INSPECTORATE OF FACTORIES The Inspectorate of Factories is enforcing the Factories Act, 1948 and 13 other Labour enactments in Factories registered under the Factories Act, 1948 and the Tamil Nadu Factories Rules, 1950. INSPECTORATE OF FACTORIES
The Inspectorate of Factories is enforcing the Factories Act, 1948 and 13 other Labour enactments in Factories registered under the Factories Act, 1948 and the Tamil Nadu Factories Rules, 1950. By the enforcement of these important Labour Legislations, the Health, Safety, Welfare, good working conditions, etc. of the workers employed in the registered Factories are protected. Factories in which 10 or more workers are employed and power is used in the manufacturing process and Factories which are engaging 20 or more workers without using power in manufacturing process are registered under Factories Act, 1948 and Rules, 1950
Applicability
The Plan approval authorities are as follows :-

Form No. 1 : (Prescribed under Rule 3 of Tamil Nadu Factories Rules).Application for permission to construct, extend or take into use any premises as a factory.
Form No.2 : Application for registration, grant or renewal of licence for the year ------ and notice of occupation specified in Section 6 (to be submitted in triplicate).
WELFARE SCHEMES FOR WORKERS :
CRECHE :Creche shall be provided and maintained under the charge of trained women in factories employing more than 30 women workers.
SHELTERS, REST ROOMS, LUNCH ROOMS :Rest Room and Lunch Room shall be provided in factories where in more than 150 workers are employed.
CANTEEN :Canteen shall be provided and maintained in factories employing more than 250 workers.
WELFARE OFFICERS :To take care of the welfare of the workers, Welfare Officers shall be employed in factories employing more than 500 workers.
Safety OFFICERS :To take care of the Safety of the workers in workplace, Safety Officers shall be appointed in factories employing more than 1000 workers.
FIRST AID APPLIANCES:There shall be provided First Aid Boxes with prescribed contents and they shall be kept in the charge of First Aid Trained persons in the Factory.In Factories, employing more than 500 workers Ambulance Room containing the prescribed equipments and in the charge of Nursing Staff shall be provided.

The Employees' Provident Fund and Miscellaneous Provisions Act 1952 applies to the whole India except Jammu & Kashmir.
Employees' Provident Fund and Miscellaneous Provisions Act 1952 is applicable to:
Every establishment which is engaged in any one or more of the industries specified in Schedule I of the Act or any activity notified by Central Government in the Official Gazette.
Employing 20 or more persons . Cinema Theatres employing 5 or more persons.
EMPLOYEES' PROVIDENT FUND AND MISCELLANEOUS PROVISIONS ACT '1952
Section 2(b) “basic wages” means all emoluments which are earned by an employee while on duty or on leave or on holidays with wages in either case in accordance with the terms of the contract of employment and which are paid or payable in cash to him, but does not include
I the cash value of any food concession;ii. any dearness allowance (that is to say, all cash payments
by whatever name called paid to an employee on account of a rise in the cost of living), house -
rent allowance, overtime allowance, bonus, commission or any other similar allowance payable to the employee in respect of his employment or of work done in such employment;
The Act, in the first instance, applies to all seasonal and non-seasonal factories employing ten or more persons, for wages and falling within the scope of an implemented geographical area. As of now, employees of factories/ establishments, that fall within the scope of coverage, and earning wages not exceeding Rs. 15,000/- per month are covered under the ESI Scheme.
