What is the QLTS?

The QLTS is the Qualified Lawyers Transfer Scheme, the fast-track route for international lawyers, and barristers in England and Wales, to qualify as English solicitors.

The scheme is administered by the Solicitors Regulation Authority (SRA), the independent regulatory body of the Law Society of England and Wales, ensuring candidate assessment is both rigorous and fair.

The purpose of the QLTS assessments is to ensure that all candidates who qualify as solicitors have the knowledge, skills and ability necessary to perform their role competently and ethically.

The SRA has published a statement of what all solicitors who follow the domestic route to qualification should know and be able to do at the point of qualification. This statement is described at the ‘Day One Outcomes’. Using the Day One Outcomes as a starting point, all foreign lawyers are required to demonstrate that they have the equivalent knowledge and understanding of law and practice in England and Wales in the same areas as that required of individuals who qualify under the domestic route.

The QLTS assessments, which have been in place since 2011, replaced the QLTT which is no longer in force. The QLTS has been successful in attracting many applicants from various jurisdictions, who are now dual-qualified English solicitors.

Why become an English solicitor?

There are numerous reasons to become qualified in English law. While taking the QLTS will undoubtedly advance your legal career, this qualification will also improve your professional profile and knowledge, and provide you with diverse and unique opportunities.

How are you assessed on the QLTS?

The full range of skills required to practise English law are tested on the QLTS, including oral, written and professional. The QLTS assessments are designed to test applicants on most of the SRA’s Day One Outcomes expected of a solicitor on qualification.

The assessments are divided into two parts:

Part 1: Multiple Choice Test (MCT)This tests knowledge and understanding of professional conduct, solicitors’ accounts, financial regulation, property law, taxation, business law, contract and tort, the English legal system, constitutional law, equity and trusts, human rights and EU law. The MCT is a computer-based assessment which consists of 180 multiple choice questions, divided into two periods of two hours and 45 minutes each, with 90 questions in each session.

Part 2: Objective Structured Clinical Examination (OSCE)This tests the skills of interviewing, advocacy/oral presentation, online legal research, legal drafting and legal writing, in the context of three legal practice areas: Business Law, Litigation (Civil and Criminal) and Property Law (Conveyancing, Wills and Probate).

The skills are assessed through simulated legal environments known as OSCE ‘stations’. The OSCE is normally offered across several consecutive days.

Assessment Rules

� The MCT must be passed before the OSCE can be attempted

� There is no restriction on the number of assessment attempts you may take, nor a time limit for completing the two assessments within a certain time period

� Candidates are not allowed to use any materials during the assessments

The best analogy to the QLTS is a driving test: whilst the MCT is equivalent to the theory test element, the OSCE comprises the practical component, where you are expected to demonstrate your competence in the skills required.

Eligibility Criteria

Applicants who wish to qualify as English solicitors via the QLTS route must first ensure they meet the SRA eligibility criteria for admission.

To be eligible to apply for admission, you must hold the correct professional qualification in a jurisdiction that the SRA recognises, and meet the requirements as to character and suitability. If you are aware of anything which might prevent you from meeting these requirements, you can apply to the SRA for an early check on any character and suitability issue prior to sitting the assessments.

There is no internship or experience requirement to complete under the QLTS, nor do you have to take any separate English language test.

European Economic Area (EEA), Intra-UK and Swiss applicants may apply to the SRA for exemption from assessment if they can show they possess sufficient knowledge in a particular legal area (a fee of £400 is payable to the SRA with the application). Lawyers qualified in other countries cannot get exemptions.

Taking the Assessments

Test Dates, Venues and Fees

The assessments are offered twice a year by a sole assessment provider, Kaplan QLTS, which has been appointed by the SRA.

There are no formal requirements to comply with before taking the QLTS assessments. You can simply contact Kaplan and register to sit the assessments at any time. The MCT is delivered online in conjunction with Pearson VUE.

Following registration for the QLTS assessments, each candidate will receive an examinee number, exact locations of the testing centres and a detailed schedule of the assessments.

Candidates with special needs should contact the assessment provider with a request for specific testing arrangements.

The results of the assessments are made available a few weeks after the date of each assessment.

Admission to the Roll of Solicitors

Once you have passed the QLTS assessments and fulfilled any outstanding requirements set by the SRA, you may proceed to the next step and apply to the SRA for admission as an English solicitor.

If you do not intend to practise in England and Wales following successful completion of the assessments, you can still maintain your name on the Roll of Solicitors.

The assessment provider, Kaplan QLTS, is not allowed to provide preparation courses for the QLTS assessments.

The scope of the material, however, is very comprehensive and based on the same standards expected of lawyers who qualify through the domestic route in England and Wales. That means you must meet rigorous and robust criteria in order to pass the assessments, which require an early and profound preparation.

It is therefore extremely important that you study for the assessments with a course provider that understands your needs and will provide you with the right guidance.

If you want to become an English solicitor, a big factor in determining whether you’ll pass your QLTS assessments is the course provider itself. Without excellent teaching, informative materials, a support network and experienced staff to guide you, passing will be more difficult.

Why do you need to take a course for the MCT assessment?

The MCT is not just another standard examination. The pass mark is determined by a ‘Standard Setting Panel’ convened by the SRA based on the standards expected of a newly qualified English solicitor. The syllabus covers the entire corpus of English law, and you need to be well-prepared in order to pass.

If you’ve sat a multiple choice test in the past, you’ll know that practising as many mock exam questions as possible is the key to your success. You need to be comfortable with the format and type of questions the examiner uses in the actual test. This way, you’ll be prepared, not surprised, when test day arrives.

High Pass Rates

QLTS School has engaged ICF International (NASDAQ:ICFI), an independent, third-party research firm to conduct a market study on the MCT and validate the pass rates of our candidates.

The findings of the study, which covered three consecutive sittings of the MCT in 2013 and 2014, have shown the following:

� QLTS School’s candidates pass at about double the rate—or more—compared to non-QLTS School candidates

� About 3 out of 4 candidates who pass the assessment, study with QLTS School

� The vast majority of candidates who study with QLTS School pass on the first attempt

The OSCE Course

While the MCT element merely tests your knowledge of academic law, the OSCE practical assessment aims to test higher level of knowledge, understanding and ability to accurately advise clients using a variety of legal skills.

What makes our OSCE course unique?

If QLTS School determines that any candidate has violated the policies set forth here or any applicable laws or regulations, it reserves the right, in its sole discretion, to deny further access to the candidate’s online account, without limiting any other rights or remedies it may have. Course fees do not include any fees payable to the SRA or the assessments provider. Further applications should be made by the candidate to sit the assessments and to apply for admission as a solicitor with the SRA. QLTS School is not responsible for whether or not you meet the SRA eligibility criteria for admission. The loading time and quality of the online content depend on the bandwidth of your Internet connection. While the content is accessible through a PC, QLTS School is not responsible for any Internet connection issues, nor for the content's compatibility with tablets, Apple devices and Android devices. You acknowledge that the textbooks and access to the online MCT portal (such access referred to as the “service”) are personalised and made on request based on the number of Outcomes you are required to pass by the SRA, and that the textbooks and online materials are updated on a frequent basis due to changes in the law. Course fees must be paid in full upon enrolment and are non-refundable. Bookings will not be processed until payment is received. VAT is not applicable on the course fees. In relation to the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers expressly request and agree that the supply of the service to them will begin when we send them an email and make the service available to them for the first time. The service will be made available within 1-2 working days following receipt of the order and the payment. Consumers acknowledge that they will not have the right to cancel the order once the supply of the service has begun. Legal professionals, paralegals, lawyers, law lecturers, judges and law students hereby acknowledge that by signing up to this course, they are acting in the course of their profession. Following enrolment to the course, MCT Premium candidates will be sent a questionnaire to return to the tutor. On receipt of the questionnaire it is your responsibility to complete and return the questionnaire to your tutor and liaise with the tutor to arrange a time to be available for the initial guidance to take place. The initial consultation will take place over the phone, Skype or GoToMeeting. The customised study plan will be provided to you by email following the initial guidance. Failure to complete and return the questionnaire to the tutor, liaise with the tutor to arrange for the initial guidance, or non-appearance at the agreed time will render your initial guidance and customised study plan forfeited. The initial guidance and customised study plan will be provided to the candidate by the tutor only once. Deferral of the test, or changes in circumstances of the candidate affecting his timetable as suggested by the tutor, will not entitle the candidate to a second guidance or study plan. By providing your personal details to us, you signify your acceptance of our Privacy Policy. Whilst all reasonable care has been taken in the preparation of the course materials, neither QLTS School nor any of the authors accept responsibility for any errors it may contain or for any loss sustained, by any person placing reliance upon its contents. Consequential loss shall be deemed to include, but is not limited to, failure in any QLTS assessment, any loss of profits or anticipated profits, damage to reputation or goodwill, loss of business or anticipated business, damages, costs, expenses incurred or payable to any 3rd party or any other indirect or consequential losses. QLTS School's liability under this agreement shall not exceed the amount of the course fees (in British Pound) paid by the candidate to QLTS School. In the event of any dispute arising out of or in connection with this agreement, including any question regarding its existence, validity or termination, the seat, or legal place, of dispute resolution shall be London, UK. The language to be used in the proceedings shall be English. All disputes shall be referred to and finally resolved by arbitration under the London Court of International Arbitration (LCIA) Rules, which Rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The governing law of this agreement shall be the substantive law of England and Wales.
