Important Charter questions on ballots arriving April 27 By The Miami laker Staff Miami Lakes registered voters will be receiving their mail-in bal- lots on April 27 for the May 17 special election involving 10 pro- posed amendments to the Town's Charter recommended by the re- cent Charter Revision Commis- sion. Town staff, in collaboration with The Miami Laker, prepared a comprehensive 16-page Voter's Guide that was designed to be included as an insert in this issue that would outline in English and Spanish the 10 ballot questions with a thorough explanation of each issue. When Town Manager Alex Rey requested funding for the Voter's Guide at the end of the April 5 Council meeting, Mayor Michael Pizzi strongly opposed the expen- diture of taxpayer funds saying, "The voters will get their ballots, the questions are on the ballot, the voters are not dumb, they don't need any further explanations." Rey explained there is a limit to the number of words which can appear on an official ballot, and there were several recommended amendments which could not be completely explained within the allocated verbiage, thus the need for further detailed clarification for each proposed amendment. Council members refused to go along with Pizzi's opposition and decided to have the Good Government Initiative review the Guide for any misleading informa- tion, and voted to have a con- densed version mailed to regis- tered voters prior to the April 27 delivery of the mail ballots. Since the ballot questions are numbered 1 to 10 corresponding in sequence to the actual Charter arti- cles, several of the more important proposals may be overlooked by voters. The owners, publisher and staff of The Miami Laker believe it is important for Miami Lakes voters to completely understand the rec- ommended amendments to the Town's Charter (it's Constitution), to preserve the integrity and digni- ty that this community was found- ed upon and understand the impor- tance of their votes on these items. One of the most important pro- posed amendments is Ballot Question #9 concerning the elec- tion of Mayoral and Council can- didates by a majority vote. The Charter currently allows a candidate who receives the highest number of votes in an election to be declared the winner. The result is that a candidate may be elected by less than 50 percent of the vot- ers. For instance, if there are four candidates running for a position, a candidate can be elected with less than 26% of the votes, mean- ing approximately 74% of the vot- ers did not vote for the candidate being elected! When the Town's Charter was originally adopted in 2000, it pro- vided that a candidate must receive more than 50 percent of the votes to be declared a winner, and that a runoff would be held if no candi- date received more than 50 percent of the votes. The proposed amend- ment would return to the original Charter language, requiring candi- dates to obtain more than 50 per- cent of the vote to be elected. This would have a profound effect on the Town's general elec- tion in November where there are already three Mayoral candidates (Councilmembers Ceasar Mestre, Manny Cid, former Mayor Wayne Slaton, and possibly Pizzi, even though he has not filed paperwork with the Town), three candidates opposing the reelection of Tony Lama for Seat 3, and four candi- dates running for Cid's vacant Seat 5. Nelson Rodriguez is unopposed to date for his reelection to Seat 1. If Ballot Question #9 is adopt- ed by voters, the result would be runoff elections where winners would receive a majority of the votes cast. Another important proposed amendment is Ballot Question #3 concerning the Town's Form of Government. When the original Charter was adopted in 2000, the form of gov- ernment called for a "Mayor- Bobcat Law Society scores a first at Project Citizen Fair Bob Graham Education Center’s 7th Grade Bobcat Law Society won first place at the 2016 Project Citizen Fair at Florida International University’s School of Law. The group presented the Breanna Vergara EKG Initiative project, named after the 11-year- old Miami Lakes resident who died of a rare heart condition after she collapsed during dance prac- tice in 2014. Her mother, Claudia Vergara, said her daughter died from pre- excitation Wolff-Parkinson-White syndrome, a congenital heart defect that is curable when it is detected with an EKG. The Town of Miami Lakes and the Breanna Vergara Foundation are spearheading the initiative to make sure all kids who participate in sports and other physical activ- ities in the town have a free EKG at local hospitals to detect any heart conditions that can save their lives. The Bobcat Law Society will be among the schools representing Miami-Dade Public Schools at the Project Citizen Capitol Showcase. (Please see Page 3)

Summary of Town Council actions at April 5 meetingDuring its April 5 regular meet-

ing, the Miami Lakes TownCouncil approved a handful of res-olutions, one ordinance and asome new business items proposedby Council members.

• Council members approved asmaller information guide of theproposed charter changes for mail-ing to registered voters along witha postcard before they are set tovote through a mail-in ballot forthe May 17 special election.

Council members shot downMayor Michael Pizzi’s proposal todo away with the guide and placethe suggested charter changes on

the town’s website instead.Lawmakers decided not to go

with a larger version developed bytown staff for placement in thisissue of The Miami Laker as aninsert and delivered to homeswithin the town’s boundaries andbusinesses.

The town will also create a linkon the town’s website with the pro-posed amendments.

Council members also agreed tosend the information guide to theGood Government Initiative for areview to make sure the languageis accurate and understandable.

According to the town, the

mail-in ballots are scheduled to goout on April 27 and residents mustreturn them before the date of thespecial election.

• Lawmakers deferred an ordi-nance to replace the town’s trafficconcurrency regulations with amobility fee system that will fundmulti-modal transportation im-provements and encourage devel-opment that better mitigatesimpacts on the transportation sys-tem.

If approved at a later date, theordinance may apply to futuredevelopment within the town.

• Council members gave their

initial approval for an ordinance toamend the town’s sign code toaddress a recent U.S. SupremeCourt decision to provide betterorganization and clarity andaddress sign types that are current-ly not addressed.

• Lawmakers approved a reso-lution expressing support for thecreation of a dormant multipur-pose maintenance special taxingdistrict for the proposed residentialdevelopment by Lennar at thenorthwest corner of N.W. 154Street and 87 Avenue.

Miami Lakes supported the cre-ation of the Centre Lake Com-munity Development District inwhich the county has the authorityto create CDDs and special taxingdistricts, which requires that whena CDD is created that there also becreated a dormant special taxingdistrict that can assume responsi-bility for certain maintenancefunctions should the CDD fail toperform those functions.

In a related matter, Councilmembers approved a preliminaryplat entitled Dunnwoody Lake forthe Lennar Corporation to developa subdivision of homes (156 sin-gle-family homes and 226 townhomes on a 142-acre propertyalong N.W. 154 Street and west ofN.W. 87 Avenue.

The project is part of the N.W.87th Avenue Development agree-ment between Miami Lakes andthe developer, which requires theproperty owner to reimburse thetown for construction of N.W. 154Street for roadway improvements,donate $300,000 for education andallow residents limited access toMadden’s Hammock as a passivepark.

The developer must meet theterms of the covenant before thetown issues the first building per-mit for the project.

• Council members approved aresolution to allow a conditionaluse and site plan for a private col-lege, Ana G. Mendez University,at 15201 N.W. 79 Court in Miami

Lakes Business Park West.Last year, the council approved

a temporary use for the college ina building near the permanentlocation, an 8.53 acre site which isowned by The Graham Companies.

The fully accredited collegewas founded in Puerto Rico andhas Florida campuses in Miramar,Tampa and Orlando.

For traffic concerns, studentsand staff’s trips to and from thefacility are during off peak hourswith morning classes from 9 a.m.to 2 p.m. and evening classes from6 p.m. to 10 p.m.

• Council members approved anamendment to a 2009 interlocalagreement with Miami-DadeCounty that transferred the formerspecial taxing district parks to thetown and outlines the town’s pro-rata share of the Quality Neigh-borhood Improvement Program.

The amendment generates asavings of $162, 442 to the gener-al fund over the course of the lifeof the loan.

The combined impact of theapproval of these items is a netgain of $90,757 to the town, whichresults from the savings of the refi-nancing of the two bonds issues,QNIP bonds ($162,446) and stormwater utility bonds ($73,491) off-set by the cost of funding a portionof the local share for the canaldrainage project ($145,180).

• Lawmakers approved an inter-local agreement to refund Miami-Dade Water and SewerDepartment for the local share(12.5 percent) for a FEMA fundeddredging project along the N.W.57th Avenue canal. The totalamount of reimbursement duefrom the town is $145,180 whichwill be repaid over the next 10years at the rate of $14,518 peryear.

Summer is just around the cor-ner and Miami Lakes announcedit will offer two camps in partner-ship with PEAR and the YMCA.

Camps will run Monday toFriday, 7 a.m. to 6 p.m., for chil-dren ages 5 to 15 year old. Bothorganizations also offer afterschool care from 2 to 6 p.m. dur-ing the school year with trans-portation available.

Summer Camp with PEARwill take place at the YouthCenter at Miami Lakes East Park,6075 Miami Lakes Drive East,while the YMCA will host itscamp at the Roberto AlonsoCommunity Center, 16500 N.W.87 Avenue.

Important ballot faces voters on Charter revisionsCouncil-Manager" form of gov-ernment. In reviewing differentforms of government, the CharterRevision Commission learned thatthis form of government is not awidely-recognized term and thatthe form of government known as"Council-Manager" more accu-rately reflects the Town's form ofgovernment.

The proposed amendmentdeletes the word "Mayor" toreflect the Town’s government iscomprised of a Council (Mayorand 6 Councilmembers) thatenacts legislation and sets policy,and a Manager who is responsiblefor the day-to-day administrationand implementation of legislationand policy.

The successful adoption of this

Ballot Question would remedy theperception that Miami Lakes has a"Strong Mayor" form of govern-ment, which it does not.

Ballot Question #4 is a pro-posed amendment that would clar-ify the Town's responsibilities inthe event of a vacancy in theMayoral seat. The existing Charterlanguage which provided for the2013 Special Election to fill Pizzi'sseat when he was removed fromoffice by Governor Rick Scott dueto criminal charges filed againsthim by the FBI involving a grantscam with the City of Medley andMiami Lakes, would be amendedto state that the Vice-Mayor wouldfill the Mayor's seat if it becamevacant for the duration of the Vice-Mayor's term. If the Vice-Mayor'sterm is shorter than the Mayor's

term, then, when the Vice-Mayor'sseat is up for election, a specialelection would be held to elect aMayor to complete the remainingtime of the original term of theMayor.

Other ballot questions - #1,#5, #6, #7 and #8 - relating toRepresentation of the Town beforeCounty, State and Federal regula-tory bodies, appointing a TownManager, selection of an ActingManager, appointing a TownAttorney, and Permission to call aSpecial Meeting, replace the word"Mayor" in each amendment withresponsibilities delegated to theTown Council.

Ballot Question #2 wouldamend the Town's Citizen's Bill ofRights by adding two additionalrights:

1. "Natural Resources andScenic Beauty," which adds a pol-icy that the Town conserve andprotect its natural resources andscenic beauty, and that this policyinclude limiting the amount of airand water pollution, and excessiveand unnecessary noise, wheneverpossible.

2. "Ethics in Government,"which provides that the Town'soperations and government mustmeet the highest ethical standardsand demonstrate the highest levelof achievement in its adherence toethics laws.

Ballot Question #10 wouldrectify conflicting language in thecurrent Charter. When the originalCharter was adopted in 2000, theTown was divided into four resi-dental areas and four Council-members were required to beelected from each of the fourareas. In 2013, the Town's electorsvoted to eliminate the residentialareas, resulting in at-large elec-tions for all Council seats. Due tothe results of the 2013 election, theprovisions regarding composition

of the Charter Revision Commis-sion are now obsolete.

The proposed revision wouldeliminate the requirement thatthere be one person appointed tothe Charter Revision Commissionfrom each of the four residentialareas, which no longer exist.

Some residents expressed theirbeliefs that a mail-in ballot in Maywas not the way these items shouldbe resolved and that they shouldhave been included in theNovember general election.

Charter Revision Commissionchairman David Bennett stronglyrecommended the May election toavoid having these important pro-posals for the Town's constitutionlost amidst a very large Novemberballot.

It is vitally important that allregistered voters understand theintent of the proposed amendmentsand cast their ballots, Yes or No,on each question.

In Memoriam:John Collins, husband of former Councilmember Mary Collins

John Collins, a former U.S.Marine, a Miami-Dade police offi-cer, and the husband of formerMiami Lakes CouncilmemberMary Collins has died.

Collins died on March 27 at theage of 82.

He joined the Marines follow-ing his high school graduation andwas honorably discharged.

He then joined the Miami-Dadepolice department and retired after

30 years on the force.After he and his wife moved to

Miami Lakes, Mary Collins, a for-mer Miami-Dade County Com-missioner, won a seat on the newMiami Lakes Town Council in2001 and won reelection for twoconsecutive terms.

John Collins was a member ofthe Miami Lakes VeteransCommittee, one of the many com-mittees his wife created to help the

town cater to the different needs oftown residents of different genera-tions.

“John was an invaluable mem-ber of the committee and willalways be remembered for hiscontributions, his laughter and hisremarks that placed a smile oneveryone’s face,” said AlejandroSanchez, chair of the VeteransCommittee. “Now is the time notonly to mourn his loss but remem-ber the good times we all sharedand be a strong support for Mary.”

Alvin Entin said Collins was apoliceman with talent, integrityand a symbol of all that was goodin law enforcement.

“He was a spirited supporter ofConservative causes before it waseither convenient or popular to bea conservative,” said Entin. “In theforefront with his wonderful wife,they spearheaded the RonaldReagan Revolution in Miami-Dade and never lost sight thatConservatism, as espoused byReagan and Goldwater, was

grounded in intense patriotism andlove for all people and their rightfor a chance to succeed.”

Said Esther Amador: “He wasan amazing human being.”

Miami-Dade CountyCommissioner Esteban Bovo Jr.,said: “I am saddened to hear thenews of John Collins passing. Johngave much of his time to servinghis community and looking out forothers from which we will alwaysbe thankful.”

A memorial service for JohnCollins was held on March 30 atOur Lady of the Lakes CatholicChurch in Miami Lakes.

A group of local student-ath-letes were honored for their stellarperformances for 2015-2016sports season, as they were namedto The Miami Herald’s All-DadeTeams for basketball, soccer,wrestling and cheerleading.

For boys’ basketball, MaterAcademy senior guard Dylan Fryewas named to the All-Dade 8A-6AFirst Team, averaging 23 points,six assists and four rebounds pergame, while his teammates seniorguard Chris Mejia and seniorplayer Rafael Diaz made theSecond Team.

from generation to generation.This year’s team continues thattradition with a 13-game winstreak, a 6-0 district record, and achampionship victory in theHSBN March Madness Shootout

Gold Tournament.The streak began in early

March with a victory overAmerican High followed by aseries of home wins over MiamiSprings Senior High, St. BrendanHigh School, and iMater Charter.

The team then defeated districtrivals Immaculata-LaSalle HighSchool 7-0 at Barry University,with senior Christopher Rodriguezpitching six innings and six strikeouts, before finishing the monthby winning the 16-team HSBNMarch Madness Shootout GoldTournament.

"We have faced some of thebest teams in all of South Floridaand due to our impressive pitchingstaff and great defensive work, wehave been successful" said pitch-ing coach Charles Lyman.

“Our pitching staff has been ourbiggest strength,” said senior leftfielder Jordan Topps. Key pitchersfor the team include ChristopherRodriguez, who averaged 93-94mph each game, and senior JesseCastro with his impressive reliefpitching.

Senior center fielder JonathanReyes-Diaz also credits the team’spitching for their success. “Wehave excellent pitching, our chem-istry as a team is amazing, we arebrothers on and off the field, andwe have amazing defense to backup the pitchers,” said Reyes-Diaz.

“I feel like we can go the dis-tance and make it to [the statechampionships] to win it all,” saidpitcher Manuel Rodriguez.

Premios Copa Dorada is asports awards luncheon created tohonor the top Hispanic athletes inMiami-Dade County, recognizing70 athletic achievements of thebest youth talent from theHispanic community each year.

Dominguez, a senior, hasrecorded a 3.38 GPA and is, so far,putting up impressive statisticsthis season.

Playing three positions, pitcher,shortstop and third base,Dominguez has registered an 1.04ERA, 137 strikeouts and 13 winsin 94 innings of work, accordingto Max Preps.

She also has a .186 OBA (heropponents batting average against

her) and an .826 fielding percent-age.

Dominguez was selectedPlayer of the Game for her per-formance against top-rankedUniversity on April 5.

Dominguez is undecided onwhat college she is planning onattending in the fall.

Lakes Educational Center recentlywon a Skype call with NicholasKristof, Pulitzer-prize winningauthor and opinion columnist forthe New York Times, through hisemail newsletter contest.

Kristof was raised in Yamhill,Oregon; a place that he describesas “in the middle of nowhere.”Through this middle of nowhere,however, he found his calling:Journalism.

“My journalism career beganby total accident – I was in the 8thgrade, and a bunch of people at mygrade school decided that theywanted to make a newspaper.”

Kristoff didn’t even show up tothe first organizational meeting,but after a surplus of writers andno editors to be found, he waspicked to be an editor. He contin-ued working with local newspa-pers through middle school andhigh school, and in college workedfor several newspapers, including

The Washington Post. However,Kristof was very nearly somethingcompletely different: A lawyer.

“I went to law school, and I wasin great danger of becoming alawyer, but, fortunately, I escapedthat fate and I ended up writing forThe New York Times.”

Although he began coveringeconomics for the Times, he hasspent the majority of his career asan Asian foreign correspondent.Kristof is perhaps most known forhis work concerning human rights,a career that began after hisPulitzer-prize earning coverage ofthe Tiananmen Square protests.

“I covered the student democra-cy movement, and one night atTiananmen Square, the army justcame and mowed people down – Iwas so heartbroken, so outraged,but witnesses said they’d seenthousands of students killed. I wasa witness, I was there, and I knewthat wasn’t what happened.”

Kristof said, “As a journalist,you have to side with the truth –it’svery human to exaggerate the scale

and brutality of what happened:perpetrators lie and exaggerate,but so do victims.”

After 2001, Kristof has beenwriting opinion columns, mostlydealing with humanitarian issues,particularly women’s rights – atopic that has been important tohim since the start of his journal-ism career back in middle school.

“My first editorial got me in areal bunch of trouble because it

was about how girls couldn’t wearblue jeans in my school, but after afew articles, the restrictions werefinally relaxed.”

When asked if he consideredhimself an activist or a journalist,Kristof responded that he was “amix of both.”

“People congratulate me onbeing an activist and I worrybecause activists don’t pursue thetruth, and I always want to pursuethe truth.

“As a journalist, I’m in thelighting business – if I shine myspotlight on something that needsattention, then maybe people willstart paying attention and give theissue the help it needs.”

As a final piece of advice to stu-dents interested in pursuing jour-nalism as a career, Kristof said:“There will always be a market fornews and information in the world.The ability to communicate isalways in demand.”

The Northpointe YMCA locat-ed at 7351 N.W. 186 Street, ishosting the annual Healthy KidsDay on April 30 from 10 a.m. to 1p.m. The event, a YMCA nationalinitiative to improve the healthand wellbeing of families acrossthe country, includes free interac-tive activities, sports clinics,health screenings, family fitnessfun, nutrition education, watersafety and the opportunity to signup for summer camps and pro-grams.

The Superintendent's HonorsOrchestra is a part of the Miami-Dade County Honors MusicFestival that students from Miami-Dade County Public Schools audi-tion to be a part of at either the ele-mentary or secondary level inorchestra, band, and choir.

Miami Lakes K-8 Center stu-dents Ariana Rejas and FrancisDalipe, both eighth graders audi-tioned for the first time and wereselected to this elite group ofstring players. Rejas has beenplaying violin since the beginningof seventh grade and Francis is inhis first year of orchestra playingcello. Rejas is also an accom-plished pianist for her age andplays guitar. Francis also plays

guitar and ukulele. “These two have quite the

musical future,” said MLK-8Center music teacher Sara Cino.

As part of the audition, the stu-dents prepared a set of scales andan etude on their instrument aswell as sight read music.Qualifying students were thengiven music to prepare on theirown and then rehearse with therest of the students in two 2.5 hourlong rehearsals in preparation fora final concert.

Two Miami-Dade CountyPublic Schools’ (M-DCPS)offices were honored recently atthe Frost Museum of Science bythe White House Initiative onEducational Excellence forHispanics. Recognition was givento the Office of Early Childhood'sTransition to KindergartenAmbassadors Program. This ini-tiative was recognized for itsimpact on 17,000 Hispanic stu-dents in Miami-Dade County.

The program promotes kinder-garten readiness and enhancesrelationships between 1,300 pri-vately-owned, early learning cen-ters and 150 neighboring M-DCPS elementary and K-8 cen-ters.

The Office of AdvancedAcademics also was recognizedfor addressing the College Accessand College Completion educa-tional priorities for the WhiteHouse Initiative on EducationalExcellence for Hispanics.Hispanic students in M-DCPSmake up 72 percent of all studentsparticipating in the AdvancedPlacement (AP) program and 68percent of students taking DualEnrollment (DE) courses.

In the College Board’s APReport to the Nation, Miami-Dade is first in the nation in thenumber of individual Hispanic/Latino students scoring 3+ on APExams (9,206), and leads thenation in number of AP Examswith scores 3+ taken byHispanic/Latino students (13,678).
