TESTIMONY: COUNTY ANIMAL CONTROL OFFICER Officer Pitts explained he was dispatched to 1567 Speaker Road in Wolf Creek to what appeared to be a dog attack and described the scene in which he saw a deceased 3- week- old, 20- pound lamb and an Ewe shaking profusely with deep punctures to her throat, ears, face and still bleeding. Officer Pitts noticed dozens of paw prints in the soft mud and followed the dog tracks through the pens, into the pasture and along the fence by the road to a pasture gate along Speaker Road. Officer Pitts asked to take the lamb as evidence and once the dog was impounded and sedated, we were able to get canine and paw impressions. Veterinarian Gary Buckmaster did the evaluation of the lamb and noted there was minimal surface lesions but upon skinning the animal there were severe underlying tissue damage with severe damage to the loins and abdominal wall and stated the 5 to 6 cm skin punctures are consistent with the 5 to 6 cm canine spread of a 2- year- old Rottweiler. TESTIMONY: OWNER OF IMPOUNDED DOG Mark Minton, Dog Owner, mentioned his two- year- old Rottweiler usually stays inside the house because he outgrew the fence and on this day, the dog was chained up outside and managed to slip out of his collar and got loose. Mr. Minton said he did pay Ms. Luthy $ 450 to compensate for the lamb that was killed ( Exhibit B) and bought a 10x10 kennel for his dog to stay in while he is at work( Exhibit C). Lori Peck, Sleepy Hallow Loop in Grants Pass, testified that the 2- year- old Rottweiler is the nicest dog, is not aggressive at all and has no problem with the dog being around her grandchildren saying the dog licks and plays with them and has never shown any signs of aggression. Commissioner Walker asked Officer Pitts how the dog was doing at the Animal Shelter and Officer Pitts said he is friendly and welcoming to everyone except him, when Officer Pitts walks by he growls and snarls at him.

Pursuant to notice through the media and in conformance with the Public Meeting Law, Cherryl Walker, Chaircalled the meeting to order at 3: 00 p.m.

Commissioner Hare read a memo casting his vote regarding ORS 609. 155 ( Exhibit A) and excused himself fromthe hearing.

Commissioner Walker asked David Pitts, Animal Control Officer, to explain the events that led to the hearing.

TESTIMONY: COUNTY ANIMAL CONTROL OFFICER

Officer Pitts explained he was dispatched to 1567 Speaker Road in Wolf Creek to what appeared to be a dogattack and described the scene in which he saw a deceased 3- week-old, 20-pound lamb and an Ewe shakingprofusely with deep punctures to her throat, ears, face and still bleeding. Officer Pitts noticed dozens of paw

prints in the soft mud and followed the dog tracks through the pens, into the pasture and along the fence by theroad to a pasture gate along Speaker Road. Officer Pitts asked to take the lamb as evidence and once the dog wasimpounded and sedated, we were able to get canine and paw impressions. Veterinarian Gary Buckmaster did theevaluation of the lamb and noted there was minimal surface lesions but upon skinning the animal there weresevere underlying tissue damage with severe damage to the loins and abdominal wall and stated the 5 to 6 cmskin punctures are consistent with the 5 to 6 cm canine spread of a 2- year-old Rottweiler.

TESTIMONY: OWNER OF IMPOUNDED DOG

Mark Minton, Dog Owner, mentioned his two-year-old Rottweiler usually stays inside the house because heoutgrew the fence and on this day, the dog was chained up outside and managed to slip out of his collar and gotloose. Mr. Minton said he did pay Ms. Luthy $450 to compensate for the lamb that was killed (Exhibit B) andbought a 10x10 kennel for his dog to stay in while he is at work( Exhibit C).

Lori Peck, Sleepy Hallow Loop in Grants Pass, testified that the 2- year-old Rottweiler is the nicest dog, is notaggressive at all and has no problem with the dog being around her grandchildren saying the dog licks and playswith them and has never shown any signs of aggression.

Commissioner Walker asked Officer Pitts how the dog was doing at the Animal Shelter and Officer Pitts said heis friendly and welcoming to everyone except him, when Officer Pitts walks by he growls and snarls at him.

BOARD DETERMINATION FINDINGS: FEES, PENALTIES, AND DISPOSOTION OF DOG

The Board discussed the disposition of the dog, possible penalties to be assessed and agreed on the followingconditions:

285 Shelter Fee.

325 Veterinarian Fee.

500 Penalty for the dog getting loose and killing livestock.20 License Fee.

Dog Neutered by May 6, 2016 and provide a certificate to the Animal Shelter.Animal Control to come out and check the new fence.

RE: Public Hearing in the Matter of: A Request by the owner of a dog or dogs impoundedunder the authority of ORS 609.155, for wounding, injuring, killing, or chasing livestock

The purpose of this memo is to provide my position on any and all requests by an owner of adog or dogs impounded under the authority of ORS 609.155 for wounding, injuring, killing, orchasing livestock. If a preponderance of evidence exists that a dog did indeed cause any of thepreviously described stresses to livestock, the dog(s) should be put down immediately.

Rehabilitation is not an option. There may be evidence to suggest that rehabilitation is possible,but the responsibility of allowing for that margin of error lies with the Board ofCommissioners. There is only one way to guarantee no possible margin of error... the animal is

put down. I won' t put the county at possible liability by allowing an animal that we havereason to believe has a propensity to cause harm to get the opportunity to cause that harmagain in the future.

It is important to note that my decision to put down a dog for cause of wounding, injuring,killing or chasing livestock is not to be construed as punishment for the actions of the dog. Theonly person responsible for the actions of any dog is of the owner.

This decision is not appealable and is standing for all future hearings concerning this issue.

Case# 10793 Minton on Speaker Road, Wolf Creek, Oregon.

I was called by ACO David Pitts and asked to evaluate a dead, 3 week old, 20 pound, St.Crouix- cross ewe lamb for possible cause of death, suspected dog attack and bite analysis.

There were minimal surface lesions, but upon skinning the animal, there was severeunderlaying tissue damage, as is usually the case. There were multiple bites and hemorrhagicdamage to the neck. There was severe damage to the loins and to the abdominal walls. The rightkidney was exteriorized. There were 5 to 6 cm skin punctures consistent with the 5 to 6 cmcanine spread of the 2 year old rottweiler identified as `Tyson', held in legal hold. This dog isVERY aggressive, and had to be sedated to be evaluated.

In my professional opinion, with 37 years of experience, the cause of death of the lambwas the physical trauma it suffered from the dog attack.

As RP walked ACO Pitts back to the sheep pen at this time Iobserved one ( 1) Ewe wobbling as she stood shaking profusely.She had blood on both sides of her throat and on the upper portion

of her head and ears.

Closer inspection of the ewe deep punctures to her throat, ears, facewere still bleeding ( photo support). Also observed was one( 1) dead

Lamb within twenty (20') feet of her mother. Photos will show theewe hiding under the barn floor with deep puncher wound to herright side neck area.

Additional Photo support to damage on the Lambs mother around

the throat and head area.

Photo support validates what appears to be tooth punctures, on the

left side and on the right side just above the hips. Bite Radius will be

measured by Veterinarian Gary Buckmaster.The lambs head also had additional wounds visible when you

moved the wool to the side at the base of the skull neck area.

Please note the lambs head, neck and lower back area was soaked

with smelled like dog saliva, in this Officers opinion the dog waslicking the blood off of the wool of the dead Iamb.Please Note: No water was in the immediate area where the lamb

lay dead only dry ground.Dog Prints and Mr. Minton' s shoe/boot soul tracks consistent withthe shoes he was wearing during dog seizure were photographed

and measured with a forensic scale.

The dozens of paw prints in the soft mud matched appeared to be

very close to the paw prints on the Rottweiler taken into custody. .I followed the dog tracks through the pens into the pasture andalong the fence by the road to a pasture gate long Speaker road.The tracks were met by the same soul tracks as the ones AnthonyMinton were wearing. These tracks were through a gate and on thesheep owners property.

Tracks along speaker road lead back to the 1325 Speaker Rd.residence where I seized the Rottweiler known as Tyson.

After I returned to RP's Ranch RP said A little after 9am the morningof the 29th of March 2016 the neighbor was leading dog from herproperty towards his 1325 Speaker Rd house.Note this validates my findings of tracking the dog and the brother ofdog owner walking coming and getting the dog on sheep ownersproperty.RP said she went to the Wolf Creek store for coffee and made some

phone calls. RP, continued to say there are no other dogs that sizeanywhere only around her ranch for miles and miles.The Rottweiler has been in that field two (2) times in the last week or

so. That sheep pen is part of that field. 3/ 24 I texted a relative ofthe dog owner and told him to come get the Rottweiler before I shootit.

RP said to ACO You have been more of a help than you can everimagine in my life. I don't think I could take it if I had to" file a reportonline" or" leave a message". My critters mean more to me thanmost humans. I just don' t understand why things go the way they do.

ACO asked the RP if I could have the Iamb as evidence to compare

bite radius to seized Rottweiler bite, she said yes.

Please Note: RP added a year ago said , my Livestock GuardianDogs Anatolian Pyrenees killed their pit bull who was attempting toharm her sheep but she had moved her dogs to the other side of herranch to protect her calves. RP continued by saying these peopledon' t care and let their dogs run all over the place. She also said

they are not nice people, and have more than a few brushes withlaw enforcement.

Please note, walking the Rottweiler across a water soaked toweland measuring those prints and walking him in mud also matchedusing the forensics scale. An official measurement fromVeterinarian Dr. Gary Buckmaster with be taken

ACO Pitts drove the 1325 Speaker road residence and made

contact with the brother of the dog owner Mr. Anthony Minton. Hehad the big Rottweiler on a leash and appeared to be was leaving

with the dog.He ( Mr. Anthony Minton) looked up, as he looked at me I could hearhim say shit! As I exited my vehicle I asked his name he saidAnthony, I asked if he was aware his dog was at large on theneighbor's property and Killed, injured and chased the neighbor'ssheep.

He said it wasn' t my dog, I replied what would say if I told you I knowyou came out of your house and noticed the Rottweiler was loose

again, you knew your dog had repeatedly ran to the neighborsproperty many times over the past several weeks and was warnedby the property owner this past week to keep your Rottweiler off ofher property.You walked to your neighbor's property and found your dog wayover there (ACO pointing to the neighbors sheep pensapproximately three hundred ( 300) yards away) in the sheep penand walked your dog back home this morning at approximately0845hrs.

I told Mr. Minton I followed that dog' s tracks from the sheep penwhere the dead lamb was and injured ewe was, I cut your tracks

pointing to his shoes with the same tread pattern on them as werein the neighbors pasture and in the dirt where he was standing) inthe neighbors pasture by the gate well on her property, next to yourtracks are the Rottweilers.

I told him I know he was over there this morning and killed that Iamband severely injured the lamb's mother. I asked what would you sayif I have a witness that saw you walking that Rottweiler back backtowards your home.

Mr. Minton looked down and then at the dog and said when I walkedoutside I saw he was gone again, my nephew let him out, we try tokeep him in but he gets out, yeah I went over and got him I tried toget him home and leave before she came over and wanted to shoot

him. I asked him, him as in the Rottweiler and her as in the owner of

the sheep, he said yes.Mr. Minton at this time immediately bent over and grabbed the dogsmuzzle and said God Damn you!

I asked him if he would load the dog, he said no, and walked himtowards me. The dog became very aggressive hackles up, Headdial on me growling and lunging towards me barking and snappinghis jaws.

I expressed immediate concerns for my safety and grabbed mychemical spray in my left hand my radio microphone in my right.I informed Mr. Minton I could have OSP here in minutes, and if he

sent that dog on me it would be assault on a peace officer,continued by saying, I would like to ask you again Mr. Minton torethink what you do here, I will ask one more time, would you please

load the dog into the open door kennel in the back of my truck for

The Nephew of Mr. Minton a Troy, seemed highly agitated and said Iam going to shoot all of her cows and sheep, I expressed concernfor him not to make comments such as that in front of me, He saidhe didn't care and when I leave he is going to shoot all of them. Iasked his name he refused to give it but for some reason gave mehis DOB which he said was 9/ 21/ 90

Mr. Minton at this time reluctantly complied, as he loaded the dog.He made sure the dog had enough leash lead it made me moveback away from the Animal Control Vehicle as he smiled. Pleasenote at this time I observed what appeared to be blood on the left

side of the dogs nose and on the muzzle at the back part of his lip.By the time I returned to the shelter it was gone, due to hisaggression I could not get close to take a photo.

As he shut the dog of the ACO vehicle, the dog seemed veryaggressive and hit the door and began barking and moving aroundso much the ACO Vehicle moved up and down and from side toside.

I expressed to both Anthony and his nephew it' s a shame this had tohappen but the process is for your Brother Anthony is to meet withme, I really do not want to approach him at his work as professionalcourtesy.

ACO PITTS RECEIVED A CALL FROM THE DOG OWNER MARKMINTON, I EXPLAINED WHAT HAPPENED AND THE FACT THATHIS DOG GOT LOOSE AND WAS ON THE NEIGHBORS RANCHAND KILLED CHASED AND INJURED THE LAMB AND EWE. IEXPLAINED THE PROCESS OF CITATIONS FOR DOG AT

LARGE, NUISANCE DOG AND BEING IN VIOLATION OF NOLICSENCE. I ALSO EXPLAINED TO HIM HE WOULD HAVE THERIGHT TO A HEARING, HE UNDERSTOOD AND SAID HEWOULD MEET WITH ME AT 0910 HRS AT THE WALMARTPARKING LOT.

ACO PITTS MADE CONTACT WITH DOG OWNER A MR. MARKMINTON AT THE WALMART PARKING LOT IN GRANTS PASSOREGON AT APPROXIMATELY 0915HRS. I HANDED HIM HISRIGHT TO A HEARING AND A CITATION FOR THREE (3)VIOLATIONS FOR ORS' 609. 100, 609.060, 609.095. MR.

MINTON ASKED ME WHAT IS GOING TO HAPPEN FROM THISPOINT ON, I TOLD MR. MINTON I CAN NOT SPECULATE THETHE EVIDENCE IN MY EYES IS OVERWHELMING. MR. MINTONALSO SAID HE HAS NO DOUBT HIS DOG DIDN'T DO IT ANDHEARD THERE WERE WITNESSES/ PASSERBYERS. AT APPROXIMATELY 1345HRS, ACO PITTS M, ET WITH DR.GARY BUCK MASTER , LARGE ANIMAL VET SPECIALIST.

AFTER THE EXAM OF THE LAMB THE AMOUNT OF DAMAGEWAS INCREDIBLE UNDER THE SKIN. THE TWO( 2) YEAR OLD

ROTTWEILER KNOWN AS TYSON ON A LEGAL HOLD AT THEJOSEPHINE COUNTY ANIMAL SHELTER WAS ALSOEVALUATED. PLEASE SEE DR. BUCKMASTERS OFFICIALREPORT. A WET TOWELL WAS PLACED IN THE KENNELWHERE THE ROTTWEILER WASLKED ON IT AND FOOT PRINTSWERE MEASURED WITH A FORENSIC SCALE , THE PAWSWERE ALSO MEASURED AND ACCORDING TO DR.BUCKMASTER ARE CONSISTENT WITH THE PAW MARKS BYTHE DEAD LAMB. Animal Control Officers Recommendation

My investigation has provided admission by both brothers (dog owner) the Rottweilercommitted the acts.

I have brought in a large animal veterinarian Gary Buckmaster to perform, examine and

conduct all tests that have confirmed beyond a doubt the Rottweiler owned by Mr. Minton is

the same dog that killed the lamb and maimed/ injured the Ewe, mother of the dead lamb.

My reports reflect the RP stated she warned them a week prior to remove their Rottweiler fromher property near the sheep pen, Mr. Minton validates this.

Reports and Photo evidence further confirms that Minton admitted he went onto the

neighbor' s property to regained control of the Rottweiler after it killed her lamb and brutallyinjured her ewe. Shoe prints, and dog prints confirm this.

Veterinarian Gary Buckmasters report confirms the Rottweiler' s paw measurements matchthose at the scene of the lambs death and injuries to the mother ewe.

Veterinarian Gary Buckmasters report confirms the Rottweiler' s Bite matches those on thelamb carcass and skin.

The aggression of this dog both at the scene and at the shelter have me concerned for the

safety of nearby livestock and people living in and around the area.

Due to the ongoing issues of the Minton' s NOT being unable to control and keep their dogs ontheir property as with the Pitbull incident previously the husky dog they now have who hasbeen reported at large by neighbors and now this dog.

Having been warned the week prior with regards to this dog at large on the neighbor' s ranchand still unable to control the Rottweiler, if asked what my recommendation would be for the

fate of this dog it would be as follows;

It is ill responsible dog owners who allow their animals to run after being warned their animal isa threat. At this time I would not want to see this animal put to sleep but possibly become

property of the Josephine county animal shelter. There he could be temperament tested andtransferred out of Josephine County to be adopted and placed in another environment with the

understanding this a '• . harms Livestock.
