For the #rit of certiorari under Rule 5 of the Rules of ourt to issue, a petitioner must

sho# that he has no plain, speed% and ade2uate remed% in the ordinar% "ourse of la# against

its per"ei*ed grie*an"e&--' A remed% is "onsidered plain, speed% and ade2uate if it #ill

 promptl% relie*e the petitioner from the injurious effe"ts o f the judgment and the a"ts of thelo#er "ourt or agen"%&-1' In this "ase, appeal #as not onl% a*aila!le !ut also a speed% and

ade2uate remed%

O!*iousl%, <IA interposed the present spe"ial "i*il a"tion of certiorari not !e"ause it is

the speed% and ade2uate remed% !ut to ma=e up for the loss, through omission or o*ersight, of 

the right of ordinar% appeal It is elementar% that the spe"ial "i*il a"tion of certiorari is not and

"annot !e a su!stitute for an appeal, #here the latter remed% is a*aila!le, as it #as in this

ruling of the ar!itral tri!unal on a preliminar% 2uestion upholding or de"lining its

Indeed, it is in the !est interest of justi"e that in the enfore"ement of a

foreign ar!itral a#ard, #e den% a*ailment !% the losing part% of the rule that !ars foreign

"orporations not li"ensed to do !usiness in the 6hilippines from maintaining a suit in our 

"ourts When a part% enters into a "ontra"t "ontaining a foreign ar!itration "lause and, as in

this "ase, in fa"t su!mits itself to ar!itration, it!e"omes !ound !% the "ontra"t, !% the

ar!itration and !% the result of ar!itration, "on"eding there!% the "apa"it% of the other part% to

insofar as the re"ognition and enfor"ement of a foreign ar!itral a#ard is "on"erned

 

Second. Respondent "annot fault petitioner for not filing a motion for

ha*e, time and again, ruled that the prior filing of a motion for re"onsideration is not re2uired
