Abandoned Underground Storage Tank (UST) Initiative
Summary Report on Initial Inventory of Abandoned UST Sites in California
Prepared for the U.S. Environmental Protection Agency Region 9 and the California State Water Resources Control Board (State Water Board)
Prepared as part of Cooperative Agreement LS‐97952501‐4 between the United States Environmental Protection Agency (USEPA) Region 9 and the California State Water Resources Control Board (State Water Board) utilizing Interagency Agreement DW96955775 between USEPA and the United States Army Corps of Engineers (USACE).
Abandoned Underground Storage Tank (UST) Definition: USTs are considered abandoned when regulated
substances are no longer stored and/or monitoring requirements of the Operating Permit and Title 23, of the
California Health and Safety Code 25298, are not being implemented, including maintenance of the UST system.
USTs that are out‐of‐service (temporarily abandoned) for more than 12 months must be removed or permanently
closed in place in accordance with Title 23 Rules.
1.0 INTRODUCTION
The Interstate Highway 710 (I‐710) Corridor is an environmental justice priority area for the U.S. Environmental Protection Agency (EPA) and the California State Water Resources Control Board (State Water Board). Through a joint pilot project of the “Underground Storage Tank Cleanup Partnership” in the I‐710 Corridor focus area, EPA, the State Water Board, and Sullivan International Group, Inc. (Sullivan) discovered that there was a backlog of sites where out‐of‐service underground storage tanks (UST) had been improperly closed (hereinafter referred to as “abandoned USTs”). This discovery inspired a California initiative to compile an inventory of abandoned UST sites statewide and develop a collaborative strategy for addressing these sites, including the identification of resources needed for sites where responsible parties (RP) may not be willing or able to address potential contamination concerns.
In November 2012, the State Water Board requested that Unified Program Agencies (UPA) and Local Oversight Programs (LOP) submit information regarding abandoned or improperly closed USTs within their jurisdiction. This report’s intent is to: 1) compile information to assess the extent of the issue and 2) determine strategies to help the UPAs obtain compliance at these sites.

2.0 METHODOLOGY
An electronic request was submitted by the State Water Board to each of the 97 UPAs with jurisdiction over permitted USTs, with a template response spreadsheet which required the following minimum information: site address, number of USTs, and status of USTs. A list of the agencies contacted is supplied in Attachment 1. Local agencies were given 60 days to respond. Follow-up phone calls were made to verify that the request reached the correct person and to gather feedback about the challenges agencies face in obtaining compliance at abandoned-tank sites.
The reported sites and associated information were tabulated into one master spreadsheet. Then, each site was researched on GeoTracker and the California Environmental Reporting System (CERS). Finally, the sites were geo-coded and overlaid with County boundaries.
3.0 FINDINGS
A total of 323 sites and a minimum of 769 USTs were reported from 46 different agencies. At some sites, the number of USTs was unknown; for those sites, two USTs per site were assumed. The collected information is summarized in Illustration 1: “Abandoned Tanks Inventory: Number of Reported USTs.” A Master List of Abandoned Tank Sites is included as Attachment 2. Information regarding the presence or absence of product in 581 of the USTs was not available. The lack of information on whether or not product is present highlights the severity of the abandoned UST problem. Recommendations for next steps are further discussed in Section 4.0.
Of the 97 local agencies that were contacted, 85% responded to the information request. Forty-six (46) agencies reported abandoned tank sites and 36 agencies reported zero abandoned sites. Fifteen (15) agencies did not respond to the request for information; these agencies are listed in Attachment 3.
3.1 UNIFIED PROGRAM AGENCY (UPA) BREAKDOWN
Illustration 2 shows the ten UPAs with the greatest number of UST sites. Together, the ten UPAs represent 74% of the total reported sites. The Los Angeles County Department of Public Works (LACDPW) reported 55 sites with a minimum of 144 abandoned USTs, which was the highest number reported from an individual UPA.

The City of Los Angeles Fire Department (LAFD) originally reported only one abandoned UST site in its records system. Meanwhile, the Brownfields Program within the City of Los Angeles Public Works Department had developed different information sources for the same geographic area, and provided Sullivan with a list of potentially abandoned gas station sites that was compiled by conducting driving surveys. Sullivan then screened the list of sites in GeoTracker, Google Earth, and in the Los Angeles County Office of the Assessor’s files to determine which sites may still have abandoned USTs onsite. In some cases, physical file reviews at LAFD had been conducted by the Los Angeles Brownfields Program, but additional investigation is needed to confirm the presence of potentially abandoned USTs at the City of Los Angeles sites. The City of Los Angeles Public Works Department data indicates that the jurisdiction with the second-highest number of potentially abandoned UST sites is the LAFD, with 44 sites and a minimum of 97 USTs.
The Fresno County Department of Public Health had the third-greatest number of reported UST sites, with 38 sites and a minimum of 87 USTs. The Mono County Health Department and Shasta County Environmental Health Department each reported 6 sites, and are tied for the tenth-greatest number of abandoned UST sites per UPA.

Illustration 3 depicts how many sites are in GeoTracker and CERS for the top ten UPAs based on the greatest number of sites reported. Eighty-eight (88) abandoned tank sites had either open or closed Leaking UST (LUST) Cases in the State’s GeoTracker database (48 open LUST Cases and 40 closed LUST Cases). Various situations could lead to a “Case Closed” status as an abandoned UST site. Typically, a historical LUST Case could have existed at the site, but it could be unrelated to the current, abandoned tank issue.
Beginning on January 1, 2013, all regulated facilities were required to report UST data into CERS by December 31, 2013. Of the abandoned UST sites reported, 124 were listed in CERS. Of those 124 sites, 17 sites also had “open” cases in GeoTracker. In these instances, the sites are regulated under both the prevention and cleanup sides of the UST Program. Based on feedback collected during outreach, UPAs need clear direction regarding the information which should and should not be included in CERS. Additionally, the Regional Water Quality Control Boards (Regional Boards) need to be fully aware of non-compliant abandoned UST sites to inform their approach with RPs.
One hundred fifty-one (151) sites are not listed in either CERS or GeoTracker. CERS tracks active UST facilities and GeoTracker tracks USTs with reported releases. There is no clear guidance on how these sites should be tracked; currently, they are not tracked consistently in either a cleanup or prevention database, and thus fall into a gray area between prevention and cleanup. They are no longer active facilities and many sites do have permit records because they were abandoned prior to current UST regulation; therefore, they receive limited regulatory oversight on the prevention side. The sites contain suspected leaking USTs, but unless a release has been reported and there is an open LUST Case, the sites are not officially tracked in the UST Program’s cleanup side. Under the State Water Board’s Underground Storage Tank Regulations, Title 23, local agencies are required to submit to the Board information pertaining to local UST program implementation and enforcement, which includes but is not limited to: “tanks subject to regulation, regulated facilities, and facility inspections conducted.” 1

Ultimately, it is the responsibility of the UPAs to report and regulate these abandoned UST sites, as well as track them appropriately in the State Water Board’s CERS and GeoTracker databases.

3.2 AGENCY CHALLENGES
In an effort to understand the individual challenges of the local agencies, informal phone interviews were conducted. Some local agency staff mentioned the pressure by UST program managers to under-report sites to the State Water Board because local agencies were unclear on the outcome of the information request and feared it could lead to a requirement to regulate these sites with no additional compensation or reflect poorly on their UST Program.
If available, UST program managers were asked for feedback on the biggest challenges facing their agencies in properly closing abandoned UST sites. Overall, the challenges described were similar to the recurring themes that Sullivan discovered while working on the I-710 Pilot Project:

3.2.1 Responsible Party Identification
The identification of RPs can be difficult if the site is vacant and the current owners or previous operators are unknown. In addition, many agencies have had difficulty identifying historical owners and/or operators who may also be responsible. In some cases, the agencies identify sites where the current owners may have inherited the sites from a family member without any knowledge of the USTs. There are also cases where the sites are owned by a trust fund, and decision-making authority is shared by numerous people. In these cases, it becomes increasingly difficult to identify an individual with the legal authority to represent the landowner.
3.2.2 Economic Hardship
Economic hardship is a common theme facing many of the UST owners and former operators, who claim they do not have the funds to close the USTs or keep them open for business. Small, family-owned businesses often operate on these sites – such as convenience stores, liquor stores, tire shops, automobile repair shops, or car washes – but generate only a subsistence income. It is a challenge to confirm whether an “inability to pay” claim is valid, as local agencies do not have an established process or the resources to request financial information and evaluate “inability to pay” claims.
Additionally, owners of sites in communities with low property values have less financial incentive to properly close the USTs because the cost of closure and cleanup activities could potentially exceed land values. In many cases, the owners simply walk away from the properties.
3.2.3 Real Estate Challenges
The closure of redevelopment agencies throughout the State of California left numerous sites with unresolved issues. Several sites are now owned by successor agencies, which do not have the financial resources to continue with the previous plans to address the USTs. Furthermore, most of the remaining successor agencies lack the capacity to apply for available funding sources, which requires administrative oversight. Sites in the foreclosure process present a similar challenge. The potentially recalcitrant owners are unable or unwilling to continue making the mortgage payments. Banks are unwilling to take possession of the sites and assume the associated environmental liability. Consequently, these sites are left in a state of noncompliance. The property owners and operators have abandoned the sites, but no work is being completed to close or remove the USTs.
3.2.4 Site Access
Site access issues arise when the RP is unresponsive or hostile to inspection requests or the site has been abandoned. In cases where access can’t be obtained, local agencies are unable to confirm the number of USTs present (if unknown) or whether there is product remaining in the USTs. Site access can also be hindered when there is a physical barrier, such as a road or building over the UST. In cases where a road has been built over the UST, the street is owned by a city (or its Public Works Department), but the UST is typically owned by a different individual or entity. Municipal Public Works Departments are hesitant to address issues with UST sites for fear of becoming the RP.

3.2.5 Recalcitrant Responsible Parties/Lack of Enforcement Support
Recalcitrant RPs – those who are unwilling to conduct required closure activities or simply unresponsive – can be a major hindrance for the local agencies. UPA managers reportedly do not have sufficient resources, staff, and/or legal support to pursue enforcement activities on a large scale. In many cases, the local agencies may issue several Notices of Violation (NOV) to the owners or even “red tag” the site, which is only effective for facilities with operating USTs which suffer lost revenue from fuel sales. It doesn’t affect the operation of businesses that are not using the USTs. Typically, longtime recalcitrant cases are referred to the District Attorney’s office. However, no additional enforcement activities are pursued for many of the sites after NOVs are issued or the sites are “red tagged.”
3.2.6 Old/Unpermitted Sites
In the past, USTs were installed without regulatory oversight agencies, such as a UPA. Consequently, numerous inactive USTs that are unpermitted and unregulated remain in the ground. Many sites with old USTs installed before the establishment of the UPAs remain unidentified, and the USTs are discovered during other types of on-site inspections or unrelated construction activities. Some local agencies do not have a process developed to address old and unpermitted UST sites and thus do not include these sites under their regulatory umbrella. The agencies lack the staff resources to locate the RP and bring the USTs into compliance or require closure.
3.2.7 Restrictive Criteria for State and Federal Funding Sources
Several state and federal funding sources are available to owners and operators of USTs and are further discussed in Section 4.0. Specific funding-source requirements prohibit many of the abandoned UST sites from obtaining financial assistance. The result is sites without state or federal mechanisms to address the abandoned UST issues. The main funding source for UST removal is the State’s Replacing, Removing, or Upgrading Underground Storage Tanks (RUST) Program.
The RUST Program offers direct grants and loans to assist owners and operators of active facilities to comply with UST regulatory requirements. However, the RUST Program is not applicable to the owners and operators of abandoned UST sites, because the USTs must be in operation at the time of application to the program.
Of the 48 LUST sites in GeoTracker, some may already be in the Cleanup Fund (CUF). The CUF can provide financial assistance to assess and clean up LUST sites. The CUF provides financial assistance to owners and operators to meet the federal and state requirements. It provides reimbursement for unexpected and catastrophic expenses associated with the cleanup of leaking USTs. However, the CUF is limited because it will provide funds for cleanup but will not provide funds for tank removal.
The Orphan Site Cleanup Fund (OSCF) and the Emergency Abandoned and Recalcitrant (EAR) Account Program will also provide funds for tank removal. However, the OSCF is restricted to sites in urban areas that have been vacant for at least one year. The EAR Account Program is applicable to sites with a confirmed release, which most abandoned UST sites do not have.

4.0 RECOMMENDATIONS FOR NEXT STEPS
Several options are available for the next steps of the Abandoned UST Initiative. The State Water Board will discuss the findings of the Final Abandoned UST Initiative Report with the CUPA Forum Board, in order to determine an overarching strategy. One of the first steps should be inputting information collected into both CERS and GeoTracker. The State Water Board should provide the appropriate guidance to the UPAs and LOPs as to what information should be uploaded. Additionally, regulating abandoned USTs can become a regular topic in conference calls with the LOPs and the CUPA Forum Board in order to develop strategies to provide a broader approach to address the sites. Progress on abandoned UST sites can be included in the CA CUPA UST Program Status Report. Sullivan will provide assistance to UPAs in need of technical, administrative, and/or enforcement support. UPAs and LOPs can contact Sullivan if they need additional support in specific areas such as site triage, drafting NOVs, RP searches, or Ability to Pay (ATP) analyses.
Various tools and resources are available to address abandoned USTs throughout California (see Table 1). These include: (1) Enforcement Support; (2) RP Identification; (3) Funding Support; (4) Investigation/Cleanup; and (5) “Open” GeoTracker case identification.
4.1 SITE PRIORITIZATION
Sullivan will assist the UPAs to potentially “fast-track” some sites that meet the criteria below:
• Located within 0.25 mile of identified sensitive receptors • Cooperative RP(s) • Readily accessible
If a site meets the above criteria, then the UPA, with the assistance of Sullivan, can:
• Confirm RP information • Send directive letter to RP(s)
o Draft letter approved by EPA and State Water Board o Require compliance or proper closure o Include “Right-of-Entry” for site access, enforcement penalties, include ability to pay
paperwork • Gauge USTs to confirm amount and quality of product • Compile specific site details and approach • Utilize EPA’s Targeted Brownfields Assessment Program • Assist with application to the State’s Orphan Site Cleanup Fund • Utilize EPA’s EAR Program for sites where a release has been confirmed
If a site does not meet the criteria to be fast-tracked, the UPA will send directive letters to the potential RP(s), while simultaneously working on the identified fast-track sites. If product is not identified in the USTs, the UPA will not prioritize action.

TABLE 1: SECOND PHASE CATEGORY RECOMMENDATIONS
(1) Enforcement Support Enforcement support enlists the District Attorney’s offices and federal field inspectors. Through warrants, federal field citations, or joint directive letters from EPA and the State Water Board, recalcitrant RPs will be required to properly abandon or close their UST sites. Enforcement support can also provide a mechanism to perform cost recovery on sites closed using a state or federal funding source such as the Emergency, Abandoned, and Recalcitrant (EAR) program.
(2) RP Identification For sites where there is an RP dispute, a subcontractor (e.g. Industrial Economics) can conduct an RP search. The RP search information will provide local agencies with contact information to pursue enforcement activities.
(3) Funding Support Funding support provides guidance to local agencies in accessing various funding sources, and in informing and assisting local agencies to refer sites to various funding sources, such as: Federal Sources
• Federal Targeted Brownfields Assessment (TBA) Program State Sources
• Replacing, Removing, or Upgrading Underground Storage Tanks (RUST Program)
• Orphan Site Cleanup Fund (OSCF) • Underground Storage Tank General Cleanup Fund (CUF) • Emergency, Abandoned, and Recalcitrant (EAR) Account
Program
(4) Investigation/Cleanup Once access has been granted, field work can be performed on sites eligible for the State’s OSCF or EPA’s TBA Program. Field work may include, but is not limited to:
• Removing product from the USTs • Advancing soil borings in the vicinity of the USTs • Assessing the soils beneath the USTs by removing the USTs
from the sites
(5) ”Open” GeoTracker Case Identification
UPAs and Regional Board caseworkers will partner to find effective ways to handle “open” GeoTracker cases. Caseworkers can insert notes into the comments field in GeoTracker to inform interested parties that abandoned USTs exist at certain open LUST sites.

4.2 FUEL RECYCLING
One potential mechanism to recoup costs for field activities related to the Abandoned UST Initiative is fuel recycling. A subcontractor can ship surplus fuel as a hazardous material on a Bill of Lading under California Health and Safety Code (HSC) Chapter 25143.2 (b), (1), (2), and (3). Specifically, “recyclable material (fuel) that is managed in accordance with Section 25143.9 and is or will be recycled by any of the following methods shall be excluded from classification as a waste: (1) Used or reused as an ingredient in an industrial process to make a product if the material is not being reclaimed. (2) Used or reused as a safe and effective substitute for commercial products (crude oil cutter) if the material is not being reclaimed. (3) Returned to the original process from which the material was generated (refinery), without first being reclaimed, if the material is returned as a substitute for raw material feedstock, and the process uses raw materials as principal feedstocks… (D) The material is a fuel that is transferred to, processed into, a fuel or other refined petroleum product at a petroleum refinery….”
These sections of the California HSC allow for the purchase, transportation, and recycling of excess, surplus, old, and mixed petroleum fuels. A transporter/recycler incurs the cost of the purchase, transportation, and recycling associated with the petroleum fuels.
Prior to the recycling of old petroleum fuels, field tests are performed on the petroleum fuels to verify that the fuel meets the qualifications to be recycled. A field technician will make visual observations, measure water content, and calculate specific gravity. A transporter/recycler will pay approximately $0.50 per gallon for old fuel products.
5.0 CONCLUSION
While the extent of the abandoned UST issue in California needs to be more accurately assessed, the Abandoned Tanks Initiative has identified a significant number of sites that were not on the State Water Board’s or EPA’s “radar” and which may pose a threat to human health and the environment. The State Water Board will work with the UPAs to develop processes to identify, report, and make progress on addressing these sites.
