by MAURA KELLER [email protected] With as much as 80 percent of municipal solid waste categorized as food and organic waste, municipalities are searching for ways to reduce tipping fees charged by landfills by diverting this waste away from landfills and towards composting facilities. From uti- lizing separate compost and organic bins to offering yard waste drop off events throughout communities, munici- palities are working with waste and recycling companies to handle the growing amount of organic waste as efficiently as possible. According to Ryan Battles, digital strategist at WasteBits, one of the largest digital waste profiling software companies, most communities with a curbside service program provide an additional yard waste pickup day, but food waste continues to mingle with the general household waste. “A growing number of cities across the U.S. are implementing dedicated curbside food waste collection pro- grams, but continued adoption is chal- lenging due to a number of factors that must be considered before a community can adopt a food waste program,” Battles said. First of all, as Battles explained, a community must be able to develop an infrastructure of haulers, either by lever- aging existing haulers or contracting with new ones. In addition, a suitable location to collect and process organic waste should be within a reasonable distance. “If none is available, the cost to develop such a facility must be consid- ered,” Battles said. “All of these factors are then compared to the regional cost for waste at the local landfills. The higher the cost of disposing of waste at the local landfill, the easier it is to jus- tify the cost of a community food waste composting program.” One of the biggest challenges to organic waste recycling is contamina- tion by non-organic material. “When the sorting process is left to the consumer, general waste and recyclables can be intermingled with the organic waste, leading to a mixture of waste that can neither be recycled nor composted,” Battles said. Ryan Cooper, waste diversion man- ager and organics recycling lead at Rubicon, said different municipalities handle their food and yard waste in dif- ferent ways because of a number of fac- tors: landfill diversion goals, cost, infrastructure and knowledge being four key considerations. “Jurisdictions have differing goals, access to capital, existing private and/or public infrastructure, and skills to create organics recycling solutions,” Cooper said. “Food waste collection for animal feed and other uses was common in some areas in the past, but has not been seen in most communities for genera- tions. Many municipalities handle yard waste by composting and/or mulching the material because the level of permit- ting is relatively low and the material is easier to handle than food scraps or biosolids. Composting food waste and biosolids requires more permitting and tighter management. Mulch yards run the risk of fires, but composting facili- ties draw criticism because of odor if they are not managed correctly.” As Cooper explained, more and more jurisdictions are moving away from landfilling or incinerating valuable resources such as yard waste, food waste and biosolids because of waste diversion goals. In fact, many munici- palities are adding food waste and fats, oils and greases (FOG) to existing anaerobic digesters at their wastewater treatment plants (WWTPs – now called water resource recovery facilities – WRRFs). “Municipalities are adding digester capacity and depackaging capability as well,” Cooper said. “Private firms are also steadily increasing the number of composting and anaerobic digestion facilities in conjunction with depackag- ing infrastructure that can separate organics from packaging like plastic or metal.” Innovations Aplenty Industry players such as municipal- ities, haulers, designers, builders and operators also have varied levels of interest in organics recycling. As Cooper explained, many industry folks and venture capitalists are excited about the opportunity and others are more reluctant. Many are specialized organics recycling companies, but larger haulers and cities are getting in the game as well. “Separation of materials into MSW, SSR and organics is becoming the norm in more progressive areas, while there are still many parts of the country with little to no infrastructure or recycling culture to drive these programs,” Cooper said. developed and tested in order to reducecosts and improve turnaround time. AsBattles explained, some of the key bio-logical innovations that help handleorganic waste include:

•Anaerobic Digestion Systems –closed systems that process waste in anoxygen-depleted environment

•Thermal Hydrolysis – high-pres-sure boiling of waste followed by rapiddecompression

•Food Waste to Water – nutrient-neutral water is created by aerobic bac-teria and released safely into the sewer

Non-biological innovationsinclude:

•Food Waste Pulpers and Shred-ders – waste is shredded, then waterextracted to provide compost feedstock

•Food Waste Dehydration – heatand agitation evaporate moisture out,remaining pulp used as compost feed-stock or potentially as animal feed orfertilizer

•Pyrolysis – thermo-chemicaldecomposition at high temperatureswithout oxygen

“The challenge of building infra-structure is creating a bottleneck thatrestricts the implementation of pro-grams and hauling,” Cooper said. Con-tamination, because of lack of trainingand education, is also a huge challenge.

Many organizations are resortingto machines that can remove contami-nants on the front end of the processingfacility. “Pricing to the consumer andmunicipality is always an issue becauseof both the cost to build and operateorganics recycling facilities as well asnew trucks, drivers, and other equip-ment,” Cooper said.

Costs aside, Cooper pointed tomany new technologies that are becom-ing more important as time goes on.For example, inside kitchens and cafe-terias, technology is being developed tohelp businesses determine how muchfood waste they are generating in thefirst place, which can help them makebetter ordering decisions or ensure thatitems are used in other dishes instead ofbeing discarded.

“Food packaging is constantlychanging – because of pushback on cer-tified compostable foodservice ware,foodservice operators are looking atsolutions like reusables,” Cooper said.

“Dehydration, aerobic digestion, shred-ding and other on-site preprocessingtechnologies have the potential tochange the industry. Depackaging tech-nology is changing the way that facili-ties deal with contamination and alsothe mix of materials that ultimatelywind up as animal feed, compost, orbiogas. Other technologies are creatingnew products that can be convertedfrom wasted food and other organics.”

C&D Organic WasteRecyclable waste from construc-

tion and demolition (C&D) activityvaries widely, but one thing’s for sure:there is a tremendous amount oforganic waste, specifically wood wastethat can be recycled and put to use in avariety of ways.

Chris Batterson, account manager,construction & demolition recyclingdivision at Rubicon, said that tradition-ally, the organic waste coming from aC&D project would be wood – whetheras dimensional lumber or pallets.

As Batterson explained, dimen-sional lumber, which is uncoated buthas odd lengths and sizes in scrap form,makes it difficult for any reuse orrepurpose needs. It is instead recycledfor wood chips, mulch, particleboard,and chipboard being the most frequentapplications.

“It can also be used for biomassfuel, but currently that is a hot topicamong the sustainability communityand certification providers as towhether or not that is truly diversion,”Batterson says. At Rubicon, they focuson two other materials on every projectthat fall under the organics category.Gypsum, which today mainly ends upin the landfill is one focus for Rubicon.Utilizing the company’s organics net-work they are able to get this materialto composters and farmers to utilize intheir soil at a lower cost than landfill oreven in some cases, to sell it as a com-modity to that network.

“We still work on closed loop solu-tions for gypsum where possible, butthe infrastructure just does not existtoday nationwide, and the costs forfreight along with the GHG emissionsassociated with that long distancetrucking make it hard to justify as abenefit,” Batterson said.

Down the RoadThere is a history of banning yard

waste from the landfill, and alreadymultiple U.S. cities and states havepassed regulations that encourage or

require diversion of food scraps fromthe landfill. So what does this mean forthe future of organic waste?

“As the industry is becoming moreaware of the issues surrounding organicwaste recycling, there has been aninflux of legislation and regulation,”said Matthew Hollis, co-founder/presi-dent of Elytus, a waste managementcompany that uses technology to helpclients receive better waste removalservices and become more sustainablein the process. “Part of the challenge isthat these laws mandate organic wasterecycling, yet do not facilitate the infra-structure to do it. This disjunctionbetween policy and pragmatism has leftthe industry in a scurry to build out theinfrastructure to comply.”

Whenever there’s an inefficientprocess, there exists a large opportunityfor innovation. Hollis and his team atElytus is seeing advancements in dehy-drators, digestors, and grinding pro-grams that transform the organic wasteinto a slurry.

“The extent to which these tech-nologies can take off may depend onhow much impact they have on the bot-tom line,” Hollis said.

As beneficial use of organics likefood waste and biosolids increases,more and more infrastructure will becreated. However, as Cooper pointedout, it is very much a case of thechicken and the egg.

“Jurisdictions pass regulations thatencourage organics recycling and thenthe industry and affected generatorsscramble to keep up. As soon as theydo, new phases of regulations start theprocess all over again. Places that con-sider these types of initiatives impor-tant will continue passing more andmore progressive rules, while areas thatdo not consider this a priority will not,”Cooper said. “This creates an unevenplaying field for generators, haulers,and processors alike. Business and con-sumers that travel from place to placewill continue to be bewildered byorganics recycling programs that varybased on location. As more municipali-ties and private companies pass organicwaste regulations, develop infrastruc-ture, and educate the citizenry aboutorganics recycling, residents and busi-nesses will continue to adopt the prac-tice of separating these materials tocreate valuable products such as fertil-izer, energy and fuel.”

A total of $450,000 is available forclean diesel and alternative fuel engineand equipment replacement projects undera competitive grant request for proposal(RFP) announced by the MichiganDepartment of Environment, Great Lakes,and Energy (EGLE).

The 2020-21 Michigan Clean DieselProgram RFP targets efforts to replace olddiesel equipment, vehicles, and engineswith new diesel, alternative fuel, electricor hybrid versions. Applicants can becities, townships and villages; county gov-ernment agencies; public school districts;

private schools; public transit agencies;port authorities; metropolitan planningorganizations; nonprofit organizations; orprivate businesses.

Applications will be accepted until 5p.m. January 30, 2020, and projects mustbe completed by August 2021 in one oftwo categories:

•Vehicle Replacement: Funding maycover up to 25 percent of the cost of eligi-ble diesel vehicle replacements, up to 35percent of the cost of eligible vehicles thatmeet the California Air Resource Board’soptional low oxides of nitrogen standards,

and up to 45 percent of the cost of an all-electric vehicle replacement. Eligibledrayage vehicle replacement may befunded up to 50 percent.

•Engine Replacement: Fundingincludes replacing diesel engines with anengine certified for use with diesel or analternative fuel or a zero tailpipe emis-sions power source. Funding for enginereplacement may cover up to 40 percentfor diesel or alternative fuel engines; 50percent for low-nitrogen oxide and up to60 percent for replacement with zeroemission engines.

The NYC Department of Sanitation(DSNY), Van Alen Institute, the Indus-trial Designers Society of America andthe American Institute of ArchitectsNew York announced that GroupProject is the winner of the BetterBinCompetition.

The BetterBin Competition offereddesigners an opportunity to reimagineNew York City’s iconic green, wiremesh litter basket. Two finalist teamseach produced 12 full size prototypebaskets that were tested in three NewYork City neighborhoods over a 90 dayperiod. The judging panel selected thewinner based on prototype performance,public response, and feedback from theDepartment’s Sanitation Workers.

Produced by the interdisciplinaryNew York City-based team Group Proj-ect, the winning design consists of alight-weight and recyclable liner nestedwithin a durable stand designed to blendin across all New York City neighbor-hoods. The design received positivefeedback from both Sanitation Workersand the public for its sleek esthetic, boldrecycling messaging, and significantergonomic improvements. The interiorliner is nearly 50 percent lighter than thecurrent wire mesh basket, making it eas-ier for Sanitation Workers to service.The liner also features eight comfortablegrips for proper lifting compared to onlytwo on the current basket.

The winning design prototypeswere placed into service starting inDecember 2019 along 5th Avenuebetween 88th and 92nd streets in Man-hattan. The prototypes will replace the

green wire mesh baskets currently inthose locations. The Group Project teamwill continue to work with DSNY forfurther design development to be able tomass-produce the basket and makeadjustments based on the learnings fromthe prototype testing period.

New York City is home to over23,000 litter baskets. The most wide-spread design — the green, wire meshbasket — dates back to the 1930s. TheBetterBin Competition offered designersa chance to envision a new litter basketwith a sustainable, environmentally con-scious, and ergonomic design that couldimprove the quality of life for NewYorkers and the service experience forSanitation Workers.

In December 2018, two finalistswere selected by a panel of nine jurymembers, including industrial designspecialists and the president of Team-sters Local 831, the union that repre-sents Sanitation Workers. The finalistsworked closely with BetterBin Competi-tion organizers to refine their designsand produce 12 full size prototypes thatwere tested in 3 New York City neigh-borhoods in summer 2019. The judgingpanel selected the first-place winnerbased on prototype performance, publicresponse, and feedback from the Depart-ment’s Sanitation Workers.

The Mattress Recycling Council(MRC) is seeking innovative proposalsto make recycling more efficient andcreate new or better uses for hard-to-recycle mattress components. The ini-tiative is part of MRC’s $1 millionannual research fund to improve howdiscarded mattresses and box springsare recycled and identify new marketsfor reclaimed mattress materials.

“The number of used mattressesdismantled by MRC recyclers and theamount of steel, foam and other materi-als reclaimed is steadily growing eachyear. To sustain future growth, it is vitalthat we help identify new economicallyviable uses for those materials,”explained Ryan Trainer, president ofMRC. “To help solve this challenge,MRC welcomes ideas and proposalsfrom potential innovators, includingmanufacturers of the original compo-nents, who may hold the key to identify-ing new and better uses for reclaimedmaterials.”

MRC is funding a series of innova-tive research projects to kickstart newmarkets for the following materials:polyurethane foam, memory foam, latexfoam, quilt panels (the top layer of amattress), shoddy pads (mixed fiberinsulating felt layer), various types offiber batting and pocketed springs.

“MRC anticipates entering intomultiple research projects over the nextseveral years that support our recyclingobjectives. Up to $100,000 per projectis available, but MRC will considerincreasing that contribution for innova-tions that show special potential,according to Mike Gallagher, MRC’sresearch consultant leading the process.“MRC is most interested in ideas thatshow technical merit and feasibility,along with the best potential for com-mercial use in achieving the targeteduse of the recycled material.”

The Pennsylvania Departments ofEnvironmental Protection (DEP) andTransportation (PennDOT), in partner-ship with Keep Pennsylvania Beautiful,announced an initiative to reduce litter-ing and presented results of the firststatewide litter study in over 20 yearsat a meeting attended by more than 125local government, legislative, business,and community organization partners.

“Pennsylvania has a littering prob-lem. Trash lines many of our roads andneighborhood streets. Hillsides andstreambanks are strewn with tires andother garbage illegally dumped,” saidDEP secretary Patrick McDonnell.“This presents health hazards, it con-taminates the soil and water, and clean-ing it up is costly to the commonwealthand taxpayers.

“DEP has funded annual commu-nity and illegal dump site clean-upsaround the state for over two decades.Thanks to these volunteer events, mil-lions of pounds of litter have beenremoved from our land and water, buttrash is accumulating faster than any-one can keep up with,” said McDon-nell. “DEP is committed to achievingan even greater impact, working withPennDOT, Keep Pennsylvania Beauti-ful, and other partners to develop andimplement a framework of litter reduc-tion measures that, for the first time,will be guided by state-specific litterdata and a nationally recognized modelof behavior change.”

The Pennsylvania Litter ResearchStudy was conducted in 2018-2019with funding from DEP, PennDOT,Keep America Beautiful and KeepPennsylvania Beautiful. A phone sur-

vey collected 500 residents’ views onlitter and littering. Field teams per-formed on-the-ground litter counts in180 locations statewide, including stateand local roads and urban and ruralareas.

Over 96 percent of survey respon-dents said littering is a problem inPennsylvania. Field results indicate anestimated 500 million pieces of litteron Pennsylvania roads. The most com-mon items are cigarette butts and plas-tics, such as plastic food packaging,bottles and bags. Motorists and pedes-trians are leading litterers, followed byimproperly secured truck loads.

“PennDOT spends upwards of$13.9 million yearly to pick up trashalong state-owned roadways,” saidPennDOT secretary Leslie S. Richards.“This enormous amount of resourcesspent on clean-up means there’s lessfunding available for improving ourroads and bridges. Clean-up is not asustainable strategy. PennDOT isproud to join forces with DEP, DCNR,and Keep Pennsylvania Beautiful totake action to shift the focus to chang-ing behavior to prevent littering.”

“Thankfully, environmental edu-cation programs and organized clean-ups help curtail littering at our 121state parks, but illegal dumpingremains a chronic problem in somestate forests throughout the state,” saidDCNR deputy secretary MichaelWalsh. “Managers of Michaux StateForest, in the south central section ofthe state, are actively deploying sur-veillance cameras in an attempt to deterroadside dumping, which often leavesthe district facing high disposal costs.”

Pennsylvania launches litterreduction initiative

The California Department ofResources Recycling and Recovery(CalRecycle) announced a $3.6 millionenforcement action against CVS HealthCorp. for failing to meet its obligationto redeem Californians’ deposits onrecycled bottles and cans at storesthroughout the state.

This enforcement action is part ofCalifornia’s broader effort to supportand expand recycling while ensuringconsumers have access to convenientrecycling options as the recyclingindustry contends with changing globalmarket conditions. State subsidies torecyclers have increased each of the lastfour years to cover the declining pricesfor scrap recyclables, resulting in $176million in payments to recyclers in2018.

Under California’s beverage con-tainer recycling law, retailers located inconvenience zones that are not servedby a recycling center must redeem California Redemption Value (CRV)

beverage containers in store or pay a$100 per day fee.

An investigation by CalRecyclefound that 81 of CVS Pharmacy’s 848retail stores in California refused toredeem CRV beverage containers instore, failed to pay the required $100 aday fee for not redeeming or failed tosubmit an affidavit to CalRecycle stat-ing how they would comply with in-store redemption standards.

“Today’s action sends a messagethat we will hold retailers accountablefor refunding consumers their nickeland dime recycling deposits,” saidJared Blumenfeld, California Secretaryfor Environmental Protection. “Every-one must do their part as we work toprotect our environment and ensurethat all Californians have convenientaccess to recycling.”

The enforcement action seeks torecover $1.8 million in $100 a day feesthat the 81 stores had failed to pay as ofOctober 31 and an additional $1.8 mil-

lion in $100 a day civil penalties. Theaction also seeks to recover CalRecy-cle’s administrative costs of investigat-ing and pursuing the action.

CalRecycle filed the enforcementaction against the retail chain onDecember 5, 2019. As part of theadministrative law process, CVS isentitled to an evidentiary hearingpresided over by a hearing officer oradministrative law judge.

“California has one of the highestrecycling rates in the nation because ofour shared commitment to the environ-ment,” said CalRecycle director ScottSmithline. “Retailers face financialconsequences if they do not fulfill theirlegal takeback requirements. This $3.6million action is part of our ongoingenforcement of the bottles and cansprogram that includes intensifiedinspection efforts and ongoing recy-cling fraud crackdowns.”

CalRecycle has increased enforce-ment against retailers that are obligated

to redeem the recycling deposit (CRV)for beverage containers in store, result-ing in an additional 2,180 inspectionsand prioritized enforcement on retailerswith the largest number of violationsand penalties owed.

Through the budget and legislativeprocesses, the state has also allocatedan additional $15 million in the past sixmonths to support recycling centersand innovative redemption projectssuch as mobile redemption in areaswith high rents and community resist-ance to recycling centers.

Since the state’s Bottle Bill wasenacted in 1986, Californians haverecycled nearly 400 billion beveragecontainers. Last year Californians recy-cled 18 billion beverage containers, thesecond highest ever, accounting for 76percent of the 24 billion CRV bever-ages sold in California. The state is ontrack to recycle 18 billion bottles andcans in 2019.

Salvaging Millions

It’s easy to say, but harder toexecute. Twenty years have passedsince I wrote my first consulting arti-cle, but I see it over and over – folksare trying to get rich fast. If you areyoung and are reading this article, youreally do have a lot of time, but youneed to stay focused. Find somethingyou love to do, and then focus on it.Don’t become distracted or bored.Just keep shooting the gun.

The other important part of get-ting rich slowly is to live within yourmeans and be thinking about how toinvest so that you can achieve yourfinancial goals. People often ask me,“What are the biggest hurdles to suc-cess I’ve seen in the automotiveindustry?”

Two come to mind. The first hur-dle is failure to invest in somethingother than your business. Invest just alittle here and there, and in a decade,you won’t believe what you will have.People call me and ask what theyshould do with the $25,000 they justgot unexpectedly. They usually put itin the stock market, which I guess issafe, but you’re never going to makeover five percent or so a year over along period. Instead, I advise them tobuy a rental house. Do you know thatif you were to buy two rental houses ayear for 20 years, in 30 years you

would be worth about $10 milliondollars? That’s a nice retirement plan!

The second hurdle is being dis-tracted. The biggest distraction I seein the automotive world is racing. Ifyou love racing and want to have anexpensive hobby that will drain youfor your entire life, racing is it. Iwon’t judge you for choosing racingas a hobby, unless you gripe about nothaving enough money. For many peo-ple in the automotive industry, racingis enticing enough that it will keepyou distracted from executing onnumber one above or from doing mostanything else that you could haveused the time, energy and money on.

Start thinking about getting richslowly by reading my book, Gettingto Yes with Your Banker, becauseyou will need credit. You can’t getreally rich without leverage. Youcan’t do it while trying to be debt free.You need other people’s money help-ing you! I am working on what willlikely be my last book. Homeless to$100 million. During its eighth Scrap Tire Recy-cling Conference, the U.S. Tire Manu-facturers Association (USTMA) issueda nationwide call to action to grow anddevelop new sustainable, circular end-use markets for scrap tires. Conferenceco-sponsors USTMA, Michelin NorthAmerica, the South Carolina Depart-ment of Commerce and the Scrap TireResearch and Education Foundation(STREF) joined more than 200 confer-ence attendees to identify and promotesolutions for economically viable andenvironmentally sound uses for scraptires.

Approximately 250 million scraptires are discarded in the U.S. eachyear. Of these, roughly 81 percent arereused or recycled into other uses likerubber-modified asphalt, tire-derivedfuel, molded and extruded automotiveproducts, micronized rubber powderand reclaimed carbon black, creatingbeneficial end-use markets.

“If South Carolina can be anational leader in tire production andexports, it also can be a national leaderin the sustainable management of scraptires,” said Rick Toomey, director ofthe South Carolina Department ofHealth and Environmental Control.“DHEC remains committed to workingwith stakeholders at all levels, includ-ing the U.S. Tire Manufacturers Asso-ciation, to become that leader.”

Tire manufacturers, auto manufac-turers, recyclers, retailers and environ-mental regulators from across thecountry explored emerging trends inthe circular economy including chal-lenges and opportunities for new andexisting markets for scrap tires. Stake-holders also discussed the importance

of robust state scrap tire programs andthe enforcement of scrap tire regula-tions, and the outlook for emergingmarkets such as pyrolysis and devul-canization. Innovative markets likepyrolysis and devulcanization help toadvance the circular economy by con-verting scrap tires into raw materialswhich can then be used to manufacturenew tires and rubber and plastic prod-ucts.

“We have come a long way, butwe have more work to do,” said AnneForristall Luke, president and chiefexecutive officer of USTMA. “Build-ing effective partnerships, talkingabout important issues, and drivingeffective solutions is our charge. In lessthan 30 years, we’ve grown the portionof scrap tires entering end-use marketsfrom 11 percent to 81 percent. To reachour goal of 100 percent scrap tiresentering sustainable end-use markets,we need to continue to work with ourstate, industry and academic partners togrow existing markets and developnew ones.”

“Sustainability is at the heart ofMichelin’s global business ambition togive people everywhere a better wayforward,” said Joanie Martin, chiefadministrative officer at MichelinNorth America, based in Greenville.“Michelin’s sustainable developmentplan was launched more than 18 yearsago. Michelin has defined an ambitioustarget: By 2048, Michelin tires will beproduced with 80 percent sustainablematerials and 100 percent of Michelintires will be recycled. We can onlyachieve the goal with an open andgood-faith exchange with stakeholdersacross the mobility value chain.”

The Wolf Administration awardedmore than $700,000 in grants for threeclean energy vehicle projects in northwestPennsylvania that will help improve airquality and public health in the region.

“Replacing gasoline- or diesel-pow-ered vehicles with lower-emissions alter-native fuel vehicles makes a world ofsense,” said Department of EnvironmentalProtection (DEP) Secretary PatrickMcDonnell. “It makes Pennsylvania’scommunities and environment healthier;helps to slow the increasingly urgentimpacts of climate change we’re seeing;and saves owners money on fuel costs.”

Funded through DEP’s AlternativeFuels Incentive Grants (AFIG) program,the projects in northwest Pennsylvania areexpected to reduce annual greenhouse gasemissions by more than 928 metric tons.

The AFIG program supports replace-ment of older shuttles, school buses,waste-hauling trucks, and other vehicles

with cleaner natural gas and electric vehi-cles, as well as installation of fueling sta-tions for such vehicles.

Grants were awarded to:

•Snyder Brothers, Inc.: $463,064 toupgrade and expand capacity to meetincreasing demand at two fast-fill com-pressed natural gas fueling stations inArmstrong County that serve their fleetand are also available to the public.

•TC Recycling: $240,000 for six newCNG trash collection trucks at their Marssite in Butler County.

•Progas Inc.: $5,800 to replace agasoline vehicle with a propane-fueledvehicle to increase their propane fleet andtrain six technicians to do propane vehicleconversions and repairs at their site inButler County.

School districts, municipalities, non-profit organizations and businesses are eli-gible to apply for AFIG grants. The nextgrant availability is in the spring.

Based on preliminary CensusBureau data, the American Iron andSteel Institute (AISI) reported that theU.S. imported a total of 2,177,000 nettons (NT) of steel in October 2019,including 1,479,000 net tons (NT) offinished steel (up 14.5 percent anddown3.5 percent, respectively, vs. Sep-tember final data).

Through the first 10 months of2019,total and finished steel importsare 24,770,000 and 18,343,000 net tons(NT), down 15.9 percent and 17.0 per-cent, respectively, vs. the same periodin 2018.

Key finished steel products with asignificant import increase in Octobercompared to September were wire rods(up 24 percent), plates in coils (up 13percent), sheets and strip hot dipped

galvanized (up 13 percent), mechanicaltubing (up 13 percent) and heavy struc-tural shapes (up 12 percent).

In October the largest volumes offinished steel imports from offshorewere from South Korea (170,000 NT,up 8 percent from September final),Germany (79,000 NT, up 22 percent),Japan (74,000 NT, up 4 percent), Brazil(59,000 NT, up 54 percent) and Taiwan(39,000 NT, down 37 percent). For thefirst ten months of 2019, the largestoffshore suppliers were South Korea(2,219,000 NT, down 11 percent vs.the same period in 2018), Japan(1,090,000 NT, down 7 percent), Ger-many (910,000 NT, down 17 percent),Taiwan (768,000 NT, down 16 per-cent) and Vietnam (622,000 NT, down30 percent).

After years of attempting to workwith the Department of Toxic SubstancesControl (DTSC), the California MetalRecyclers Coalition has filed a complaintagainst DTSC to prevent the unlawfulimposition of “hazardous waste” facilitypermitting requirements on metal shred-ding and recycling facilities.

Scrap metal has never been classi-fied as a “hazardous waste” under eitherfederal or California law – and thereforemetal recycling facilities have neverbeen considered “hazardous waste” treat-ment facilities under either federal orstate law.

The metal recycling industry isalready extensively regulated by a widearray of federal, state, regional and localauthorities, including federal and stateair and water quality laws, regional waterquality control boards, regional air qual-ity districts, and local fire departments aswell as other government entities thataddress local land use and permitting.

DTSC’s action is unlawful andthreatens to undermine the scrap metalrecycling industry in California. Califor-nians have enthusiastically embracedrecycling because they know that recy-cling helps reduce pollution, reduces theneed for raw materials, preserves naturalresources and reduces the energy used tomine and process native ores. California,which has always been a national leader

in recycling, is already facing a crisis, ashundreds of recycling operations haveclosed down.

Now it seems state government,through DTSC, is about to worsen therecycling crisis by threatening to put thelargest, most successful, and most viableremaining recycling operation out ofbusiness by making it infeasible to recy-cle scrap metals like junk cars, usedrefrigerators, and many other thousandsof end of life metal products.

Instead of being recycled into newproducts and reducing waste, this haz-ardous waste designation by DTSC willresult in such materials accumulating inhuge quantities, increasing urban blightand creating eyesores, and causingpotential threats to health and safety bybeing abandoned in back alleys, yards,neighborhood streets, vacant lots – andthrough a geometric increase in “mid-night dumping” along roadsides or inempty fields.

The California Metal RecyclersCoalition seeks a determination from theCourt that the Hazardous Waste ControlLaw does not authorize DTSC to requirehazardous waste treatment facility per-mits for metal processing and recyclingoperations conducted at California metalshredding facilities. The complaint alsoseeks injunctive relief.

California metal recyclersfile suit for relief fromharmful regulation

Based on the Commerce Depart-ment’s most recent Steel Import Moni-toring and Analysis (SIMA) data, theAmerican Iron and Steel Institute(AISI) reported that steel import permitapplications for the month of Novem-ber totaled 1,864,000 net tons (NT).

This was a 28.1 percent decreasefrom the 2,594,000 permit tonsrecorded in October and a 14.4 percentdecrease from the October preliminaryimports total of 2,177,000. Import per-mit tonnage for finished steel inNovember was 1,201,000, down 18.8percent from the preliminary importstotal of 1,479,000 in October. For thefirst 11 months of 2019 (includingNovember SIMA permits and Octoberpreliminary imports), total and finishedsteel imports were 26,634,000 NT and19,545,000 NT, down 16.3 percent and18.6 percent, respectively, from thesame period in 2018. The estimatedfinished steel import market share inNovember was 14 percent and is 19percent year-to-date (YTD).

increases in November permits vs.October preliminary imports includedblack plate (up 353 percent), cutlengths plates (up 39 percent), line pipe(up 28 percent), reinforcing bars (up 18percent) and hot rolled bars (up 16 per-cent). Products with significant year-todate (YTD) increases vs. the sameperiod in 2018 include black plate (up90 percent), steel piling (up 34 percent)and tin free steel (up 20 percent).

In November, the largest finishedsteel import permit applications foroffshore countries were for SouthKorea (175,000 NT, up 3 percent fromOctober preliminary), Japan (75,000NT, up 1 percent), The Netherlands(71,000 NT, up 133 percent), Germany(56,000 NT, down 29 percent) and Tai-wan (35,000 NT, down 9 percent).

Through the first 11 months of2019, the largest offshore supplierswere South Korea (2,394,000 NT,down 10 percent from the same periodlast year), Japan (1,165,000 NT, down9 percent) and Germany (966,000 NT,down 21 percent).

Cleveland-Cliffs Inc. and AK SteelHolding Corporation have entered into adefinitive merger agreement in whichCliffs will acquire all of the issued andoutstanding shares of AK Steel commonstock. Lourenco Goncalves, chairman ofthe board, president and chief executiveofficer of Cliffs, will lead the expandedorganization.

Under the terms of the mergeragreement, AK Steel shareholders willreceive 0.40 shares of Cliffs commonstock for each outstanding share of AKSteel common stock they own. Uponcompletion of the transaction, Cliffsshareholders will own approximately68 percent and AK Steel shareholderswill own approximately 32 percent ofthe combined company, respectively,on a fully diluted basis.

The fixed exchange ratio implies aconsideration of $3.36 per share of AKSteel common stock and represents apremium of 16 percent based on theclosing share prices of Cliffs and AKSteel common shares, respectively, as ofDecember 2, 2019, and a premium of 27percent based on the 30 day volumeweighted average price of AK Steelcommon shares. The transaction impliesan aggregate consideration to AK Steelshareholders of approximately $1.1 bil-lion on a fully diluted basis, a totalenterprise value of approximately $3.0billion for AK Steel and an acquisitionmultiple of 5.6x LTM AdjustedEBITDA.

The transaction will combineCliffs, North America’s largest pro-ducer of iron ore pellets, with AKSteel, a leading producer of innovativeflat-rolled carbon, stainless and electri-cal steel products, to create a verticallyintegrated producer of value-added ironore and steel products. The combinedcompany will be ideally positioned toprovide high-value iron ore and steelsolutions to customers primarily acrossNorth America.

Further,the potential startup of pig iron manu-facturing at AK Steel’s facility in Ash-land, Kentucky would create futureopportunities for pellet demand andmore metallics products without signif-icant additional capital expenditures.

•Accretion through significantannual synergies: The transactionoffers significant potential for opera-tional synergies, which will contributeto long-term value creation forinvestors. The combination is expectedto generate approximately $120 millionof annual cost synergies to be fullyrealized within the first 12 months afterclosing, primarily from consolidatingcorporate functions, reducing duplica-tive overhead costs, and procurementand energy cost savings, as well asoperational and supply chain efficien-cies.

•Stronger company with com-pelling pro forma financial metrics:The combined company is expected tobenefit from a larger and more diversi-fied base of customers, with less over-all emphasis on commodity-linkedcontracts. For the last 12 months, thepro forma combined company has gen-erated net revenue of $8.2 billion,Adjusted EBITDA of $1.3 billion andunlevered free cash flow of $923 mil-

lion. The transaction will also be lever-age-neutral with pro forma Total Debtto Adjusted EBITDA of 3.5x.

Additional transaction details andgovernance

Following completion of the trans-action, with Goncalves leading theexpanded organization, Newport willretire as chief executive officer and adirector of AK Steel. Three existingmembers of AK Steel’s board of direc-tors will join the Cliffs board, and twoexisting Cliffs board members will stepdown, bringing the Cliffs board to 12members in total. AK Steel willbecome a direct, wholly-owned sub-sidiary of Cliffs and will retain itsbranding and corporate identity. Cliffswill continue to be listed on the NYSEwith its headquarters in Cleveland,while maintaining a significant pres-ence at AK Steel’s current offices inWest Chester, Ohio along with itsResearch and Innovation Center inMiddletown, Ohio.

The transaction is expected toclose in the first half of 2020, subject toapproval by the shareholders of bothcompanies, receipt of regulatoryapprovals and satisfaction of other cus-tomary closing conditions.

Cliffs has obtained an approxi-mately $2 billion financing commit-ment from Credit Suisse in connectionwith a new Asset Backed Loan and therefinancing of AK Steel’s 2023 seniorsecured notes.

An Orange County based elec-tronic waste handler owes up to$154,836 in restitution to the CaliforniaDepartment of Resources Recyclingand Recovery (CalRecycle) following amulti-year recycling fraud investiga-tion.

“The E-Waste Recycling Programis meant to ensure that hazardous mate-rial is handled properly and does notharm our environment,” CalRecycledirector Scott Smithline said. “Compa-nies who try to take advantage of theprogram will find out that there are realconsequences for their actions.”

In 2014, CalRecycle’s E-WasteRecycling Program staff found thatRecycle Your City, a now defunctcompany based in Costa Mesa, had dis-crepancies in collection logs, includinginflated counts of materials and falsi-fied names and addresses of individu-als who supposedly discarded theelectronic waste, as well a lack ofsource information. After this discov-ery, the department disallowed theapproved recycler’s e-waste recyclingpayment claims for material fromRecycle Your City. The E-Waste Recy-cling Program staff alerted the Califor-

nia Department of Justice, whichlaunched an investigation and prose-cuted the case.

On October 27, 2017, Glen Davis,owner of Recycle Your City, pledguilty of attempt to file false/forgedinstrument and grand theft. On January29, 2019, he was sentenced to proba-tion community service, and restitu-tion. On May 14, 2019, Orange CountyProbation Department approved a max-imum restitution amount of $154,836.

Davis was a handler, someone whocollects and transfers electronic wasteto a collector approved by the E-WasteRecycling Program. The approved col-lectors must provide compliant collec-tion logs to CalRecycle for materials tobe eligible for payment.

The Electronic Waste RecyclingAct of 2003 and associated regulationsestablished a funding system for thecollection and recycling of certain elec-tronic waste. The E-Waste RecyclingProgram is intended to provide all Cal-ifornians convenient ways to recyclecertain electronic waste to keep haz-ardous materials from ending up inlandfills.

New York State Department of Envi-ronmental Conservation (DEC) commis-sioner Basil Seggos announced thatsuccessful CleanSweepNY events wereheld in Riverhead and Melville. Clean-SweepNY helps promote a healthy andsustainable New York by providingopportunities for proper disposal ofunwanted and/or obsolete pesticides andother chemicals.

The fall CleanSweepNY events col-lected a total of 77,458 pounds of chemi-cal wastes from 103 participants in Nassauand Suffolk counties. The event collected:70,227 pounds of pesticides; 3,005 poundsof school chemicals; 2,948 pounds ofpaint; 4,943 aerosol containers of disinfec-tant spray, insect repellent sprays, and oldspray paint; 515 pounds of old motor oil;and 763 pounds of various non-hazardousliquid wastes such as used engine coolant.

DEC staff visited three sites for thecollection of waste chemicals to ensurepesticide containers in poor condition andwaste chemicals were transported safely.In addition, the Agricultural ContainerRecycling Council, currently managed bythe Long Island Cauliflower Association,provided for the collection and transportof recyclable plastic from CleanSweepNYcollection sites.

DEC schedules and organizes Clean-SweepNY events in collaboration with the

New York State Department of Trans-portation (DOT). Collection events wereheld at DOT facilities.

This was the 28th collection eventorganized and administered by the DEC’sBureau of Pesticides Management. Sincethe CleanSweepNY program’s inceptionin 2002, more than two million pounds ofchemical wastes have been collectedacross New York State, as well as morethan 910 pounds of liquid elemental mer-cury.

Approximately 6,100 plastic pesti-cide containers, including many 55- and30 gallon triple-rinsed pesticide drums,which would otherwise have been dis-posed of in landfills, have been collectedand properly recycled. The program isendorsed by Cornell Cooperative Exten-sion, the Agricultural Container RecyclingCouncil, Soil and Water ConservationDistricts, the New York Farm Bureau, andrelated agricultural associations.

CleanSweepNY services are avail-able to agricultural and non-agriculturalprofessional pesticide applicators, schools,and certain businesses which use pesti-cides such as golf courses, cemeteries andmarinas. Homeowners cannot participate,but information about reducing householdhazardous waste is available on DEC’swebsite.
