To The Finance Centre and any mortgage lender or its agent which lends me/us money pursuant tothis application (‘the Lender’), (which term includes successors and assignees, and those derivingtitle through it).
I/we hereby agree and declare that:
1 The particulars contained in this Mortgage Application whether completed in my/our hand or notand any accompanying or supporting documentation which is now enclosed or may hereafter beprovided by me/us (the Mortgage Application) are and will be true and accurate in all respects and ifa formal loan offer is made by the Lender and a contract is concluded such particulars are to beregarded as forming part of that contract.2 No loans exist which are required to be, but are not, disclosed in this Mortgage Application.3 I/we consent to The Finance Centre and/or the Lender and its introducers (this will be yourmortgage advisor or financial intermediary) to make such enquiries and searches and obtain suchreferences and information as they shall consider necessary of such persons, including but notlimited to tax authorities, employers, landlords, accountants, building societies, bankers and creditreference agencies (who will keep a record of searches made) as they deem necessary to confirmthe truth and accuracy of the particulars contained in this Mortgage Application, whether or not thisMortgage Application proceeds. The Lender and its agents are authorised to seek information fromother insurers to check the answers I/we have provided. The results of these enquiries, searches andreferences and any information given by me/us or any person in applying for the loan may be usedfor credit assessment and for debt recovery, tracing and fraud prevention.4 A valuation report will be obtained solely for the benefit of the Lender to enable it to assess theamount of the mortgage loan, if any, which it is prepared to make on the security referred to in theMortgage Application and such valuation report confers no rights on me/us whether against theLender or any other persons. Whilst the Lender may provide me/us with a copy of the valuation reportthe Lender is not the agent of the surveyor or firm of surveyors providing the valuation report andneither the Lender nor such surveyor or firm of surveyors give any warranty, representation orassurance that the statements, conclusions and opinions expressed or implied in the valuation reportare accurate, valid or complete or that the property is free from defects or worth at least the amountof the loan or that (where relevant) the purchase price is reasonable. I/we must, for my/our ownprotection, obtain independent advice from a surveyor or other professional person as to thecondition and value of the property.5 The only fees payable in respect of this Mortgage Application are those which are due and payableto the Lender and which are specifically referred to in the literature relating to the particular mortgageloan applied for. Any fees in addition to the above paid by me/us to any third party are not as acondition of submitting this Mortgage Application or as a condition of obtaining the Mortgage Offer(the formal offer of mortgage facilities), if made.6 The Lender may from time to time transfer or assign any loan, mortgage loan or policy/ies of lifeassurance and other related security (or any one of them) to any other, company or person withoutnotice to me/us. I/we hereby consent to each such transfer or assignment.7 The information contained in this Mortgage Application and Declaration may be relied upon by theLender and any person or body in whom the benefit of all or any of the loan, mortgage loan and otherrelated security is from time to time vested.8 I/we consent to my/our Solicitor disclosing to The Finance Centre and/or the Lender anyinformation or documentation whatsoever requested by The Finance Centre and/or the Lender eitherin relation to the transaction or the property which is the subject of this Mortgage Application or whichThe Finance Centre and/or the Lender requires or would have required to consider whether or not tomake a mortgage loan to me/us.9 I/we have read and considered the information provided relating to the particular mortgage product.I/we have chosen and/or have been advised to apply for by my/our financial or other adviser. I/weunderstand that the Lender may decline this Mortgage Application without giving any reasonwhatsoever.10 I/we undertake to provide you forthwith with details of any changes in circumstance of whatevernature which have, or are likely to have an effect on the continuing accuracy of the particularscontained in the Mortgage Application and which may affect the Lender’s willingness to provide theloan.11 I/we give the Lender consent to use my data for the processing of this Mortgage Application. TheLender may pass information, documents or data held by it or provided to it in relation to thisMortgage Application, the mortgage loan, any related security (historical, current or confidential), anypossession of the property by the Lender and any insurance to:a. any actual or proposed transferee of the mortgage loan or such related securityb. the provider of funds for the mortgage loanc. any party with whom the Lender is considering entering into a contractual agreement in relation tothe mortgage loan or such related securityd. credit reference agencies and fraud prevention agenciese. any introducer of mortgage business to the Lenderf. the Insurance Companies (the buildings/contents insurer and such other companies as the Lendermay reasonably decide) and/org. any insurance database registerh. any companies/third parties located outside the European Economic Area where thetransfer/processing of information is equivalent to that provided under the Data Protection Act 1998.12 Certain information collected may be classified as sensitive (for example county court judgementsor criminal offences) and The Finance Centre and/or the Lender can only use such data where TheFinance Centre and/or the Lender has my/our explicit consent. I/we consent to The Finance Centreand/or the Lender processing this data. I/we am/are informed that this information is only used forassessing risk, my/our eligibility for a mortgage and for any contract of insurance. I/we consent tothe Lender holding securely any medical health data about me.13 If the Mortgage Application is in respect of joint applicants, all obligations in relation to the loan(if granted) shall be joint and several. This means that in addition to being responsible together, eachcustomer is responsible in full for all obligations as if they were the sole customer.14 I/we consent to any telephone conversations and calls between The Finance Centre and/or theLender and myself/ourselves being monitored for training purposes.
15 I/we understand that it will be my/our responsibility to maintain payments on any mortgagethrough the Lender. If I/we decide not to accept the Lender mortgage payment protection insurance,I/we will arrange/have already arranged suitable cover and/or understand that my/our mortgagepayments will not be protected in the event of accident, sickness or unemployment, if such cover isnot in force.16 I/we confirm that by stating on the Mortgage Application information about another party,including but not limited to a joint applicant, a financial association may be created which may linkour financial records. I/we am/are entitled to:a) Disclose information about a joint applicant and/or anyone else referred to by me/us andb) Authorise the Lender to search, link and/or record information at credit reference agencies aboutme/us and/or anyone else referred to by me/us.17 I/we agree that details relating to this application and my/our account can be provided to the FSAor the applicable regulatory body or supervisor, to assist them in monitoring their compliance and theprogress of this mortgage application.18 Where this application has been introduced by a third party, that party is not an Agent of theLender and does not have any authority to commit the Lender to any binding agreement.19 I/we understand that The Finance Centre is not an Agent of the Lender and does not have anyauthority to commit the Lender to any binding agreement.20 The Lender may use credit scoring/automated decision-making systems when assessing my/ourapplication.21 I/we understand that once my/our loan, mortgage or security for the repayment of any loan ormortgage made in connection with this application has been transferred or assigned, a third partymay obtain information and data from the new lender about my/our loan, mortgage or security for therepayment of any loan or mortgage account to assist in statistical research relating to credit scoringor the investigation and resolution of complaints. I/we understand that this information will beobtained from the new lender and I/we consent to the Lender using my/our data in this way.
PLEASE NOTE – use of your information
The Finance Centre and/or the Lender will check your details with fraud prevention agency/agenciesand if you give the Lender or its introducers false or inaccurate information and the Lender suspectfraud, the Lender will record this.
The Lender and other organisations may use and search these records to:
Help make decisions about credit and credit related services, for you and members of yourhousehold;Help make decisions on motor, household, credit, life and other insurance proposals and insuranceclaims, for you and members of your household;Trace debtors, recover debt, prevent fraud, and to manage your accounts and insurance policies;Check your identity to prevent money laundering, unless you furnish the Lender with othersatisfactory proof of identity.
The Lender and other fraud prevention agency/agencies will also use the records for statisticalanalysis about credit, insurance and fraud. Please telephone the Lender if you want to have detailsof those fraud prevention agencies from whom the Lender obtain information and with whominformation is recorded about you. You have a legal right to these details.
Under the provisions of the Data Protection Act 1998 (‘the Act’) any information provided by you maybe held by The Finance Centre and/or the Lender in its computer and manual records and may beshared within The Finance Centre and/or the Lender organisation and with those third parties,specified in paragraph 11 above, to protect both The Finance Centre and/or the Lender and itscustomers against fraud. Under the Act you are entitled to know what information is held about youon the records of The Finance Centre and/or the Lender and to ask for inaccurate details to beamended. If you have any questions about the Act or your rights under it you may write to the DataProtection Officer at The Finance Centre and/or the Lender.
Information held about you by the Credit Reference Agencies may already be linked to records relatingto another party. For the purposes of this Mortgage Application you may be treated as financially linkedand this Mortgage Application may be assessed with reference to any “associated” records.
Where you borrow or may borrow from the Lender, we may give details of your account and how youmanage it (whether or not in default) to credit reference agencies. If you borrow and do not repay infull and on time, the Lender may tell credit reference agencies and/or the Council of MortgageLenders’ Possessions Register who will record the outstanding debt.
Where you choose a mortgage repayment method of capital repayment or interest only, the Lenderdoes not require the Mortgage Application to be supported by any financial products sold by a thirdparty (for example endowments or ISAs).
