Policy Number DRESS CODE AND UNIFORMS FOR Date Adopted: 9-17-02 Section IV-4 EMPLOYEES Revised: 10-16-02
The Grand Traverse County Road Commission (GTCRC) has adopted a dress code for all employees to provide for the safety and welfare of our employees that are often working in traffic and represent the Road Commission to the public. The establishment of a dress code empowers our employees by being quickly identified as road maintenance providers who are completing the official work of the Road Commission.
The dress code is designed to cover the full spectrum of Road Commission employees. That which might be proper attire for a driver or mechanic would not be deemed appropriate for office personnel. All employees are expected to maintain a neat, well-groomed appearance and to wear clean clothes.
1. The employees will wear the provided safety vest at all times while outside of their vehicles in the right-of-way.
2. A new hat or cap, to be worn at the employee's discretion as long as it is non-offensive. Hats will be provided semi-annuaJly and exchanged if the item becomes damaged. This amendment allowing employee discretion of hats will be monitored by the Manager and Foreman. Anything offensive will not allowed.
3. The union stewards, or their appointed individuals of up to three persons, can act as an advisory committee to the Maintenance Supervisor to recommend changes to the dress code and to select the style and labeling on hats/caps.
4. Mechanics, servicemen and the tar crew will be provided with uniforms as detailed in the Agreement between Teamsters Local 214 and Grand Traverse County Road Commission.
5. Drivers and employees doing fieldwork or inspection will be allowed to wear sweatshirts and Tshirts with sleeves (no "muscle shirts"), so long as these sweatshirts and T-shirts do not have offensive, inappropriate or obscene language or pictures on them.
6a. Employees working in a field environment are required to wear boots above the ankle and have safety toes. No casual shoes may be worn in a field work environment.
6b. Staff regularly performing duties within areas of fresh asphalt and/or other paving materials are eligible for a $150 boot allowance in alternate years. Boots must be safety-toed, above-ankle height and conform to current ASTM standards.
6c. Boot allowance for crew employees conforms to the current bargaining agreement terms. 6d. The purchase receipt must be provided to the Road Commission in order to receive payment. The
Employer reserves the right to examine the boot to ensure it is compliant with ASTM standards prior to reimbursement.
7. Other clothing may be required as stated in the "Personal Protection Equipment Assessment" form provided for various activities.
Employees are expected to use good judgment in their appearance and grooming, keeping in mind the nature of their work and that of their co-workers, and their need to interact with the public, vendors or others. As a guide, the following types of clothing are not acceptable: nylon jogging suits; tank tops, halter tops, or bare midriffs; and shorts or cut-offs.

USING SOCIAL MEDIA TO COMMUNICATE WITH THE PUBLIC
Adopted: I 0-25-12
1) The purpose of this policy is to establish the Grand Traverse County Road Commission's policy for using and utilizing social media intended for external use to communicate with the public regarding Road Commission matters.
2) The Manager and/or Board will designate employee(s) eligible to post on social media sites on behalf of the Road Commission.
4) 5) The objective and purpose of utilizing Social Media is to educate and inform both employees and the
public on relevant Road Commission topics in order to meet its mission to upgrade and maintain a safe and efficient road system. The Road Commission establishes its Social Media sites as a limited public forum for such purposes.
6) All social media (Internet, Facebook, Twitter, etc.) postings, whether done on a Grand Traverse County Road Commission site or a personal site when acting in an official capacity on behalf of the Road Commission must be done in an accurate, professional manner without any expectation of privacy. This policy does not apply to Road Commission employees using social media in their personal capacities.
7) When you are working in your official capacity while online, you are representing the Road Commission. Remember that you are "speaking" for the Road Commission when you are working in your official capacity. Set forth below are several general ethics areas of concern: a. Do not say anything online that you would not say in a speech in your official capacity. b. Do not misuse your Road Commission position for your own gain or to help others
inappropriately. c. Do not endorse any product, service, company, non-profit organization or any other enterprise
unless specifically authorized to do so by the Road Commission Board. d. Do not divulge nonpublic information. This includes any information designated as confidential,
privileged, or any other type of information that may not be disclosed, even if someone else asks you for it.
e. Do not engage in any partisan political activity. f. Do not fundraise for any organization. g. Do not utilize the Road Commission Social Media site to engage in political activity prohibited
under the Michigan Campaign Finance Act, MCL 169.257. 8) Posts should aim to be personable, open, responsible and courteous while offering useful or thought
provoking ideas. 9) Be thoughtful when posting pictures and video of people. While there is no expectation of privacy at a
public event, be aware that there could be restrictions around whose photo you post depending on the circumstances and venue. Photos of minors shall not be posted without parental consent.
10) Misuse of this privilege may result in disciplinary action. 11) Except for content set forth in paragraph 13 below, all public postings from all persons or entities related
to the purpose of the site will remain on the social media site with an appropriate response as indicated. The Road Commission as a governmental entity may not discriminate based upon the viewpoint of the speaker or speech.
12) As needed, the designated employee(s) will confer with staff on subject matters requiring more detailed or politically sensitive responses.
13) Should inaccurate information be posted, timely acknowledgements and corrections will be made. 14) Content submitted to a Road Commission Social Media site shall be moderated by a trained moderator.
The moderator will ensure that posted comments containing any of the following form of content shall not be allowed for posting: a. Comments that are in violation law or encourage violation of law b. Comments that promote, foster, or perpetuate discrimination on the basis of race, religion,
gender, marital status, familial status, national origin, age, mental or physical or other protected status under applicable law.

c. Comments or links to sites that contain obscene, indecent, sexual, or profane language or material.
d. Comments that contain threats or defamatory statements. e. Comments that solicit commerce or promote or endorse services or products. f. Information that may tend to compromise the safety or security of the public or public systems. g. Content that violates a legal ownership interest of any person or entity, including the posting of
copyrighted material.
Anonymous postings shall not be allowed. 18) All Road Commission Social Media sites should contain a statement notifying commenters that their
comments are being moderated pursuant to this policy and may be removed for the reasons set forth in this policy, their comments and the information provided in connection with their comments, including identification information, may be subject to disclosure under the FOIA or in litigation, and by submitting their comments they are granting the Road Commission or anyone viewing the Social Media site irrevocable permission to copy, distribute, make derivatives, display or perform the submitter's work publicly and free-of-charge.
19) All content posted on any Road Commission Social Media site shall be retained as a public record pursuant to the Road Commission's record retention policy.
Grand Traverse County Road Commission Board Presentation
Lake Shore Drive is a well-traveled and important county road in Fife Lake Township.
• Lake Shore Drive is the only east-west paved road between the Wexford-Grand Traverse county
line and Fife Lake.
• It carries traffic between US 131 and roads south and east of Fife Lake.
• It provides access to a boat launch, a water point for fire department use, sanitary sewer
infrastructure and several public access sites on Fife and Pickerel Lakes.
• It provides sole access to approximately 115 residences either directly or from roads that
intersect it.
• The road is used by fishermen, ice fishermen, kayakers, boaters, hunters and tourists.
• It is used for bicycling, running, walking and dog walking.
• The road becomes the primary alternative route if there are problems on the Fife Lake
roundabout.
Lake Shore Drive is in critical need of repair.
• Lake Shore Drive was paved in 1979 and was chipped sealed around 2000. No other preventive
or routine maintenance has been done other than some patching of potholes. The road was
never crack sealed.
• Its PASER rating in 2013 was 3-4. Per the current Asset Management Plan, the appropriate
maintenance then would have been some milling followed by sealcoat or thin overlay.
• Due to lack of appropriate maintenance the road deteriorated to a 1-2 PASER rating in 2014 and
now needs a total reconstruction, at least in the developed section between the state forest
stretch and Grand Kai Road. Road Commission staff has estimated the total cost to rehabilitate
that section of approximately 1.17 miles to be $735,531.
• The condition of the road is especially hazardous to pedestrians and bikers due to the extensive
cracking at the edges.
• The poor condition of the road contributes to serious flooding problems near the east end of the
road near its intersection with Evergreen.
Funding needs to be determined.
• At least as far back as the 2016 levy renewal campaign, the GTCRC published a list of projects
titled "Projected 2017-2022 Priority Improvement Projects (primarily funded by Millage)" that
included Lake Shore Drive.
• Since the passage of the millage renewal in 2016 the GTCRC has completed 7 local road
projects that appear on that list (Strait, Bluff, North Arbutus, Prouty and 4 Mile Roads and two
sections of Potter Road) and one other local road project (Silver Pines Road).
• All 8 of those projects were 100% funded without local contribution other than the millage -
five were funded primarily by millage funds supplemented with county MTF funds, and the
other three were funded by unrestricted funds received from the State of Michigan.
• During the first term of the millage (2014-2016} three other county local road projects were
completed, also all 100% funded by millage and MTF funds with no local contribution (Hoch,
Harris and Herkner Roads).
• Road Commission staff has advised us that no millage funds can be used to fund local road
projects, although no such limitation appears in the millage language or the Asset Management
Plan and that is contrary to the representations contained in the project list and the GTCRC's
actua I practice.
• In any event the GTCRC should honor the Priority Improvement Projects list which was
published before the Asset Management plan was submitted; that list should be incorporated
into the Asset Management Plan.
• Lake Shore Drive should be funded 100% from millage funds supplemented by MTF funds or
from unrestricted funds the same as was done for all of the other local roads on the list.
• If the Commission is reluctant to do that, it should consider designating Lake Shore Drive a
county primary road.
• If a local contribution is deemed appropriate it should be based on the cost of the chip sealing
as was contemplated when the project was originally added to the Projected 2017-2022
Priority Improvement Projects (primarily funded by Millage) list. The township should not be
penalized because the road was allowed to deteriorate to the point that reconstruction is
necessary.

7:00 PM- Was canceled. 7: 15 PM - John Nelson, CARS - Concerned that East/West Corridor leads to a bridge. He doesn't feel funds should be spent on a study, when that money can go to fixing up the roads. The money that has been spent on the study should have went to preserving a road.
Kluczynski spoke of the error in the amount of money spent. He also stated that part of the study indicated that most people were in favor of a bridge. This study is to determine if our area warrants this bridge and if it would be the best option. This will be determined by the consultants that the GTCRC has no affiliation with.
Gillman stated that we need to play by the rules and that is what we are doing.
McKellar added that to have State/Federal funding, we have to go through the PEL Process.

D. Employee Survey Results Jennifer Ewing gave the results of the employee survey results. We are almost at a I -point increase of the average score from last year. There were 31 participants in 2020 and 35 in 2019, but 2019 included seasonal employees. Although overall it was a positive upward trend, we still have room for improvement.

J. Signal Optimization Discussion Kluczynski stated that Avery is really busy with permits. She will come in on a couple Saturdays to get this done. She has had a lot of discussions with people at Siemens and she knows what is going on. Should all happen pretty quickly at each intersection. A few more detection cameras that need to be installed.
Kluczynski stated that Siemens now has a State of Michigan Rep to help support with SCOOT. He will be staying in this region, so he will be able to give us a lot of assistance. OHM still owes us a drive thru after. Marek questioned the time frame. Kluczynski figured detection would be done by the end of the year. With installing in February.
Kluczynski also spoke of some unwiring of Logan's Landing. When this is all said and done, the light will be back in active mode.
Kluczynski stated that OHM has talked about reconstruction of some intersections. South Airport and Silver Lake intersection, Silver Lake and Zimmerman also, and some potential lane additions. They will configure when they come back.
7. INFORMATIONAL ITEMS A. Manager's Comments Kluczynski stated that we had an elderly lady hit one of our workers on Wednesday. The worker was checked out and is okay. The police let her go, so we are working with the Post Responder in Cadillac as to the way it was handled. Macomb County had a worker killed in a hit and run. He believes this is the first fatality this year in Michigan for a Road Commission.
B. Commissioners' Comments, Questions and Future Agenda Items Brown asked about a Special Meeting. It was decided a Special Meeting will happen on Tuesday, September 29th at 7:30AM. The topics will be Millage and Assent Management.
Mouser commented that we need to get word out on millage, as ballots are already out.
McKellar asked where we were on Phase 11. K.luczynski said they have started, with us continually monitoring and reporting back to commission on a bimonthly basis or more frequent if needed. They are collecting data on plant life throughout the valley and we have some data too.
Marek and Gillman had no further comment.
8. PUBLIC COMMENT Dan Olson, 14795 Mallard Drive - spoke on Bluff Road. He appreciates what we do. He feels the community has lost some confidence in the road commission. He recalls early on when this came about, we said repairs would be coming, but dependent on the weather. He feels it has shifted from fixing to abandonment. He feels it warrants more attention.
McKellar stated he appreciated Mr. Olson's and that he is in support of his suggestion of getting the parties together.

Brandon from K wik Print came in to discuss the Millage pamphlet.
McKellar and Gillman both stated that we can not "Target" residents. It is informational only.
McKellar suggested that we put the information out all online. Facebook, Record-Eagle, The Ticker, our website, etc.
Marek suggested we mailout the pamphlet to every door.
Gillman stated he is not interested in spending a lot of taxpayer's funds toward this. He suggested doing a video of our crews working and of contractors working on our roads and post this to our webpage and Facebook He agreed to do this on his time and free of charge.
All Commissioners agreed that mailing the pamphlets would not be beneficial.
Motion by McKellar, seconded by Mouser to approve a budget of $10,000 for Educational Information. This will be disseminated through Record Eagle, Ticker, UpNorth Live, YouTube and Facebook, and using organic materials created by commissioners under volunteered time as well as what we currently have for our millage projects; drones, etc. ROLL CALL VOTE: YEAS: Mouser, McKellar NAYS: Marek, Gillman ABSENT: Brown NOT CARRIED

B. Asset Management Plan Kluczynski stated this is just for informational purposes, but feels we need to set up a work session in the near future. The last few years we have done good with projects. We need to continue to follow through with this. We need to explain the Asset Management Plan (website, Facebook, oral, etc.) and why certain roads get selected and others that do not.
Gillman stated that the public needs to understand that we are preparing for the next generation. It is clear that we are a growing region. He mentioned back to Mouser's comment on the radio, we should have done this 20 years ago.
Kluczynski stated again that everyone needs to communicate that this is all based on the Asset Management Plan. The roads that are repaired are due to the Asset Management Plan.
McKellar stated that the local roads are improving. Townships are starting to match our contribution.
A Work Session for the Asset Management Plan is scheduled for Wednesday, October 14th at 7:00 PM.
C. Traffic Signal SCOOT Kluczynski stated we had spoken about this previously. The controllers will be installed and then next phase would be SCOOT as the overlay that actually controls them. At this point, we have twenty intersections. They are purchased in packages of ten. Additional costs per lots of ten.
The cost of this is for the 20 intersections. It has a new interface, which was not included with the previous version. This allows us more accuracy. This also includes installation, training and 5 years of annual support.
Marek questioned the timeline. Will we be ready in a year? Kluczynski thinks it would be five or six months, for SCOOT to be self-sufficient.

McKellar wanted to state that he feels the Board made an error by calling the East/West Corridor a Study. It should have been called a Strategy.
Marek commented that he feels it is a study. If it was a strategy, he feels it would be perceived that we had a plan in advance. He feels from that study, the strategy is the plan of SCOOT and Roundabouts.

MANAGER'S REPORT
STAFF REPORT FOR THE MEETING OF OCTOBER 22, 2020
COVID-19: The ongoing changes are still being implemented by the Manager, Financial Manager, Account Clerk, and HRP. As new developments occur, the staff has been meeting as necessary with the Field Crew to assure that they are kept in the loop. In addition, changes to operations continue to be finetuned to alleviate concerns of the staff.
With the court ruling, staff has been scrambling to keep up with new rules from the State Health Department and MIOSHA. Combined, they have produced rules that essentially replace all of the Governor's executive orders, with minor modifications.
Staffing:
The new receptionist position has been filled by Katrina McGinnis. She has much to learn, but we expect her to be a long-term asset to the GTCRC.
The GTCRC has separated employment with one Automotive Technician, but will not be filling the position immediately. Our Fleet and Facilities Manager is evaluating how the position will be filled so that the individual can help coordinate facilities maintenance through out the year.
Team Building, Relationship Building/Image Improvement: (HRP to assist): The GTCRC has formed four cross departmental action teams to work toward helping address concerns indicated in the Annual Employee Satisfaction Survey. It is hoped that these teams can assist the Manager in determining solutions that work for the entire GTCRC.
The long-abandoned Safety Committee has be reformed with representatives from through out the organization. After experiencing a rise in concerns from different employees about safety concerns, the committee was formed to address safety through out the entire organization. On a separate note, the GTCRC was awarded $500 from MCRISP for a safety grant, which will be used to help jump start the Safety Committee in its mission.
• Staff Meetings - Each unit holds monthly staff meetings and will present to the field crew an update of what the unit is currently working on. We have postponed returning to normal briefings until September.
" Interdepartmental Projects - We continue with success to work on more joint-projects where our staff works together (field staff and engineering, etc.) in addition to maintenance activities and engineering projects. Discussions between the entire staff will be expanded over the winter to review additional interaction and possible changes in both Engineering and Field to provide better interaction between the two. With the implementation of the new Computerized Maintenance Management System (CMMS), we anticipate a much higher level of interaction between Departments.
• The Field supervisory staff and HRP are working on a more comprehensive training program that will provide a framework for all field staff the opportunity to advance during their career with the GTCRC. The first round of tests has been administered and based on results modification are being made. One employee was successfully advanced to the next level of the equipment operator tier.
Facilities Management: Substantial work on the corridor between the Admin and Field building has been in progress. The old heating tube which ran underground and was the cause of substantial basement flooding has been filled with flowable concrete fill, and a new space heater for the corridor has been installed. The flooring is still in need of repair, and will be completed before year end.
There will be several additional projects that will be discussed during the upcoming budget meetings, as the facilities are starting to show signs of age. As we move forward with the Kingsley Facilities, some of the subcontractors may be utilized to perform replacements or repairs on the Traverse City Facilities also.
Meetings and the Public: The Manager and the Engineering staff met with 3 townships to speak generally about roads. The remainder of the meetings had been placed on hold. With the reopening of the area to public meetings, we are beginning to schedule meetings with each of the remaining townships.
Meetings and the Media: The manager has been speaking to local media outlets regularly about the millage, and our electronic footprint for the milling is now quite substantial. The manager has also spoke to Townships and many citizens and citizen groups to keep spreading the message.
Local Emergency Planning Committee (LPT/LEPC): These meetings have either been placed on hold, or are held electronically, and are mainly focused around dealing with COVID.
Grand Traverse County: "Mutual Aid Agreements" are still being pursued. This will be brought to the board for discussion and approval when they are complete.
Signal Maintenance County-wide: The GTCRC, and MDOT are working closely to coordinate response for signals. At this time, Traverse City has agreed to work with Windemuller for one year, at which point, we will be in a better spot to sign an agreement with the City. The Signal Tech, has also already been working with lVlDOT through their system upgrade.

Grand Traverse County Road Commission has implemented ArcGIS Online. This software is a webbased mapping software that will allow Office Staff and Field Staff to have geospatial information on any web-enabled device. ArcGIS is also being used to convert existing Roadsoft data to ArcGIS Maps. Roadsoft is the engineering software that has been used for many years at GTCRC.
o GTCRC is converting Roadsoft data to geodatabase feature class and putting the data through quality control\quality assurance (QA\QC) procedures.

ENGINEERING REPORT State and Federal Aid Projects: " Garfi e ld Road, Hammond to South Airport (Smal l Urban Program funding) and Three Mile Rd, South Airport
Road to Parsons Road (Category F funding): Project close-out is in progress. Final payment estimate is being developed now that final payrolls have been received. (Contractor - Rieth-Riley Construction Company; Contract Bid -$956,077.30.)
• River Road Bridges (SN's 3060 and 3061) and S. Garfield Road Bridge (SN 3069) over the Boardman River: The VE proposal for the Garfield Rd bridge that proposed replacing this structure this fall with a change in traffic control to a full detour has been denied. They are still proposing eliminating the steel beam rehab in lieu for new beams that will be galvanized as required and we are acceptable to that and are reviewing associated shop drawings. Additional VE proposals may be presented for the River Rd bridges in the near future. A Schedule and Pre-Con have yet to be set. (Contractor - Davis Construction, bid of$2, 704,589.51. State and Federal funding is capped at $990,660. The project has an Open-to-Traffic and Final Completion dates of October 1 and October 30, 2021.)

SHOP REPORT • All winter maintenance trucks have been inspected and repaired. Half of the fleet has sanders and wings
installed and are calibrated for winter. As Fall projects finish up, we will continue to switch over trucks, with the intention of being completed by November 1.
• The CAT Excavator is here and in operation. We have received great feedback and are very happy with it. • The 3 new 2021 Western Stars are here. We went through and did upgrades before sending off to Truck
and Trailer. • There were three 2020 trucks at Truck and Trailer. One truck has been back and operational. The other 2
are ready to be picked up for winter operations. • We are continually working to make sure we have supplies for janitorial needs, due to COVID-19.

The following is an expanded update from the October 22, 2020 Board Meeting Staff Report generated October 14th:
A meeting was held with the Drain Commissioner and new consultant, Jennifer Hodges, GFA, and GTCRC staff on September 29th. Discussions of the County-At-Large (14A) estimated price and that the GTCRC share will be 50% of the county apportionment. Additionally, the GTCRC is responsible for the supplemental cost of additional road design cost. See supporting documentation attached.
Division I and II bids were opened by the Drain Commissioner on September 30th at the Garfield Township Office with two bidders submitting. Team Elmer’s submitted a Confirmed Low Bid of $1,406,191.30. (Molan Excavating submitted a bid at $1,498,969.21.) Division II includes a 10’ x 7’ concrete box culvert replacement under Cass Road. A schedule has not been provided at this time.
The Day of Review of Apportionments was held October 8.
After Day of Review, the Drain Commissioner set the roll at $2,838,000.00 for this Division 1 and II project. The GTCRC are responsible for the following costs:
• Supplemental (Road Design Cost): $ 50,000.00 • 50% of the County-At-Large (14-A, $135,335.20 ): $ 67,667.60• Total: $137,667.60
It is anticipated at this time that an invoice will be sent in November or December.
Division III, which is the enclosed storm drain, micro drains and road work including widening to three lanes with a center-left turn lane continuous to Hartman Rd, is under review by GFA. They will be reviewing the developed plans from Spicer Group over the course of the winter and will share results with the GTC Drain Commissioner in the early spring. It is anticipated that the DC will have further discussions with the Township and GTCRC on how to move forward. If construction is pursued, earliest construction would occur in 2022 depending on Division III going through a new SAD process.

WHEREAS, the Cass Road Drain ("Drain") is a county drain located in the County of Grand Traverse, and established pursuant to the Michigan Drain Code, Public Act 40 of 1956, as amended (the "Drain Code"); and
WHEREAS, Section 327 of the Drain Code authorizes a county board of road commissioners to file a petition with the Drain Commissioner for the cleaning out, widening, deepening, straightening or extending of the drain if the drain is necessary for the construction or maintenance of any highway to take the surplus water across adjacent lands; and
WHEREAS, the cleaning out, widening, deepening, straightening or extending of the Cass Road Drain is necessary to address road drainage issues in the Cass Road Drain Drainage District to take surplus water across adjacent lands, and is also necessary and conducive to the public health, convenience or welfare.

The undersigned petitioner is the County Board of Road Commissioners for the County of Grand Traverse, State of Michigan, and does hereby petition for cleaning, widening, deepening, straightening or extending of a drain known and designated as the Cass Road Drain located and established in the County of Grand Traverse.
The petitioner further shows that this petition has been authorized by its governing body and that said cleaning out, widening, deepening, straightening or extending of the county drain is necessary for the construction or maintenance of a highway, to wit: Cass Road. A copy of the Resolution of the Board of County Road Commissioners is attached hereto.

MARKET CONDITIONS
The subject's Market conditions in the northern Michigan area have been softening over the past 18-24 months due to the relatively slow
statewide economy. With interest rates rising slightly,rates still appear attractive around 4.5%-5% for 15-30 year fixed without points.
Homes generally sell at about 96% of list price with seller concessions becoming more prevalent. This market is somewhat seasonal with
more of the sales occurring during the warm season.
ADVERSE SITE CONDITIONS AND/OR EXTERNAL FACTORS
Private water & sewer systems are common to the outlying neighborhoods,while some of the suburban areas have municipal
water/sewer(private wells and septics are also common). This area is not prone to flooding,and no adverse conditions were observed at
the time of the inspection.
SALES COMPARISON APPROACH
Data Gathering:
The comparables selected were from the Traverse Area Association of Realtors MLS system, local realtors, and/or other reliable source/s
for sold data. The original source of the comparable described in the Data Source section of the market grid along with the source of
confirmation, if available. The original source is presented first. The sources and data are considered reliable. When conflicting
information was provided, the source deemed most reliable has been used. Data believed to be unreliable was not included in the report
or used as a basis for the value conclusion. The extent of the analysis applied to this assignment is stated in the Scope of Work above,
and in the Appraiser's Certification on Freddie Mac form 239, dated 3/05 and Fannie Mae form 1004B, dated 3/05.
Sales in and beyond the subject's neighborhood with some similar style/design and/or features when compared to the subject, were
viewed. The comparable selection was bracketed by price/value, acreage,and quality, to more accurately reflect the value range for the
subject. The subject's market being in the [mainly rural & suburban] Grand Traverse region with many specialty &/or recreational
properties, it is not uncommon for comparables to be more than the preferred mile away or over 6 months old. Upon a thorough search
of all available market data, it was determined that the comparables used are the most recent and similar data available at this time.
RECONCILIATION OF DATA AND SUBJECT"S VALUE
The comparables have adjusted values ranging from $26,500 to $43,500 , . It is felt that the subject would have a most probable
price/market value of $35,000 which is supported by the adjusted values of the comparables.

DEFINITION OF MARKET VALUE: The most probable price which a property should bring in a competitive and open market
under all conditions requisite to a fair sale, the buyer and seller, each acting prudently, knowledgeably and assuming the price is not
affected by undue stimulus. Implicit in this definition is the consummation of a sale as of a specified date and the passing of title from
seller to buyer under conditions whereby: (1) buyer and seller are typically motivated; (2) both parties are well informed or well
advised, and each acting in what he considers his own best interest; (3) a reasonable time is allowed for exposure in the open market;
(4) payment is made in terms of cash in U.S. dollars or in terms of financial arrangements comparable thereto; and (5) the price
represents the normal consideration for the property sold unaffected by special or creative financing or sales concessions* granted by
anyone associated with the sale.
*Adjustments to the comparables must be made for special or creative financing or sales concessions. No adjustments
are necessary for those costs which are normally paid by sellers as a result of tradition or law in a market area; these
costs are readily identifiable since the seller pays these costs in virtually all sales transactions. Special or creative
financing adjustments can be made to the comparable property by comparisons to financing terms offered by a third party
institutional lender that is not already involved in the property or transaction. Any adjustment should not be calculated on
a mechanical dollar for dollar cost of the financing or concession but the dollar amount of any adjustment should
approximate the market's reaction to the financing or concessions based on the appraiser's judgement.
STATEMENT OF LIMITING CONDITIONS AND APPRAISER'S CERTIFICATION
CONTINGENT AND LIMITING CONDITIONS: The appraiser's certification that appears in the appraisal report is subject to the
following conditions:
1. The appraiser will not be responsible for matters of a legal nature that affect either the property being appraised or the title to it.
The appraiser assumes that the title is good and marketable and, therefore, will not render any opinions about the title. The property
is appraised on the basis of it being under responsible ownership.
2. The appraiser has provided a sketch in the appraisal report to show approximate dimensions of the improvements and the sketch
is included only to assist the reader of the report in visualizing the property and understanding the appraiser's determination of its
size.
3. The appraiser has examined the available flood maps that are provided by the Federal Emergency Management Agency (or other
data sources) and has noted in the appraisal report whether the subject site is located in an identified Special Flood Hazard Area.
Because the appraiser is not a surveyor, he or she makes no guarantees, express or implied, regarding this determination.
4. The appraiser will not give testimony or appear in court because he or she made an appraisal of the property in question, unless
specific arrangements to do so have been made beforehand.
5. The appraiser has estimated the value of the land in the cost approach at its highest and best use and the improvements at their
contributory value. These separate valuations of the land and improvements must not be used in conjunction with any other appraisal
and are invalid if they are so used.
6. The appraiser has noted in the appraisal report any adverse conditions (such as, needed repairs, depreciation, the presence of
hazardous wastes, toxic substances, etc.) observed during the inspection of the subject property or that he or she became aware of
during the normal research involved in performing the appraisal. Unless otherwise stated in the appraisal report, the appraiser has no
knowledge of any hidden or unapparent conditions of the property or adverse environmental conditions (including the presence of
hazardous wastes, toxic substances, etc.) that would make the property more or less valuable, and has assumed that there are no
such conditions and makes no guarantees or warranties, express or implied, regarding the condition of the property. The appraiser will
not be responsible for any such conditions that do exist or for any engineering or testing that might be required to discover whether
such conditions exist. Because the appraiser is not an expert in the field of environmental hazards, the appraisal report must not be
considered as an environmental assessment of the property.
7. The appraiser obtained the information, estimates, and opinions that were expressed in the appraisal report from sources that he
or she considers to be reliable and believes them to be true and correct. The appraiser does not assume responsibility for the
accuracy of such items that were furnished by other parties.
8. The appraiser will not disclose the contents of the appraisal report except as provided for in the Uniform Standards of Professional

APPRAISER'S CERTIFICATION: The appraiser certifies and agrees that:
1. I have researched the subject market area and have selected a minimum of three recent sales of properties most similar and
proximate to the subject property for consideration in the sales comparison analysis and have made a dollar adjustment when
appropriate to reflect the market reaction to those items of significant variation. If a significant item in a comparable property is
superior to, or more favorable than, the subject property, I have made a negative adjustment to reduce the adjusted sales price of the
comparable and, if a significant item in a comparable property is inferior to, or less favorable than the subject property, I have made a
positive adjustment to increase the adjusted sales price of the comparable.
2. I have taken into consideration the factors that have an impact on value in my development of the estimate of market value in the
appraisal report. I have not knowingly withheld any significant information from the appraisal report and I believe, to the best of my
knowledge, that all statements and information in the appraisal report are true and correct.
3. I stated in the appraisal report only my own personal, unbiased, and professional analysis, opinions, and conclusions, which are
subject only to the contingent and limiting conditions specified in this form.
4. I have no present or prospective interest in the property that is the subject to this report, and I have no present or prospective
personal interest or bias with respect to the participants in the transaction. I did not base, either partially or completely, my analysis
and/or the estimate of market value in the appraisal report on the race, color, religion, sex, handicap, familial status, or national origin
of either the prospective owners or occupants of the subject property or of the present owners or occupants of the properties in the
vicinity of the subject property.
5. I have no present or contemplated future interest in the subject property, and neither my current or future employment nor my
compensation for performing this appraisal is contingent on the appraised value of the property.
6. I was not required to report a predetermined value or direction in value that favors the cause of the client or any related party, the
amount of the value estimate, the attainment of a specific result, or the occurrence of a subsequent event in order to receive my
compensation and/or employment for performing the appraisal. I did not base the appraisal report on a requested minimum valuation,
a specific valuation, or the need to approve a specific mortgage loan.
7. I performed this appraisal in conformity with the Uniform Standards of Professional Appraisal Practice that were adopted and
promulgated by the Appraisal Standards Board of The Appraisal Foundation and that were in place as of the effective date of this
appraisal, with the exception of the departure provision of those Standards, which does not apply. I acknowledge that an estimate of a
reasonable time for exposure in the open market is a condition in the definition of market value and the estimate I developed is
consistent with the marketing time noted in the neighborhood section of this report, unless I have otherwise stated in the reconciliation
section.
8. I have personally inspected the subject property and the exterior of all properties listed as comparables in the appraisal report. I
further certify that I have noted any apparent or known adverse conditions on the subject site, or on any site within the immediate
vicinity of the subject property of which I am aware and have made adjustments for these adverse conditions in my analysis of the
property value to the extent that I had market evidence to support them. I have also commented about the effect of the adverse
conditions on the marketability of the subject property.
9. I personally prepared all conclusions and opinions about the real estate that were set forth in the appraisal report. If I relied on
significant professional assistance from any individual or individuals in the performance of the appraisal or the preparation of the
appraisal report, I have named such individual(s) and disclosed the specific tasks performed by them in the reconciliation section of
this appraisal report. I certify that any individual so named is qualified to perform the tasks. I have not authorized anyone to make a
change to any item in the report; therefore, if an unauthorized change is made to the appraisal report, I will take no responsibility for it.
SUPERVISORY APPRAISER'S CERTIFICATION: If a supervisory appraiser signed the appraisal report, he or she certifies and

COMMITMENT CONDITIONS
1. DEFINITIONS (a) "Knowledge" or "Known": Actual or imputed knowledge, but not constructive notice imparted by the
Public Records. (b) "Land": The land described in Schedule A and affixed improvements that by law constitute real
property. The term "Land" does not include any property beyond the lines of the area described in Schedule A, nor any right, title, interest, estate, or easement in abutting streets, roads, avenues, alleys, lanes, ways, or waterways, but this does not modify or limit the extent that a right of access to and from the Land is to be insured by the Policy.
(c) "Mortgage": A mortgage, deed of trust, or other security instrument, including one evidenced by electronic means authorized by law.
(d) "Policy": Each contract of title insurance, in a form adopted by the American Land Title Association, issued or to be issued by the Company pursuant to this Commitment.
(e) "Proposed Insured": Each person identified in Schedule A as the Proposed Insured of each Policy to be issued pursuant to this Commitment.
(f) "Proposed Policy Amount": Each dollar amount specified in Schedule A as the Proposed Policy Amount of each Policy to be issued pursuant to this Commitment.
(g) "Public Records": Records established under state statutes at the Commitment Date for the purpose of imparting constructive notice of matters relating to real property to purchasers for value and without Knowledge.
(h) "Title": The estate or interest described in Schedule A.
2. If all of the Schedule B, Part I-Requirements have not been met within the time period specified in the Commitment to Issue Policy, this Commitment terminates and the Company's liability and obligation end.
3. The Company's liability and obligation is limited by and this Commitment is not valid without: (a) the Notice; (b) the Commitment to Issue Policy; (c) the Commitment Conditions; (d) Schedule A; (e) Schedule B, Part I-Requirements; [and] {f) Schedule B, Part II-Exceptions; and (g) a counter-signature by the Company or its issuing agent that may be in electronic form].
4. COMPANY'S RIGHT TO AMEND The Company may amend this Commitment at any time. If the Company amends this Commitment to add a defect, lien, encumbrance, adverse claim, or other matter recorded in the Public Records prior to the Commitment Date, any liability of the Company is limited by Commitment Condition 5. The Company shall not be liable for any other amendment to this Commitment.
5. LIMITATIONS OF LIABILITY (a) The Company's liability under Commitment Condition 4 is limited to the Proposed lnsured's actual
expense incurred in the interval between the Company's delivery to the Proposed Insured of the Commitment and the delivery of the amended Commitment, resulting from the Proposed lnsured's good faith reliance to: (i) comply with the Schedule B, Part I-Requirements; (ii) eliminate, with the Company's written consent, any Schedule B, Part II-Exceptions; or (iii) acquire the Title or create the Mortgage covered by this Commitment.
(b) The Company shall not be liable under Commitment Condition 5(a) if the Proposed Insured requested the amendment or had Knowledge of the matter and did not notify the Company about it in writing.
(c) The Company will only have liability under Commitment Condition 4 if the Proposed Insured would not have incurred the expense had the Commitment included the added matter when the Commitment was first delivered to the Proposed Insured.
(d) The Company's liability shall not exceed the lesser of the Proposed lnsured's actual expense incurred in good faith and described in Commitment Conditions 5(a)(i) through S(a)(iii) or the Proposed Policy Amount.

this Commitment. (c) Until the Policy is issued, this Commitment, as last revised, is the exclusive and entire agreement
between the parties with respect to the subject matter of this Commitment and supersedes all prior commitment negotiations, representations, and proposals of any kind, whether written or oral , express or implied , relating to the subject matter of this Commitment.
(d) The deletion or modification of any Schedule B, Part II-Exception does not constitute an agreement or obligation to provide coverage beyond the terms and provisions of this Commitment or the Policy.
(e) Any amendment or endorsement to this Commitment must be in writing [and authenticated by a person authorized by the Company].
(f) When the Policy is issued, all liability and obligation under this Commitment will end and the Company's only liability will be under the Policy.
7. IF THIS COMMITMENT HAS BEEN ISSUED BY AN ISSUING AGENT The issuing agent is the Company's agent only for the limited purpose of issuing title insurance commitments and policies. The issuing agent is not the Company 's agent for the purpose of providing closing or settlement services.

1. The Proposed Insured must notify the Company in writing of the name of any party not referred to in this Commitment who will obtain an interest in the Land or who will make a loan on the Land. The Company may then make additional Requirements or Exceptions.
2. Pay the agreed amount for the estate or interest to be insured.
3. Pay the premiums, fees, and charges for the Policy to the Company.
4. Documents satisfactory to the Company that convey the Title or create the Mortgage to be insured, or both, must be properly authorized, executed, delivered, and recorded in the Public Records.
5. You must tell us in writing of anyone not referred to in this Commitment who will get an interest in the land or who will make a loan on the land. We may then make additional requirements or exceptions.
6. Provide evidence of payment of all special assessments due hereunder.
7. Provide evidence of payment of all taxes due.
8. In order to issue the subject policy, the following item is required: Owner's Affidavit.
9. For each policy to be issued as identified in Schedule A, Item 2; the Company shall not be liable under this commitment until it receives a designation for a Proposed Insured, acceptable to the Company. As provided in Commitment Condition 4, the Company may amend this commitment to add, among other things, additional exceptions or requirements after the designation of the Proposed Insured.
In the event Corporate Settlement Solutions does not close the mortgage transaction, the recording of the insured Mortgage must be within 30 days of execution of the respective Mortgage, or the following exception will be shown on the final policy: Loss of priority or validity of the insured Mortgage arising out of any Bankruptcy of the Mortgagor.

WHEREAS. said quit-claim deeds provided that title to the above described lands shall revert to the State of Michigan if not used for Municipal Forest purposes; and
W. EREAS, cL45 , ublic cts.of 1994, as ameAded, Sectio 52!06 (MCL 3 4.52706), authorizes the Directo of tne apartment of Natura Resources to release tfie aforementioned reverfer restrictions.
NOW THEREFORE, the State of Michigan, by its Department of Natural Resources, in consideration of the promises set forth below, hereby RELEASES its possibility of reverter in the above-described property to Grantee and its successors and assigns.
As required by MCL 324.52706, Grantee, by accepting this deed, promises to: (AJ not convey the Property any time after June 6, 2010, un ess the conveyance is approved by the Granter; (B) not convey the Property for less than fair market value; and (C) submit 50% of the proceeds to the Michigan Department of Treasury, unless the Property is conveyed to another public agency.
If, before June 6, 201 O the Property is conveyed by the Grantee, the Grantee shall notify the Granter within 60 days of the conveyance. Notice of the conveyance shall be in a form prescribed by the Granter.
The Grantee shall not convey the Property to a third person unless the Grantee has conducted a public hearing on tbe proposed conveyance. The Grantee may conduct a second public hearing on the proposed conveyance if the Grantee determines that a second public hearing may be necessary. Notice of this public hearing shall be published at least twice in a newspaper of general circulation in the county or counties where the Property is located, not more than 28 or less than 7 days before the hearing. The notice shall describe where the Property is located, specify the approximate size of the Property, describe its current use, and identify the person to whom the Property is proposed to be sold, if known.
In granting this release, the Grantor does not release or convey to Grantee any right, title, or interest in coal, oil, gas, or other minerals, aboriginal antiquities, or ingress and egress to watercourses that Granter may have previously reserved in the above-described land.

Purpose: The purpose of the easement Is to grant Consumers the right to enter Owner's Land to construct, operate, inspect, maintain, replace, improve, remove, and enlarge overhead and underground electric lines on the Easement Area for transmitting and distributing electrical energy and communications signals. overhead electric lines may consist of poles, anchors, guys, wires, cables (including fiber-optic cable), transformers, and other equipment. Underground electric lines may consist of underground cables (including fiber-optic cable), conduits, wires, conductors, subsurface junction vaults, surface-mounted transformers and enclosures with pads and supports, and other equipment.
Trees and Other Vegetation: Consumers shall have the right from time to time hereafter to enter Owner's Land to trim, cut down, and otherwise remove and control any trees, brush, roots, and other vegetation, whether inside or outside the Easement Area, that Consumers believes may interfere with the construction, operation, and maintenance of the electric lines.
Buildings/Structures: Owner shall not: 1) locate any buildings, structures, septic systems, drain fields, ponds, or swimming pools within the Easement Area, 2) plant any trees within the Easement Area, or 3) change the ground elevation over the underground electric lines or under the overhead electric lines. If Owner violates this provision, Owner shall reimburse Consumers for any expenses Consumers incurs correcting the violation. If Consumers corrects the violation by relocating the electric lines on Owner's Land, this easement shall automatically apply to such relocated line(s).
Exercise of Easement: Consumers' nonuse or limited use of this Easement shall not preclude Consumers' later use of this Easement to its full extent.

Buildings/Structures: Owner shall not: 1) locate any buildings, structures, septic systems, drain field~, ponds, or swimming pools within the Easement Area, 2) plant any trees within the Easement Area,. or 3) change 1he ground elevation over the underground electric lines or under the overhead electric lir,~ . .If OWner violates this provision, Owner shall reimburse Consumers for any expenses Consumera incurs correcting the violation. tt Consumers corrects the violation by relocating the electric lines on Owner's Land, this easement shall automatically apply to such relocated line(s).
Exercise of Easement: Grantee's nonuse of llmlted use of this Easement shall not preclude Grantee's later use ·of this Easement to lts fullest extent · ·
