Preface

The Administrative Report of the Excise Department for the year 2012-13 is ready forpublication. The present report precisely deals with various activities of the Excise Directorate duringthe period, both in qualitative and quantitative terms.

The operation of Excise Directorate centres around enforcement of regulations relating tomanufacture, production, possession, distribution, transport and sale of liquor and other intoxicants.This Directorate strives to achieve the dual need of prevention, manufacture, supply and distributionof illicit/counterfeit/spurious/non-duty paid liquor and achieving the full potential of revenue of theState.

During the year of reporting, special emphasis was laid on preventive activities, e-governanceand re-organization of Excise Directorate. As a result of intensified preventive activities, 4745 personswere arrested for committing excise offences. The quantity of seizure of illicit liquor was 11.20 lakhlitres to 36.17 lakh litres. The quantity of fermented wash seized was 94.4 lakh litres against 100.8lakh litres in the previous year.

In the financial year 2012-13, collection of Excise Revenue was ` 2609.81 crores. This is notonly 24.16% higher than the last year’s collection of ` 2101.95 crores but also 95% of the revisedtarget of revenue set for the Directorate to achieve in 2012-13.

The number of services rendered by the Excise Directorate are now rendered electronically aspart of e-governance of this Directorate. Implementation of modules for issuing import permits forbulk spirit, packaged foreign liquor; industrial and medicinal spirit, manufactured drugs and labelregistration modules have been put in place. Collection of revenue is monitored on day-to-day basisthrough GRIPS. The daily reports on preventive activities are also monitored electronically.

Considering the increase in population of the State and also increase in the nature and extent ofexcise crimes, it was considered that the Excise Directorate be reorganized to cope up with thechallenges. The Excise Administration was reorganized and the operational area of Circles and Rangeswere diminished. As a result, the number of Circles, Ranges and Excise Districts increased. Steps forrecruitment in vacant posts have been taken. The Excise Act was amended to make the penal provisionsmore stringent. A new section in the Bengal Excise Act, 1909, viz. section 46AA was introduced inthe Act to increase the punishment of offences relating to adulteration of liquor and intoxicatingdrugs which may likely to cause disability or death to the people. Most of the offences under the Actwere made non-bailable.

In order to make supply of country spirit in tandem with the demand, licenses for new countryspirit bottling plants have been issued. New establishments of country spirit bottling have come up.‘In-principle-agreement’ to a number of applicants has been given for setting up of distilleries in theState.

It was considered that mere preventive activities cannot wipe out the excise crimes from thesociety. Unless the people are aware of consequences of Excise crime, effective prevention isconsidered almost impossible. During the year of reporting, mass awareness generation campaignwas taken up in all the districts.

Special emphasis was also laid on construction of excise buildings in different districts using theplan fund allocated for Excise Administration. Computers have been procured to equip the subordinateoffices for e-governance in the coming years.

This Administrative Report could be published through collective and sincere efforts of the staffof Excise Directorate. Although care has been taken to ensure accuracy in providing statisticalinformation, the possibility of error cannot be ruled out. Any suggestion to improve the report will bethankfully accepted for improving subsequent publications.

ADMINISTRATIVE SET-UP AND EXECUTIVE FIUNCTIONS

1. Acts AdministeredFollowing Acts and rules framed thereunder were administered during the period under report:(a) The Bengal Excise Act, 1909 (Ben. Act V of 1909),(b) The Narcotic Drug and Psychotropic Substances Act, 1985 (Central Act 61 of 1985),(c) The Medicinal and Toilet Preparations (Excise Duties) Act, 1955 (Central Act 60 of 1955)(d) The West Bengal Molasses Control Act, 1973 (W.B. Act VI of 1973).

2. Amendment in the Bengal Excise Act, 1909 upto 2012-13Necessary amendments have been made in the Bengal Excise Act, 1909 (Government Notification

No. 1137-L, Dated 2nd August, 2012) to make the penal provisions more stringent. A new section(Section 46 AA) has been introduced in the said act to increase the punishment of the offendersinvolved in adulteration of liquor or any intoxicating drug which is likely to cause disability anddeath to the people (punishment increased to imprisonment for life, or imprisonment of eitherdescription for a term which may extend to ten years and fine). Barring a few, all the offences underthe Bengal Excise Act were made non-bailable. In addition, fine and imprisonment in variouscontravening sections of the Bengal Excise Act have also been increased.

4. Establishment SectionEstablishment Section is headed by a Deputy Commissioner of Excise, Headquarter. He is assisted

by the Personal Assistant to the Excise Commissioner. It looks after the service matter of the employeesof all ranks in the Excise Directorate including the officers belonging to the West Bengal ExciseService. In addition, this section is also entrusted with the processing of applications regarding grantof all kinds of retail Excise License.

5. Distilleries & Warehouses SectionThe Section is headed by the Deputy Commissioner of Excise, Distilleries & Warehouses. He is

assisted by the Special Superintendent of Excise, Distilleries & Warehouses and the AdditionalSuperintendent of Excise, Distilleries & Warehouses. The Section looks after manufacture and supplyof Country Spirit in the State. The Section also monitors manufacture and supply of rectified spirit bythe distilleries of the State, regulates imports of rectified spirit for potable purpose and administersthe provisions of the W.B. Molasses Control (Regulation, Storage & Transport) Notified Order, 1986in the State, Compilation of different reports and returns in connection with consumption of intoxicantsand collection of revenue is entrusted to this Section. The purchase of excise opium for medicalpurpose and its distribution to all opium depots over the State through districts treasuries is done bythis Section. Regular meetings, conferences, seminars, etc. at the Excise Directorate are also arrangedby this section.

6. Law SectionLaw Section is headed by one Deputy Commissioner of Excise. He is assisted by one Special

Superintendent of Excise and one Addl. Superintendent of Excise. This Section is responsible forproper representation before different legal forums in cases where the department is a party and totake steps to defend and protect the interest of the department in such cases.

7. Foreign Liquor SectionThe Section is headed by the Deputy Commissioner of Excise, Foreign Liquor. He is assisted by

the Special Superintendent of Excise, Foreign Liquor. The Section looks after the manufacturing andsupply of Foreign Liquor in the State. This Section regulates import of ENA and other kinds of spiritrequired in the manufacturing of potable Foreign Liquor. The Section control export of India madeForeign Liquor and supply of the same out of India.

8. Organisation SectionThe Organisation Section is headed by the Deputy Commissioner of Excise, Organisation. He is

assisted by Special Superintendent of Excise, Organisation and the Administrative Officer.The Section looks after – among other matters – construction, repair, maintenance of Buildings,

Barracks, Warehouses, Lands of the Excise Department including their up-keeping etc. The Sectionalso oversees the supply of office furniture, apparatus, instruments, uniforms, stationeries and vehicles– both Government and hired.

Budget and allotment of fund to the outlying districts and organisations under the control ofExcise Directorate, which is essential for running the day to day administration is done from thisSection.

9. Excise DivisionsUnder the general control of the Excise Commissioner, West Bengal, there are now eight Excisedivisions – two in Jalpaiguri administrative division, three in Burdwan administrative division andthree in Presidency administrative division. Each such division is headed by a Deputy Commissionerof Excise. There shall be a striking force under the control of the Deputy Commissioner of Excise ineach Division. This striking force comprises of Superintendent of Excise, Additional Superintendentof Excise, and Deputy Excise Collector(s), Senior Sub-Inspector of Excise, Sub-Inspector of Excise,Assistant Sub-inspector of Excise and Excise Constables.

10. Narcotic CellNarcotic Cell is headed by a Deputy Commissioner of Excise. He is assisted by one Superintendent

of Excise and one Deputy Excise Collector. This Cell is entrusted for prevention and detection ofcrimes relating to Narcotic Drugs and Psychotropic Substances Act, 1985 and prosecution of offendersunder the Act.

11. Special SectionSpecial Section is responsible to administer provisions of the Medicinal and Toilet Preparations

(Excise Duties) Act, 1955 (Central Act 60 of 1955). The Section is headed by one Deputy Commissionerof Excise who is assisted by one Special Superintendent of Excise and two Superintendents of Exciseand one Addl. Superintendent of Excise. Administration relating to Industrial Alcohol is also entrustedto this Section.

12. Training InstituteTraining Institute is headed by one Deputy Commissioner of Excise, who is assisted by one

Special Superintendent of Excise. This institute imparts both theoretical and practical training to thenew entrant Excise officials of different cadres as well as organises in-service training programmesfor the officers at different training institutes viz. Police Training College, Administrative TrainingInstitute, National Academy of Central Excise and Narcotics etc.

13. Computer CellThere is a Computer Cell in the Excise Directorate under the general control of Excise

Commissioner. An excise officer of the rank of Deputy Commissioner of Excise (Systems) is in chargeof this cell. This Cell is manned by two Deputy Excise Collectors and 02 (two) Systems Analysts inthis cell. This cell is entrusted to look after the e-governance programme in the Excise Directorate.

14. Chemical Examination LaboratoryThe Laboratory is entrusted with the analysis of samples of seized intoxicants sent by different

Investigating Officers under the B.E. Act and the N.D.P.S. Act. The reports of such analyses playimportant role in prosecution. Besides this work the Laboratory also tests samples of differentintoxicants received from manufacturing units and warehouses. Special Section also sends samplesto this Laboratory for analysis and test to oversee as to whether the manufactured products conformto the prescribed standard and norms.

15. Internal Audit UnitInternal Audit With at Excise Directorate is an independent organisation under Excise

Commissioner. This Wing is headed by one Deputy Commissioner of Excise (Audit & Accounts),who is assisted by three Assistant Commissioner of Excise (Accounts) & three Auditors.

The main function of this Wing is to ensure that the existing regulations and procedures arebeing carried out in proper manner in respect of Govt. Receipts & Expenditure. The Unit is responsibleto scrutinise and detect irregularities in assessment and levy of duty and different fees payable by theholders of licenses in accordance with the provisions of the Bengal Excise Act, 1909. The N.D.P.SAct, 1985 and the rules framed thereunder.

This Unit also helps in replying the queries raised by Hon'ble public Accounts Committee, byC.A.G. of India, by Principal A.G. (Audit), West Bengal & by A.G. (E.R.S.A.), West Bengal.

Activities and Achievements in the financial Year 2012-2013

Excise Revenue collection during the financial Year 2012-2013 has crossed Rs. 2500 Croremark. The total collection was Rs. 2609.82 Cr., which is 24.16% higher than the collection of theprevious year i.e, Rs. 2101.95Cr.

Of the total Excise Revenue collected in 2012-13, 57% i.e, Rs. 1481.53 Cr. was from ForeignLiquor. On the other hand, collections from Country spirit and Beer were Rs. 848.10 Cr. i.e, 32%and 241.17 Cr. i.e, 9% respectively.

Consumption of Country Spirit during the financial year under review has sought up 24.66%,when compared to previous year's consumption. Total amount of Country Spirit consumed duringthe period was 1014.62 Lakh LPL.

During 2012-13 consumption of Foreign Liquor (excluding Beer) was 834.88 Lakh Bulk Litre. Itis a 8.09% increase over previous year's consumption.

Consumption of Beer registered a 15.01% growth in this financial year. Total consumption ofBeer in 2012-13 was 879.62 Lakh Bulk Litre.

Preventive Activity during 2012-2013

Department undertakes round the clock preventive activity throughout the year. In 2012-1340754 cases were lodged against illicit distillation of liquor and 11.20 lakh litre of illicitly distilledliquor was seized. In addition, 94.40 lakh litre of fermented wash was also seized and destroyed. Asa whole 45912 cases were registered in this financial year throughout the state. In connection to theabove mentioned cases 4712 person were arrested.

Notable seizure of rectified spirit and overproof spirit has also been registered in the periodconcerned. Total 20903 litre of rectified spirit and 18149 litre of overproof spirit were seized in2012-13.

Under the Narcotic Drug and Psychotropic Substances Act, 1985 90 cases were lodged by theExcise department in this financial year. 33 persons were arrested in connection to these cases and191.7 Kg of Ganja was seized. Nonetheless, Department was also successful in seizing and destroy-ing huge poppy and Ganja plantation. Throughout the state 1,99,70,800 poppy plants, 19,73,272ganja plants and 2,32,010 kg of poppy straw were seized in this financial year.

eGovernance Initiatives at the Excise Directorate

The eGovernancestrategy of the Excise Department are directed at developing systems for theelectronic delivery of its services to its licensees and other stakeholders, and for enabling thedepartment to discharge its functions with a greater level of transparency, efficiency andresponsiveness.

Some of the major eGovernance initiatives taken by the department include the following:

1. A system has been developed for the collection of excise duties and fees through internet bankingchannels. At present, State Bank of India is offering the service, and the system is being widelyused by excise licensees. A few other banks, including private sector banks, are expected tooffer the service soon.

2. As part of the eGovernance software called xPERT (Excise Programme for Effective RevenueTracking) being developed by the National Informatics Centre, all requisitions for permits forthe import of spirit for the manufacture of liquor, are now being submitted and processed online.

3. Web-enabled reporting systems for excise crime figures and revenue figures have been developed.

4. A revamped R.T.I. Act-compliant website has been launched. The website is hosted on thedomain wbexcise.gov.in

Continuous steps are being taken to strengthen the eGovernance capabilities of the department,with particular emphasis on broadening the range of services that are to be delivered electronically.

Awareness Campaign against illicit liquor

In West Bengal, Excise Department is driven by the motive to minimize consumption of liquorwith maximum revenue earning. To implement this principle, Excise Department, along with revenueadministration, also undertakes preventive activities to curb illegal distillation or manufacturing ofliquor. Illicit liquor is not only harmful for the health of the consumers but also a competitive productof Government approved liquor. Thus, illicit liquor is acting as a double hawk causing immenseharm to society.

In this perspective, Excise Department has come up with awareness campaign of completelynewer approach. Along with postering and wall writing against illegal liquor, arrangements havealso been made to transmit information coming from common people to the officers of Excise andPolice Departments. In this purpose phone numbers of the key officials of these Departments aredisplayed in the posters.

The Department has started an awareness campaign against drinking / selling of illicitly distilledliquor by way of advertisement through All India Radio, Kolkata from 1st September, 2012.Simultaneously, effective measures for raising awareness against this menace have been taken bythe district excise authorities through banners, wall writings, hoardings outside the hospitals, railwaystations, market places, gramin melas etc with a view to mobilise the local people against themanufacturing and selling of illicit liquor.

NOTIFICATION

Whereas, for undertaking effective preventive action, for better monitoring and supervision of growing number ofexcise establishments, for coping with the changing nature of excise crime, for strengthening of excise range leveladministration and for making the excise administration at the lowest level co-terminus with the jurisdictions of the policestations, it has become imperative to re-organise the excise administrative set up, by way of delimitation of the jurisdictionof excise ranges and circles and by creation of new divisional units and providing a preventive unit in the ranges, in theinterest of excise administration;

Now, therefore, in exercise of the powers conferred under Section 7 of the Bengal Excise Act, 1909 (Ben. Act. V of1909) the Governor is pleased hereby to make the following rules:—

Rules

1. Short Title and commencement: (i) These rules may be called the West Bengal Excise (Reorganisation of theExcise Administration) Rules, 2012.

(ii) These rules shall come into force on and from 1st day of November, 2012.

2. Definitions: In these rules, unless there is anything repugnant to the subject or context—

(a) ‘the Act’ means the Bengal Excise Act, 1909 (Ben. Act. V of 1909);

(b) the words and expressions used shall have the same meaning as respectively assigned to them in theBengal Excise Act, 1909 (Ben. Act. V of 1909) and rules made thereunder.

3. (i) 462 (four hundred and sixty two ) new posts of Excise Constable in the Pay Band PB-2 (Rs. 5400–25200/-) with Grade Pay Rs. 2600/- shall be created in Excise Department;

(ii) 137 (one hundred and thirty seven) new posts of Assistant Sub-Inspector of Excise in the Pay Band PB-3(Rs. 7100-37600/-) with Grade Pay Rs. 3200/- shall be created in Excise Department;

(iii) 88 (eighty-eight) new posts of Sub-Inspector of Excise in the Pay Band PB-3 (Rs. 7100-37600/-) withGrade Pay Rs. 3900/- shall be created in Excise Department;

(iv) 27 (twenty seven) new posts of Deputy Excise Collectors in the Pay Band PB-4A (Rs. 15600-42000/-)with Grade Pay Rs. 5400/- shall be created in West Bengal Excise Service;

(v) 3 (three) new posts of Deputy Commissioner of Excise in the Pay Band PB-4B (Rs. 28000-52000/-) withGrade Pay Rs. 7600/- shall be created in West Bengal Excise Service;

(vi) 3 (three) new posts of the rank of Additional Excise Commissioners in Pay Band PB-5 (Rs. 37400–60000/-) with grade pay Rs. 8700/- shall be created in West Bengal Excise service;

4. (i) There shall be within the Jalpaiguri district a Superintendent of Excise for Jalpaiguri Excise Districtcomprising Jalpaiguri Sadar and Mal Sub-Divisions and a Superintendent of Excise for Alipurduar ExciseDistrict comprising Alipurduar Sub-Division and they shall in their respective areas exercise all the powersand perform all the duties conferred and imposed on a Collector by the portions of the Act, in subordinationto the Collector of Jalpaiguri and subject to the control of the Excise Commissioner;

(ii) There shall be within the Paschim Medinipur district one Superintendent of Excise for Paschim MedinipurExcise District comprising Medinipur Sadar, Kharagpur and Ghatal Sub-Divisions and one Superintendentof Excise for Jhargram Excise District comprising Jhargram Sub-Division and they shall in their respectiveareas exercise all the powers and perform all the duties conferred and imposed on a Collector by theportions of the Act, in subordination to the Collector of Paschim Medinipur and subject to the control ofthe Excise Commissioner.

(iii) There shall be within the North 24 Parganas district three Superintendents of Excise, (a) one Superintendentof Excise for the Barrackpore Zone which is synonymous and coterminous with the jurisdictional areasof Barrackpore Police Commissionerate; (b) one Superintendent of Excise for the Bidhannagar Zonewhich is synonymous and coterminous with the jurisdictional area of Bidhannagar Police Commissionerate;(c) one Superintendent of Excise for the rest of the area of the district of North 24 Parganas which shallbe coterminous with the jurisdictional area of North 24 Parganas district police. All the said threeSuperintendents of Excise shall in their respective areas exercise all the powers and perform all the dutiesconferred and imposed on a Collector by the portions of the Act, in subordination to the Collector ofNorth 24 Parganas and subject to the control of the Excise Commissioner.

5. (i) There shall be three Collectors of Excise within the Kolkata district which shall be coterminous with thearea of the Kolkata Police Commissionerate. These three Collectors of Excise shall be appointed fromthe cadre of the West Bengal Excise Service, to exercise all the powers and perform all the duties conferredand imposed on a Collector by the portions of the Act, in respect of the jurisdictional areas specified

hereinafter, subject to the control of the Excise Commissioner :

6. The number of Excise Districts in the state of West Bengal shall be twenty four in place of existing twenty one

and there shall be two new excise zones in North 24 Parganas administrative district. In these Excise Districts

and Zones there will be 215 Circles, 87 Ranges and 41 manufacturing units mentioned in the Tables below and

they will be administered as shown hereunder:

7. The existing excise establishments at the non-manufacturing foreign liquor bonded warehouses in all districtsshall be abolished.

8. (i) There shall be eight Deputy Commissioners of Excise - (a) 2(two) in Jalpaiguri administrative division, (b)3 (three) in Burdwan administrative division and (c) 3(three) in Presidency administrative division to exercisepowers and perform duties conferred and imposed on the Collector in their respective jurisdictions as shown inthe table below and subject to the general control of the Excise Commissioner, West Bengal. The existingthree posts of Deputy Commissioners of Excise (Preventive) in three preventive divisions, viz., Presidsency,Bardhhaman and Jalpaiguri and the post of Deputy Commissioner of Excise, Central Striking Force shall standabolished. The establishment of Central Striking Force under the control of the Excise Commissioner, WestBengal, having its headquarters at the Excise Directorate, Kolkata shall also be merged with the respective

divisions .

(ii) There shall be 9 (nine) Superintendents of Excise, (a) 1(one) Superintendent of Excise at each of the

7(seven) excise divisions, viz., Jalpaiguri, Malda, Krishnanagar, Barrackpore, Alipore, Kharagpur and

Durgapur; (b) 2(two) Superintendents of Excise for Bardhhaman division with headquarters for one at

Bardhaman and the other at Chandannagar, who shall be assisted by a Striking Force comprising Additional

Superintendent of Excise, Deputy Excise Collector(s), Sub-Inspectors of Excise, Assistant Sub-inspectors

of Excise and Excise Constables, and shall function in subordination to the respective Deputy

Commissioners of Excise, subject to the control of the Excise Commissioner.

(iii) There shall be 12(twelve) Excise Checkposts, namely, EIB (Excise Intelligence Bureau) Checkposts at

the railway stations and 1(one) Checkpost shall be at Netaji Subhas Chandra Bose Airport at Dum Dum.

The Deputy Commissioner of Excise of the concerned division shall be in overall supervision of these

checkposts and each of these 13(thirteen) Checkposts shall be manned by one or more Sub-Inspector/s of

Excise who may be assisted by Assistant Sub-Inspector/s of Excise and Excise Constables. The details of

9. Range Preventive Force – A preventive unit comprising one Sub Inspector of Excise, one Assistant Sub-

Inspector of Excise and 08 (eight) Excise Constables shall be placed at every Range ,in all excise districts

except Kolkata, at the disposal of the Deputy Excise Collector under the general control of the Superintendent

of Excise.

In Kolkata Excise Districts there shall be three preventive units namely Special Squads, one for each excise

district, comprising one Deputy Excise Collector, one Sub Inspector of Excise, two Assistant Sub-Inspectors

of Excise and 10 (ten) Excise Constables at the disposal of the concerned Superintendent of Excise under the

general control of the respective Collector of Excise.

10. Computer Cell – There shall be a Deputy Commissioner of Excise (Systems) in charge of the Computer Cell

in the Excise Directorate under the general control of Excise Commissioner. This Cell shall also be manned by

(02) two Deputy Excise Collectors and 02 (two) Systems Analysts. Such Systems Analysts shall have a suitable

degree in Computer Software.

11. The Excise Commissioner may issue such orders, not inconsistent with the provision of the Bengal ExciseAct,1909 and the rules framed thereunder, and not inconsistent with this notification as may be required for theimplementation of this scheme of reorganisation.

12. Power to waive – The State Government shall have the right to waive any of the provisions of these rules at itsdiscretion in the public interest.

13. Overriding effect of rules – These rules shall have effect notwithstanding anything to the contrary containedin any other rules or orders for the time being in force, relating to the general administration of the ExciseDepartment and all such rules or orders shall be subject to these rules.

14. Interpretation – The power of interpreting these rules is reserved to the State Government.

Consequent upon creation of 33 additional posts of the cadre of West Bengal Excise Service, 88 posts of Sub-Inspector of Excise, 137 posts of Assistant Sub-Inspector of Excise and 462 posts of Excise Constables to implement thescheme of the Re-Organisation of the Excise Administration published under Excise Department Notification No. 1074-Ex dated 01.11.2012, the sanctioned strength of excise personnel at different cadres has been revised in following manner.

a) the strength of Excise Constables shall be enhanced to 2562 in place of existing 2100 ;

(Out of 22 posts of A.E.C./D.C., 11 posts shall be manned by the officers of the rank of Additional Excise

Commissioner in the Pay Band PB-5 (Rs. 37,400-60,000/-) with grade pay Rs. 8,700/- and rest 11 shall be

manned by the officers of the rank of Sr. Joint Commissioner of Excise / Joint Commissioner of Excise in the

Pay Band PB-4B (Rs. 28,000-52,000/-) with grade pay Rs. 7,600/-)

No. 1229–Ex, Dt. 17.12.2012.— In exercise of the power conferred by the proviso to article 309 of the Constitutionof India and in supersession of all earlier notifications on the subject-matter, the Governor is pleased hereby to make, withimmediate effect, the following rules regulating the recruitment to the posts of Excise Constables and Lady ExciseConstables in the Subordinate Excise Service under the Excise Directorate in the Department of Excise, Government ofWest Bengal:—

Rules

The method of, and the qualifications required for, the recruitment to the posts of Excise Constables and LadyExcise Constables in the Subordinate Excise Service under the Excise Directorate in the Department of Excise, Governmentof West Bengal, shall be as detailed below:—

(1) Name of the post : Excise Constable;

(a) Method of recruitment : (i) By selection (direct recruitment) through the tests ofphysical measurement and physical efficiency,followed by the written test and an interview, to beconducted by the West Bengal Police RecruitmentBoard, on the basis of an open advertisement in atleast three widely circulated daily news papers out ofwhich one shall be in English language;

NOTE.— The candidates who qualify the testsof physical measurement and physical efficiency shallbe eligible to appear in the written test and thecandidates qualifying the written examination shallbe called for interview;

(ii) by promotion from the Group 'D' employees of theExcise Directorate who have completed six years ofcontinuous service and conforming physicalmeasurements as mentioned in item (i) for directrecruitment;

NOTE— Promotion quota shall be 10% of thetotal sanctioned strength of the Excise Constables orthe Lady Excise Constables;

(b) Qualifications for direct recruitment : (i) Must be a citizen of India;

(ii) must have passed the Madhyamik Examination fromthe West Bengal Board of Secondary Education or itsequivalent;

(c) Age for direct recruitment : Not less than 18 years and not more than 27 years on the1st day of January of the year of advertisement. The upperage limit may be relaxed by (05) five years in the case ofScheduled Castes, Scheduled Tribes Candidates and by(03) three years in case of Other Backward ClassesCandidates;

(2) Name of the post : Lady Excise Constable;

(a) Method of recruitment : By selection (direct recruitment) through the tests ofphysical measurement and physical efficiency, followedby the written test and an interview, to be conducted bythe West Bengal Police Recruitment Board, on the basisof an open advertisement in at least three widely circulateddaily news papers out of which one shall be in Englishlanguage;

mark and ¼th (one fourth) mark will be deducted for each wrong answer. Questions in the

written test shall be in the following subjects:

(A) General awareness and general knowledge: Full Marks-25,

(B) English: Full Marks-25,

(C) Elementary Mathematics (Madhyamik standard)-25,

(D) Reasoning-15;

(ii) The West Bengal Police Recruitment Board will fix qualifying marks for the written

examination;

(b) An interview will be organised for the candidates obtaining qualifying marks in the written test. The

Interview Board shall be represented by an officer of the Excise Department, not below the rank of

Joint Secretary or Additional Excise Commissioner;

(8) Appointing Authority:

(a) Additional Excise Commissioner/ Senior Joint Commissioner/ Joint Commissioner/ DeputyCommissioner of Excise, Headquarters, in respect of the posts under the Directorate Headquarters;

(b) Additional Excise Commissioner/ Senior Joint Commissioner/ Joint Commissioner/ DeputyCommissioner of Excise, Special, in respect of the posts under the Special Section at ExciseDirectorate;

(c) Additional Excise Commissioner/ Senior Joint Commissioner/ Joint Commissioner/ DeputyCommissioner of Excise in charge of the Excise Divisions in respect of the posts in the concernedExcise Division and the districts under the Division.

(9) Miscellaneous:

(a) The Excise Commissioner shall allot the selected candidates to the different organisations as perrequirement/vacancy and order of preference of Division of the selected candidates.

(b) An Excise Constable or Lady Excise Constable shall be borne on the establishment where he or sheis posted by the appointing authority. But his seniority for the purpose of promotion to higher postsshall be determined as per his position in the date-wise gradation list of Excise Constables or LadyExcise Constables maintained by the Excise commissioner, West fiengal.

(c) The Excise Commissioner, West Bengal, shall have the power to transfer an Excise Constable orLady Excise constable from one establishment to another. The officer under whose establishmentthe Excise Constable or Lady Excise Constable is so transferred shall be deemed to be the appointingauthority of the latter.

Rules

The method of, and the qualification required for, recruitment to the post of Assistant Sub-Inspector of Exciseunder the Excise Department, Government of West Bengal, shall be as follows:-

1. the Excise Commissioner, West Bengal shall be the appointing authority;

2. (1) Subject to the provisions of rule 3, appointment to the post of Assistant Sub- Inspector of Excise shallbe made by way of promotion from Excise Constable subject to the fulfilment of the conditions that thecandidate-

(i) shall have rendered 5 years of continuous service as Excise Constable prior to the year ofappointment;

(ii) shall have been confirmed in the rank of Excise Constable; and

(iii) shall have to qualify in a qualifying examination (written and oral) to be conducted by orunder the authority of the Excise Commissioner.

(2) The qualifying examination referred to in sub-rule (1) shall be held in February or at such other timeas the Excise Commissioner may decide.

(3) The vacancies, which shall be considered for being filled up by promotion in a calendar year, shallbe such as have occurred upto the 31st December of the preceding calendar year.

(4) The Excise Commissioner shall have the discretion to fix qualifying marks for examination.

3. (1) When one or more vacancies referred to in sub-rule(3) of rule 2 cannot be filled up by promotion onaccount of non-availability of qualified candidates, the said vacancies may be filled up by direct recruitment,inviting applications through advertisement published in local dailies in at least three wide circulated dailiesout of which one shall be in English. Recruitment will be made on the basis of qualifying the physicalmeasurement followed by written test and interview to be conducted by the Staff Selection Commission, WestBengal.

(2) For direct recruitment a candidate -

(i) shall be a citizen of India;

(ii) shall not be less than 18 years and shall not be more than 27 years on the 1st day of January ofthe year of advertisement. The upper age limit may be relaxed by (05) five years in the case ofScheduled Castes, Scheduled Tribes Candidates and by (03) three years in case of OtherBackward Classes Candidates;

(iii) minimum Educational Qualifications: Passed in Higher Secondary (10+2) Examination fromthe West Bengal Council of Higher Secondary Education or its equivalent;

(iv) minimum Physical Measurements:

(b) the Staff Selection Commission, West Bengal will decide the prescribed scheme and syllabusfor the written examination;

(c) the Staff Selection Commission, West Bengal will fix full marks and qualifying marks for thewritten examination and interview;

(d) the Staff Selection Commission, West Bengal shall prepare a panel of successful candidates inorder of merit and recommend the appointment of Assistant Sub-Inspector of Excise to theExcise Commissioner, West Bengal.

(4) Verification of character antecedents:

All provisionally selected candidates will be required to fill up a verification roll which will be thoroughlyenquired into by the concerned authority;

(5) Medical Examination:

After receipt of verification roll having “NO OBJECTION” all provisionally selected candidates will besent for medical examination at the designated hospitals. The candidates must not have knock knee, flat foot,varicose vein, squint eye. The minimum vision should be 6/6 with or without glasses. They should possesshigh colour vision and should not be colour blind. The medical test will also include the chest X-ray and othertests as prescribed by the Department of Health and Family Welfare, Government of West Bengal from time totime. The selected candidate should be of good mental and physical health and free from any physical deformitylikely to interfere with efficient performance with their duties. The certificate of medical fitness will be issuedby authorised medical officer.

(6) Training and Discharge:

(a) The candidates on recruitment shall be required to undergo training, both physical andtheoretical, at the Police Training College or any other training centre as selected by the ExciseCommissioner, West Bengal and/or in any district as may be determined by the ExciseCommissioner. All such candidates shall be required to pass out of the college or centre, as thecase may be, for the confirmation of their service. In case the candidates are sent for districttraining, successful completion of their district training shall be certified by the concernedSuperintendent of Excise.

(b) An Assistant Sub-Inspector of Excise while undergoing training in the Police Training Collegeor subsidiary training centre and / or any district may at any time be discharged by the AppointingAuthority on the basis of the report of the authority of the Police Training College or thesubsidiary training centre or the district, as the case may be, if he is considered by them to beunsuitable for the post. The order of discharge shall intimate the ground for the discharge butno formal proceeding, such as are prescribed for removal or dismissal of Government servantshall be necessary. No appeal shall lie against the order of discharge.

1. Change of designation of the existing DDOs and attaching more offices under the DDO -Annexure-I: Theofficers under Excise Directorate mentioned at column 3 shall act as the Drawing and Disbursing Officers [DDO] inrespect of the offices mentioned in column 6 in place of the existing officers mentioned at column 4. The name ofthe Treasury/Pay & Accounts Offices to which the DDOs are attached and the allotted Code against each DDO arealso mentioned in the Annexure. The Treasury/Pay & Accounts Officers shall modify the existing DDO-Designationand collect the specimen signatures of the present DDO duly attested by the previous DDO. The present DDO shallfurnish the revised sanctioned strength of the employees of the offices covered under his jurisdiction, to the concernedTreasury/Pay & Accounts Officers, according to their classification (Group A, Group B, Group C and Group D) andstatus (Permanent / Temporary).

2. Attaching more offices/retention of office under the present DDO - Annexure-II: The officers under Excise

Directorate as mentioned at column 3 shall continue to act as the Drawing and Disbursement Officers [DDO] inrespect of the offices as mentioned at column 5. The name of the Treasury/Pay & Accounts Offices to which theDDOs are attached and the allotted Code against each DDO are also mentioned in the Annexure. The present DDOshall furnish the revised sanctioned strength of the employees of the offices covered under his jurisdiction, to theconcerned Treasury/Pay & Accounts Officers, according to their classification (Group A, Group B, Group C andGroup D) and status (Permanent / Temporary).

3. Closure/abolition of existing DDO - Annexure-III: The officers under Excise Directorate as mentioned at column3 shall cease to act as the Drawing and Disbursement Officers. The name of the Treasury/Pay & Accounts Offices towhich the DDOs were attached and the allotted Code against the DDOs are also mentioned in the Annexure. The

Treasury/Pay & Accounts Officers shall deactivate the DDO-Codes in respect of those officers as mentioned atcolumn 3.

4. The Order shall take effect from 01.02.2013.
