Contract Protection
To protect against the costs and damages associated with delay if asbestos is discovered after work is already in progress, the contractor should include a “changes and extras” clause in any contract for repair and renovation of existing facilities.Suchaclauseshouldnotifyownersoftheirobligationtodetermineifthestructurecontainsasbestos.Theclauseshouldprovideforincreasedcompensationandanincreaseintimeforcompletionifphysicalconditionsatthesitearedifferentfromthosedescribedintheplansandspecifications.Any new conditions, such as asbestos discovered mid-project, would then trigger a “claim” or “extra” negotiation between the contractor and the owner.Withoutsuchaclause, thecontractorshouldincreasetheinitialbidtocoverunforeseenhazardsoradditionalworkthatmayonlybediscoveredonceworkbegins;otherwise the contractor runs the risk of paying for any such additional work.
