilian departments, the

percentage of employees in the higher grades are more,
however, this is offset by the fact that in defence,
majority of the employees are in the Group D category.
Experts feel that the figures look too low than
what was anticipated. But a few feel that the final figure
may be moderated because unlike the Fifth Pay
Commission, salaries since then have been 100%
neutralised to the Consumer Price Index (CPI).
Therefore, the increases may not be that drastic. Prior
to that, for the extent of neutralisation to the CPI was
about 75% for the lower grades.
The New Pension Scheme (NPS) is out of the
terms of reference for the Sixth Pay Commission, lest
political opposition influence defined benefit as against
the defined contribution system prescribed in the NPS.
The 40 lakhs government employees include those in
the armed forces, not taking into account the various
grades. Currently, civilian posts in the central
government are classified into four groups (A, B, C
and D) with reference to their scales of pay.
The Sixth Pay Commission was constituted in
October 2006 to recommend comprehensive changes
in salary structure of the government employees. It
and employees in the Union Territories. Besides, the
commission would examine the pay structure for Indian
audit and ac-counts department, regulatory bodies set
up by Acts in Parliament and Supreme Court
employees.

grant of Special Casual Leave admissible to Central

The government has decided to invest Postal
Department's Postal life insurance and rural postal
life insurance funds, deposited with ministry of
finance, in government bonds and securities as per
IRDA norms, according to the Economic Survey.
An investment board would decide policy
guidelines for the management of the fund whereas
and investment division manned by financial experts
would take day-to day decisions. The execution of
the decisions of the investment division would be
made by two public sector asset management
companies. The survey said a proposal to create a
special purpose vehicle for planning and execution
of commercial utilisation of vacant plots of land and
buildings is under active consideration of the
government. the SPV is proposed to be a 100%
subsidiary of DOP.
With the new initiatives such as instant money
order, railway reservations and rural banking among
others taken by DOP, the deficit of the department
has declined to Rs 1250 crore in 2006-07 from Rs
1382 crore in 2004-05. in order to order to provide a
level playing field to the department and also to
regulate the courier market, the government is also
considering appropriate amendments the Indian Post
Office Act, 1898, the survey said. The Indian postal
network is the third largest in the world with over 1.55
lakhs post offices across the country.

India Post is all set to enter into a series of
global partnerships to compete with international
money services companies (such as Western Union
and Money Gram International) and global courier
companies (such as Fedex and DHL). The postal
department is in talks with counterparts in the US
Switzerland, France, and Oman amongst others as it
plans to tap the expertise of these countries in
specialised financial services and replicate such
offerings in India. The logic: with nearly 82,000 post
offices being computerised, the strong IT base will
enable India Post to offer several additional value-added
services in addition to full-fledged banking services.
Partnerships with global majors will enable India Post
to launch these value-added services and modern ICT-
based services as done by the postal departments in
the West.
Besides, with millions of expatriate workers of
Indian origin in several countries sending huge
remittances back home, the Postal Department is also
going all out to tap this segment. More so, considering
that India Post has the largest possible network of
70,000 branches in rural India alone. For instance,
India Post has already tied up with the postal service
department of the UAE (UAE post) for speedy transfer
of money orders between the two countries. While
this facility is presently available only to a few South
Indian states, in will soon be extended to all the states
in a phased manner.
Additionally, such tie-ups will also be extended
to the postal departments of several other countries.
"We are planning to make things easier for expatriates
living across the globe. In this initiative the department
of post (DOP) would sign memorandum of
understanding (MOU) with most of the countries in
the Gulf and the European Union apart from with the
US," DOP Secretary IMG Khan told ET.
The process to get into global partnerships was
set rolling last year in November, 07. India Post has
signed a memorandum of understanding with Deutsche
Post where both organisations agreed to create a multi-
layer relationship. The MOU envisaged partnerships
in the field of conveyance and distribution of mails,
logistic and warehousing operations and financial
services. The postal department has also created a
special division to handle its global communication
businesses. " The Global Business Division of the
Postal department has been launched-they have
already started interacting with all the world leaders in
postal administration for the possible tie-ups in different
areas of operations," DOP sources added.

INDIA POST GETS READY TO TAKE ON FOREIGN COS
Post Offices are all set to turn into pharmacies
in rural India. In another attempt to offset declining
postal revenue, the department of posts has tied up
with herbal and medicinal product companies to sell
their products at post offices. Tie ups are in place in
Andhra Pradesh, Maharashtra and Uttarakhand. Talks
are on for similar alliances in other states. In the next
stage, Post Offices will stock over the-counter (OTC)
drugs that are sold without any prescriptions.
"Some companies have approached the
department to sell their herbal and medicinal products
through the post offices. the circles have made
arrangements with those companies for the sale of
their products," departments of post sources told ET.
For instance, in Andhra Pradesh, Sriram Gopalraju
Pharma has tied up to sell its products at all head
post offices in the state. Herbolab has tied up to sell
its medicines through 125 post offices in Mumbai
and Divya Pharmacy has started selling its products
at the branch post offices in Uttarakhand on a trial
basis.
The proposal to get post offices to sell
pharmaceutical products was first mooted by the
POST OFFICES TO PUSH ENVELOPE BY SELLING DRUGSOrganisation of Pharmaceutical Producers of India.
However, when contacted, a top executive in the
Pharma sector said that current regulations must be
changed to allow post offices and other retail outlets
to sell over-the-counter medicines. "These drugs are
household remedies. The proposal of amending the
regulation are still pending," the executive added.
The departmental of post's move will increase
the market size and reach. There are about 150,000
post offices, most of which are located in rural India.
Importantly, the postal department feels such
measures will also help it reduce its revenue deficit.
The postal department's revenue deficit for the fiscal
2006-07 was about Rs. 1,250 crore and is estimated
to be Rs. 1,291.34 crore this fiscal. Just last week,
the Economic Survey 07-08 had questioning the
logic of extending subsidies for India Post while
adding that the postal department was generating
only 78% of its expenditure from services.
"Redefining the rationale and the delivery
mechanism of the subsidy needs to be addressed
urgently," the Survey said.

Standing Committee on Personnel, Public Grievances,Law and Justice, after its bifurcation from Departmentrelated Parliamentary Standing Committee on HomeAffairs, included the subject 'Administrative Reforms'from its parent Committee as a part of considerationof the subject, the Committee chose to make a reporton the 'Government's Policy of Appointment onCompassionate Ground' in the first instance. TheScheme for Compassionate Appointments is a socialsecurity scheme in a welfare State like ours underwhich appointments can be made on compassionategrounds to dependent family members of a deceasedGovernment employees dying in harness or who isretired on medical grounds leaving his family in penuryand without means of livelhood. This step of theGovernment gives relief to the family of the deceasedfrom financial destination to get over the emergency.The nomenclature of the scheme itself shows that underthis scheme compassion is at the center stage. Ithas been observed that particularly in the case ofprolonged illness, the family in order to save their breadearner and beloved ones do whatever it can to savehis/her life. They not only spend their entire savingsbut also incur heavy debts. Despite their best effortsthe cruel hands of the destiny snatches their near anddear one. The only ray of hope thereafter is appointmentof a dependent on compassionate ground. Even insome accidental cases also same thing happens. TheCommittee having the nomenclature of being the PublicGrievance Committee received representations fromthe employees of different banks. PSUs andGovernment Departments on the issue ofcompassionate appointment apprising the Committeethat the guideline issued from time to time by theMinistry and DoPT were not followed properly. TheCommittee in this background, decided to examinepolicy's compliance in the public sector banks/publicsector undertakings along with GovernmentDepartments and make on the spot study of the Banks/PSUs etc.1.1 A letter in this regards was written to theSecretary, Ministry of Personnel, PG and Pensionson 10th January 2006 to furnish the background noteon the rules and guidelines followed in the cases ofappointment on compassionate grounds, procedureand mechanism of monitoring the implementationthereof in Ministries/Departments/Offices/Public sectorEnterprises etc. Where these are applicable etc. Inresponse, the Ministry furnished the details of thescheme as under :OBJECTIVECTIVEo2.0 The objective of the Scheme is to grantappointment on compassionate grounds to adependent family member of a Government servantdying in hamess or who is retired on medical grounds,

Apropos reference, it is constrained to note that
instead of set asiding the irregular officiating
arrangements made for SPM, Bathinda City (HSG I)
post with one Sri S.K. Bhardwaj who declained HSG I
promotion, the SSPOs Bathinda division has
communicated that the PMG, Punjab region has given
extension of his officiating chances for another four
months vide his letter dt. 30.01.08.
This causes a concern. When the official has
declined his HSG I promotion, as per rules, he should
not be continued to officiate in other HSG I Post.
The action of the PMG Punjab region is against
to the spirit of the Directorate guidelines and the eligible
officials are thus denied and deprived of their due
chances of officiation in higher posts.

As you know, we are facing the problem of acute
shortage of clerical staff. We are not getting sufficient

passing the exam and if passed the department is not
appointing the SC/ST candidates immediately for want
of verification for caste certificates.
The rule for verification of caste certificate before
joining promotional post is applicable to all Government
servants Central as well as State. But in Maharashtra
State the Government of Maharashtra has issued one
order on 16.11.2007 stating that the SC/ST candidate
can be appointed on promotional post pending
verification of their caste certificate. (Copy enclosed).
Kindly take similar steps in respect of
appointment of LGO's to solve the problem of shortage
in Post offices.

We are forming JCA or Coordination committees
among the Central Government employees or State
Government Employees at all levels including Central
Head Quarters and the Nodal ministry had never taken
any objection for this. There are no guidelines issued
by the department on the subject. Whereas the SPO's
has given a threatening to the office bearers as if taking
disciplinary action on employees who will take part in
coordinataion committee. He has crossed his limit and
this causes a serious concern.

where they erected construction and some parts of
our land has also been encroached while constructing
their building.
Being a Posh locality in the midst of various I.T
industries and the market value of the land is alone
crosses 70 Crores, there is every possibility of
encroachment by the land grabbers. Further, there is

developing area.

77 lakhs have not been utilised for the expansion of
the building and it is remaining in paper only.

and allot adequate funds early on priority basis for the
vertical expansion of the existing building.

Despite clear orders and instructions of the
comptroller General of Accounts, MOF vide their OM
No. 1(1)/2005/TA/42-45 dt. 24.01.06 that the
employees are free to draw salary either by cash or
through banks, the New Delhi GPO administration is
compelling the officials vide its letter dt. 19.02.2008 to
open salary account with SBI, Chandini Chowk branch
in order to receive their salary from 01.04.2008.
This causes a concern. The move is against to
the instructions of the MOF and will cause more
problems to the officials.
It is therefore requested to cause necessary
instructions to the Chief Postmaster New Delhi- GPO
not to insist the officials to open salary account in SBI
and allow them freely to avail their option.

accumulation of problems causing total resentment
amidst staff.

office, this could not be materialised due to the
indifferent and lethargic attitude of the civil wing.
The present offer made by one Doctor to house
the PO may be dropped if the delay continues resulting
several problems. At present, the HPO is functioning
in two different buildings. Even though the HO has
been declared as fully computerised, the server is not
connected by LAN due to the functioning in two
different buildings. The Public are being tossed in
between two buildings in transacting business. Except
the Civil wing, all members in the committee visited
the building and expressed their satisfaction.
It is therefore requested to cause suitable
instructions to the Circle adminstration to finalise the
building without any further delay for the betterment of
services.

lllll During my visit to Satna, M.P. Circle it has been
brought to my notice that, number of items are pending
at divisional level without any fruitful result for long time.
Some of them are given below.
1. Leakage from ceiling and side walls of Satna
HO building. Resultantly the electricity connection is
disconnected due to continuous choaking in the wall.
The position is very risky and dangerous. This should
be attended forthwith.
2. Shifting of Postal colony of Satna from present
place to City due to non availability of electricity, water
at present place and pollution due to cement factory
which is nearer to Postal colony.
3. The Satna HO building was renevated before
two Years but the modernisation of the above building
is not completed yet. The work done by the contractor
regarding electricity fitting, windows is faulty and
unsatisfactory.
4. The Satna HO is not computerised fully yet.
5. Old furniture required to be replaced with new
furnitures to Satna HO.
6. No Security arrangements is available at Satna
HO. The Armed Police guard should be provided.
7. Huge amount is lying as part of cash. As per
Directorate instructions the sanctions for pending bills
should be issued within one month but this guide lines
are not adhered by the Divisional Head.
8. The Incentive bills are pending for long period.
9. Shri Babulal cont. Night guard of Satna HO was
murdered before 25 Years but no lum-sum-grant was
given to his family and a case of relaxation for
recruitment rules of his son is still pending.
I would there fore request you kindly look in to
the matters personaly and suitable instructions may
be issued to the concerned authorities.

NFPE congratulates the new team of Office
Bearers of AIPEDEU CHQ headed by Comrade
D.N.Giri as CHQ President and Comrade
S.S.Mahadevaiah as General Secretary. The AIC of
AIPEDEU was held at Rewa [Madhya Pradesh] from
24th to 26th February 2008. NFPE Secretary General,
P3 and R4 General Secretaries attended the AIC.
The deliberations of the AIC emphasized the
need for total unity between the GDS and the regular
employees in facing the future. The debates in the
subjects committee were problem oriented. The
suggestion by the NFPE to consolidate the unity inside
the GDS Organisation was well taken by the leadership
of the GDS Union and a unanimous team of Office
Bearers was elected with due representation for major
and militant circles. NFPE Secretary General had
earlier emphasized the need for unity by GDS Union
accepting the offer of Federal Council Resolution for
'Associate Membership' outside the Constitution of
NFPE and for withdrawing the court cases etc against
the NFPE and work together with the NFPE.
Acceptance of Associate Membership and
readiness for considering withdrawal of NFPE as a
respondent in Court Cases as well as consolidation
of unity inside the GDS Union with major Circles
representing in the team of Office Bearership with
whom the GDS General Secretary would always
consult before taking major organisational decisions,
a new chapter will open in building the unity in our
movement. In the new chapter there need not be any
anti-NFPE or anti-GDS positions from any corner.
Let the postal workers movement in which the GDS
are an inseparable part move onward unitedly to face
the serious problems being faced by the entirety of
employees in our postal department.

AMENDMENT TO P.O.M.I.S. RULESG.S.R. 763 (E). - In exercise of the powers conferred
by Section 15 of the Government Savins Banks Act,

Office (Monthly Income Account) Rules, 1987,
namely:
1. (1) These rules may be called the Post Office
(Monthly Income Accounts) (Second
Amendment) Rules, 2007.
(2) They shall come into force on the date of
their publication in the Official Gazette.
2. In the Post Office (Monthly Income Account)
Rules, 1987, in Rule 9, sub-rule (1), after the proviso
shall be inserted, namely:-
"Provided further that a bonus equal to five per cent
of the amount deposited, on production of the
passbook accompanied by a written application
(withdrawal form) shall be paid on the deposits made
in new accounts opened on or after the 8th day of
December, 2007."

to convey the opinion of the Bankura Branch to the
following points,
Regarding BCR and LSG
As per the guidelines TBOP and BCR are not
any Promotion, just a financial upgradation, LSG and
HSG Postings are Promotion. A BCR official getting
the Pay Scale of 5000-150-7500 is promoted to a LSG
post in the pay scale of 4500-125-6500, Wow. what a
promotinal avenue! You have to shoulder greater
responsibility but in lesser Pay scale, the scenario is
same in the HSG Posting also.
It is stated that TBOP and BCR are just
financial up gradation, how much financial up gradation
an official is getting? when PA getting Basic Pay of
Rs. 5600/-after completion of 16 years service he is
upgraded to TBOP and his Basic pay is fixed Rs.5750/
-and his financial benefit is Rs. 317(Excluding HRA,
CCA) after completing 16 years when his family
liability, children education is increased by thousands,
his pay up gradation has been made in hundreds. It is
nothing but a farce and forcing him to earn money by
any means to meet up his requirement.
Filling up of residual vacancy
Previously it was decided that, the residual
vacancy will be filled up by the GDS Official having
higher marks in H.S.(up to less than 10% marks of
last selected outsider candidate of the division) now it
has been enhanced to equal percentage, means scope
for the GDS official as well as filling up of the vacancy
has been reduced, GDS official having equal marks of
the selected candidates, can easily appear in exam
as an outsider, what scope the Department is providing
vvvvv I convey my heartiest thanks to our beloved General
Secretary cum Editor of 'Bhartiya Post' for his invaluable
editorial in 'Bhartiya Post "Does the Postal Board Know"
for February 2008. The editorial is also acutely consistent
with the present situation and expresses the grave concern
felt by all the Postal staff all over India.
What is most disastrous is that there is not only
shortage of 30-35% of group 'C' staff, the existing staff are
to run the offices with all times anxiety and fear of
committing mistake or error due to tremendous work
pressure on them. They know that no mercy for such
mistake will be received from our iron hearted
administration. What hell is left when LSG offices are to
run with two staff.
We are yet hopeful that the CHQ will surely find
out ways and lead us to the land of light.

vvvvv CONSEQUENCES OF TOTAL
COMPUTERISATION
1. Department is proudly saying that all HOs,
HSG II A Class & B Class SOs are fully computerized
(i.e. Sanchay Post and Meghdoot Millennium) all over
India. But till date directorate has not issued even a
single order/procedure for discountinuation of Manual
work. But by showing full computerization department
has removed staffs (like ledger PAs, General branch
PAs, Treasurers and PAs in accounts branch) and
the same in Sub offices. But Directorate has issuing
orders continuously for implementation of security
measures only to safe guard the administration officers.
2. But unfortunately the manual works have been
discontinued in many offices in all branches without
any written orders from the Department. Nowadays
computers and UPS are under repair in many offices
and the work in that offices were held up. The
Postmaster and PA's working in the offices are
helpless to proceed further because they discontinued
the manual work. Major problem due to discontinuation
of manual work are pertaining to Savings Bank. If the
concerned Postmaster reports to the immediate
Superior (SP/ASP/IPO) about the above said problem
the Superior simply replies to proceed with manual

for them?
Instead of running after the percentage of marks
in the H.S. Exam, the process may be made like this,
enlist the top scoring (in H.S. Exam, division wise)
GDS officials in 3 times of the residual vacancy and
arrange for an Exam to promote them to the P.A.
Cadre to fill up the Vacancy. Otherwise the residual
vacancy will remain unfilled, and even after 5 years we
will be talking in this point and our agenda will remain
the same.
Regarding the latest order of Dte on System
Administrators
Some Postal Assistants having Computer
literacy(in recruitment criteria, it was mentioned as
Data Entry Knowledge) have been madly designated
as System Manager, System Administrator, System
Assistant without any norms and formalities. Recent
Computerization of the Department to some extent
depends on these officials. Surprisingly it is seen that
even after 12-15 years of computerization, any norms,
duty responsibility, are yet to be fixed. It is irrelevant
what is the nomenclature has been given. It is a fact
that their duty begins at 6.30 hrs when a H.O. starts
its works and ends at 21.00 or 21.30 hrs when HO
summary of the HO even daily account of every
computerized SO has generated successfully. There
is no second up line for any help proving the proverb
best "self help is the best help".
You have to make your own way out in case of
any difficulties or problem, without giving any weightage
to their pains taking effort. If Directorate passes such
type of sarcastic comment it appears very humiliating.
Regarding Posting in single hand and
Double handed Post offices
In the recent order one official could not be
posted back into a single handed or double handed
SO second time in his entire service period.
Some day will come when it will be seen that
junior most officials are bound to work at SOs and
senior officials will be working as PA in HOs. What is
the harm there if any official posted back into SO where
he worked more than 8 years ago (completing two full
tenure in other office).
Regarding fast track promotion
It is seen that many officials have been
promoted to LSG cadre even after their retirement,
and now LSG is a Circle cadre. So after completion
of about 30 years service one will get LSG posting
and may be posted to any other Division (within the
circle) so at the fag end of his service life, how much
productivity we can expect from him? And what will
he FTP should be started immediately in this format.
Produce! Bearing two or more establishments at
different places.
After 10 years- LSG
After 12 years- HSG II
After 15 years- HSGI/Gr B
The vacancy of LSG or other posting may be filled up
50% by FTP and other 50% by promotional avenues.
Regarding engagement of SDPA and OTA
No doubt it is a good proposal to make up the
shortage by engaging short duty PA but, how far it is
practicable in computerized environment when most
of the HOs and even a considerable number of SOs
are also computerized. The better option to pull up
the work is OTA, but the rate of OTA is very poor,
perhaps which has been fixed in the third pay
commission and not revised till date. To encourage
the staff for performing extra work on OTA basis, the
rate of the OTA should be made on pro rata basis.
Regarding Special Pay for S.A. and
Marketing Executive & PO RMS
Accountants
In the changing environment of the Department,
System Administrators/ Managers/Assistants and
Marketing Executives are bound to shoulder more
responsibility. PO & RMS Accountants are already
shouldering more responsibility. A Postmaster or SPM
thinks only for his office, but as a SA one has to think
for every computerized offices in the Division and
literally his work completes, only when daily account
of every computrized offices are generated
successfully. They deserves a separate pay scale.
Already they have been exploited for more than a
decade. Mere special pay should not commensurate
them.
If we just demand a special pay for them, their
life will be same as the PO & RMS Accountants, before
few years their allowance had been taken as special
pay and fixed accordingly, but now they are just getting
an allowance of 180/- which is negligible comparing to
their responsibility.

Applicants 1 to 6 presently working as Gramin
Dak Sevak Mail Man in Head Record Office, RMS "Ek"
Division, Emakulam under the administrative control
of the first respondent are aggrieved by their non
selection to Group-D Post in the Department for which
according to them they are eligible and have been
waiting for the last seventeen years.
2. The applicants state that according to the
Department of posts (Group-D) Recruitment Rules
2002, 75% of the vacancies remaining unfilled after
recruitment from employees mentioned at SI. No. 2
shall be filled by GDS of the Recruiting Division or
Unit where such vacancies occur failing which by
Gramin Dak Sevaks of the neighbouring Division or
Units by Selection-seniority. The applicants had earlier
filed O.A. 444/2002 before this Tribunal seeking for
similar direction to the respondents to take steps for
filling up the existing vacancies in the cadre of Group-
D in the RMS Ekm division and when the O. A came
up for bearing the respondents had submitted that
steps had been taken for making recruitment to thevacancies in the Group-D cadre for the years 2000and 2001 and that for the vacancies of the year 2002recruitment action would be taken shortly and takingnote of the above submission the O.A. was disposedof by order dated 16.7.2002 directing the respondentsto make recruitment considering the applicants inaccordance with Rules. According to the applicantsthere are 26 clear vacancies of Group-D in the HeadRecord Office of RMS which are remaining unifilledand there are no qualified employees under thecategory No. 2 in the Recruitment Rules and therefore75% of these vacancies in Group-D, by following thenext step in the Recruitment Rules are to be filled upby the GDS, But the respondents are not initiatingany steps for promoting the GDS against the existingvacancies in Group-D in accordance with the rules.The applicants are fully eligible to be promoted under

the said quota and according to annexure A-5 seniority
list they are at SI. Nos. 6 to 11 and the last person
appointed to the post of Group-D from the above
seniority list is SI. NO. 5. The applicants contend that
since the provision exists in the recruitment Rules
which is statutory, the authorities are bound to follow
the same.
3. They have sought the following reliefs:
(i) to issue appropriate direction or order directing
the respondents 1 to 4 to take immediate steps for
promoting the applicants 1 to 6 to group-D on the
basis of their running seniority against the existing
vacancies which falls under 75% quota set apart for
Gramin Dak Sevak under the Recruitment Rules, 2002
and to promote them to Group-D from the date of their
entitlement with all consequential benefits forthwith
and at any rate, within a time frame that may be fixed
by this Hon'ble Tribunal.
(ii) To grant such other reliefs which this Hon'ble
Tribunal may deem fit, Proper and just in the
circumstances of the case such other, and
(iii) To award costs to the applicant.
4. The respondents have filed reply statement. It
is submitted there in that the Annexure A-2
Recruitment Rules would cover the recruitment process
once the Department has approved the vacancies that
arose in each division. According to the OM dated
16.5.2001 of the Ministry of Personnel and Grievance
and Pension, Department of Personnel & Training(Annexure R-2), recruitment is limited to 1/3rd of directrecruitment vacancies with the ceiling that it does notexceed one percentage of the total strength of thedepartment and recruitment process could commenceonly after obtaining the vacancies approved forrecruitment by the Screening Committee. Hence,though retirements or promotions occurred in the yearsas alleged in the O.A. unless the vacancies areapproved by the Screening Committee, they cannotfill them up. The Screening Committee has approvedfilling up of three Group-D posts only during the years2001 and 2002 and they were filled up by two GDSand one temporary status Casual labourer inaccordance with the provisions contained in AnnexureR-1 Recruitment Rules. No Group-D post were approvedfor the year 2002. Only one Group-D post was approvedfor 2003. Two posts were approved for 2004. All theabove posts were filled up by making selection inaccordance with the rules, by appointing seniors ofthese applicants and the other two applicants did notcome under the zone of selection at that time. Noneof the juniors of the applicants has been appointed.During the year 2000-2005, 29 Group-D posts wereabolished in the Ekm Division. At present there are 11group-D posts lying vacant in RMS Ekm Division, out
of these the Screening Committee has recommendedabolition of 8 Group-D posts. Hence only three posts
are at present available for filling up. To fill up these
three vacant posts approval of the Screening
Committee is necessary and it has not been received
so far. As soon as the Screening Committee issues
the necessary approval, the applicants excluding 1 &
3 already appointed will be considered.
5. In the rejoinder filed, the applicants have
submitted that annexure R-2 OM dated 16.5.2001
referred by the respondents relates to direct recruitment
and it has no application in the case of promotion of
GDS to Group-D posts. Therefore, approval of the
Screening Committee is not required for filling up these
posts and the matter was settled by the orders of the
Tribunal in O.A. Nos. 901/03,977/03 and 115/04.
Therefore, the reliance of the respondents on this OM
any more cannot be accepted. This ground cannot
be taken by the respondents for denying promotion
due to the applicants.
6. Additional reply statement has been filed taking
the stand that the contention of the applicants that
75% quite is set apart for GDS by promotion is not
correct. The respondents have enclosed Annexure R-
4 and R-5 orders of the full Bench of this Tribunal in
support of their claim that the 75% quota for GDS is
filled by direct recruitment. The Full Bench decision
by common order in O.A. 807/99 quoted is holding
that appointment of EDAs as postman is by way of
direct recruitment against the 25% seniority quota.
Annexure R-5 order in O.A. 1033/2003 is another Fullbench order of the Tribunal was rendered on a referencemade in the said OA before the Chandigarh Bench inSuriith Singh Vs. Union of India. Hence it is averredthat such recruitment to Group-D is by directrecruitment and Annexure R-2 memorandum is relevantin such cases.7. We have heard Shri O.V. Radhakrishnan, SeniorCounsel for the applicant and Shri P.M. Saji, ACGSCfor respondents.8. The learned counsel for the applicant producedthe order of the Hon'ble High Court in WEP(c) 3618/2006 confirming the order of this Tribunal in O.A. 977/2003 and order in WP 2218/2006 confirming the orderof this Tribunal in O.A. 115/2004 and submitted thatsince the declaration of this Tribunal that theconsideration of the GDS against 75% of Group-Dposts is not by way of direct recruitment and the priorapproval of the Screening Committee is therefore notrequired has been up held by the Hon'ble High Court.Hence, the stand of the respondents is legallyunsustainable. Also it was pointed out that AnnexuresR-3 and R-4 orders now enclosed by the respondentsdo not deal with issue on hand.

9. The learned counsel for the respondentsmaintained the respondents stand taken in the replyand additional reply statements and also placedreliance on the judgment of the Hon'ble Supreme Court
in Shankarsan Dash Vs. Union of India (AIR 1991SC
1612) in which it has been observed that "…. Unless
the relevant recruitment rules so indicate, the State is
under no legal duty to fill up all or any of the
vacancies…."
10. We have carefully considered the pleadings and
the arguments advanced by the learned counsel on
either side. As is evident, this issue has come up
time and again before this Tribunal and we have given
considerable thought on the position as reflected in
the Recruitment Rules. For facility of reference the
relevant provisions of the Schedule, part-II- Post of
Subordinate offices in Recruitment Rules are extracted
as below:-
11. Method of recruitment shall be in the manner
specified below, namely-
A test shall be held to determine the working
eligibility of the candidates holding the post of specified
against SI. No. 2 for filling up the posts. In case the
suitable candidates are not found to fill up the posts
by such test, the remaining posts shall be filled up by
the method as specified below:-
(i) 75% of the vacancies remaining unfilled after
recruitment from employees mentioned at SI.No. 2
shall be filled by Gramin Dak Sevaks of the Recruiting
division or Unit where such vacancies occur failing
which by Gramin Dak Sevaks of the neighbouring
Division or Unit by selection-cum-seniority.(ii) 25% of the vacancies remaining unfilled afterrecruitment of employees mentioned at SI. No. 2, suchvacancies shall be filled up by selection cum seniorityin the following order:-
(a) by casual labourers with temporary status ofthe recruiting division or unit failing which.
(b) By full time casual labourers of the recruitingdivision or unit failing which.
(c) By full time casual labourers of theneighbouring division or unit failing which.
(d) By part-time Casual Labourers of therecruiting division or unit failing which.
(iii) by direct recruitment.(11) On a wholesome reading of the columnspertaining to the selection and mode of recruitmentas provided in the schedule to Part 1 of these rules itcan be reasonably concluded that the scheme ofrecruitment envisaged only "promotion" by "selection-cum-seniority" initially from the categories asmentioned in the category 2 in schedule 2 and in casesuch categories are not available by the same methodof " selection cum seniority" from the categories as
mentioned in col. 11 of the Recruitment Rules inaccordance with the percentages as stipulated. Only
if any of the above methods fail the provision had been
made in for "direct recruitment." Since the term " direct
recruitment" is specifically referred to in the
Recruitment Rules with reference to failing which
clause as a last resort, it would be a natural corollary
that the rest of the procedure should be construed as
promotion. This view is further fortified by the provision
of the Recruitment Rules relating to the consideration
of the DPC and also by the method of selection
prescribed as " Selection cum seniority". In a case of
direct recruitment there is no scope for seniority. Even
if there is any ambiguity in the Recruitment Rules, a
harmonious interpretation of the various provisions in
the rules has to be undertaken and on that basis we
had come to the conclusion that the selection GDS
under the 75% quota and also the selection of Casual
Labourers under the 25% quota would fall under the
category of promotion only. The orders in the OAs
referred to supra and as confirmed by the Hon'ble High
Court relate to part-time and full time Casual Labourers
under the same rules who qualified under the 25%
quota. However, the principle whether the method of
selection was direct recruitment or promotion would
remain the same for both the categories. We therefore
reiterate our earlier view. In this context, adverting to
Annexures R-4 and R-5 orders of the Full Bench of
this Tribunal referred to by the respondents, it is seen
that Annexure R-4 order that the points referred to the
Full Bench were whether the appointment of GDS asPostman in the 25% seniority quota is by way of directrecruitment or promotion. The rules of Promotion tothe post of postman are entirely different from the rulesin question in this O.A. Therefore, any reliance of thishas no basis. Similarly Annexure R-5 order on theFull Bench the point of reference were as follows:(i) Whether the post of Extra Departmental BranchPostmaster being a feeder post for further promotionto group-D is a public post?(ii) Whether the service rendered as EDBPMfollowed by promotion as Group-D employee which isa pensionable post can be taken into considerationfor the purpose of determining as qualifying service forthe purpose of pension and other benefits?(iii) Whether the view taken by a Division Bench ofthis tribunal in O.A. No.283/HP/2003(Rattan Singh Vs.Union of India and others) decided on 4.4.2003 iscorrect view?
Hence the legal question referred to the FullBench was whether the service rendered as an EDAcan be considered as qualifying service for purpose ofpension on the ground that it is a public post. It is alsoan entirely unrelated issue and the Recruitment rules

for the post of Group-D which is under consideration
in this case were not covered by the above judgment.
Hence we do not find that as far as this issue is
concerned the stand of the respondents is legally
defensible and the matter has already been settled by
other earlier decisions as confirmed by the Hon'ble
High Court.
(12) The second aspect is whether for filling up the
existing vacancies the approval of the Screening
Committee is required or not. The answer to this
question flows directly from the decision above whether
the posts are to be filled up by direct recruitment or by
promotion. It is clear that Annexure R-2 memorandum
of the Department of Personnel and the instructions
contained therein was limited to direct recruitment
vacancies. Para 3 there of is specific in this regard
and this was already dealt with by us elaborately in
our order in O.A. 115/2004. Therefore the reliance of
the respondents on the Memorandum again has no
basis and only shows the reluctance on the part of
the respondents to accept the settled legal position.
It is no doubt, true that it is the prerogative of the
Department to take a conscious decision whether at
any point of time the vacancies arising should be filled
up or not. They can take a conscious decision not to
fill up a post on the existence of a situation. While
accepting their reliance on such a ratio in the judgment
of the Hon'ble Supreme Court in AIR 1991 SSC. It is
also true that the court further observed therein:
"…..However, it does not mean that the State has
the licence of acting in an arbitrary manner. The
decision not to fill up the vacancies has to be taken
bonafide for appropriate reasons. And if the vacancies
or any of them are filled up, the State is bound to
respect the comparative merit of the candidates as
reflected at the recruitment test, and no discrimination
can be permitted…."
There is no such stand taken by the
respondents that they had taken any such decision
not to fill up the posts.
12. The applicants have claimed that there are 27
vacancies, the respondents have now stated that from
the Year 2005, 29 posts are lying vacant of which 8
Group-D posts are to be abolished. This is a decision
within the authority of the department and we cannot
find fault with the same. However, it is not clear whether
this recommendation for abolishing the 8 posts was
accepted by the competent authority. In any case,
the respondents have admitted that there are three
posts vacant at present but they are unable to fill up
those posts since the clearance of the Screening
Committee is awaited. We have already held that the
approval of the Screening Committee is not mandatory
for filling up the vacant posts by promotion in
accordance with the Recruitment Rules. A decision
for abolishing the posts has to be distinguished from
a decision for getting the clearance for filling up. While
abolishing is a permanent measure, obtaining
clearance is a temporary restriction imposed by certain
instructions. In this case it has been found that the
restriction would operate only in the case of direct
recruitment. Therefore, it is to be reiterated that such
a clearance from the Screening Committee is not
required to go ahead with the filling up of the three
vacant posts admittedly available in the Division and
the Screening Committee can be apprised of the
position.
14. In the result, the respondents are directed to
consider the case of the applicants excluding
applicants 1 & 3 in accordance with their rank and
seniority under the 75% quota set apart for Gramin
Dak Sevaks under the Recruitment Rules 2002 without
waiting for clearance of the Screening Committee and
to promote them according to their eligibility and
seniority against the available vacancies. It shall be
done within two months from the date of receipt of this
order. The OA is disposed of as above. No costs.

Letter No. 23-1/1999-UPE, dated 12/17-3-1999
regarding increase in length of sarees supplied to
female employees of the Department of Posts from
5.5 metres to 6.3 metres (including 80 cms cloths
for blouse).
2. Some Circles/PSDs have sought for
clarification about proportionate increase in the
prices of sarees of 6.3 metres. The matter has been
considered in this office in consultation with DoP&T
and Integrated Finance Wing and it has been decided
that the rate of saree having length of 6.3 metres
(including blouse piece of 80 cms) will be Rs. 216.70
(Rupees Two hundres sixteen and seventy paise
only) on pro rate basis.
3. The Circles may procure sarees for female
employees after following the codal formalities as
contained in the Revised General financial Rules,
2005 and the DFPR.

Employees, Field Officers and Gramin Dak Sevaks
are getting enormously delayed in almost all Circles
for various reasons. Such delays demorlise our sides
force in procuring new business. The issue has been
examined in great details at this Directorate and it
has been found that main reasons for delay in payment
incentives are as follows:
(i) Head offices are not always sending the
Premium Schedules in time to the CO/RO.
(ii) Even if the Schedules are received in time,
Ledgers are not updated immediately at the
CO/RO and in consequence the process or
verification that a new insurant has paid first
six monthly premiums, gets inadvertently
delayed and till that time no incentive is paid
to the Salesman who had procured the
business.
(iii) In some cases because of the transfer of the
insurant immediately after procuring a policy
makes verification of first receipt of first six
premiums become extremely difficult.
2. It has been found that the lapsation rate in PLI
is quite low now-a-days. This is because the insurants
are coming from organized Governmental/Semi
Governmental Sector and are in general more alert
and educated. They are also having steady source of
salaried income. Keeping these issues in mind, it has
been decided that 90% of the incentive due to PLI
Agent can immediately be released on acceptance of
a PLI proposal. Remaining 10% will be released only
on verification of receipts of first six PLI premium as
envisaged in this Directorate No.19.1/98-LI dated
14.06.2000. This order will not be applicable in case
of Rural PLI.
3. Circles are requested to project their
requirement of fund for payment of incentive
accordingly. While projecting the Budgetary
requirements they should keep in mind recent growth
of business and delay in payment of incentive to our
sales force for procurement of PLI business should be
avoided by all means.
4. This order issues with the concurrence of the
internal finance of the PLI Directorate dated 26.12.2007.

Sub: Training of Sales force and granting license
to the Direct Aents.
1. Kindly refer to Para 5 of my D.O. No. 26.02/
2003-dated 20.09.2007 as regards training of our sales
force and granting license to the Direct Agents for
procuring PLI./ RPLI business. Insurance Institute of
India has now prepared the study materials (in English)
and has expressed their readiness to conduct the
training and conduct the examination for granting
license to the sales force of PLI/ RPLI.
2. The Training program of the sales force for PLI/
RPLI will be condensed in three working days and
they will be organized in the premise of the Department
in Circle / Regional Headquarters to start with.
Insurance Institute of India will arrange faculty members
wherever necessary through their affiliated Institutes.
3. At the end of the three days training, an one
hour examination will be conducted under the
supervision of the Departmental Officers. The
examination will be based on Multiple Choice
Questions and the Answer Papers will come back to
Insurance Institute of India and the results will be
declared thereafter within a week time from the date
of receipt of Answer Papers. Every candidate who
passes the examination successfully will be issued a
certificate by I.I.I. which will be countersigned by the
Head of the Circle.
4. The honorarium payable to the faculty members
(to be deputed by I.I.I. from their locally available
affiliated Institutions) for imparting training at
Departmental premises in Circle / Regional head
Quarters, will be Rs.500/- for a half day Session. This
rate will be applicable to all Circles and no further
payments need be made to faculty members on
account of TA/DA etc.
5. The examination fee to be paid to I.I.I. is Rs.200/
- for each candidate Examination fee will include the
cost of examination hand book and there will be no
other charge. The Circles will be required to deposit
the examination fee in the bank account of the I.I.I., to
be intimated by them shortly. Whereas the
Departmental candidates and the Gramin Dak
Sewaks, will not be required to pay any amount for
the training and examination, direct agents will be
required to Pay Rs. 1000/- for their training which will
include cost of Study Materials, Examination Hand
Book and Examination Fee, as intimated to all
concerned vide this Office Order No. 26.02.2003-LI
dated 25.10.2007. This amount will however be
reimbursed to the Direct Agents if they completed the
training process satisfactorily and worked for the

specified time thereafter.
6. Each book (study material ) will cost Rs. 50/-
and the examination entry form will be included in the
book. However, payment for payment for the book will
be made centrally by the PLI Directorate and Circles
are not required to pay anything for that. The
candidates are, however, required to be supplied with
the books before the commencement of the training
and for filling up the examination entry form.
7. In order to make a training programe viable, at
least 25 candidates may be included in one program.
If number of Direct Agents in a particular programme
is not sufficient, Departmental Employees who have
been authorized to procure PLI/RPLI business may
be included in the training. Such employees may also
be encouraged to appear and qualify in the examination
for better professional knowledge. However, passing
the examination is not mandatory for the Departmental
Employees.
8. Since this training is a Plan activity, all
expenditure in this connection made till 31st March,
2008, may be booked under the Plan Head 3201.02/
003.02/02. for payment of facilities etc. and
3201.02.003.02.02.11 (TE) for settlement of bill of
traveling expenses of Departmental officials and GDS
deputed on training.
9. The Heads of circles may contact Shri S.J.
Gidwani, Secretary General of the Insurance Institute
of India, Universal Insurance Building, 6th Floor, Sir
P.M. Road, Mumbai -400001 to work out the training
programme and the examination . A comprehensive
report on the action taken may be sent to this
Directorate for perusal of the Secretary (Posts) by 5th
April, 2008

Sub: Revitalizing Direct Agency System.
According to Para 10 of this Directorate letter
No.26-02/2003-LI dated 15.07.2003, Selection
Committee for empanelment of Direct Agents (PLI/
RPLI) is to comprise of the DPS (HQ), DDM (PLI) and
the concerned Divisional Head. While inspecting
various Circles it has been observed that empanelment
of Direct Agents get inadvertently delayed because
the Committee find it difficult to move from Division to
hold interview. It is found not practicable for the DPS
(Head Quarters) and DDM (PLI) to move from place to
place for empanelment of the Agents, leaving their
important Head Quarter work. On the other hand, there
is no provision of paying TA/DA to the candidates who
are appearing before the Selection Committee. It has
been found that if Selection Committee calls the
applicants in the Circle Head Quarter where DPS (HQ)
& DDM (PLI) are available, candidates do not turn-up
all the way in substantial number.
2. In this background, the issue has been re-
examined in this Directorate and it has now been
decided that the process of selection of Direct Agents
be decentralized. In partial modification of Para 10 of
letter dated 15.07.2003, following orders are being
issued:
(a) Selection Committee for empanelment of Direct
Agents will be headed by the Divisional Head and the
Committee with constitute of two other Gazetted
Officers as nominated by the concerned PMG/CPMG.
(b) The applications received from the candidates
may be scrutinized and shortlisted as per the
guidelines prescribed in the order dated 15.07.2003
by the Divisional Head (instead of shortlisting at the
Circle level as prescribed earlier).
(c) The Advertisement for empanelment of Agents
in different Divisions will, however, be issued in the
local newspapers at Circle/Regional level only.
There will be no other changes in procedure for
empanelment. This order may please be
acknowledged.

Sub: Clarification on incentive to GDS officials.Certain Circles have raised a query
whether GDS Officials (other than GDS BPM/SPM)are eligible to get incentive for procurement ofRPLI business and if so at what rate.2. The issue has been examined in this Directorate.
In this context, I would like to draw your attention to
Para 10 of the original Gazette Notification dated
15.03.1995 on RPLI Scheme. GDS BPMs and GDS
SPMs ( besides that Departmental SPMs in rural
areas) were authorized to work as Agents for
procurement of Insurance business under the Rural
PLI Scheme in their respective Jurisdiction in that
Notification
3. Subsequently, Para 10 of the original Notification
dated 15.03.1995 was modified vide this Directorate
order No. 5-1/94-LI dated 23.02.1996 and EDDAs/
EDMCs and Postmen serving in rural areas were also
authorized to procure RPLI business as Agents in their
respective areas. Therefore the commission rate as
applicable to the GDS BPMs/GDS SPMs were
automatically extended to all other categories of GDS
staff authorized to work as Agent in rural areas viz
GDS MDs/GDS MCs/ GDS Packers/ GDS TMs etc.
and Village Postman. All categories of GDS staff are
also authorized to procure PLI business and incentive
at the rates prescribed for RPLI shall be payable. This
may be brought to the notice of all concerned.

Recently in the context of a Starred ParliamentQuestion in Rajya Sabha, the issue of creating greaterawareness on Postal Life Insurance, Particularly RPLIin the rural areas came up for discussion. The Memberof Parliament also raised the issue as how to educatean insurant or his nominee for submission of claimpapers in proper shape.2. PLI Directorate had formulated a Media Plan,which was circulated to all heads of Circles vide No.28-05/2007-LI(Pt) dated 22.06.2007 Budget Sectionof the Directorate also released necessary funds underthe Non-Plan Head 3201-03-101-08-26AdvertisementSales &Publicity (PLI) to all Circles for promotion of
PLI & RPLI. I am informed that out of Rs. 62.86 lakhs
released to the Circles, only Rs. 9.73 lakhs has been
spent as on October 31, 2007. The tardiness in utilizing
funds for publicity may be one of the reasons for some
Circles to lag behind in achievement of their targets.
3. Member (I&Fs) earlier had taken up issue with
you vide D.O. No. 1-1/Business Performance/2007-LI
dated 31-10-2007. I have observed that in the half yearly
evaluation that except for APS no other Circle has
achieved the pro-rata target for this year. Circles like
Bihar, Haryana & Punjab have not even achieved 20%
of their target. In RPLI. Also, Tamil Nadu, Madhay
to engage as many Direct Agents as they consider to
be appropriate and the commission to be paid to them
has also been doubled and put at par with the Field
Officers. Restrictions on the number of Postal
Assistants that can be engaged for procurement of
business outside working hours has also been
removed. We have stopped collecting Service Tax from
the individual insurants w.e.f. November 1, 2007.
Maximum limit of Sum Assured has been enhanced
from Rupees Twenty five thousand to Rs. One Lakh in
respectof RPLI policies with non-standard age proof.
Time is now ripe for you to take personal initiative in
promotion of PLI/RPLI. Your promotional initiative
should in promotion of PLI/RPLI. Your promotional
efforts should highlight the strengths of our L.I. productsand simultaneously you should take efforts to improveour after-sales services. Unless we are in a positionto take care of the basic needs of our customers, our
initial advantage of carrying out life insurance businessparticulary, in rural areas will soon be lost.5. I do appreciate the concerns of the hon'bleMembers of Parliament in Rajya Sabha as regardseducating our customers, particularly those who arein the rural areas, as to how to facilitate them in
submission of claim papers with all relevantdocuments. You may consider sending preprintedPost Cards to such customers whose policies are dueto mature shortly, besides taking other campaigns andeducating our field staff.6. Kindly bring me up-to-date on efforts taken by

This is regarding development of the new webbased software for PLI/RPLI on Oracle 10g by NICand on line testing of this software from National DataCentre at Circle/Regional and Divisional Offices,

modules of the software except 'Posting' has been
developed and tested on line with the data of Delhi
circle at Sansad Marg Head Post Office. The PLI
data of Uttarakhand, Jharkhand, Bihar, APS, Delhi,
Gujarat, Rajasthan, Kerala, Maharashtra and
Tamilnadu Circles have been successfully transferred
to new software and data of the remaining Circles will
be received from the Circles by PLI Directorate.
3. Further, DDG(Tech.) has intimated most of the
locations identified for networking have been supplied
with the net working equipments and 113 sites have
already been commissioned as on 29.10.2007.
4. The web based PLI software is, therefore, now
ready for on line testing at the sites were connectivity
has been established. The Circles are required to
prepare the site and make hardware arrangements for
testing of the software on line without disturbing the
present set up immediately. I shall request you to
undertake the following preparatory steps for
implementation of the new software at Circle/Region/
Divisional level.
(a) ensure that the NIC leased line is extended to PLI
Section of Circle/Regional/Divisional office
where PLI operations are taking place.
(b) Pentium machine with 1 GB RAM having hard
disk capacity of 80 GB or more, 104 Keys OEM
Keyboard, Preloaded Windows XP
Professional/Window 2000, Antivirus Software
is made available for operations. Wherever 512
MB RAM is available, that can also be used
but performance of the software will be a little
slower. The PCs are required to be put in LAN
in such offices where more than one machine
is required to be put into use.

l Regarding Rotational Transfer of Staff
working in Post offices.
1. Tenures of Single Handed and Double Handed
SPMs, and PAs working in double handed SOs and
above must be observed very strictly. Although
instructions exist that overstayal of tenure has to be
personnally approved by the PMG/CPMG, many
cases are noticed where Divisional Heads manage to
continue staff beyond tenure on some pretext or the
other and the inspecting officers also do not object to
this. In some cases, PA in double handed SO is
continued there itself as SPM, ignoring his previous
stay as PA and treating the SPM's tenure afresh from
the date of posting as SPM. This is incorrect and office
tenure as a whole should be observed strictly. Tenure
of PAs working in HPOS is Four years with some
exception for SB incentives qualified officials. It is
observed that officials are retained far in excess of
prescribed tenure, which need to be stopped forthwith.
They will please send their compliance report

time of Transfer Posting/Rotational Transfers etc.

The undersigned is directed to refer to the
consolidated instructions issued in this Department
OM No. 14/8/90-JCA dated 29/6/1990 and further
orders issued from time to time dealing with the

procedure for procurement and supply of summer/
winter uniforms t common categories of Group 'C' and
'D' employees serving in various Ministries/
Departments of the Central Government and to say
as follows.
2. Consequent to the coming into force of the new
General Financial Rules, 2005 (GFRs), it has become
necessary t review and modify the existing Procedure
for Procurement/purchase of simmer/winter uniforms'
for common categories of Group 'C' and 'D' employees
serving in various Ministries/Departments of the Central
Government so as to bring it in line with the provisions
of the revised GFRs. In this connection, it is also
relevant to note that vide OM dated 29-7-2005 cited
above, the Ministry of Finance (Department of
Expenditure) has clarified that the special dispensation
from the process of inviting tenders/quotations provided
to NCCF/Kendriya Bhandar in DOPT Welfare Division's
OM dated 14.7.1981 and 11.4.1994 under Chapter 8
of the old GFRs no longer holds good and that
purchase/procurement of goods by Government of India
offices will now be solely guided by the provisions of
GFRs 2005.
3. In the circumstances, in supersession of the
extant instructions regarding procurement of
summer/winter uniforms relating to Groups 'C' & 'D'
employees in the Central Secretariat Ministries/
Departments and its attached an d subordinate
offices, the purchase procedure to be followed in
different exigencies and the relevant rules in the
GFRs are outlined below:-
(i) Chapter 6 of the GFR's 2005 pertaining toProcurement of Goods and Services may becarefully perused to ensure that theprocurement/purchase procedure adopted isstrictly in line with the prescribed rules. In thisconnection attention is specially drawn to someof the following important provisions, details ofwhich may be obtained from the GFR's 2005:-
Rule 137 - Fundamental Principles of Public Buying
Rule 144 - Reserved items
Rule 145 - Purchase of Goods without Quotation
Rule 146 - Purchase of Goods by Purchase Committee
Rule 148 - Demand should not be divided into smallquantities to make price meal purchase
Rule 160 - Transparency, competition, fairness andelimination of Arbitrariness in the procurementprocess
Rule 161- Efficiency, Economy and Accountability inPublic Procurement System.
(iii) All Purchases should be made through a duty
constituted Purchase Committee comprising of
three members of an appropriate level as
decided by the Head of the Department,
including one member from the Internal Finance
Division and two belonging to the Administration
Division. In addition, a fourth member may be
associated with the Purchase Committee, to
be nominated by the concerned staff
Associations, / unions.
"Certified that we, S/Shri……………, members of the
purchase committee, are jointly and individually
satisfied that the goods recommended for
purchase are of the requisite specification and
quality, priced at the prevailing market rate and
the supply the goods in question."
(iv) Subject to the exceptions incorporated in Rules
151 and 154 pf GFR's 2005, invitation to tenders
by advertisement should be used for
procurement of goods of estimated value of Rs.
25 lakhs and above,
(v) In case the Ministry / Department directly
procures DGS&D rate contract goods from
suppliers, the prices to be paid for such goods
should not exceed the rates mentioned in the
rate contract and the other terms and conditions
of purchase should also be in line with those
specified in the rate contract . In addition, theMinistry/Department has to make its ownarrangement for inspection and testing of thegoods, where so required.
4. White observing the above change in procedure,the Purchase Committee / Competent Authority mayalso keep in view the provisions of Rule 144 of theGFRs, 2005 that reads as under:-

NOTES OF THE MONTH
GDS Union AIC at Rewa : The 5th All India Conference
of AIPEDE Union was sucessfully held at Padmadhar
Park, Rewa, M.P.Circle from 24th to 26th Feb, 2008
under the presidentship of Com. D.N. Giri, All India
President of the union. More then 2000 Postal
employees were participated. The Open Session was
held on 24th Feb, 2008 with Com. D.N. Giri with Chair.
The Open Session was inaugurated by Com. G.L.
Dhar, Secretary AITUC and was addressed by Sri
Sunder Lal Tiwari Ex., M.P. Rewa, Com. K.
Raghavendran, Secretary General, NFPE, Com. K.V.
Sridharan, General Secretary, P-III, Com. P. Suresh,
G/S R-IV, Com. B.G. Tamhankar, Ex. President,
AIPEU Gr.'C' Union, Com. Yaswant Purohit General
Secretary COC Madhya Pradesh, Com. S.K. Nema
Working President P-III CHQ.
The deleberations of the AIC emphasized the
need for total unity between the GDS and the regular
employees in facing the future. The debates in the
subjects committee were problem oriented. The
suggestion by the NFPE to consolidate the unity
inside the GDS Organisation was well taken by the
leadership of the GDS Union and a unanimous team
of Office Bearers was elected with due representation
for major and militant circles. NFPE Secretary General
had earlier emphasized the need for unity by GDS
Union accepting the offer of Federal Council Resolution
for Associate Membership outside the Constitution of
NFPE and for withdrawing the court cases etc against
the NFPE and work together with the NFPE.
Acceptance of Associate Membership and
readiness for considering withdrawal of NFPE as a
respondent in Court Cases as well as consolidation of
unity inside the GDS Union with major Circles
representing in the team of Office Bearership with
whom the GDS General Secretary would always
consult before taking major organisational decisions,
a new chapter will open in building the unity in our
movement. In the new chapter there need not be any
anti-NFPE or anti-GDS positions from any conrner.
Let the postal workers movement in which the GDS
are an inseparable part move onward unitedly to face
the serious problems being faced by the entirety of
employees in our postal department.
Honourable Finance Minister has presented the last
budget of the present UPA Government in Parliament
on 29th February 2008. The ceiling limit of income
exempted from income tax is raised to 1.5 lakhs. For
women the same is enhanced to 1.8 lakhs and for
senior citizens 2.0 lakhs. But no provision is made to
meet out the expenditure towards implementation of
the Pay Commission recommendations except a mere
announcement by the Finance Minister that 6th CPC
would submit before 31.03.2008, even though the
Finance Ministry had earlier advised the Railway
Ministry to make provision in the Rail Budget The
purpose of not making any allocation towards pay
commission in the main budget appears to be to show
the figures of fiscal and revenue deficit lower than what
he anticipated in the last budget but the reality will be
definitely contrary to his claims.
The 6th Central Pay Commission is expected to
submit its recommendations shortly. The Honourable
Finance Minister declared during his budget
presentation also that Pay Commission would submit
recommendations before 31st March. It is in this
background that the Extended National Executive of
Confederation fo Central Government Employees will
discuss on 2nd and 3rd at Mumbai regarding our
strategy to ensure minimum wage, protect social
security and health care. As already pointed out the
Executive will be attended Comrades C.C. Pillai
(Working President Confederation); K.Ragavendran (SG
NFPE); and Com. Rajanayagam (GS Postal A/Cs).
The Standing Committee of JCM National Council is
rescheduled to be held on 9th March 2008 instead of
15.02.2008. The important issues like Revision of Bonus
Ceiling; CGHS Rates for hospitalization and pathological
tests with specialist hospitals in all cities; implementation
of Arbitration Awards etc are expected to be effectively
raised by our Confederation and Staff Side.
NFPE Delegation consisting of the Secretary General
NFPE and General Secretaries of P4, R3 and Postal
Accounts Unions met the Secretary (P) twice during
February 2008 and discussed many urgent issues.
The Secretary (P) assured to process the grant of
recognition of Federations; modify the orders of the
Member (P) causing dislocation to present incumbent
Sub-Postmasters in delivery post offices by posting
FTP LSG officials; hold discussions with the Staff Side
on the change of nomenclature of RMS by withholding
the implementation of 30th January orders; sort out
issues of cadre controlling and merger of DOP & DOT
for ensuring promotions to JAO qualified; stopping
unjustified curtailment of deliveries and postment
beats; Cause suitable action on the serious on the
serious complaints against the SSPO Meerut etc.
Comrade S.S. Mahadevaiah [General Secretary
GDS] along with the Secretary General NFPE and
General Secretaries of P3, R4 and Admn. Unions
submitted the list of newly elected Office Bearers of
GDS Union in the Rewa AIC to the Postal Directorate
