1. GENERAL RULES FOR SELECTION OF PROJECTS TO BE FINANCED UNDER THE

early stage of the selection process. After the final decision is taken, all applicants will be informed indue time on the winning proposal.

All publicity and documents within the selection process will be drafted in Romanian language.

RIO is the designated authority to conclude the contracts. The contracts will be granted on the basisof the following criteria:- the relevance of the projects, in relation with Romania's situation and requirements in the field ofintegration of third country nationals;- the cost-effectiveness of the expenditure, with a view to the number of persons concerned by theprojects;- the experience, expertise and reliability of the applicant organisations and any partner organisation;- the extent to which the projects complement other actions funded by the general budget of EU orpart of national programmes.

ln cases where the Delegated Authority acts as an awarding body, the applicants will support theprivate co-financing of each project in the amount of minimum 5% of the value of the project. RlO, asthe Contracting and Payment Authority should bear the difference of maximurn 2Oo/o of the nationalcontribution, namely the public co-financing. lf the public co-financing is not available at the time ofthe calls for proposals, the applicants should provide private co-financing up lo 25o/o.

2. ACTIONS TO BE SUPPORTED BY THE PROGRAMME UNDER THE PRIORITIES CHOSEN

Except for the main focus area"Reflect on pre-depafiure measures as a support to integration", therewere implemented measures under all key strategic objectives established for the annualprogrammes 2012 and 2013.Related to the main area of focus'Enhance active padicipation of both TCN and receiving society infhe process of integration", 8 projects covered relevant areas of the social integration process suchas language and culturalorientation courses, information and counselling, medicaland psychologicalcare, recognition of diplomas and material assistance.Under the area of focus "lncrease the effectiveness of integration rneasures addressing the specificneeds of vulnerable groups", one project was implemented, under the annual programme 2008. As itaimed a small segment of the target group, at the level of a city in Romania, it had a limited impactcompared to the expectations of the programme.As for the area of focus "Fosfer the multilevel cooperation between the different levels of govemanceinvolved in the development of integration strategies and measures and encouraging local action anda bottom-up approach to integration", various issues related to the social integration of immigrantswere addressed by 8 projects, respectively training of the staff of local authorities, consultation of theTCN communities at local-national level, research on integration of immigrants, as well as anawareness campaign targeting the host population.

2.1. Actions implementing Priority 1 "lmplementation of actions aimed at putting the'Common BasicPrinciples for immigrant integration policy in the European Union' into practice"

AGTION 1: Support for the information and counselling offices

To commit the allocation of this action, the Delegated Authority (RlO) shall act as an awarding body.The total eligible value of the action shall be supported as follows: 75o/o from EU contribution,maximum 20o/o trom the national budget and minimum 5% from the applicants.

The expected time for starting the projects is January 2013. The end date for the projects is 30 June2014.

a) Purpose and scope ofthe action:The purpose of the action is to provide necessarv information and traininq to TCNs leqallv residinq inRomania aiming at social inteqration in the localcommunities.

The information and counselling offices are aimed at raising the awareness of the TCNs legallyresiding in Romania, in the process of integration, thus the action being related to Objective 1

(lnformation disseminated to third country nationals on the rights and integration opportunities inRomania) of the Multi-annual Programme 2007-2013).

Regarding the key strategic objectives identified for 2012 and 2013 annual programmes, the actionrelates to the focus area "Enhance active pafticipation of both TCN and receiving society in theprocess of i ntegration".

The current action is a follow-up of Action 1 of the Annual Programme 2009 and Action 1 of theAnnual Programme 2010, which were aimed at the creation of information and counselling offices atterritorial level, in the locations registering the highest number of TCNs legally residing in Romania.The task of these offices was to provide relevant information and assistance in at least the followingareas of social integration: education, health, housing and social security.

The action shall support the existing information/counselling offices and, if required by the distributionof immigrants in the Romanian territory, new offices shall be created in order to cover a largerproportion of the integration/information needs.

Aiming at the integration in the host society, the action shall support the TCNs in accessing the labourmarket, through counselling and dissemination of information, tailored to the individual profiles andemployment opportunities.

For the TCNs residing in Romania for family reunification purpose, who usually face difficulties inadapting to the social life of the host country, the action takes into account special integrationmeasures.

The information and counselling offices shall guide the TCNs on how lo access the existingintegration measures and programmes. Therefore, the beneficiaries shall conclude protocols with thedifferent organisations and authorities providing such services. Moreover, the projects shall becorrelated with the activities performed on a daily basis by the regional/county branches of RlO, andthe methodologies shall be established based on a prior consultation of the RIO dedicated staff.

The action shall involve cultural mediators in order to facilitate the access of the TCNs to the servicesoffered by the public institutions. Specific measures shall be provided to enable the participation forvulnerable categories in the integration programmes.

Adequate publicity at local level shall be taken in the targeted areas, in order to involve as manyTCNs as possible. The offices shall perform the information and counselling of the TCNs in at leastthe areas focused on by the previous annual programmes, respectively the access to the labourmarket, education, health, housing, social security and other rights. lnformation tools andapproaches for the target group are to be used, such as brochures, newspapers, counsellingsessions, informalion within public eventVother activities, local mass- media etc.

Following the consultation of the relevant actors in the field of integration and the analysis of therelevant statistical data, this action shall cover the requirements regarding information, counsellingand cultural mediation of at least 3.000 persons (including vulnerable cases and family members), in12-15 cities which register the highest numbers of TCNs in Romania.

The outcome of the action consists of information, counselling and training of the TCNs in the field ofsocial integration.

The output of the action consists of integration measures adjusted to the needs of the TCNs legallyresiding in Romania.

The following indicators should be used:- number of information ofiices maintained/created and operational;- number and categories of persons benefiting from information and counselling- number of material produced and disseminated;- number of vulnerable persons benefiting from the specific programmes- number of cultural mediators facilitating the access of TCNs to the services offered by thepublic institutions

e) Visibility of EU fundingFor all the activities, the EU logo and the indication on lF co-financing will be placed on the printedreport and all materials produced such as leaflets, publicity materials, PR work etc.Posters with information on lF co-financing and the number and title of the project shall be placed atthe entrance and within the premises where courses and assistance activities are conducted, as wellas within the offices of the beneficiaries dedicated to the project.The items of equipment purchased within the projects shall be visibly marked with the EU logo andinformalion on the project.

0 Complementarrty with similar actions financed by other EU instruments:Overlaps with specific projects developed under the European Social Fund are possible, therefore, toeliminate the risk, during the implementalion of the Annual Programme, the Delegated Authority andthe Responsible Authority shall have regular consultations with the Ministry of Labour, Family andSocial Protection and the General Directorate for Development of Administrative Capacity, withinMAl, which are the management authorities for ESF. Moreover, to adequately prepare thedocumentation for the planned calls for proposals and eliminate duplication starting from thecontracting phase, the Responsible Authority shall consult the Managing Authorities before launchingthe call for proposals. ln this regard, the mentioned authorities concluded the Protocol no.72737129.08.2008 on prevention of overlapping of funding from the European lntegration Fund, theEuropean Refugee Fund and the European Social Fund.

To ensure complementarity with the European Refugee Fund, the Responsible Authority shall beinvolved in the calls for proposals, performed by the Delegated Authority, by designating observers,as well as in monitoring the implementation of the projects. Ensuring a clear distinction between thetarget groups of the actions supported by the two Funds (third country nationals, on one hand, andthe categories defined in Decision 57312007|CE, on another) shall be a main concern.

ACTION 2: lntegration programmes for the TCNs legally residing in Romania

The purpose of the action is to provide necessarv assistance to the TCNs leoallv residing in Romaniaaiminq at their inteqration in the Romanian societL

The actions is expected to provide for specific integration measures for the TCNs in Romania, inparticular the vulnerable categories of TCNs, thus being related to Objectives 2 (lncreasing theintegration opportunities for the vulnerable groups) and 4 (Enhancement of the opportunities to learnthe Romanian language and adaptation of the TCNs to the Romanian specific conditions) of theMulti-annual Programme 2AO7 -2013.

Regarding the key strategic objectives identified for 2012 and 2013 annual programmes, the actionrelates to the focus area "Enhance active pafticipation of both TCN and receiving society in theprocess of integration'.

Based on the consultation with the relevant stakeholders and the available statistical data, this actionis envisaged to meet the reguirements of the TCN population of 5-10 cities in Romania, registeringhigh number of immigrants with legal stay. The integration measures shall cover a large spectrum,such as language and cultural orientation training, education activities for children, facilitation of theacess to the labour market, medical and psychological assistance, social counselling as well asmaterial support, if needed.

The locations shall be established so that the staff of the territorial branches of RIO could easilymonitor the activities or offer specialised guidance to the beneficiaries.

The integration programmes for vulnerable persons, such as children, unaccompanied women, oldpersons and other disadvantaged persons, shall consist of measures adeguately tailored to theneeds of these persons. They shall focus in particular on the following issues:- enhancement of the communication with the public authorities, at both central and local level, andthe Romanian population;- providing conditions for equal treatment to children, unaccompanied women, old persons and otherdisadvantaged persons;- adopting durable solutions concerning accommodation, special social care, medical care,rehabilitation/psychological treatment, schooling etc. ;

- implementing measures to promote the involvement of vulnerable persons in the social, economicand cultural life of the society.ln any case, the selection of the TCNs to attend the integration activities shall be done based on anassessment of the individual needs.

For the Romanian language courses, the educational materials and evaluation procedures shall bedrafted in accordance with the Common European Framework for teaching foreign languages. Suchprojects shall provide for specialization of trainers in the field of teaching Romanian language andcultural orientation for adults.

Special emphasis shall be on disseminating relevant information to the targeted persons throughbrochures, leaflets, media channels, at both national and local level, in order to facilitate lheintegration process.

Most of the assistance shall be delivered through integrated schemes of assistance, rather thanaddressing a limited number of integration necessities of the TCNs. Regardless the approach, theimplementation of the integration programmes shall be supervised by the competent authorities, sothat the minimum standards and methodologies in this area are complied with.

d) Expected quantified results and indicators to be used:The expected impact of the action shall be an increased number of TCNs legally residing in Romaniaable to self-sustain and contribute to the social and economic life of our country.

The outcome of the action shall consist of increased opportunities for the social integration of theTCNs legally residing in Romania.

The outputs established at the level of the action shall be at least the following:- improved knowledge and skills of the TCNs aiming at their adaptation and self-sustaining in

the economic and social life of the host country;- improved knowledge of the Romanian language and of the Romanian values and features in

the TCN categories of persons;- improved assistance provided to the TCNs regarding Romanian courses, cultural orientation,

education, social and medical assistance and housing;' implementation of sufficient measures addressing the specific needs of the vulnerable

persons, such as old persons, children, women, disabled persons with a long stay visa or astay permit for the purpose of family reunification.

The following indicators should be used:- number of persons benefiting from educational courses;- number of persons being assisted in order to access medical services;- number of persons benefiting from medical and psychological care or other rehabilitation

measures;- number of persons benefiting from Romanian language and cultural orientation courses- number and types of materials drafted and used within the projects;- number of persons with special needs benefiting from specific programmes/assistance;- quantity and type of material assistance provided;- number of activities performed;- number of teachers identified and involved in courses dedicated to the TCNs;- number of children benefiting from specific activities/assistance.

e) Visibility of EU fundingFor all the activities, the EU logo and the indication on lF co-financing will be placed on the printedreport and all materials produced such as leaflets, publicity materials, PR work etc.Posters with information on lF cofinancing and the number and title of the project shall be placed atthe entrance and within the premises where courses and assistance activities are conducted, as wellas within the offices of the beneficiaries dedicated to the project.The items of equipment purchased within the projects shall be visibly marked with the EU logo andinformation on the project.

ACTION 3: Research centre in the field of integration of immigrants

The purpose of the action is to develop and maintain the documentation centre created in theprevious annual programmes as well as to provide research on the qualrty of the life of TCNs inRomania.

The action is expected to develop research tools, as well as data basis regarding the immigration inRomania, thus being related to Objective 5 (Better knowledge on the third-country nationals legallyresiding in Romania from the perspective of their integration in the society) of the Multi-annualProgramme 2007-2013.

Regarding the key strategic objectives identified lor 2012 and 2013 annual programmes, the actionrelates to the focus area "Foster the multilevel cooperation between the different levels of govemanceinvolved in the development of integration strategies and measures and encounging local action anda bottom-up approach to integration".

The current action is a follow-up of 1F2010/Action 3 "Research centre in the field of integration ofimmigrants".

The action addresses the need for quality and comprehensive knowledge on irnmigration/impact ofimmigrants on the Romanian society, from the social integration perspective.

The action shall support the functioning of a documentation centre in the field of social integration ofimmigrants. lt shall be opened to researchers, students and other relevant and interested personsand bodies. The centre shall interact with stakeholders in the field such as organisations involved inthe related projects and other initiatives, local and national authorities acting in areas relevant for theTCN social integration, other public or private bodies, as well as experts acknowledged at nationaland European/international level. The centre shall represent a focal point designed to coordinatecollaboration and exchange of information/good praclices between actors involved in researchdomains, policy and practice field .

The action shall develop and maintain a network of researchers from different scientific areas such associology, psychology, economics, law, anthropology etc., involved in the study of the immigrants'integration. ln this regard, there are expected partnerships between universities, researchers, andother stakeholders in Romania, as well as exchanges of good practices with partners from abroadrelated to research on immigration and integration issues.

The action shalloffer a literature review regarding the immigrants'integration from a multidisciplinaryperspective and propose a new approach on the conceptual framework and new research tools tostudy the integration processes of the immigrants in the Romanian society. Furthermore, studiesbased on the new conceptual framework and on the new research tools in the integration field areenvisaged.

ln the context of the legislative developments which involve directly or indirectly the immigrants withlegal stay in Romania, as well as of the numerous projects implemented in the area of socialintegration of TCNs financed from lF and ESF, a scientific research shall be conducted, to assess theimpact of these measures on the quality of life of the immigrants. The research, materialised in acomprehensive report, shall rely on various elements such as methodology, databases, target groupsand items (personal data, economic standard of the personifamily, perception of the changes, labour,perceived quality of life, leisure activities, inter-personal relations, woniesi/concerns and satisfaction in

relation to life).

To commit the allocation of this action, the Delegated Authority (RlO) shall act as an awarding body.The total eligible value of the action shall be supported as follows: 75% from EU contribution,maximum 20Yofrom the national budget and minimum 5% from the applicants.

The expected time for starting the projects is January 2013. The end date for the projects is 30 June2014.

a) Purpose and scope ofthe action:The purposes of the action are: (a) to sustain the TCN communities in Romania through facilitiesdedicated for educational, qocial and cultural activities; (b) to sustain the dialogue among the TCNcommunities and the national actors relevant for the integration of TCNs in Romania

The action aims to deveop information tools for TCN communities, cultural events, consultation withTCN communities, thus being related to Objective 7 (Creation of a inter-cultural environmentdesigned to facilitate the integration and the social cohesion) of the Multi-annual Programme 2007-2013.

Regarding the key strategic objectives identified lor 2012 and 2013 annual programmes, the actionrelates to the focus area "Foster the muftilevel cooperation between the different levels of governanceinvolved in the development of integration strategies and measures and encouraging local action anda bottom-up approach to integration'.

The action is a follow-up of the actions:- lF20O7 / Action 4 "Development of a consultation mechanism with the TCN communities";- lF2009lAction 4 "Support for the consultation mechanism with TCN communities";- lF20l0lAction 4 "Enhancement of the consultation mechanism with TCN communities"- 1F2011/Action 4 "Support for the consultation mechanism with TCN cornrnunities"

The current action promotes the participation of the TCN communities in the national legislativeprocess as well as in the decisions taken at local level in areas of public interest, giving the TCNcommunities the opportunity to express their opinion on their specific assistance needs, exchangeideas with other communities, dedicated organisations and authorities. Thus, consultations betweenthe TCN communities and the national and localactors (national and local authorities, NGOs etc.) areenvisaged.

Beside the dialogue process, the TCN communities shall be supported if promoting their values andcontribution to the social life of the country at national and local level. Therefore, the TCNs shall be

- -involved in social and cultural events and benefit from efficient information tools such as dedicatedweb pages and published media (such as quarterly magazines, informative bulletins etc.). At least aweb page and a quarterly publication, promoting values of immigrant communities and disseminatinginformation relevant for the social integration shall be available to the immigrants.

A multi-functional centre in Bucharest - the city registering the highest number of immigrants withlegal stay in Romania (approximately 22.000 persons), shall be created. lt shall be endowed withnecessary equipment and arranged to support various activities of the TCN communities, such ascultural and recreational events, delivering of assistance to persons according to their integrationneeds, educational activities etc. The facility is designed for all categories of TCNs, regardless theircitizenship, religion and culture and shall provide easy access to persons with disabilities.Administrative costs for the centre are envisaged as well.

The opening of the multi-functional centre shall be adequately promoted through an awarenesscampaign.

The creation of the multi-functional centre is seen as a pilot initiative and its results shall be used in

the drafting of the future annual programmes. Specifically, it shall be analysed the opportunity tomaintain this facility or even extend it to other representative cities in Romania.

Based on the available statistics, the action takes into account the needs of the TCN cornmunities ofat least $7 cities in terms of .counselling and information. At least 500 TCNs with legal stay in

Romania are expected to participate in the activities organised in the facilities created for cultural and

social activities, throughout the implementation period of this action.

The following outputs are established at the level of the action:- adequate communication ensured between the relevant authorities and the communities ofTCNs legally residing in Romania;- inter-cultural exchanges performed among the communities of TCNs legally residing inRomaniaiwith the Romanian population;- adequate participation of the TCNs, in particular young, qualified and highly qualifiedpersons in the social life;- values and cultural background of the TCN communities promoted;- creation of a multi-functional centre sustaining the cultural, recreational and social activitiesof the TCNs- an awareness campaign promoting the multi-functional centre perforrned at local level

e) Visibility of EU fundingln all consultation meetings, the EU logo and the indication on lF co-financing shall be placed on allmaterials produced such as leaflets, publicity materials, PR work etc. and the audience shall receivesuch information. The dedicated web page shall have features in conformity with the visibility rules.Posters with information on lF co.financing and the number and title of the project shall be placed

within the offices of the beneficiaries dedicated to the project.The items of equipment purchased within the projects shall be visibly marked with the EU logo and

information on the projecl.

The difference between the amount allocated to Priority 3 within Multi-annual Programme 20A7-2013and the amount allocated to this Priority within the Annual Programme 2011 is due to the revisedallocations communicated by the Commission in document SOLID/2010/20 REV2.Furthermore, following the consultation process with the relevant stakeholders, it was concluded thatre-allocations should be made among the priorities, as initially calculated in the MAP 20O7-2013, inorder to cover the existing integration necessities of the TCNs.

3. TECHN ICAL ASSISTANCE

3.1 Purpose of the technical assistanceThe purpose of the technical assistance is to provide financial support to the designated authorities infulfilling their duties, as stated in art. 15 of Decision 2OOBI4351EC.The technical assistance will support preparatory measures for calls for proposals, management,implementation, monitoring, visibility, risk analysis, evaluation, audit, information and controlmeasures, as well measures for the reinforcement of the administrative capacity of the designatedauthorities for the implementation of the Fund.The technical assistance budget, not exceeding the amount ol 4o/o of the total annual co-financingallocated to Romania plus EUR 30,000, will be commifted directly by the Romanian lmmigrationOffice, in compliance with the national legislation in the field of public acquisitions.ln order to commit the allocation for technical assistance, RIO shall draft a log frame matrix and afiche with the full description of the activities envisaged for technical assistance and submit it forapproval to the Responsible Authority. The Responsible Authority shall approve the fiche or, ifnecessary, send their observations to the Delegated Authority in order to revise it.Once the documents are approved, RIO shall revise its Annual Procurement Plan, including the newacquisitions in the document, and start to purchase the necessary supplies and services, according tothe provisions of the fiche.ln order to achieve the results provided in the Annual Programme, RIO shall conclude contracts withspecialized companies, applying the provisions of Emergency Government Decision 34i2006. Theact regulates the public procurement procedures for contracting supplies, services and works, as wellas the modalities to solve the appeals in relation with these procedures. lt is meant to: (a) promotecompetition among the economic operators, (b) guarantee equal treatment and non-discrimination ofeconomic operators; (c) ensure transparency and integrity of the public procurement process; (d)ensure efficiency in using the public funds, in procurement procedures concluded by the publicauthorities.According to the relevant legal provisions and the internal procedures in the field of publicprocurement, the Delegated Authority has the obligation to organize the call for tenders, by draftingtender dossiers, publicizing the procurements, and establishing evaluation committees. Further, it isresponsible for the technical management of the contracts. All activities are supervised by theResponsible Authority, which shall verify the documentation and designate observers for the specificactivities.

lf justified, in order to benefit from expertise in certain areas such as selection of proposals,monitoring and evaluation of projects etc., the Delegated Authority shall conclude contracts fortemporary assignment of experts, thus not applying the provisions of the public procurementprovisions.

The purpose of the technical assistance is to support the activities performed by the designatedauthorities (responsible authority, delegated authority, certification authority, audit authority) relatingto the measures stated under art. 16. 1 of the basic act.

ln all activities, the EU logo and the indication on European lntegration Fund co-financing will beplaced on all materials produced such as tender dossiers, handouts, presentations etc. and theaudience will receive such information. Such information will be placed on all equipment andmaterials procured from the resources dedicated to the technical assistance.Whenever a designated authority organizes an activity, as provided in section 4.2, it shall takeappropriate measures to ensure the visibility of the EU co-financing. For this purpose, it shall ask inadvance the Delegated Authority to provide/procure the necessary materials or services.Furthermore, an information activity shall be organised, as provided by art. 33(2Xa) of thelmplementing Rules, in order to present the achievements of the programme.The beneficiaries of the projects awarded in the "awarding body" mode shall have the responsibility toensure both the visibility of the EU funding, and of the projects themselves, committing the allocationsof the projects.
