RE: SPRINGWOOD LAND DIVISION - VARIATION APPLICATION
(DA490/D026/19 & DA960/D025/19))
We refer to the land division creating an additional 1,201 allotments with associated bulk earth works,
landscaping and removal of 47 Regulated Trees and 40 Significant Trees (DA490/D026/19 and DA960/D025/19)
at Gawler East and Kalbeeba (Springwood) that was approved by the State Commission Assessment Panel
(SCAP) on 13 February 2020 (refer to decision notification attached in Appendix 1).
The applicant, Springwood Development Nominees Pty. Ltd. [‘Springwood’] now seeks to vary the proposed
plan of division resulting in an overall reduction of nine (9) allotments.
It involves the division of allotments for ‘residential’ purposes (allotments 997 – 1001) on land adjacent the
town centre that was previously earmarked for ‘commercial’ land uses (approved Allotment 2060).
The proposed variation also involves the removal of three (3) allotments to the east of the site (approved
Allotments 16, 17 & 18), and a minor adjustment to the configuration of two (2) allotments (approved
Allotments 19 and 20). These amendments have occurred as a result of a minor amendment to the original
Highfield plan of division (DA040/D010/17) which has resulted in the creation of two additional allotments in
the Highfield subdivision (subject to Council consent). These two new allotments in the Highfield subdivision
have replaced three allotments (and slightly adjusted the configuration of two allotments) that originally formed
part of the Springwood plan of division DA490/D026/19 & DA960/D025/19.
1.0 Proposed Variation to Approved Plan of Division
The proposed variations to the approved plan of division are demonstrated spatially within Figure 1 and Figure 2
below with the revised allotment configuration and ‘metrics’ provided in Table 1 below. A copy of the proposed
Plan of Division prepared by Alexander Symonds is also attached in Appendix 2.

The proposed variation to the approved plan of division results in an overall reduction in commercial allotments
(reduced by 1 lot), Terrace allotments (reduced by 13 lots), Villa 10.5m allotments (reduced by 8 lots) with a
corresponding increase in the number of Traditional allotments (increased by 1 lot), Courtyard allotments
(increased by 3 lots) and Villa 12.5 allotments (increased by 9 lots).
The amended plan of division results in a total allotment yield of 1,192 allotments with total of 1,184 residential
allotments.
The proposed variation application does not seek to alter or amend the road alignment of the approved plan of
division nor the provision of proposed future public open space / reserves.

2.0 Procedural Considerations
2.1 Variation Application
The variation is proposed pursuant to Section 39(6) of the Development Act, 1993 which states:
(6) Subject to this section, a person may seek the variation of a development authorisation previously
given under this Act (including by seeking the variation of a condition imposed with respect to the
development authorisation).
In requesting The State Commission Assessment Panel (SCAP) consideration and assessment of a new ‘variation
application’ it is noted that:
• pursuant to Section 39 (7)(a) of the Development Act, 1993 the relevant authorisation is still operative
(recognising that pursuant to the ‘Advisory Notes’ Development Plan Consent will expire 10 years from
the Decision Notification dated 13 February 2020);
• pursuant to Section 39(7)(d) of the Development Act, 1993 the variation application does not seek to
extend the period for which the relevant authorisation remains operative.
2.2 Relevant Authority
By letter dated 15 November 2018 the State Coordinator General appointed the State Commission Assessment
Panel (SCAP) as The Relevant Authority to assess and determine the original Development Application pursuant
to Schedule 10(20) of the Development Regulations, 2008.
Pursuant to Schedule 10, clause 20(2) of the Development Regulations, 2008, the SCAP will continue to act as
the Relevant Authority in relation to a variation of an application for development undertaken in accordance
with Section 39(4)(a) of the Development Act, 1993. Schedule 10, clause 20(2) of the Development Regulations,
2008 states:
(2) Without limitation, subclause (1) applies to—
(a) a variation of an application for development referred to in section 39(4)(a) of the Act if the
development proposed to be varied has previously been given development authorisation under this
clause; and
(b) proposed development that the State Planning Commission considers to be ancillary to or in
association with development that has previously been given development authorisation under this
clause, [our emphasis]
3.0 Zone & Policy Framework
Whilst the overall plan of division is located within both the Town of Gawler and The Barossa Council, the
proposed variation to the plan of division relates to land located entirely within the Gawler (CT) Development
Plan. Since the lodgement and determination of the original development application, the ‘Gawler East
Structure Plan DPA’ was endorsed by the Minister for planning on 11 July 2019. Accordingly, the proposed

variation to the approved plan of division must now be assessed against the Gawler (CT) Development Plan
recently consolidated on 18 July 2019.
The land subject of the proposed variation application is located within the Mixed Use Centre Policy Area 3 of
the Residential (Gawler East) Zone in the Gawler (CT) Development Plan (Consolidated 18 July 2019).
A plan showing the Zoning and Policy Areas applicable to the subject site and surrounds is provided in Figure 3
below.

4.0 Development Plan Assessment
As a variation application, it is only those parts of the application that have been varied that require assessment
against the Development Plan.
Given the proposed variation to the approved plan of division does not seek to vary the approved road layout
nor configuration of public open space and reserves, the following brief assessment focuses on the proposed
future land use mix and allotment composition of the amended plan of division.
It is noted that ‘Land Division’ is specifically envisaged in the Zone by Principle of Development Control 1 of the
Residential (Gawler East) Zone.

The future land use of the overall plan of division remains consistent with Objective 1 of the Residential (Gawler
East) Zone as well as Objective 1 of the ‘Mixed Use Centre Policy Area 3’ of the Gawler Development Plan which
seek a range of low and medium-density dwellings, with associated infrastructure, retail, commercial,
recreational, educational and community development in a master-planned community.

OBJ 1 A predominately residential area comprising a range of low and medium-density dwellings,
with associated infrastructure, retail, commercial, recreational, educational and community
development in master-planned locations in accordance with Structure Plan Map Ga/1

community, residential, office, consulting rooms and educational uses.

Importantly, the proposed overall sub-division layout continues to accommodate future medium density
residential development as well as future commercial development (commercial, retail, office & consulting
room development) within the ‘Mixed Use Centre Policy Area 3’.
Whilst one allotment designated for future commercial development is proposed to be replaced with five (5)
residential allotments, there is a considerable balance of approximately 4.4 hectares of commercial land
proposed to be retained within the future ‘Village Centre’ fronting Calton Road and the new Gawler East Link
Road (under construction). In addition, the proposed variation does not impact or seek to amend the separate
allotment (Allotment 2014) designated for future educational use (school) in the north-western corner of the
Springwood estate.
It is noted that the following development applications have recently been approved for future retail and
commercial development within the village centre:
• Supermarket, six specialty shops, two stand alone shops and associated car parking and signage on
Allotment 2046 (DA490/E006/19);
• Child care centre (pre-school) with associated car park landscaping, fencing and signage on Allotment
2048 (DA490/E009/19)
• Petrol filling station with associated shop, fuel, canopy, car parking, signage, retaining walls, fencing
and landscaping on Allotment 2050 (DA490/E008/19);
• Sales centre, showroom, office and café with associated car park and signage on Allotment 1006 in
approved plan of division DA490/D025/19 (DA490/E005/19)
In addition, a separate development application has also recently been lodged for a proposed car wash, vacuum
bays and signage fronting Calton Road (Allotment 2044).
Whilst the proposed variation to the approved plan of division seeks to remove one allotment for future
commercial purposes (Allotment 2060), the proposed and approved commercial land uses combined with the
balance of commercial land remaining within the Village Centre will ensure the creation of a vibrant and
dynamic mixed use centre.
The proposed amendment to the plan of division also seeks a reduction to the overall number of residential
allotments within the Village Centre (reduction of 4 residential allotments) with a reduction in Terrace and Villa
(10.5m frontage) allotments and a corresponding increase in Traditional, Courtyard and Villa (12.5 frontage)
allotments. Whilst this has reduced the theoretical density of residential development within the Village centre,
as demonstrated in Table 1 above, the overall land division still maintains a mix and range of residential
typologies with a considerable proportion of Terrace (approximately 12%) and Villa (8%) housing allotments
predominantly fronting open space reserves and within walking distance of the Village Centre.
In the context of the overall approved plan of division, the proposed variation to allotment configuration still
generally satisfies PDC 21 of the Residential (Gawler East) Zone in the Gawler Development Plan which seeks the

achievement of higher density residential development within the Mixed Use Centre Policy Area 3 and fronting
areas of active pubic open space (i.e. Future playing fields).
Residential (Gawler East) Zone
PDC 21 Housing with an average site area for dwellings less than 250 square metre should be located
within the Mixed Use Centre Policy Area and Local Centre Policy Area or within walking
distance of public open space, local shops and public facilities.
Accordingly, the proposed variation application remains generally aligned with the most relevant provisions of
the Development Plan and warrants Development Plan Consent and Land Division Consent, subject to
reasonable and relevant conditions.
