Marshall resides at 5917 Club Oaks Drive, Dallas, Texas,telephone number, 972! 931-0961, and owns a company called,MAROPCO, 7600 W. Tidwell, Suite #800, Houston, Texas, telephonenumber, �13! 690-4321. MAROPCO was previously owned by hisfather, Howard Marshall II Marshall II!, but was placed in afamily trust subsequent to his death on August 4, 1995.
Marshall knew Anna Nicole Smith as Vickie Lynn Smith andas the woman who had married his father, Marshall II, on June 27,1994. Marshall first found out about Smith and his father's
relationship in the latter part of 1992 or early 1993 when hisfather told Marshall that he had been romantically involved with ayoung lady named Vickie Smith.
Marshall had visited his father about twice a week at his
father's Houston home, 11100 Meadowick Drive, Houston, Texas andusually stayed with his father for several days during his visit.Marshall had only seen Smith on two occasions while she had beendating his father. On one occasion, in 1993, Marshall's fatherinvited Marshall to have lunch with him and Smith, and on anotheroccasion, in late 1993 or early 1994, when Smith walked into hisfather's office while Marshall was visiting his father.
Marshall did not find out about his father's marriage toSmith until he was told two weeks later by his father's attorney,Dan Hedges.
Shortly after the wedding, Smith telephoned Marshall andtold him she would like to move into Marshall's old bedroom at his
father's house. Smith told her he would not mind, however, askedher not to discard any of his old books still in the bedroom.Smith was apparently angered by Marshall's comments.

Even after Smith's marriage to Marshall's father Marshall II!, Marshall still visited his father twice a week forseveral days at time. Marshall never saw Smith at Marshall II'shouse. It appeared to Marshall that Smith had moved into his oldroom at Marshall II's home but did not spend too much time at thehouse. Marshall II told Marshall that he rarely saw her at thehouse, and that she spent some of her time in California. MarshallII's caretakers, who live at with Marshall II at his house,verified Marshall II's statement that Smith rarely spent time withhim. Marshall II expressed to Marshall that he was very upset at,his new wife's Smith! constant absence from the home.
Marshall II's|LM Ikept a log of Smith's visits to
arshafl II�s house. According to| |log, Smith hadvisited Marshall II about a thirty days out of the whole time theyhad been married, a little over a year. Marshall said that ifSmith visited his father for two hours,[::;;::;:&would log that asa day she had come to visit. The last mon o arshall II'slife, Smith never came to see him. Smith's last visit to seeMarshall II was on July 4, 1995. Marshall II died in August 1995.
Marshall II complained to Marshall that Smith asked forfifty to sixty thousand dollars two times a week. Marshall IIaccommodate Smith by borrowing money from the Marshall Family Trustof which Marshall was the trustee to give Smith the money shewanted. Marshall II had bought Smith a house in Spring, Texas andlisted under the name of, Houston Land Trust.
After Marshall II's death, a series of law suits took
place between Marshall and Smith. Smith contended that Marshall IIhad made her an oral promise to give her half of his estate whichis being held in a family trust. Marshall disputed her claim whichis the subject of a pending civil suit.
The above civil action received notoriety through themedia. Smith had made several comments about the law suit to the
press, and, according to Marshall, she and her two attorney's, hadlaunched a negative media attack against Marshall. Marshall suedSmith and her two attorneys. One of Smith's attorneys settled thecivil suit out of court while the other attorney lost severalmillion dollars as a result of a jury judgment. Smith's suit isstill pending and has been consolidated with the law suitconcerning the Marshall Family Trust.

Marshall is the trustee of his family's trust.Marshall's deceased father, E. Howard Marshall, about 89 years old,had married Anna Nicole Smith, aka, Vickie Lynn Marshall, about 32years old, in 1995. Marshall died the following year, and Smithalleges that Howard Marshall had made her a verbal promise to giveher half of his estate. Howard Marshall's estate is protected in afamily trust which has an estimated worth of about twenty�fivemillion dollars. Smith and her attorney, Howard Stern, contendthat the estate is worth over a billion dollars. Marshall and
Smith have been engaged in several law suits in California andTexas since Howard Marshall's death. Smith and Marshall's next
court appearance is a trial scheduled for September 2000.

| ' I Smith showed agents two carbon copieL ofchecks, one made in the amount of twenty�eight-hundred dollars, andthe other in the amount of five-thousand dollars. Both checks
reflected the name,[::::;::;::g:] in the memo portion of the check.The check for twenty�e1g t� un red dollars was written on an BankOf America check, #1524, and dated "7/7/00 probably meant to be6/7/00!." The check for five�thousand dollars was written on aBank Of America check, 1472 and dated, "4/11/2000." The check
also indicated, "Loan [f::::::::::]After Smith finished describing her relationship with
[;;:::;;]agents told her that they were investigating allegationst at s e had planned to kill Pierce Marshall. Smith began cryingand denied ever making such plans and blaming[::::::] for making upthe story. Sm� n asked if[::::::] had made those allegationsabout her. SA1;::iEfresponded that they could not divulge theirsource of the a egations, and that they were conducting aninvestigation to verify the allegations.
Smith said she was a party in a civil suit in Texasinvolving Pierce Marshall and his family's trust. Marshall livesin Texas and is the trustee of the trust. Smith explained that shewas married to Marshall's father, Howard Marshall, in 1995. Howard
Marshall died about a year later, and she was suing Marshall for

money owed to her by the trust. Smith never thought about killingMarshall, and explained that it would not be logical for her towant Marshall killed as the law suit would soon be finished bySeptember 2000. Smith said killing Marshall would not make sensesince the trust would still exist. Smith adamantly denied evercontemplating such a crime and believed ade up the storybecause he was angry with her for severing their relationship.
