During the period, Officers of the Licensing Team have processed 692
applications relating to the sale or supply of alcohol, provision of entertainment or late night refreshment. The Proactive work of the team in providing licensees awareness of their licence restrictions i.e permitted hours and the British Lions Rugby series resulted in 200 Temporary Event Notices (TEN's) being submitted by licensed premises across the Borough. Most licensed premises required a TEN as the majority of premises licences / club premise certificates would not have permitted alcohol sales between 8.30am until 11.00am.
Aside from the British Lions tour, a number of Temporary Events Notices (TEN’s) notifications were used by Private Member clubs to authorise additional hours / access to non members, birthday parties and Charitable events.
A number of on licensed premises primarily in town centre locations submitted TEN's in view of the clocks going forward for British Summertime.
One former on licensed premise utilised the TEN’s process in order to facilitate the retail sale of alcohol, following the lapse of the premises licence due to the bankruptcy of one of the premises licence holders. This bridged the gap until a new premises licence was granted.
TEN's have also been use to authorise licensable activity at outdoor events such as 'Beating of the Bounds' in Llantrisant and various charitable or fund

raising events within the Borough. Licensing Officers inspect TEN's to ensure compliance and promotion of the licensing objectives.
Analysis of the TEN's applications indicate 133 related to Private Members Clubs, 216 for existing premises licences and 61 permitted community events.
A summary of TEN’s, is reproduced for Members information as Appendix 1A.
In accordance with the advice received in respect of data protection
matters, the summaries of Personal Licences and Premises Licences issued under delegated authority are now reproduced for information as a Part II restricted item.

Objections to the TEN were received from South Wales Police who cited concerns over the applicants’ ability to promote the crime and disorder licensing objective and difficulty in contacting the applicant. Objections were also received from Environmental Health Officers who expressed concern in respect of the promotion of public safety and public nuisance licensing objectives. At Sub Committee Hearing, Members heard from the applicant and from Police and Environmental Health Officers and subsequently determined to refuse the application on the basis that the applicant could not satisfy them that they could adequately promote the licensing objectives. Officers provided advice and guidance to the TEN provider following the hearing in order that any future planned events may be permitted. Llantwit Fardre Sports Club made a variation application to increase the permitted hours of their Club Premises Certificate (CPC) until 02.00hrs on Friday and Saturday. Objections were received from the local Member and a local resident opposing the increased hours. After the hearing the application, Members determined to grant the application subject to conditions. Rhydyfelin AFC made an application for a Club Premises Certificate (CPC) to permit the supply of alcohol one day a week, (Saturday 13.00 to 20.00hrs) at their clubhouse, located at Hawthorn Dog Track, Hawthorn. Whilst the Responsible Authorities were satisfied that subject to conditions, the Club could promote the licensing objectives, the application drew a number of resident objections concerning alleged anti social behaviour, nuisance and parking issues. Members having considered resident representations subsequently determined to grant the Club Premises Certificate subject to a number of conditions. Shane Evans application for a Personal Licence was heard by Members. After hearing from Mr Evans and following evidence presented by South Wales Police, Members subsequently determined to refuse the application. Reviews

Whilst a review of the Club Premises Certificate of Beddau RFC was triggered by the Licensing Authority following concerns in respect of compliance, following positive mediation with Club Committee Officials, a Minor Variation application was submitted to add conditions to the existing Club Premises Certificate and the Review was subsequently withdrawn. Two applications were subsequently received to Authorise a family fun day / Charitable on the Beddau RFC pitch this Summer, Club officials have been working positively with Officers to ensure this event goes ahead safely with the requisite authorisations in place. Appeals There have been no appeals lodged or determined in the period.
4.3 Compliance & Enforcement
(i) Prosecutions/Infringements
The Licensee of an Off Licence in the Pentre area was prosecuted for an offence under the Licensing Act 2003 in respect of the sale of alcohol to a person under the age of 18 following a test purchase under the direction of Trading Standards Officers.
The Licensee of an Off licence in Glyncoch received a Simple Caution for the sale of alcohol to person under 18. Details of complaints / investigations have been detailed in the complaints, advice and guidance section below.
(ii) Test Purchasing
Trading Standards Officers have conducted 25 underage sales test purchases at off licences in the Borough during the period. It was pleasing to note that each premises correctly refused the 16 year old test purchase volunteer.
(iii) Premises Inspection & Infringements 70 premises in the Borough were inspected in the period between 26th December 2016 and the 9th July 2017. The relevant Performance indicator for the Licensing Team is the premises licences found to be broadly compliant following inspection by Licensing Officers. Officers will consider confidence in management, compliance with licence conditions and business competency when determining the risk rating of the premises when considering whether they are broadly compliant. As at the 31st March 2017, 74.4% of premises inspected were found to be broadly compliant. As at the 30th June 2017, 79.8% of premises were broadly compliant.

A summary of infringements arising from inspection is reproduced as Appendix 1B.
The most common infringement related to lack of Licence Summary's on display, the absence of the full Premises Licence from the premises and lack of / non compliant CCTV. In the first instance, licensees will receive written notification of the breaches identified. Officers will ensure that any corrective action required is undertaken in a timely manner. In order to address the non compliance identified, the next quarterly Alcohol and Gambling newsletter will provide a checklist reminder for licensees on some basic housekeeping requirements.
(iv) Complaints, Advice and Guidance A total of 107 complaints and/or requests for service have been received across the three areas. A summary of the type of complaint / service requested have been summarised by area below. Cynon Valley
Officers have supported the Pub watch schemes in Aberdare and Mountain Ash over the period. The Licensees have in a number of instances 'banned' patrons from Member premises for up to two years. Officers have undertaken a number of multi agency pre application advice visits with prospective applicants as advocated within our Licensing Policy. These included premises looking to licence their outside areas i.e beer gardens. Joint enforcement visits with South Wales Police have been undertaken at on and off licensed premises in Mountain Ash and Aberdare following complaints and intelligence passed by the Youth Offending Team concerning alleged underage alcohol sales and the alleged theft of alcohol. The premises subject to the theft complaint was subsequently revisited by Officers and the store concerned had moved the alcohol to an alternative location within the store. Officers have liaised closely with a licensee who advised them that the 'CCTV had been "switched off because it was quiet." In this instance a Section 19 Closure Notice was issued requiring the licensee to comply with licence conditions. Officers assisted an on licensed premises to resume the retail sale of alcohol where it was established that the Designated Premises was absent. Following receipt of an application to remove a number of conditions relating to the use of the outside area of a town centre premises. Officers met with the applicant and provided advice and guidance resulting in the withdrawal of a contentious variation application.

Officers have facilitated a multi agency meeting with a licensee who is the Premises Licence Holder of 10 on licensed premises in the borough in order to address a number of management issues. Letters of warning/advice have been sent to 3 takeaway premises in the Aberdare and Abercynon area allegedly selling hot food after 11pm without the appropriate licence. Licensing Officers following a number of incidents of proxy sales of alcohol in the Aberdare area have used Social Media to help highlight the dangers of buying alcohol for underage persons. Two eighteen year old females have received Anti Social Behaviour referrals for purchasing quantities of alcohol for underage youths in the town centre. Licensing Officers have provided advice and guidance to a licensed premises in Ynysybwl concerning a Music festival that was due to be held in May, which is now likely to be held in August and concerning a variation application to increase the pubs licensed area.
Rhondda A meeting was held with a Private Members club in Clydach following receipt of a complaint about patron noise after permitted hours of the Club Premises Certificate. The meeting with the Club Committee was positive and advice provided concerning options to extend licensable activities. Officers have supported Upper Rhondda and Porth Pubwatch meetings throughout the period. A Pubwatch member in the Treorchy area has been expelled by the group for permitting the serving of individuals 'banned' by the Pubwatch group. Officers facilitated a meeting of Responsible Authorities to assist a prospective new applicant for a new off licence in the Porth area. Visits to off licences in Penygraig and Ynyshir have been undertaken with Police Licensing Officers following concerns about proxy sales and youth annoyance. A Treorchy on licensed premises which had ceased trading and had proceeded to surrender its licence has been purchased by new owners, transfer application submitted and trading has recommenced. Officers have visited a retailer in Penygraig reportedly selling alcohol illegally. Officers subsequently identified that the premises was selling novelty non alcoholic 'Duff' Beer’. Officers have conducted multi agency visits in conjunction with the Security Industry Authority and South Wales Police to three on licensed premises looking at the provision of door staff and compliance with licence conditions. Non compliance was identified at one of the premises visited in Tonypandy, which will now be subject to further investigation.

Music and patron noise complaints have been received from 3 Private Members clubs located in Maerdy, Gelli and Pontygwaith. Officers have written to the Secretary's of each club. Taff Area Officers have attended Pubwatches in Pontypridd, Treforest and Pontyclun thoughout the period. Officers have successfully mediated an application for a new premises licence in Llantrisant following local resident concerns in respect of public nuisance. Following concerns raised by CCTV Operatives, Officers have liaised with the Police and Security Industry Authority (SIA) following allegations of inappropriate behaviour towards patrons by members of door staff at a licensed premises in Pontypridd. Investigations are still currently ongoing and an update will be provided in future reports. Officers organised a multi agency meeting to deliver pre application advice for a prospective new on licensed premises in the Treforest area. Each of the Responsible Authorities provided expert advice on their expectations, whilst the meeting was positive, the prospective applicant decided not to pursue the venture on this occasion. A number of private member clubs in Pontyclun and Llantrisant have requested advice in respect of their responsibilities of their existing Club Premises Certificates, Temporary Events and the pros and cons of moving to Premises Licences. Officers have provided advice to a local sport club, where it was alleged that sales of alcohol were being made in the absence of the appropriate licence / authorisation. Whilst the allegation could not be substantiated, an application for a Club Premises Certificate was subsequently received by the Licensing Authority. Officers are currently investigating noise nuisance complaints, following complaints from local residents about live or recorded music attributed to on licensed premises in Llantrisant and Llantwit Fardre.
Advice has been provided to the licensee of an on licence premises in the Taffs Well area following complaints about music noise emanating from the first floor of the premises.
A Pontypridd town centre premises has been visited by Officers and advice provided following a report of underage drinking and the sale of alcohol before permitted hours. Complaints have been received concerning a private members club in the Trallwn area in respect of trading past permitted hours, loud music and admission of non members. Officers have written to the Club Secretary of the club concerned.

Officers have facilitated a meeting with the licensee of an on licensed premises which previously had its ability to hold live and recorded music removed with a view to a new application to add live and recorded music to its licence. The Premises is currently using TEN's to demonstrate its ability to hold such activity once again. The licensees and management of an on licensed premises in Pontyclun have received written warning following an illegal sale of alcohol at 8.45am on a Tuesday morning during one of the British Lions Rugby tour and a failure to meet a number of conditions. Meetings have also taken place with the relevant parties to ensure future compliance. Complaints have been received concerning two takeaway premises in Treforest in respect of nuisance and failure to hold the appropriate late night refreshment licence. Officers have also written to a takeaway premises in Pontyclun inviting them to make the necessary application in order to legitimately trade beyond 23.00hrs. Advice has also been provided to the licensee who had provided a loudspeaker for entertainment in the beer garden area of his Pontypridd premises. The Licensee decided to remove the same.
(v) Member / Officer Training Training has been provided and was well received by new Members of the Licensing Committee by David Lucas of Fraser Brown Solicitors on the 6th June 2017. The training concentrated on key aspects of the Licensing Act 2003 in relation to alcohol/entertainment and late night refreshment and legislation relating to the taxi and private hire regime. Training for Officers of the Licensing Team and a number of the Responsible Authorities including Child Protection, Trading Standards, Environmental Health, Health Board and Police was undertaken on the 7th June 2017 and covered recent changes and amendments to the Licensing Act 2003 including the Immigration Act requirements. (vi) Community Alcohol Partnership (CAP) - Porth Members will recall the Porth Community Alcohol Partnership initiative launched in November 2016. The Partnership aimed to provide diversionary activities for children, Alcohol awareness, training for licensees and a reduction in anti social behaviour for the town.
Recent developments include Dragon’s Den style event involving Ysgol Gyfun Cymmer, year 9s. Pupils split in to several groups across four, each having to come up with a project/scheme/idea around a diversionary activity to divert under 18’s from drinking alcohol. There were winners in each class, receiving certificates and the CAP working group can now look to see if any of the four winning ideas are feasible to put in to action using the CAP funding available.

purchasing. Pupils from Ysgol Gyfun Cymmer are also helping with the spraying of the signs.
Surveys have gone out to all pupils in both Ysgol Gyfun Cymmer and Porth County Comprehensive, to gauge what diversionary activities they would like to see in their area, with a view of utilising the CAP money available to put some in to practice. A large number of responses have already been returned. (vii) Alcohol/Gambling Newsletter Officers have commenced a quarterly Alcohol/Gambling newsletter in order to provide advice and guidance highlighting key dates, legislative changes and practical self help tips on compliance with the Licensing Act 2003 and Gambling Act 2005. A copy of the first edition is reproduced for Members information as Appendix 1C. It was pleasing to note that that a large number of licensees responded positively to the information provided particularly in respect of TEN usage for the British Lions Internationals.

5.3 Enforcement
Licensing Enforcement Officers have required a fast food retailer in the Williamstown area to remove a Gaming Machine illegally sited on the premises. The food business operator was provided with guidance on the siting of such machines and liaison undertaken with the Gambling Commission. A pre-application advice visit was undertaken with the Gambling Commission to a premises in the Clydach area following a query about a new application for an Adult Gaming Centre. After viewing the premises and following advice, the prospective licensee decided not to pursue an application at this location. Officers have also undertaken a visit to a Family Entertainment Centre in Treorchy providing advice concerning access to gaming machines to school pupils and have also provided advice to an alcohol licensed premises in Treforest allegedly facilitating illegal betting.
5.4 Recovery of Annual Fees
As a result of the static nature of the trade, there is little change to the position, where 100% recovery of annual fees is the standard, primarily due to the robust provisions contained within the legislation which allow for withdrawal of the licence/permit for non-payment of appropriate fees.

NEWS FOR LICENSED PREMISES
Application forms Premises Licences / Personal Licences application forms have changed from the 6th April 2017 following the introduction of the Immigration Act 2016. Such licences cannot be issued to individuals who do not have permission to be in, or are not entitled to work in, the UK.
New forms can be accessed via GOV.UK or contact your local Licensing Team who will be happy to forward the amended applications.
Summer’s coming Do you have outdoor events or festivals planned? Selling alcohol? Having forms of entertainment? You will probably require a TEN. Get early advice from the Licensing Team to address any concerns and ensure the smooth running of the event.

British Lions on Tour Looking to open early to sell alcohol? Your current Premises Licence or Club Premises Certificate (CPC) may not permit the sale or supply of alcohol from 8.30am. STAY LEGAL - apply for your Temporary Event Notices (TENs) without delay.
Important Dates for your diary
Games commence on the 3rd June 2017. Standard TENs require 10 working days notice / Late TENs a minimum of 5 days. Submission is easy and can be done online via GOV.UK. Alternatively contact your local Licensing Team via [email protected]. TENs cost £21 per notice, however one TEN can last a week. You can have up to 15 TENs lasting for up to 21 Days. DON'T GET CAUGHT OUT!!
Where or when did you last see your DPS? The Designated Premises Supervisor is the person in day to day control of, and authorises the sale of alcohol from, Licensed Premises. Has your DPS moved on? Forgotten to notify the Licensing Authority? Then it's likely that you’re selling alcohol illegally. Avoid having to cease alcohol sales, It can be easily rectified, contact your Licensing Team for advice / guidance.
Club Premises Have you notified the Licensing Authority of any change to your Club Secretary? Details of any changes can be sent to [email protected]. Failure to notify could result in a delay in relevant information being provided to your club premises.
Lighter Nights / Warmer Days!! Avoid complaints from local residents. Poor management of doors and windows or beer garden areas particularly in the summer months can cause problems for your neighbours and could impact upon your Premises Licence / Club Premises Certificate.
Suddenly acquired or sited Gaming Machines? Do you have the required permit/notification in place? Are you aware of your supplier details? Are you permitted to have the Category of Machine on your Premises? Contact Licensing Officers for advice and guidance.
