CATEGORY – GIFTED
[ 02 ] To consider the building notices received under section 235(1) of the Cantonments Act 2006 from the following applicants for erection of Building on Plot / Survey Numbers in colonies mentioned against each. The building plans are in accordance with the building byelaws and FSI restrictions. The site in each case is situated outside notified civil area classified as B-2 land as per the GLR maintained by the DEO, AP Circle, Secunderabad. The layout of these colonies was sanctioned after 1974 and the societies have handed over 40% open area for civic and other amenities to the Cantonment Board, Secunderabad by a way of Registered Gift Deed as per the bye-laws.
As per the decision of the Board in its meeting held on 04th November 1997, No Objection Certificate from Airport Authority of India has not been insisted in such cases where construction of only Ground Floor is involved.

The Board resolved to approve the building applications under section
235 of the Cantonments Act, 2006 subject to condition that the plan will be released only after Rain Water Harvest Pits are made in the plots. CEO shall release the plinth sanction only as resolved under CBR No.12 dated 07th August 2013. On satisfactory completion of plinth, rest of the building plans will be cleared.

The date of completion shall be reported as required under section 242 of the Cantonments Act 2006.The sanction will be subject to receipt of NOC from concerned authorities. The Board resolved to approve the building applications under section
235 of the Cantonments Act, 2006 subject to condition that the plan will be released only after Rain Water Harvest Pits are made in the plots. CEO shall release the plinth sanction only as resolved under CBR No.12 dated 07th August 2013. On satisfactory completion of plinth, rest of the building plans will be cleared.

The Board resolved to approve the building application under section

As per the report of Engineering Branch previously Board has
considered such building applications and approved the plans up to ground Floor only where the National Airports Authority issued ‘0’ height clearance keeping in view of various High Court Orders passed periodically in (1) WP No.32468 of 2016 Dt.23.09.2016, (2) WP MP No.42782 of 2013 & (3) WP No.34370 of 2013. The matter was again discussed in the Board in detail, vide CBR No.11, Dt.31.05.2018 resolved to approve such building applications up to Ground Floor only where the NAA has given ‘0’ height clearance.

The Board resolved that the following conditions are set for ‘0’ height building applications in Mahendra Hills where AAI has given nill height relaxation.
i. The plinth level of the plot shall be fixed by the applicant himself by giving a declaration in writing defining the corresponding site elevation of the subject site for fixing the plinth and the plinth level shall be proposed as per the nearest approach road. The plinth level be as close as possible to the adjoining approach road level and to this effect a certificate of technical justification from the licensed structural engineer be obtained from the applicant as to why the plinth level is not at the level of the adjoining approach road. The construction of ground floor be allowed upto 4.5 m or 15 feet from the plinth level to include all structures like parapet wall, water tank and temporary structures too. ii. The applicant is required to submit a site elevation certificate even in the case of ‘0’ height clearance showing the longitude and latitudes of all four corners of the proposed site. iii. As per the basic civil engineering principle in fixing the plinth level it is to ensure that a balanced depth of excavation be fixed so as to minimise the quantity of earth filling / carting of excavated material which results in cost effectiveness. iv. Not more than one cellar or basement is permitted and such cellar or basement be used only for parking purpose.

Cantonment Planner in Secunderabad Cantonment Board in respect of Shri D. Rajeshwar, Draftsman. The Board had already recommended the proposal of upgradation of post vide above referred resolution under CFSR 1937 and Cantonment Account Code 1924. The Cantonment Account Code 1924 has been superseded by the Cantonment Board Accounting Rules, 2020. The Principal Director, Defence Estates, Southern Command, Pune, vide the letter referred above has directed to resubmit the proposal in accordance with Cantonment Board Accounting Rules, 2020.

Further Dearness allowance has been granted 3% from 01-09-2019 and revised to 7.28% from 01-07-2019 on the revised pay scales vide G.O. Ms. No. 52, Dated 11-06-2021. House Rent Allowance is declared as 24% on the Basic pay of revised pay scales without any ceiling limit and it will be increased to 27% (Hyderabad) when the Dearness Allowance exceeds 50% of the Basic Pay ( G.O.Ms.No. 53, Dated 11-06-2021). Five (05) bidders participated in the online tender and after technical evaluation of the requisite documents uploaded by the bidders, M/s. Trinetra Constructions was rejected in Technical Bid and the remaining four (04) bidders were admitted for Financial Bid. The Financial Bid of the said firms was opened and from the BoQ Comparative statement it is observed that M/s. B.Ramachandraiah & Sons quoted the lowest total Rs.5,98,52,385/-. The rate quoted by M/s. B. Ramachandraiah & Sons was forwarded to GE (South) for vetting of reasonability of rates vide this office letter no.SCB/EB/IR/GE Reasonability/644, Dt.01.03.2021. The Garrison Engineer (South) vide their letter No.8019/CB/67/E8, Dt.07.04.2021 vetted and sent their reasonability of rates and reduced rates of certain items as quoted by the bidder and thus the total is Rs.5,92,16,322/- (Rupees Five Crores Ninety Two Lakhs Sixteen Thousand Three Hundred and Twenty Two only). The reduced rates were informed to contractor i.e. M/s. B. Ramachandraih and sons to seek their consent vide this office letter dt.17.07.2021. In response to the above, the contractor M/s. B.Ramachandraiah & Sons has forwarded a letter dt.20.07.2020 in which the contractor submitted his willingness to carryout the subject work on the rates suggested by GE (South) for an amount of Rs.5,92,16,322/- (Rupees Five Crores Ninety Two Lakhs Sixteen Thousand Three Hundred and Twenty Two only).

Anuradha was appointed as Data Entry Operator on 01.06.1991 in the pay scale of Rs.810-1420 in lien of abolition of the post of Pound Keeper which carried the same pay scale i.e 810-1420 vide Dte, De SC. Pune Lr.No.7680/B/XX/DE dated 03.05.1991. The said pay Scale was lower than Jr.Asst.
The pay scale was subsequently revised bringing the pay scale at par with the post of Jr.Asst vide CBR No.10 dated 20.04.2001 since she was holding the qualifications more than the minimum qualifications required for Jr.Asst. However, no opportunities for promotion were provided as the said post has not been included in the channel of promotion to any of the higher posts.
The Cantonment Board vide CBR No. 04 dated 17.09.2001 considered the matter in detail & resolved that instead of bring the post of Data Entry Operator in the main stream for promotion from Junior Assistant to Senior Assistant, Data Entry Operator should be given all the promotions as are given by the State Government to such posts, in view of the fact that the work of Data Entry Operator is not same as Junior Assistant and the nature of work is also totally different.
Also resolved that in order to protect the interest of present incumbent working as DATA ENTRY OPERATOR, her post should be upgraded equivalent to that of Senior Assistant in scale available in state Government for such post, when junior Assistants appointed at the time of appointment of present Data Entry Operator become eligible for promotion to the posts of Senior Assistant. The matter was referred to the PD Dte of Defence SC Pune vide this office Lr.No.AB/DEO/39 dated 29.02.2004 for absorption of the post of DEO in the main stream of Jr. Asst. The PD SC Pune vide his Lr.No.7680/B/XXVI/DE dated 24.08.2004 raised certain observations for considering of the case. As this office could not get proper clarification from the concerned department the case could not be processed further and was kept pending. The Board vide CBR No. 06 dated 25.08.2008 resolved that the proposal be submitted to GOC–in-Chief, SC, Pune for seeking necessary sanction under rule 5 B (5) of CFSR 1937 for including the post of Data Entry Operator as one of the feeder post to the post of Senior Assistant. However, no proposal was forwarded pursuant to the said resolution.

Further, vide CBR No. 14 dated 23rd September, 2015, the matter was again placed before the Board to consider the pending issue of promotion channel to the Data Entry Operator Smt. T. Anuradha who was appointed temporarily in October, 1987. The employees scale was fixed on par with Junior Assistant as per the re-fixation sanctioned by GOC-in-C, SC, Pune in 2001. However, the post of DEO was not included in the feeder grade for promotion to the post of Senior Assistant due to which the employee could not be considered along with other Junior Assistants. The Board in the said meeting considered and approved the matter and resolved that the Proposal should be sent to PDDE, SC, Pune for approval of competent authority. However, the proposal was not fructified.
Further, vide CBR No. 18 dated 22nd October, 2016, the matter was again placed before the Board to consider the order dated 13.06.2016 of Hon’ble High Court of Telangana and Andhra Pradesh in WP NO. 15199 of 2016 filed by Smt T Anuradha, Data Entry Operator, Secunderabad Cantonment Board seeking directions to include the post of Data Entry Operator in the feeder category and to grant her promotions. The Hon’ble High Court has given interim direction to pass appropriate orders within a period of three (03) months from the date of receipt of order. The CEO informed the Board that there is no promotional post in the cadre of Date Entry Operator in Secunderabad Cantonment Board, but however grant of higher pay scales can be considered with respect to her immediate junior and proposal can be sent to GOC-in-C, Southern Command for his approval as required under CFSR 1937. The Board resolved accordingly and PCB directed the CEO to expedite the matter. However, no action is initiated pending order from the PDDE, SC, Pune based on the Hon’ble High Court directions. On 25.01.2017, an order was passed by the PDDE, SC, Pune in pursuance to the directions of Hon’ble High Court in WP No. WP NO. 15199 of 2016 filed by Smt T Anuradha, Data Entry Operator, Secunderabad Cantonment Board. The relevant portion of the PDDE, SC, Pune, Order is reproduced as under:-
“… In view of the rule position as well as the factual status of the case, no further financial upgradation of the pay scale of Smt. T. Anuradha can be considered as the employee has already been granted three financial upgradations on the ground of not having been given any promotion in her cadre till date. Further, it is stated that mere eligibility i.e., possessing requisite qualification for a higher post cannot be pleaded as a ground for claiming promotion to that higher post. There is no channel of promotion for the post in which the petition is appointed and in para 3(iv) of the appointment order issued to her, it was clearly stated that she will be governed by the provisions of CFSR, 1937. I therefore find no merit in the representation submitted by the petitioner on 18.11.2016 for grant of promotion on par with employees in other cadres/posts in the organization.”
Smt. T. Anuradha will be retiring on attaining the age of superannuation on 30.06.2024 and she has been working all throughout the service in the same post and hence her grievance. Under such circumstance and considering the evolution of computers, the post of Data Entry Operator be re-designated to that of Junior Assistant (Lower Division

Clerk) so as to avoid any such ambiguity/claim/grievance/litigation for future promotion. A proposal to re-designate the post be considered as required under rule 5-B(5) of Cantonment Fund Servant Rules 1937. The relevant file is placed before the Board. Resolution: The Board considered the case of Smt. T. Anuradha and her services as Data Entry Operator with no further avenue promotions. The Board discussed the matter in detail and resolved that henceforth i.e. after the retirement of the permanent incumbent the post of Data Entry Operator in Establishment Section be redesignated to that of Junior Assistant (Lower Division Clerk), as at present the scale of both the posts being identical, so that such grievances will not arise in future. The Board further resolved to send the proposal to the competent authority to re-designate the post as per rule 5-B(5) of Cantonment Fund Servant Rules 1937. [ 23 ] To consider the note of the Revenue Superintendent with regards to proceedings of the e-tender for “Leasing of rights for temporary usage of land for providing pay-n-park facility for general public at JBS, in GLR Sy.No.481/Part, near Picket Garden, Secunderabad Cantonmentfor a period of three (03) years from the date of handing over of site”.
As per the said note, this office vide Tender Notice No.SCB/RS/Parking/e-Tender/2021/1568 dated 2nd July, 2021has invited the applications from the Individual/Firms/Agencies/Contractors working with other Govt. Departments/PSU’smeeting eligibility criteria for considering the e-tender for subject work. The details with all terms and conditions were uploaded in the website “www.eprocure.gov.in/eprocure/app” with tender ID: 2021_DGDE_636806_1.
Further, as per the critical dates given/mentioned, the closing date and
time of online submission of tender documents was on 26.07.2021 at 1300 hours and the date &time of opening of Technical Bid was on 27.07.2021 after 1300 hrs.Accordingly, the technical bid was opened and the documents submitted by the bidders/tenderers were scrutinized and verified wherein total six bidders/tenderers have participated and the details of the same are as under:

From the above, it is to submit that M/s. MORGAN ENTERPRISES
has quoted the highest rate/bid of Rs.32,59,999/- (Rupees Thirty Two lakhs Fifty Nine thousand Nine hundred and Ninety Nine only) for one year excluding GST.
If approved, the proposed site for pay-n-park facility would be allotted

Apart from the above points, the following points were also discussed in the meeting with the permission of the chair. 1. The matter of Assessment of Unauthorized/Encroached properties was discussed and it was decided that as the occupants are availing basic civic amenities in the Cantonment, such properties be assessed for levying of property tax and separate register be maintained for such properties. 2. The CEO apprised regarding the study visit of Parliamentary Standing Committee on defence to Secunderabad Cantonment. The arrangement for the stay and transport facilities for the dignitaries will be carried out by the Bharat Dynamics Ltd., and the expenditure to be incurred in this matter has to be shared equally by Secunderabad Cantonment Board and Bharat Dynamics Limited. It was decided that the CEO is authorized for taking necessary action in co-ordination with Bharat Dynamics Limited and make necessary payments towards the share of Secunderabad Cantonment Board. 3. CEO informed the Board that vide Circular Agenda 02 dated 17.05.2021, on conversion of Cantonment General Hospital to COVID dedicated hospital, the Board had engaged medical staff and para medical staff on temporary basis. Subsequently the CEO has taken steps to setup the ICU facility at COVID dedicated Cantonment Hospital in Bollarum and the same will be made ready to use shortly. In this regard an anesthetist may be engaged on honorarium basis on temporary basis at a honorarium of Rupees One Lakh per month.
