Kennedy and onefrom Javitsboth in regard to Federal Grant Aid.

Letter was received from Eugene J. Heil, Chairman of theEvans-Angola Recreation Commission recommending the appoint-'ment of Mr. Donald Grundtisch as Director of the Rec. Com.The following resolution was adopted by move of Mr. Whiteand 2nd. by Mr. Kingan: Whereas, there is a vacancy in theposition of Director of Evans-Angola Recreation CommissionNOW THEREFORE IT IS RESOLVED, that Donald K. GrundtischJ12Beverly Dr.,Angola, N.Y. be approved and appointed as Dir­ector of the Evans-Angola Recreation Commission and the sal­ary of $150.00 per month for the (10) months;and$.mO.OO perweek ofr nine (9) weeks in the summer from the joint X»~Town-Village Recreation item be approved, subject to approvalby the Erme County Office aof Personnel. Mayor Carbeck received the notice for Registrar apqDintment. It was moved byMr. Kingan and 2nd. by Mr. White that the following resolution be passed:Resolved that Marianne Arnold is hereby appointed Registrar of Vital Statis­tics for the term commencing Jan. lst.1966 and ending Dec. 31, 1969 and allpursuant to section 4121 Article 41 00. the Public Health Law. Un. Crd.Mrs Arnold appointed Chief of Police Stanley Maronski to act as Deputy Reg­istrar whenever her services were not available.

Question arose on the erroneous tax entries for Charles Corluccio and MrsStella Lerczak that are present on the tax roll. Marianne Arnold suggestedthat this matter be corrected so that she may be able to make the necessaryadjustments on the tax control sheet before Feb. lst.1966. It was moved byMr. Kingan and 2nd. by Mr. White that the following resolution be adopted:Whereas the Village has carried on the assessment roll account # 202-265 inthe name of Charles Corluccio onthe So. side aof 42 Delwood Ave. in theamount of $5.20 and account # 202-391-125 in the name of Stella Lerczak onJohn R. Drive in the amount of $7.80 and pursuant thereto both parties haveattested the tax as there is a duplication of assessment in as much as theseparcels are shown under the assessment account as follows: 202-265 underacct. # 202-268 and 202-391-125 under 500-249. NOW THEREFORE BE IT RESOLVED

FIRE DEPT.:Only report in was the Fire Inspection report from the Chief of the FireCompany on the quarterly Inspection conducted each year. The Fire Contractwas received from the Town of Evans for approval and signatures of theMayor and Clerk. This was withheld due to several items to be checked bythe Village Attorney and approval from the Fire Dept.

POLICE DEPT.:Request was received from Police Com. White in regard to patrolman John

.Reiter attending Training School from Jan. 31st. to March l8th.,1966.The following resolution was moved by Mr. White and seconded by Mr. JeneHeimburg: Resolved: Police Officer John Reiter is hereby authorized toattend the Erie County Shermffs Police Training School, 37 Franklin St.,Buffalo, N.Y. starting January 3lst.,1966 and continuing to March l8th.~

Mil.ler· have been completed and his app­roval has been received.Receiver on Lake Street has been installed.Question arose on the serious condition prevailing at the R.R. crossingon cars being caught within the train gates and insufficient passagewayfor cars to proceed off~ofthe tracks. Letters have been forwarded to thePublic Service on this condition and the replies received still do notcorrect the condition ·that prevails. The State Highway Dept. must widenthe street area before and past the R.R. tracks to promote a safetymeasure for all cars crossing the tracks. It was moved by Mr. Dennis andseconded by Mr. Kingan that a letter be sent to the Dept. of Public Workson this serious condition and in the meantime, the Board of Trustees willdo all they can to help eliminate this hazard. Letter was received from Mr. Edwin Cotton stating that he would forward acomplete statement on all of the work that has been done at the plant andalso a financial statement accompanying it. In the meantime, it was dec­ided that the Bill received from Harvey Myers & Sons be withheld until thestatement is received from Mr. Cotton.

It was moved by Mr. Kingan and 2nd. by Mr. White that the following Res­olution be passed: Resolved that the Mayor is hereby authorized to make app­lication to the New York State Division for Youth for approval of Rec­reation Project in accord with the budget of the Evans-Angola Rec-reation Commission attached to such application. TAX REPORT:Tax Collector Marianne Arnold stated that she has s.ent out.3 notices on theVillage taxes that are still unpaid and that she has received several pay­ments but there are a lot more still outstanding. The certified report forUnpaid Taxes to the Board.must be presented by Feb. Ist.,1966 and at thattime the Board will determine as to what method is to be used for the coll­ection of same. The next Board mtg. will be on Feb. 7th. which is past thedue date for the approval of the Certified Tax list so the Board will meetfor an informal meeting on Jan. 31st. to accept the Certified Unpaid TaxReport from the Yreas. & Tax Collector. The 1966 tax roll has been filedwith the Village Clerk and the Public Services tax entries have not beenrecorded as yet until they are received plus the Special Franchises.Clerk was so instructed to notify all Property Owners on their change ofAssessments.

Erie County Association meeting wi+l be held on Thursday Jan. 20th. inBlasdell. 10 Members are planning on attending.

Mayor Carbeck stated that the date to hear Grievances is legally set forthe 3rd. Tues. in Feb. so Grievance will be held on Tues. Feb. 15th.,1966from the hours of 6 P.M. to 10 P.M. and for the entire Board to be present.

Clerk=Treas. Marianne Arnold and Budget Director Earl Kingan request thatseveral transfers are necessary due to some changes that have occured sincethe budget was adopted. In treWaterDept. a tranfer is needed for item 290-616 on Real Estate taxes due to the new Sewer charges imposed on the taxbills, so this fund is short a total of $482.461 i:kXlXlaal in the General Dept.accounts # 290-623 Taxes on Village Property1 290-624 tax expenses1 item290-681 Interest on BAN notes are short of funds. Mr. Edwin Cotton, Village Engineer was present at the meeting and gave a reporton the work project at the pumping plant and a summary on the Pipe Cleaningproject that was completed, plus an itemized report of expenditures to date.

Mr. Heimburg reported that new gas heaters are in need at the Angola PumpingStation. The .present heaters h~ee been removed due to gas fumes escaping andnew gas heaters must be installed immediately. It was moved by Mr. White and2nd. by Mr Dennis that 4 heaters be purchased and installed at the plant. Un.Crd. Water Com. Heimburg will purchase the heaters and have them installed assoon as pOBsible.

The Regular Meeting of the Board of Trustees, Village of Angola, N.Y.was held at the Village Hall on Monday Feb. 21st.,1966.

Meeting was called to order by Mayor Donald L. Carbeck at 7:30 P.M.

Several representatives from the Niagara Mohawk Corp. were present atthe meeting to discuss electrical heating for the Commercial St. VillageCffice. Mr. McMullen, presented the Board Members with a proposal on factsplus estimates of cost. Mayor Carbeck stated that the Board would table thisfor a further discussion which would be held before the close of the meeting.FIRE DEPT.:Mayor Carbeck read a written request that he received from Fire Chief NelsonArnold in regard for permission to be granted on the purchase of six Plec­tron Home Receivers for the Fire Dept. The cost of the Plectrons would bearound $817.00. By ordering a group of six, it would enable them to be tappedin on the Plectron channel Board. It was moved by Mr. Heimburg and secondedby Mr. White that the Fire Chief be given permission to make the purchase assubmitted. Un. Crd.Fire Chief Arnold also stated that it is his suggestion that one of the oldhome receivers be installed at the Angola Waterworks, so that they would bealerted of any large fires due to the water consumption and pressure thatwould be needed for same. It was stated by Mr. Heimburg, the Water Com. thatit is not necessary for this equipment to be inslllalled at the plant, as theyare alerted immediately of any big fires, and that the Fire Chief should actWisely before issuing the new receivers, so that men will receive them, thatwill be using them for the fires,and that the receivers will not be layingaround idle without any imporatant usage.Fire Chief Arnold also alerted the Board that the Angola Vol. Fire Co. hasrejected the Contract between the Town of Evans and the Village of Angola,due to the Fire Inspection clause which is in the contract.

POLICE DEPT.; No Report.

ST. DEPT.:St~ Com. Dennis made the report on the sewer line that has been laid onSchool St. And he also requested that two large trees in that area must betaken down, as they are the cause of all the sewer trouble due to the largeroots.Mayor Carbeck gave a report on the progress of the Erie Co. Sewer lines forJohn R. Drive, Com. st. and the Lerczak Area.It was suggested by Mr. Dennis that a letter should be written to the Erie Co.Sewer District as to the added expense to the Village for this sewer work anda bill should be presented to them covering the materials and man labor. Mr,Dennis requested Supt. Gugino to give him a listing of same, so that we canprepare a billing and send it with the letter.

Mayor Carbeck requested the pleasure of the Board on the purchase of a bladeto be used on the snow plow that cost $300.00. It was decided that this bladeis needed for the plow, so it was moved by Mr. Heimburg and seconded by Mr.Dennis that this blade be purchased. Un. Crd.

288Water Com. Heimburg stated that he has set up a meeting to be held on Sat.Feb. 26th. at 1 P.M. here at the Village Hall with Town Supvr. Klumpp; WaterSupt. Norman Wick and Ma~or RiChard Hosisington of Farnham and Water Supt.William Battaglia from Farnham. Clerk was instructed to notify the above byletter.

In regard to the letter that was received at the last meeting from DistrictPrincipal William Houston on the garage hoist, it was moved by Mr. Dennis andseconded by Mr. Heimburg that the following resolution be passed: Whereas, theVillage of Angola bought the new Fire Hall and Village office building in1962 which building was formerly used as a garage building and Whereasthe said building contained a Weaver 2 part auto lift used by the formeroccupant and Whereas the Angola Vol. Fire Co. has recently adopted a res­olution to the effect that the lift is of no use to the Company and in­dicating their desire that the same be removed and this space filled in andleveled off. NOW THEREFORE IT IS RESOLVED this Village Board does hereby det­ermine that .the lift is of no value to the Village of Angola and should beremoved and the same become the property of the Lake Shore Central School'District prOVided the removal of the same is done at the sole expense of thesaid Lake Shmre Central School District and further that the said SchoolDistrict prOVides all labor and materials in filling the hole and repairingthe damage to the floor from Which the lift is removed. It was moved by Mr. White and seconded by Mr. Dennis that the follOWing res­olutions for elections be passed: RESOLVED: Election shall be held at theAngola Village Hall, 11 No. Main st., Angola, N.Y. 2 = The hours of openingthe polls shall be at 12 noon. 3= The closing hours shall be at 9:00 o'clockin the evening. 4 = The offices to be filled and the terms thereof are as foll­ows: Trustee in place of Earl Kingan - term = 5 yrs. Trustee in place of AubreyDennis - term = 5 yrs. Clerk is authorized to publish this information in theEvans Journal 10 days before election (March 3rd. issue) and post in 6 publicplaces. Un. Crd.

Mayor Carbeck stated that Mr. Schwenk was in the Village on the R.R. Crossingproblem. More details later on this.

Mr Edwin Cotton was present at the meeting on a report he has submitted onthe Booster Station project including all the expenditures. More discussionwill be held on this later at the next meeting due to the question of themoney used from the reqular water fund for expenses before the Bond funds weremade available.

Notice of a Public Hearing was received by Mayor Carbeck on a meeting to beheld in the Erie County Office Bldg. on Mar. 23rd.,1966 in regard to WaterPollution. Mayor Carbeck requested that if any of the Board Members can attendit would be appreciated.It was moved by Mr. Kingan and seconded by Mr. White that the Village conducts

~__~~illage Tax Sale on March 17th.,1966. Village Atty. Hurst and Treas. Arnoi'wil prepare the necessary data for this sale. Un. Crd. ' ,

Discussion was held on the renovacation of the new Village office on Com,st. and budget item 43-100 is to be entered on the books to cover the laborpayroll exppnses. It was moved by Mr. Kingan and seconded by Mr. White thatthis item be entered plus a total of $1000.00 to be allocated for payroll. Un.Crd.

Mr. Gerald Kingsley was present at the meeting with figures on the lightingfixtures and installation of extra service for the new office area. Mr. King­sley quoted a cost of $435.00 more or less for his billing plus a cost of~6iBiOO more or less for the light fixtures that the Village will have to pur­chase. Mr. Kingsley will present the Cle~k with the order·to be filled on same.

The Clerk was authorized to order the fixtures immediately upon the re­ceipt of the order from Mr. Kingsley.

At this time it was decided by the Board Members to accept the Iroquois Gasproposal on the heating and air-conditioning unit to be installed, in placeof the electrical heating that was previously discussed. Clerk was in­structed by the Mayor to contact Mr. Harold Jordan to proceed with his pl,ns.

~n regard to the Planning Board discussion what waS previously tabled. Mayorearbeck stated that he has contacted 10 men that have shown their desire toserve on this new Board. It was moved hy Mr. Whiee and 2nd. by Mr. Dennis thathe following resolution be passed: Resolved: Whereas the Angola VillageBoard is authorized by section 179 of the Village Law to appoint a PlanningBoard of five Members, now therefore it is resolved that the Planning Boardis hereby created and the folihowing named persons .are hereby appointed asfiembers of such Board for the terms set forth after their respective namescommencing April 4th.,1966: George Lemmler = 1 yr. term; Carl Ulmer- 2 yr.term; Franklin Drago =3 yr. term; Carlton Hengerer =4 yr. term and DonaldVolker =5 yr. term. Mr. Smith, the Sales Representative from the Parson's Office EquipmentCo. was present atthe meeting with several proposals for office counter equip­ment. This was tabled for further discussion.

Due to there being three candidates for two Trustee positions, a namedrawing was held and the following were drawn for position = 1 = Carl Iannello2 = Earl Kingan and 3rd. Charles Catalano.

Fire Report was read and ordered filed. Mr. Salavatore,S<l'ek, Fire Com.was present at the meeting and returned the Fire Contract between the AngolaVol. Fire Co.,Inc. and the Town of Evans to the Village Board. Itwas:movedby Mr. Kingan and seconded by Mr. Dennis that the following resolution bepassed: Whereas this Board heretofore tentatively approved a Fire ProtectionContract with' the Town of Evans subject to approval by the Angola Vol. FireCo. It was moved by Mr.Kingan and seconded by Mr. Dennis that Joseph Houle of Lincoln St., Angola,N.Y. be hired to fill this position at the hourly rate of 1.75,per. hr.Un. Crd. Discussion arose on the necessity of a new police car. It was movedby Mr. Heimburg and seconded by Mr. Kingan that the following resolution bepassed: Whereas there is at present an unencumbered balance of surplus carr­ied over from the fiscaL :yeaI' ~H'ided May 31st;, 1965: 'in e:x:cess:of '1800.00 ,Nowtherefore it is resblveGF:t.hat the sum. of' $1800.00 be allocated to item 82­200 in the budget to provide for the purchase of a new 1966 police car. Letter was received from the Angola Chamber of Commerce as going on recordto control the speed of the passing trains in the Village of Angola,N.Y.

Mayor Carbeck received a letter of request from the Sewer Dist # 2 forthe lowereing of the present water rates. This was tabled until furtherdiscussion •..A signed petition was received from the residents of Lake St. and ProspectSt. areas on the flooded conditions that prevail on the street and sidewalkin that area. Mayor Carbeck stated that he will try to contact someone fromthe County Highway Dept. to see if this condition can be corrected. He willhave a report on this for next meeting.

,Request was received for the purchase of a new street broom attachmentto be used with the new equipment that was recently purc~ased. This wastabled until next mewting.

Clerk gave report to the Board on Anna Greninger of Center St. who trippedover a raised walk on Cen~er St. and that she has requested that this walkarea be leveled With the driveway exit that leads to the rear of the No.Main St. business places in that block. It is a hazardous condition andshould be corrected immediately. St. Com. Dennis stated that he would takecare of this as soon as possible.

Mayor Carbeck received a Itter for soliciting in the Village by AmericanRescue,Workers. Clerk was unable to contact th~% Better Business Bureau onthis group, so a letter was writtent to them and as soon as an answer isreceived, action will be taken on this matter.

Mayor Carbeck gave his report on the canvas that he made with several oft1;leLorain St. residents in ,regard to a dog complaint in that area,.,This was tabled until more information can be obtained.

Mayor Carbeck stated that he, has received a bill from the N.Y.C. RailraodCo. in regard to the expenses incurred by them during the installationof the 12" sewer line on Oatman St. which ran under the train tracks.Mayor Carbeck stated that he has received the permission from the:,Erie Co.Sewer Dist. # 2 that the Village will be reimbursed this amount by the SewerDist. Mayor Carbeck instructed the Clerk to pay this am9unt to the N.Y.D.Railroad Co. and then bill the Erie Co. Sewer Dist. # 2 for the same amount.

ST. COM. REPORT:St. Com. ,Dennis gave'his report on the street sweeper that he wishes to pur­chase for the Village of Angola. By purchasing this sweeper, it will elimatethe necessity of having to hire extra labor,just for street cleaning. Mr. Joseph Pinker, one of the Co-owners of the Angola Milling Co. was presentat the meeting and stated that the Angola Milling Co. would like to lease thecorner lot on York and So. Main St. for a Pool dsiplay that would be erectedby them. Mr. Pinker stated that they would assume all liability and they dointend to fence in the entire corner as a safety precaution., and that hewould secure the necessary Certifieate of Insurance from his broker and submitit to the Village Clerk. It was moved by Mr. Dennis and 2nd. by Mr. Kingan thatthe following resolution be passed: WHEREAS: the Village of Angola owns a vac­ant: lot at the Corner of South Main St. and York St. for which it has no imm­ediate use and WHEREAS Frank Pinker1 Leonard Pinkeq Joseph Pinker and ConradPinker doing business as Angola,Milling Co. at 6-8 South Main St.,Angola, l"l.Y.propose to ll3ase such tand from the Village for use as i(l- display i(l-rea forabove ground swimming pools, NOW TH~REFORE IT IS RESOLVED that the Village leasethe said land to Angola Milling Co. at the annual rental of $60.00 per yearpayable in advance commencing April lst.,1966. It is required that the tenantby a written lease agrees to fence the installationr agrees to hold the Vill­age harmless from any liability on the part of the Villager provide publicliability insurance for the benefit of the Village with limits of $100,000.00to $300,000.00. Mr. Edwin Cotton was present at the meeting with charts and a report that was-- drafted up by him in regard to the increased water consumption that has beenthe object of discussion between the Town of Evansr Village of Farnham and theVillage of Angola. After an anatysis was made of the report and Charts, itwas stated that the Village of Fa.rnham will g.ave to reinburse the Town ofEvans a sum of $29.49 which will rectify the discussions that have been heldon this matter. A copy of the letter submitted by Mr. Cotton is on file with

13the Village Clerk and copies of same will be submitted to the other partiesin mention, by Mr. Cotton.

A request has been received from the Erie.'County Sewer Dist. # 2 for a waterrate of 35¢ per M. for their water consumption at the plant. At the present ~

time they are on the household rate. This was tabled until the next meeting!and the Clerk will furnish a copy of the water rates for the Board to compare.

Question arose on the existing balance for the Booster Station Fund. This wastabled until next meeting.

Letter was received by Mayor Carbeck from the Erie Co. Dept. of Public Workson the resolution that was adopted by the Board of Managers of the Dist. #2 .Sewer Dist. .requesting that the Village Board is not ot issue any building Ypermits unless the applicant presents a receipt shoWing the connection chargefor the Erie Co. Sewer district had been paid. and that no construction isto be undertaken until this fee has been paid.

Mayor Carbeck received the notice of a Traffic Engineering Seminar to be heldMay 5th. in Buffalo, N.Y. and submitted same to Mr. Allen White, Police Com.in the event he can attend this meeting.

Mayor Carbeck reported that the New Planning Board of Angola met on March 15thand that Mr. George Lemmler was appointed to serve as Chairman of this Board~

and Mr. Carl Ulmer as Sec'y. The Planning Board will meet again on May 10th.and May 24th. and have extended an invitation to Mr. George McNeight to betheir speaker. .

Report wwas received from the Better Business Bureau in response to a letterthat was sent to them by the Clerk for information on the American RescueWorkers. Mayor CarbeCk read the report received stated that permission tosolicit in the Village by this group be rejected.

Mayor Carbeck reported that he will be meeting with the N.Y.C.R.R. Officialsand Public Service Com. Officials on March 30th. at 12130 P.M. for a meetingin regard to the Railroadbrossfng hazard that prevails in the Village.

Mayor Carbeck also received a letter from the Governor's Chamber in regardto N.Y.S.Office of Regional Development. This was tabled until next meeting.

Clerk-Treas. Marianne Arnold submitted to the bUdget director a request fora transfer of funds that are needed for 43-100 and 43-400. It was moved byMr. White and 2nd. by Mr. Kingan that a total of $1500.00 be transferred frombudget item 290-650 (Contingent fund) and that $500.00 be placed in 43-100and the remaining $1000.00 in 43-400. lIn. The Annual Re-Qrganization Meeting of the Board of Trustees, Village ofAngola, N.Y. was held on Monday April 4th.,1966 at the Village Hall.

Trustees elected for a four year term and' sworn into office by MayorDonald L. Carbeck were: Earl D. Kingan and Carl Iannello. Members of theVillage of Angola's new Planning Board were also sworn into office by MayorCarbeck: Donald VoRkery Eranklin Dragor Carl Ulmerr George Lemmler representedthe five member team of the Planning Board. Mr Carlton Hengerer the fifthmember was unable to attend the meeting.

Mayor Carbeck declared the above appointments and resolutions closed and continuewith the regular meeting.

Mr. Gene Heil and Mr. Ray Reitz were present at the meeting with a report'on the Youth Recreation program and the new Youth Service that the YouthCommission wishes to undertake. After a discussion and explanation of theNew Youth Service, Mr. Heil asked the pleasureofbhe Board for a changeto be made in the tentative budget for 209-400 which is budget item forYouth Program, the amount that had been set up by the Board Members was for$2300.00 and the change requested was that this be changed from $2300.00 to$2000.00 and the $300.00 be placed for the new Youth Service. It was moved byMr. Kingan and 2nd. by Mr White that this change be made in the tentativebudget. 'Un. Crd. '

Fire Report was submitted by Fire Chief Nelson Arnold. Read and ordered filed.

At this time Village Atty. Hurst stated that he had received a notation from oneof the Vol. Firemen on the Firemen's exemption of $500.00 which is in sessionat the present time. This was tabled until further notive. At this time therequest was al,so received for the Village to publish in the paper a request fortrash fires and garbage being burned in the Village Trash burner, that no oneis to dump an!i garbage in this, burner and there are not to be any fires started

,after ,sundown. No action was taken on this request at the present 'time, but Mr.Heimburg stated that the Village should remove this burner from the parking lotas it is ,a, eyesore and garbage hole.

Police Report was submitted by' Chief Maronski. Read and ordered filed.MayorCarbeck read a letter of thaaks he, received from Ptlm. John Reiter forallowing him to attend the Training School with expenses paid by the Village.Mayor Carbeck read the letter he received from Mr. Neff of the Personnel Off­ice stating that the prob. period for Ptlm. Reiter will expire on May 21,1966.

Letter of thanks was received from William Houston, Dist. Principal of LakeShore Central School for the generous donation of the garage hoist to theLake Shore School from the Village Fire Hall building.

Assessors verification stat,ement w,a,s signed and notarized for the Roll Bookthat was completed for 1966-67.

Next Erie Co. Village Officials meeting will be held at the Holiday Inn inHamburg, N.Y. on Thurs. ~ril 21st.,1966.

Mr. Smith was present at the meeting with smaples of a new drape for thewindow in the new office,bldg. This was tabled until further notice as theoffice has aot as yet been completed.

Request was received again from the Erie Co. Sewee Dist. # 2 in regard to, the change of water rates they have requested. Mayor Carbeck stated thatithere will not be a meeting of the Board of Managers until next week, so

Clerk has written to the Sewer Dist. advising that this current bill'bepaid as billed and next billing will probably be considered for a change.

Mayor Carbeck gave a report on the Official Meeting that he held with theRailroad Officials, Dept. of Public Works and Members of the Chamber ofCommerce on the Railroad crossing to be widened. All looks satisfactory at

Transfer request was submitted by the Treas. to the BUdget Director for 43­100 which will be short for next payroll. It was moved by Mr. Kingan and 2nd.by Mr. White that $100.00 be transferred from 43-200 to 43-100. Un. Crd.

Fire Protection Contract has not as yet been ~eceived from the Town with thechanges requested.

The Street Lighting Survey was received from Mr. Harry Gilbert of the NiagaraMohawk Corp. for the Village of Angola. This was left tabled until the nextmeeting due to some extra lights requested as necessary in the Village.

Question of a Revision of the present Dog Ordiances were brought up: Clerkwas instructed to write to other Villages as to what their Ordiances read.

At this time Mayor Carbeck requested if all bids were received for the newPolice Car. Clerk Arnold stated that she had sent out 5 copies in the mailand only received the one presented at the meeting.Mayor Carbeck declared the receiving of all bias on the police car closed andproceeded with the opening of the one bid: Bid received was from Lewis AutoService on Route 5 in the amount of $1325.00 less trade-in. Check for $66.25accompanied the bid. It was moved by Mr. Kingan and 2nd. by Mr. White thatthe following resolution be passed: Whereas specifications were heretoforeapproved for the purchase of a new police car with the 1964 Ford to be tradedin and Whereas Notice of such trading of bids was duly pUblished in the EvansJournal and at the SKm& time and place indicated on Monday Apr. 4th.,1966 at8130 P.M. and one bid having been received to wit from Lewis Auto Service inthe amount of $3020.35 less $1695.35 trade in of Ford giving net price of$1325.00 for purchase, NOW THEREFORE IT IS RESOLVED that the Village pur­chases such Plymouth Fury Police Car from Lewis Auto Service and the Mayoris authorized to turn over the 1964 Ford in partial payment of such newvehicle. Mr. Harry Gilbert from the Niagara Mowawk Corp. was present at the meet-I ing in regard to a Street Light Survey he has made for the Village area for

the changeover from the present lights to Mercury Vapor. This proposal wastabled until the next meeting due to several new lights to be installed anda completee survey to be presented to the Board listing the gross total forthe complete changeover.

A group of Village Merchants were present at the meeting in regard tothe parking meters. They were in accordance that the meters should be re­moved and the Village should resort back to the 2 hr. parking on the MainSt. area. Business has dropped off considerably with some of the Merchantsthat were present and they have blamed it on the parking meters, as some oftheir customers do not favor the meter fees to be paid when they shop in theVillage. They also complained on the condition of the parking lot, it is invery poor condition due to rubbish, glass, cans and etc. strewn allover thelot and the condition of the Village rubbish burner which is filled withburned garbage and it is a hazard when cars are parked close by and papersare being burned in the burnerl Mayor Carbeck listened very tentatively toall Merchants that wished to be heard, then he expressed his views on boththe parking meters and the rubbish burner. His first comment was dn the metersMayor Carbeck stated that the parking meters were first installed for thebenefit of all of the Merchants, so that the public could find parking spacesto shop in the Village, prior to the meters, all day parking by both theMerchants and their personnel could not be controlled by the previous 2 hr.parking violation. So a survey was taken by the Merchants for thier opinionon having meters installed and the survey was in favor of the meters, so themeters were purchased and paid for from the meter revenue and they provedvery satisfactory. Several years after the meters had been installed, theyhad to be removed for cleaning, adjusting and re-oilirig, so the meters weeenot in use for a month or so and during this period of time, cars were beingparked on the streets for the full 8 hrs. by Merchants, store personnel andeven the Town police. Complaints were being received for the meters beingout of operation so long and people not being able to park on the street toshop. Mayor Carbeck stated that better police patroling could be used in re­gard to watching the meters, the Dept. has been lax on several occasions andwhen he has issued the order to the Police Dept. for a closet check to bemade on the meters, the public goes up in arms over this order, all due inrespect to the violators taking advantage of parking all day When the policewere not on the alertl The removal of the meters is not an easy project. Itwill take considerable time for the Ordinance to be cancelled out, a new Ord­inance will have to be setup and pUblished with a new Violation to be im­posed for a limited time on parking and after this lengthy procedure, theMercha~ts w~ll still be diSSatisfied as any other method for parking is veryhard to control. Mayor Carbeck asked the Merchants to think this over beryseriously before making their survey for the removal of the meters, he willbe very pleased to hear whatever suggestions are presented to him. Next -the rubbish burner complaint was accepted by the Mayor, as he too, has foundthis to be an awful eyesore.

38 The Merchants were blamed for this condition that is prevailing, as someof them have tenants who dump their garbage in this burner in place of itbeing set out for refuse collection each week. The Vi11age maintenance menclean this burner out ev~ry week and yet the garbage dumping cannot bestopped. Mayor Carbeck stated that the lease for the use of this parkinglot expires on May 31st. of this year, and' he instructed Village Atty.Hurst to check with the property owners on their suggestions on the re­moval of this burner from the parking lot. (As it was in the lease thatthe Village should provide a burner for papers, so that they would not bestrewn allover the parking lot by the public use of this lot) Mr. Hurstwill have a report for next meeting on this.

Mr. Leonard Lerczak was present at the meeting in regard to hisprevious request for a sidewalk to be constructed in the Grove St.-John R. Drive and Lerczak Dr. areas. This walk is in great need for thechildren and·the public in walking to church and the children for school.St. Com. Carl Iannello made a note of this and will check on it and havea report ready as soon as possible. Complaint was a10s received from Mr.Lerczak on the dust condition in that area. Mr. Gugino will take care ofthis as soon as possible.

Mr. Gugino suggested that a man be hired to help with the Sidewalkand street cleaning as the new broom that was installed on Village Equip­ment can only push the debri to the curb and a man is needed to continuewith the sweeping. No action was taken on anyone being hired as yet.,

Mr. Heimburg asked about the parking for the new area being con­structeq by the R.R. tracks on Com. St. The Board is in favor or a 1 hr.parking limit, so that parking ~an be controlled to some extent other­wise the Village will be plagued with all day parkers in that area andthis new section will not be of any benefit to the Merchants.

The following resolution was moved by Mr. Kingan and 2nd. by Mr. White:Whereas, this Board of Trustees has 'met at the time and place specifiedin the notice of public hearing on the tentative budget and heafd allpersons desiring be heard thereon, therefore it is resolved tha thetentative budget as amended and revised and as hereinafter set forth ishereby adopted and that several amounts stated together with the am­ounts set forth in Statement 1 as required for the payment XaxxEkeof andinterest on inde»tness, be and they are appropriated for the objects andpurposes specified and the salaries and wages stated in schedule 5 ofsuch budget shall be and are hereby fixed at the amounts shown thereineffective June lst.,1966. Mr. Floyd Wilson was present at the meeting in regard to the Dog problemthat is a serious nuisance with a large number of Village residents at thepresent time. Trustee Carl Iannello also stated that he has received a largenumber of complaints in,regard to this nuisance of dOgs running loose in theVillage and actually something should be done to curb it. Village Atty. Hursttried to explain the pros and cons in regard to a Dog Ordinance and all thatit involves, and this situation cannot be curbed overnite. It was suggestedthat the Clerk notify Mr. John Miller, the Town Dog Warden and invite him toattend the next Board Meeting and possibly he would have some good' .suggestionsas to curb this problem.

Mr. Harry Gilbert was present at the meeting with a complete survey and am­ounts for the changeover to new street lights. He left a copy of the nec­essary papers to be signed shOUld the Village decide to carry out this newstreet lighting program.

Mr. Leonard Lerczak was present at the meeting in regard to a sewer line thathe proposes to lay in a "neW area at Rosalind Dr. Mr. L'erczak stated that allhe is requesting from·the Village is the purchase of the sewer tile and thathe would furnish all of.the labor and rest of the materials that would beneeded. His r'equest was tabled for Mayor Carbeck I s approval.

Heimburg and Village Engine~r Edwin Cotton gave a report on themeeting that they both attended in Washington, D.C. on the Federal Aid program.Mr. Cotton stated that before any application can be presented for any Aid, acomprehensive program planning would have to be se~ up first, and after this wasdone, then the rest of the worK would proceed from t~is point on. It was sugg­ested that this program be presented to the new Village Planning Board. Mr.Cotton stated that he would be glad to assist them if they wished his help.

Mr. Heimhurg stated that he will have to maKe some changes of the electricmeter up at the stand pipe area. He will checK on this more thoroughly andhave a report later on it.

Discussion was held on the Erie Co. Sewer Dist. # 2 request for a flat 35¢water rate. They have returned the billing sent to them unpaid, and request'edif possible that it be revised. Clerk Arnold stated that this billing has be.enprecessed on the water ledg.ers. and on the water control with the rest o.f the1st. qtr. wat.er.;::billings, and if it was to be revised, the change would haveto be followed through on the water records, also the fact that this bill wasdue April 15th. and it having been declared delinquent as of now, it is subjectto the 10% penaly as the Sewer Dist. is not exempt from a penaltY,on del­inquent bills. It was moved by Mr. HeimJ;mrg and 2nd. by Mr. Iannello that thefollowing resolution be passed: RESOLVED: Whereas the Erie County Sewer Dist.# 2 purchases water from the Village of Angola for uSe at the Sewer plant andWhereas the Town of Evans Water Districts and the Thruway Restaurant, bothpublic users of Village water. at the rate of 35¢ per M. Mr. Cotton, Mr. Heimburg and Mr. Iannello gave a report on the drain water inthe Lake & Prospect St. areas. Mr'. Cotton presented some figures to the Boardthat he had arrived at and also question on the footage. Further discussionwas tabled on this· until Mayor: Carbeck can meet with Mr. Earl North.

Board Invitations ware recieved from the American Legion Post of Memorial Dayparade, and the other was reveived from the Home Bureau for May 5th. from 6P.M.­9P.M. at the Congr. Honorable Mayor Donald L. Carbeck:

As Fire Chief of the Angola Vol. Fire Co~ I feel it is my duty to sub­mit this report to you which I feel is of vital importance as it is in re­gard to Fire Fighting Equipment which should be put out of service as soonas possible before we are faced with a serious accident that may result ina death or permanent injury to the Fireman driving it to a fire. During myrecent inspection of the Fire trucks, I found that the 1947 DodgerTank Truck(which was donated to the Fire Co. by Mr. Clerk, and which was before my termof office) is in very poor condition; the right front spring has weakenedcompletely pulling the chasis down on the axel and this pulls the truck tothe right making it very difficult to steer. The clutch is gone plus manyother important parts of the motor. The truck is a hazard and should not beused for any fiee calls. The tank is still in good condition and can be re­used on a new truck chasis.

The request for replacing this truck is very important as we cannotoperate without a water tank truck.

I did not make any allowance in the Fire Co. budget to the Village forthe replacement of this piece of fire fighting equipment due to my annualiBspection of the trucks being held after I had already submitted the FireCo. budget.

It would be very costly to have this old truck overhauled as in duetime we would be faced with other defects.

I would appreciate an anSwer as soon as possible to this request be­cause I will have to list that truck out of service as a precaution forthe safety of the firemen.

Bid Opening on Refuse Collection:Resolved: Whereas bids were received and opened for the award of garbage remov­al contracts for the year commencing July Ist.,1966 and ending June 30th.,1967and Whereas sealed bids were received and opened-at 8130 P.M. after consent ofboth bidders who were present in person waiting the 30 minute difference be­tween the 8 P.M. opening time as published and the 8130 time as stated on thespecifications as approved by the Board, the'difference being determmned bythe Board to be inmaterial, the oral consent fo the two bidders having beenrecorded: Joseph Ball = ~7300.00 and Sam Vassallo = ~6828.00. WATER DEPT: ,Water Com. Heimburg stated that both him and Supt. Gugino were into Buffaloat the Taber Pump Co. and that they have selected a pump that will be pur­chased for the ~umping station within the near future. Mr. Heimburg also statedthat he has placed his order for a M-S-A(AII Service Gas Mask ) plus the extracansisters needed, est. price around ~80.00 for the mask plus 8.40 for eachcansister needed. This mask is needed at the pumping plant when the men are

Discussion was held on the drainage tile to be purchased. Mayor Carbeck stated that June 9th. is the date that has been agreed upon fora joint meeting between the Village and the Evans Town Boards. Meeting to beheld here at the Village Hall.

Tax Collector Marianne Arnold stated that there is a duplicate taE bill forMrs Lade on the new tax roll and requested Board action for a resolution toclear the roll for the amount of this tax bill. This was tabled until the nextmeeting.

Main St. road wideningrand a written petition was received from the residents on Sunst Bldv. area inregard to the manner that the refuse is collected weekly by Mr. Vassallo.Mayor Carbeck instructed the Clerk to notify Mr. Vassalmo on this petition thatwas reveived and to also send him a copy of same and to also state that the'refuse collection is done in a very poor manner in regard to garbage being leftstrewn on peoples' lawns.

Mayor Carbeck also gave a report on the prices that he has received from twooffice equipment dealers for the equipment needed for the new Village Off­ice on Com. St. McClenathan's price did not quote the vault price and alsolacked several of the necessary file cabinets. The price quoted from EatonBothers Equipment Co. included the Walk in Vault plus the necessary filecabinets so it was moved by Mr. Heimbu~g}and 2nd. by Mr White that the orderbe placed with the Eaton Bros. Equip. Co. Un. Crd.

Water Com. Heimburg stated that he has hired Mr. William Burch to be employedat the Pumping station as a part time relief water plant trainee, becoming etf-'ective on June 11th. 1966 at the rate of $1.75 per hr.~yor Carbeck appointed Mr. Heimburg to serve as Pro-tem Mayor while Mayor Car­beck and Dep. Mayor White are away at the N.Y.State Conference of Mayors schoolto be held at Grossingers June 12 to June l8th.,1966.

The Regular Meeting of the Board of Trustees, Village of Angola, N.Y. washeld on Mo.nday June 20th.,1966 at the Village Hall.

Meeting was called to order by Mayor Carbeck at 7130 P.M.

Mr Vincent Walters, resident of Pleasant Ave. and Mr. Richard Carlson fromthe same area were present at the meeting in regard to a complaint that theypresented to the Village Board against the Niagara Mohwak Corp. The NiagaraMohawk Corp. is using the rear parking lot at their site for the storage ofpoles which are soaked with creosote and the odor from the creosote is veryoffensive in the hot summer months to the nearby residents. They also comp­lained sbout the water drainage from this lot, as adequate drainage was notinstalled at the time the parking lot was paved. Mayor Carbeck stated thathe would cheek on this and have a report at the next meeting.

Mr Johm Carlson was present at the meeting in request for a new sidewalk tobe laid on Lincoln St. area, so that the small children would have a safe areato walk in while attending school. Mr. Carlson will obtain the names of therest of the residents in this area for their approval of same. Report will begiven at the next meeting.

Mr Leonard Lerczak was present at the meeting in regard to the fence that hewishes to erect on his property. His request was sent to the Zoning Board ofAppeals and Mr Floyd Wilson, Chairman of the Zoing Board of Ampeals conveyeda message to the Village Clerk stating that the Zoning Board will approve thepermission requested if a written permission is obtained by MrLerczak fromhis neighbor, otherwise, the permission will not be granted. The ruling onfence erection was explained to him and also the fact that a permit must bemade out and filed for erection of fences as well as other building purposes.as this ruling is included in the Zommng Ordinances. Mr Lerczak also requestedthat the sidewalk request that he has previously made be carried throuhg forthe safety of the children in that area. He was so instructed to get a listingfrom the residents in that area for their permission to have this new walk in­stalled, as they were not in favor of this added expense in the past. This wastabled until Mr Lerczak presents the list to the next meeting.

It was moved by Mr. Kingan and 2nd. by Mr. Heimburg that the following res­olution be adopted: Resolved: Whereas the Town of Evans has submitted a con­

, tract relating to the payment of $8000.00 for the ,year 1966 by the Town ofI Evans to the Village of, Angola representing partial relief to the Angola Tax

Payers by reason of consideration that the Village maintains 4 full time pol­icemen, NOW THEREFORE IT IS RESOLVED that the Mayor be and hereby is author­ized to $ignthe agreement as submitted on behalf of the Village. ll[n. Crd.(Copy of agreement is attached sep.)

·132It was moved by Mr. Heimburg and 2nd •. by Mr. Iannello that Richard Currey behired as a relief temporary water trainee for the Angola Waterworks at the rateof $1.75 per. hr. becoming effective July 9th.,1966. Un. Crd.

Water Com. Heimburg also stated that the Supt. o~ Public Works should be pres­ent at every Board Meeting and if he cannot be present, a report should be sub-itted to the Board on all projects that are underway and the results to date

on each, so that the Commissioners and the Board would have a record of what isbeing done and what has been completed. Mr. Heimburg moved that this be a ruleand on record and it was 2nd. by Mr. Iannello. Un. Crd.

Mr. Bal. Sack stated that he would l~ke to see a Stop Sign erected at Del­wood and Glenwood to slow down a lot of speeders in that area. Mayor Carbeckstated that due to the new traffic sign ordinances that were passed, thiswould have to be tabled until later to see what could be done about it, andin the meantime, Mayor Carbeck would contact the Village Police for their co­operation on this violation.

It was moved by Mr. Heimburg and 2nd. by Mr. Iannello that the Treas. put intodeposit the sum of $40,000.00 into Certificate of Deposits; one certifiacte for$20 0 900.00 for 3 month period and the other $20,000.00 for a 6 month period. Un.Crd •

Mayor Carbeck will contact the Niagara Mohawk Corp. on the cOmplaint recentlyrecieved from Mr. Vincent Walters as to the zoning regulations.

ST. COM:St. Com. Carl Iannello stated that the project underway on Lake St. is comingalong very nicely and they have completed the R.R. Ave. area and are going totry to give the Sunset Blvd. residents some relief too within the near future.St. Com. Iannello also stated that he wishes a permit application to be filledout before an§?: Village Sts. or walks are torn up by any contractor. It was movedby Mr. Iannello and 2nd. by Mr. Heimburg that the following resolution be ad­opted: RESOLVED: No person or Corporation shall cl,1t or excavate under a pavedstreet of the Village of Angola or paved sidewalk of the Village of Angola with­out first filing with the Village Clerk an application for a permitsubstanicallyin the form as submitted herewith, to cut or undercut a street or sidewalk whichis to be granted or denied by the Supt. of Public Works and a Bond or Certifiedcheck in an amount to be determined by the Supt. of Public Works is to be filedwith the Village Clerk by the applicant at the time such Permit is granted.Such cut or opening is not to be made until permit has been granted. Mayor Carbeck received a notice from the State Board of Equalization andAssessment in regard to the New Lw exemption for the aged on Real Estatetaxes. This was tabled until further discussion.

Discussion was held on the Division of Youth Hometown Beautification Projectthat is under way. It was moved by Mr. Heimburg and 2nd. by Mr. Kingan thatthe following resolution be adopted: RESOLVED: Whereas the Village of Angolaand the Town of Evans have jointly entered into the New York State Divisionfor Youth Beautification Hometown Project which has been approved by the Stateof New York for reinbursement to the extent of $3500.00 to the Village ofAngola and $3500.00 to the Town of Evans and Whereas the Town of Evans is hand­ling the bookkeeping on project and needs the $3500.00 .from the Village forthe financing of such project which sum is to be reinbursed to the Village~

MAYOR'S REPORT:Mayor Carbeck gave his report on the following:1 = Mr. Frank Gugino will terminate his work at the Steel Plant on Aug. 27th.1966 and will assume his duties with the Village on a full time scale. Mr.Gugino has been cleared with the Civil Service Commission to be appointed bythe Village Board as Supt. of Public Works for the Village, a Civil Servicetest was waived by the Commission due to the years of service that Mr. Gug­ino has put in for the Village. It was moved by Mr. Iannello and 2nd. by Mr.He~burg that Mr. Gugino be appointed as Supt. of Public Works for the Vill-

3 = Question arose on the Police Aid from the Town of Evans. Mr. Kingan statedthat he would draft up a letter to be mailed to the Evans Town Board on this.

4 = Mayor Carbeck received the following letters which he read to the Board:State Board of Equalization and Assessment in regard to the State Aid for Hwyland the amounts that will be payable in April and June and the future setupof the remaining payments. This was ordered filed.

Letter from. the State of New York Dept. of Health in regard to the Approvals ofSewage Collection and Treatment Projects. Mayor requested the Clerk to make copiefor the Board Members of this letter.

Mayor stated that he has checked into some of the details on the vacant storeon No. Main St. which is owned by Mrs. Frank Leone, and has been informed thatthe bUilding is up for sale in the amount of $17,500.00 and Mayor stated thatthis would be an ideal place for the Village Library. Mayor presented the new keys to the Board Members for the new Village Clerk'sOffice on Com. St. which is under construction and hopes of it being completedby Sept.

Mayor stated that the construction Co. will have to lay a concrete floor in thevault al::ea Clue to the present floor having a 3" drop in order to make the vaultarea floor level with the office area floor, this will cost an additional est.of $75.00 or so.

Question arose on a full time clerk to assist the Village Clerk. Ad. was placedin the paper and 2 applications were received: one from Mrs. Donald Vellam, whosince has rejected the job due to other full time employment that she accepted. 1leaving one applicant and that being Miss Ann Runfola, whm is presently employedat Beal McCarthy and Rogers as Bookkeeper. Due to the budget item for an extraclerk not being sufficient for a full time clerk, it was decided that Mrs A,rnoldthe Village Clerk, re-hire Mrs Ware as a part time clerk for this fiscal yr. andapplications for a full time clerk be tabled until provisions are made for samein the new budget,

BUILDING PERMITS:Building permits were received from: Charles Mawk to erect a new home onStellane Dr. and from Turner's Applicator Svce. t~ erect an addition to pres­ent home on Allen St. for Sam Faraci. Mayor Carbeck gave a report on the N.Y.C.R.R. crossing widening. He receiveda proposed sketch of the widening and communication in regard to same. Thiswas referred to Villa~e Engineer Edwin Cotton to study and submit an answerto the R.R. Company. Mayor Carbeck requested that Police Com. White and ChiefMaronski make a survey of the street signs that are to be changed or addedand to present this list at the next meeting for review and for the Atty. tofollow thru on.

WATER DEPT:Water Com. Heimburg gave a report on the water that was pumped at the plantthis summer and stated that he was vwry pleased with the results and that allequipment is in perfect working condition other than a samll adjustment thathas to be made on some of the valves and he requested that Mr. Cotton and Mr.Myers are to meet on this within the near future. Mr. Heimburg also statedthat Mr. Burch is to go into Buffalo to the Board of Education to file an app­lication to try the equivanlency test for his High School Diploma so that hemay be retained at the plant as an operator.Mayor Carbeck asked about the compressor and batteries in the maintenance roomif they are used anymore, and it was stated that they are not in use, so theymay be removed from this room whenever possible.

PARKING LOT AGREEMENT:Mr. Heimburg stated that he has contacted the property owners for their sig­natures and approval for the leasing of the parking lot renewal and that hehas obtained all signatures but one, being Mr. Pearce from Hamburg, his re­fusal at the present time is due to the driveway footage next to his build­ing. Mr. Heimburg also stated that the owners complained about the disorderlymanner of this parking lot and that they requested that this lot be kept ina better condition than it has been, and alee questioned the $1.00 fee thatis to be paid to them. Mayor Carbeck instructed the Clerk-Trease to submita check to each owner of said parcels a check in the amount of $1.00 for nexemeeting.

ST. REPORT:

St. Com. Iannello reported on all of the streets that he has had paved andalso stated that he wishes to pave two more before the summer season is overplus resurfacing the parking lot on No. Main St.

Mr Foster Thayer was present at the meeting with his report of the Library site.Mr. Thayer gave a co~plete report oh this and after his refort, it was sugg­ested that he contact the Library Board and the Erie Co. Library Board for theirapproval of the Leone Building on No. Main St. which was one of the most selectedsites for a new Library bldg. and to have this report for next Board Mtg.

Clerk-Treas. requested a transfer for A 121-400 which will be in the deficitbefore next meeting due to the Lake St. Storm drain project that was completed.,A transfer of $1000.~0 was suggested. It was moved by Mr. Iannello and 2nd. byMr. Heimburg that the sum of $1000.00 for A 121-400 be taken from A290-650.~~rd.

Mr. Edwin Cotton was present at the meeting with his proposal of a sanitarysewer to be constructed on Sunset Blvd.1 and Terrylynn. This was in the amountof $6196.10 but stated that it could be cut down sonsiderably. This was tabledunJt1 next mtg.

Hurst for his report next mtg.Police Contract was read and it was moved by Mr. Allen White and 2nd. by Mr.Iannello that the following resolution be passed: Whereas the Village Tax­Payers pay both Town and Village Taxes, both of which taxes include support oftheir respective police forces and Whtireas the Town of Evans has agreed torepay to the Village of Angola the sum of $8000.00 in partial tax relief tothe Village taxpayers from payments made in support of the Town Police Forceprovided the Village continues to maintain a four man police force on anannual full time basis dueing such term. NOW THEREFORE IT IS RESOLVED that theVillage does agree to maintain such police force on a full time basiS and theMayor is hereby authorized and directed to sign such an agreement whereby the ~

St. Corn. Carl Iannello stated that most of the street paving work has beencompleted for the Village and that there is a small amount of sidewalk workplus the two parking lots that he would like to get finished before theweather changes. Request was made for the permission to purchase a largerbucket for the Backhoe so that the Village Maintenance men can handle thesnow removal rather than having to pay for this service. Mr. Gugino willhave more details as to the purchase price for this piece of equipment, inthe meantime, it was moved by Mr. Iannello and 2nd. by Mr. Kingan that theVillage street department be granted permission for this purchase. Parking Lot Agreement will be signed by Mr. Cash as soon as he returns fromhis vacation.

FIRE UONTROL ORDINANCE:Whereas notice was published in the Evans Journal August 18th.,1966, thata public hearing would be held at its Regular meeting at the Angola VillageHall on October 3,1966, upon the question of the adoption of an Ordinancerelative to Fire Control within the Village of Angola and WHEREAS the Boarddid meet and hold a public Hearing on the question and thereafter referredthe proposed ordinance to the Angola Vol. Fire Co. which thereafter approvedsuch ordinance. Fire Control OrdinanceVillage of Angola, N.Y.

For the purpose Of promoting the health,' safety and general welfare of tthe Village of Angola and its inhabitants, the Village Board has ordained anddoes hereby enact the following Ordinance:SEUTION 1. The burning of garbage in an outside bon-fire is hereby probited.Any bon-fires intentionally started for the burning of paper,boxes, or rubb­ish is permissable only when in a metal or wire container and when situatedat least thirty (30ft.) feet from any building. Any such fire shall be per­mitted to continue only while under the constant supervision of the personlighting the same and is to be extinguished by him before leaving.

Fire Dept. Report:Mr. Frank Lorenz, Member of the Fire Prevention Commission, was present atthe Fire Meeting with a recent report on the Fire Hydrant inspection that washeld in Octoboer by the Chief of the Fire Dept. and his Ass't. Shiefs. Mr.Lorenz stated that out of 86 Fire Hydrants, there are 42 that need repairs,many of which are minor labor repairs but which are vital to the operation ofeach hydtant in the event of a fire. Should the Fire Underwriters learn ofthis hydrant report, the Fire Ins. will take a tremendous raise and the Vill­age would be put on report for this, so Mr. Lorenz made a uital plea to the

1M ~11ayor and the Board of Trustees, to please have the maintenance dept. repair all,the hydrants on the list that are in need of repairs as soon as possible.Mayor Carbeck and Water Com. Heimburg stated that they would gmve this thmmrimmediate attention and assured Mr. Lorenz that they would be all repairedbefore the next inspection.

Fire Com. Sack and Carlson were present at the metilting with it;he fibllowingreports:Fire Boxes are still up and request that they be removed. (Mayor instructedthe Clerk to notify Mr. Weston Bull of the Niagara Mohawk on this)Firemen's exemption of $500.00 on Village Taxes. This was tabled until moreinformation can be secured.The Village to hire someone to finish the rest of the carpenter work in thenew Fire Hall and to have the electrical work finished. Mayor Carbeck re­quested a full report on the remainder of the work to be finished at theirhall plus an estimate of the cost. This is to be presented to the next BoardMeeting. Mayor Carbeck will contact Mr. Kingsley to finish the electricalwork also.

WATER DEPT. Report:Water Comma Heimburg stated that at the present time he is encounteringsome trouble with one of the valves that has been recently installed in oneof the filters. He has contacted Mr. Cotton and the other responsible rep­resentatives and has not as yet been able to rectify this condition. He wasadvised to contact the mfg. company that made the valves.

REPORT:Mr. Iannello was absent,soMayor Carbeck stated that he has received a·letter of complaint from the Cutler Pharmacy in regard to the conditionof the sidewalk in the front of their store and they requested that it bereplaced as it was before the walk was torn up. Mr. Gugino stated that Mr.Lauren Brown is taking care of this.

Whereas, the Angola Village Board has considered the proposed granting of a part­ial exemption from the Angola Village real propetty taxes for real property ownedby certain persons with limited income who are over 65 yrs •. of age, and WHEREASpursuant to notice duly given, a public hearing wa~ held at the Angola VillageHall on Nov. 21st.,1966, at 8,00 P.M., at which time all persons had an opport­unity to be heard and, WHEREAS, such partial exemption has been authorized bythe legislature of the State of New York, by enactment of Section 467 of theReal Property Tax Law, added by Chapter 6160f the Laws of 1966, NOW THEREFOREBE IT RESOLVED:1 = That Real property owned by one or more persons, each of who, is 65 yrs.of age or over shall be exempt from taxes by the Village of Angola to the .extent of fifty per eentum (50%) of the assessed valuation thereof:2 = No exemption shall be granted if the income of the owner or the com­bined income of the owners of the property exceeds the sum of Thres$ thousanddollars($3000.00) for the twelve (12) consecutive months immediately prec­eding the date of making application for exemption. Where the title is vestedin either the husband or wife, their combined i~come may not exceed such sum.Such income shall include social security, and retirement benefits, interest,diVidends, rental income, salary XKE~ or earnings and income from self­employmmnt, but shall not include gifts or inheritancesJ3 = No exemptions shall be granted unless the title of the property shall have'been vested in the owner or all of the owners of the property for at least sixty(60.) consecutive months prior to the date of making application for exemption,4 ~ No exemptions shall be granted unless the real property is the le§§l resid­ence of and is occupied in whole or in part by the owner or by all of the ownersof teh property,5 = No exemption shall be granted unless the property is occupied wholly forresidential purposes.6 = Application for such exemption must be made by the owners, or all of theowners of the property annually on forms to be furnished by the .Village Clerk'soffice and shall furnish the information and be executed in the manner re­quired or prescribed in such forms, and shall be filed in such Clerk's officeat least ninety days (90) before the day for filing the final assessment roll.

The question of the adoption of the foregoing resolution was duly put to avote on roll call, which resulted as follows: Mayor Carbeck - Voted Aye,Trustee Kingan voted - Aye, Trustee Heimburg voted Aye, Trustee White voted Aye.Absent - Trustee Iannello. The resolution was thereupon unamimously adopted.

How­ever, this would result in a local cost of the program being increased substantially.The Village in turn would benefit from no lost time, direct control over the projectand less administrative requirements. The consultant and/or total cost under thisapproach would be approximately $12,400. .

A third alternative would be an attempt to design a program which wouldcombine the two previous alternatives in a manner so that some of the advantagesof each could be preserved.· Under this approach, the Village would financewithout Federal Aid the initial steps of the comprehensive studies and at the sametime make appl ication for Federal Aid for the balance. Ironicall y, such anapproach could conceivably improve the Village's priority in that they wouldalready be involved in a planning program! As an example, one such programwould be to contract for an initial step which would include preparation of aplanning Base Map, Land Use and Physi cal Features Studies, Population andEconomic Base Studies. These items would be completed within a twelve monthperiod for approximately $4700. Federal AId under '701.' could then be soughtfor the.remaining items in the program. The consultant fee for the balance

would be $12,250; estimated State Fee approximatel y $2083; Federal Feeestimated at approximately $252 producing a total program of $14,585.The local share of this '701' program would be $2430 payable at the end of thecontract or sometime in late 1970 or early 1971. If '701' is not approvedwithin one year, an additional private agreement would be necessary for usto continue ollr work while waiting and the remaining 17°1 'Scope of Serviceswould probably have to be revised. On the basis of this alternative, thelocal cost for both phases of the program would be approximately $7130 withpart payable now and the '701' balance in 1970 or 1971. .

RETAINER A Retainer or General Consulting contract is another alternativeCONTRACT which could be considered. Und~r t.his approach, noneofthe items proposed

in the UPAP application .would be'undertak',"hat this time, rather, the con­sultant would assist the \fil~b@e-Plcihrilrlg'B6a'rCJ in the daily problems encount­ered, i.e., zoning; land subdivisi¢n; industrial or .commercial development;expansion of municipal facilities as the library, etc.; and other items as theyarise. Such a contract would provide ten (l0) man days (7.5 hours) of aprofessional planner's time for $1200. This. fee would cover all expensesincurred and the approach could conceivably be the means of retaining profes­sional planning consultation on a stand-by basis during the next year.

While I have only outlined four alternatives, there could be any number ofapproaches developed pending on the urgencyof local problems and budgetary limitations.I will be happy to discuss this with you at your convenience.

Discussion was held bn .the Sunset Blvd.area sewer line and it was decided that 300 ft. of 8" tile be purchasedand this job made ready as. soon as possiblegj,le to the erection of morenew homes in this area. POLICE DEPT. REPORT:It was moved by Mr. White and 2nd. by Mr. Iannello that the following res­olution be passed: RESOLVED: Reid Smith, 69 Orchard Ave. Angola, N.Y. ishereby appointed as a part time relief patrolman commencing December 19th.,1966 at a salary of $1.75 per hour under the supervision of the Chief ofPolice or the Acting Chief. Discussion was held on the Town contract for the Police and Snow plowingand it was moved by Mr. White and 2nd. by Mr. Heimburg that the followingresolution be adopted: Resolved: The resolution authorizing the Mayor tosign the proposed agreement with the Town of Evans for services to berendered by the Town for the Village conditional upon a modification ofclause (3) adopted December 5th.,1966, be and hereby is rescinded a ndFurther resolved that the Mayor be and hereby is authorized to sign theagreement as submitted without modification. REPORTS:LIBRARY; = Several Members of the Library Board were present at the meeting ••Mr. Foster Thayer was the Spokesman for the Board. Discussion was in regardto a Library building, namely the Leone Building on No. Main St. in theVillage. It was suggested that an Architect be consulted before any definiteplans are made on the purchase of the building.

Fire report was submitted by Chief Arnold. Read and filed.

Police Report was submitted by Chief Marosnski. Read and filed.

Mayor Carbeck reported that he has contacted the Chief of the Tonwanda PoliceDept. and permission was granted for a period of 6 weeks or more in regardto Ptlm. Coulter remaining with the Village Dept. in order for the Villageto have ample time to find a replacement for Ptl. Coulter. Mayor Carbeckalso stated that he received notice that the Basic Training will start Feb.27th. and continue to Apr. 21,1967 for new Ptlm.

WATER DEPT.:Com. Heimburg stated that a representative from the Leopold Co. was at theplant and checked the valves. One valve had to be replaced. The biggest pro­blem at the present time is the shortage of help for operators at the plant,the only full time men are Leo Widmer and Robert Beck, the rest are temporaryrelief men and David Josler will be leaving soon to draw his unemployment fronhis first job and will be unable to conitnue at the plant as a operator.Mayor Carbeck requested that Com. Heimburg place an advertisement in thepaper for help wanted at the plant and to specailly state the qualificationssuch as High School graduate. Clerk Arnold stated that she received the foll­owing report from the Personnel Office and Mr. Trigg, Personnel Administratorstated that the Village cannot hire anyone to work at the plant as a WaterPlant Trainee unless he is a High School Graduate and this rule pretains toall Trainees whether they are full time of part time. This is a ruling thatthey received from the N.Y. State Dept. of Health and they must cope with the

rule. Clerk stated that she has been notified that William Burch cannot becarried on the payroll after Jan. unless he tries" the High School equivanlenc~

test in Buffalo.
