AGREEMENT

1. Expressly subject to the terms and conditions contained in the Agreement, Ownerhereby grants User the right to rent from Owner and use the Union Hall on theday (or days) and for the sole purpose as. indicated on page 1.

2. User shall pay to Owner the deposit to secure his/her desired date. The rentalamount is due in full 30 days prior to the event. If the rental is cancelled within 2weeks of the scheduled event the User will receive a full refund. If the Usercancels less than two weeks of the scheduled event, they will forfeit all of theirdeposit.

3. User hereby certifies that he or she is a Member in good standing of the DallasArea Local in accordance with the National & Local Constitution of said Union.

4. User agrees that he/she shall be the person responsible for ensuring that the Hallwill be used strictly for the purpose indicated in this Agreement. By User'sexecution of this Agreement, User certifies to Owner and hereby agrees to obtainany and all permits or licenses that are required by any federal, state or localgovernmental body for the use of the Union Hall for the purpose stated or anyother use for which the Union Hall is actually used during User's period of use.Further, User agrees that the Union Hall shall not be used for any illicit, immoralor illegal purpose, determined by Owner in Owner's sole discretion. Owner shallhave the right to terminate User's use of the Union Hall at any time that Userviolates any provision of this Agreement concerning the use of the Union Hall.User shall not publish or distribute to the general public any advertisementpublicizing any event to be held at the Union Hall

5. No other person (other than User) shall be in control of nor shall rent the UnionHall from User under a sublease or other agreement during the time that theUnion Hall is in use pertaining to this Agreement.

6. User shall not charge any admission fee for access to the Union Hall during theperiod of use nor shall User charge a fee for any activity conducted at the Hall.

7. User understands and agrees that User shall have the use of the Union Hall andthe kitchen area, but not any of the administrative offices or any other areaslocated at the building. SMOKING IS PROfflBITED IN ALL AREAS OFTHE BUILDING.

g. No audio visual equipment located at the Union Hall shall be used during theperiod of use. User may, however, bring Ms or her own audio visual equipmentinto the Union Hall for User's use. User agrees to operate the audio visualequipment in accordance with standards of good taste and within compliance withall City codes, including the City's noise ordinance.

9. User may use the kitchen area located in the Union Hall. User agrees to leavekitchen in a clean and sanitary condition which includes the removal of all trash,the cleaning of any and all spills on the tables, counters, microwave andrefrigerator. User further agrees to unplug and remove all electrical equipmentthat user brought for use during his or her period of use and farther agrees to useonly electrical equipment at the Union Hall which is compatible with theelectrical system available at the Union Hall (110 volt electrical Ike). User willalso remove any and all personal items used.

10. No alcohol will be sold or given away by User at the Union Hall during the periodof use. User agrees to ensure that no alcohol shall be served to any person who isunder the legal age and that no alcohol be saved to anyone who sis or appears tobe inebriated. User shall ensure that no controlled substances or any handguns orfirearms of any kind shall be brought onto the Union Hall premises, including, butnot limited to, the Union Hall parking lot.

11. NO ACTIVITY AT IKE UNION HALL SHALL BE CONDUCTED ORCARRIED ON BY USER AFTER 2:00 AM IN IfflE MORNING.

12. User acknowledges that the Union Hall*s capacity is 300. User agrees that theUnion Hall's capacity shall not exceed 300 at any time during the period of use.User hereby certifies to Owner that User's estimate of the expected attendance atthe event held by User pursuant to this Agreement is User's good J^th estimate ofthe expected attendees at the event. User agrees to be solely responsible forcrowd control at the event.

13. USER AGREES THAT USER HAS INSPECTED THE UNION HALL ANDHAS DETERMINED TEEE UNION HALL IS SUITABLE FOR THEPURPOSE INTENDED BY USER. USER VERIFIES NUMBER OFTABIJES TO BE __^^USER AXX3E3PTS THE U^^FAULTS" AND AGREES TO RETURN THE BALL TO IT'S ORIGINALSETUP. USER FURTHER AGREES TO DEFEND, INDEMNIFY ANDHOLD OWNER HARMLESS INCLUDING ANY LIABILITY ARISINGOUT OF ANY ACT OF COMMISSION OR OMISSION OF OWNER OROTHER THIRD PPERSONS USING THE UNION HALL DURING

USER'S PERIOD OF USE. THE TERM "OWNER" FOR PURPOSE OFTfflB PARAGRAPH INCLUDES OWNER'S OFFICERS, TRUSTEES,DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES ORSERVANTS.

14. User agrees that user shall hire and utilize at least one security person certified asa peace officer in the State of Texas for each 100 persons expected to occupy theUnion Hall during the period of use. User agrees that the requirement imposedherein shall not subject Owner to any liability of any nature for either anyinadequacy of security or any duty to provide security for the event held at theUnion Hall during User9 s period of use.

15. If liabiltiy insurance is available from an insurance carrier that can be procured byOwner to cover User's intended use of the Union Hall, user agrees that User willpay to the Owner a reasonable insurance surcharge in order to help cover suchinsurance costs, if such insurance is so procured by Owner. User shall provide acopy of User9 s liability insurance policy to Owner upon Owner's request.

16. User agrees that Owner shall not be liable for any theft or damage to User'sequipment or motor vehicles while on the Union Hall premises.

17. User will not tape, nail or staple any item to the wails or ceilings. Thumbtacksmay be used to- secure decorations but must be removed upon the conclusion ofthe event held. Any damage to wails, ceilings or floor could result in the loss ofthe deposit. Any altering of the Hall &/or the contents could result in the loss ofthe deposit

18. User agrees that User shall leave the Union Hall premises clean and in goodcondition upon conclusion of the event for which User has rented the Union Hall.User shall be liable for any damage to the Hall occurring during User's period ofuse, including but not limited to any damage to the walls, or floor. User agreesthat the Use's secutiry deposit shall be used to repair any damage to the unionHall or any other liability to Owner created by User as a result of User's use ofthe Union Hall AGAIN, SMOKING IS PROfflBITED IN ALL AREAS OFTEE BUILDING INCLUDING THE RESTRGOMS. EVIDENCE OFSMOKING IN THE BUILDING COULD RESULT IN THE FOREEIT OFTHE ISEOJIOTY DEPOSIT.

19. User must return key on the first day of business following his/her event. A laterdate can be agreed upon between the User and the Secretary/Treasurer of theLocal. Upon return of the key, the User and the Secretary/Treasurer or theirAgents will inspect the Union Hall for any damages or any issues outlined in thisagreement. If all items are adhered to, the full amount of the deposit will bereturned at that time.

20. User is responsible for securing the Union Hall upon conclusion of their event.Securing the building includes the locking of all doors and security bars in thelocked position on all doors with the exception of the door used by the User toenter the Union Hall Both locks must be locked on this door when exiting thebuilding and the alarm set. If the building is not properly secured and the Ownersuffers a loss of property or damage to property due to negligence of User toproperly secure the building the Owner reserves the right to seek damages fromthe User.

Your name and signature on this page acknowledges you are receiving a fullcopy of the contract to rent the hall located at 2010 Postal Way, Dallas, TX75212. It is your responsibility to read and adhere to all requirements andexceptions as stated in the contract. You acknowledge you must leave theproperty as found, unless otherwise agreed to by the representative of theAmerican Postal Workers Union. The cleaning fee does not waive norexcuse your responsibility to leave the property as outlined by the contract.

Hourly Rental Requirement Agreement regarding deposit return.

For the hours of to , acknowledge the following guidelines have beenmet:

Any liquid spills have been removed using the bucket, sponge and towel provided (left inkitchen area), using water only, (no cleaning agents), and wet area dried using towel

Floors have been swept with broom provided..

All trash has been removed and taken to dumpster.

Microwaves have been cleaned, and any spills in the refrigerator &/or freezer have beencleaned up.

All tables and bar have been wiped down.

No food or debris has been left on or in the sink.

All toilets are in good working order (please flush all before leaving to verify noblockage).

All personal items have been removed from the hall.

All tables and chairs are returned to their original state (unless instructed differently).

If using cooler, personal contents have been removed and cooler left in original state.

I have verified with that all requirements have been met,(agent of APWU, please print & sign name)

and I am vacating the premises (2010 Postal Way) on or before the agreed upon time.Any time exceeding the end time will result in a $50.00 deduction from thedeposit, and any non-compliance of the afore mentioned requirements will also affect thedeposit made.
