Foreword

This is the 2014 highlights report of the Maastricht European Private Law Institute (M-EPLI). M-EPLI conducts fundamental research in the field of European private law, covering the law of contract, property and tort, but also European procedural law, European legal theory and European legal history. MEPLI was established by the Faculty of Law of Maastricht University in late 2010 to mark the importance the Faculty attaches to the international study of law and its commitment to facilitate both internationally leading academics and young scholars in pursuing high quality academic work.

This fourth annual report highlights the main events that were undertaken in 2014 under the MEPLI-umbrella. It does not contain a complete overview of all meetings, publications and other noteworthy information, but merely provides a taste of what we have been doing. The headings in the report reflect what we find important in doing academic work: people, debate, quality output and academic community.

After four years of activities and cooperation, we are proud to say that M-EPLI has clearly carved out its own place in international legal academia. We are known for our fundamental work and for the community that we built through academic meetings and social media. We published again in all major peer-reviewed journals in our field, lectured extensively and took the initiative for a number of different activities. Our blog (www.mepli.eu) is widely read and our Facebook page has a high number of ‘likes’. In addition, I am proud to say that many of our researchers and activities are externally funded, which we also see as a sign of recognition.

If anything, this report should convey the message how much we enjoy the academic cooperation within M-EPLI. As always, we are open for any comments and questions you may have.

Debate

One of the main aims of M-EPLI is to provide an environment that is conducive to academic discussion. To this end, we have set up two types of events: M-EPLI Round Tables, that focus on discussion around a specific theme and of which we organize two or three each year, and the bi-weekly M-EP LI Talks focused on presenting research by colleagues from Maastricht or elsewhere. In addition to this, a number of other events were organised. A selection of events in 2014 can be found below.

M-EPLI Round Tables & Conferences

22 August 2014: ‘Setting the Contract Aside: Comparative Perspectives’ Workshop (Shanghai)

The aim of this workshop was to take stock of the different ways in which a contract can be set aside. Different legal doctrines exist to help a ‘disappointed’ party. These doctrines range from the age-old mistake and misrepresentation and incapacity to newer techniques such as avoidance for undue influence and withdrawal rights. The topic has regained importance as a result of the recent enactment of the new Chinese Consumer Code (in China) and the consolidation of consumer rights in the new Consumer rights directive (in Europe). On the background is the lingering tension between contractual autonomy and protection of a supposedly weaker party. At this one-day workshop, colleagues from both China and Europe discussed present developments. The workshop was organised by MEPLI in cooperation with East China University of Politics and Law (ECUPL). 10 October 2014: 200 Years Savigny and Thibaut: The Codification Debate Revisited, MEPLI Round Table (Maastricht)

2014 marked the 200th anniversary of the famous debate between Von Savigny and Thibaut about the need for and feasibility of private law codification. This debate has made a lasting contribution to our thinking about the sources of private law and still shapes present-day discussions about European private law. Thibault gave three main reasons in favour of codification: to facilitate the market by way of unification of law, to promote the transparency of the legal material, and to adjust the law to the ‘modern times.’ All three motives seem to have a universal value: they were not only relevant in 19th century Germany, but still shape today’s private law in whichever part of the world – just as Von Savigny’s rebuttal of these arguments seems just as relevant today as it was then. This Round Table revisited the Savigny-Thibaut controversy and links it to current views about how the legal materials are best organised. The main issues that were on the table 200 years ago were discussed by legal historians, experts in modern law and colleagues in related areas. In each of the four sessions, both a historical and a modern perspective was also provided. The Round Table was organised by the Maastricht European Private Law Institute (MEPLI) at Maastricht University in cooperation with the Molengraaff Institute of Private Law at Utrecht University. 17 October 2014: ‘Enforcing Corporate Social Responsibility: Transforming voluntary corporate codes into private law obligations?’ – A MEPLI/HiiL conference (Maastricht) Corporate codes are voluntary policies that companies frequently develop in order to show the public their commitment to respect human rights, to improve workplace standards, and to protect the environment in their global operations. The research conducted by the UM- HiiL-Visiting Chair on the Internationalisation of Law has focussed in one of its research projects on these codes. As one of the core outcomes, the argument has been developed that such voluntary corporate codes, in order to be successful in the long run, would need to be transformed into private law obligations. This result has been reached by engaging in an interdisciplinary socio-legal analysis, which suggests treating the codes as unilateral declarations that reveal a serious effort of companies to regulate public interest matters in the absence of global government. It is this specific character that private law is accordingly called upon to support by enforcing these codes. This workshop aimed to discuss and critically evaluate the outcome of this research in general and this core suggestion in particular.

M-EPLI Talks M-EPLI’s bi-weekly seminars are called ‘M-EPLI Talks’. These one-hour sessions feature invited guests who present papers related but not limited to the institute’s research fields, and also incubate or showcase papers from the institute’s members. As such, they provide an opportunity both for external speakers to introduce work connected to the interests of M-EPLI’s fellows, and for scholars within the institute to exhibit their respective projects to a wider audience. Bram Akkermans and Caroline Cauffman were appointed Associate Professors at Maastricht University. In April, a team of 4 bachelor students coached by Catalina Goanta won third prize in the International Commercial Mediation Competition held in Paris by the International Chamber of Commerce. In September, Daniel On was appointed as PhD researcher. In November, a team of 4 bachelor students coached by Catalina Goanta won the first edition of the International Commercial Mediation Competition held at Houthof Buruma in Amsterdam by the Centrum voor Conflicthantering. PhD Defenses Anna Beckers defended her PhD thesis on ‘Taking Corporate Codes Seriously: Towards Private Law Enforcement of Voluntary Corporate Social Responsibility Codes’ on 16 October. Lotte Meurkens defended her PhD thesis on ‘Punitive Damages: The Civil Remedy in Amerian Law, Lessons and Caveats for Continental Europe’ on 19 December. Teaching This is a selection of lectures by MEPLI fellows given to students at foreign universities or institutions: In January, Jan Smits gave a lecture on ‘Is there a future for legal doctrine?’ at Universität Würzburg. In February, Wenqiang Liao gave a workshop for the European Master in Law and Economics Midterm Meeting, Workshop in Law and Economics, “Efficient Breach and the Common European Sales Law”, Bologna (Italy). In February, Catalina Goanta gave a lecture on Comparative Law at the University of Poitiers, for Master’s students studying law and languages. In March, Jan Smits gave a guest lecture on ‘Nederland recht in vergelijkend perspectief’, University of Leuven (Belgium). In March, Julieta Marotta gave a course on ‘Comparative Regionalism’ for the Master in Public Policy & Human Development, MGSoG, Maastricht University. In May, Jan Smits delivered a lecture on European Contract law at Ghent University (Belgium).

de droit contemporains’ (Master Degree, Year 1 - B. Fauvarque-Cosson, course organizer). Caroline Cauffman and Niels Philipsen taught European competition law at the China-EU School of Law in November 2014. From July to August, Mark Kawakami was the internship coordinator for 5 Masters Students for a paid internship at MVO Nederland. In October, Jan Smits gave two lectures on European private law at Koc University (Istanbul, Turkey).

In November 2014, Jan Smits gave a presentation Innovating private law: on law and technology, lecture Collegio Ghislieri, University of Pavia, 21 November 2014. As of December 2014, Mark Kawakami, William Bull and Catalina Goanta were Project Coordinators for the User Based Law research program on European consumer law, bringing together 11 bachelor students. Between December 2014 and May 2015, Mark Kawakami and Catalina Goanta were Project Mentors for a PremiUM project on International Commercial Mediation. External funding M-EPLI’s research activities are to a large degree financed by third party-funding. Currently, 12 out of the total of 15 resident MEPLI PhD-researchers are funded by funding agencies such as the Netherlands Organisation for Scientific Research (NWO), the Hague Institute for the Internationalisation of Law (HiiL) and the China Scholarship Council. Its conferences in 2014 have also been generously co-funded by the Royal Netherlands Academy of Arts and Sciences (KNAW), the Universiteitsfonds Limburg (SWOL) and the China European School of Law (CESL). Research projects have been funded by the European Parliament, the European Commission and the European Land Registry Association (Cross Border Electronic Conveyancing of Land (CROBECO) project).
