Base Zoning Vs. Overlay

• Base Zoning – City-wide uses / dimensional standards

• Overlay – Additional regulations for a specific geographical area

-AO Airport Overlay District• Limit uses to industrial and other

uses that are compatible with airport operations;

• Limit residential uses to very low densities;

• Minimize the negative effects of aircraft noise on homes; and

• Prohibit erection of structures which would interfere with operations at the airport.

• Written documentation from the airport indicating structures with a height of 50 feet or more complies with all applicable airport regulations; and

• Residential uses are prohibited with the exception of single-family detached dwellings on lots that are at least 40,000 square feet in area.

(1) Public Notification of Potential Aircraft Noise Impacts

• Written disclosure statement to prospective purchasers;

• Statement on the recorded final plat for all subdivisions; and

• Statement within the declaration for owners' association.

"This property is located within the Airport Overlay District and is subject to both day and nighttime aircraft overflights and to aircraft noise that may increase in the future and that you may find to be objectionable dependent upon the use and location of the property.”

(2) Noise Level Reduction Design

• Achieve an outside to inside noise reduction level of at least 30 decibels (dB);

• Through building design, building materials, construction standards, and/or other measures; and

• Certified by a qualified acoustical professional.

(3) Parcels Split by the AOD-B Line:

Outside Overlay but,

• Line cannot shift by more than 600 feet;

• Line cannot encroach into AOD-A.

OPTION “B” - The proposed overlay district will be divided into two parts:

1) AOD-A which would allow single-family dwellings on lots greater than 40,000 square feet with notification and noise level reduction requirements; and

2) AOD-B which would allow all residential uses with notification and noise level reduction requirements.

OptionsOPTION “A” - The proposed overlay district would be divided into two parts:

1) AOD-A which continues to allow single-family dwellings on lots greater than 40,000 square feet; and

2) AOD-B which continues to allow single-family dwellings on lots greater than 40,000 square feet, and allow other residential uses with notification and noise level reduction requirements.
