WelcomeIt is my pleasure to welcome you and introduce the 2009-2010edition of the “Azerbaijan Export Catalogue” (AEC). This isthe second edition of this kind and a unique project whichaims to introduce Azerbaijan’s export potential to the world.

At present, Azerbaijan’s economic growth is one of the high-est in the world; thus, the potential of local companies is grow-ing. Our country was among the least affected by the globalfinancial crisis due to the timely policy measures by the gov-ernment. Moreover, the development of entrepreneurshipremains one of main priorities of economic reforms. As aresult Azerbaijan’s business sector is getting stronger and hasbecome a driving force for country’s development.

As a result of these positive trends many Azerbaijani companies now produce high quality products andservices that could compete regionally and internationally. However, these products and services some-times are not promoted and marketed properly. The AEC's mission is to provide the necessary marketingsupport to promote local companies' exports.

Since AEC is based on the detailed study of country’s export potential and selection of companies to rep-resent Azerbaijani business sector, we are confident that it will serve as a useful source of information forforeign companies interested in establishing successful business relations with Azerbaijani companies.

Thus AEC provides information on various companies operating in Azerbaijan that have potential and com-mitment to export their products and services, to compete internationally. And it is you, who will judge thequality of our work.

AZERBAIJAN COUNTRY PROFILEOil-rich Azerbaijan gained independence from the Soviet Union in 1991 amid political turmoil and

against a backdrop of violence in the Nagorno-Karabakh region. Azerbaijan has been known for its hydro-carbon reserves since ancient times. By the beginning of the 20th century Azerbaijan was supplying almosthalf of the world's oil. In 1994, Azerbaijan signed an oil contract worth $7.4bn with a Western consortium of11 trans-national oil companies from eight countries on development of the "Azeri", "Chiraq" and "Gunashli"oil fields in the Azerbaijani Sector of the Caspian Sea. Since then, around 18,4 billion US Dollars has beeninvested in the development of the country's oil and gas reserves. Azerbaijan hydrocarbon reserves are deliv-ered to the rest of the world through a network of pipelines, amongst which are the essential components ofthe South-West energy corridor – the Baku-Tbilisi-Ceyhan oil pipeline and Baku-Tbilisi-Erzerum gas pipelineforming a very strong partnership of the three countries of South Asia – Azerbaijan, Turkey and Georgia.

Azerbaijan is a member to a number of international organizations of global significance and impact such as:ADB, BSEC, CE, CIS, EAPC, EBRD, ECO, FAO, GCTU, GUAM, IAEA, IBRD, ICAO, ICRM, IDA, IDB, IFAD, IFC,IFRCS, ILO, IMF, IMO, Interpol, IOC, IOM, IPU, ISO, ITSO, ITU, ITUC, MIGA, NAM (observer), OAS (observer),OIC, OPCW, OSCE, PFP, SECI (observer), UN, UNCTAD, UNESCO, UNIDO, UNWTO, UPU, WCO, WFTU,WHO, WIPO, WMO, WTO (observer).

Azerbaijan became a member of the Council of Europe in 2001. The Partnership and Cooperation Agreementconcluded between the European Union and Azerbaijan entered into force in June 1999. The EuropeanNeighborhood Policy (ENP) Action Plan for Azerbaijan was adopted on 14 November, 2006 and offers Azerbaijanthe prospect of increasingly close relationships with the EU, involving a significant degree of economic integrationand deepening political cooperation.

ECONOMIC OUTLOOK AND FORECASTEconomic Outlook

According to the official statistics, in 2003-2009 domestic economy grew by 2.6 times, having reached

6.1% GDP growth in the year of global economic crisis – 2009. During 2009 GDP growth made 9.3%

(10.8% growth vs. 2008). 85% of GDP has been generated by private sector. Population income has

increased at 8.0%. Banks issued loans of USD 8.4bn or 17.4% more than in 2008 The country’s FOREX

reserves in the State Oil Fund and the Central Bank have reached the amount of USD19 bn in 2009 and will

continue growing steadily in 2010 to reach USD50 billion through proper asset management and income gen-

eration to finance social development projects

The 2009 World Bank/IFC "Doing Business" report ranks Azerbaijan the world’s top reformer country, while

according to the World Economic Forum qualifies Azerbaijan for the 51st place by competitiveness rating in the

world and for the 1st place among the CIS countries.

Forecast

The social economic strategy for 2011-2013 proposed by the Ministry of Economic Development envisages 6.8%

GDP growth with 4.9%-increase of the non-oil sector. During next three years, the government will continue allo-

cation of cheap loans for agricultural development, especially for construction of grain elevators, wheat warehous-

es and cold storages. More than USD 20 billion FDI is expected to inflow into the economy over the next 15 years

upon the launch of the Second Phase of development of one of the largest gas fields in the Caspian Sea -

Shahdeniz gas field.

Independent international monitors (Emerging European Monitor) estimate that Azerbaijan posted real GDP growth

of 5.0% over the first eight months of the year, by that having performed as the only Caucasus country to avoid reces-

sion. Sustained expansion of industrial output volumes helped to lift headline growth, while the stabilization of oil

prices through Q209-Q309 has also improved the investment outlook over the medium term. EEM estimates that the

Azeri economy to grow by 3.8% by the end of 2009 and accelerating back to 9.0% growth in 2010. The country’s

leadership has pledged to continue all social and infrastructure projects and secure macroeconomic stability in 2010.

Draft State Budget 2010: Infrastructure and social protection are key to the nation’s development

The State Budget continues applying conservative policy of the previous years and estimates the price of USD45 per

one barrel of oil. 2010 budget revenues are set at approx USD 14.3bn and expenditures-USD15.1bn respectively. The

Budget envisages extensive allocations around USD5bn for social, infrastructural, and investment projects. In 2010,

the government will progressively sponsor construction of highways, water, gas and power lines, power plants and

water dams in order to strengthen the domestic economy and address regional development agenda.

Infrastructure

In 2010, the largest state-sponsored infrastructural projects aim to solve the problems of water supply and energy

security in the Baku City and the regions of Azerbaijan. Such projects are construction of the Oguz-Gabala-Baku water

channel, Takhtakorpu Water Reservoir, Samur-Absheron water channel, and Shamkirchay water reservoir. Given the

domestic energy resources supply-demand balance, the government plans to implement more alternative energy pro-

duction projects. Particular attention will be given to utilization of mountainous rivers potential through construction of

2-3 megawatt power stations. Significant attention and budget allocations are envisaged for utilization of solar and

wind energy.

Social protection

The Draft 2010 budget social spending will make USD 4.65bn or 34.4% of total expenditures in the following distri-

bution: USD3.9bn for science, education, healthcare, social protection, culture, physical culture and youth;

USD1.3bn for raise of effectiveness of the national social protection system, improvement of living conditions of peo-

ple and living standards of the low-income families, financing of basic part of labor pensions and other social meas-

ures and the remaining amount to be channeled to address social aids and other social measures, and aid to

refugees and IDPs.

Taxation

According to the Tax Code of the Azerbaijan Republic the taxes shall not be of discriminatory nature and shall not

be established based on the political, ideological, ethnic, confessional or other existing differences between taxpay-

ers.

Trade Liberalization

Azerbaijan has an observer status at the WTO. Import of alcohol, alcoholic drinks, and tobacco as well as food prod-

ucts of animal origin are subject to licensing. Imports of large communication equipment must be authorized by the

Ministry of Communications. Apart from the commodities that are subject to export restriction, exports are not subject

to licensing.

Main Features of Customs Regulations

Import Tariffs

Today, imports are subjects to ad valorem duties at uniform rates at 0.5%, 3%, 5% and 15% of declared customs value.

Some goods are granted duty free entry.

Tariff Exemptions

According to Article 34 of the law on “Customs Tariff”, a duty free import regime applies to the following: medical equip-

ment and medicines, humanitarian goods and some products for military use, property contributed by foreign investors

to the equity capital of joint ventures and goods for official use by diplomatic missions and international organizations.

Moreover, customs duties are not applied on goods imported under bilateral free trade treaties.

Special provisions for imports by companies working in the oil sector are an integral part of the Product Sharing

Agreements between the Government and respected oil companies. Goods, tools, equipment, supplies and services

used under the Product Sharing Agreements are duty free as well as exempt from VAT. This regime is also extended

to foreign firms registered in Azerbaijan and providing services to the contractor parties as well as respected foreign

sub-contractors.

There are no other duty free-exemptions from custom duties for imports used as factors of productions for export

products. This is one of serious obstacles for exports by the non-oil sector, since many components need to be

imported.

Import Quotas. Prohibitions

There are import quotas on ethyl alcohol, alcohol beverages and tobacco products.

Exports tariffs

Domestic export tariffs are applied for the “non-precious metals and products thereof” (especially, Group 72 (fer-

rous metals) and Croup 76 (aluminium and articles thereof). In these groups tariffs are applied to about 75 prod-

uct items (51 of them from Group 72; 9 – Group 76; 15 – Groups 78, 79 and 80). Exports tariffs are estimated

as 5 USD per tone for ferrous metals, 15 USD per ton for aluminium and articles thereof, lead and articles

thereof, zinc and articles thereof, tin and articles thereof.

Export Restrictions

Export of works of arts, weapons, explosives, radioactive materials and wastes, narcotics, and psychotic

drugs are prohibited. In addition, exports of strategic commodities produced in Azerbaijan are restricted;

such commodities include: petroleum products, cotton, electric power and non/ferrous metals.

Export subsidies

Azerbaijan does not maintain any agro export subsidies. In Azerbaijan farmers are exempt from VAT

while imported agro-products are not. GATT requires equal taxation of domestic and imported goods.

While GATT requires equal application of taxation, Azerbaijan applies higher excise tax rates on

imports than domestic goods for a number of products.

Conclusion:

Given the country’s steadily growing positive economic performance during the last decade due

to rich hydrocarbon reserves and stable political environment, quite effective anti-economic cri-

sis strategy in 2008-2009, Azerbaijan, in 2010, and for the years to come, will remain as a very high-

margin, attractive destination for doing business.

The National Confederation of Entrepreneurs (Employers’)Organizations of Azerbaijan Republic was established on March 5, 1999and officially registered on April 9, 1999. The Confederation is republic-wide public union of international standing which protects interests ofbusinessmen and supports entrepreneurship development. More than4000 entrepreneurial entities including well-established companies,banks and company groups as well as about 50 economic and socialoriented Association and Unions, NGOs are currently members ofNational Confederation of Entrepreneurs (Employers) Organizations ofAzerbaijan Republic. There were established 10 permanentcommissions covering all the spheres and 10 regional representationsunder Confederation to broaden business relations between membersand to increase team work effectiveness. The confederation’s activity is based on The Constitution of Republic of Azerbaijan, law of Azerbaijan Republic “Onnon-governmental organizations”, other normative legal acts and the statue of the confederation. General Collective Agreement signed between Cabinet ofMinisters, Trade Unions Confederation and AEC in social-economic policy development and labour regulations inAzerbaijan since 2001. Main objectives of the confederations areto contribute into promoting successful integration into the worldeconomy, to facilitate solution of existing problems of the country,to foster creation of new jobs and to increase professionalism ofthe population and support entrepreneurship development. TUSIAB played a great role in improving modern life standards in Azerbaijan, supporting the formation

of the structure of Azerbaijan's economy to meet modern standards, in joining in the ranks of developed

countries that solved the majority of economic and social problems.

Turkey and Turkish businessmen sharing historical roots with Azerbaijan made an investment in Azerbaijan

during very risky periods, which in turn provided an impetus for the development of the economy and

integration to the world economy. Businessmen willing to invest into Azerbaijan were given information

about Azerbaijan through TUSIAB which in turn improved economic, social and cultural relations between the

two countries and helped hundreds of businessmen to invest.

Exhibitions and business-forums assisted Turkish goods in entering Azerbaijani market.

TUSIAB continues its activities in many cities and regions of Azerbaijan like Baku, Ganja, Sumgait, Zagatala,

Goychay, Absheron, Tovuz, Qabala, Sheki, Hacikabul, Shamahi, Agdash, Lankaran.

Turkish investments into Azerbaijan are among the first non-oil foreign direct investments. Turkish companies

operate in industry and processing, telecommunication, construction, mass-media, food, textile, education, health,

banking and insurance, logistics, electronics and oil sectors.

Social and cultural activities of TUSIAB

TUSIAB sponsored several events improving social and cultural relations between the two countries and at the same

time supported many cultural projects. TUSIAB publishes monthly “BULTEN” that contains information about

economic analysis and “DYALOG” live broadcasts three times in a month shedding light to the Economic, Social,

Cultural events.

TUSIAB’s website www.tusiab.org is one of the most used sites in Azerbaijan and became a major search engine

for those who are willing to invest into Azerbaijan.

TUSIAB aid and organizational activities

TUSIAB, within the framework of enlightenment, career seminars and conferences organized “Traditional kite fly

festival”, “Football Competition”. Moreover, TUSIAB supports martyrs family, poor people and students.
