End of Registration of Chemical Products
This notice is published under section 47C of the Agricultural and Veterinary Chemicals Code scheduled to the Agricultural and Veterinary Chemicals Code Act 1994 (Agvet Code). The APVMA provides notice that:
1. the registration of the products listed at Table 1 ended and were not renewed for the financial year 2017–18 (the product(s)).
2. the registrations for the product(s) ended on 30 June 2017.
INSTRUCTIONS FOR DEALING WITH THE CHEMICAL PRODUCTS
The APVMA issues the following instructions for the possession, custody, supply and use of existing stocks of the product(s) listed in this notice and which were manufactured in, or imported into, Australia before 30 June 2017:
1. the label attached to the container of the product must be identical (except for particulars relating to the batch number, date of manufacture or expiry date of the product) to an approved label for that product that was in force on 30 June 2017; and
2. the products are to be used in accordance with the instructions on the approved label for that product.
Note: The label(s) for these products in force on 30 June 2017 continue in force while these instructions apply to the product.
INSTRUCTIONS FOR POSSESSION, HAVING CUSTODY OF, USING OR OTHERWISE DEALING WITH THE PRODUCTS
If after publication of this notice a person, possesses, has custody of, uses or otherwise deals with the product(s) in accordance with the instructions in this notice, the person is taken to have been issued with a permit to possess, have custody of, use or otherwise deal with the product(s) in accordance with those instructions until:
a) 1 year after the day on which the registration ended (being 1 July 2017); or
b) the APVMA, by notice published in the Gazette, declares that this subsection does not apply in respect of the product(s);
whichever first occurs.
LATE APPLICATIONS FOR RENEWAL OF REGISTRATION
A late application for renewal of registration for products whose registration has lapsed as at 30 June 2017 will only be accepted up until 15 December 2017.
Products whose registration lapsed before 30 June 2017 and late applications for products whose registration lapsed as at 30 June 2017 that are received after 15 December 2017 will need to submit a new application for product registration.
FAILURE TO COMPLY WITH NOTICE
All products listed in this notice are now subject to APVMA compliance. Where instances of possession, custody of, use or otherwise dealing with the product(s) with the intention of supply, or to supply the product(s) outside the scope of the notice are identified, regulatory action will be considered.
It is an offence under the Agvet Code for a person to supply, or cause or permit to be supplied or possess for supply, any product(s) listed in this notice after 30 June 2017 other than in accordance with this notice. It will be an offence to supply the product(s) or to possess or have custody of the product(s) with the intent of supplying it after 30 June 2017 or an earlier date notified by the APVMA by notice in the gazette.

Recall Notice Issued to Rust-Oleum Australia Pty Ltd
Notice under section 104(1) of the Agricultural and Veterinary Chemicals Code (Agvet Code), as scheduled to the Agricultural and Veterinary Chemicals Code Act 1994.
Notice No. 2 of 2017
Applicable to all pack sizes of Zinsser Mould Stop Primer (Containing: 4,5-Dichloro-2-N-Octyl-3(2h)-Isothiazolone, 1.23 G/L) (hereafter, the product).
On 10 October 2016, the Australian Pesticides and Veterinary Medicines Authority (APVMA) issued a notice (recall notice) to Rust-Oleum Australia Pty Ltd (Rust-Oleum) pursuant to section 101 of the Agvet Code in relation to the product. The product is not a registered agricultural chemical product.
BRIEF STATEMENT OF MATTERS TO WHICH RECALL NOTICE RELATES
The recall notice imposed the following obligations on Rust-Oleum:
1. Rust-Oleum must immediately stop supplying the product to any person.
2. Rust-Oleum must by no later than 24 October 2016:
a) prepare and issue a letter to all of Rust-Oleum's distributors and retailers who have, or have had, possession or custody of stocks of the product, advising that the product is subject to a notice under section 101 of the Agvet Code and requesting return of the product to the control of Rust-Oleum.
b) accept any returns of the product made by any person.
The obligation appearing at (1) (above) was the subject of a notice under section 104 of the Agvet Code, which appeared on pages 16–17 of the APVMA Gazette published on 21 March 2017 (Notice No.1 of 2017).
Between 21 October 2016 and 10 November 2017, the operation or implementation of the obligation described at (2) (above) was stayed by orders of the Administrative Appeals Tribunal (the Tribunal) pending the determination of an application by Rust-Oleum for review of APVMA’s decision of 10 October 2016 (the decision).
On 10 November 2017, the Tribunal affirmed the decision. As a result, the entirety of the decision is now operative.
The new date for compliance with the recall notice is 5 December 2017.

Amendments to the APVMA MRL Standard
The Australian Pesticides and Veterinary Medicines Authority (APVMA) approves maximum residue limits (MRLs) of agricultural and veterinary chemicals in agricultural produce, particularly produce entering the food chain. The MRLs approved by the APVMA are associated with a regulatory decision to register a product, grant a permit approval, or as an outcome from a review decision and are set out in the Agricultural and Veterinary Chemicals Code Instrument No. 4 (MRL Standard) 2012. The MRL Standard lists MRLs of substances that may arise from the approved use of agricultural and veterinary chemical products containing those substances on commodities used for human consumption as well as livestock feeds. The MRL Standard also provides the relevant residue definitions to which these MRLs apply. There may be situations where the residue definition for monitoring and enforcement is different to the definition used for dietary risk assessment purposes.
MRLs are set at levels which are not likely to be exceeded if the agricultural or veterinary chemicals are used in accordance with approved label instructions. In considering MRLs and variation to MRLs, the APVMA takes into account studies on chemistry, metabolism, analytical methodology, residues, toxicology, good agricultural practice and dietary exposure. In approving MRLs, the APVMA is satisfied, from dietary exposure assessment, that the levels set are not an undue hazard to human health.
The APVMA has amended the MRL Standard and the changes will have affect the day after the instrument is registered.
Details of the amendment can be found in the Agricultural and Veterinary Chemicals Code Instrument No. 4 (MRL Standard) Amendment Instrument 2017 (No. 12).
The amendments will be incorporated into the compilation of the Agricultural and Veterinary Chemicals Code Instrument No. 4 (MRL Standard) 2012.

Proposal to amend Schedule 20 of the Australia New Zealand Food Standards Code
In the previous notice on page 40 of APVMA Gazette No. 24, the APVMA gazetted amendments which it has approved to vary maximum residue limits (MRLs) for substances contained in agricultural and veterinary chemical products as set out as in the APVMA’s MRL Standard.
Under section 82 of the Food Standards Australia New Zealand Act 1991, the APVMA is proposing to incorporate those variations (Agricultural and Veterinary Chemicals Code Instrument No. 4 (MRL Standard) Amendment Instrument 2017 (No. 12)) to MRLs into Schedule 20–Maximum residue limits in the Australia New Zealand Food Standards Code.
MRLs contained in Schedule 20 provide the limits for residues of agricultural and veterinary chemicals that may legitimately occur in foods. By this means, Schedule 20 permits the sale of treated foods and protects public health and safety by minimising residues in foods consistent with the effective control of pests and diseases.
The APVMA and Food Standards Australia New Zealand (FSANZ) are satisfied, based on dietary exposure assessments and current health standards, that the proposed limits are not harmful to public health.
The agreement between the Australian Government and the New Zealand Government concerning a Joint Food Standards System, excludes MRLs for agricultural and veterinary chemicals in food from the system setting joint food standards. Australia and New Zealand independently and separately develop MRLs for agricultural and veterinary chemicals in food.
FSANZ will make a Sanitary and Phytosanitary (SPS) notification to the World Trade Organization (WTO).
The APVMA invites comment on these proposals. Details on how to make a submission appear near the end of this notice, below the details of the proposed amendment.
The APVMA will consider any public comments made in response to this proposal. If the APVMA decides to proceed with the proposal, it will further notify any variations it makes to Schedule 20 in the APVMA Gazette. The variations will take effect as from the date of that subsequent notice.

INVITATION FOR SUBMISSIONS
Written submissions are invited from interested individuals and organisations to assist the APVMA in considering the proposal to vary Schedule 20–Maximum residue limits in the Australia New Zealand Food Standards Code. Submissions should be strictly confined to relevant matters that the APVMA must consider (such as public health and safety) which are associated with the occurrence of the proposed residues in foods. Comments received outside these grounds will not be considered by the APVMA. Claims made in submissions should be supported wherever possible by referencing or including relevant studies, research findings, trials, surveys etc. Technical information should be in sufficient detail to allow independent scientific assessment.
Please note that FSANZ will make a SPS notification to the WTO and submissions related to impacts on international trade should be made to FSANZ in response to that notification.
Submissions must be made in writing and should be clearly marked as a ‘submission on the proposed amendment to Schedule 20’ and quote the correct amendment number.

Variations to Schedule 20 of the Australia New Zealand Food Standards Code
The APVMA has previously gazetted particular amendments which it had made to the APVMA MRL Standard and which have been proposed as variations to maximum residue limits (MRLs) for substances contained in agricultural and veterinary chemical products as set out as in Schedule 20–Maximum residue limits of the Australia New Zealand Food Standards Code. This notice pertains to proposals (No. 9) gazetted on 5 September 2017 (No. APVMA 18).
Submissions have been sought on these proposals and the APVMA has written separately to each person or organisation that made a submission. All matters raised in the submissions have been resolved.
Under subsection 82(1) of the Food Standards Australia New Zealand Act 1991, the APVMA has, by legislative instrument, incorporated these variations to MRLs into Schedule 20. A copy of the Amendment Instrument (No. APVMA 24, 2017) accompanies this notice.
