    I, Marisa Moret, declare as follows:1

    23 1. I am the Managing Attorney of the San Francisco City Attorney's Office. I have4 personal knowledge of the facts set forth in this declaration, and, if called asa witness, could and5 would testify competently thereto.6 2. I s u b m ~ t this declaration pursuant to the Court's February 9,2010 order7 (Doc. #585) requiring that third party subpoena recipient Californians Against Eliminating Basic8 Rights submit a declarationjustifying the inclusion in its core group of the individuals identified in the9 letter dated February 1,2010, from Kari Krogseng to Jesse Panuccio.10 3. I am a Board Member and Secretary ofCalifornians Against Eliminating Basic11 Rights ("CAEBR"). CAEBR (formerly known as Californians Against Discrimination) was formed in12 July 2008 to educate the public about discrimination, and to oppose Proposition 8. It was engaged13 primarily in fundraising activities, including one-on-one solicitations, one-one-one meetings between14 potential donors and CAEBR Chair City Attorney Dennis Herrera, and a small number offundraising15 events. Although it originally intended to use its funds for puhlic messaging, CAEBR ultimately16 contributed the bulk of the funds it received to the umbrella No on 8 organization, Equality for All, No17 on 8. Attached as Exhibit A are true and correct copies of excerpts ofCAEBR's campaign finance
