Executive Summary Insite Heritage were commissioned by ADW Johnson Pty Ltd to assess the archaeological impacts of a proposed 50 berth marina and associated amendments to a carpark on Murphy’s Bay, Koolewong, located on the Central Coast of NSW. The project is for a 50 berth marina extension to an existing jetty and a redesign of the existing carpark to allow for patronage parking. The project is to be assessed under Part 3A of the EP&A Act. The assessment has been carried out to meet the requirements of the Director Generals Requirements issued on the 20th December, 2010 (ref MP10_0209). The location of the marina proposal is not within any land subject to Native Title. The following report finds that there are no indigenous or non indigenous heritage constraints to the proposed marina project and its associated infrastructure.

1.0 Introduction
This Aboriginal Cultural Heritage and European Heritage Assessment Report has been prepared to address the Director Generals Requirements (DGR’s) issued by the Department of Planning upon acceptance of the project under Part 3A. The requirements specifically request a cultural heritage assessment carried out as per the Draft Guidelines for Aboriginal Cultural Heritage Assessment and Community Consultation (DEC 2005). This report documents the process undertaken to satisfy these conditions. In addition the DGR’s require the identification of non indigenous heritage values that may be impacted by the proposal and mitigations measures where necessary. Non- indigenous heritage values are to be detailed in a draft Heritage Impact Statement.
1.1 Scope of Works and Proposal Details. The scope of work entails the assessment of the land area of the car park and the area of Brisbane Waters (Murphy’s Bay) that will be impacted by the development of the Marina. The proposed Marina will provide 50 berths as an extension to the existing jetty on Lot 519 DP729020. The site currently comprises a carpark, the Boatshed Restaurant and jetty. The development of the Marina will entail: Upgrade of the existing timber jetty from 1metre to 1.5 metres in width; Construction of a fifty berth marina extending 100m into Murphy’s Bay from the end of the existing jetty; The marina will be a construction of floating pontoon secured by pylons, with rollers to allow the pontoon to rise and fall with the tide; Upgrade and reconfiguration of the existing car park to provide eleven additional car parking spaces (total 33). The upgrade will not involve any additional area to the existing car park and does not require additional fill to extend the existing reclaimed platform. The proponent is Gemsted Pty Ltd who are the lessee’s of the site. The land is Crown Land and zoned RE1 and W2 Recreational Waterways under the Gosford 2009 draft LEP. The full account of State and Local Planning instruments that pertain to the project area are detailed in the ADW Johnson EIS.
1.2 Methodology The methodology used in this study is based on the DECCW Draft Guidelines for Aboriginal Cultural Heritage Assessment and Community Consultation (DEC 2005). The methodology is focused on the identification of the cultural heritage values of the

study area in terms of indigenous and non indigenous heritage. These values are identified by:
1. Consultation with the Aboriginal community to identify the significance of the locale (refer to Appendix A); 2. Analysis of known historic and indigenous sites in the local area and region; 3. Assessment of the landscape context of the study area including degrees of disturbance and the potential for heritage sites with integrity; 4. Provision of mitigation measures and heritage impact statements as required.
Notification of the project including project details have been provided to:
Darkinjung Local Aboriginal Land Council (DLALC); DECCW; Gosford Council; Registrar of Aboriginal Owners; Native Title Services; and Advertised in the Central Coast Express on Wednesday 9th February 2011 (see Figure 8, Appendix B). Copies of the letters and the advertisement tearsheet are located in Appendix B.
A list of stakeholders identified in the process above was formed and each stakeholder invited to contribute their knowledge of the cultural value of the study area (please refer to Appendix C). The registered Aboriginal stakeholders for the project are: Darkinjung Local Aboriginal Land Council - Ms Sharon Hodgetts Cultural & Heritage Research Officer Guringai Tribal Link Aboriginal Corporation - Ms Tracey Howie Chairperson Mr Kevin Duncan
The study area was then assessed by means of landscape context and known archaeological sites and disturbance for archaeological potential. The archaeological and cultural potential of the site are then integrated to identify any cultural values that may be impacted by the proposed development. Please refer to Appendix A for the Cultural Heritage Assessments of the registered Aboriginal stakeholders for the project.
1.3 Existing Environment The site is located 2 km north of Woy Woy on the north eastern side of Brisbane Water Drive. The site has been developed as reclaimed land and now houses The Boathouse waterfront restaurant. The site is Crown land above and below the mean high water mark of Brisbane Water drive. The Department of Lands is the owner of the land and Gemsted Pty Ltd the lessee.

The reclaimed area was constructed under approval by the Department of Lands in the 1985. The Department of Lands granted a Special Lease (182966) for the purposes of reclamation, building for operation of the restaurant and function room office space and car park and jetty. The Boathouse restaurant occupies the two storey premises and 33 spaces carpark and 21 metre jetty. The jetty was constructed in 1989 (Dept of Lands, 2004). The land was reclaimed for the construction of an oyster depuration site with landfill creating a trapezoidal shape jutting from the shore line. The adjacent shoreline is rock armoured to protect Brisbane Water Drive. The leasehold area comprises entirely land fill retained by a sea wall. The following Parish Maps from 1933 and 1953 show the shore line prior to the reclamation of the study area.

2.0 Heritage Context
2.1 AHIMS A search of the Aboriginal Heritage Information Management System (AHIMS) register of recorded archaeological sites maintained by the Department of Environment Climate Change and Water (DECCW) was conducted over a 16km² area with a fifty metre buffer zone around the site. A search of AHIMS was also conducted for the specific lot and DP number of the study area. No sites are recorded within the study area. A total of 64 sites were recorded in the local area. Table 1 below outlines the site types recorded in the area as identified by the AHIMS search (Appendix E). Table 1 AHIMS results site type frequency

2.2 Heritage Register Searches No shipwrecks are recorded in the vicinity of the marina. A search of the Gosford Council LEP, State Heritage Register, Regional Environment Plan, National Estate, Archaeological Conservation Zones, S170 Register and Register of the National Estate found no items listed in the Koolewong area (Appendix D).
2.3 Known Aboriginal Heritage Context It is believed that Aboriginal occupation in this area occurred around the late Pleistocene. Radiocarbon dating of a shelter site at Shaw’s Creek in the Blue Mountains has given the earliest occupation of the Hawkesbury-Nepean area at c. 14 700 years BP (Attenbrow 2002 in AHMS 2005). A study by Vinnicombe (1982) of the Gosford-Wyong area indicated that the aboriginal population of the area increased between 3000 – 1000 years ago, together with a preferential shift to the use of open campsites from rock shelters (Haglund 2000).
McDonald (1993) noted that engraving sites tend to occur on ridge lines, largely away from main economic resource areas and often on access routes around the region.
The Sydney regions and surrounding Hawkesbury sandstone formations have an abundance of rock art. In 1999 there were 4,000 known rock engraving sites in greater Sydney and more than 3,000 rock shelters with pigment art (Mulvaney and Kamminga 1999). The method of creating engravings was to peck pits into the rock and the join them by abrading. The majority of engravings are simple figurative outline motifs and abstract designs that incorporate the surface features of the rock at times. The engravings generally depict fauna, mythical beings (anthropomorphs), people, lines, circles and material culture. Regional variation in rock art has also been demonstrated. Dating of rock art has been attempted by the dating of sediment accumulated adjacent to a panel of art and an argument for an age of 5,000 years was made (McDonald in Mulvaney and Kamminga 1999).
The study area is located within the coastal region occupied by the Guringai people (Ross in English 1999). The Guringai occupied the coastal areas and the adjacent hinterland areas. Their diet appears to have been predominantly marine based. Contact with Europeans and the Guringai occurred shortly after invasion with the Broken Bay area being explored by Governor Phillip in 1788. European settlement not only displaced the Guringai from their lands but the introduction of diseases such as small pox also had a devastating effect on the population numbers of the Guringai (English 1999).
A review of previous archaeological assessments was conducted in proximity to the proposed development in order to place the study area into an archaeological context.
English (1999) carried out an archaeological survey on Spectacle Island Nature Reserve on behalf of NSW National Parks and Wildlife Service and Metropolitan Local Aboriginal Land Council. The subject area is located approximately 10km to the east of the study area. Foot surveys were conducted over the island. The survey identified eight newly identified midden sites, two shelter sites with archaeological deposit and two engravings. All of the midden sites were located in the foreshore areas of the island with dominant shell types of oyster and cockle. One shelter site was located on the northern side of the

island adjacent to a midden site. The other shelter site was situated on the southern side of the island on a steep slope
Donlon (1990) conducted a study of two skeletons located at Ettalong Beach approximately 8km north east of the study area the skeletons were uncovered by a plumber carrying out work in the back yard of a house in Ferry Rd at Ettalong Beach. The skeletons were situated approximately 2m below the surface in sandy soil. Prior to development of the area, the skeletons would have been located in the sand dunes the back of Ettalong Beach.
Dallas (1990) undertook an archaeological assessment at Patonga as part of the Gosford Regional Sewerage Scheme. The survey did not identify any archaeological sites located along the proposed pipeline route of the Patonga sewerage scheme. The survey revisited recorded site 45-6-1276 on Patonga Creek. The site was located 300m from the proposed route. The report notes that shell was observed along the foreshore areas which included species of inedible fish but also variable sizes of edible and inedible shell types. The survey also conducted some research into the recorded burial site 45-6-0177. It is thought that this may be a reference to the stone cairns along the Patonga – Wondabyne walking trail. The report notes that if the burials were located in sand dunes they would not normally be represented as mounds, but are usually dug into the sand, with possible slight subsidence. The report noted that disturbance to the Patonga spit has been quite extensive. It was considered that the construction of the sewer would not impact on previously undisturbed due deposits.
Witter (1999) conducted a survey for a 5km proposed fibre optic cable route between Patonga and Umina. Approximately 3.5km of the route was located within the road reserve through Brisbane Water National Park. The survey identified seven rock engraving sites, a stone arrangement and a midden site. None of the recorded sites were expected to be impacted by the proposed development.
2.4 Known Historical Context Brisbane Water was occupied by Europeans in the 1830’s. Initially Koolewong was settled by Edmund Couche on Portion 19 and he was well known for his use of shell and ‘seaweed’ to fertilise his market garden known as Glenrock Estate that produced navel oranges, pineapples and tobacco. Murphy’s Bay was occupied in 1876 and developed a lime burning facility and probably depleted those local middens not used by Couche. Murphy became world renowned for his seed collecting business. Murphy went on to develop holiday cottages along the foreshore (Dept of Lands 2004).

3.0 Impact Assessment The potential impact of the marina proposal is the pile driving of pylons into the floor of Murphy’s Bay. The floor of Murphys Bay is likely to be covered with a considerable layer of post European occupation silt, rendering the identification of any pre sea rise sites or relics washed into the Bay unlikely. As the assessment has not identified any potential indigenous or historical sites on the floor of Murphy’s Bay that may be impacted by the pile driving activity, there are no impacts on heritage values anticipated upon approval of this project. The proposed changes to the car park design will not impact on any ground that is not recent fill and will not impact on any heritage values.
3.1 Community Cultural Significance Assessment To identify the appropriate knowledge holders who may hold information regarding the significance of the study area the process outlined in the DEC 2005 Draft Guidelines for Aboriginal Cultural Heritage Impact Assessment and Community Consultation as outlined in Section 11.1 of the Director General’s Requirements for the project. The project was advertised and the required Government and non Government agencies notified by mail (see Appendix B). Following receipt of responses from these government agencies, identified Aboriginal persons or groups who may have an interest in the project were contacted and invited to register their interest in the project and to comment on the proposed methodology for the assessmen. As stated in Section 1.2 a list of registered Aboriginal stakeholders was compiled for the project and each stakeholder invited to contribute their knowledge of the cultural value of the study area (please refer to Appendix C). The registered Aboriginal stakeholders for the project are: Darkinjung Local Aboriginal Land Council - Ms Sharon Hodgetts Cultural & Heritage Research Officer Guringai Tribal Link Aboriginal Corporation - Ms Tracey Howie Chairperson Mr Kevin Duncan A field inspection was carried out with two stakeholder representatives from Darkinjung LALC (DLALC) and Guringai Tribal Link Aboriginal Corporation (GTLAC). The proposed methodology and a draft report were supplied to Mr Duncan for review and comment, as his registration of interest was received after the close of the registration period. Please refer to Appendix A for the reviews, comments and cultural assessments of the registered Aboriginal stakeholders.

3.2 Historical Heritage – Statement of Heritage Impact. No items of historical heritage value (State or local), including shipwrecks, have been identified in development area, therefore the proposal will not impact upon heritage values.
3.3 Field Inspection An inspection of the study area was carried out on the 25th February 2011. The inspection was carried out by Angela Besant, Director and Elizabeth Wyatt, Archaeologist, Insite Heritage with Sharon Hodgetts, Culture and Heritage Research Officer, Darkinjung LALC, Tracey Howie, Chairperson and Female Cultural Heritage Officer, Guringai Tribal Link Aboriginal Corporation and Mr Kyle Howie, Guringai Tribal Link Aboriginal Corporation. The site was found to be obviously reclaimed land and no evidence of any archaeological potential was identified.

4.0 Recommendations The search of heritage databases, the field inspection and consultation with the Aboriginal Community have not identified any constraints to the proposed development. Consultation with the Aboriginal stakeholders did not identify any cultural values that pertain specifically to the development site. Therefore it is recommended that no further heritage assessment is required should the project be approved.

Hi Angela,sorry for the late reply after your initial report on the proposed development area at Koolewong foreshore I agree totally that the possibility of locating any Aboriginal Heritage sites would be slim and as you stated it has been exstensively disturbed with refill and yes if there were any sites the piles would pushed them to the side and natually they would be covered with silt and sedimentation.There is no other cultural elements that is known of that particular site,Sincerley,In Unity,Kevin Duncan.

Thank you for DLALC's registration of interest in the project. The purpose of this letter is to provide DLALC with more information regarding the project and the proposed methodology for the cultural and archaeological assessment for your review and comment. As mentioned in the initial notification letter Insite Heritage Pty Ltd have been engaged by ADW Johnson on behalf of Gemsted Pty Ltd to assist in conducting an Aboriginal cultural heritage impact assessment for a proposed 50 berth marina and modification to existing parking at 19 Brisbane Water Drive, Koolewong. The current owner purchased the lease from the Department of Lands approximately 20 years ago. At this time, the site was approximately half reclaimed. The present owner completed the reclamation works using imported fill and developed the existing restaurant "The Boathouse", car park and jetty. The project will involve the re-modelling of the layout of the existing car park area and the extension of the marina. The marina extension will involve a floating pontoon held in place by a number of pylons (please see attached Figures 1 and 2). Our proposed methodology for the cultural heritage assessment is outlined below:
Initiate the consultation process seeking registrations of interest from Aboriginal parties, provision of information about the proposal to all registered parties, circulation of proposed methodology.
Seek submissions and information regarding the presence of culturally significant objects/and or places within the project area so that these may be avoided where ever possible
Conduct the site visit Seek submissions regarding the development of culturally acceptable management
options / mitigation measures of the identified objects and / or places within the project area (should any be identified) where impacts are considered to be unavoidable by the proponent
Collate information received from registered stakeholders, documenting all feedback and response to submissions and incorporate into the draft cultural heritage assessment report
Circulate the draft cultural heritage assessment report to the registered Aboriginal parties for review and comment
Collate and incorporate all responses to the draft report into the final cultural heritage assessment report

We would like to invite all registered parties to identify any protocols that they wish to be adopted in the information gathering process and assessment methodology and any matters such as issues/areas of cultural significance that might affect, inform or refine the assessment methodology. We would appreciate if you could please provide any comments or requirements regarding the proposed methodology by Monday 7th of March 2011. We would also like to invite submissions regarding the presence of any culturally significant objects and or places within the study area so that these may be avoided wherever possible. To assist in the assessment we will also be undertaking a site visit to the subject area, could you please provide details of half day rate for conducting a site visit.
