WhenthenewCode of Civil Procedure(CCP)comesintoeffectinJanuary2016,itwillrequireadifferentapproachtodisputeresolutionandprevention. Essentially,itwillcallforavisionthatisresponsivetoachangingsocietyandthatputscitizensbackatthecentreofthejusticesystem.
Howarewetounderstandthesenewprovisionsandanticipatetheirimpactonourareasofpractice?Shouldwebequestioningourcurrentapproaches? Whatisbeingdoneelsewhere?
