NOTICENotice is hereby given that the 54th Annual General Meeting of the BASIC CHEMICALS,COSMETICS AND DYES EXPORT PROMOTION COUNCIL, Mumbai will be held on Friday the 15th September, 2017 at 11.00 a.m. in the Conference Room of the Council (Jhansi Castle, 4th floor, 7 Cooperage Road, Mumbai-400 001) to transact the following as per Article 34.2 of the Byelaws of the Council.

a. Annual Report of the Working Committee for the year ended as on 31st March, 2017

Dear Esteemed Member Exporters,

First of all, I have immense pleasure to inform my colleagues that I have taken over as Chairman of CHEMEXCIL w.e.f. 30th January, 2017 with the active support and cooperation of all of you. I am honored to have been selected and I am very much looking forward to taking on this important role. CHEMEXCIL is a premier chemical export promotion council and we must always aim to improve our chemical exports and evolve to secure its future both in terms of the volume and value.

CHEMEXCIL has been playing a pioneering role in the promotion of exports of Dyes and Dye Intermediates, Basic Inorganic & Organic Chemicals, Including Agrochemicals, Soaps, Detergents, Cosmetics, Toiletries, Essential Oils and Castor Oil & Speciality Chemicals from India to various countries abroad.

The global chemical industry, estimated at U.S. $ 4.3 trillion, with Indian chemical industry accounting for US$ 147 billion in 2015. The last few decades have witnessed the chemical industry gravitating towards Asia, making India a key player in the global markets.

The chemical industry in India is a key constituent of Indian economy, accounting for about seven per cent of the GDP. The Indian chemical industry is one of the most diversified sectors and covers more than 80,000 commercial products. In terms of volume of production, Indian chemical industry stood as 3rd largest producer in Asia and 12th in world. Indian chemical industry could grow at 14 per cent p.a. to reach size of USD 350 billion by 2021. Indian Chemical industry is 6th in the World and 3rd in Asia in value added terms at constant prices. India accounts for approximately 7 per cent of the world production of dyestuff and dye intermediates, particularly for reactive, acid and direct dyes. India is currently the world’s third largest consumer of polymers and fourth largest producer of agrochemicals.

I would like to inform you that export performance of items under CHEMEXCIL purview for the period April 2016 to March 2017 were USD 12.15 billion as against USD 11.68 billion for the year 2015-16 registering a growth of 3.98 per cent. As regards volume wise export performance of the said items for the similar period, there is an increase of 13.49 per cent.

I would like to thank the Hon’ble Minister of Commerce & Industry, Smt. Nirmala Sitharaman convening the meeting on 6th April 2016, so as to seek views and suggestions from all stakeholders on continuous declining trend in exports since last few months and to take effective steps to arrest the same for faster export growth. Let me also thank Smt. Rita Teaotia, Commerce Secretary for her initiative in addressing various issues (including removal of “Proof of Landing” requirement

for MEIS claim) being faced by exporters. The dispensing of the requirement proof of landing for MEIS will reduce transaction costs of the exporters and improve their competitiveness

As far as Foreign Trade Policy 2015-20 is concerned, the Mid-Term Review is expected in the later part of this year. In this regard, the O/o DGFT New Delhi had also invited the Council for consultations wherein we have given comprehensive suggestions regarding enhanced support in MEIS, allowing MEIS on cases wherein exporters have ticked “N” in Shipping Bill post 30/09/2015, Faster fixation of Norms for chemical sector, removal of Cap on Incremental Exports Incentivisation Scheme for 2013-14 etc. and various other suggestions for ease of doing business. Further, since GST is expected to roll out in few months, exporters are also concerned about the status of FTP 2015-20 schemes and other existing duty exemptions against Form H, CT1 etc under GST framework and urge government to provide suitable provisions under forthcoming GST framework also so that exporters competitiveness is not adversely impacted. We sincerely hope that the concerns of industry are addressed in the forthcoming Mid-Term Review of Foreign Trade Policy 2015-20.

The Union Budget 2017-18 focuses on boosting the trade and industry. The reduction in corporate tax for MSME by 5% and introduction of Trade Infrastructure Export Scheme will help Indian exporters reduce transaction costs to become globally competitive.

Regarding Duty Drawback AIR review, the council had facilitated the yearly exercise of export import data compilation and submitted to DBK dept for AIR review/increase. However, despite our efforts and presentation before DBK Committee, the DBK rate has been reduced from 1.9% to 1.5% which is a matter of concern and impacts competitiveness of our exporters. The council has sent representation for reinstatement of earlier rate of 1.9% and awaits government support.

I also thank the government for facilitating reinstatement of EU GSP on exports of some of the chemical items to EU from 1st January 2017 and also implementation of REX system which will reduce transaction costs. However, organic and inorganic chemicals are still not covered under GSP, so we request inclusion of same in EU GSP.

As an export promotional measure, CHEMEXCIL had participated in various international exhibitions and Buyer-Seller Meets both abroad and in India for the benefit of member exporters to increase their exports. One of the major exhibitions held abroad, the Council had participated in the CHINA INTERDYE 2016 show at Shanghai, China from 13-15th April, 2016 and had organized CHEMEXCIL’S India Pavilion in the show. China Interdye is a world famous exhibition for Textile Chemicals and Dyestuff Industry. CHEMEXCIL’s India Pavilion was inaugurated by H.E. Shri. Prakash Gupta, Hon’ble Consul General, Consulate General of India in Shanghai. It was a grand success and well attended by the local prospective customers as well as overseas agents who were keen on co-operation with reliable suppliers/ exporters from India.

The Council had organized India Pavilion in CHEMSPEC EUROPE 2016 (The Fine & Specialty Chemicals Connection) held on 1- 2nd June, 2016 at Basel Messe, Basel, Switzerland, wherein 54 member-exporters had exhibited their products. Chemspec Europe is a world famous exhibition for Specialty Chemicals. Europe is the leading market for Indian Specialty chemicals followed by USA, China and Japan. CHEMEXCIL is participating in this event and organizes India Pavilion. The India Pavilion is inaugurated by Mr, Ravindra P Jaiswal, Dy. Chief of Mission, Embassy of India, Bearn, Switzerland.

Further, as a part of export promotional activities, CHEMEXCIL had successfully organized a Buyer-Seller Meet at Sao Paulo, Brazil on 17th October 2016. 32 Member-exporters participated in this Meet.

The Council has organized Indian Chemicals and Cosmetics Exhibition at Buenos Aires, Argentina on 19th -20th October-2016. Altogether 40 CHEMEXCIL member exporters participated in this exhibition. 200+ visitors from Argentina and surrounding countries visited this exhibition.

As you are all aware, the Government of India has taken several initiatives aimed at eradicating corruption and black money from our country. In order to give push to its dream pet project “Digital Campaign”, the Government has directed all Departments to make cashless transactions/payment through electronic mode only. The Council has already taken necessary initiative and advised the members to make online payments through NEFT and RTGS and CHEQUE payments. Members are also requested to adopt cashless transactions for their operations as per the guidelines issued by the Government.

I am happy to inform you that the Government has proposed introduction of Goods and Services Tax (GST) which would be one of the pioneering and game changing transformative initiatives taking shape in our country. It is also expected that the GST will boost domestic demand as also create more opportunities for domestic business in addition to make Indian economy more robust. Taking into account on the importance of the above as also for creating awareness on the GST for the benefit of member-exporters, CHEMEXCIL had organized seminars on “Model GST Law covering critical issues impacting the Chemical Industry” and on “Forex Management & Hedging at Ahmedabad, Kolkata, Mumbai.

Further, for capacity building we have also organized seminars on “Handling of Dangerous Goods Transportation (By Sea & Road)” along-with IIP, in Mumbai, Vadodara and Dahej. Similarly, seminars on “Free Trade Agreement” where organised in Ahmedabad and New Delhi and a seminar on “Customs Procedures for Export/Import” was organized in Mumbai.

I take this opportunity to thank the Ministry of Commerce & Industry, specially Shri Sunil Kumar, Joint Secretary, Ministry of Commerce & Industry, for taking initiative in organizing the 2nd edition of CAPINDIA Exhibition which was held from 21st -22nd March 2017 at Hall 6 Bombay Exhibition Centre, Goregaon, Mumbai. The exhibition was jointly organized by four Export Promotion Councils, viz. CHEMEXCIL , PLEXCONCIL, CAPEXIL, SHEFEXIL under the aegis of the Department of Commerce, Government of India, supported by Department of Chemicals and Petrochemicals, Ministry of Chemicals & Fertilizers, Government of India. CAPINDIA 2017 Exhibition was one of the largest showcasing and networking event to boost the Chemical, Plastic, Construction Industry Shellac & Forest Products sector under the “Make in India” initiative and establish its presence in the global market. The initiatives of Make in India and the CAPINDIA are very much relevant in today’s scenario in terms of building and enlarging our manufacturing base and targeting the world as our market. The Exhibitionl has received overwhelming response from members and more than 375 Exhibitors covering manufacturers/exporters showcasing a range of Industrial & agricultural inputs, Consumer items, Packaging items, Plastics processing machinery under the purview of, CHEMEXCIL, PLEXCONCIL, CAPEXIL and SHEFEXIL. The event was inaugurated on 20th March-2017 by chief guest Smt. Rita Teaotia, IAS, Commerce Secretary, Department of Commerce, and Ministry of Commerce & Industry, Guest of Honour Shri. Subhash Desai, Hon’ble Cabinet Minister of Industries & Mining, Government of Maharashtra in the presence of Dr. Sonia Sethi, IAS, Additional Director General of Foreign Trade, Mumbai, Shri. Sunil Kumar, IAS Joint

Secretary, EP (CAP), Mr. Satish Wagh-Chairman-CHEMEXCIL, Mr. Pradip Thakkar, Chairman-PLEXCONCIL, Mr. Ramesh K. Mittal-Chairman-CAPEXCIL and Sumit Kumar Ghosh-Chairman -SHEFEXCIL. All four council has invited more than 180 foreign buyers from 36 countries including Ghana, Kenya Uganda, Tanzania, Ethiopia, South Africa, Vietnam, Thailand, Indonesia, Malaysia, Myanmar, Russia, Kazakhstan, Tajikistan, Chile, Brazil, Argentina, Guatemala, Colombia, Tunisia, Sudan, Israel, Egypt, Syria, Morocco, Algeria, Yemen, Nepal, France, Pakistan, Bangladesh, Malawi, Sri Lanka, Sierra Leone, Oman, China.

I have pleasure to inform you CHEMEXCIL also organized its 45th Export award function on 24th March-2017 at Jade ball Room, Hotel Sahara Star, Vile Parle, Mumbai. CHEMEXCIL Export Awards pay tribute to the achievements and contributions of export companies have made to the Indian economy. The awards celebrate export excellence through leadership and innovation. The awards were presented by Smt. Nirmala Sitharaman, Hon’ble Minister of State (Independent Charge) Commerce and Industry, Govt. of India along with Members of the Committee of Admn. of CHEMEXCIL. Shri. Shankar Bhai Patel from AMI PHTHALO PIGMENTS and Shri. Ashok Manilal Kadakia from EMMESSAR BIOTECH & NUTRITION LTD are the life time achievement award winners. I on behalf of CHEMEXCIL committee of administration congratulate all the export awardees for their valuable contribution in Indian Economy.

CHEMEXCIL is publishing bi-Monthly bulletin “CHEMEXCIL NEWS” incorporating Chemical news related to exports, imports, statutory issues, Major activity related to chemicals and its trade, Port, Custom issues, meeting with any government officials on related issues major achievement of member-exporters, etc. CHEMEXCIL also issues e-bulletin for the benefit of member-exporters, specially to disseminate information about the activities of Council and various EXIM updates.

I am happy to inform you that CHEMEXCIL has launched SMS alert service and CHEMEXCIL Mobile apps. Now stay connected with CHEMEXCIL through our SMS Alert and Mobile application facility.

I also invite suggestions/views, if any, from our member-exporters on the export promotional activities of the Council so as to improve it further for the benefit of all of you.

Some of the major points discussed/decisions taken in the above meetings are listed below:

• In the first meeting of the Committee of Administration of the Council held on 15th June, 2016, while discussing the steps undertaken to increase the Membership Drive of the Council, as suggested by the Jt. & Organic Chemicals, Including Agro Chemicals, Shri Abhay Udeshi - Castor Oil Panel, Dr. Smita Naram- Cosmetic Panel, Shri Bhalla also mentioned that the members of the Sub-Committee should work out and propose/formulate a Policy for the respective Panel, supported by the Secretariat of the Council and come back with their ideas/feedback.

• Re-election of Vice-Chairman of CHEMEXCIL, was conducted under the supervision of Returning officer for election, Shri A K Jha, Jt. DGFT, Mumbai Shri Satish Wagh of M/s. Swastik Industries, Mumbai was elected unopposed as Vice Chairman of the Council for the period 2015-17.

• Decided to organize the second edition of CAPINDIA 2017 on 20-22 March 2017 and CHEMEXCIL as lead Council as per the directive of the Ministry of Commerce & Industry and instructed the Secretariat to book the Venue at Bombay Exhibition Centre, Mumbai. It was also decided to organize the 3rd edition of CAPINDIA 2018 during 20th-22nd March , 2018.

• The Tata Strategic Management Services (TSMS) has been assigned to develop “5-year Export Strategy and a vision document for CHEMEXCIL” based on the 4-digit level data of all panels covered under the purview of the Council, To understand the key pain points for Indian Chemical exports, To conduct demand analysis of its product panel by target countries (10 countries), to analyses competitor countries for the target markets (FTA’s, Tariffs) to develop an export strategy, highlighting key product panels/categories by target countries and develop a document covering vision, mission & objectives, recommendations for industry members and policy measures for government.

• In the 3rd meeting of the Committee of Administration held on 18th November, 2016 at Ahmedabad, CHEMEXCIL had invited Shri Bipin Patel President - Gujarat Chamber of Commerce and Industry, Gujarat, Shri Shanker Patel Chairman CEPT Vatva, Gujarat and Shri Shailesh Patwari, Sr. Vice President - Gujarat Chamber of Commerce and Industries, Special Invitees, the purpose of which was to identify crucial problems faced by the industry on environmental issues and find out corrective measures. Joint Secretary informed that he will strongly take up these issues with the concerned authorities and if required he will call meeting with concerned Ministry.

• In the 4th Meeting of the Committee of Administration of the Council for the year 2016-17 held on 30th January 2017 at Mumbai. Shri Satish Wagh, Vice Chairman has taken over the charge as Chairman of the Council for a period of two years since the tenure of Dr. B.R. Gaikwad, as Chairman has completed the period of two years and as per the Clause 2.92 of the Foreign Trade Policy 2015-20, the Vice Chairman will automatically become Chairman of the Council.

• Declared to conduct elections for the vacancies to be filled in with respect to Panel I – Dyes & Dye Intermediates - Status Holder Category, Panel II- Basic Inorganic & Organic Chemicals including Agrochemicals - General Category and Panel III - Cosmetics, Toiletries & Essential Oils- Category Status Holder and thereafter conduct the election for the post of Vice Chairman.

• Formed an Award Sub Committee consisting of Shri Satish Wagh, Chairman, Shri Ajay Kadakia, Chairman M.E. Panel, Shri Abhay Udeshi, Chairman, Castor Oil Panel and Shri Bharat Mehta, Member to finalize the nominations received for Export Awards for the year 2015-16.

• CHEMEXCIL had successfully organized its Export Award Function for the year 2015-16 on 24th March, 2017 at Hotel Sahara Star, Vile Parle, Mumbai wherein the Chief Guest was Hon’ble Minister of State for Commerce & Industry, Smt. Nirmala Sitharaman.

EXPORT PROMOTIONAL ACTIVITIES

REACH:

CHEMEXCIL has been appointed by the Ministry of Commerce & Industry as a Nodal Agency for Pre-registration and Registration of substances of the firms under EU’s REACH regulation (Registration, Evaluation and Authorization of Chemicals).

Accordingly, during the 2nd phase of Registration deadline i.e. in 2013, 69 companies registered their 135 substances through the Only Representatives (OR) appointed by CHEMEXCIL.

The Council recommended Ministry of Commerce & Industry for disbursement of 50% of ECHA Registration Fee incurred to 69 firms who had made their claims through CHEMEXCIL for their 135 substances.

The Ministry thereafter sanctioned and released 50% of ECHA Registration Fees of the aforesaid 69 firms which has been already disbursed 66 concerned firms who had registered their substances in the EU during the said registration deadline and had submitted the registration claims through CHEMEXCIL.

REGISTRATION OF PRODUCTS ABROAD (AGRO CHEMICALS):

The Council received the applications from the member-exporters for registration of their Agrochemical products abroad. The applications were accordingly recommended to Ministry of Commerce & Industry for disbursement of 50% of the registration charges for Agrochemical products registered in various countries. OVERSEAS TRADE DISPUTES/ COMPLAINTS:

The Council received representations from exporters on overseas trade disputes related to delay in exports payment, supply of sub-standard materials etc. As a follow-up action, letters were sent to concern Indian Missions abroad for intervention.

INFORMATION TO MEMBERS:

The Council disseminated information to member-exporters pertaining to DGFT/CBEC/RBI Circulars and Notifications. Information received on Anti-Dumping Investigations, TBT/SPS Measures etc were also passed on to the members as well as uploaded on website.

INTERNATIONAL TRADE ENQUIRIES:

International Trade Enquiries received by the Council from potential importers and Indian Missions abroad were circulated to concerned Manufacturers Exporters and also uploaded our website.

NON PREFERENTIAL CERTIFICATE OF ORIGIN:

A number of Member-Exporters are approaching the Council requesting for issuance of Certificates of Origin (Non-preferential) and attestations connected with documents like Export Invoice, etc. in respect of their products exported by them to various overseas countries. The Council scrutinizes the said documents received from them and issues certificates accordingly.

During the years under view, 183 Certificates of Origin (Non-preferential were issued to the member exporters).

VISA RECOMMENDATION LETTERS:

A number of applications are being received by the Council from the Member-Exporters from time to time requesting for recommendation letters to various foreign missions in India for issuance of Visa in favour of their officials as also Officers of the Council, for their visit abroad in connection with export promotional activities. Their applications are being scrutinized by the Council and Recommendation letters are issued to them accordingly.

During the year under review, 110 Recommendation letters for Visa were issued by the Council to various Foreign Missions in India in favour of our Member-exporters as well as Officers of the Council.

CHEMEXCIL’S COMPLETED EVENTS DURING THE YEAR 2016-17 UNDER MDA

Brief About Each Event

1. Iran Beauty & Clean 2016 held on 24th -27th April, 2016 in Tehran, Iran

The trade show IRAN BEAUTY & CLEAN – International Exhibition of Detergent, Cleanser, Hygienic, Cellulose Products and Machinery was hosted at Tehran Permanent Fairgrounds, Tehran, Iran from 24th to 27th April, 2016.

The emphasis of IRAN BEAUTY & CLEAN lies on Detergents and Cleanser Products, Skin and Hair Care Products, Perfumes, Eau De Cologne and Spray, Hair Colours, Cellulose and Hygienic Products, Fresheners, Insecticides, Home Hygienic Products, Bags, Shoes and Leather Care Products (Polish), Raw Materials, Tools and Accessories for Hair Salons, Trade and Consulting Services, Machinery and related Industries.

CHEMEXCIL had participated in the event with 12 Indian Member Exporters.

2. AgroChemex Myanmar 2016 held on 8th & 9th June, 2016 in Yangon, Myanmar

The 8th International Exhibition & Southeast Asia Crop Protection Forum, AgroChemex Myanmar (Agro Myanmar 2016) was held at Myanmar Convention Centre (MCC), Yangon, Myanmar on 8th & 9th June, 2016. The expo is supported by the Myanmar Ministry of Agriculture and Irrigation, The Republic of the Union of Myanmar, Federation of Commerce and Industry (UMFCCI).

The tradeshow aimed to provide a useful commercial platform for exhibitors and visitors from all related fields to cooperate and build up a firm position for their business in the growing market of Myanmar. Agro Myanmar 2016 was targeted to attract those in Agrochemicals and Crop Protection Products, Agriculture Chemicals, Chemical Fertilizers, Crop Protection and Biotechnology, Agricultural Mechanical Equipment’s and Agricultural Products.

Mr. Aung Kyaw Do, Director (Head of Plant Protection Division), Ministry of Agriculture and Irrigation, Department of Agriculture attended the inaugural ceremony and visited the exhibition.

Council had participated in the Exhibition with 12 Indian Member Exporters.

3. In Cosmetics Korea Exhibition held on 6th & 7th July, 2016 in Seoul, South Korea

In Cosmetics Korea Exhibition is the only exhibition in South Korea dedicated to the personal care ingredient was held at Hall B of the COEX Exhibition and Convention Centre, Seoul, South Korea on 6th & 7th July, 2016.

The visitor profile included finished cosmetic product manufacturers, Raw material suppliers, sales & marketing professionals, Scientists and Consultants, Research Institutions and Distributors.

Mr Mijito Vinito, Second Secretary, Embassy of India, Seoul, South Korea visited CHEMEXCILs Indian Pavilion.

Council had participated in the Exhibition with 14 members-exporters. Total 6152 visitors attanded this show.

4. Indian Chemicals and Cosmetics Exhibition held on 28th & 29th July, 2016 in Dar Es Salaam, Tanzania

Indian Chemicals and Cosmetics Exhibition was held at Mlimani Conference Centre, Dar Es Salaam, Tanzania on 28th & 29th July, 2016. The exhibition turned out to be a platform for meeting potential buyers, dealers and end users of Chemicals, Agrochemicals, Cosmetics and Dyes from Tanzania.

MOU was signed between CHEMEXCIL and TCCIA ( Tanzania Chamber of Commerce, Industry and Agriculture) on 29th July, 2016 with the purpose of developing the contacts between both institutions as a means of contributing to the further development of Trade and Economic relations between INDIA and TANZANIA in new context.

Council had participated in the Exhibition with 46 CHEMEXCIL Member Exporters exhibited in the exhibition.

5. Buyer Seller Meet held on 1st August, 2016 at Kampala, Uganda.

CHEMEXCIL had organized a Buyer Seller Meet at Hotel Fairway, Kampala, Uganda on 1st August, 2016. Agrochemicals and Cosmetics are the sectors where India has a lot to offer and the economy of Uganda has great potential and it appeared poised for rapid economic growth and development. A joint venture in terms of manufacturing is an ideal business as trading becomes more expensive since it is a land locked country.

The HE Mr. Ramesh Chandra, High Commissioner visited the BSM. He was keen on setting up the manufacturing units in Uganda by Indians.

28 Indian Companies with 35 delegates participated in the event.

6. Buyer Sellers Meet at Addis Ababa, Ethiopia held on 3rd August, 2016

CHEMEXCIL had organized Buyer Seller Meet at Hotel Hilton Addis Ababa, Ethiopia on 3rd August, 2016.

Mr. Ashok Kumar, Charge D’ Affairs, Embassy of India, Mr. Vijay Kumar, First Secretary, Embassy of India, Ethiopia, Mr. Kuma Dhaba, Advisor & Expert, Investment Commission & Dr. Temesgen, Advisor to PMO, Government of Ethiopia were the Special Invitees during the BSM.

CHEMEXCIL BSM witnessed 210 buyers from Ethiopia. 28 Indian Companies with 35 delegates participated in the event.

7. Agri Business Global Trade Summit 17th -19th August, 2016 USA

Council has participated in the Agri Business Global Trade Summit held at Caribe Royale Hotel, Orlando, Florida, USA from 17th - 19th August, 2016.

The Agri Business Global Trade Summit is a global sourcing event for Crop Protection and Plant Health Products. It’s core attendees included more than 140 exhibitors from China, India, The United States, Eu and Southeast Asia and offer both Technical-Grade and Formulated Crop Protection Products, Bio Pesticides, Bio Stimulants, Micronutrients, PGRs and more.

Council had participated in the Exhibition with 11 Member Exporters.

8. Viet Beauty 2016 held from 18th-20th August, 2016 at Ho Chi Minh, Vietnam

CHEMEXCIL had participated in “Vietnam’s Premier International Beauty Show-VIETBEAUTY” held at Saigon Exhibition and Convention Centre (SECC), Ho Chi Minh City, Vietnam from 18th- 20th August, 2016. The purpose of this exhibition was to create a positive brand image of Indian cosmetics products in Vietnam.

The emphasis of VIETBEAUTY laid on the main / business sectors i.e. Detergents and Cleanser Products, Skin and Hair Care Products, Perfumes, Eau De Cologne and Spray, Hair Colours, Cellulose and Hygienic Products, Fresheners, Home Hygienic Products, Raw Materials, Tools and Accessories for Hair Salons, Trade and Consulting Services.

CHEMEXCIL took part in this event along with 16 member exhibitors.

9. 25th Dye +Chem Bangladesh 2016 International Expo 31st August -3rd September, 2016 Dhaka, Bangladesh

CHEMEXCIL had participated in 25th Dye+Chem Bangladesh 2016 International Expo organized by CEMS-Global USA/ Bangladesh at Bashundhara Convention City, Dhaka, Bangladesh from 31st August to 3rd Sept, 2016.

Dye+Chem Bangladesh exhibition is an gateway to the Dyes and Fine & Specialty Chemicals sector of Bangladesh and a perfect B2B platform for overseas manufacturers of Dyes & Dyes Intermediate, Basic Chemicals to showcase their products under one roof.

CHEMEXCIL’s India pavilion was visited by Dr. Adarsh Swaika, Deputy High Commissioner of India to Bangladesh, HCI, Dhaka & Shri Shishir Kothari- First Secretary (Commerce). The members-exporters were happy to interact with the visiting dignitaries.

Council had participated in the exhibition with 25 Indian exporters to promote Brand India.

The Dye+Chem 2016 exhibition evinced good response with more than 150 visitors to CHEMEXCIL stall/ pavilion. These visitors were from local Bangladeshi companies and other markets who were interested in co-operating with Indian companies.

10. Buyer Seller Meet on 17th October, 2016 at Brazil

CHEMEXCIL had organized Buyer Seller meet at Melia Hotel (Salas Paulistas), São Paulo, Brazil on 17th October-2016.

The BSM was inaugurated by Mr. Jitendra Rawat, Consul, Consulate General of India, Sao Paulo, Brazil on 17th October-2016 along with Dr. B.R. Gaikwad, Chairman, CHEMEXCIL, Mr. Fernando Figueiredo ABIQUIM President & Mr. Dilson Ferreira – ABRAFATI President.

The BSM concentrated on Dyes and Dye intermediates, Organic, Inorganic Chemicals including Agrochemicals, Specialty Chemicals, Soaps Cosmetics and Toiletries Essential Oil Castor Oil and its Derivatives.

About 264 meetings in one day was held among 32 Indian companies and 45 Brazilian companies.

CHEMEXCIL had organized Indian Chemical and Cosmetics Exhibition at Sheraton Buenos Aires Hotel & Convention Center, (San Telmo-Exhibition Hall), Buenos Aires, Argentina on 19th -20th October-2016.

The exhibition focused on Dyes and Dye intermediates, Organic, Inorganic Chemicals including Agrochemicals, Specialty Chemicals, Soaps, Cosmetics and Toiletries, Essential Oil, Castor Oil and its Derivatives industry.

The Exhibition was inaugurated by Mr. Sanjiv Ranjan, Ambassador, Embassy of India, Buenos Aires, Argentina on 19th October-2016 along with Dr. B.R. Gaikwad, Chairman, CHEMEXCIL and Mr. Ignacio Dos Reis, CAPQ, (Cámara Argentina de Productos Químicos). The exhibition was supported by local Chamber of Commerce viz. Cámara Argentina de Productos Químicos, Argentina Chamber of Chemicals.

12. Buyer Seller Meet 21st February, 2017 Malaysia

Council had organized Buyer Seller Meet at Renaissance, Kuala Lumpur, Malaysia on 21st February, 2017 with active support of High Commission of India, KL Malaysia and ASC Agenda Suria Communication Sdn. Bhd,. Malaysia.

CHEMEXCIL’s BSM was graced by H.E Shri T.S. Trimurti, High Commissioner of India to Malaysia who was also the Chief Guest for the opening ceremony. The event was also graced by Shri Nikhilesh Giri, Deputy High Commissioner of India to Malaysia, Shri Bramha Kumar- First Secretary (Commerce), HICOM- KL, Shri Sasi Kumar- Attache (Com) HICOM-KL, Shri Jag Rao, Simancha, CEO, ASC, Dato Shri J Palaniappan, Council Member (MFM), Shri Norsalan Hadi Abdul Kadir, Deputy Director, MATRADE and others.

Total 29 delegates participated in the BSM under the umbrella of CHEMEXCIL. The BSM event evinced good response with around 95 Malaysian visitors from diverse sectors of end-user industries who are potential buyers of Indian delegates and were interested in co-operating with Indian companies.

13. Buyer Seller Meet 23rd February, 2017 Singapore

Council had organized Buyer Seller Meet at Suntec Convention & Exhibition Centre, Singapore on 23rd February 2017 with active support of High Commission of India, Singapore and De Ideaz Pty Ltd., Singapore.

CHEMEXCIL’s BSM was graced by Dr. Pradyumn Tripathi, First Secretary (Commerce), High Commission of India to Singapore who was also the Chief Guest for the opening ceremony. The event was also attended by Shri Nirmesh Kumar, Attache (Com) HICOM-Singapore and others. Dr. Tripathi also interacted with the delegates and inquired about their current business and wished them well.

Total 26 delegates participated in the BSM under the umbrella of CHEMEXCIL. Around 63 Singapore visitors from diverse sectors of end-user industries who are potential clients for Indian delegates and were interested in co-operating with Indian companies.

Council had participated in CHEMSPEC INDIA 2016 held on 7th-8th April, 2016 at Hall No. 1, Bombay Exhibition Centre, NSE Complex, Goregaon, Mumbai.

Major Industry Sector Covered in CHEMSPEC INDIA are Specialty Chemicals, Dyes, Pigments & Intermediates, Cosmetics Chemicals, Water Treatment Chemicals.

CHEMEXCIL provides a wide spectrum of services to Trade and Industry and acts as a catalyst for growth of India’s Trade for promoting Dyes and Dye Intermediates, Basic Organic and Inorganic Chemicals, Soaps, Detergents, Cosmetics, Toiletries and other products like Essential Oils, Castor Oil etc.

15 member exporters had participated in the said exhibition through CHEMEXCIL. Nearly 76 visitors visited the CHEMEXCIL pavilion.

2. China Interdye Exhibition 2016

Council had participated in 16th China Interdye Exhibition 2016 held at Shanghai World Expo Exhibition & Convention Centre (SWEECC), Shanghai, China from 13th -15th April 2016

The profile of exhibits included Dyestuffs, Whitening agents, Intermediates, Auxiliaries, Pigments, Textile Chemicals and Instruments & equipment’s. The exhibition occupied an area of 40,000-square meter and was held in two Halls namely Hall 1 & 2 of SWEECC with a year-on-year growth of 8.1%.

CHEMEXCIL’s India pavilion was inaugurated by His Excellency Mr. Prakash Gupta, Consul General of India to Shanghai who also visited the India Pavilion and interacted with the exhibitors.

CHEMEXCIL had organized an India Pavilion which was spread over an area of 1497 sq.m. in the two Halls 1 & 2 with 110 companies participating in the exhibition.

3. CHEMSPEC EUROPE Exhibition held on 1st & 2nd June, 2016 at Basel, Switzerland.

CHEMEXCIL participated in Chemspec Europe-2016 exhibition organized by M/s. MACK BROOKS EXHIBITIONS LIMITED UK, at Hall 1.1, Basel Messe, Basel, Switzerland on 1st-2nd June-2016.

The exhibition aimed at the industries based on Agrochemical Intermediates, Biotechnology, Catalysts, Colours & Pigments, Flavours & Fragrances, Organic Intermediates, Photographic Chemicals and Water Treatment Chemicals, International Trade Missions are the target visitors.

CHEMEXCIL Pavilion was inaugurated by Shri. Ravindra P. Jaiswal Dy. Chief of Mission, Embassy of India, Bern, Switzerland along with Dr. B.R. Gaikwad, Chairman, CHEMEXCIL.

54 CHEMEXCIL member-exporters participated in this exhibition.

4. 9th India Chem 2016 held from 1st -3rd September, 2016 at Mumbai, India

CHEMEXCIL had participated in the 9th edition of the INDIA CHEM exhibition that took place from 1st – 3rd September, 2016 at Hall 1 of the Bombay Exhibition Centre in Mumbai. It is the largest event of Chemicals and Petrochemical Industry in India which is jointly organized by the Department of Chemical and Petrochemicals, Government of India and Federation of Indian Chamber of Commerce (FICCI).

The show was inaugurated by the Hon’ble Union Minister for Chemicals and Fertilizers, Mr. Ananth Kumar.

In order to popularize and promote our exports of the items covered under the purview of CHEMEXCIL viz. Dyes & Dye Intermediates, Inorganic & Organic Chemicals including Agrochemicals, Cosmetics & Toiletries, Essential Oils, Castor Oil etc. as also to assist our member-exporters to explore the market potential in various countries, the Council had organized a CHEMEXCIL Pavilion by booking 108 sq. mtr. space in this exhibition.

The Council had organized free consultations for its member-exporters and visitors of the exhibition on two important topics namely “FOREIGN TRADE POLICY MATTERS, FREE TRADE AGREEMENTS & CUSTOM PROCEDURES” on 1st Sep, 2016 and “HANDLING OF DANGEROUS GOODS (CHEMICALS) TRANSPORTATION BY SEA AND ROAD” on 2nd Sep, 2016.

Under the umbrella of CHEMEXCIL, 10 member-exporters booked their stalls in the CHEMEXCIL Pavilion and exhibited their products.

5. 18th China International Agrochemical & Crop Protection Exhibition held at SNIEC, Shanghai, China during 1st - 3rd March, 2017.

The 18th China International Agrochemical & Crop Protection (CAC 2016) exhibition was held from 1st -3rd March 2017 at the Shanghai New International Expo Centre (SNIEC) in Shanghai, China. This event was held concurrently with the 18th China International Agrochemical and Crop Protection Equipment Exhibition (CAC 2017) and the 8th China International Fertilizer Show (FSHOW 2017).

As the largest Agrochemicals exhibition in China, CAC offers an international trade, communication and exchange platform involving Pesticides, Fertilizers, Seeds, beyond-agriculture, production & Packaging Equipment, Crop Protection Equipment, Logistics, Consultancy, Laboratories and Supportive Services.

36 exhibitors from India had showcased their products under the umbrella of CHEMEXCIL.

6. CAPINDIA 2017 Exhibition held on 21st & 22nd March, 2017

The second edition of CAPINDIA was organized jointly by CHEMEXCIL, PLEXCONCIL, CAPEXIL and SHEFEXIL under the aegis of the Department of Commerce, Government of India, supported by Department of Chemicals and Petrochemicals, Government of India . It was one of the largest sourcing and networking events for the Chemicals, Plastics, Construction Industry & Allied Products sector at Hall 6, Bombay Exhibition Center, Goregaon, Mumbai during 21st -22nd March-2017.

The Event attracted Retailers and wholesalers from the Industry.

CAPINDIA 2017 was an opportunity to:

To The Members of Basic Chemicals, Cosmetics and Dyes Export Promotion Council (Formerly known as Basic Chemicals, Pharmaceuticals and Cosmetics Export Promotion Council)(Limited by Guarantee)

Report on the Financial Statements

We have audited the accompanying financial statements of Basic Chemicals, Cosmetics and Dyes Export Promotion Council (“the Council”), which comprise the Balance Sheet as at 31st March, 2017, the Statement of Income and Expenditure for the year then ended, and a summary of the significant accounting policies and other explanatory information.

Committee of Administration’s Responsibility for the Financial Statements and for Internal Financial Controls over Financial Reporting.

The Council’s Committee of Administration is responsible for the matters stated in Section 134(5) of the Companies Act, 2013 (“the Act”) with respect to the preparation of these financial statements that give a true and fair view of the financial position and financial performance of the Council in accordance with the accounting principles generally accepted in India, including the Accounting Standards specified under Section 133 of the Act, read with Rule 7 of the Companies (Accounts) Rules, 2014. This responsibility also includes maintenance of adequate accounting records in accordance with the provisions of the Act for safeguarding of the assets of the Council and for preventing and detecting frauds and other irregularities; selection and application of appropriate accounting policies; making judgments and estimates that are reasonable and prudent; and design, implementation and maintenance of adequate internal financial controls, that were operating effectively for ensuring the accuracy and completeness of the accounting records, relevant to the preparation and presentation of the financial statements that give a true and fair view and are free from material misstatement, whether due to fraud or error.

The Council’s Committee of Administration is responsible for establishing and maintaining internal financial controls based on the internal control over financial reporting criteria established by the Council considering the essential components of internal control stated in the Guidance Note on Audit of Internal Financial Controls Over Financial Reporting issued by the Institute of Chartered Accountants of India. These responsibilities include the design, implementation and maintenance of adequate internal financial controls that were operating effectively for ensuring the orderly and efficient conduct of its activities, including adherence to Council’s policies, the safeguarding of its assets, the prevention and detection of frauds and errors, the accuracy and completeness of the accounting records, and the timely preparation of reliable financial information, as required under the Act.

Auditor’s Responsibility

Our responsibility is to express an opinion on these financial statements based on our audit and to express an opinion on the Council’s internal financial controls over financial reporting based on our audit.

We have taken into account the provisions of the Act, the accounting and auditing standards and matters which are required to be included in the audit report under the provisions of the Act and the Rules made thereunder.

We conducted our audit in accordance with the Standards on Auditing specified under Section 143(10) of the Act and the Guidance Note on Audit of Internal Financial Controls Over Financial Reporting. Those Standards and the Guidance Note require that we comply with ethical requirements and plan and perform the audit to obtain reasonable assurance about whether the financial statements are free from material misstatement and whether adequate internal financial controls over financial reporting was established and maintained and if such controls operated effectively in all material respects.

An audit involves performing procedures to obtain audit evidence about the amounts, the disclosures in the financial statements and adequacy of the internal financial controls system over financial reporting and their operating effectiveness. Our audit of internal financial controls over financial reporting included obtaining an understanding of internal financial controls over financial reporting, assessing the risk that a material weakness exist, and testing and evaluating the design and operating effectiveness of internal control based on the assessed risk. The procedures selected depend on the auditor’s judgment, including the assessment of the risks of material misstatement of the financial statements, whether due to fraud or error. In making those risk assessments, the auditor considers internal financial controls relevant to the Council’s preparation of the financial statements that give a true and fair view in order to design audit procedures that are appropriate in the circumstances. An audit also includes evaluating the appropriateness of the accounting policies used and the reasonableness of the accounting estimates made by the Council’s Committee of Administration, as well as evaluating the overall presentation of the financial statements.

We believe that the audit evidence we have obtained is sufficient and appropriate to provide a basis for our audit opinion on the financial statements and qualified opinion on the Council’s internal financial controls system over financial reporting.

Meaning of Internal Financial Controls Over Financial Reporting

A Council’s internal financial controls over financial reporting is a process designed to provide reasonable assurance regarding the reliability of financial reporting and the preparation of financial statements for external purposes in accordance with generally accepted accounting principles. A Council’s internal financial controls over financial reporting includes those policies and procedures that (1) pertain to the maintenance of records that, in reasonable detail, accurately and fairly reflect the transactions and dispositions of the assets of the Council; (2) provide reasonable assurance that transactions are recorded as necessary to permit preparation of financial statements in accordance with generally accepted accounting principles, and that receipts and expenditures of the Council are being made only in accordance with authorisations of Committee of Administration of the Council; and (3) provide reasonable assurance regarding prevention or timely detection of unauthorised acquisition, use, or disposition of the Council’s assets that could have a material effect on the financial statements.

Inherent Limitations of Internal Financial Controls Over Financial Reporting

Because of the inherent limitations of internal financial controls over financial reporting, including the possibility of collusion or improper management override of controls, material misstatements due to error or fraud may occur and not be detected. Also, projections of any evaluation of the internal financial controls over financial reporting to future periods are subject to the risk that the internal financial control over financial reporting may become inadequate because of changes in conditions, or that the degree of compliance with the policies or procedures may deteriorate.

Opinion

In our opinion and to the best of our information and according to the explanations given to us, the aforesaid financial statements give the information required by the Act in the manner so required and give a true and fair view in conformity with the accounting principles generally accepted in India, of the state of affairs of the Council as at 31st March, 2017, and its surplus for the year ended on that date.

Emphasis of Matter:

Without Qualifying we draw attention to the following matters in the Notes to the financial statements:

a.) Note No. 17.2(a) regarding premises occupied by the Council in Mumbai, in respect of which cheques aggregating to `25,30,820 for 107 months (Previous Year `23,82,487 for 95 months) have been sent to the landlord and duly acknowledged by them but not deposited by the them lying in the stale cheques account under “other current liabilities” to the extent cheques becoming stale, and

b.) The expenses in respect of code-activities are subject to sanction / confirmation of the Government of India and Grant-in-aid received from the Ministry of Commerce and Industry is subject to adjustments as may be necessary in view of any Government Audit observations, non/partial fulfillment of certain conditions, if any as may be observed by them for eligibility of such Grant-in-aid, clarifications by the Council and final decision of the Ministry. Such audit is pending for the financial year 2016-17 (Refer Note no. 17.4).

c.) Interest payable to the government on unutilized grant received by the Council for the earlier years, which, at present, is not ascertainable and accordingly not provided as the Council is confident of getting the waiver of payment of such interest as and when demanded by the Government in terms of the conditions stipulated at the time of sanction.

Report on Other Legal and Regulatory Requirements

1. As required by Section 143(3) of the Act, we report that:

(a) We have sought and obtained all the information and explanations which to the best of our knowledge and belief were necessary for the purposes of our audit.

(b) In our opinion, proper books of account as required by law have been kept by the Council so far as it appears from our examination of those books.

(c) The Balance Sheet and the Statement of Income and Expenditure dealt with by this Report are in agreement with the books of account.

(d) In our opinion, the aforesaid financial statements comply with the Accounting Standards specified under Section 133 of the Act, read with Rule 7 of the Companies (Accounts) Rules, 2014.

(e) In our Opinion, Section 164(2) of the Act in respect of reporting on disqualification of the Directors as provided under section 164(2) of the Act is not applicable to the Council as it is registered under section 8 of the Act.

(f) According to the information and explanations given to us and based on our audit, the following material weaknesses have been identified as at March 31, 2017:

i. Internal control procedures, financial accounting/reporting activities, statutory compliances and internal audit system need to be strengthened to be commensurate with the activities of the Council.

ii. To have the Information Systems Audit to ensure the security, authenticity etc. of the various data, documents and records maintained by the Council and disaster management of the data system. [Refer Note No. 17.11(b) of Notes to Financial Statements]

In our opinion considering nature of activities, size of operation and organisational structure of the entity, except for the possible effects of the material weaknesses described above on the achievement of the objectives of the control criteria, the Council has maintained, in all material respects, adequate internal financial controls over financial reporting and such internal financial controls over financial reporting were operating effectively as of March 31, 2017, based on the internal control over financial reporting criteria established by the Council considering the essential components of internal control stated in the Guidance Note on Audit of Internal Financial Controls Over Financial Reporting issued by the Institute of Chartered Accountants of India.

We have considered the material weaknesses identified and reported above in determining the nature, timing, and extent of audit tests applied in our audit of the March 31, 2017 financial statements of the Council, and these material weaknesses do not affect our opinion on the financial statements of the Council.

(g) With respect to the other matters to be included in the Auditor’s Report in accordance with Rule 11 of the Companies (Audit and Auditors) Rules, 2014, in our opinion and to the best of our information and according to the explanations given to us:

i. The Council has disclosed the impact of pending litigations on its financial position in its financial statements - Refer Note 17.3 to the financial statements;

ii. The Council did not have any long-term contracts including derivative contracts for which there were any material foreseeable losses;

iii. There were no amounts which were required to be transferred to the Investor Education and Protection Fund by the Council;

iv. The Council has provided requisite disclosures in the financial statements as to holding as well as dealings in Specified Bank Notes during the period from 8th November, 2016 to 30th December, 2016, on the basis of information available with the Council. Based on audit procedures, and relying upon Committee of Administration’s representation, we report that disclosures are in accordance with the books of accounts maintained by the Council and as produced to us by the Committee of Administration. Refer Note- 9 to the Financial Statements

2. As the Council is registered under section 8 of the Act, the clauses under the Companies (Auditor’s Report) Order, 2016 (“the Order”) are not applicable.

1. Significant Accounting Policies:

1.1 Council’s Information:

The Council is registered under Section 8 of the Companies Act, 2013 with the objective of promoting export activities in specified industries such as organic and inorganic chemicals, dyes, cosmetics and other allied products.

1.2 General:

a) The financial statements are prepared on the basis of historical cost convention, in accordance with applicable accounting standards and on the principle of a going concern.

b) All income and expenses to the extent considered receivable and payable, respectively with reasonable certainty are accounted for on accrual basis.

c) Membership subscription which remains unpaid as at the close of the year is not accounted for except the amount actually received out of such unpaid subscriptions approximately one month prior to the approval of the financial statements by the Committee of Administration.

d) Entrance Fees receipts are credited to General Reserve.

e) Library books are charged to Income & Expenditure Account in the year of purchase.

1.3 Use of Estimates:

The preparation of financial statements is in conformity with Generally Accepted Accounting Principles (GAAP). It requires Committee of Administration to make estimates and assumptions that affects the reported amounts of assets and liabilities and the disclosure of contingent liabilities on the date of financial statements and reported amounts of revenue and expenses for that year. Actual results could differ from these estimates. Any revision to accounting estimates is recognized prospectively.

1.4 Fixed Assets (Tangible and Intangible):

Fixed Assets are stated at cost of acquisition less accumulated depreciation/amortisation without any adjustment for Government Grant received, if any, for their purchase.

1.5 Depreciation/Amortisation and Impairment:

a) Depreciation on Fixed Assets is provided on written down value method at the useful life specified in Schedule II to the Companies Act, 2013 (hereinafter referred to as the ‘Act’).

b) Impairment of Assets:

i. The Council assesses the carrying amount of assets at each Balance Sheet date to determine whether there is any indication of impairment. If such indication exists, the Council estimates the recoverable amount of the assets. The recoverable amount

is estimated as the higher of the net realizable value and the value in use with an impairment loss being recognized whenever the carrying amount exceeds the recoverable amount.

ii. A previously recognized impairment loss on assets is reversed if there has been a change in the estimates used to determine the recoverable amount, however not to the extent higher than the carrying amount that would have been determined had no impairment loss been recognized in prior years.

1.6 Investments:

Non-current Investments are stated at cost less provision made for permanent diminution in their carrying value.

1.7 Revenue Recognition:

a) Contribution from Members:

Contributions receivable from Members for participation in Exhibition, Delegation, Seminar, Pre-Registration, Late Pre-Registration and Annual Maintenance Fees are recognized as income as and when the respective activities are completed and/or on receipt basis in view of uncertainty. The cost of Publications of the Council is charged to Statement of Income and Expenditure in the year of incurrence of such expenses and the income in respect of the same is taken into account as and when their sale is affected.

b) Government Grants:

Grants from Government are credited to Income and Expenditure Account on receipt basis as it is not possible to ascertain, the quantum of Grant due & receivable from/refundable to the Ministry of Commerce and Industry with reasonable certainty/accuracy.

1.8 Transaction in Foreign Currency:

Transactions in foreign currency are recorded at the rate of exchange in force at the time of occurrence of the transaction.

Monetary - Current assets and current liabilities in foreign currency at the year-end are stated at the rate of exchange in force as on that date and the resultant gain / (loss) is recognized in the Income and Expenditure Account.

1.9 Employee Benefits:

a) Contribution for Provident Fund (based on a certain percentage of salary) is funded into an approved Trust.

b) Gratuity is charged to Income and Expenditure Account on the basis of actuarial valuation as at the year end and funded into an approved Trust.

c) Leave Entitlement Benefits are provided for on the basis of actuarial valuation as at the year end.

1.10 Provision and Contingent Liabilities:

a) Provisions are recognized for liabilities that can be measured only by using a substantial degree of estimation, if

a. The Council has a present obligation as a result of a past event;

b. A probable outflow of resources is expected to settle the obligation; and

c. The amount of the obligation can be reliably estimated.

b) Where some or all of the expenditure required to settle a provision is expected to be reimbursed by another party, such reimbursement is recognized to the extent of provision or contingent liability as the case may be, only when it is virtually certain that the reimbursement will be received.

c) Contingent liability, if material, is disclosed in the case of:

a. A present obligation arising from a past event, when it is not probable that an outflow of resources will be required to settle the obligation.

b. A possible obligation, unless the probability of outflow of resources is remote.

17. Notes to Financial Statements:

17.1 The Council (set-up by Ministry of Commerce & Industry, Govt. of India) has been registered as a Company under the provisions of the ‘Companies Act, 1956 (hereinafter called as the “Act”). By virtue of the license granted to the Council by the Central Government under Section 25 (now governed by section 8 of the Companies Act 2013) of the ‘Act’ the word “LIMITED” is not required to be suffixed to its name. Further, the Council is continuing to hold the registration certificate under Section 12AA of the Income Tax Act, 1961. Accordingly, no provision has been made in financial statements for the current financial year and in respect of earlier financial years.

17.2

a) The Council is occupying premises at Jhansi Castle (5th Floor), Mumbai since 1971 and is a statutory tenant. It has been sending cheques to landlord but the same has not yet been deposited by them. An amount of ` 2,530,820 (Previous Year `2,382,487) is lying in stale cheque account being rent payment for 107 months (Previous Year 95 months), included in Other Current Liabilities – Note No. 3 hereof.

b) The Council has decided to create sufficient funds for buying its own offices in Mumbai, Kolkata and Bangalore and accordingly ` NIL (previous year 20,000,000) transferred to Chemexcil Building Fund from Surplus.

17.3 a) Contingent Liabilities not provided for in respect of:

17.4 The expenses in respect of code-activities are subject to sanction / confirmation of the Government of India and Grant-in-aid received from the Ministry of Commerce and Industry is subject to adjustments as may be necessary in view of any Government Audit observations, non/partial fulfillment of certain conditions, if any as may be observed by them for eligibility of such Grant-in-aid, clarifications by the Council and final decision of the Ministry. Such audit is pending for the year 2016-17.

Interest payable to the government on unutilized grant received by the Council for the earlier years, which, at present, is not ascertainable and accordingly not provided as the Council is confident of getting the waiver of payment of such interest as and when demanded by the Government in terms of the conditions stipulated at the time of sanction.

17.5 The Council generally classifies its expenditure in accordance with the format given by Ministry of Commerce and Industry, Government of India.

17.6 Pursuant to the approval by the Ministry of Commerce and Industry for grant of Marketing Development Assistance (MDA) to individual exporters under certain eligible schemes, (the Council being a conduit) the amounts being disclosed as ‘Amount due to members/Government' under other Current Liabilities are as follows:

17.7 `1,291,500 (Previous Year `1,498,000) being the amount of membership subscription receivable as on 31st March, 2017 and which was received subsequently up to cut-off date 30th June, 2017 (Previous Year 30th June, 2016) has been included in the Receivables.

17.8 The Council pays certain fees to Directorate General of Commercial Intelligence & Statistics (DGCI & S) for obtaining import-export statistics of Council’s items to be supplied by them as and when asked for by the Council. An aggregate expensed out balance of ` 6,960 (Previous year ` 115,378) as at the year end is still lying with them which would be utilized in due course of time.

17.10

a) The accounts of certain Receivables, Payables & Advances are subject to confirmation, reconciliation and adjustments, if any, having consequential impact on the surplus for the year, assets and liabilities, the amount whereof is presently not ascertainable. The Management, however, does not expect any material difference affecting the current year’s financial statements.

b) In the opinion of the Council, the assets other than Fixed Assets and non-current investments are approximately of the value stated, if realized in the ordinary course of business unless otherwise stated. The provision for depreciation and other known liabilities is adequate and not in excess of what is required.

17.11 a) Internal Audit System is still in the process of being strengthened in terms of scope and

extent of verification and various reconciliations.

b) Internal Control for financial Accounting/Reporting Activities is still in the process of being strengthened to be commensurate with the activities of the Council including that the Council will regularize its statutory compliances; to have the Information Systems Audit to ensure the security, authenticity etc. of the various data, documents and records maintained by the Council and disaster management of the data system and Internal Audit System as mentioned in para (a) above.

c) Physical verification of fixed assets at its registered office including its branches were carried out during the current financial year and no discrepancies were noticed.

d) The Management has not come across, noticed or reported during the year any instance of fraud on or by the Council.

17.12 Disclosure in Respect of Operating Leases:

a) The Council has taken various commercial premises under cancelable Operating Leases. The Lease Agreements are usually renewable by mutual consent on mutually agreeable terms.

b) The rental expenses in respect of Operating Leases are charged as rent under Note 16-Other expenses.

17.17 Employee Benefit-Gratuity:

In terms of the Council’s gratuity plan, on leaving of service every employee who has rendered continuous service of not less than 5 years but less than 10 year shall get gratuity at the rate of 15 days total salary as per the Payment of Gratuity Act, 1972 (as amended from time to time) and those employees on leaving of service after rendering continuous service of not less than 10 years shall pay gratuity at the rate of one month’s salary based on the rate salary drawn by the employee concern. The Gratuity Scheme of the Council is funded in Government Securities, SBI Special Deposit Scheme and other Bonds. The Disclosure is based on Actuarial Valuation details provided by M/S K. A. PANDIT (Consultants & Actuaries).
