Order on Request to Terminate Probation Developed
As stated previously in the Report to Idaho Courts re: Uniform
Business Practices to Implement Legislative and Rule Changes, the
new justice reinvestment legislation authorizes any party or the
IDOC to apply directly to the court to modify or terminate
probation. Per Idaho Code section 20-221(3), the court shall rule
on the request for discharge within sixty (60) days of the date of
the submittal of the request. As such, it is important that any
request to terminate probation filed with the court be IMMEDIATELY
FORWARDED to the assigned judge for consideration. It is recommend
that judges determine whether or not it is best for their court to
set a hearing on the petition upon receipt (to preserve a date that
can be vacated later if deemed unnecessary) or to wait until after
review of any response to the request (due on or before thirty (30)
days of the date of submittal of the request) to determine if a
hearing will be set. To assist the courts, the District Judges
Workgroup have developed a form: “Order on Request to Terminate

Judges: Suggestions Welcome for Breakout Sessions The Judicial
Conference will be here soon. We have scheduled breakout sessions
for both District and Magistrate Judges to discuss topics pertinent
to the judiciary. If you have topics or subjects that you would
like to have discussed at these round table sessions, please send
your suggestions by email to either Judge McLaughlin or Judge
Heise. We welcome your suggestions for the conference and
appreciate your input.
Retirement Workshop Available Prior to the Judicial Conference
There will be an optional PERSI workshop for our JRF members:
“Retirement’s a Beach.” This four-hour workshop will cover JRF,
Social Security, and Medicare/Healthcare taught by Mike Mitchell
and Shasta Luper from PERSI. This workshop will be held on Sunday
afternoon before the Judicial Conference. Date: Sunday, September
21, 2014 from 1:00 – 5:00 p.m. MDT Place: Cinnabar Room at The
Riverside Hotel, 2900 Chinden Blvd. Please RSVP to Kim Woods if you
would like to participate.
Flu Clinic Available on Wednesday of the Judicial Conference On
Wednesday, September 24, a Flu Shot Clinic will be open from 7:30

Idaho Receives its Third Access to Recovery Grant
Idaho has received a new Access to Recovery (ATR) grant, one of
only five states to be awarded this funding. The Department of
Health and Welfare will receive this funding starting October 1,
2014 and the initial services will begin no later than December 30,
2014: $2,105,316 is awarded for the first year and $2,180,316 in
each of the remaining two years, for a total of $6,465,948 for
treatment and recovery support services. The proposed services will
be targeted to three groups:
Veterans with substance use disorders who have committed a crime
and are on supervised probation
Parents with substance use disorders and involvement in child
protection services
Homeless persons of any age with substance use disorders
The project offers the linkages, services and resources to
assist the identified target populations gain the ability to build
satisfying new lives free of drugs and alcohol and will continue to
provide treatment and recovery support services to many court

SQL Report Developer: The Idaho Courts have an opportunity for an
SQL Report Developer to create, write, and deliver SQL-based forms,
reports, and business analytic services to support the Court’s
transition to a new statewide case management system. This is a
temporary position to be filled from August 2014 through June 2017.
The position does include benefits. Application packets must be
received by Tuesday, August 19, 2014, MDT.

New to the Idaho Courts
Lindy Hornberger, Law Clerk to Chief Justice Burdick. Lindy grew
up in Fort Macleod, Alberta, Canada. Lindy’s undergraduate degree
is from the University of Lethbridge, where she was also a member
of the Pronghorn’s basketball team. Her law degree is from the
University of Idaho. Jason Blakley, Law Clerk to Justice Daniel
Eismann. Prior to law school, Jason spent ten years living in
northern California. Four of those years were spent in San
Francisco, where he received his English degree from the University
of San Francisco. After college, he and his wife moved to South
Lake Tahoe, where they spent six years running a small motel
located across the street from the local ski resort, Heavenly. He
received his law degree from Notre Dame in May, 2014. Having grown
up in Boise, he is happy to be home, close to family, friends, and
mountains! In his free time, he enjoys mountain biking, hiking,
skiing, and spending time with his wife, Perrine, and golden
retriever, Thurman. Andrew Wake, Law Clerk to Justice Jim Jones.
Andrew was born in Boise, lived elsewhere for a while, then moved
back to Boise and earned his undergraduate degree at BSU. He earned
a graduate degree in Rochester, NY, moved back to Boise, and taught
for about a year at BSU. He attended law school at the University
of Utah and then moved back (hopefully for the last time) to Boise.
He has been married for just over ten years and his wife has been
very patient with all of this moving. Danny Mortensen, Law Clerk to
Justice Warren Jones. Danny grew up in Bonsall, Califor-nia (San
Diego), completed his undergraduate studies at Pomona College in
Claremont, California (Go Sagehens!), and received his law degree
from Pepperdine University School of Law in Malibu, California. He
is married with two daughters and one English Bulldog. He enjoys
stand-up paddleboarding and participating in any outdoor adventures
his young girls enjoy (or can at least endure), and is looking
forward to exploring all of the recrea-tional opportunities Boise
has to offer. Owen Moroney, Law Clerk to Justice Joel Horton. Owen
is originally from Bozeman, Mon-tana, but his wife is a native
Idahoan who was born in Boise. Owen obtained an undergrad-uate
degree from Western Washington University, where he received a B.S.
in environ-mental science with an emphasis in freshwater ecology.
After graduating, Owen worked in Yellowstone National Park and
Devils Postpile National Monument before attending law school at
the University of Idaho. He is an avid outdoor enthusiast and can
usually be found outdoors on his days off, whether he is hiking,
climbing, skiing, hunting, or fishing. Kelsie Kirkham, Law Clerk to
Judge Dave Gratton. Kelsie was born and raised in Idaho Falls, ID.
She attended Idaho State University for undergrad, where she
obtained a BA in Political Science. She then attended law school at
the University of Idaho. She has been married for three years and
her and her husband are expecting their first baby next month.
Outside of work, she enjoys camping, hiking, and riding
motorcycles. R. Kade Beorchia, Law Clerk to Judge John Melanson.
Kade was raised in Wendell and received a finance degree from Idaho
State University. He then attended the University of Idaho, where
he earned a JD. While attending the University of Idaho, he had the
opportunity to work with the State Board of Education, the federal
magistrate court, and the bankruptcy court. He and his wife live in
Nampa with their three children, and are expecting their fourth in
December. His primary hobbies are fly fishing and restoring vintage
Volkswagens. Kristy Grabo, Virtualization Administrator. Kristy
grew up in Arizona, then moved and graduated from Weber State
University in Utah. After graduating, she moved to Boise and began
working for Boise Cascade. She worked for Boise Cascade and has
been in Boise for 13 years. She currently lives in Star, Idaho and
enjoys the quiet of being out among the farmland. She enjoys the
outdoors of Idaho (much cooler than the outdoors of Arizona) and
can be found in the mountains riding ATVs or Camping in her spare
time. Just recently she has been introduced to fishing which she
really loves. She also loves DIY pro-jects. Kristy is excited to be
here and working with everyone. Kasey Kliegl, 5th District
Guardianship & Conservatorship Monitoring Coordinator. Kasey is
a native of Idaho and has lived in Idaho her entire life. She is a
graduate from Idaho State University with a Bachelor of Arts in
History. She currently lives in Twin Falls with her husband Joey
and has two beautiful daughters, Zoe and Colbie. Zoe is a sophomore
at the University of Idaho. Colbie is a freshman at Filer Middle
School. She has worked for the judicial system in Twin Falls County
for a little over twelve years as a deputy clerk. She originally
started in the records division and was promoted to criminal clerk
and then to an in-court clerk. Kasey was instrumental in the
development of the Twin Falls DUI Court; manager of the
guardianship/conservatorship cases and has clerked for several
Magistrate Judges. She is very passionate about the outdoors and
reading. She has a green thumb and a love of cooking, canning, and
gardening. If she is not in her yard working, chances are, you can
find her curled up with a good book or more often than not you can
find her enjoying the mountains with her family and dogs.
