The amendments to the CCP reflect and support an approach based on dispute prevention and resolution. What emerges from the preliminary provisionandsections1through7inthenewCodeisanoriginalciviljustice,unknown intermsofwhathasbeenfamiliar thus far. It requires learninganumberofnew foundationsandprinciples, suchas self-determination,communicationandcooperation.ThisworkshopprovidesuswithabettergraspofthephilosophyofthenewCodeandhelpstogaugeitsimpactonourpractice.

HOW TO MAKE THE MOST OF THE NEW DISPUTE SETTLEMENT PROVISIONS

WhenthenewCode of Civil Procedure(CCP)comesintoeffectinJanuary2016,itwillrequireadifferentapproachtodisputeresolutionandprevention. Essentially,itwillcallforavisionthatisresponsivetoachangingsocietyandthatputscitizensbackatthecentreofthejusticesystem.

Howarewetounderstandthesenewprovisionsandanticipatetheirimpactonourareasofpractice?Shouldwebequestioningourcurrentapproaches? Whatisbeingdoneelsewhere?

Comeandfamiliarizeyourselfwiththeseupcomingchanges:theyaregoingtoshiftthewaypeopleaccessjusticeinQuebecandwillsignificantlyimpactthewaythesystemevolves.Presentersatthesymposiumwillclarifythelaw,withregardforourdiverseareasofpracticeandvariedapproaches.

Thisone-daysymposiumisanopportunitytoreflectonyourpractices.Itwillansweryourquestionsabouttheimminentchangesandtheirimpactonyourworkasaprofessional,lawyer,advisor,arbitrator,mediatorormanager.

Thisworkshopproposesacommunications-basedapproachtoconflictthatcallsforacomplex,relationalvisionofdisputesthatgoesbeyondlitigation.Often the source of numerous conflicts, communication is also the most powerful means of resolution. During the discussion, participants will bemadeawareofthevarioustoolsandstrategiesthatsupportchangethroughdialogue.Throughanunderstandingoftheimpactoflanguagingandcertainstrategic issues,mediationpractitionerswillhave the resources theyneed totakeaproactiveandconstructiveapproachthatfosterscooperationandownershipoftheissuesbytheparties.

In 2011, Australia took an innovative step by adopting the Civil Dispute Resolution Act. This new legislation obliges mediation practitioners and prosecutorstoshowthateffortshavebeenmadetotrytoresolveissuesindisputebeforeproceedingsareinstitutedintheFederalCourtofAustralia.Thisishowthelegislatorhasensuredthat“genuinestepstoresolvedisputes”aretakenbeforelegalaction.

Participantsatthissessionwillhearabouttheimpactofthesenewprovisionsonthepracticeoflaw,andthehistoryofpre-litigationmediationproceduresastheyhaveevolvedinAustraliaoverthelast30years.Thepresentationwillhighlightlessonslearnedandidentifyresultingbestpractices.(This session will be conducted in English, with simultaneous interpretation.)
