Numerous petitioners have filed petitions for exemption from the closed captioning requirements, pursuant to Section 79.1 of the Commission’s rules, 47 C.F.R. § 79.1, for their programs. Each of these petitioners claims that compliance would impose an undue burden, as defined in Section 79.1(f) of the Commission’s rules, 47 C.F.R. § 79.1(f).
We are now placing these petitions on public notice. We note that where similar petitions were previously placed on public notice, an opposition was filed by only one commenter. 1 The last date any opposition was filed was March 2, 2006. This same Commenter wrote to the Commission that “Commenters have decided to not have Bingham McCutchen routinely prepare oppositions to closed captioning petitions” that they characterize as “clearly deficient.”2 This Commenter notified the Commission that they would only file oppositions to petitions that raised new issues, because “[p]reparing a unique opposition to each of the pending 450 petitions, no matter how routine the oppositions have become, poses a significant burden on Commenters and their limited resources.” 3 As a result, the Commission stopped placing these petitions on public notice.
Nevertheless, this same Commenter has now indicated to the Commission that it is interested in filing comments related to these types of petitions.4 Given this request, we now place all such petitions on public

We further note that all such petitions for relief from the closed captioning rules based on undue burden will be placed on public notice on a going forward basis.
Given that all of these petitions have been available on the Commission’s website since October 12, 2006, and that many interested parties have already reviewed and commented on the granted petitions through the Parties’ Application for Review,6 comments and oppositions are due within 20 days from the date of this public notice. The case identifier, located in Column 1, must be placed on all filings. Comments and oppositions sent via e-mail to the Commission will be considered informal and are not part of the official record.
Filing Instructions -
An original and two (2) copies of all comments, oppositions, and replies must be filed with the Commission. Filings can be sent by hand or messenger delivery, commercial overnight courier, or by first class or overnight U.S. Postal Service mail (although we continue to experience delays in receiving U.S. Postal Service mail). All filings must be addressed to the Commission’s Secretary, Office of the Secretary, Federal Communications Commission, Attention: CGB Room 3-B431.
* The Commission’s contractor will receive hand-delivered or messenger- delivered paper filings for the Commission’s Secretary at 236 Massachusetts Avenue, N.E., Suite 110, Washington, DC 20002. The filing hours at this location are 8:00 a.m. to 7:00 p.m. All hand deliveries must be held together with rubber bands or fasteners. Any envelopes must be disposed of before entering the building.
* Commercial overnight mail (other than U.S. Postal Service, Express Mail and Priority Mail) must be sent to 9300 East Hampton Drive, Capitol Heights, MD 20743.
