EXECUTIVE SUMMARY

HOW EXPANSIVE IS ALEC’S REACH IN JEFFERSON CITY AND TOPEKA?

Through the American Legislative Exchange Council (ALEC), corporations hand Missouri legislators wish

lists in the form of "model" legislation that often directly benefit their bottom line at the expense ofMissouri families. Behind closed doors, ALEC legislators vote as equals with corporate lobbyists to adopt

ALEC model bills crafted by corporations, for corporations. The same corporations that benefit from

ALEC model legislation funnel thousands of dollars of gifts and campaign contributions to ALEC

legislators, which pushes the envelope on ethics and lobbying law. Elected officials who are members of

ALEC then bring their model legislation back to Missouri, where they pass-off the bills as their own ideas

and important public policy innovations without disclosing that corporations crafted and pre-voted on

the bills at closed-door meetings with legislators who are part of ALEC.

The influence of ALEC is strong in Topeka, Jefferson City and state capitols around the country. Our

research shows:

  120 current and former Kansas and Missouri legislators with known ALEC ties

  47 current MO legislators with known ALEC ties, although ALEC claimed in leaked documents

last year that 57 are members (leaving at least 10 unknown)

  48 known KS legislators with ALEC ties, while ALEC claims 69 are members (leaving at least 21

unknown)

  At least 24 ALEC model and ALEC-inspired bill filed in the Kansas legislature in recent years

  At least 58 ALEC model and ALEC-inspired bills filed in the Missouri legislature in recent years

Identifying a complete list of Kansas and Missouri legislators who are part of ALEC is a difficult task,

because ALEC operates largely in secret, and refuses to make their full list of members public.

WHY IS ALEC’S INFLUENCE IN JEFFERSON CITY AND TOPEKA IMPORTANT?

ALEC gives state legislators a way to appear highly active in the legislative process by secretly

outsourcing their role in drafting legislation to the corporate special interests that curry influence with

lawmakers behind closed doors at ALEC meetings. The Kansas City Star  writes that ALEC “is funded and

dominated by free-market and corporate interests who work with like-minded legislators to push

various agendas.” What are these “various agendas”? Here is a taste: 

  Taking away workers’ rights while shielding corporations from accountability. ALEC works

fervently to promote laws that limit the rights of workers, and at the same time pushes bills that

help shield corporations from legal accountability for injuring or killing Kansas and Missouri

citizens. ALEC model legislation rolls-back or blocks efforts to guarantee workers are paid a fair

wage. Its bills undermine organized labor by stripping public employees’ collective bargaining

rights and weaken private-sector workers’ voices through so-called ‘right to work’ laws. ALEC

also promotes so-called “tort-reform” bills that shield corporations from liability for harming

state residents, for example, by making it harder for injured Missourians to access the courts

and capping damages that corporations might owe.

  Taking away voters’ fundamental freedoms. ALEC is directly tied to the trend among state

legislatures to limit the ability of American citizens to vote by passing restrictive ‘voter ID’ laws.Citing demonstrably false allegations of ‘voter fraud,’ right-wing politicians, many of whom are

ALEC members, are pursuing policies that threaten to disenfranchise people of color, students,

and other voters - including the elderly and the poor - who are statistically less likely to have the

forms of identification required under the laws and who previously could vote by showing proof

of residence and other identification. By suppressing the vote of such groups of likely

Democratic voters, ALEC’s model ‘Voter ID Act’ grants an electoral advantage to Republicans

while undermining Americans’ fundamental right to vote.

  Privatizing public schools. Despite constitutional problems, negative impacts on public schools,

bias against disadvantaged students, and comprehensive studies demonstrating that private-school voucher programs fail to make any substantial improvements in education, ALEC pushes

vouchers as a way to privatize public education and put dollars from Missouri and Kansas

taxpayers into the pockets of for-profit and private school operators. Under the guise of ‘school

choice,’ ALEC pushes bills with titles like the ‘Parental Choice Scholarship Act’ and the ‘Great

Schools Tax Credit Program Act,’ that establish or expand private -school voucher programs.

  Protecting polluters. At the behest of its major donors like Peabody Energy, Exxon Mobil and

Koch Industries, ALEC puts its muscle behind state-level legislation that hinders citizens’ ability

to curb polluters through environmental regulation. ALEC has previously said that carbon

dioxide “is beneficial to plant and human life alike,” and promotes climate change denialism, 

even in schools. ALEC’s model legislation assails EPA emissions guidelines and greenhouse gas

regulations, undermines regional climate initiatives, and pushes for extreme deregulation, giving

free rein to some of the biggest polluters on the planet.

  Undermining public systems and structures. As states face challenging budget deficits, ALEC

seeks to make it harder to generate revenue in order to close budget shortfalls. Such bills

include the “Super-Majority Act,” which would allow a tiny minority of lawmakers to block a

majority vote to raise taxes (and created such a financial disaster in California that voters

overturned a similar law); the so-called “Taxpayer Bill of Rights,” which drastically restricts

government revenue and helped forced Colorado to slash vital public programs; and measures

to eliminate capital gains taxes and progressive income taxes. The main beneficiaries of ALEC’s

reckless fiscal policies are big corporations (like those that back ALEC) and their executives – the

big losers are the rest of us.

ALEC’S CAMPAIGN FLOWS THROUGH TOPEKA AND JEFFERSON CITY

Why would a legislator be interested in advancing cookie-cutter bills that are giveaways for

multinational corporations located outside of Missouri and Kansas? ALEC’s appeal rests largely on the

fact that these legislators receive trips, food and lodging that provide many part-time legislators and

their families with vacations, along with the opportunity to rub shoulders with prospective donors totheir political campaigns. The ritzy trips are paid for by “scholarships” funded by corporations and

“awarded” to legislators, not on the basis of any scholarly work, but on a legislator’s willingness to push

the ALEC agenda. For a few hours of work on a task force and sitting through a couple of workshops by

ALEC experts, part-time Kansas and Missouri legislators can bring the whole family to ALEC’s annual

convention, vote in private meetings with corporate lobbyists, and stay in swank hotels and attend

parties, all heavily subsidized by the same corporations that benefit from the introduction and passage

of ALEC model legislation. As the St. Louis Post-Dispatch reported after the 2011 ALEC conference in

New Orleans, “corporate benefactors made sure Missouri lawmakers attending the conference were

well fed and hydrated;” AT&T, for example, picked up the entire $1,400 dinner tab for Missouri

lawmakers in one meal at a high-end French Quarter restaurant. The arrangement goes something likethis:

1.  Missouri and Kansas legislators go to an ALEC conference that resembles a vacation, with

expenses paid by corporations via ALEC’s so-called “scholarships.” 

2.  Legislators vote, together with these same corporations, to adopt model legislation written to

boost corporate profits.

3.  While on vacation at the ALEC conference, legislators mingle with lobbyists and potential donors

to their political campaigns.

4.  Legislators take the model bills back to their capitols and push them as their own.5.  Corporations and lobbyists make donations to favored legislators’ political campaigns. 

This happens among legislators in both Missouri and Kansas with alarming frequency. Between 2006

and 2008, Kansas legislators were awarded more than $38,000 worth of “scholarships” to ALEC junkets,

and have enjoyed at least $24,000 in 'scholarship' junkets since 2008 -- for a total of at least $62,302 in

corporate-funded gifts since 2006. Even though Kansas has strict donations on lobbyist gifts, these lavish

trips are disguised as “educational expenses.” Since 2006, ALEC has spent more than $70,000 on trips

for Missouri state lawmakers, whisking them away to junkets in places like San Diego, Los Angeles, New

Orleans and Washington, D.C. The worst offender in Missouri is House Speaker Tim Jones, who has

received nearly $12,000 worth of trips funded by ALEC corporations.

MISSOURI AND KANSAS ELECTED OFFICIALS WITH ALEC TIES

ALEC operates largely in secret, so it is challenging to identify all legislators with ties to the organization.

Despite claiming to be a legislative membership organization, there is no full list of member legislators

anywhere on ALEC’s website, and the organization has refused to make public a list of its members.

Through extensive research, including the Missouri Ethics Commission and Sunshine Law requests of

legislators’ offices, Progress Missouri and the Center for Media and Democracy have uncovered more

than 120 Missouri and Kansas legislators and politicians who are ALEC members and supporters. Of

these, 47 Missouri elected officials and 48 Kansas elected officials with ALEC ties currently hold public

office. The Speaker of the Kansas House, Rep. Ray Merrick, is an ALEC Board Member.

BEYOND COPYCAT BILLS: ALEC-INSPIRED ATTACKS

In addition to introducing ALEC model legislation directly as bills, ALEC-affiliated legislators have also

pushed “ALEC-inspired” bills in our statehouses. While these bills are not verbatim copies, they closely

resemble ALEC model legislation and further the aims of ALEC corporations.

Missouri House Bill 1617 is the latest in a years-long effort to pass “paycheck deception,” an anti-worker

policy designed to make it harder for workers and their unions to engage in the political process. . ALEC’s

model “Public Employee Paycheck Protection Act” pushes the same policy, prohibiting public employees

from voluntarily contributing to union political activity via payroll deductions. Though HB 1617 was not

drafted in precisely the same format as the ALEC model, they both seek the same harmful ends through

the same burdensome means.

There are similar instances in Kansas. House Bill 2458 seeks to end “net metering” policies that 

incentivize consumers to use clean, alternative energy like solar by crediting consumers who feed

energy back into the grid. ALEC has an “Updating Net Metering Policies Resolution” that urges states toreplace their net metering policies with “fixed rate” policies. While Kansas HB 2458 is not an exact

replica of the ALEC resolution, they are strikingly similar and both impose new fees on the use of solar

energy, benefitting large power companies. This is not surprising, given that corporate special interests

and the David Koch-backed Americans for Prosperity pushed the bill in the state.

longtime ALEC member and sponsor. Koch Industries has been a state corporate co-chair in Kansas and

its Director of Public and Government Affairs, Mike Morgan, sits on ALEC’s corporate board, the so-

called “Private Enterprise Advisory Council.” Koch Industries is a member of ALEC’s Energy, Environment

and Agriculture Task Force, Civil Justice Task Force, Public Safety and Elections Task Force, and Tax and

Fiscal Policy Task Force.

HEIN LAW FIRM, CHARTERED

The Hein Law Firm, Chartered, is a lobbying and government affairs firm based in Topeka, Kansas.

The Rex Sinquefield-funded Pelopidas LLC -- which has described itself as an “influence management

firm” and a “top tier lobbying force” -- paid six figures in 2013 to sponsor ALEC’s Annual Meeting in

Chicago.

SHOOK, HARDY & BACON LLP

As of April 2014, Victor Schwartz of Shook, Hardy & Bacon is listed as the Private Chair of the Civil Justice

Task Force. Schwartz is also general counsel for the American Tort Reform Association. Shook Hardy &

Bacon lawyer Mark Behrens is an “advisor” to the task force. For years, Schwartz and other members of

the firm have attended ALEC meetings, testified for bills on behalf of ALEC, and even registered to lobby

in North Dakota, despite the fact that ALEC maintains it does not lobby. Shook, Hardy & Bacon has

spearheaded ALEC’s tort-reform efforts for years, often pushing bills that seem to benefit the firm’s

GENERAL MOTORS CORPORATION

General Motors is a multinational automobile manufacturer with a plant employing hundreds of

workers in Wentzville, Missouri. GM was a member of ALEC’s Commerce, Insurance and Economic

Development Task Force as well as the Energy, Environment and Agriculture Task Force. GM cut ties

with ALEC in July of 2012.

MONSANTO

Monsanto is a “multinational chemical and agricultural biotechnology corporation” based in Creve

Coeur, Missouri. Monsanto was a corporate member and supporter of ALEC in 1992 but no longer has

ties to the organization.

AMEREN

Ameren is Missouri’s largest electric utility and the second largest in Illinois. It has supported ALEC in the

past, and  sponsored “Missouri Night” at Antoine’s Restaurant in New Orleans during the 2011 ALEC

Annual Meeting. The St. Louis Post-Dispatch reported in 2014 that Ameren “is not a member of ALEC

and that it would disclose any political contributions to that group.”

ALEC JUNKETS AND “SCHOLARSHIPS” 

Why would a legislator be interested in advancing cookie-cutter bills that are giveaways for

multinational corporations located outside of Missouri and Kansas? ALEC’s appeal rests largely on the

fact that these legislators receive trips, food and lodging that provide many part-time legislators and

their families with vacations, along with the opportunity to rub shoulders with prospective donors to

their political campaigns. The ritzy trips are paid for by “scholarships” funded by corporations and

awarded to legislators. For a few hours of work on a task force and sitting through a couple of

workshops by ALEC experts, part-time Kansas and Missouri legislators can bring the whole family to

ALEC’s annual convention, vote in private meetings with corporate lobbyists, and stay in swank hotels

and attend parties, all heavily subsidized by the corporate till. As the St. Louis Post-Dispatch reported 

after the 2011 ALEC conference in New Orleans, “corporate benefactors made sure Missouri lawmakers

attending the conference were well fed and hydrated.”

Tens of thousands of dollars in “scholarships” and gifts do not tell the whole story. ALEC-affiliated

legislators in Kansas and Missouri alike have received significant campaign contributions from ALEC’s

corporate members. ALEC member corporations have made nearly half a million dollars’ worth of

campaign contributions to Kansas legislative leaders with ALEC ties and their affiliated committees. In

Missouri, where there are no contribution limits whatsoever, the total is more than twice that of Kansas.
