1. INTRODUCTION

The project is implemented in accordance with the Decree of the President of the

Republic of Uzbekistan dated 7 March 2013 No.ПП-1933 "On the measures to

ensure the implementation of the investment project “Expansion of Talimarjan TPP

with the construction of two CCGT with a capacity of 450 MW". The site is an

existing gas fired power plant, which currently generates 800 megawatts (MW). The

project will install two additional combined cycle gas turbine (CCGT) units of about

450 MW each at the site.

Based on ADB's safeguards policy statement (SPS), the Project is classified as

follows: (i) environment (category A) – environmental impact assessment (EIA), (ii)

involuntary resettlement (category C) – no actions, and (iii) indigenous peoples

(category C) – no actions. Therefore, an environmental clearance from ADB was

obtained in December 2009.

According of Decree Cabinet of Ministry of Republic of Uzbekistan № 491 «On government ecological expertise» the Project is classified as a class 1 Project (is attached in appendix 1) Under the Uzbekistan Environmental Legislation. The environmental clearance was obtained from Nature Protection Committee (NPC) on 5 October 2009. According to the legislation of the Republic of Uzbekistan the correction is made after 3 years, a new Conclusion of Ecological Expertise № 18/768 dated 13 August 2013 is received (attached in appendix 2).

The objective of this report is to provide a progress in implementing

Environmental Management Plan and Environmental Monitoring Plan (EMP) as

stated in the Environmental impact. This Report was prepared to cover the period of

July-December 2014.

CCGT by Yuliya Yakubova, PMU Safeguard

Specialist. Visual inspection on the main

Within the framework of the project Capacity development program is

implemented under Loan # 2630). Selection of Consultant for environmental and

social Safeguards and Gender is implemented under this program as one of the

subcomponents.

Over a reporting period on this subcomponent a tender was held on 25.12.2014 to

select a consulting company.

1.1. DESCRIPTION OF CONSTRUCTION WORK

During the period under review the project is at the stage of construction works. According to the report on project implementation for December 2014, submitted by Hyundai Engineering and Construction and Daewoo International Consortium (HDEC), progress of the project as of December 2014. is 50.25%.

1.2. ORGANIZATION OF ENVIRONMENTAL WORK

There are no changes in the composition of the Environment Department. PMU Environment Specialist - Yuliya Yakubova Station Ecologist - Nizom Rakhimov

On the part of Corporate Solutions and Mott MacDonald Team (CSMM) the local

consultant on Social, Gender and Environmental issues Lyudmila Khegay is

involved. From November 1, 2014 the International Environmental Specialist of

"Corporate Solutions Consulting Limited" Natasha Sim doesn’t work in this project.

Currently the management of "Uzbekenergo" approved the candidature of new

international expert but this, however, requires the approval of the competent

authorities of the Republic of Uzbekistan. Approval of the candidature of new

international expert on environmental protection is a priority issue, as CSMM doesn’t

conduct any work on environmental and social issues from November 1, 2014.

Since 10 October 2013 the Contractor's representative Mr. Jeong Hyeon Kim

works at the construction site, who provides active support and regular inspections on

HSE in accordance with the Environmental Management Plan, as well as his assistant

Khusan Khidirov, Environmental and Safety Specialist. Since June 2014 a safety and

environmental engineer – Amanov Oybek has also been working on construction site.

In April 2014 Shaybalov Oybek- subcontractor (Tupolang) ecologist was

employed.

Regarding environmental works: The Contractor shall (a) establish an operational system for managing environmental impacts, (b) carry out all of the monitoring and mitigation measures set out in the Environmental Management Plan (EMP).

The Contractor shall submit to the Employer monthly reports on the carrying out

of such measures.

As of today HDEC provides PMU with monthly progress reports, which includes

a chapter "HSE Management", as well as separate monthly report on « environmental

protection and safety code » (attached in appendix 3).

The consultant also provides PMU with a quarterly report, that includes a section

on HSE, the report on monitoring the implementation of the Environment Work Plan

after visiting the construction site, as well as monthly and semi-annual reports on the

results of an environmental inspection.

All these reports PMU reviews, analyzes and takes corrective measures if needed.

According to the results of joint activities Contractor - Consultant - PMU the semi-

annual Environmental reports for the ADB are carried out.

Also according to ADB policy, the PMU sends the semi-annual Environmental

reports to the Kashkadarya Regional Committee for the Nature Protection for

reference.

II. ENVIRONMENTAL MANAGEMENT PLAN (EMP)

2. 1 STATUS OF ENVIRONMENTAL MANAGEMENT PLAN.

In September 2013, HDEC has provided the HSE plan, which includes the Site

Environmental Management Plan (SEMP) and Environmental Protection Plan. This

plan has been reviewed by the PMU and the Consultant and sent to the Contractor for

updating. When updating the HSE plan the Contractor was recommended to base

upon the environmental impact assessment (2009), Environmental Action Plan

(2009).

This plan was under updating 2 more times and the final third version of the EMP,

which was acceptable to PMU and Consultant, was completed in January 2013.

It was also agreed, that every 6 months the SЕМР will be revised for continual

improvement. In May 2014, HDEC, PMU, and CS-MM revised and checked SЕМР

to reflect current conditions and status of site. The objective is to ensure continual

improvement (ISO 14000).

The new Site Based Environmental Management Plan (SВЕМР) was finally

updated by the Contractor and submitted to the PMU.

The new plan is convenient for the ongoing project and guarantees minimum

negative impacts on the environment. SBEMP will be observed by the Contractor

and monitored by SJSC “Uzbekenergo” and the Consultant.

With the letter No. 384 dated on 09.10.2014 PMU has officially notified HDEC of

the approval of the latest version of SВЕМР as a working document.

2. 2 ECOLOGICAL MONITORING.

Based on EIA, the PMU with the Station ecologist has carried out the Monitoring

of compliance with the requirements of the Environmental Management Plan

(SEMP) at the construction site. Jointly with the ADB the PMU conducted the

environmental monitoring in October 2014, but station ecologist conducts a visual

inspection of the construction site on a monthly basis. The main violation detected

during inspections is insufficient watering of green spaces. During the construction

works the watering system has been damaged. Therefore the trees growing on the

surrounding grounds need additional watering. Contractor shall also increase the

number of waste containers to provide greater separation of waste by type.

The Chemical Analysis Laboratory of the station also carries out monthly

analyzes of water samples from the Karshi Main Canal and sewage treatment plants.

All violations detected would be recorded and eliminated as work proceeds. In

the accounting period no material breaches of operational code for electrical

installations requirements, which may negatively influence the state of environment

has been recorded. Preoperational and construction works are being conducted in

accordance with environmental legislation of the Republic of Uzbekistan.

Monitoring of the implementation of SEMP on a regular basis is conducted by the

Consultant. In the accounting period Consultant has conducted 2 environmental

audits. Audit findings are described in (attached in appendix 4).

The audit revealed violations of SEMP. All comments of Consultant were sent to

the Contractor to correct violations. Specifically the HDEC has improved drainage

system of sedimentation water tanks at the cement plant, 4 water meters for cold

water were installed, the device to prevent spilling of fuel was installed in the motor

garage and filling stations.

HDEC engineers conduct daily tours and site surveys. All environmental

indicators are monitored: quality of the water, open air, warehousing and recycling of

household and industrial waste, noise level, means of transport, safety code etc. More

detailed information on the Contractor’s activities can be found in monthly reports by

HDEC on environmental protection and safety code (attached in appendix 3).

The EPC Contractor also has concluded a contract with the company for waste

disposal and carries out regular HSE trainings.

According to the recommendations of Co ltd «Nazar Business Technology»,

which in October 2013 conducted ecological audit on the project, the Contractor has

been carrying out systematic trainings on environmental protection and safety code

(on 30th of each month).

For the purpose of project information release semi-annual reports by PMU are

submitted to local agency on conservation of nature and local authority.

Labour and human population complaints mechanism is also implemented as part

of the project. For this purpose there is available free a « book of complaints and

suggestions » in the staff office (attached in appendix 5). In the accounting period no

human population claims have been noted.

The PMU is attentive to recommendations of the CSMM-consultant to improve

the monitoring of the implementation of SEMP and to improve the rating of the

project. The consultant recommended that the Contractor (HDEC) is to develop a

regulatory environmental documentation for the period of construction works and to

provide the local authority for the nature protection with statistical reports. To resolve

this issue HDEC officially appealed to the Kashkadarya Regional Committee for the

Nature Protection and received a reply letter No. 08-1461 dated on 05.09.2014 with

explanations (Appendix 6).

Monitoring shows that the environmental requirements at the stage of construction

works are fulfilled satisfactorily. In the accounting period no violation of

environmental regulation, or claims from the human population have been noted.

This semi-annual report on the monitoring of environment protection covers the

period of July - December 2014.

Materials of the first stage of Environmental impact assessment of the

"Expansion of Talimarjan TPP with the construction of two CCGT with a capacity

of 450 MW" has been submitted for the Government Ecological Expertise.

The enterprise is located at Nuristan settlement, Nishan area, Kashkadarya

region in 18 km from the Nishan area center. The nearest residential buildings are

in 700 m to the north-east from the enterprise, in 1.0 km from priority sources of

pollutant emissions to atmosphere. To the east from TPP at a distance of 1.0 km

there is the rail road Karshi-Termez-Dushanbe.

The station is located on the right bank of the Karshi Main Kanal, which is

connected with Talimarjan reservoir (in 7 km).

Talimarjan TPP is focused on power generation; the installed capacity - 800

MW. The power generation in 2012 is amounted to 5516308.8 thousand kWh.

Natural gas is used as a main and reserve fuel at TPP, gas flow rate in 2012 is

amounted to 1323074.4 knm³, at that, specific reference fuel consumption for

electrical supply is determined in a value of 313.25 g/kWh, heat-167.99 kg/Gcal.

At existing situation the process equipment of TPP is presented by one

power unit comprising:

- steam turbine К-800-20-5 with a capacity of 800 MW with generator ТВВ

-800-2.

- boiler ТG-805-С3 with steam producing capacity of 2650 ton per hour

The structure of block station includes also a starting heating boiler house

equipped by four boilers U-50-3.9-440GM with steam producing capacity of 50

ton per hour and two water-heating boilers PTVM-30 with heat producing capacity

of 30 Gcal per hour.

The industrial and agricultural enterprises of a southern part of the republic

are experiencing a deficiency in the electric energy as at Talimarjan TPP with the

designed capacity of 3200 MW there is only one power unit with a capacity of 800

MW and being the basic source of electricity generation, thermal power plant is

not able to meet the needs of the served region.

In pursuance of the Resolution of the President of the Republic of

Uzbekistan #ПП-1933 dated 7 March 2013, Talimarjan TPP expansion project

with the construction of two CCGT is developed with increasing its capacity to

1,700 MW. The structure of CCGT includes gas turbine unit with the electrical

capacity of 314 MW, waste-heat steam boiler and steam-turbine condensing unit

with the electrical capacity of 157.7 MW. Natural gas flow rate will make 1267.38

mln.nm³ per year (162.964 nm³/h). Emission of smoke gases from new units is

provided through two individual pipes with a height of 85 m and diameter of 7.2

m.

Management of CCGT is planned through an automated system that allows

ensuring of the control of the process parameters and execution of tasks for

regulation, alarm and blocking of fuel supply in a case of any violations of the

production cycle.

Accommodation of two projected CCGT is planned at the territory of

existing TPP from the main building without additional land acquisition. For

stabilization of natural gas supply with the required parameters of pressure (up to

39.5 bars) the construction of booster compressor station equipped with three gas

compressor is planned.

Water supply of CCGT is provided from existing networks of Talimarjan

TPP (Karshi Main Canal) with consumption for technical needs, taking into

account the available capacities 591182 thousand m³/year. Water for the CCGT

will be used in a cooling water system and chemical water treatment.

Wastewater in the turbines under the straight-through arrangement is

removed into the Karshi Main Canal below the water abstraction point. Losses

replenishment in the process water circulation system is carried out by a fresh

water supply from the additional water intake structures, located at the initial KMC

area (from the Talimarjan reservoir). Considering a high mineralization, rigidity

and turbidity of surface waters under the expansion of TPP the organization of

additional (make-up) water pre-treatment with the arrangement of intake chamber

and drilling waste disposal site is provided. For prevention of deposition and salts

scaling formation as well as for disinfection the water is treated with the inhibitor

and sodium hypochlorite.

Number of wastewaters and sewage waters outlet in Karshi Main Canal

remains unchanged:

- Outlet No.1, through which the sanitary sewage is discharged after

cleaning and drain of the water treatment plant in the manifold (collector) K-3-2 at

a rate of 527.2 m3/h;

- Outlet No.2, directing the partially clean waters of turbine condenser

cooling system of power unit No.1 and two CCGT, as well as brine of distillation

desalination plant in the discharge canal of KMC at a rate of 144243.5 m3/h.

Analysis of the manufacturing parameters of installed equipment shows that

at its design the requirements of water-saving technologies are taken into account:

for comparison - the discharge of sewage waters from two combined cycle gas

turbine will reach 45220 m/h while from the power unit No.1 - 93162 m/h.

Thermal pollution of the Karshi Main Canal water as the result of partially

clean waters discharge after coils cooling shall not exceed 3°C in the summer.

The main source of sewage waters pollution with oil products is oil

lubrication system of turbines. Oily sewage waters to be cleaned at the Integrated

treatment of production waste waters. Under the expansion of thermal power

plant to 1700 MW from 800 MW it is necessary to provide the reconstruction

of facilities on the cleaning of oily sewage waters by adjusting the

concentration of petroleum products to the background values that

characterize the quality of water in Karshi Main Canal at the outlet from the

Talimarjan reservoir.

During the plant operation a carbon and nitrogen oxides, nitrogen and sulfur

dioxides and benzo(a)pyrene get into the atmosphere currently, the bulk is

accounted for the nitrogen dioxide - 2847.6 tons/year and nitrogen oxide - 441.3

tons/year. Gross emission of pollutants is 3289.4 tons/year. Flue gases from power

unit are exhausted through a pipe with 270 m height and with a diameter of 6.6 m.

Atmospheric air in this region is characterized by a moderate content of

pollutants; Talimarjan TPP and motor transport brings the main contribution to the

contamination of the atmosphere with nitrogen dioxide. With TPP emissions the

nitrogen dioxide are generated outside of TPP reaching 0.19 of maximum

permissible concentration (MPC) that is do not exceed the established limits (0.25

MPC).

After the expansion of TPP at developing of its capacity to 1700 MW

from 800 MW the pollutant emissions increase to 4431.29 tons/year (by

1141.89 tons/year), and the maximum concentrations of nitrogen dioxide,

generating with TPP emissions outside of TPP will make 0.24 MPC (without

taking into account a background) at the territory of Nuristan settlement -

0.21 MPC. On other substances – they do not reach the values of 0.1 MPC.

Specific emission rate of pollutants per unit of capacity (MW) are

significantly reduced: from 4.11 tons till 2.6 tons.

The generation of additional types of wastes during the construction of two

CCGTs is not predicted, their quantity is increasing due to high consumption of

lubricants, mercury-containing lamps, work clothing, etc., but standards of wastes

generation will remain at the same level.

For the purpose of noise reduction, CCGTs are equipped with acoustic

enclosure, an Air Filtering and Conditioning System (AFCS) is installed, equipped

with a filtration system and air heating that will provide effective cleaning of the

air flowing to the suction pipe of CCGT.

Environmental expertise of the submitted materials has shown their

compliance with the requirements of the environmental laws on the scope and

content of the first stage of the EIA and considers it necessary to develop the final

stage - Statement of environmental effects (SEE) for the purpose of regulatory

actions on emissions and discharges of pollutants into the environment, waste

generation and emplacement of industrial waste separately by years in view of

the commissioning schedule of CCGTs with a capacity of 450 MW.

For the regulatory actions on discharges of pollutants to surface-stream flow

under the SEE it is necessary to perform schemes of water disposal separately by

discharges and the identifying the sources of pollutants supply in baseline

characteristics. Prediction of water pollution of Karshi Main Canal with sewage

waters of TPP should be calculated depending on the mode of water flow in the

canal.

The draft of environmental impact statement of Talimarjan TPP expansion

project with the construction of two CCGT with a capacity of 450 MW and

increasing the plant capacity to 1700 MW is under the coordination of

Government Ecological Expertise of the State Committee for Nature protection the

Republic of Uzbekistan.

Kashkadarya Regional Committee for Nature Protection should take

under control the compliance with the requirements of environmental laws when

placing the combined cycle gas turbines at the territory of Talimarjan TPP. Prior

to the development and submission of the Statement of environmental effects

by the Government Ecological Expertise it is necessary to submit to the State

Committee for Nature protection the results of status monitoring of the

Karshi Main Canal surface waters before and after discharge of Talimarjan

TPP sewage waters.

1. ВВЕДЕНИЕ

CS-MM планирует выполнять экологические проверки дважды в год (в ноябре и мае каждого года) и вести ежемесячную регистрацию наблюдений.

Из-за того, что CS-MM не был на строительной площадке в июле, августе и почти весь сентябрь 2014, не были выпущены экологические отчеты. Поэтому данный отчет предоставляет исчерпывающий анализ экологического статуса на строительной площадке по состоянию на сентябрь 2014.

Даты посещения площадки: 18, 24, и 25 Сентября 2014

Средняя температура: 30 °C

� Область энергоблока – обратная засыпка почти завершена, фундамент котла утилизатора 2 был залит, фундамент ГТГ 2 был залит и продолжаются работы по армированию, стержневая арматура для ГТГ 3 установлена, бетон для котла утилизатора 3 находится под выдержкой, ПТГ 1 и 2 are заложены, и происходит установка арматуры установки конденсатоочистки системы регенерации.

� Фундамент Комнаты управления / административного здания был залит. И устанавливаются арматурные стержни и арматурные стойки устанавливаются.

� Здание столовой – завершено и эксплуатируется � Строительство рабочего лагеря (Topalang и HDEC) продолжается

Был выполнен маленький экологический прогресс во время июля и сентября 2014. Очень много беспокойств, которые остаются неизменными и работы которые не соответствуют ПЗОС. Таблица 1 описывает ключевые экологические проблемы по состоянию на сентябрь 2014. Данные проблемы обсуждались с HDEC и Topalang на совещании которое произошло 24 сентября 2014 (Протокол приведен в Приложении A), и официальное письмо в ГРП (Приложение B).

Environmental Normative Documents (ZEP)

As of the end of September 2014, CS-MM and the PMU have not received a formal letter from HDEC stating that the ZEP for construction is not needed.

Furthermore it is still unclear who is responsible, if at all, for either obtaining a ZEP for operation or paying environmental compensation fees for working facilities (i.e. batch plant, refuelling area, worker’s camps, etc.).

HDEC state that they have received an official letter from the Karshi Environmental Committee stating that a ZEP for the construction period is not needed. They have not sent this letter to CS-MM or the PMU.

HDEC is currently in the process of determining what is required for the working facilities and who is responsible for this. It is the opinion of CS-MM, that the EPC Contractor and subcontractor would be responsible for ensuring that working facilities are following local environmental regulations.

HDEC сообщил что они получили официальное письмо от Каршинского Комитета по охране ОС в котором указано что ЗЭП для строительного периода не нужен. Они не отослали данное письмо ни в CS-MM ни в ГРП.

HDEC на данный момент в процессе определения что необходимо для рабочих установок и кто ответственный за это. CS-MM считает

строительства.

Поэтому, не ясно до сих пор, кто является ответственной стороной за получение ЗЭП для эксплуатации, либо за оплату компенсации для рабочих структур (таких как БСУ, область заправки, рабочие лагеря, и т.д.)

Resource records and quantitative environmental data

The monthly environmental reports from HDEC still do not contain adequate data for CS-MM to do a proper environmental analysis of the construction site.

The following data is outstanding:

- Wastewater quantities - Water usage quantities - Test results from water

quality analysis including information on where the sample were taken from (some of this information is provided in the July 2014 monthly environmental report)

- Type and quantities of waste

- Quantitative emissions results (to the air)

Ежемесячные экологические отчеты от HDEC до сих пор не содержат правильной информации для того чтобы CS-MM выполнил тщательный экологический анализ строительной площадки.

Since January 2014 CS-MM have stated that the environmental monthly reports produced by HDEC need to be more detailed. They need to include quantitative environmental data.

С января 2014 CS-MM заявлял неоднократно что ежемесячные отчеты по экологии от HDEC должны быть более детальными. Они должны включать экологические количественные показатели

Resource records need to be improved. This has been emphasized by CS-MM in most of our monthly environmental reports. Without quantitative date it is difficult for us to do any environmental assessment aside from visual site visit inspections.

Регистрацию ресурсов необходимо улучшить. Это было подчеркнуто CS-MM в большинстве ежемесячных отчётов по экологии. Без количественной информации очень трудно для нас выполнить какую-либо экологическую оценку, кроме визуальной проверки площадки.

Based on the HDEC monthly environmental reports for July and August 2014, resource monitoring has improved slightly as there are now water quality results. However the quality indicators for discharge do not show the locations and quantities of discharge.

Основываясь на ежемесячном отчете по экологии за июль и август 2014, контроль ресурсов немного улучшился так как теперь имеются результаты о качестве воды. Однако показатели качества для выброса не отражают места и объемы выбросов.

The Contractor is not producing statistical reports for any environmental authority. If this is not required a letter from the environmental authorities must be provided. Regardless it is international best practice to keep resource records.

Lack of water meters has been a concern since the start of the project. Some were purchased by Topalang in June 2014 and partially installed, however they are not being used and are not certified.

Remains Open. No progress has been made since June 2014 with regards to water meter installation and certification.

Topalang confirmed that the water meters are not officially installed. They are not using them to pay for water because the Presidential Decree (PP-1933, 7 March 2013) states that Uzbekenergo is responsible for paying for utilities and therefore there is no incentive for them to use the water meters. However the EMP and international best practice requires that accurate monitoring of resource usage takes place. The water meters do not have to be used for payments, but should be used for recording accurate quantities.

A filter was installed on the 26/06/2014 however it was damaged / poorly maintained after 20 days of operation and has not been repaired. Workers are drinking from the technical water supply.

Drainage on site

Drainage and wastewater treatment at the batch plant, refuelling area, and vehicle washing need to be vastly improved.

Currently there is no drainage at the batch plant (an issue that has been raised several times over the past 3 months).

The refuelling area should be paved and adequate drainage and wastewater treatment should be provided. Furthermore a catch basin around the fuel tanks should be installed.

The vehicle washing area wastewater collection and treatment needs to be improved.

Ongoing issue from May 2014

Open. Still needs to be vastly improved. Topalang has assured improvement by mid-October 2014 during a meeting held on the 24 September 2014 (MoM in Appendix A).

Section 3 of the general terms and conditions of the HDEC and Topalang Contract states:

21.8 “The subcontractor shall be responsible for pollutions emanating from its own equipment”.

The monthly environmental reports from HDEC need to include more detailed information. Furthermore at the moment there are many statements that are misleading (as described in CS-MM comments on the HDEC monthly progress reports). The reports lack information on key environmental issues such as environmental payments, analysis of test results, and any issues with the sub-contractor. 2. РЕЗУЛЬТАТЫ

1.1. Статус ПЗОС

Статус выполнения ПЗОС, по состоянию на 26 сентября 2014, показан в Таблице 4. Проверенный ПЗОС от 6 августа 2014 был использован для данного анализа.

Экологическая ситуация на строительной площадке не правильная для многих работ и не соответствует ПЗОС ориентированному на строительную площадку. Данные вопросы обсуждались на совещаниях между Topalang и HDEC 24 сентября 2014 (Протокол в Приложении А) и официальное письмо в ГРП было направлено 26 сентября 2014 (копия письма в Приложении В).

1.2. Проверка ПЗОС

Было согласовано что каждые 6 месяцев ПЗОС будет пересмотрен для постоянного улучшения. В мае 2014, HDEC, ГРП, и CS-MM пересмотрели и проверили ПЗОС чтобы отразить текущие условия и состояние площадки. Цель проверки – гарантировать постоянные улучшения (ISO 14000).

. Пересмотренная версия ПЗОС ориентированного на площадку, была предоставлена в ГРП 6 августа 2014г. HDEC ждет официального утверждения от ГРП. Следующая ревизия ожидается в Ноябре 2014.

1.1. Рекомендации

Рекомендации для ГРП

� Беспокойства поднятые в письме от CS-MM в ГРП должны быть донесены до HDEC

� ГРП должна продолжать гарантировать что местные стандарты по экологии соблюдаются в плане отчетности экологической статистики и разрешений.

� Эксперт ГРП в области ООС должен посещать строительную площадку более чаще (рекомендуется раз в квартал)

� Все замечания и рекомендации предоставляемые CS-MM должны быть переданы в HDEС для выполнения улучшения.

Рекомендации для экологов HDEC и Topalang

ГРП должна рекомендовать следующее для HDEC:

� HDEC должен улучшить текущую экологическую ситуацию, так как много аспектов ПЗОС не выполняются. Письмо от CS-MM в ГРП описывающее необходимые улучшения, так же как и описано в таблице 1 и таблице 4. Следующие области необходимо улучшить:

o Дренаж на площадке o Очищение сточных вод и ее выброс o Регистрация ресурсов (включая установку водных счетчиков) o Управление отходами o Контроль розлива и обучение o Природоохранные разрешения для существующих сооружений и

2 Drainage on site: CS-MM pointed out the following aspects of the EMP:

EMP 5.2 “Waste water from concrete batching plant operation and shall not be discharged overland” – the current drainage and wastewater collection at the batch plant is unacceptable. EMP 5.3 “Undertake settling and neutralization of alkaline washing water containing excessive cement prior to discharge” – this is not taking place EMP 5.4 “Washing of equipment areas must be equipped with a suitable impermeable floor and sump/oil trap” – there is inadequate drainage and a non-functional oil trap at the vehicle washing area EMP 5.5 “Waste water collected within bunded area around the fuelling area be disposed of as hazardous waste” – there is inadequate drainage at the fuelling area EMP 6.4 “Sediment tanks can be used for settling wastewater prior to disposal” – the sediment tanks on site have not been fully constructed and are not operational. EMP 6.5 “All drainage facilities, erosion, and sediment structures shall be regularly inspected and maintained” – drainage facilities are not adequate

EMP 7.3 “Treat oily wastewater in coalescence separator prior to

discharge“ – this is not taking place

Topalang reviewed the drawings for the water disposal areas and

agrees they need to be modified and implemented. They argee

that drainage on site needs to be improved. They state it will be

done in 10 days.

HDEC pointed out that the Topalang/HDEC contract requires

Topalang to discharge wastewater appropriately.

выбросом»-этого не происходит Topalang проверил чертежи для областей выброса воды и согласился что их необходимо переделать и выполнить. Они согласились что дренаж на площадке необходимо улучшить. Они заявили что это будет выполнено через 10 дней. HDEC подчеркнул что контракт

между Topalang/HDEC обязует Topalang сбрасывать сточную воду

соответствующим образом.

3 Water meters: CS-MM pointed out the following aspects of the EMP:

EMP 1.4 “monthly monitoring of water (m3)” – Although the

quantity of water is being “recorded” it is not being measured as the

water meters have not been tested/certified and therefore are not

officially operational. The comments are misleading here when it

states: “the usage of water is being monitored”. In the “monitoring

of usage” the August monthly report states that the quantity of non-

potable and potable water is the same as in June and July implying

that they are not using the water meters. Topalang states that water meters are not yet officially installed. They are not using them to pay for water because the Presidential Decree (PP-1933, 7 March 2013) states that Uzbekenergo is responsible for paying for utilities and therefore there is no incentive for them to use the water meters. However the EMP requires that accurate monitoring of resource usage takes place. The water meters do not have to be used for payments, but should be used for recording accurate quantities. Они не используют их для оплаты воды потому что Постановление президента (РР-1933, от 7 марта 2013) гласит что Узбекэнерго ответственно за оплату услуг и к тому же нет мотивации для низ использовать счетчики воды. Однако ПЗОС требует чтобы происходил правильный мониторинг используемых ресурсов. Счетчики воды не необходимо использовать для оплат, но должны быть использованы для регистрации правиьного количества.

4 Spill control: Контроль розлива: CS-MM pointed out the following aspects of the EMP: CS-MM подчеркнул следующие аспекты ПЗОС: EMP 5.9 “Develop a hazardous materials and handling plan. Provide spill response kits at all HazMat storage areas and work sties” – CS-MM have never seen any spill kits on site.

EMP 7.1 a) “Any spillage of fuel shall straight away be absorbed using sand or other absorbent materials” – there is no sand or absorbent materials present by the refuelling station, employees have not been trained on spill control. d) “Fuelling should be done on concrete surface provided with spill catch tank that can be easily cleaned and all spilled fuel recovered/safely disposed” – this is not taking place at the refuelling area e) “All repair and maintenance work to be done either on concrete surface with oil spill catch basins or oil catch pans provided at all service areas” – please provide evidence of this. EMP 7.2 d) “All Fuel tanks and storage areas provided with concrete embankments to readily contain spills” – no yet complete e) Provide spill response kits at all working areas – no spill response kits on site Topalang states that these measures are understood and will be implemented. ПЗОС 7.2 d) “все резервуары для топлива и области хранения снабженные цементными насыпями должны иметь быстрый доступ к устройствам сбора разлитой жидкости” – еще не закончено e) предоставить устройства сбора разлитой жидкости на всех рабочих областях – на площадке отсутствуют устройства сбора разлитой жидкости Topalang сообщил что данные меры поняты и будут выполнены. Waste management: Управление отходами: CS-MM pointed out the following aspects of the EMP: EMP 8.1 “should keep a waste log for all types of wastes produced in construction site” – there is no waste log currently. The types and quantities of wastes should be recorded. EMP 8.3 d) “Must be separated do the domestic, metal scrap, used oil, paper, hazardous, etc” – waste separation on site should be improved. EMP 8.6 “Provide sufficient bins with lids to store the solid waste produced on a daily basis” – there are not currently sufficient bins on site. More have apparently been ordered but the status has not changed for over 4 months. CS-MM выделил следующие аспекты ПЗОС: ПЗОС 8.1 « необходимо вести регистрацию для всех типов отходов производимых на строительной площадке»-на данный момент отсутствует регистрация отходов. Видимо было заказано больше, но положение не изменилось более чем за 4 месяца.

ПРИЛОЖЕНИЕ B: ПИСЬМО В ГРП КАСАТЕЛЬНО ЭКОЛОГИЧЕСКИЗ

ВОПРОСОВ

26 September 2014 Dear Yusupov Olim M., The environmental situation at the construction site is not adequate and not compliant with the Site Based Environmental Management Plan (EMP). CS-MM raises environmental issues in our monthly environmental reports however we would like to bring your attention specifically to the following issues:

1. The ZEP for construction – it is not clear whether the local regulations of Uzbekistan are being followed in this regard. Apparently HDEC have a letter from the Karshi Environmental Committee stating they do not need the ZEP for construction, however this letter has not been passed to CS-MM or the PMU. Regarding the ZEP for operation of the facilities in operation, HDEC needs to determine who is responsible for obtaining this, if at all. The Contractor is not currently providing any statistical environmental data to any environmental authority and it needs to be confirmed whether this is acceptable. An official letter should be provided.

2. In July 2014 HDEC submitted the revised EMP to the PMU. They are awaiting official approval on this document.

3. There are many aspects of site operation that are not compliant with the EMP (July 2014). The following issues are outstanding:

a. Drainage, collection, and treatment of storm and wastewater are inadequate. This applies in particular to the batch plant area, vehicle washing area, and refueling area. These areas are not paved over in a way that allows for wastewater collection, there is no treatment of wastewater, and although drawings have been produced for wastewater collection and treatment they require modification and have not been implemented. This situation has not improved since February 2014. See Points 5.2, 5.3, 5.4, 5.5, 6.4, 6.5, and 7.3 of the EMP.

b. The water meters for cold and hot water have not been officially installed (no test certificates have been provided to CS-MM). It appears from the monthly environmental reports that the water is being measured using norms as the quantity of non-potable and potable water for each month remains the same, therefore implying the actual consumption is not measured. This is unacceptable from a resource management point of view. See point 1.4 of the EMP.

c. Spill control should be improved on site. Employees need to be trained on spill control and spill kits need to be provided on key areas of the site. See points 5.9, 7.1, and 7.2 of the EMP.

d. Waste management is in need of improvement. More containers should be installed and more waste separation needs to take place. See points 8.1, 8.3, and 8.6 of the EMP.

4. The monthly environmental reports from HDEC need to include more detailed information. Furthermore at the moment there are many statements that are misleading (as described in CS-MM comments on the HDEC monthly progress reports). The reports lack information on key environmental issues such as environmental payments, analysis of test results, and any issues with the sub-contractor.

All these comments have been raised in CS-MM environmental monthly reports as well as in the Appendices of the CS-MM comments on the HDEC Monthly Progress Reports. CS-MM has not received any replies to the comment sheets. Please ensure that the comments are being passed on to HDEC. The issues in this letter regarding the EMP have been brought up in a meeting between Topalang and HDEC on 24 September 2014. MoM and photographs are attached. +++++++++++++++++++++++++ Уважаемый г-н Юсупов, Экологическая обстановка на строительной площадке не правильная и не соответствует Плану защиты ОС для строительной площадки (ПЗОС). CS-MM поднимает экологические проблемы в наших ежемесячных отчетах по экологии, однако, нам бы хотелось обратить ваше внимание особенно на следующие проблемы: 1. ПЗОС для строительства – не ясно выполняются ли местные нормативы в Узбекистане в этом отношении. Видимо HDEC имеет письмо от Каршинского Комитета по охране ОС, которое гласит что им не нужно ЗЭП для эксплуатации сооружений в рабочем состоянии, HDEC необходимо определить кто вообще является ответственным за получение этого. Подрядчик на данный момент не предоставляет никакие статистические экологические данные ни в какой уполномоченный орган по защите ОС и это необходимо подтвердить приемлемо ли это. Должно быть предоставлено официальное письмо. 2. В июле 2014 HDEC предоставил пересмотренный ПЗОС в ГРП. Они ждут официального утверждения данного документа. 3. Существует много аспектов эксплуатации площадки которые не соответствуют ПЗОС (Июль 2014). Имеются следующие нерешенные вопросы: a. А) Дренирование, сбор и очищение ливневой и сточной воды не правильные. Это касается в частности области БСУ, области мытья транспортных средств а так же области заправки. Данные области не замощены таким образом, что позволяет сбор сточной воды, отсутствует очищение сточной воды, и хотя чертежи для сбора и очистки сточной воды производились, их необходимо переделать и они не были реализованы. Данная ситуация не улучшилась с Февраля 2014. См. пункты 5.2, 5.3, 5.4, 5.5, 6.4, 6.5, and 7.3 ПЗОС. b. Счетчики воды для холодной и теплой воды не были официально установлены (не были предоставлены сертификаты тестирования в CS-MM). Из ежемесячных отчетов по экологии очевидно, что вода замеряется согласно использования стандартов, так как количество не питьевой воды и питьевой воды для каждого месяца остается неизменной, следовательно фактический расход не замеряется. Это не приемлемо с точки зрения управления ресурсами. См. пункты 5.9, 7.1 и 7.2 ПЗОС.

c. Контроль розлива должен быть улучшен на площадке. Работников необходимо проинструктировать о контроле розлива а так же устройства сбора разлитой жидкости необходимо предоставить в ключевых областях на площадке. См. пункты 5.9, 7.1, и 7.2 ПЗОС. d. Управление отходами необходимо улучшить. Необходимо установить больше контейнеров и больше отделения мусора должно происходить. См. пункты 8.1, 8.3, и 8.6 ПЗОС. 4. В ежемесячные экологические отчеты от HDEC необходимо включать больше детальной информации. К тому же на данный момент много заявлений которые сбивают с толку (как описано в замечаниях CS-MM к ежемесячным отчетам HDEC о ходе работ). В отчетах не хватает информации о ключевых экологических проблемах, таких как экологические платежи, анализы результатов тестирования и любых вопросов с субподрядчиком. 5. Все данные замечания были подняты в экологических отчетах CS-MM а так же в Приложениях замечаний CS-MM к ежемесячным отчетам HDEC о ходе работ. CS-MM еще не получил никакие ответы в своим листам с замечаниями. Просим убедиться, что замечания были переданы в HDEC. 6. HDEC needs to push the subcontractor to get these properly installed and used correctly. The Committee on Nature Protection per }lb 18/768- conclusion of the State Committee on

Nature Protection of the Republic of Uzbekistan, has reviewed your petition letter and informs

you that:

The State Committee on Nature Protection of the Republic of Uzbekistan performed J\b

181768- positive conclusion about implementing the necessary nature protection measures for

"Construction of Two Combined Cycle Gas Turbine Units 450 MW each for TTPP Expansion

and its environmental impact (l- level)" on l3 August,2013.

. / Contractor should submit a report each quarter_about done work for implementing thev conclusion conditions of "Consfiffioffr;m"mbined Cycle Gas Turbine Units 450 Mweach for TTPP Expansion and its environmental impact (I- level)" according to 2l-article ofooEnvironmental Impact Assessment Law" of Republic of Uzbekistan dated on25 May 2000;

Nsl6l-order, confirmed on 8 September 2011 by chairrnan of the State Committee on Nature

Protection of the Republic of Uzbekistan oostatue about monitoring of implementing nature

protection measures showed on conclusions ofthe state environmental approvals of inspections,

environmental certification agencies and State Environmental Expert Review and cooperation

conditions between the systems of environmental normalizing.

According to this the following information should be provided in the report:

facts about formalizing(legalizing) procedures of this land corresponded with Land Code ofRepublic of Uzbekistan and on 25 February 2013 published J'&54-resolution of Cabinet ofMinisters Republic of Uzbekistan about oolmplementing of urban development activity and

providing with non-agricultural lands, also normalization measures of submitting permission for

the construction of objects" despite the land for construction of Two Combined Cycle Gas

Turbine Unit is located in TTPP area;

copy of the schedule of step by step works designed in the project and approved by

management, also providing with necessary information about done work in accordance with this

schedule.

Until construction's commission based on "Construction of Two Combined Cycle Gas

Turbine Units 450 MW each for TTPP Expansion and its environmental impact (I- level)",

contractor will inspect the object for state environmental impact assessment per o'Statement ofenvironmental consequences" according to the requirements of 15- article of "EnvironmentalImpact Assessment Law" of Republic of Uzbekistan dated on25 May 2000, and according to the

requirements of ooProviding with lands of settlements for implementing urban development

activity, designing of construction objects and registration them, also commissioning of objects"

based on Ng54-resolution of Cabinet of Ministers of Republic Uzbekistan about "implementing

of urban development activity and providing with non-agricultural lands, also normalizingmeasures of performance the permission for the construction of objects" dated on25 February

' 2013 will be accepted for operation..,.

We inform you thaf, based on stafutory indicators of "statement of environmental

consequences", payment for pollution and waste of environment will be performed by legalpersons- Branch enterprise of TTPP according to the Ns 199-resolution of Cabinet of Ministersof Republic of Uzbekistan dated on I May 2003 'oabout developing of payment system for waste

and pollution of environment in the territory of Republic of Uzbekistan".
