Judging by the number of illegal business prac- tices sprouting up across town in residential areas over the past few years, many believe that this question is justifiable. For years now, Mooketsi Towing has been operating illegally from a property, 80 Olifant Street (Erf 1642), still zoned as Residential 1. In 2011 already, this illegal operation was brought to the attention of the municipality. Earlier this year, the municipality acknowledged once again that Mooketsi Towing was trading illegally from a residential property when they stated “the owner is contravening the municipal by-laws if the prop- erty is being used for ‘towing services’, and that contravention letter will be issued in due course.” Another business operating in contravention of the municipal by-laws and regulations is the scrapyard in Grobler Street (Erf 429, 79 Grobler Street). Although the premises were, according to the Makhado Municipality, re-zoned to Business 1 sometime during 2012, this was only done with consent to sell second-hand vehicles and not to operate as a scrapyard (The municipality’s 2014 to 2018 valuation roll still lists this property as Residential 1). More recently, Maseakhole Constructability and Projects started operating a construction and transport company from a residential property in Stubbs Street. A workshop was also built on the premises, with generators running and vehicle re- pairs taking place at all hours of the day and night. Huge traffic jams are also caused by this company as drivers attempt to manoeuvre the fleet of trucks in and out of this residential property. It is also not strange to find heavy vehicles parked halfway in the road for days on end. The Makhado Municipality’s apparent reluc- tance to act against these and other illegal business- es operating right under its nose has residents living around these properties fuming. Some believe there is a sinister plot behind the municipality’s turning a blind eye to these operations, while others are of the opinion that the municipality is applying dou- ble standards when it comes to cracking down on illegal business practices. At the beginning of the year, the municipality went to war with hawkers in the town’s CBD who were apparently operating without licenses. Yet it would seem that, when it comes to the wealthier and better-known business owners, the latter are being allowed to operate without having to adhere to any of the municipal by-laws and zoning regulations. In their response to a media enquiry regarding these businesses last week, the Makhado Munici- pality categorically denied applying double stand- ards when it comes to municipal law enforcement. “The municipality is not and will never apply double standards when it comes to the issue of contravening its by-laws,” the municipality states. They say that last year alone, 196 contravention notices related to land-use management were issued within the Louis Trichardt Extensions, Tshikota, Eltivillas and Vuwani townships. Is it still necessary to adhere to municipal bylaws and regulations when it comes to starting a business in Makhado (Louis Trichardt)?
Judging by the number of illegal business prac-tices sprouting up across town in residential areas over the past few years, many believe that this question is justifi able.
For years now, Mooketsi Towing has been operating illegally from a property, 80 Olifant Street (Erf 1642), still zoned as Residential 1. In 2011 already, this illegal operation was brought to the attention of the municipality. Earlier this year, the municipality acknowledged once again that Mooketsi Towing was trading illegally from a residential property when they stated “the owner

A workshop was also built on the
premises, with generators running and vehicle re-pairs taking place at all hours of the day and night. Huge traffi c jams are also caused by this company as drivers attempt to manoeuvre the fl eet of trucks in and out of this residential property. It is also not strange to fi nd heavy vehicles parked halfway in the road for days on end.
The Makhado Municipality’s apparent reluc-tance to act against these and other illegal business-es operating right under its nose has residents living around these properties fuming. Some believe there is a sinister plot behind the municipality’s turning a blind eye to these operations, while others are of the opinion that the municipality is applying dou-ble standards when it comes to cracking down on illegal business practices. (Contd from P1)“More than 20 contravention notices have been
issued this year and the municipality will take action [against] owners who are not complying. The list of those properties can be viewed at [the] town planning offi ces for reference,” the munic-ipality says.
In the latest development regarding the scrapyard in Grobler Street and Mooketsi Towing, the mu-nicipality states that both businesses, irrespective of their zoning, are in contravention of the munic-ipal regulations and by-laws. “The Department of Development Planning has investigated the matter and the site visit was done. It was found that the owners are contravening the municipal by-laws, in particular the Makha-do Land Use Scheme, 2009. Upon site vis-it, contravention letters were issued and given to the property’s owner,” the municipality said.
Following the issuing of the contravention let-ters, the owners of both properties were given seven days to discontinue the illegal land use on their properties. The owners, however, failed to respond. “The period given to the owners has lapsed and the municipality will exercise Clause 31.3 of the Makhado Land Use Scheme 2009,” the municipality says. This clause, basically, mandates the municipality to remove all buildings or work that does not comply with the land-use scheme from the premises at the expense of the owner. The supporting section of this clause is Section 42 (6) of the Town Planning and Town-ships Ordinance, 1986. “Currently, the internal process, in consultation with other departments within the municipality, is underway and the above
clause will be exercised before the end of March 2014,” the municipality says.
Maseakhole Constructability and Projects, op-erating from 21 Stubbs Street (Erf 1540) has also been found to be in contravention of the Makhado Land Use Scheme 2009. “The zoning of the prop-erty is ‘Residential 1’ with (the) dwelling unit as a primary right. There is no special consent applied for or given and the property is not rezoned. The municipality has since given the owner of the property a notice with a period of 14 days,” the municipality says. They point out that proper procedure must be followed when dealing with the issue of illegal land use. “The owner must be given
a notice fi rst before Clause 31.3 of the Makhado Land Use Scheme 2009 is exer-cised. This will serve as evidence,” the municipal-ity says.
With regard to the mu-nicipality’s recent crack-down on illegal hawkers, the municipality states that it should be noted that contraventions are dealt
with in terms of Section 42 of the Town Planning and Townships Ordinance of 1986 (Ordinance 15 of 1986) and Clause 31 of the Makhado Land Use Scheme of 2009, and steps as stated under the section and clause must be followed. “This is different when coming to hawkers issues since the municipality is the rightful owner of the property where hawkers normally operate and operation without a permit or licence issued by the owner (municipality) is an offence. The difference is the process to be followed and illegal land use is more complex as it deals with the individual owner of the property and evidence will be needed in case of court order,” the municipality says.
Municipal by-laws still apply to all residents
“More than 20 contra-vention notices have been issued this year and the
municipality will take action [against] owners who are
not complying”
Another business operating in contravention of municipal bylaws and regulations? This is the scene of a transport company at 56 Munnik Street (Erf 643) where the municipal sidewalk also doubles as a workshop for trucks to be repaired, as was the case when this photo was taken. On the adjacent property, 58 Munnik Street (Erf 641), a business signs appears (registered as Masana Social Consultants CC on the municipal valuation roll), although both properties are still zoned as Residential 1 on the valuation roll.
Instead of cashing in on the illegal rhino horn trade, a wouldbe poacher was ordered to pay thousands of rands into the Kruger National Park’s antirhino poaching fund this week.
On 10 October last year, the 27-year-old Chico Maluleke from Mozambique was caught armed with a .375 Winchester hunting rifl e and ammunition, walking in the Punda Maria area of the national park. He ap-peared before the Louis Trich-ardt Regional Court on Mon-day, where he pleaded guilty
to single counts of a restricted activity in a special nature reserve, illegal possession of a fi rearm, illegal possession of ammunition and illegal access to a national park.
Maluleke, when arrested, told park rangers that he was only hunting game for their meat. During his court appearance on Monday, he also used this excuse as extenuating circum-stances as to why he should not be sent directly to jail. Maluleke also admitted that he was a fi rst-time offender and truly showed remorse by pleading guilty.
Regional state prosecutor Hilke Janse van Rensburg, how-ever, argued that with such a big calibre weapon it was doubtful that Maluleke was in the KNP to hunt for small animals. “It is lucky for us that the park rangers were on duty, otherwise he might have shot and killed a rhino or elephant,” said Janse van Rensburg.
Maluleke was fi ned R20 000, payable to the rhino fund of the KNP. In addition, he was also sentenced to four years’ direct imprisonment, suspended for four years.

Rage is mounting against all those who continue to destroy and steal the town’s municipal infrastructure necessary to provide residents with a constant water supply.
Thieves once again the targeted the boreholes situated at the Rietvley smallholdings, southwest of Makhado (Louis Trichardt). These boreholes supply Tshikota and the old part of town with water. The previous time when all the boreholes had been equipped, at a cost of R2.4m, all of them were stripped bare and rendered dysfunctional after one month.
Word probably had spread that the Vhembe Dis-trict Municipality was busy equipping the boreholes again. The Zoutpansberger witnessed a broken concrete pump house with most of the equipment gone on 18 March. The pump house had just been completed and the borehole equipped by Solidarity Developers four days earlier.
Sub-contractor Johan Kotze of Johan Pompe arrived at the pump house, which only needed elec-
Fighting a losing battle against constant theft
Thieves have targeted yet another borehole pump house. They had broken the back wall to gain access. Staring in dismay are, from left to right, Mr David Mukosi, Vhembe’s Makhado water manager, Mr Wally Schultz, chairperson of AfriForum Louis Trichardt, and Mr Liano Viviers, contractor partnering with Solidarity Developers.
trification in order to start pumping. When Kotze unlocked the heavy steel door on the 18th, the con-crete pump house which had seemed impenetrable had been broken into. Thieves had smashed through a back wall and bent open the steel reinforcement. Two mono pump heads and two 5.5 kW motors that had been lying on the floor were removed.
The stolen equipment is valued at R70 000. The contractors, Messrs Liano Viviers and Johan Kotze, afterwards removed all other equipment from the site. “They could not steal the mono pump that was fitted in the blockhouse; it is far too heavy to remove,” Kotze said. It is suspected that the perpetrators used a vehicle because of the weight of the equipment.
“Our goal was to connect this borehole and the one near Woodstock on Wednesday (19th) and then continue with the others. This site must get security as soon as possible,” Viviers said.
Mr Samuel Ndou, whose cattle graze at the site, said that he had received a phone call on Friday evening (14th) around 09:30. “They told me that my cattle were in the road. I drove there and found the gate open and the chain of my lock gone. Every couple of months they come here and steal the machines. I don’t believe that it is always just Zimbabweans…” Ndou said.
The chairperson of AfriForum Louis Trichardt, Mr Wally Schultz, was enraged that AfriForum’s objective of getting consistent water to town had been delayed by thieves. “AfriForum insisted that a case be opened, unlike in the past when there were no dockets when thieves and vandals had stripped the water infrastructure. Not opening a case means no investigation and no repercussions for the thieves. The swiftness of this theft leads one to think that this could be an ‘inside job’… ” Schultz said.
A criminal case has since been opened with the Makhado SAPS.

If you have not entered a team for this year’s Cansa Relay for Life, there is still time.
This year’s Relay will start at 18:00 on 28 March and continue until 06:00 the following day (29 March), with Louis Trichardt High School making their sports grounds available for this community event.
Entered teams attended a last-minute meeting on Monday to smooth over details for the coming event. During the meeting, organiser Mr Dirk Meis-senheimer asked the public to be patient with any noise that might be caused by the event. As part of the Relay there will be music and announcements throughout the night.
Over the past three years, residents have shown unprecedented support for this project. The Cansa Relay for Life is about showing support to people who have overcome cancer or who still have can-
cer. Support is shown by spending a whole night walking with them.
At this year’s event, for the first time ever, there will be a state-of-the-art mobile CANSA screen-ing clinic where participants can undergo cancer screenings. Some of the tests will be free, while some will be available at a reduced price. There will also be various local artists and talents shows on the hour to keep walkers awake. Food, cool drink and coffee booths will be open for business throughout the night. No alcohol, drugs, or smoking will, however, be allowed on or near the track while the relay is in progress.
“If you are a smoker, you can bring extra cash because we will fine you if caught,” said Meis-senheimer.
For any last minute entries, Sinette can be con-tacted at 079 050 0074.Some of the team captains of this year’s Cansa Relay for Life met on Monday for a lastminute
meeting to finalize arrangements for the relay that will take place on 28 to 29 March here in Makhado (Louis Trichardt).

“Daar word ‘n ander waar-dasie-metode by ondernemings gebruik.

Limpopo Melkery is beste in Suid-Afrika
Foto verskaf.

Me. Rosetta Otto, wat by P.D.
Imperial GM in Makhado (Louis Trichardt) was honoured with two accolades during the national awards ceremony of Imperial GM South Africa. Hendrik thanked his service team for their hard work and dedication. “Without them this award would not have been possible,” he said.

Pitfalls keeping the Makhado local municipality from obtaining a clean audit were addressed on Monday during a public hearing held at the municipality’s council chamber.
Members of the municipal public account committee (MPAC) asked the municipal manager about the problems that were identified by the auditor general (AG) in the 2012/2013 financial year. The municipal manager was also asked if the municipality had taken any resolutions to prevent the re-occurrence of those problems.
The municipality obtained a quali-fied audit in the previous financial year (2012/2013) after many years of receiving a disclaimer from the AG.
Mr Sakkie Mutshinyali (municipal manager) acknowledged that it must not be taken for granted that after 10 years the municipality had ultimately moved to a qualified opinion. He said even though they were working on obtaining a clean audit, the public should know that the municipality had spent the full municipal infrastructure grant (MIG) in that financial year. He added that there were several improvements which signified that the institution was in good hands.
Some of the pitfalls established by the AG include irregular expenditure, incor-rect interpretation of accounting standards and inadequate inventory control. Mr Mutshinyali said that a few institutions, such as the provincial treasury and the AG had agreed to assist them in their efforts to achieve a clean audit in this financial year (2013/2014).
“If we were able to move from a dis-
Municipality endeavours to acquire clean audit report
claimer to a qualified opinion, what will prevent us from obtaining a clean audit?” he asked.
The municipality has developed an ‘audit action plan’ which will address those setbacks established by the AG. “We always try in our management meetings to address our setbacks through this audit action plan. The appointment of the new performance management system (PMS) manager ensures that directors are evalu-ated,” said Mutshinyali. He said the PMS, internal audit committee and the integrated development plan (IDP) officials managed to work together to address problems.
“This collaboration will ensure that we improve and achieve a clean audit in this financial year (2013/2014),” he added.
The municipal speaker, Cllr Lindiwe Mohale, said that the council would like to receive progress reports indicating how the municipality management was resolv-ing those setbacks. She said even though there were few irregularities established by the AG, the municipal management should be commended for managing to spend 100% of the MIG. “It shows that the management resolutions will help us to obtain a clean audit in this financial year,” she said.
From left to right are Mr Gerald Odendaal from the office of the Limpopo auditor general’s office, Mr Isaac Mutshinyali (municipal manager), Cllr Rachel Malange (chairperson of MPAC) and Cllr Lindiwe Mohale (municipal Speaker).

Every year, on the last Saturday of March, the whole world is asked to switch off all nonessential electrical appliances and lights for an hour, between 20:30 and 21:30, to lessen the impact of “civilisation” on the earth and its natural resources.
This year, WWF’s Earth Hour campaign will be calling on you to make your individual promise to the planet by asking the question, “How do you Honour the Earth?”
For seven years running, on the last Saturday of March, millions of people around the world have switched off their lights for Earth Hour as a sym-bolic gesture to show their commitment to taking positive actions for our planet.
Beyond the symbolic 60 minutes of darkness,
Earth Hour has grown into a powerful, global, citi-zen-driven movement of progressive change for the environment. Recent examples of bold innovation and collective action have demonstrated the power of Earth Hour to effect lasting and tangible change across the globe.
Earth Hour is an inspired opportunity to engage our hearts and minds and to reflect on, and renew, our commitments to making the planet a place where we and future generations may prosper. Al-though we are not always aware of it, our individual actions can, and do, have a great impact on our natural world. This year, make a note and join the movement that will transform our planet. After all, you will be saving more than just electricity. (http://www.wwf.org.za/what_we_do/earth_hour_2014/)

Die Weg, die Waarheid en die Lewe
Jesaja 5:1-7
Die wingerd was God se ver-
bondsvolk Israel.
As jy dit doen sal jy lewe.
Lees Jesaja 55:6-7. 079 5168303

Brief
Waarheen gaan Cansa Relay-fondse?
Brief
Cyclists’ space must be respectedLetter
“Baardman, kom ek stiek jou vir ‘n pizza vanaand by Tony’s.
Of selfs ander ernstige siektes?
Mev. Tokkie Engelbrecht (Makhado / Louis Trichardt)
Mnr. Dirk Meissenheimer, voorsitter van die plaaslike Cansa Relay for Life, het in reaksie op die brief soos volg reageer:
Geagte mev. Engelbrecht.
U kan my skakel by tel. 082 789 3927.

I am very disappointed with the way motorists are not respecting
cyclists on the roads here in South Africa.
On Saturday, 22 March, at around 15:00, my father, Norman Thavha-na, who currently works at SNS Tyre Retreaders, was hit by a car at the N1/Elim crossing by a driver who ignored the stop sign. My fa-ther was busy with his usual practise ride to Adam’s Apple. Miraculously, he only sustained a sprained ankle and a couple of bruises. He was then
taken to the Louis Trichardt private hospital and he is recovering very well.
I think South Africa should toughen up on law enforcement to prevent these accidents from happening. The annual Kremetart race is getting closer and many more cyclists will fall prey to such drivers if we don’t create awareness campaigns for cyclists to avoid bad drivers.

Haar tyd was 12.40s in die finaal (853), terwyl haar tyd in die uitdunne 12.11s was.
Foto verskaf.
Goeie prestasies vir Triegie-atlete by SA’s
BergCare is ‘n niewinsgewende organisasie wat betrokke is by verskeie liefdadigheidsprojekte in Makhado (Louis Trichardt).

082 493 3189.
Despite the cold and wet weather, this year’s Munnik Meerkat Mountain Bike Race on Saturday, 22 March, attracted a record number of almost 600 entries.
The event is annually hosted by the Munnik Farmers Association, in conjunction with the P&L Cycling Club, with the 70 km and 35 km races serving as Limpopo-colours qualifiers. Year after year, this race is growing in popularity, as is evident in the annual increase in entries, and once again it lived up to expectations as being one of the most enjoyable MTB races on the provincial sporting calendar.
In the gruelling 70 km race, 75 cyclists managed to complete the event. In the men’s category, Alan Gordon cycled home in first place in a respectable time of 02:42:37. His time was just more than two minutes quicker than that of his nearest rival, Mario Ferreira, who finished second in 02:44:58. It was, however, a sprint to the finish for Ferreira with a mere second separating him and Eddy Texeira, who finished third in 02:44:59. Texeira boasted a second place in last year’s race, but with a much slower time of 02:51:06.
In the women’s race there was no contest for first place with Melanie Melville crossing the finishing
line in first place in a time of 03:17:27. Louwrina Dando came in six minutes later in second place in a time of 03:23:44, with Dorothy Rood cycling home in third place in a time of 03:39:10. Rood also boasted a third place in last year’s race.
The 35 km race saw the largest number of entries of close to 350 cyclists entering and 323 finally completing the race. The men’s race was dominated by the youngsters with first, second and third place going to high school students. Few will forget local star cyclist CP van Wyk’s impressive winning time of 01:14:49 last year. He has since turned pro and moved to Stellenbosch where he is studying. This year’s race saw that record being shattered by almost two minutes, with a Louis Trichardt High School student, 16-year-old Kombo Bere, winning the race in a blistering 01:12:33. Fellow club mate Marco Roets (18) took second place in a time of 01:14:54, with Gustav van Veyeren (17) in third place in a time of 01:18:14.
In the women’s 35 km race, last year’s winner Robyn Cronjé was back to defend her title. This year, however, she only managed a third place in a time of 01:33:37. Top honours this year went to Ashley Murray, who completed the course in a winning time of 01:28:39. It was also a sprint
