Kashmir is pleased to make the following rules to determinethe
terms and conditions of the employees to be recruited inthe AJK
Technical Education and Vocational TrainingAuthority and to
carryout the purposes of establishment ofAJK Technical Education
and Vocational TrainingAuthority namely:-
Chapter-IPRELIMINARY
1.01. Short title, Application and Commencement: (1)These rules
may be called the Azad Jammu & KashmirTechnical Education and
Vocational Training Authority (Terms andConditions of Service)
Rules, 2009.(2) It shall apply to all persons employed in
theservice of Azad Jammu & Kashmir TechnicalEducation and
Vocational Training Authority.(3) They shall come into force at
once. Allappointments made before coming into force ofthese rules
shall be deemed to have been made underthese rules.
1.02. Definitions: (1) In these rules, unless there isanything
repugnant in the subject or context,following expressions shall
have the meanings ashereby respectively assigned to them:-
a) Act means the Azad Jammu & KashmirTechnical Education and
Vocational TrainingAuthority, Act, 2007;
b) Appointing Authority means a person orauthority designated as
such or authorized tomake appointment to any post in the
Authority;
c) Basic pay scale means pay scale of a post asprescribed;
d) Confirmation means regular appointment orinduction as
substantive appointment to apermanent post;
e) Central Selection Board means SelectionBoard constituted for
the purpose of making

selection for appointment by initial recruitmentand appointment
by promotion or transfer to theposts in BPS-16 to 19 employees of
the Centraloffice of the Authority;
f) Central Selection Committee No. 1 meansSelection Committee
constituted for thepurpose of making selection for appointment
byinitial recruitment and appointment bypromotion or transfer to
the posts in BPS-11 to15 employees of the Central Office of
theAuthority;
g) Central Selection Committee No. 2 meansSelection Committee
constituted for thepurpose of making selection for appointment
byinitial recruitment and appointment bypromotion or transfer to
the posts in BPS-01 to10 employees of the Central Office of
theAuthority;
h) Field Selection Board means Selection
Board constituted for the purpose of makingselection for
appointment by initial recruitmentand appointment by promotion or
transfer to theposts in BPS-16 to 19 employees of the FieldTraining
Institutions of the Authority;
i) Field Selection Committee No. 1 meansSelection Committee
constituted for thepurpose of making selection for appointment
byinitial recruitment and appointment bypromotion or transfer to
the posts in BPS-11 to15 employees of the Field Training
Institutionsof the Authority;
j) Field Selection Committee No. 2 meansSelection Committee
constituted for thepurpose of making selection for appointment
by

initial recruitment and appointment bypromotion or transfer to
the posts in BPS-01 to10 employees of the Poly
TechniqueInstitutions of the Authority;
k) Field Selection Committee No. 3 meansSelection Committee
constituted for thepurpose of making selection for appointment
byinitial recruitment and appointment bypromotion or transfer to
the posts in BPS-05 to10 employees of the Vocational
TrainingInstitutions of the Authority;
l) Field Selection Committee No. 4 meansSelection Committee
constituted for thepurpose of making selection for appointment
byinitial recruitment and appointment bypromotion or transfer to
the posts in BPS-01 to04 employees of the Vocational
TrainingInstitutions of the Authority;
m) Duty includes the performance of normalwork and include,-
(i) period spent on training or courses,conferences and meetings
etc, in oroutside Azad Kashmir with theapproval of competent
authority ofthe Authority.
(ii) Compulsory waiting for posting,attending obligatory
examination;
(iii) Service as probationer;(iv) Joining time, journey from and
to the
place of posting;(v) Travel period spent away from
normal place of work on officialassignment.
n) TEVTA means the Azad Jammu andKashmir Technical Education and
VocationalTraining Authority;

o) Employee means an officer or member ofstaff appointed, posted
or deputed in theTEVTA under the Act and the rules madethereunder,
and includes its other employeeswho may, for the time being,
serving in anyother organization but does not include
thosebelonging to other organizations but serving inthe TEVTA;
p) Family means employees spouse, childrenand stepchildren,
residing with or whollydependent upon him except where
otherwisespecified, it includes his parents, sisters andminor
brothers, if residing with any whollydependent upon him;
q) Honorarium means remuneration grantedto an employee on
accomplishment of specialwork of an occasional nature which
performedin ordous hours and beyond normal officehours;
r) Initial recruitment means appointmentmade on the
recommendations of AuthoritySelection Board or Committee otherwise
thanby promotion or by transfer;
s) Joining time means the time permissible toan employee to join
a new post or spent ontravel from or to a station to which he is
posted;
t) Lien means title of an employee to holdsubstantively a
permanent post to which he hasbeen appointed and confirmed;
u) Methods of Appointment and Qualification(MAQ) means requisite
qualification,experience and other terms & conditions formaking
appointment through initial recruitment

or by transfer or promotion to various posts asprescribed in the
Schedule A;
v) Pay includes the amount drawn monthly byan employee as
salary, special pay, technicalpay and qualification pay duly
admissible bycompetent authority;
w) Permanent Post means a post carrying adefinite remuneration
or pay sanctionedwithout limit of time;
x) Personal Pay means additional pay grantedto an employee:
i. to save him from loss of substantivepay in respect of a
permanent post dueto revision of pay or any reduction ofsuch
substantive pay otherwise than adisciplinary measure; and
ii. in exceptional circumstanceson other
personalconsiderations.
y) Prescribed means prescribed by theserules;
z) Probation means the period for whichan employee is placed on
probation againsta vacancy on initial recruitment orotherwise;
aa) Prime Minster means the PrimeMinister of the Azad Government
of theState of Jammu and Kashmir;
bb) Service means employment to be calledas Service of the
TEVTA;
2) The terms and expression used hereinafter andnot defined
shall have the same meaning asgiven to them in the Act.

1.03. Appointment on Regular BasisThe appointment made in the
manner prescribedunder these rules through initial recruitment or
bypromotion or by transfer or by induction shall bedeemed to have
been made on regular basis.
1.04. Employees of the Authority(1). The employees transferred
to AJKTEVTA
under section 12(2) of the Act andNotification dated 25-01-2007
are consideredon deputation will be governed by allrelevant rules
of the Azad Jammu & KashmirGovernment e.g. E&D Rules,
Conduct Rules,Pension Rules, Leave Rules and G.P. FundRules etc.
All such employees will beentitled for all those facilities which
they areenjoying in their parent department beforethey transferred
to TEVTA like pensioncontribution, house building advance,medical
facilities, car advance etc. They willnot be entitled to any
deputation allowance/pay.
(2). Rule 10 (1) enforced through NotificationNo.
S-IND/2671-91/2008 dated 15-04-2008shall be deemed to have been
deleted.
CHAPTER-2Appointment
Part-1General Provisions
2.01. Composition of ServiceThere shall be a separate service to
be called theService of TEVTA consisting of the following:-
(i) Regular Service.(ii) Contract Service.(iii) Temporary
Service.

The authority competent to make appointmentsubject to selection
by the Selection Boards orCommittees concerned against various
posts inthe Central Office of the Authority shall be asfollows:

PART-IIInitial Recruitment
2.05. Method of Appointment and Qualifications(MAQ) etc.The
appointment by initial recruitment, promotionand transfer against
the posts of regular service shallbe made strictly in accordance
with method andcriterion expressly prescribed in the Schedule A
ofthese rules, however subject to the selection/recommendations
made by the relevant SelectionBoard or Committees, as the case may
be.
2.06. Recommendations of relevant Selection Board/Committee.
a) Appointments to posts in basic pay scale 16and above shall be
made on therecommendations of concerned SelectionBoard in the
prescribed manner.
b) Appointments to posts in basic pay scales 15and below shall
be made on therecommendations of concerned SelectionCommittees.
2.07. Advertisement of Vacancy
All vacancies belonging to regular service shall befilled in by
initial recruitment which shall be widelyadvertised in the national
and regional newspapersand also through modern means of
communication.
Provided that a suitable method will beadopted to invite
applications from eligible personsin case of appointment is made by
transfer ordeputation from government departments.
2.08. Fulfillment of Prescribed Conditions:
A candidate for initial appointment must possessprescribed
conditions including educational

qualification, experience and age limit and alsofulfill other
conditions which are prescribed in therules and or made applicable
by the competentauthority from time to time.
2.09. Nationality and Citizenship Only the State Subjects of the
State of Azad Jammu
and Kashmir shall be eligible for appointment in theservice of
TEVTA:
Provided that the condition may be sparinglyrelaxed by the
Government in the exceptionalcircumstances of non-availability of a
person ofrequisite expertise and experience on case to
casebasis.
2.10. Relaxation in Maximum Age LimitMaximum age limit as
prescribed for a post may berelaxed by the Government in case the
nature of thejob required significant expertise or
peculiarexperience of a person not available with prescribedage
limit but in the exceptional circumstances forwhich reasons will be
recorded in writing.Provided no relaxation in minimum age
prescribedunder the rules shall be given.
2.11. Subject to section 12(1) of the Act, the Chairmanmay in
cases of urgency, appoint such officers,servants, experts or
consultants on such term andcondition as he may deem fit.Provided,
that every such appointment made underthis Rule shall be reported
to the Authority withoutunreasonable delay
2.12. Certificate of Medical Fitnessa) A candidate for initial
appointment must be
in good mental and bodily health and freefrom any physical
defect likely to hinder himin discharge of his duties.

b) No person shall be initially appointed unlessdeclared fit in
all respects and produce acertificate to that effect from medical
boardor medical officer specified by theappointing authority and in
the prescribedform.
2.13. Good Moral Character:(1) No person who is not already in
service ofTEVTA or any body set up or managed by theGovernment
shall be appointed BPS-06 and aboveunless he produces a certificate
of good moralcharacter from educational institution last attendedby
him.(2) No person who is not already in service ofTEVTA or any body
set up or managed by theGovernment shall be appointed BPS-01 to
BPS-05unless he produces a certificate of good moralcharacter from
an officer of basic pay scale 17 andabove in the service of
Government or any officer ofbasic pay scale 17 and above or
equivalent in theservice of any corporation or organization set up
ormanaged by the Government.
PART IIIAppointment by Promotion
2.14. Classification of the Posts:-The posts in the cadres are
classified as under:-
(1) The posts in basic scale 16 and above areSelection posts to
which promotion shall bemade by selection on merit.
(2) The posts in basic scale 15 and below arenon-selection posts
to which promotion shallbe made on the basis of
seniority-cum-fitness.
2.15. Criteria of Eligibility:-

An employee possessing such minimumqualification and length of
service and fulfilling suchother conditions as specified for
promotion shall beeligible for promotion to higher posts for the
timebeing reserved for promotion.
2.16. Manner of Processing:-(1) The promotions to posts in basic
pay scale 16
and above shall be made by the appointingauthority on the
recommendations of theconcerned Selection Board.
(2) The promotions to posts in basic pay scale 15and below shall
be made by the appointingauthority on the recommendations of
theconcerned Selection Committee.
(3) The concerned Selection Board or Committee, asthe case may
be, may consider the case ofeligible employees in the order of
their seniorityand shall;
a) recommend an employee forpromotion ;or
b) recommend an employee forsupersession on the ground ofbeing
unfit for promotion at thetime of consideration; or
c) defer consideration of promotionof an employee provided that
thisstep will be taken only if;
i) ACR dossier of theemployee is incomplete orany other document
orinformation required bythe Selection Board orconcerned
PromotionCommittee for

determining his fitness forpromotion is not available;or
ii) Disciplinary or proceedings are pendingagainst the
employeewhose promotion casecomes up forconsideration before
theSelection Board/Promotion Committeeconcerned; or
iii) an employee is ondeputation abroad to aforeign
Government,private organization or aninternational agency; or
iv) an employee does notpossess the requisitelength of service;
or
v) an employee has notundergone the prescribedtraining or passed
the examination for reasonsbeyond his control; or
vi) An employees seniorityis sub judice. Provided further thatin
case of deferment avacancy shall be reservedfor the employee or if
it isfilled, it shall be subject tothe condition that whenthe
employee is

subsequently promotedwithout having beensuperseded,
thearrangement may bereversed and the juniorperson will be reverted
tohis lower post.
(4) An employee who is superseded will not beconsidered for
promotion again unless he earnedone more confidential report for
full year.(5) An employee who is deferred will be
considered for promotion as soon as thereason for which he was
deferred ceases toexist;
2.17 Fulfillment of minimum Service
(1) The promotion to posts in basic pay scale 16and above shall
be subject to fulfillment of minimumlength of service by the
employee as specifiedbelow: -
(i) For promotion topost in basic payscale 1-17
Difference of scale plusone year.
(ii) For promotion topost in basic payscale 18
05 years service in basicpay scale 17 and above
(iii) For promotion toposts in basic payscale 19
12 years service in basicpay scale 17 and above
(iv) For promotion toposts in basic payscale 20
17 years service in basicpay scale 17 and above
Provided that:(a) When initial appointment of a person
not being employee of the TEVTA

takes place against a posts in basicpay scale 18, 19 or 20, the
length ofservice specified above shall bereduced for the purpose of
promotionto higher posts as specified below:-
(b) When first appointment of a personwas made in TEVTA in a
post inbasic pay scale 16 or below, one halfservice in basic pay
scale 16 and onefourth in basic pay scale 15 andbelow may be
counted as service inbasic pay scale 17 for computinglength of
service for promotion only.
(2) The periods of extra-ordinary leave or anyother period of
service which is not reckonedas service qualifying for pension
shall not becounted towards prescribed length of servicefor
promotion.
2.18 Conditions Prescribed for Promotion to SelectionPosts For
promotion to selection posts in BPS-16 and
above, an employee must fulfill the followingconditions as
prescribed from time to time by theGovernment:-
(i) Qualifying Service(ii) Eligibility threshold (minimum
score/marksin ACRs)(iii) Qualification as prescribed by Method
of
Appointment and Qualification (MAQ).(iv) Relevance of
Experience(v) Quality or output of work and integrity(vi) Training
etc.
2.19. Priority of Filling up Promotion Posts:

The promotion to next higher posts shall not beconstrued as
vested right of an employee, however,where cadre has definite quota
reserved for initialappointment and promotion, promotion quota as
faras possible, be made first and the post reserved forinitial
appointment shall be followed later.
PART-IVAPPOINTMENT BY TRANSFER
2.20 Appointment in Public Interest The appointment by transfer
against the posts
available in the service of TEVTA or from a post inone cadre to
a post in another cadre shall be made inthe public interest with
the approval of theappointing authority on the recommendations
ofSelection Board/Committee concerned.
Provided that no appointment by transfershall be made without
the consent of an employeeconcerned.
2.21 Regular Incumbent to be considered. Appointment by transfer
shall be made from
amongst persons holding appointment on regularbasis in a post in
the same basic pay scale orequivalent to or identical with the post
to be filled.
2.22 Possessing Qualification for Initial Appointments Only
employee of the Government possessing the
qualifications and other conditions laid down forinitial
appointment to the post on which appointmentby transfer is being
made, shall be considered by theconcerned Selection Committee for
appointment bytransfer.
PART-VAppointment on Deputation
2.23 Appointment to be made Sparingly The appointment on
deputation to a post shall be
made sparingly and only in the public interest or to

enhance the capacity or to help in improving thequality and
progress of the TEVTAs working.
2.24 Conditions of Deputation1. The appointing authority may
appoint on the
deputation a Government Servant or Federalor a Provincial
Government Servant or anemployee of an organization set up
ormanaged by such Government who isholding an appointment on
regular basis,against an equivalent post in TEVTA.
2. The appointment shall be made with theconsent of the lending
agency for suchperiod and on such terms and conditions asmay be
determined by the appointingauthority of TEVTA in consultation with
thelending agency.
3. A person on deputation may be alloweddeputation allowance and
all other benefitsunder the prevalent rules and
deputationpolicy.
PART-VIContract and Temporary Appointments
2.25 Appointment against temporary post.(1) The appointment on
temporary posts shall be
made by the appointing authority, on specificterms and
conditions as may be prescribed bythe Authority on the
recommendation ofrelevant Selection Board/Committee.
(2) The persons appointed against any such postspecified shall
perform or continue till theduration of the project or purpose or
on thebasis of satisfactory performance.

(3) The appointments made against thetemporary/contract posts
included in shall notcarry any right to continue in the service
orfor reappointment whatsoever.
PART-VII2.26 Appointment on Acting Charge Basis
(1) Where the appointing authority considers it to bein the
public interest to fill a post in basic payscale 16 and above
reserved for promotion andthe most senior employee belonging to the
cadreconcerned who is otherwise eligible forpromotion, does not
possess the prescribedlength of service, the appointing authority
mayappoint him to the post on acting charge basis.
(2) So long as the employee holds the acting chargeappointment,
the employee junior to him shallnot be considered for regular
promotion but maybe appointed on acting charge basis to
higherpost.
(3) Acting charge appointment shall be made againstposts which
are likely to fall vacant for a periodof six months or more.
(4) In case of appointment on acting charge basis,employee shall
assume full responsibilities of thepost and exercise all statutory,
administrative andfinancial powers vested in the regular
incumbentof the post.
(5) Acting charge appointment shall not amount topromotion on
regular basis for any purposeincluding the inter-se-seniority of
the incumbentsin the cadre.

(6) Acting charge appointment shall not confer anyvested right
for regular promotion to the postheld on acting charge basis.
(7) During the period an employee holds charge of apost on
acting charge basis, he shall draw payequal to minimum stage at
which his pay wouldhave been fixed had he been appointed to
thatpost on regular basis but the service rendered onacting charge
basis in the scale applicable to thepost shall begin to count for
increment in thatscale from the date on which he completes
theprescribed length of service for regularpromotion to that
post:
Provided that if at any time duringhis appointment on acting
charge basis the pay ofthe employee in the lower post exceeds his
pay onacting charge appointment he will draw his pay ofthe lower
post. The service rendered on actingcharge basis shall also count
towards increment inthe scale of the post held prior to appointment
onacting charge basis.
PART-VIIIAdditional Charge and Current Charge of Post
2.27 Additional Charge:- If a post falls vacant and it is not
possible to fill it in
the prescribed manner the work of the post shall asfar as
practicable, be distributed among one or moreemployees of the same
status and designation.However, where this is not practicable the
charge ofthe vacant post may be entrusted in its entirety,
withapproval of Chairman, to another employee. Thisarrangement
should not be made for period of lessthan three months, however, it
may be extended for

another three months with the approval of theauthority.
2.28 Current charge of higher post Where a temporary vacancy
occurs for not more
than two months and no arrangement is immediatelymade for
carrying out day to day work of the post,the charge of the vacant
post may be given with theapproval of the concerned appointing
authority, inaddition to the duties of his own post, to the
seniormost employee in the cadre present if he isotherwise fit and
eligible for promotion. Thearrangement shall be subject to the
followingconditions: -a) The arrangements shall not be made for
a
period of time less than one month andshould not exceed three
months. However, itmay be extended by another three monthswith the
approval of the next higher authorityand where the Chairman is the
next higherauthority in granting extension, beyond sixmonths shall
require approval of theAuthority.
b) As soon as the current charge is given,proposal for regular
appointment shall beinitiated and processed.
c) In making current charge arrangement, thesenior most employee
of the cadre availableand present shall be considered.
d) The length of service prescribed forpromotion shall, however,
not apply in suchcases.
CHAPTER 3PROBATION
3.01 Probation Period:-

i. A person appointed by initial appointment orby promotion or
by transfer will be placed onprobation for a period of two
years.
ii. The period of probation may be curtailed forgood and
sufficient reasons, to be recordedby appointing authority, or if
considerednecessary, it may be extended for a periodnot exceeding
one year as may be specified.
3.02 Completion of Probation:-(1) An employee appointed by
initial
appointment shall not be deemed to havecompleted his period of
probationsatisfactory until his character andantecedents have been
verified to thesatisfaction of the appointing authority.
(2) On the successful completion of the periodof probation, the
appointing authority shall,by specific order, terminate the
probation.
(3) If no order is issued under sub-para (2) afterconsideration
of the case on the expiry oftwo year probation, the period of
probationshall be deemed to have been completedsatisfactorily
subject to provision of sub-para(1) above and para 3.03 below.
3.03 Passing of Examination:-Where in respect of any post the
satisfactorycompletion of probation includes the passing of
anyexamination, test or course or successful completionof any
training, a person appointed on probation tosuch post, who before
the expiry of the original orextended period of his probation, has
failed to passsuch examination or test or complete successfullythe
course or training shall, except as may beprescribed otherwise.

(a) be discharged from service if he wasappointed to such post
by initialappointment:
Provided that if a personconcerned holds a lien on a post inthe
TEVTA, his service shall not beterminated and he shall be reverted
tothat post; and
(b) be reverted to the post from which hewas promoted or
appointed bytransfer.
CHAPTER-4CONFIRMATION
4.01 Principles and Eligibility(1) An employee appointed by
initial
appointment or by promotion ortransfer to a post in TEVTA shall
onsatisfactorily completion of hisprobation, be eligible
forconfirmation.
(2) The confirmation shall be made onlyagainst a permanent
post.
(3) Two or more employees shall not beconfirmed in the same post
and at thesame time or in a post in whichanother employee holds a
lien.

(4) An employee shall not be confirmedon two or more posts at
the sametime.
(5) An employee shall be considered forconfirmation strictly in
order ofseniority.
(6) No confirmation shall be madeagainst the post which falls
vacant ondismissal, removal or compulsoryretirement of an employee
until theappeal, if any, against such dismissal,removal or
compulsory retirement isfinally decided.
(7) Any employee who, during theperiod of service, was eligible
forconfirmation on any post retires fromservice before such
confirmation shallnot, merely by reason of suchretirement, be
refused confirmation insuch post or any benefits accruingthere
from.
(8) Confirmation of any employee in apost shall take effect from
the date ofoccurrence of permanent vacancy inthat post or from the
date ofcontinuous regular officiation on suchpost whichever is
later.
4.02. Retention of Lien

On confirmation against a permanent post, theemployee shall
acquire a lien on that post and shallretain it during the period
when he:-
(a) performs duties of that post;(b) holds a temporary post
other than a post in
the cadre, against which he was originallyappointed.
(c) holds a post on deputation with a ForeignGovernment, an
International Organizationor any other organization outside
Pakistan,with the Federal or Provincial Governmentsor in a
corporation or a body setup ormanaged by the Government, Federal
orProvincial Governments.
(d) is under suspension;(e) is on leave.
4.03 Termination of Lien
(1) The lien of an employee, who is reducedin rank or reverted
to a lower post orgrade as a consequence of
disciplinaryproceedings, shall be terminated againstthe post from
which he is reduced inrank, as the case may be, reverted to alower
post.
(2) A confirmed employee who, on his ownaccord, joins some other
service onregular basis outside TEVTA i.e in anautonomous body or a
corporation or abody set up managed by the Governmentor Federal or
Provincial Government,shall have, after being selected, through

regular selection process, the right ofreversion to the previous
post againstwhich he shall hold lien only during theperiod of his
probation for the newappointment.
CHAPTER-5SENIORITY
5.01 Seniority(1) The seniority in general of the members of
the
service in various grades shall be in accordance withcontinuous
appointment in a particular cadre/ grade.
(2) In the case of members appointed by initialrecruitment the
seniority will be in accordance withthe order of merit assigned by
the selectioncommittee, provided that a person selected for
anappointment to the service in earlier selection shallrank senior
to a person selected in a later selection,and
(3) In the case of members appointed otherwise theseniority will
be with reference to the dates of theircontinuous appointment
provided that if the date ofcontinuous appointment in respect of
two or moreofficers/ officials (if not junior to the
youngerofficer/officials in the next below grade) shall ranksenior
to younger officer/ officials.
5.02 Inter-se-Seniority on Initial Appointment(1) The seniority
of an employee on initial
appointment to a cadre or post shall takeeffect from the date of
regular appointmentto the post to which he has been
initiallyappointed.
(2) Persons initially appointed through an earlieropen
advertisement shall rank senior to

those appointed through subsequent openadvertisement.
(3) If two or more persons are appointedthrough the same
advertisement or selection,their inter-se-seniority shall be
determined inthe order of merit assigned to them by theselection
authority. If no merit was assigned,the person older in age shall
be senior.
5.03. Drawing of inter-se-seniority on PromotionSeniority in a
cadre or post to which an employee ispromoted, shall take effect
from the date of regularpromotion to that post:
Provided that:
(a) Employees selected for promotion toa higher post or on
earlier date shallbe senior to those selected for suchpromotion on
a later date.
(b) Employees selected for promotion toa higher post in one
batch shall, ontheir promotion to the higher post,retain their
inter-se-seniority as in thelower post; and
(c) An employee eligible for promotionwho is inadvertently
omitted frompromotion in the original reference orwhose case is
held up incircumstances beyond his controlwhile his juniors are
promoted to thehigher post, shall, on promotion

without having been superseded, takehis seniority with the
original batch.
5.04. Inter-se-Seniority on Appointment by TransferSeniority in
a cadre or post to which an employee isappointed by transfer shall
take effect from the dateof regular appointment to that post:
Provided that(a) employees belonging to the same cadre or
post
selected for appointment by transfer to a cadre orpost in one
batch shall, on their appointment,take inter-se-seniority in the
order of their date ofregular appointment as in the previous cadre
orpost; and
(b) employees belonging to different cadres or postsselected for
appointment by transfer to a cadre orpost in one batch shall take
their inter-se-seniority in the order of the date of their
regularappointment and where such date is the same,the person older
in age shall rank senior.
5.05. Inter-se-Seniority of Employees Appointed in aCalendar
Year
Employees appointed by transfer in a particular yearshall, as a
class, be senior to those appointed bypromotion or by initial
appointment to such posts inthat year and employees promoted to
higher posts ina particular calendar year shall, as a class, be
seniorto those appointed by initial appointment to suchposts in
that year.
CHAPTETR-6POSTING AND TRANSFER
6.01. Transfer to Equivalent Post(a) An employee shall be liable
to serve in any
equivalent post in TEVTA or for any of its

field institutions wherever functioning or setup in future.
(b) Posting of an employee on a particular postunless decided
otherwise may not exceedthree years.
6.02 Authority Competent to Transfer within theTEVTA
The appointing authority may transfer employeesholding posts in
the Service of TEVTA within oroutside the cadre.
Provided that the Government with theconsent of appointing
authority shall be competent tomake transfer of an employee, in the
public interest,to another equivalent post outside the service
ofTEVTA, in any other Government department ororganization.
CHAPTER-7TERMINATION, REVERSION,
RESIGNATION
7.01. Termination of Irregular Appointment
The appointment of a new employee, which hasbeen made otherwise
than in accordance with theprescribed methods of Appointment
andQualifications (MAQ), may be terminated at anytime by the
appointing authority:
Provided that before such appointment isterminated the employee
shall be informed of theaction proposed against and the grounds
thereof andgiven an opportunity of showing cause against theaction
proposed to be taken against him.

7.02. Reversion, Dismissal or Removal from Service
(1) An employee appointed to a higher post ontemporary for
officiating basis shall be liable toreversion to his lower
post.
(2) No employee shall be dismissed or removed fromservice or
reduced in rank by an authoritysubordinate to that by which he was
appointed.
(3) No employee as aforementioned shall be dismissedor removed
from service or reduced in rank save asprovided in Rule
10.10;Provided that this sub-para shall not apply:-
(i) Where any employee isdismissed or removed fromservice on the
ground ofconduct which has led to hisconviction on a
criminalcharge; or
(ii) Where the appointingauthority is satisfied, forreasons to
be recorded inwriting, that in the interestof security of Azad
Jammuand Kashmir or Pakistan orany part thereof, it is notexpedient
to give thatemployee such anopportunity
7.03. Principles Governing Resignation(1) Subject to any
provision of law for the time
being in force, a temporary or permanentemployee may resign in
writing from his post. The resignation shall not become
effectiveunless the appointing authority accepts it. Till

such time the resignation is accepted, theemployee shall
continue to serve and cannotabsent himself from his duties without
properleave. Any violation in this behalf shall amountto misconduct
and the employee shall makehimself liable to disciplinary
action.
(2) If an employee after submission of hisresignation withdraws
it before it is accepted,the resignation shall be deemed to have
beenwithdrawn.
(3) If any employee withdraws his resignation afterits
acceptance by the appointing authority butbefore it becomes
effective i.e the employee isrelieved, it will be open to the
authority, whichaccepted the resignation to allow the employeeon
merit of the case to withdraw the resignation.
(4) The resignation of an employee shall not beaccepted if any
disciplinary proceedings arecontemplated or are in progress.
(5) An employee submitting his resignation shall berequired to
clear all dues payable by him.
(6) The resignation shall be submitted by anemployee through his
immediate superior officerto the appointing authority accompanied
by theoriginal letter of resignation, along with thefollowing
information:-
(a) Whether any disciplinary proceeding arepending or
contemplated against him;
(b) Whether the employee is required toserve TEVTA for any
specified period inaccordance with his terms and conditionsof
appointment or any bond orunderstanding in connection with the

grant to leave, course of instructions ortraining, etc, and if
so, whether thatperiod has expired and if not, whetherany money
spent on his training andrecoverable from him has been paid byhim;
and
(c) Whether he has paid any other duesrecoverable.
7.04. Retirement from ServiceThe employees of TEVTA shall retire
from serviceon completion of sixtieth year age. The provision
ofthis rule does not apply to the temporary/ contractappointments,
who shall be governed by theprovisions of the Act, and terms and
conditions oftheir services as expressly stipulated while
makingsuch appointments.Explanation:When an employee is required to
retire on attaininga specified age, the day on which he attains
that ageis reckoned as a non-working day, and he must retirewith
effect from that day.
7.05. Retirement on completion of 25 years ServiceOn completion
of 25 years service an employee maybe retired under the following
circumstances withearned pension plus other prescribed
benefits:-
(a) On his own request; or(b) On recommendation of the Service
Review
Committee or Board constituted by theChairman of TEVTA. The
performance ofthe employee having completed 25 yearsservice will be
reviewed by the Committeebi-annually. The Committee after review
willrecommend, basing on the overall

performance of the employee, his furtherretention in service or
retirement fromservice.
7.06. Retirement on medical groundsThe retirement on medical
grounds shall begoverned by the Government Rules as amendedfrom
time to time.
CHAPTER 8EMPLOYMENT AFTER RETIREMENT
8.01. Provision for Making Re-employment(1) The retired employee
shall not be reemployed
unless such re-employment is necessary in thepublic interest
which shall be made with theapproval of the Chairman.
(2) Re-employment beyond the age ofsuperannuation shall be made
as exceptiononly. The following criteria may be followedwhile
considering cases of re-employment:-
(a) Non-availability of suitably qualifiedand experienced person
throughprescribed methods of qualification(MAQ) to replace the
retiringemployee.
(b) The employee is highly competentperson with distinct
qualification andexperience in the relevant field,whose substitute
is not available inthe market.
(c) The re-employment does not createpromotion block.

(d) Retention of the retiring employeefor a specified period is
in the interestof the TEVTA.
8.02. No re-employment in certain cases.- An employeewho was
compulsorily retired or removed fromservice as a result of
disciplinary action or retiredafter completion of 25 years of
service qualifying forpension under the rules applicable to him,
shall notbe re-employed.
8.03. Private and Commercial Employment AfterRetirement
If a retired employee seeks any commercial orprivate employment
during leave preparatory toretirement or before the expiry of two
years from thedate of retirement, he shall obtain prior approval
ofthe Chairman if he holds a post in basic pay scale 19and above
and appointing authorities in other cases.
CHAPTER-9CONDUCT
9.01. Family CompositionFor the purpose of these rules in this
chapter,member of an employees family includes:
(a) employees spouse.(b) his child or step-child,
whetherresiding with the employee or not; and(c) any other relative
of the employee or
his wife, when residing with andwholly dependent upon the
employeebut does not include a wife legallyseparated from employee,
or a childor a step-child who is no longer inany way dependent upon
him or ofwhose custody the employer has beendeprived by law.

ExplanationReference to a spouse in this provision shallbe
construed as reference to a husband wherethe employee is a
woman.
9.02. Acceptance of Gifts and Cash AwardsSave as otherwise
provided in this para, noemployee shall, except with previous
sanction of theChairman, accept, or permit any member of hisfamily
to accept from any person any gift the receiptof which will place
him under any form of officialobligation to the donor. If, however,
due to veryexceptional reasons a gift cannot be refused thesame
may, under intimation to the ChairmanTEVTA, be kept for official
use in the TEVTA.
9.03. Foreign Award/Title and decoration
No employee shall, except with the prior approval ofthe
Government, to be obtained through theChairman, receive a foreign
award, title ordecoration.
Explanation
For the purpose of this provision, the expressionthe approval of
the Government, means priorapproval in ordinary cases and ex-post
factoapproval in special cases where sufficient time is
notavailable for obtaining prior approval.
9.04. Public Meetings and Funds Raising
(1) No employee shall encourage meetings to beheld in his honour
or presentation ofaddresses of which the main purpose is topraise
him.

(2) Notwithstanding anything contained in sub-para (1) :-
(a) An employee may with the previouspermission of his higher
officer, takepart in raising of funds to be incurredfor any public
or charitable purpose;and
(b) An employee may take part, with theprevious sanction of the
Chairman, inthe raising of funds to be expendedfor any public or
charitable objectconnected with the name of any otheremployee or a
government servant ora person who has recently quittedservice of
the TEVTA or theGovernment.
(c) When an employee takes part in theraising of funds in
accordance withthe provisions of clause (a) and (b)sub-para (2), an
employee shall berequired to keep regular accounts andsubmit them
to the next higher officerfor scrutiny.
9.05. Permission to Marry a Foreign National(1) Save as provided
in sub-para (2), an
employee may, with the prior permission ofthe Chairman, marry a
foreign national
(2) An employee who marries or promises tomarry a foreign
national including Muslimcitizen of India without permission shall
beguilty of misconduct render himself liable to

disciplinary action under relevant provisionof these rules and
Government rules.
(3) The grant of permission under sub-para (1)or (2) shall be at
the discretion of Chairmanor, as the case may be, the person
authorizedthereof and may be subject to such conditionsas may be
specified by the ChairmanExplanationFor the purpose of this
provision, marriagesmeans matrimonial relationship entered intoin
accordance with any law for the timebeing in force or any religious
rites orceremonies, and its grammatical variationsand cognate
expressions shall be construedaccordingly.
9.06. Acceptance of Subscription
Subject to para-9.04, no employee except with theprevious
sanction of the Chairman, ask for or acceptor in any way
participate in the raising of anysubscription or other pecuniary
assistance inpursuance of any object whatsoever.
9.07. Money lending and Borrowing(1) No employee shall lend
money to, or borrow
money from, or place himself under anypecuniary obligation to
any person within thelocal limits of his authority or any
personwith whom he has any official dealings:
Provided that this rule shall not applyto dealings in the
ordinary course of businesswith a joint stock company, bank or a
firm ofstanding.
(2) When an employee is appointed ortransferred to a post such
nature that a personfrom whom he has borrowed money or to

whom he has otherwise placed himself underpecuniary obligation
will be subject to hisofficial authority, or will reside,
possessimmovable property, or carry on businesswithin the local
limits of such authority, heshall forthwith declare the
circumstances tothe Chairman through the usual channel:
Provided that the employee is BasicPay Scale 15 and below shall
make the declarationreferred to in this sub-para to the Director
(Tech.).(3) This rule is so far as it may be construed to
relate to loans given to or taken from co-operative societies
registered under co-operative Societies Act, 1912 (II of
1912),adapted and as enforced in AJK, or under,law for the time
being in force relating to theregistration of co-operative
societies by theemployees, shall be subject to any generalspecial
restrictions made or permitted.
9.08. Acceptance of Training FacilitiesNo employee shall, except
with the previoussanction in writing of the Chairman, accept or
takeup training in any other organization within thecountry or
abroad. No request of advance copy ofthe request for training in
another organization shallbe made by the employee except through
properchannel or as may be prescribed by the Chairman bygeneral or
special orders.
9.09. Delegation of PowersThe Chairman, Secretary/ Chief
Operating Officeror the Director (Tech.), may by general or
specialorder, delegate to any officer or authoritysubordinate to
him all or any of his powers underthese rules and may, by such
order, prescribe the

channel through which reports, shall be regarded asreceipts of
the reports by the TEVTA within themeaning of these rules.
9.10. Derogation of any Law etc.Nothing in these rules shall
derogate from theprovisions of any law or of an order of
anycompetent authority for the time being in force,relating to the
conduct of employees.
Chapter-10Miscellaneous, Relaxation, Amendment and Repeal
10.01 Just and Equitable Treatment in Hardship
casesNotwithstanding anything to the contrary containedin these
rules in relation to the terms and conditionsof service of an
employee, the Chairman TEVTA, ifhe is satisfied, for reasons to be
recorded in writing,that strict application of any provision or,
conditioncauses hardship in any case, by order, may relax
thisrequirement to such extent as he may deems fit, forensuring
just and equitable treatment to theemployee concerned without
infringing the right ofany other employee.
10.02 Induction of Employees of any other Service(1) A person
belonging to the Government or a
Corporation or body set up or controlled bythe Government and
serving on deputation inthe TEVTA may opt for permanentabsorption
in the TEVTA against the postequal to or identical with the post
held onregular basis by him, under suchGovernment, Corporation or
body.
(2) The option for absorption once exercisedshall be final and
subject to the consent ofthe competent authority of such employee
in

the parent department and approval of theappointing authority in
the TEVTA, hisappointment in the TEVTA shall be deemedas
appointment on transfer for all purposesunder these rules.
10.03 Seniority on InductionNotwithstanding anything to the
contrary containedin these rules on induction in the TEVTA
asprovided in para 12.02.(i) The employee shall take their
inter-seniority
in order of the date of their regularappointment to the posts in
BPS-17 orequivalent in their respective cadres whichthey hold
before their appointment in theTEVTA and where such date is the
same, theperson older in age shall stand senior.
(ii) The employees serving in BPS-16 and belowshall reckon their
seniority from the date oftheir regular appointment to the posts,
whichthey were holding before their appointmentin the TEVTA.
10.04 Not to Consult PSCNotwithstanding anything to the contrary
containedin any other law already in force, it shall not
benecessary to consult the Azad Jammu and KashmirPublic Service
Commission on matters relating tothe Methods of Appointment or
Qualifications etc.,or making such appointments of numbers of staff
ofthe TEVTA, who are not be governed by theprovisions of the Civil
Servants Act, 1976.
10.05 Application of Other RulesThe matters not covered, under
these rules theemployees of the TEVTA shall be governed by theAct
and the rules applicable to the civil servants and

the instructions issued from time to time by theGovernment on
such subject.
10.06. LeaveThe Azad Jammu & Kashmir Civil Servants
RevisedLeave Rules 1983 as amended from time to timeshall be
applicable for employees of the TEVTAsubject to the condition that
leave shall not beclaimed by the employee as a matter of right,
grantof which shall be subject to the exigencies of theAuthority
business, as the case may be. Thesubmission of an application will
not be deemed tobe valid ground for proceeding on leave until
formalsanction of the competent Authority. Extension ofleave shall
be discouraged and will be sanctionedonly in very special
circumstances and will besubject to the employees entitlement.
10.07. Medical FacilitiesExcept where the specific rules are
made in thisbehalf for TEVTA, the rules applicable for the
civilservants shall be applicable to the employees ofTEVTA.
10.08 Provident FundTEVTA employees provident fund to be
constitutedand established by a separate deed of trust, shall
begoverned by the rules to be made by theGovernment, (this scheme
will be only for theemployee of Authority and Government
employeestransferred to TEVTA, GPF will be dealt byAccountant
General office till their absorption inTEVTA).
10.09. Gratuity and Pension(1) Regular Employees of TEVTA
(Except GovtEmployee transferred to TEVTA) will be entitled
forgratuity at the rate of two month salary last drawn

for each completed years of service shall be payableon
retirement or discharge by the authority providedthat employee has
put in at least three years ofservice. No gratuity will be paid to
an employeewhose services have been terminated for mis-conduct or
corruption.(2) If an employee quits services of the
authorityvoluntarily, period he served before quitting theservice
shall not be counted for any purpose.However, service rendered for
six months and abovewill be treated as a complete year of
service.(3) For the purpose of calculation, service less thansix
months period be dropped however, servicerendered for six months
and above will be treated asa complete year.(4) The pension and
gratuity rules applicable forcivil servants shall also be
applicable for employeesof TEVTA till specific rules in this behalf
are madeby the Government.
10.10 Conduct/ Efficiency and DisciplineNotwithstanding anything
contained in these Rules,Removal from Service (Special Powers) Act,
2001and the Azad Jammu & Kashmir GovernmentServants (Conduct)
Rules 1981 shall be applicableon all the employees working in the
service ofTEVTA.
10.11 TA/ DA RulesTA/ DA Rules of Government shall be
applicablefor employees of TEVTA till specific rules are madeby the
Government for employees of TEVTA.
10.12. Contract Employees PayAuthority has the full power to
offer its contractemployees salary as per the BPS or fixed
salary.

Fixed salary structure has to be approved by theAuthority.
10.13 Appointment of consultantThe Chairman shall appoint any
person dulyqualified consultant for any specific purpose
orassignment: Provided further that such appointment madeshall be
reported to the Authority withoutunreasonable delay.
