40th anniversary of the FSPA Swim Meet

More than 1,200 athletes from nearly 70 Florida high schools will compete during the 40th FSPA High School Invitational Swimming and Diving Meet. This meet was started many years ago in the FSPA Central Florida Chapter. The meet grew and grew and at one point had nearly 2,000 students involved in the two-day event. It was held at the YMCA on I-Drive for many years and recently moved to the Sailfish Splash Aquatic Athletics Center in Stuart.

This year we are expecting around 1,200 to compete in the developmental and invitational meet. The developmental portion of the meet is for any swimmer while the invitational is for those with qualifying times fast enough to participate.

Thank you to the many FSPA member companies sponsoring the event, many who have been doing so for years. These companies will be recognized in the October issue.

Volunteers are still needed to time the swimmers in case the touchpads in the pool fail to properly record their time. Each FSPA chapter is required to provide volunteers so support your chapter and these athletes by spending some time on the pool deck. Volunteers receive a T-shirt and are welcome in the hospitality room for food and drinks. You can see volunteer times and register to volunteer through a link on www.FSPASwimMeet.com.

Are you connected?As an employee of the FSPA for more than 16 years, I’ve

seen the evolution of our member communications. When I began in March of 2001 as communications manager, one of my first priorities was to launch a website for the association. Seems a little crazy to think about these days, but at the time it was the “hot new thing.” Since then we’ve re-launched the association website several times, including separating the consumer information from industry information.

The newsletter has seen lots of changes as well, from a black and white tabloid style newspaper to the magazine format today. And in the past year we added an electronic version sent out simultaneously which has live links for additional interactivity.

Two years ago we made the decision to revise the public relations position to have the majority of their responsibility be social media. This evolution of the position has improved our engagement with members and allowed FSPA be present in our members’ lives every day. FSPA also launched an online community where members can ask questions, share information, or even sell and trade equipment and materials.

Our newest staffing progression is in support of the chapters who utilize a coordinator based in Sarasota. A third person has been added to the Chapter Service Team, Kayleigh Smith, and she will focus on the chapter social media and member data. Presently she is connecting local chapter members with the chapter’s Facebook page and next will work closely with the local boards to develop a social media calendar. She will also be creating strong prospect lists of target members and improving the current data we have for all members. This is all with the goal of connecting more quickly and efficiently with the industry.

CE requirements have changed

Effective July 19, 2017, 61G4-18.001 Pool Electrical Continuing Education Rule requires one hour of continuing education on the topic of Pool Electrical. The CE requirement is included in the 14 hours currently required, nothing additional. The requirement for one hour of pool electrical will begin when the individual’s license renewal cycle begins for all registered and certified contractors in

the following categories: Commercial pool/spa, residential pool/spa, swimming pool/spa servicing, or residential pool/spa servicing specialty.

61G4-18.001(2)Of the fourteen (14) hours, one (1) hour shall be required in each of the following topics:

(a) Specialized or advanced module course approved by the Florida Building Commission, or the Board;

(b) Workplace safety; (c) Business practices; (d) Workers’ compensation; and (e) Laws and rules regulating the construction industry;(f) Wind mitigation methodologies, if license is held in the following category:

General, Building, Residential, Roofing, Speciality Structure, or Glass and Glazing.

(g) Pool electrical requirements, if license is held in the following category: Commercial pool/spa, Residential pool/spa, Swimming pool/spa servicing, or Residential pool/spa servicing specialty.

The remaining hours may include any of the aforementioned subject matter or general topics as defined hereinafter.

FSPA is prepared to submit new courses to the CILB, for approval, that will meet the pool electrical requirement as soon as the new course submission application is available.

It’s heater time again

That time of year is fast approaching, heating season will be here in no time. This long hot summer will fade away as the first cold front comes down and the snowbirds will start flocking south again wanting their pools and spas heated when they arrive. If your company works on heaters, it is time to get your service department in order and your technicians trained.

First things first your company must have a Florida CPC or county RP license to install or reinstall any heater or any other pool equipment. Second, if you work on LP gas heaters you must have a state license to work on LP equipment, and if you work on natural gas equipment, several counties require licensing. Last but not least, if your company works on heat pumps your technician must have the proper EPA certification to hook up to or work on the refrigeration system. If you are not licensed and do not have the proper

certifications, do not work on the equipment. If that piece of equipment fails, your insurer will not cover you for any damages and you and your company, along with the technician who did the work, can and will be held personally liable for any damages. So the bottom line is to get the proper licensing and training and life will be good.

The manufacturers have their training classes starting in September. Check with your local factory representative or go to their website and get your technicians signed up as class space is usually limited and fills up fast. If you work on LP gas heaters, the Florida Department of Agriculture will be able to let you know if a gas safety class will be held near you. The FSPA will have the EPA certification exam prep and exam at the Everything Under the Sunsm Expo in February along with the LP gas exam prep. I thank Mary Anderson at the FSPA state office for all her hard work in putting this together.

As you know, the pool industry and the air conditioning industry have been in a battle over heat pumps regarding who can work on them and install them. Under a pool contractor’s scope of work, we are allowed to do both. Many pool company owners are unaware that they can work on the refrigeration portion of the heater as long as the technician doing the work has the proper EPA certification. The company does not need to be licensed in air conditioning for the work to be done. An air conditioning contractor is only allowed to work on the refrigeration portion and cannot work on any portion of the pool plumbing, this incudes disconnecting the heater even at the unions or replacing the heater even if it is the same model. This being said, several of the heat pump manufacturers do not let pool companies work on their heat pumps even if the techs have the proper certification. They only allow air conditioning contractors to do this work which gives the AC industry a leg to stand on in their quest to sell and install pool heat pumps. I strongly urge all companies to get their technicians EPA certified and trained by the manufacturers or local VO-TEC or technical school so our industry can gain their trust and let us do the work instead of our competition.

The EPA Section 608 Prep and exam will take place at the 2018 Expo on Thursday, February 8, 2018. The exam prep will take place from 8:00 a.m. to 11:00 a.m. Attendees will return for the exam at 2:00 p.m. – 5:00 p.m.

Input needed on DEP Rule 62B-34

The Department of Environmental Protection is proposing to amend Chapter 62B-34, F.A.C., to adopt General Permits for swimming pools associated with single-family homes.

Amendments to the rules will also add a definition of “registered professional,” amend the application fee schedule to include General Permits, add general conditions applicable to all General

Permits, create a new General Permit for certain minor structures, and clarify existing siting criteria for major structures.

Sunsm Expo website, www.UnderTheSunExpo.com. The cost of the exam prep will be $99 and registration will open in October. There is a study book that each student needs to order prior to the exam, so they have time to study. Attendees will need to purchase the book at least three weeks prior to the class date to give themselves enough time to study and then bring it to the exam prep. The cost of the EPA Preparation book is $14.58+shipping and it can be ordered online or by calling the supplier. The size is limited to 35 students and the cutoff for registration will be January 18, 2018.

So to sum it all up, get your guys trained and certified, knowledge is power and with the proper training your customers will have confidence in your company and your technicians and our industry will look more professional.

Temporary labor can lead to long-term consequences

Like many businesses, from time to time your company may use workers from a temporary employment agency. In Florida the temp agency is considered the workers’ employer. As such, the agency is obligated to insure the workers under a workers’ compensation policy. This arrangement can you save money on workers’ compensation premiums. However, it can also leave you with no insurance for lawsuits by injured temporary workers.

In Florida, workers’ compensation benefits are an injured worker’s exclusive remedy (sole source of compensation from the employer) for an employment-related injury. Consequently, workers who are injured on the job are generally barred from suing their employer. This concept is called the exclusive remedy rule.

When your business obtains workers from a temp agency, your business is not the workers’ employer. Thus, the temporary worker is not barred from suing you.

So, how does your business insurance program respond to these claims and how can you protect yourself?

Because the temp worker is not your employee, there is no coverage here and any claim would be denied. In addition, the injured temp worker has probably already received benefits under the temps’ workers’ compensation policy.

Because of the relationship between you and the injured temp worker, this claim would be denied as well. General liability policies exclude bodily injury to any of your employees if the injury arises out of the injured employee’s employment. In the policy definitions the term employee does not include a temporary worker. We could argue that this was a temporary worker, so that exclusion should not apply to your claim.

Unfortunately, the term temporary worker has a very specific meaning in the liability policy. It applies only to a person who is furnished to you (the employer) either as a substitute for a permanent employee on leave or to meet seasonal short-term workload conditions.

Therefore, within the context of your general liability policy, the temp was an employee when the injury occurred. Again, the general liability policy excludes lawsuits brought by employees for injuries sustained on the job.

Fortunately, the workers’ compensation and employer’s liability coverage that is provided by the Alternate Employer endorsement protects your business against such suits.

You should always request coverage as an alternate employer under the temp agency’s workers compensation policy. A standard NCCI endorsement is available for this purpose. It is called the Alternate Employer endorsement and you should make sure that the Certificate of Insurance from the temp agency specifically lists this coverage.

The Alternate Employer endorsement is attached to the temporary agency’s workers’ compensation policy. All references to “you” in the endorsement mean the temporary agency (the employer named on the policy). The alternate employer is your company.

The endorsement covers injury sustained by employees during their temporary employment with you as the alternate employer listed in the endorsement schedule. The temp agency remains the worker’s primary employer. You are covered for any lawsuit (for a work-related injury to the temp employee) only while the temporary worker is assigned to you.

The Alternate Employer endorsement imposes certain policy conditions on you as the alternate employer. You must immediately report any injury involving a temporary worker to the employer’s workers’ compensation insurer. You must also provide immediate medical care to the injured worker, and forward all relevant documents to the insurer or its agent.

One condition that does not apply to the alternate employer is the cancellation clause. The insurer is not obligated to notify you if the workers’ compensation policy is cancelled. This is because the alternate employer is not the named insured under the policy.

The Alternate Employer endorsement is the best way to protect your company in these situations under these conditions.

Q&A WITH TOM CUCINOTTA OF CUCINOTTA’S POOL SERVICE

EPA recently sat down with Tom Cucinotta of Cucinotta’s Pool Service. He is one of the leading pool service contractors in Florida. We asked him how he markets ENERGY STAR® certified variable speed pool pumps to his customers and how the pumps helped him build his business.

How long have you been installing ENERGY STAR certified variable speed pool pumps? I was one of the first contractors to sell variable speed pool pumps in the state of Florida. We have now installed over 2,000 variable speed pumps.

What are the signs that you need to replace your pool pump? There are a number of signs, some pretty simple but some are a little more subtle. In general, if your pump is seven to 10 years old it probably needs to be replaced. More specific ways to tell are when the pump loses power, is much louder than before, gets hot and shuts down, or will not start.

What is the best way to explain what a variable speed pool pump is to your customers?First thing to explain is that pool maintenance can use different pool pump speeds. Pool cleaning with a pressure side cleaner requires high pump speed, but filtering, which is the task performed 80 to 90 percent of the time, only requires low speed.

Second, regular single speed pool pumps run at high speed all the time – like a car always going 100 mph – and waste energy.

Third, variable speed pumps can be programmed to run most of the time at lower speeds for filtering and ramp up occasionally for cleaning. You save enormous amounts of energy by running the pool pump at lower speeds.

What is the best way to explain to my customers how much energy the variable speed pool pump saves? Many of your customers probably don’t know the enormous energy costs of pool pumps. If you have an in-ground pool, pool pumps are the second largest energy use in the home next to HVAC. In FL, I see variable speed pumps saving customers at least $350 per year and as high as $1,000 per year in some cases. Pool pumps running at lower speed use much, much less energy because pump energy use varies with the cube of the pump speed. In English that means that:

A pump running at 1/2 speed uses 1/8 the energy!

A pump running at 1/3 speed uses 1/27 the energy!!

So even if you run it longer at lower speeds (to achieve the same pool turnover as before) it will still use a lot less energy. The energy savings easily pay for the extra cost of a variable speed pump in less than two years. And over their lifetime, you’ll save thousands of dollars.

In addition to these savings, are there utility rebates available? Yes, to sweeten the deal even further, rebates for variable speed pool pumps are available all over the country. You should check with your local utility’s website to see if they offer rebates. I have seen the rebates as high as $400 per pump. Some of these rebates go directly to the contractor.

What are the other benefits of ENERGY STAR certified variable speed pool pumps to your customers?In addition to impressive savings, there are other great features to variable speed pumps. Usually the biggest selling point comes when you just turn on the pumps and hear how much quieter they are. You can barely hear them because they

use permanent magnet motors not induction motors and, of course, run at much lower speeds. Another great benefit is safety. Some variable speed pumps come with built-in Safety Vacuum Release Systems that shut down the pump to prevent suction entrapment. They also clean better as filters work better and last longer when water runs through them at lower speeds. Finally, variable speed pumps last a lot longer. I have seen them last 10 years, where it seems I was replacing single speed pumps every three to four years in the past.

What are common myths around ENERGY STAR variable speed pool pumps?

I hear all sorts of excuses for not using variable speed pumps and none of them are true. Some think installation will be a hassle because they are configured differently than single speed pumps. That is not true, they have the same shape and footprint. Some folks don’t want to use a new technology because it will break and lead to call backs from customers. I tell them I have been using them for 10 years. Others say the programming to set pump speeds and times is too complicated. I tell them it is easy and now can be done through user friendly smart phone apps.

Can you tell me how selling ENERGY STAR variable speed pool pumps helped your business?

These variable speed pumps have been great for business. Every time I install one I ask if I can put up a sign in the property for about a week to advertise your savings. I get a lot of calls due to that advertising.

Also, Cucinotta’s Pool service now has a more high-tech, high-end contractor reputation. Not to disrespect my fellow pool guys and gals, but it has a reputation as a low tech service!

Probably the best thing that comes out of variable speed pumps is it ends the need for multiple pumps and can lead to customers investing in other high end pool products like hot tubs, salt water systems or fountains. Next thing you know you

are also working on bringing LED lights, automation systems, and other high end accessories!

A task force will be formed to help find a replacement. If you are interested in this position, please contact Brian Curts. Additionally, Treasurer Kim Quintal’s term will be coming to an end. In accordance with our By-Laws, you must have been on the Board as a Director for at least one year to assume this position. If you have an interest in serving your Chapter, let Brian Curts or Debi Garner know. Ballots will be going out in the fall. Help support your industry; it does not take much time and you will be rewarded many times over by volunteering.

Please submit any and all suggestions to the Board for events and classes you would like to see us offer for next year. Remember this is your Chapter and your voice counts.

The Chapter meeting on September 12 will be conducted by Charlie Chansen, Hayward Pool Products. The program will include troubleshooting of pool and spa gas heaters, as well as gas supply issues.
