Merger Control – time for a policy rethink?Economic analysis has been a bedrock of merger control for years and has undoubtedly improved the predictive powers of agencies conducting merger review, the following questions will be discussed:• Are we now seeing gaps? • Is it credible to argue that common ownership by large investors
of minority holdings in rival companies will affect management decisions?
• Should the acquisition by large digital businesses of tech start-ups be banned because they block innovation?
Our panel will discuss these topics and tackle the question of whether the European Union merger rules hamper the emergence of European champions fit to compete at the highest level on the global stage in the wake of the European Commission’s veto of the proposed merger of the rail businesses of Siemens and Alstom.

Litigation A year after all 28 European Union Member States implemented the European Commission’s Damages Directive, private antitrust litigation is surging in Europe. For example, the Commission’s trucks cartel decisions – which imposed fines of almost e4 bn – have spawned claims worth over e1 bn filed across Europe, including Germany, Hungary, Ireland, the Netherlands, Spain and the United Kingdom. Collective proceeding orders have been applied for in the trucks matter before the UK’s specialist Competition Appeal Tribunal. In the new environment of high-stakes litigation, questions abound as to how collective proceeding mechanisms will function, how courts will deal in general with expert evidence and damage calculations, and how the EU’s antitrust enforcement against Big Tech will translate into litigation in domestic courts. This panel will engage with these issues and, drawing on experience from both sides of the Atlantic, will offer their views about the future path of antitrust litigation in Europe.

Digitalisation – antitrust tools for the digital economy – do we need a rethink?The debate around whether or not antitrust tools need to be adapted to the digital economy continues across major jurisdictions. Antitrust and big tech has become a political issue in the US Presidential campaign as well as with a new European Commission taking shape in Europe. The following questions will be addressed:• What are the implications for future enforcement of the various
hearings and studies we are seeing, including at the US FTC and by Commissioner Vestager’s special advisers?
• How should we think about online platforms and vertical integration, which is an issue being investigated on both sides of the ocean.
• Is there an antitrust theory of harm around self-favouring? • Do we need new tools or theories of harm to address network
effects and ‘tipping’ markets? • How do we look at defining relevant markets and market
power in view of competition between ecosystems, competition for attention, two/multi-sided platform markets, an increasing focus on non-price effects, and data privacy as an element of product design?

Conference sell-outsThe IBA places its conferences in venues of a suitable size for each event; however, there are times when our conferences may sell out. Should this happen, prospective delegates will be informed and a waiting list will operate. The waiting list will function on a ‘first come, first served’ basis, subject to receiving registered delegate cancellations. The IBA will not be liable for any travel or accommodation expenses incurred by an individual who travels to a conference without a confirmed place at the event.
Cancellation of registration or social functionsIf cancellation is received in writing at the IBA office by 9 August, fees will be refunded less a 25 per cent administration charge. Refunds will be made minus any monies owed to the IBA.
We regret that no refunds can be made after this date. Registrations or social function bookings received after 9 August will not be eligible for any refund of fees. Please note that NO exception will be made to this policy. Should you have difficulties in obtaining your visa and are not able to attend the Conference this cancellation policy will still apply.
Upon submission of your completed Conference registration form to the IBA you are considered ‘registered’ pending payment. Please note that the cancellation terms and conditions as indicated will apply as soon as your registration is received.
Provided you have cancelled your registration to attend an IBA conference in accordance with the terms of the ‘cancellation of registration’ clause included in the ‘Information’ section of the relevant conference programme, you must then confirm to us in writing at the IBA office as soon as possible, but in no event later than one year (12 calendar months) from the date of any such conference, all necessary details to enable any reimbursement owed to you to be paid. • Delegates are required to pay the total price including Italian Value Added Tax (VAT) (22% at 22 January 2018 and subject to change).
