Thc Agency shall have its I-Iead Office in Addis Ahaba and 'rnay have branch offices elsewhere as necessary.

4. Obiective

The objective of the Agency shall be to strengthen and expand private organ izations' employees social security prograrns.

S. Powcrs and Dutics

The Agency shall ha ve the powers and duties to:

11 implcment private organizations' employees

social security Iaws, reguIations and directives;

2/ estabIish efficient and effeetive system to

implement the private organizations' empIoyees

pension seheme;

3/ establish a system for the 'collectipn of private

organizations ' employees pension contributions,

colleet conlribu~ions, ensurc that pension '

contributions are collected by the appropriate

organ in ti me and in tbe correet amount,

supervise the implementation of tbc system by

employers and, where necessary, audit their

documents and records by requiring their

subrnission or througb site visits;

4/ adrninister private organ izations' employees

pension funds and assets related thcreto;

5/ eoUect in advance and maintain records of

evidentiary data tbat entitIe private organizations'

empIoyees lo pension benefits;

6/ take legaI actions against employers and

individuaIs who fa iI to pay pension contributions,

maintain accounts of eontributions and furnisb

required documents and information on time;

7/ deter:nine, the . adequacy and valid ity of

cv identiary data suhmilted in conneclion witb

claims of the employees of private organizations .

powers and dutics;

131 own property, enter into comracts, sue and be

slled in its own name;

14/ carry out such other activities as may be

necessary for the fulfiUmcnt ofits objective.

6, Organization or the Agencv

The Age.ncy shall have:

l/ a Board of Management (hereinaftcr the "Board"),

2/ Director GeneraI and, as may be nccessary,

Deputy Director Generals to be appointed by the

govemment, and

3/ the necessary staff.

7, Members 'orthe Board

1/ Members of tbe Board shall be equa lly

represented from the govemment, private

organizations and t~e employccs of the private

organizations; and their number shall be

detennined as may be necessary,

21 The Chairperson and governrnent rcpresentatives

shall be assigned by the govemment. The election

procedure ,applicable to representatives of private

organizations and employccs shall be determined

by government.

31 The' Director Generai of the Agency shall be

mcmber and sccretary ofthe Board.

1/ The Board shall oversee and supervise operations 01' thc I\g.:ncy.

2/ Without limiting Ihe generality of sub-article (1) of this Article, the Board shall have the powers and dutics IO:

a) approve the strategy, plans, budgets and

performance reports of the Agcncy;

b) submit to thc govcrnment, for approvaI, generaI

policy matters regarding the . private

organizations' employees pension sclieme and

fund;

c) approve dircctives of the Agency to be issued

pur~ uant lO sub·artic le (12) of Art ide :s of this

Regulation.

9. Mcetings of thc Board

The Board shall meet once in every three month~; provided, however, that it may meeI at any time as may be required.

There shall be a quorum where more than half of the members are present at a meeting of the Board.

Decisions of the Board shal! be passed by majority votes of the metnbers present at a meeting; provided, however, that the Chairperson shall have a casting vote in case of a tic.

4/ Without prejudice to the prov isions of this Artic1e, thc Board may adopt it5 own rules of procedure .

lO. Powcrs and Duties ofthe Director Gencra l

1/ Thc Director GeneraI shall be the chief executive

officer of the Agency and shall, subject to the

generai directives of the Board, di'rect and

administer activities ofthe Agency.

2/ Without lim iting the generality of sub-article (1)

ofthis Article, the.Director GeneraI shall:

a) exe~cise the powers and duties of the, Agency .

specified in Artide 5 ofthis Regulation.; ,

b) cmploy and administer employees of the

Age'ncy in accordance with the federai civil

service laws;

c) prepare and submit to the Board the strategy,

pIan and budgets of the Agency and

implement same upon approvai;

effect expenditure in accordance with the approvcd budget of the Agcncy;

represent the Agency in a li its dealings with third parties;

submit performance and financial reports of the Agency to the Board and, upoo appro,:,al , to the concemed govemment bodies.

The Director Generai may deleg<l.te part of his powers and duties to the officers and other employees of the Agency to the extent necessary for the efficient performance of the activities of the Agency.

II. Budgel

The Budget of the Agency shall be allocated from the pension fund ; provided, however, that the government sha!! allocate initial budget to commence operation.

12. Books or Accounts

Il The Agency shall keep complete and accurate

books of dccounts.

21 The books of accounts ànd financial documents of

the Agency shall be audited annually by the

Auditor Gener~l or by auditors appointed by him.

Effective Date

This Regulation shall come into force up on the date of publication in the Federai Negarit Gazeta.
