Q 5 How does the current points test distort outcomes for a skilled migrant?
The current points test does not always lead to outcomes that are consistent with the objectives of General Skilled Migration Program, which is to focus on applicants with high value skills that will meet Australia’s medium to long-term economic needs.

On 8 February 2010, the Minister for Immigration and Citizenship, Senator Chris Evans, announced the outcomes of a review of the Migration Occupations in Demand List (MODL).
The review found that the existing MODL needed to be revoked and replaced by a more targeted skilled occupations list to better meet the demands of Australia’s labour market.
The revocation of the current MODL will not affect those who at the date of announcement:
• hold a Skilled—Graduate (subclass 485) visa, or have a pending subclass 485 visa application and are yet to apply for a permanent or provisional General Skilled Migration (GSM) visa, or
• have a pending GSM visa application.
New Skilled Occupation List from mid-2010
On 8 February 2010, the minister also announced the replacement of the current Skilled Occupation List (SOL) in the second half of 2010, with a new list of targeted occupations determined by the independent body, ‘Skills Australia’. As the new SOL will be a comprehensive, targeted list, the current Critical Skills List will be revoked.
The new SOL will come into effect from mid-2010 and will apply to all applicants lodging visa applications made on or after this date, except to GSM applicants who at the date of announcement ( 8 February 2010):
• hold a Skilled—Graduate (subclass 485) visa, or had a pending subclass 485 visa application and had not yet lodged an application for a provisional or permanent GSM visa and who make an application by 31 December 2012, or
• have a pending GSM visa application.
In addition, the new SOL will not apply to people applying for a Skilled—Graduate (subclass 485) visa who at 8 February 2010 hold a:
• Vocational Education and Training Sector (subclass 572) visa
• Higher Education Sector (subclass 573) visa
• Postgraduate Research Sector (subclass 574) visa.
However these student visa holders will be required to have an occupation on the new SOL to apply for a permanent GSM visa.
GSM applications lodged before 1 September 2007
Under section 39 of the Migration Act 1958, the Minister for Immigration and Citizenship has the power to set a maximum number of visas of a class that may be granted in a particular financial year.
On 8 February 2010, the minister announced he would set a maximum number of offshore GSM visa applications made before 1 September 2007 that could be granted. Once this number is reached, any applications awaiting a decision will not be considered and the application returned to the applicant or their authorised recipient. These applications will be taken not to have been made.
Refunds of the visa application charge (VAC) will be made to the payer of these charges for affected visa applicants.

Introduction of New Points Test It is proposed that a new points test for skilled migration visa applications will be introduced on 1 July 2011. It complements the series of reforms the Australian Government announced in February 2010. The new points test is focused on selecting highly skilled people to deliver a more responsive and targeted migration program. It was developed following a review of the current points test, which considered submissions from a variety of experts and the wider Australian community. The new points test balances the different factors that are considered when determining whether someone will be granted a skilled migration visa. It will deliver the best and brightest skilled migrants by emphasising high level qualifications, better English language levels and extensive skilled work experience. The new points test will continue to award points for study in Australia, including regional study, community languages, partner skills and completing an approved Professional Year. Points will no longer be awarded on the basis of an applicant’s occupation, but all applicants must still nominate an occupation on the applicable Skilled Occupation List. It is important to note that the new points test will only apply to one component of the skilled migration program. This change won’t affect every type of skilled migration visa and only applies to the following visas.

Transitional arrangements apply to people who, on 8 February 2010 held or had applied for a Temporary Skilled Graduate visa (subclass 485). Frequently Asked Questions - New Points Test Why is a new points test being introduced? On 8 February 2010, the Australian Government announced a series of reforms to the skilled migration program, including a review of the points test. The points test review found the current points test had led to a skewing of applications toward a small number of occupations and does not always lead to outcomes that are consistent with the objectives of the skilled migration program. How was the new points test developed? The Department of Immigration and Citizenship consulted widely in developing the new points test. On 15 February 2010, the department released a discussion paper inviting responses from stakeholders and the general public. More than 220 responses were received from a variety of individuals and organisations including industry peak bodies, education providers, migration agents, current and former international students, prospective migrants from outside Australia and the wider Australian community. State and territory governments were also consulted on the various options under consideration. The department also took into account research on what aspects of the skilled migration program delivered the greatest contribution to the Australian economy. How is the new points test different from the current points test? The new points test provides for migrants with a better balance of skills and attributes. As no one factor will guarantee migration, successful migrants will need to possess a combination of skills and experience. The changes focus on better English language skills, more extensive skilled work experience, higher level qualifications obtained in Australia and overseas and different age ranges. The new points test will continue to award points for study in Australia, regional study, community languages, partner skills and a Professional Year. Points will no longer be awarded on the basis of an applicant’s occupation, but all applicants must still nominate an occupation on the applicable Skilled Occupation List. After 1 July 2011, if you are not eligible for transitional arrangements and you lodge an application for any of the visas listed above, you will need to meet the requirement of the new points test Will the pass mark change under the new points test? Yes. The pass mark is a tool that allows for management of the skilled migration program and is always subject to change. It is expected that the pass mark will be set at 65 points. There will no longer be a distinction in the pass mark between independent and sponsored visas and permanent and provisional visas. I am considering applying for a points tested visa. Should I apply now, or wait until the new points test is introduced? The decision is one for you to make. The department recommends you carefully consider your situation to determine whether the current or the new points test would be of most benefit to you. For example, people with higher level qualifications, English language proficiency or more extensive skilled work experience may benefit under the new points test. I have already lodged an application for a GSM visa. Can I choose to have my application assessed under the new points test? No. Applications lodged before 1 July 2011 will be assessed against the current points test. If you want to have your application assessed against the new points test, you will need to lodge a new application after the new points test is introduced. It is important to note that if you choose to lodge a new application, you will be required to pay a new Visa Application Charge (VAC). You will not be able to have the VAC you paid in association with your first visa application refunded.
I will not be ready to lodge an application before 1 July 2011 and under the new points test I don’t think I will be able to meet the pass mark. What are my options? Australia is fortunate in that there are many more people seeking migration than places available. Skilled migration to Australia is highly competitive and requirements adjust over time according to Australia’s skills needs. Not everyone will be able to meet the requirements for skilled migration. You may want to consider your eligibility to apply for an alternative migration option, such as the Employer Nomination Scheme or Regional Sponsored Migration Scheme. Australia’s skilled migration program is run to benefit Australia. The program is designed to help deliver the skills the Australian economy needs. The skilled migration program must remain flexible to adjust to economic circumstances to select the best people to contribute to Australia’s future. The program will continue to change over time. The introduction of the new points test is part of a suite of reforms announced on the 8 February 2010 aimed at delivering a skilled migration program that will select migrants with the high value, nation-building skills that are needed by the Australian economy and labour market. Why have occupation points been removed from the new points test? The points test review found that the current points test gives undue weight to a person’s occupation, as an applicant can claim up to half the points needed to meet the pass mark on the basis of their nominated occupation alone. The introduction of a more targeted Skilled Occupation List (SOL) means it is no longer necessary to award points on the basis of occupation, as all applicants must nominate an occupation from the new list. Will the new points test changes apply to the threshold age requirements? Yes. The maximum age threshold for applicants will be raised from 45 to 49. This recognises that in many professions, workers do not reach their full potential until their mid to late 40s, and that significant work experience is a key factor in determining a skilled migrant’s labour market performance. While applicants aged 45-49 will be eligible to apply, no points will be awarded for age. This means that those applicants will have to have outstanding results in other areas in order to meet the pass mark. Will the new points test change the allocation of points across different age brackets? Yes. Australian Bureau of Statistics data and the department’s research indicate that highly skilled migrants who come to Australia between the ages of 25-32 add the most benefit to the Australian economy in terms of lifetime earnings. I am over the age of 45 and wish to apply. Do I need to wait until the new points test is introduced? Yes. The maximum age requirement will not be increased until the new points test comes into effect. Is there a new minimum English language requirement? For all skilled migration points tested visas the threshold English language requirement will be Competent English, which is a minimum score of 6 in each of the four components of the International English Language Testing System (IELTS) test. No points will be awarded for English language where an applicant has Competent English. Will the new points test allow applicants to claim points for higher levels of English language proficiency? Yes. The new points test will recognise applicants with higher levels of English language proficiency. The new points test will award points for English language ability as follows. Points Description of English language ability 20 Superior English (a score of at least 8 in each of the four components
of the IELTS test). 10 Proficient English (a score of at least 7 in each of the four
components of the IELTS test). Will the new points test award points for both overseas and Australian work experience? Yes. The new points test gives more recognition to applicants who have more extensive skilled work experience, either in Australia or overseas. Will the new points test award points for experience in any skilled occupation? No. To claim points for work experience under the new points test, the experience must be in an applicant’s nominated occupation, or a closely related occupation. I have worked in my nominated occupation in Australia and overseas. Can I claim points for both overseas and Australian work experience? Yes. If you are able to meet the requirements to claim points for both Australian work experience and overseas work experience under the points test then you will be recognised for both. For example, an applicant who has worked in their nominated occupation overseas for three out of the past five years and in Australia for one in the past two years will be able to claim ten points for work experience – five points for their overseas work experience and five points for their Australian work experience. Why are more points awarded for Australian work experience, compared with the same length of overseas experience? The points test recognises the extra value Australian work experience provides in assisting migrants find skilled employment and settle easily in Australia. Will points still be awarded under the new points test for the completion of a Professional Year? Yes. Under the new points test, five points will be awarded to applicants who complete an approved Professional Year in their nominated occupation or a closely related skilled occupation. Under the new points test will applicants be able to claim points for both a Professional Year and Australian work experience? Yes. The current points test is designed so that applicants can only claim points for either Australian work experience or the completion of a Professional Year. The new points test allows an applicant to claim points for both completing a Professional Year and meeting work experience requirements. It is important to note however that work conducted as part of the Professional Year program will not be eligible for consideration as work experience. What points will be awarded for education qualifications? The following table outlines the number of points awarded for an applicant’s highest education qualification. Why will the new points test award more points to higher level qualifications? The new points test awards more points to certain higher level qualifications as higher level qualifications generally result in increased earning capacity. Why doesn’t the new points test award extra points to an applicant who studies a Master program after completing their Bachelor Degree? Applicants who complete a Master program after completing a Bachelors degree are not awarded extra points, as research indicates that the labour market outcomes of previous skilled migrants have not been improved by holding a Masters degree.

Under the new points test will I be able to claim points for two qualifications? No. The new points test will only allow applicants to claim points for their highest level qualification. For example, if an applicant has completed a Bachelors Degree and a PhD, they will only be able to claim points for the PhD. To claim points for a qualification or apprenticeship obtained overseas, do I have to have the qualification recognised? Yes. To claim points for a qualification or apprenticeship obtained overseas, it will need to be recognised as being of a standard comparable to that awarded by an Australian education institution. Further information regarding the process for having an overseas qualification or apprenticeship recognised will be made available closer to the date of implementation of the new points test. Are there any restrictions on what Australian qualifications can be used to claim points? Yes. To claim points for an Australian qualification, the qualification must have been undertaken while the applicant was in Australia and it must have been completed as the result of a course of study that was at least two academic years (that is, 92 weeks as registered on the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS)). Will the new points test still allow points to be claimed for the Australian study requirement? Yes. Applicants who have studied in Australia and who have met the Australian study requirement will be eligible for five points under the new points test. Under the new points test can I use the same period of study to claim points for both qualifications and Australian study? Yes. The new points test will allow applicants who have studied in Australia to use the same period of study to claim points for qualifications and for meeting the Australian study requirement. For example, if you obtain a PhD and meet the Australian study requirement, you can claim 20 points for the PhD and five points for the study in Australia. Will the new points test continue to award points to applicants who have studied in regional Australia? Yes. Under the new points test applicants who satisfy the Australia study requirement while studying in regional Australia will continue to be awarded an additional five points. These points will be available in addition to points claimed for the qualification and for meeting the Australian study requirement. Under the new points test will applicants still be able to claim points for fluency in a designated community language? Yes. The new points test will award five points to applicants who meet the requirements to claim points for community language. Will the new points test change the evidence required to claim points for community language? Yes. The new points test will recognise applicants who are accredited by the National Accreditation Authority for Translators and Interpreters (NAATI) in a designated language. Points for designated language will no longer be able to be claimed on the basis of having obtained a qualification from a university where instruction was in that language.

Will applicants still be able to claim points for partner skills under the new points test? Yes. The new points test will continue to award five points where the primary applicant’s partner satisfies the threshold criteria for GSM. Under the new points test, to claim partner points the primary applicant’s partner will need to meet the following criteria: • be included on the same visa application as the primary applicant • not be an Australian permanent resident or citizen • be less than 50 years old at the time of application • nominate an occupation on the Skilled Occupation List, and be assessed by the relevant
assessing authority as having suitable skills for the occupation • have Competent English • have been employed in a skilled occupation for at least 12 months in the 24 months before
the application is lodged. Will the new points test change the award of points for sponsorship? Yes. The new points test will award points for sponsorship as follows. Points Description of sponsorship 5 Nomination by a state or territory government under a state
migration plan, for the purposes of a subclass 176 or 886 application.
10 Nomination by a state or territory government under a state migration plan, or sponsorship by an eligible relative, to a regional area for the purposes of a subclass 487 or subclass 475 Skilled – Regional Sponsored application.
Will family sponsored applicants still be eligible to apply for a permanent Skilled – Sponsored visa? No. As part of the changes accompanying the introduction of the new points test, from 1 July 2011 applicants for the Skilled – Sponsored subclass 176 or 886 visa subclasses will need to be sponsored by a state or territory government under a state migration plan. There will no longer be a permanent family sponsored skilled migration visa however eligible family members can still sponsor relatives under the provisional sponsored skilled migration visa. Holders of a provisional sponsored skilled migration visa may be eligible for a Skilled Regional (Residence) visa (subclass 887) after meeting certain eligibility criteria. Will family sponsored applicants still be able to apply for a provisional Regional Sponsored visa? Yes. The new points test will continue to award points to applicants for a subclass 475 or subclass 487 who are sponsored to a regional area by an eligible family member or a state or territory government under a state migration plan. Holders of either of these provisional sponsored skilled migration visas may be eligible for a Skilled Regional (Residence) visa (subclass 887) after meeting certain eligibility criteria.

State and Territory governments may nominate visa applicants who have an occupation that is in shortage in their particular State or Territory. The Regional Sponsored Migration Scheme (RSMS) allows employers in regional or low population growth areas of Australia, to sponsor employees who are foreign nationals for a permanent visa to work in Australia.
Who is this visa for? This visa is for employers operating in regional and low population growth areas of Australia, who want to sponsor skilled workers to fill skilled vacancies in their business.
The employees applying for a visa can be either of the following:
skilled workers from overseas skilled temporary residents currently in Australia.
Visa applicants who are currently living and/or working in Australia on a qualifying visa can apply for the onshore RSMS (subclass 857) visa. These Frequently Asked Questions (FAQs) are designed for clients who have already lodged an application for General Skilled Migration (GSM). These FAQs should be read with the information about the priority processing arrangements. Please note: These FAQs will continue to be updated in response to common questions received from clients about the changes. The Minister for Immigration and Citizenship, Senator Chris Evans, set new priority processing arrangements for certain skilled migration visas on 14 July 2010. These priority processing arrangements apply to all applications already lodged with the Department of Immigration and Citizenship, as well as all future applications. QI What is priority processing? Priority processing refers to the order in which the department considers skilled migration applications. Section 51 of the Migration Act 1958 gives the Minister for Immigration and Citizenship powers to consider and finalise visa applications in an order of priority that the Minister considers appropriate. Departmental officers must follow this ministerial direction, which applies to both new applications and those applications awaiting a decision. Q2 What are the changes to the skilled migration visa processing priorities? The Minister has set new priority processing arrangements which apply to the following visas: • Employer Nomination Scheme (ENS) • Regional Sponsored Migration Scheme (RSMS) • Certain General Skilled Migration (GSM) visas. Under the arrangements, processing priorities (with the highest priority listed first) are: 1. Applications from people who are employer sponsored under the ENS and the RSMS. 2. Applications from people who are nominated by a state or territory government agency with a nominated
occupation that is specified on that state or territory’s state migration plan. 3. Applications from people who have nominated an occupation on the new Skilled Occupation List (SOL) –

Applications where it is readily apparent that the criteria for grant of the visa would not be satisfied. Applications by visa applicants claiming to be a member of the family unit of a person who holds a visa
granted on the basis of satisfying the primary criteria in Schedule 2 to the Regulations and who did not make a combined application with that person.

Q6 The new direction refers to Schedule 3 of the Skilled Occupation list (SOL) what do these
schedules refer to?

The Skilled Occupation List (SOL) is a list of occupations that are accepted for general skilled migration. Applicants must have a nominated occupation which is on the SOL that applies to them at the time they apply. The recent changes to skilled migration have included generous transitional arrangements for some people. These arrangements require that the previous version of the SOL be kept available for those people so they can access their transitional arrangements. The changes also included a change in the way occupations are classified, from ASCO to ANZSCO. This change required that the previous version of the SOL be provided in both the ASCO and ANZSCO coding. The different SOLs are distinguished by different schedules, as follows: • the SOL in existence prior to 1 July 2010 in ASCO code (schedule 1) — applies only to GSM applicants
who lodged their application prior to 1 July 2010. • the SOL in existence prior to 1 July 2010 in ANZSCO code (schedule 2) — applies to GSM applicants
who are eligible for transitional arrangements and who lodge their application before 1 January 2013. • the current SOL (schedule 3) in effect from 1 July 2010 — applies to all new GSM applications,
including applicants eligible for transitional arrangements if they prefer to use it. • the State and Territory SOL (schedule 4 ) — applies only to GSM applicants nominated by a State or

State Migration plans are developed by state or territory governments and include occupations that are in demand in an individual state or territory. Each state migration plan is approved by the Minister for Immigration and Citizenship. State migration plans are currently being developed and are expected to come into effect during the second half of 2010. A notice will be put on the department’s website when plans come into effect. Q8 Why have the processing priorities changed? The priority processing arrangements take account of the changes to the SOL that came into effect on 1 July 2010, as well as the revocation of the Migration Occupations in Demand List (MODL) and the Critical Skills List (CSL). These changes to priority processing simplify previous arrangements. Many applicants will find that they are in a higher priority group. Some will have to wait longer for their visas to be processed.

Q9 When did the changes to priority processing come into effect? The changes took effect from 14 July 2010 and apply to applications lodged with the department on or after this date. The changes also apply to applications lodged before 14 July 2010 that have not been finalised. Q10 Is there any difference in the processing priorities that apply to onshore and offshore visa
subclasses? No, the processing priorities apply to both onshore and offshore applications. Processing times, however may vary for onshore and offshore applications Q11 What will happen to applications in the final stages of processing where the department has
requested applicants to provide health and character clearances? The new arrangements apply to all visa applications, including those in the final stages of processing. Applications in lower priority groups cannot be processed further until those in higher priority groups are finalised in accordance with the priority processing direction. Q12 Can I request that my application be given higher priority outside of the Minister’s Direction? No, please do not contact the department to request your application be exempt from the priority processing direction. Case officers must adhere to the Minister for Immigration and Citizenship’s priority processing direction. Q13 My nominated occupation is Accountant but I was not eligible for the CSL. What level of
priority processing will I receive? The occupation of Accountant is included on Schedule 3 of the current Skilled Occupation List (SOL) and therefore your application will be in priority group 3, except those already included in priority groups 1 or 2. Q14 My application is in priority category 4. When can I expect to have my application finalised? Applicants with nominated occupations in priority group 4 will have a long wait for visa processing. The department’s Client Service Charter will be updated shortly with information about current estimated processing times. State Migration Plan. What level of priority processing will my application receive? If your nominated occupation is not on your state or territory’s State Migration Plan, your application will be processed on the basis of your nominated occupation. Applicants who have nominated an occupation that is included in Schedule 3 of the current SOL are in priority processing group 3. An applicant with a nominated occupation that is included only in Schedule 1 or Schedule 2 of the current SOL is in priority processing group 4.

Q16 If my nominated occupation is not in Schedule 3 of the SOL in effect at 1 July 2010 what level of priority processing will I receive?
Applicants with a nominated occupation that is included only in Schedule 1 or Schedule 2 of the current SOL are in priority processing group 4, unless they have applied for ENS or RSMS or have a state or territory nomination in an occupation on a state migration plan. Q17 I applied for GSM. If my nominated occupation is not in Schedule 3 of the SOL in effect at
1 July 2010 can my application receive higher priority processing? Yes if you are nominated by a state or territory government under a state migration plan. Applicants who lodged before 1 July 2010 that have been nominated by a state or territory government agency in an occupation that is subsequently specified in their nominating state or territory’s state migration plan will receive processing under priority group 2. Q18 What are my options if my application is in priority group 4 and I have applied for an onshore
GSM visa? The options available are:
• continue to live and work in Australia (if your visa permits) while you await a decision on your visa application
• assess your eligibility for an employer sponsored visa or a nomination by a state or territory government under a state migration plan agreed to by the minister
• apply for another substantive visa • withdraw your application and depart Australia.
Please note: Some of these options would require the lodgement of a new application and the payment of a new Visa Application Charge (VAC). If you choose to withdraw your application you will not be entitled to a refund of your VAC. visa is finalised can I remain in Australia while my visa is processed? Applicants for an offshore GSM visa are not eligible for an associated bridging visa to remain in Australia while their GSM application is being processed. You must apply for another visa to remain in Australia lawfully; otherwise you will need to depart Australia. Q21 I am an onshore GSM applicant on a Bridging C visa which does not allow me to work. What
can I do? It is possible to be granted a Bridging C visa that will allow you to work. Please complete a Form 1005 Application for a bridging visa and submit this and supporting documentation evidencing financial hardship to the skilled processing centre processing your visa application. Examples of the types of supporting documents required include a statement outlining income against outgoing expenses. Other examples may include living expenses such as accommodation costs and other bills. Q22 I want to travel overseas but my onshore visa application has not been finalised. What should I
do? If you were granted a Bridging A visa when you applied for your GSM visa you may be able to lodge an application for a Bridging B visa to allow you to travel and return to Australia (within a specified period). A Bridging B visa is generally not issued for longer than three months. You must apply for a Bridging B visa at one of the department’s state or territory offices, not the skilled processing centre which is processing your GSM application. Yes, applications for subsequent entrants for provisional GSM visas are exempt from priority processing arrangements. These arrangements apply to the following GSM visas:

due to the new priority processing direction? Compensation is not available for delays in processing. Q25 Why do the rules keep changing? The skilled migration program is designed to be responsive to the current economic climate and the needs of the Australian economy. The new priority processing arrangements complement other recent changes to skilled migration to ensure that the economy gets the skills it needs in a timely manner. Priority processing arrangements are always subject to further change in response to the economic climate and the demand for particular skills in the Australian economy. Priority in the skilled migration program goes to those who can provide the skills Australia most needs, rather than those visa applicants who applied first. The Australian Government is aware that the priority processing arrangements impact on many applicants. These changes to priority processing simplify previous arrangements. Many applicants will find that they are in a higher priority group. Some will have to wait longer for their visas to be processed. Q26 Isn’t priority processing retrospective legislation? Priority processing is an administrative arrangement, and impacts on the order in which applications are considered. It is not retrospective legislation as it does not change the criteria for the grant of a GSM visa. Minister's announcement about the new points test – 11 November 2010 On 11 November 2010 the Minister for Immigration and Citizenship, the Hon Chris Bowen MP, announced the government's intention to implement a new points test applying to certain skilled migration applications made on or after 1 July 2011. The new points test will not apply to unfinalised applications lodged prior to 1 July 2011.

Introduction the Australian and New Zealand Standard Classification of Occupations (ANZSCO) – 1 July 2010 ANZSCO is a classification system that provides for the standardised collection, analysis, and dissemination of occupation data. From 1 July 2010 ANZSCO will replace the Australian Standard Classification of Occupations (ASCO) currently used by the department. Capping and ceasing of specified offshore GSM applications lodged before 1 September 2007 – 1 July 2010 On 8 February 2010, the Minister for Immigration and Citizenship, Senator Chris Evans, announced that applications for certain offshore skilled migration visas made before 1 September 2007 would be capped and ceased. The Minister has now set the maximum number of visas that can be granted for the specified visa classes in the 2009-10 financial year. As the cap has now been reached,

Changes to state nominated and family sponsored GSM visas –1 July 2010 From 1 July 2010, applicants for certain GSM applications will be required to demonstrate that they have been nominated by a state or territory government agency or sponsored by an eligible relative apply. These amendments relate to the following visa subclasses:
Skilled – Sponsored (Migrant) Visa (Subclass 176) Skilled – Sponsored (Residence) Visa (Subclass 886) Skilled – Regional Sponsored (Provisional) Visa (Subclass 475) Skilled – Regional Sponsored (Provisional) visa (subclass 487)
Departmental forms and systems currently do not facilitate proof of nomination or sponsorship at time of lodgement. However, system changes are currently being pursued.
In the meantime, to lodge a valid application, applicants should lodge their visa application form once the relevant state or territory government agency or sponsoring relative have agreed to sponsor them. The nominating state or territory government agency or sponsoring eligible relative should then complete the associated nomination or sponsorship form using the TRN number provided to the visa applicant when lodging the visa application. The nominating state or territory government agency or sponsoring relative should lodge the form within 28 days to demonstrate that the applicant is nominated or sponsored.
Migration Amendment (Visa Capping) Bill 2010 On 26 May 2010 the Migration Amendment (Visa Capping) Bill 2010 (the 'Bill') was introduced into the Parliament and was referred to the Senate Legal and Constitutional Affairs Committee for report and inquiry.
The Bill was not passed when the Parliament was prorogued for the election and, as a result, it lapsed on Friday 19 July 2010. Because of this, the Committee has determined not to continue its inquiry into the Bill. It is for the incoming Government to decide whether the Bill will be re-introduced into the new Parliament after the election. If the Bill is re-introduced into the new Parliament, the Senate can again refer it to the Committee for inquiry.
Changes to the time of provision of evidence of English language ability There are new arrangements for the provision of evidence for English language ability. Applicants for the following GSM subclasses have until the time of decision to provide evidence of their English language ability.
Skilled – Independent (Residence) visa (subclass 885) Skilled – Sponsored (Residence) visa (subclass 886) Skilled – Independent (Migrant) visa (subclass 175) Skilled – Sponsored (Migrant) visa (subclass 176) Skilled – Provisional (Regional Sponsored) visa (subclass 475) Skilled – Provisional (Recognised Graduate) visa (subclass 476)

Skilled – Provisional (Graduate) visa (subclass 485) Skilled – Provisional (Regional Sponsored) visa (subclass 487).
Applicants should not delay in providing their evidence of English language ability. The department will not delay finalising applications where English language test results have not been provided at time of application. Applicants will have 28 days from the date of application to provide their English language results if they did not provide them at time of application. At this point in time, if evidence has not been provided the application will be refused.
New administrative arrangements to meet the health requirement when you make your onshore GSM application – 22 March 2010 Applicants for an onshore General Skilled Migration (GSM) visa must show evidence at the time they make their application, that they have made arrangements to undergo a medical examination.
From 22 March 2010, applicants for an onshore GSM visa need only obtain a reference number from Medibank Health Solutions to meet the time of application health requirement. Applicants should phone Medibank Health Solutions and state that they are applying for a GSM visa and request a reference number. This reference number must then be provided as evidence as part of their GSM application. Note: Applicants must ensure that they retain a copy of this reference number.
Applicants will be requested to undertake a medical examination by their case officer at a later date.
Applicants who have already applied for GSM and have either made a booking for a medical examination or undertaken their medical examination, do not need to obtain a reference number.
Minister's announcement on GSM visas – 8 February 2010 On 8 February 2010, the Minister for Immigration and Citizenship, Senator Chris Evans, announced the following changes to the General Skilled Migration program:

1 January 2010 legislative change – suitable skills assessment as a validity requirement for onshore GSM visas Pre 1 January 2010, applicants applying for permanent migration based on one of the onshore General Skilled Migration (GSM) visa subclasses were required, at time of application, to provide evidence that they had applied for a skills assessment by the relevant assessing authority. At time of decision, a suitable skills assessment was required.
From 1 January 2010, applicants applying for one of the following onshore GSM visa subclasses are required to have obtained a suitable skills assessment prior to applying for migration in order for the application to be valid and assessed by the department for a decision:

Recent changes to General Skilled Migration Information for current and former student visa holders
In February 2010, the Australian Government announced a number of changes to its Skilled Migration program. These changes included the withdrawal of the Migration Occupation in Demand List and the introduction of a new Skilled Occupation List. These changes were not retrospective. Anyone who had applied for a General Skilled Migration visa before the announcement of the changes will be assessed on the basis of the old Skilled Occupation list.
The changes included generous transitional arrangements which have been extended to current and former students. These transitional arrangements are in place until the end of 2012.
• They allow anyone who held or had applied for a Temporary Skilled Graduate visa (subclass 485) on 8 February 2010 to apply for permanent General Skilled Migration on the basis of the old Skilled Occupation List.
• They also allow anyone who held a qualifying Student visa when the changes were announced on 8 February 2010 to apply for a Temporary Skilled Graduate visa (Subclass 485) on the basis of the old Skilled Occupation List. Qualifying student visas are subclasses 572, 573 and 574.
The Temporary Skilled Graduate visa (Subclass 485) provides a stay period of 18 months and allows the holder to work or study in Australia.
These arrangements provide current and former students with time to explore further visa options. Apart from General Skilled Migration, other visa options are available through employer or state/territory sponsorship. Information about other visa options can be found on the department’s website. It is important to understand that while there are visa options, there can be no guarantee of a further visa. The grant of a further visa depends on whether an individual applicant meets the requirements for that visa at the time they apply.

Applicants must contact these assessing authorities to obtain valid skills assessment. The Skilled Occupation List (SOL) instrument lists previous relevant skills assessing authorities in the assessing authority column. A valid (a skills assessment that has not expired) skills assessment from these assessing authorities is still acceptable as evidence of having met the criteria of skills assessment by the Department. However, the previous assessing authorities no longer provide skills assessment for occupations listed in the SOL. Notes: National Office of Overseas Skills Recognition (NOOSR) ceased conducting skills assessments for teaching occupations in 2005. Please do not approach NOOSR for a new skills assessment. If you have valid skills assessment certificate issued by NOOSR, please contact NOOSR for advice prior to lodging your application for skilled migration. This list applies to applications made on or before 31 December 2012 for a Subclass 885 (Skilled-Independent), 886 (Skilled – Sponsored), or Subclass 487 (Skilled – Regional Sponsored) visa by an applicant who held a Subclass 485 visa on 8 February 2010 or had applied for a Subclass 485 visa that was not finally determined on 8 February 2010, and may nominate an occupation on the current SOL or the new SOL that commences from 1 July 2010.
This list also applies to applicants who held a student visa in subclasses 572, 573 and 574 on 8 February 2010 and who apply for subclass 485 visa on or before 31 December 2012.
Applicants can only nominate an ANZSCO occupation from 1 July 2010. The ASCO codes correlated to ANZSCO occupations provide DIAC-endorsed policy guidance for the purposes of acceptable skills assessments. An applicant with a relevant valid skills assessment in an ASCO occupation should map it to the relevant ANZSCO occupation.

This list applies to all GSM applicants from the date of commencement of the new Skilled Occupation List on 1 July 2010 including those who qualify for the transitional arrangements but choose to apply under the new SOL.
Applicants can only nominate an ANZSCO occupation from 1 July 2010. The ASCO codes correlated to ANZSCO occupations provide DIAC-endorsed policy guidance for the purposes of acceptable skills assessments. An applicant with a relevant valid skills assessment in an ASCO occupation should map it to the relevant ANZSCO occupation.

Skilled Occupation List (SOL) – Schedule 4
(Including DIAC-Endorsed ASCO – ANZSCO Correlations) This list applies to occupations in the State Migration Plans (StatSOL) with ANZSCO codes. This list applies to applicants for subclasses 176 (Skilled – Sponsored), 886 (Skilled – Sponsored), 475 (Skilled – Regional Sponsored) and 487 (Skilled – Regional Sponsored) visas who are nominated by a State or Territory government agency. Applicants can only nominate an ANZSCO occupation from 1 July 2010. The ASCO codes correlated to ANZSCO occupations provide DIAC-endorsed policy guidance for the purposes of acceptable skills assessments. An applicant with a relevant valid skills assessment in an ASCO occupation should map it to the relevant ANZSCO occupation.

State Migration Plans Overview State Migration Plans are being introduced for each state and territory over the coming months in 2010. The Plans will provide state and territory governments with flexibility within the Migration Program to address specific skill shortages and local labour market needs as each agreement will be tailored to the individual requirements of each jurisdiction. While state and territory governments have had the capacity to nominate applicants for the purposes of the GSM program for a number of years, the introduction of Plans is intended to improve the targeting of this part of the program. Plans are proposed to be agreements, in the form of Memoranda of Understanding (MOUs), between individual states and territories and the Minister for Immigration and Citizenship, which will allow jurisdictions to sponsor applicants under a broad range of occupations to fill skills shortages within their local labour markets. Plans are currently being developed for all states and territories, and are subject to the Minister’s approval prior to implementation. Under Plans, state and territories are able to nominate only those applicants whose nominated occupation is included on their respective Plan. States and territories will however have some limited capacity to nominate applicants where their occupation is not specified on their Plan. These provisions allow states further flexibility in providing nominations which may be valuable in meeting shortages in very specialised occupations. The availability of this facility is entirely at the discretion of the state and territory government, and states and territories are not obliged to offer any nominations outside the occupations specified in their Plan. State and territories will include information on the eligible occupations included in their Plans on their respective web-sites.
Application processing New visa applications State Migration Plans will apply to those applicants who obtain nomination from a state or territory government and apply for one of the following visas:
To lodge a new visa application, applicants are required to obtain nomination from a state or territory government prior to lodging their visa application. Evidence that the state or territory government has agreed to nominate the applicant should be submitted with the visa application. For all applications lodged after 1 July 2010, there is no capacity for applicants to switch between an application lodged for a Skilled Independent Subclasses 175 and Skilled Sponsored Subclass 176, or between a Skilled Independent Subclass 885 and Skilled Sponsored Subclass 886. Similarly, there is no capacity for an application for either a Skilled Sponsored Subclass 176 visa or a Skilled Sponsored Subclass 886 lodged on the basis of family sponsorship to be changed to an application made on the basis of nomination by a state or territory government. The Migration Regulations 1994 have never permitted applications for Skilled Sponsored – Regional 475 or 487 visas made on the basis of family sponsorship to change their application to a state or territory nominated application and this has not changed. Existing Visa applications Applicants with an existing visa application in an occupation which is included on their nominating state or territory’s Plan will receive priority in having their application processed. The current Ministerial Direction in place for the processing of skilled visas provides applications made in relation to a State Migration Plan will be processed after those applications for the Employer Nomination Scheme (ENS) and the Regional Sponsored Migration Scheme (RSMS) programs. If you applied for your visa before a state or territory Plan commences, and your occupation is not on your state or territory’s Plan, your application will be afforded either priority 3 (if you nominated an occupation on the Skilled Occupation List) or priority 4 processing (if your nominated occupation is not on the SOL. The priority of your application will not change as a result of State Migration Plans.

OCCUPATION LIST December 2010
The ACT ‘State Migration Plan (SMP) Occupation List identifies occupations that are in demand in Canberra. The occupations listed do not relate to a specific job vacancy, nor represent a guarantee of a job in a specific occupation. The applicant should understand that the ACT Government is NOT responsible for finding them employment, accommodation or for providing any form of financial assistance. Applicants must compete for positions with all people in the labour market as part of the normal selection process. Success will depend on employer requirements, relevant skills and experience and level of English ability. SMP Occupation List updates The SMP Occupation List will be updated on a regular basis to show the current status of the skill demand against each occupation, as demonstrated below:
Closed Nomination places are not available for this occupation.
Limited Nomination places are limited. Occupations must be VERIFIED before the application for nomination is lodged.
Open Nomination places are available for this occupation.
VERIFICATION OF ‘LIMITED’ OCCUPATIONS A ‘limited’ occupation indicates that the current ACT target for this occupation is almost met. Applicants seeking nomination of a ‘limited’ occupation must have the occupation verified by the SBM Unit before an application for nomination is lodged (see the Nomination Guidelines for further information). NOMINATION CRITERIA
Applicants should refer to the appropriate Department of Immigration and Citizenship (DIAC) criteria and ACT Government Nomination guidelines to ensure that specified criteria is met before submitting an application for nomination. CONDITIONS OF NOMINATION Some occupations have ‘conditions of nomination’ listed against them which are in addition to the general criteria outlined in the Nomination Guidelines. APPLYING FOR NOMINATION OF A SKILLED – SPONSORED SUBCLASS 176 / 886 VISA
Applicants must demonstrate that they meet the current application criteria. It is entirely at the discretion of the ACT Government whether an applicant is offered a nomination under the Skilled Migration program.

South Australia’s State Sponsorship Interim Occupation List (September 2010)
The following list includes occupations that Immigration SA will consider for Sponsorships until the State Migration Plan is implemented. The occupations listed below reflect general skills shortages in South Australia and do not relate to a specific job vacancy, nor represent a guarantee of a job in a specific occupation. State Sponsored migrants must compete with all people in the labour market as part of the normal competitive selection process. ANZSCO / ASCO – If your skills assessment has an ASCO code, please visit the DIAC website to check DIAC’s Endorsed ANZSCO / ASCO correlations - http://www.immi.gov.au/skilled/_pdf/sol-schedule3.pdf Special requirements - Some occupations have additional requirements that you must meet in addition to all other sponsorship requirements. If there is no special requirement listed, you are required to meet the IELTS requirement of 6.0 in each of the four bands. If you hold a valid passport from, and are a citizen of, the United Kingdom, Canada, New Zealand, United States of America, or the Republic of Ireland, you must provide an IELTS test result if the requirement is 7.0 or higher. Where the requirement is less than 7.0 no IELTS test result is required.
