And whereas as per the AICTE service conditions and as per the notification No. 1-65/CD/NEC/98-99 dated 15th March, 2005 the re-employment of retired/ !superannuated persons is permissible only till the maximum age of 65 years.
And therefore, in view of above, the Government of Goa is. pleased to terminate the contract agreement entered with Shri Jalmini Mehta on 30-6-2003, with effect from Shri Mehta attaining 65 years of age i.e. w.e.f, 27-5-2005(A.N.).

Kundaim Industrial Estate, Kundaim Goa, and their workmen represented by CG-PPI Kundaim Employees Union, in respect of the matter specified in the Schedule heret,o (hereinafter referred to as the "said dispute");
And whereas the Government of Goa consideres it expedient to refer the said dispute for adjudication.
Now, therefore, in exer~ise of_ the powers conferred by clause (d) of sub-section (1) of Section 10 of the Industrial Disputes Act, 1947 (Central Act 14 bf 1947) (hereinafter referred to as the "said Act"), the Government of Goa hereby refers the said dispute for adjudication to the Industrial Tribunal of Goa, at PanajiGoa, constituted under Section 7-A of the said Act.

"(1) Whether the action of the management of M/s. CG-PPI Adhesive Products Limited, Kundaim Industrial Estate, Kundaim-Goa, in refusing to concede the following demands of ' the workmen, represented by CG-PPI Kundaim Employees Union, is legal and justified".
CHARTER OF DEMANDS
(1) Demand No.1:
The Union demands that all the workers should be given the following revised pay scale:-

The Union demands that all the workmen shall be given rise in basic at the rate mentioned below:-

W4 - Rs. 700/-
, Fitment: After adding above flat rise to the existing basic of the workmen, they should be fitted in the revised scale of pay in their respective grades.
(3) Demand No.3, Seniority Increments.
The Union demands that all the workmen shall be given the seniority increments as mentioned below:-
Service above 2 and upto 3 years
Service above 3 years and upto 7 years
Service 7 years.
One increment.
Two incremen'ts.
Three increments.
(4) Demand No.4, Fixed Dearness Allowance.
The Union demands that all the workmen should be paid Fixed Dearness Allowance at the revised rate of Rs. 600/- per month per workmen.
(5) Demand No.5, Variable Dearness Allowance.
The Union demands that the present rate of variable Dearness Allowance being very less, the same shall be paid at the revised rate of Rs. 2.50 per point rise beyond 2200 (1960=100).
(6) Demand No.6, House R'mt Allowance.
The Union demands that House Rent Allowance should be paid at the revised' rate i.e. a rise of Ro. 350/- should be given over the present House Rent Allowance.
(7) Demand No.7, Conveyance Allowance.
The Union demands that every workIllen shOUld be given a Conveyance Allowance at the revised rate of Rs. 400/- per month, to meet the increased cost of transport.
(8) Dem!'I1d No.8, Canteen Subsidy.
The Union demands that Canteen subsidy be paid at the revised rate of Rs. 400/- per month per workman or canteen item should be provided at subsidize,! rates.
(9) Demand No.9, Educ"tionAlloWance.
The Union demands that all the workIllenShould be paid education allowance at the revised rate of Rs. 300/- per month per workman.
The ,Union demands that the Domiciliary treatment allowance should be paid at the rate of Rs. ·200/- per month per.workman.
(11) Demand No. 11; Accident Leave and Medical Expenses.
The Union demands that those workmen who meet with accident whie on duty should be given full pay and special sick leave till they are fit to resume duty and full inedicalexpenses should be'reimbursed by the management.

(12) Demand No. 12, Leave Travel Allowance.
The Union demands that a rise of Rs. 800/- should be given over the present Leave Travel Allowance to each worker.
(13) Demand No. 13, Leave.
The Union demands that leave facilities should be provided as follows:-
i) Private leave - One day for every 15 days worked or 25 days per year.
ii) Sick leave - 10 days per year.
iii) Casual leave - 10 days per year.
Holidays - 10 public holidays and 3 restricted holidays per year.
(14) Demand No. 14, Chemical Allowance:
The Union demands thatall the workmen should be paid chemical allowance at the rate of Rs. 125/- per month. to each workmen.
(15) Demand No. 15, Washing Allowance.
The Union deman.ds that all the workmen should be given washing allowance at the rate of Rs. 50/- per month as a rise in their present allowance.
(16) Demand No. 16, Loan.
The Union demands that those workmen who have completed more than two years in service should be given loan facility of Rs. 50.000/- to purchase house hold things which loan will be recoverable crom the worker at the rate of 4% interest.
(17) Demand No. 17, Shift Allowance.
The Union demands that if they work for II shiftRs: 15/- per day should be paid.
(18) Demand No. 18, Medical Allowance_
The Union demands that Medical benefit should be given as below:-

Whereas disciplinary proceedings for major penalty were instituted against Shri 'Gangadhar T. Taiekar, Talathi in the Office of Collector, North Goa District, Panaji vide Memorandum No. 9/95/98-VIG/COL/281 dated 21-0.9-1991 on two Articles of charge asunder:-
1. That Shri G. T. Talekar while functioning as Talathi .' of Tivrem-Orgaon, Saza during th~ period of 1981
onwards issued a false certified copy on 0.2-0.9-1982 of Form I &. XIV in respect of Survey No. 3/6 of Orgaon Village in Ponda Taluka to Smt. Maria A. Gomes.
2. That during the aforesaid period, the said G. T. Talekar, Talathi has committed an error while making entry in the Cultivators Reg;ster in respect ' of Survey No. 3/6 of Village Orgaon of Ponda Taluka without following the rules connected with. the procedure during mutation.
Whereas in his written statement of defence dated 0.1-10.-1999, the saidShri G. T. Talekar denied the Articles of charge framed against him.
'Whereas. vide Order No. 9/95/98-VIG dated 0.1-0.2-20.0.0., Shri D. H. Kenaudekar, Asstt. Director of Indnstriesand Mines, Panaji was appointed as Inquiring Authority to ' inquire into the charges framed against the said Shri Talekar. Subsequently, Shri D. H. Kenaudekar was replaced by Shri S. D. Dessai, retired Group'll: Officer of Goa Civil Service vide Order dated 28-0.9-20.0.1.
Whereas the Inquiring Authority subnutted its inquiry report dated 21-0.3-20.0.2 holding that charges in Article I & II have been proved beyond doubt against the said Shri G. T. Talekar.
Whereas the said Shri G. T. Talekar, retired on attaining the age of superannuation w.e.f. 0.1-10.-1999 and the disciplinary proceedings were continued under RUle 9 of CCS (Pension) Rules, 1972.
, Whereas the report of Inquiring Authority was made available to 'SM G. T. Talekar vide Memorandum dated 19-0.4-20.0.2 invitmg for his representation on the said inquiry report.
Whereas Shri G. T. Talekar submitted his reply vide his representation'dated Hi-05-2o.o.2.
Whereas after careful consideration of findings of the Inquiry Authority vis-a-vis the evidence on record"reply of Shri G. T.' Talekar dated 15-0.5-20.0.2 and other circumstances of the case, the Government in consultation wit!l the Goa Public Service Commission communicated vide their letter No. COM/Il/15/42(1)/o.5

dated 23-06-2005 agrees with the findings of the Inquiring Authority that Article I & II are fully proved against Shri G. T. Thlekar. T.he Government after taking into consideration the gravity of misconduct committed by Shri G. T. Thlekar has arrived at conclusion that the ends of justice would be met in imposing a penalty of 5% cut in the pension of Shri G.T. Thlekar for a period of 2 years under the relevant provisions of CCS (Pension) .. RuJes.
Now, therefore, the Government imposes a penalty of 5% cut in the pension of said G. T. Thlekar, Thlathi (retd.) for a period of 2 years with immediate effect.

Whereas it appears to the Government of Goa (hereinafter referred to as "the Government") that the

land specified in the ScheduJe hereto (hereinafter referred to as the "said land") is likely to be needed for public purpose, viz. Land Acquisition for augmentation of Sanquelim Water Supply Scheme laying and jointing conveying main (Part-I) Ch. 7380 to 11400 mts.
Now, therefore, the Government hereby notifies under sub-section (1) of Section 4 of the Land Acquisition Act, 1894 (Central Act 1 of 1894) (hereinafter referred to as the "said Act") that the said land is likely to be needed for the purpose specified above.
2. All persons interested in the said land are hereby warned not to obstmct or interfere with any surveyor or other persons employed upon ,the said land for the purpose of the said acquisition. Any contract for the disposal of the said land by sale, lease, mortgage, assignment, exchange or otherWise. or any outlay commenced or improvements made thereon without the sanction of the Collector appointed under paragraph 4 below, after the date of the publication of this notification, will under clause (seventh) of section 24 of the said Act, be disregarded by him while assessing compensation for such parts of the said land as may be finally acquired.
3. If the Government is satisfied that the said land is needed for the aforesaid purpose, a declaration to that effect under section 6 of the said Act will be published in the Official Gazette and in two daily newspapers and public notice thereof shall be given in due course. If the acquisition is abandoned wholly or in part, the fact will also be notified in the same marmer.
4. T.he Government further appoint's, undercJause (c) of section 3 of the said Act, the Land Acquisition Officer, PWD, (Cell), Altihho, Panaji-Goa to perform the functions of the Collector under the said Act in respect of the said land. . ....
5. T.he Government also authorises under sub-section (2) of section 40f the said Act, the following Officers to do the Acts, specified. therein in respect of the said land.
