PATNA Thirty-two people were killed and over 80 serious- ly injured as a nor'wester ravaged several Bihar dis- tricts on Tuesday night, destroying thousands of huts and standing crops. The Principal secretary to Bihar Disaster Management Department said that "the maximum number of 25 deaths were reported from Purnia dis- trict, while six have died in Madhepura and one in Madhubani." The storm hit Purnia, Madhepura, Saharsa, Madhubani, Samastipur, Darbhanga and Samastipur uprooting several thousand trees, damaging power lines and destroying thou- sands of huts and standing crops of maize, wheat and pulses. "Road transport in the districts have been hit in the aftermath of the storm as many trees are lying uprooted," he said. the capital came to a halt as a two-daystrike over trial courts' pecuniary jurisdic-tion began on Wednesday, with lawyerspreparing for a protest march outside theresidence of Prime Minister NarendraModi tomorrow. The coordination com-mittee of all district courts bar associationshas called the two-day strike against thedelay in tabling in Parliament an amendedbill to enhance the pecuniary jurisdictionof trial courts.

The lawyers termed the strike as "suc-cessful" saying no substantial work wastaken up in any of the six trial courts - TisHazari, Karkardooma, Patiala House,Rohini, Saket and Dwarka courts.Advocate Mahesh Sharma, President ofShahdara Bar Association, said thelawyers have been repeatedly ditched bythe law minister and other ministers whohad given assurance that the Bill would besoon tabled and passed in Parliament.

"We had met Arun Jaitley, D VSadananda Gowda and Ravi ShankarPrasad at BJP office and were assured thatthe Bill would be tabled and passed in theParliament.

"But it was deliberately halted when itwas tabled in the Rajya Sabha on March 4.This was a conspiracy and they haveditched us repeatedly," Sharma said.

Advocate R K Wadhwa, President ofNew Delhi Bar Association, said no judi-cial work was done in the courts today andthe strike would continue tomorrow also.He said a large number of lawyers wouldgather outside Patiala House courts tomor-row morning when they would marchtowards the Prime Minister's residenceprotesting against the central government."The advocates urge the Prime Ministerthat the bill for pecuniary jurisdiction ofRs two crore for district courts of Delhishould be re-tabled and passed in theongoing Budget Session...," a releaseissued by the committee said.

Wednesday asked theUnion AgricultureMinistry to look into theissues being faced byfarmers across the countryand demanded compensa-tion for the family of afarmer who committedsuicide at the party's rallyhere.

At a meeting with theUnion AgricultureMinister Radha MohanSingh, senior AAP leadersincluding MP BhagwantMann, Kumar Vishwas,Sanjay Singh andAshutosh raised issuesrelated to land bill, canedues and poor relief beinggiven to farmers in vari-ous states.

After the meeting, Singhsaid AAP leaders alsomade a reference to thefarmer's suicide anddemanded compensationfor his family.

Speaking to reporters,Viswas said: "We made

12-13 demands includingfarmers' suicide cases,land bill, sugarcane duesand poor farm relief.

"We also told him thatthe Centre is not sending apositive message to farm-ers across the country.There was an unfortunateincident in the rally. Afarmer from Rajasthancommitted suicide. Wedemanded the governmentto take adequate measuresin the interest of farmers."

On farmers' suicides,Singh said: "We informedthem that the UP govern-ment has written to theCentre that there havebeen no farmers' suicidesdue to agrarian crisis,while there were 2-3 casesreported in Maharashtra."

Stating that the Centrehas taken measures to helpfarmers affected by recentunseasonal rains and hail-storm, the Minister saidthat the norms under theNational DisasterResponse Fund have been

Delhi Congress ChiefAjay Maken today sub-mitted a memorandumto EC that Kejriwal'sstatements on the eve of'Civil Services Day' con-stituted a violation of theelection watchdog'smanifesto guidelines.

"In front of thebureaucrats, he(Kejriwal) made a state-ment that achieving 40-

50 per cent of the prom-ises made by his partybefore the electionswould not be bad; (that)is in violation of themanifesto guidelines ofEC," said Maken.

"AAP, in violation ofthe guidelines, has con-ceded that it cannotachieve 50-60 per centof the promises that it

made in the run up to theelections in Delhi.

"This is also a directbreach of its 70-pointelection manifesto,which was used to gath-er votes... We haveurged EC to exercise itsplenary power underArticle 324 of theConstitution and takenecessary action against

AAP for misguiding thevoters of Delhi," hesaid.

The manifesto guide-lines were drawn up inorder to prevent undueinfluence being exer-cised upon the voters bypolitical parties throughunrealistic election doc-uments.

Addressing a gather-ing on the eve of 'CivilServices Day', Kejriwalhad said, "People havehigh expectations fromus. Public, which praisesus, also hurls shoes infive years. The committee was setup on August 7, 2014 tomake a comprehensivereview of the existingsecurity set-up inParliament and suggestmeasures to furtherstrengthen it.

On December 13, 2001,five terrorists in a whiteAmbassador car with a redbeacon had stormed theParliament complex.

Nine persons, mostlysecurity guards, werekilled in the attack. All thefive terrorists were alsoshot down in the ensuinggunfight with securityforces.

After that, security of the

complex was overhauled atan estimated cost of Rs 100crore with hi-tech gadgetslike boom barriers and tyrebusters being installed.

In the previous LokSabha, a committee onsecurity in Parliamentcomplex, headed by thenDeputy Speaker KariaMunda, was set up in theaftermath of the pepperspray attack inside LokSabha by a Congress MPthat sparked massive out-rage.

This committee hadexamined security-relatedmatters, which also includ-ed ways to prevent bring-ing of dangerous and life-threatening material intothe House by the Membersof Parliament themselves.

CRPF, Delhi Police andParliament's own securitystaff are currentlydeployed for the entirecomplex.

Referring to the Swaminathan Committeereport, Kejriwal said he has already asked thechief secretary to check whether the recom-mendations can be implemented in thenational capital.

"We need to ask why farmers are sellingtheir land or committing suicide? They aredoing it out of compulsion because they arenot getting full price for their produced," hesaid.

The chief minister also lashed out at theRajasthan government and Delhi Police overthe farmer's suicide at the rally, holding themresponsible for his fate.

"If Rajasthan government had providedadequate compensation, he would not havetaken the extreme step. We kept asking thepolice to bring him down. Police may not bein our control but at least there should be asemblance of humanity among them,"Kejriwal said.

The SGI had observed that in some of themaps displayed by Al Jazeera, "a portion ofIndian territory of Jammu and Kashmir (i.e.PoK and Aksai Chin) has not been shown asa part of Indian territory." The channel alsodid not show Lakshadweep and Andaman

Islands in some of the maps, the SGI said.The SGI also said that the maps were not in

accordance with the Survey of India copy-right map and is also against the NationalMap policy, 2005 and map restriction policyissued by Ministry of Defence from time totime. The Ministry of External Affairs alsopointed out similar airing of a wrong map bythe channel. In their reply to a Show CauseNotice, Al Jazeera said that all maps that aredisplayed by them are generated by an inter-nationally known software used by GlobalNews Providers.

The channel also added that it takes Indiangovernment's concerns about maps very seri-ously and accordingly reviews all its Indiaand Pakistan maps to ensure compatibilitywith recent official UN map.

"Muleoperators to the dhams come from TehriGarhwal while sweepers come from as far asBijnor in UP. Often, the income that theygenerate during this time sustains most ofthem throughout the year," he says.

But memories of the 2013 floods continueto haunt. According to a survey conducted byGarhwal University, the hardest hit amongthe people who constitute the yatra economywere the inhabitants of villages located in thevalleys near Kedarnath.

BK Joshi, director of the Doon Library andResearch Centre, says it may take a lot oftime before the yatra economy is able to getback on track. "People still haven't been ableto get out of the shock. Most of their savingshave been wiped off, and they are slowlypicking up the pieces of their lives," he says.

Chinese officials stated that the bank willdraw best practices from the IMF, WorldBank and ADB but will avoid domination offew countries setting rules for the interna-tional financial system.

As a new multilateral institution focusingexclusively on infrastructure development,the AIIB will be dominated by developingcountries, and their requests and demandsneed to be respected, China's vice financeminister Zhu Guangyao said. The establish-ment of the AIIB is an attempt to help fillAsia's infrastructure investment gap and pro-mote economic development in the region,he has been quoted by the official media hereas saying.

The Asian Development Bank (ADB) esti-mated in 2009 that Asia needs about $8 tril-lion investment by 2020 to improve theregion's battered infrastructure to keep itseconomies humming.

Representatives of the 57 founding coun-tries, which were finalised will deliberate inthe next two months on the AIIB's charter, ofwhich management structure will be the mostimportant part.

The US and Japan have refrained fromjoining while a number of their Europeanallies like Britain, Australia, Germany andFrance joined the bank as founding members,taking Washington by surprise.

China has said the AIIB will draw experi-ences from other multilateral developmentbanks and avoid their detours so as to bemore cost-effective and efficient.

The new bank will feature a three-levelmanagement structure that includes a boardof governors, board of directors and seniormanagement, according to the ChineseFinance Ministry.

Zhu said that there were debates aboutwhether or not the AIIB should have a resi-dent board of directors commonly adoptedby the World Bank and the ADB.

The intention of these debates is to"increase efficiency and improve the capaci-ty" of the bank to better serve the clients, butit will be finally decided by coming negotia-tions among founding members, he said.

Officials said it is a good idea to have anon-resident board of directors for the AIIB,as it would help make a clear distinctionbetween the board and the management, andalso have great accountability.

No proposal ..."In some states, ban on cow slaughter has

been there for several decades now. In anumber of states, it is not there, includingall the states of the northeast, because of thedemographic situation here," the BJP leader,who is of Rashtriya Swayamsevak Sangh(RSS) background, told journalists here inthe Meghalaya capital.

History, they say, is always written by the winners.But could this be by even winners of elections? Soit would seem from the workings of India’s pre-

mier institute of historical research and funding, the IndianCouncil of Historical Research, which sees a reshuffle ofpeople and priorities every time there is a regime-changein New Delhi. Senior historian and former Chairman of theICHR, Sabyasachi Bhattacharya, who recently resigned asthe Chief Editor of Indian Historical Review, the ICHRjournal, has delivered a sharp indictment of the competen-cies within the ICHR in its present avatar after a new fam-ily of historians was appointed by the present government.He said: “I doubt whether you would find instances of per-sons, nominated by the government in power, regardingtheir position pro tem as a franchise to fantasise about his-tory.” The comments of this reputed historian reinforce theconcerns that many professional historians have warnedof, namely, the dressing up of myth and religious belief ashistory. This can be seen in the priorities set by the ICHRChairman, Y. Sudershana Rao, who is from the AkhilBharatiya Itihas Sankalan Yojana, affiliated to the SanghParivar. Professor Rao has directed the focus of the ICHRto the Vedic age, which is certainly no less important thanany other period. But surely this has to be subject to rigor-ous tools of historical analysis and verification. What is,however, striking in this focus is the express intent toestablish a “golden age” and the superior antecedents ofHinduism. This is a standpoint the Chairman summarisedin a presentation at a recent international seminar thus:“Indian history is set with [a] higher goal for which oursages delved deep into the remote past.” It is perhaps forthe first time since its establishment that the prestigiousICHR Foundation Day lecture was delivered by a non-his-torian, a certain David Frawley, whose Facebook pagedescribes him as “a western born teacher or guru in theVedic tradition”. The discipline of history, in India andelsewhere, has been enriched by different and competinginterpretations because they are premised on well-estab-lished standards and practices of the historical method,what the historian Eric Hobsbawm once described as the“absolutely central distinction between establishable factand fiction”. The problem in the ICHR today, as ProfessorBhattacharya’s comments suggest, are serious preciselybecause of attempts to render factual evidence irrelevant.The Bharatiya Janata Party established a questionablerecord with regard to rewriting history textbooks during itsfirst stint in power at the Centre. Its current efforts high-light the dangers of which many historians have warned:the replacement of history as social science, by “history”as fantasy and myth.

The elevation of SitaramYechury to the post of generalsecretary of the Communist

Party of India (Marxist) is at a timewhen the party (and other forces ofthe Left) are in dire need of newdirection and inspiration. The newleadership of the CPI(M) will be car-rying a difficult burden to revive theprospects of a depleted Left and sup-port from a largely sceptical elec-torate. The 21st Party Congress of theCPI(M) was held at a time when theparty had registered new electorallows — even in its strongholds —and is, perhaps, at its weakest politi-cal position since its inception in1964. This is in stark contrast to theperiod when Mr. Yechury’s predeces-sor, Prakash Karat, took on the roleof general secretary 10 years ago.Incidentally, both leaders cut theirteeth in student politics at JawaharlalNehru University and are ex-presi-dents of the JNU Students Union.

Within a year after Mr. Karatbecame the first general secretarywho wasn’t a founder-member in2005, the party was at its strongestparliamentary position. The Left par-ties, combined, had more than 60MPs in the Lok Sabha, in power intheir strongholds and initially lever-aged these positions adroitly to influ-ence policy in welfarist directions, asthey extended support to theCongress-led United ProgressiveAlliance (UPA). At the centre, theLeft managed to punch above itsweight and even steered a few land-mark pieces of legislation such as theForest Rights Act and the NationalRural Employment Guarantee Act. Itis another matter that the party couldnot utilise these “achievements” totranslate into support, bogged downas it was by events that had hamperedit in its strongholds. It must also besaid that tactical blunders — such aswithdrawing support to the UPA overthe nuclear deal at a wrong juncture— did not help it either.

Decline in strongholds

In the States where the Left was inpower, especially West Bengal andKerala, troubles of varying kindsbegan to brew only months after itscoming to or retaining power.Buoyed by a strong mandate that waswon on the slogan of industrialisa-tion, the Left Front governmentsought to pursue “big ticket” projectsin a hurry. The “reform zeal” of thethen West Bengal Chief MinisterBuddhadeb Bhattacharjee was con-trasted with the “obstructionist”emphasis of the CPI(M)’s cen-tral leadership. Thereseemed a disconnectbetween what theparty waspreaching atthe Centre —the fighta g a i n s t“neoliberal-ism” — andwhat theWest Bengalgovernment wasseeking to do in theState — fostering capi-talist development throughincentivisation. Much has beenwritten about the land acquisitionissue that hastened the government’sdownfall in the State and this neednot be repeated. But the victory in2006 in West Bengal had alsopapered over serious issues with theLeft Front and in particular theCPI(M)’s rule in the State. The partyhad, over its long tenure, turned intoa machine that combined a set of pro-gressive leaders with others whowere willing to get their hands dirtyin electoral mobilisation, issuing con-tracts, and “managing” support. Overtime, a large set of self-seekers hadfound a place in the party — thatseemingly was going to be in powerfor a long time — and it was this setof careerists at the middle and lowerrungs of the party who defected to theopposition at the first instance of theLeft Front losing power.

The image of the party, as a pro-poor force, had also taken a beatingfollowing the Nandigram and Singur

incidents and a wholesale defectionof the rural support base to theTrinamool ensued. Since 2009, theLeft Front has only seen a cascadingdecline in vote shares at every levelof elections. This was partiallybecause the CPI(M) could notmobilise enough support as an oppo-sitional force against the TrinamoolCongress due to a moribund leader-ship that had little experience beingout of

power. Andthe latter had taken the strong-arm,violent tactics of voter and candidateintimidation to even greater heights.It will not be an exaggeration to saythat the once mighty CPI(M) in WestBengal is in a shambles, and theBharatiya Janata Party (BJP) isemerging as a stronger oppositionforce to the Trinamool Congress. InKerala, on the other hand, theCPI(M) and its allies have managedto retain a steady support base, but along-standing saga of factionalismand reliance on an overly-militantleadership from North Kerala hascontributed to dents in its image andrestricted its prospective growth. Allsaid, the CPI(M)’s journey to rele-vance as a major national force willdepend on how it manages to over-come the hurdles it has posed foritself in its strongholds in Kerala andWest Bengal.

The State units of the CPI(M) have

been loath to admit these frailties, letalone work upon them. The partyleadership in West Bengal has insist-ed that the break in relations with theCongress at the centre (over thenuclear deal) was the main reason forthe drastic loss of support for theparty. This lazy excuse had allowed itto imagine that mere electoralrearrangement — a joint coalitionwith the Congress against the

of the BJP and the party’s organisa-tional tepidity, it is not a surprise asto why the CPI(M) continues toflounder in the State despite theTrinamool government’sunfavourable image.

Lack of a positive voiceYet, the decline in the fortunes of

the CPI(M) and the Left as a wholesince 2005 is not merely due toparochial factors. The Central leader-ship had emphasised the need togrow in other parts of the countryparticularly in North India. But thelack of an adequate organisation, orenough imagination to formulate spe-cific strategies of mobilisation thatare relevant to these areas, has result-ed in the further enfeeblement of itspresence.

The CPI(M) has been forever latein trying to innovate its political tac-

tics to reach out to a changing India.The emphasis on “negation” —resistance, obstruction and depend-ence upon statism — has not helpedfulfil its aims to set an alternativeagenda. The Left parties will be bet-ter off seeking to promote an alterna-tive agenda of comprehensive, wel-fare-driven growth, by emphasisinguniversal health care, social securityand state support and struggling forthem rather than only offering resist-ance to the model of developmentespoused by the BJP and even theCongress. There are exceptions of

course, in the manner in which theparty has taken up issues of the

marginalised in proactiveways — such as the Tamil

Nadu UntouchabilityEradication Front forexample. But largely,despite espousing pro-gressive and even Left-

liberal values (for exam-ple, the CPI(M) is the first

party to openly take a posi-tion against capital punishment

and its legislators were at the fore-front of the Section 66A annulmentdiscourse), it is seen as a party thatdoes not stand for something, but isonly opposed to many things. This isespecially so among the youth andthe middle classes. The latter in par-ticular and the CPI(M) seem to sharea mutual derision, even if the party’sleadership mostly comprises leadersfrom the very same section.

Even the urban poor, a humongouscategory that should be the ideal con-stituency for the Left, seems to havebeen bypassed by it. The Left’semphasis on mobilisational tacticsbeing limited to the workplace —organising the poor as labourers,craftsmen, public sector employees,etc, rather than urban residents wholack amenities, access to essentialsupplies and who live precariouslydue to inflation and job insecurity —is another factor that has limited itsreach. The urban poor prefer to bemobilised by sectional and patron-age-dispensing parties because of thelack of an alternative. The electoral

success of the Aam Aadmi Party(AAP) in Delhi — by reaching out tothe urban poor as a mobilising cate-gory through the distinct lack of sec-tional appeals related to caste orregion — perhaps holds some lessonsfor the Left parties. Of course, theAAP’s organisational failures are areason why it has not matured as aprogressive political party but that isnot germane to the discussion here.India’s Left parties can also look upto the influences of the “new leftforces” in Latin America and Europe,where the rise of radical Left partieshas been aided by new strategies ofmobilisation and organisationalbuilding.

Left unity

The easy claim made by critics forthe weakness of the Left in India isthat the goals that it espouses —socialism and comprehensive welfaredriven economics — are passé. Thisis not true. While the Left partieshave certainly declined, social move-ments have pushed for and achievedthe implementation of welfare poli-cies that do not flow from the neolib-eral form of development. Left par-ties in Latin America have sought torethink socialism as a process ratherthan a stage of development and haveformed united fronts with socialmovements to bring about substantialchanges in the economy, with largepublic support.

Mr. Yechury’s remarks after hispromotion suggest that the CPI(M)will look to revive organisationallyand is seeking to renew its supportbase, even while venturing to formprogrammatic (and even electoral)alliances with secular and like-mind-ed parties to take on its primaryenemy, the BJP. One hopes that theCPI(M) realises that without astronger emphasis on Left unity andengagement with social movementsto set a positive, progressive agenda,mere electoral alliances with regionalparties and programmatic tie-upswith the Congress will prove to be afruitless exercise for the party.

Looking for occult solutions to real-world problems may seem incom-patible with the hard-headed indus-

trial and financial magnates who supportthe present Bharatiya Janata Party gov-ernment, but there seems to be few betterexplanations for the government’s recentorders that will severely weaken or aban-don important aspects of the legal frame-work intended to protect the environmentagainst harm caused by developmentprojects. The suggested modificationsseem to leave mystical intervention as theonly remaining protection of the environ-ment.

The existing notification requires thatprojects be given clearances only aftercompliance with an informed process forassessment of environmental impact. Thisis the primary and globally used tool toensure that development projects aresited, designed and executed with respon-sibility and concern for avoiding or min-imising environmental harm. The notifi-cation recognises that the causes of envi-ronmental harm are often complex anddifficult to predict, and so it investigatesall significant environmental risks.

Like many scientific inquiries, it isobvious that potentially harmful condi-tions and interactions do not readily vol-unteer for disclosure. Often, risks can beidentified only by persistent investigationthat goes deeper than the initial or super-ficial data. This is why the notification asit exists calls for a careful preliminaryanalysis of the “scope” of informationneeded and further studies required toidentify all significant project impacts.

Strange recommendations

The High-Level Committee to reviewenvironmental laws made two recommen-dations, which are now under implemen-tation by the government.

First, the Committee proposed to speedup the process of identifying (“scoping”)the range of project activities, and the fac-tual, scientific and analytical inquiriesaround the project. Although the wholeprocess provides the very basis for pre-dicting the environmental and social con-sequences of the proposed project, theCommittee requires all proposals forimpact inquiries to be completed within10 days of the first filing of the appli-

cant’s request. Failing that impossibleschedule, the Committee proposes toleave the determining of impact entirelyto the gentle mercies of the project propo-nent.

The second Committee recommenda-tion the government has decided to followis to issue an order that requires all impactinvestigation to be limited to that earlyinitial stage, which was meant to deter-mine merely the scope of the inquiry. Inother words, regardless of any evidenceshowing the need for further impactinvestigation at this stage, no furtherinquiries are to be authorised.

Other restrictive requirements seem tobe issuing regularly from the designatedenvironment authority, but these twoillustrations are typical.

Seemingly, the purpose is to ensure thatimportant concerns about any proposedproject’s environmental impact are basedlargely on ignorance. Meanwhile, otherrecommendations and actions to furtherlimit the effectiveness of environmentalimpact studies seem to issue forth every-day. Here are some recent ones: first, theCommittee proposes to abolish anyrequirement for public hearings on proj-ects where settlements are located “awayfrom the project site”, ignoring the obvi-ous fact that projects can cause seriousharm even far from the project site. Thesame injustice will result from theCommittee’s proposal to limit public par-ticipation to “only genuine” local partici-pants, thus excluding, for example, manywhose downstream water sources may bepoisoned by project activities farupstream.

Second, the Committee’s apparentlyminimal concern about transmitting seri-ous environmental harms is also reflectedin the recent authorisation for fast-trackapproval of so-called “linear projects”. Asabove, the basic assumption of thisexemption is obviously faulty. The imme-diate site of a project may be “linear” inthe sense that the physical facilities occu-py a narrow elongated space, but the envi-ronmental consequences will often bemuch more extensive.

Roads, canals, and transmission lines,for example, may severely intensifymotor traffic, or cause unintended routes

for drainage, or expand the probableexpansion of pollution sites, or seriouslylimit wildlife migration routes, feedinghabits, or reproduction patterns.

It would seem obvious that such limita-tions on environmental protection couldnot have been endorsed by the Committeeif it had fulfilled its mandate to studyIndia’s “experience” in applying — orfailing to apply — the existing environ-mental laws. Indeed, even without con-ducting its own studies, extremely trou-bling indications were available fromother important sources. But theCommittee apparently gave no considera-tion to the facts and judgements reflectedin other authoritative and extended stud-ies.

For example, the High-PoweredCommittee on Management of HazardousWastes, established by a Supreme Courtorder, said in its 2001 report ‘TakingHazardous Waste Seriously: A FutureAgenda’: “[P]ollution of air, water andland by the noxious gases, toxic chemicaleffluents, infectious biomedical wastesand other hazardous substances poses agrave threat to the health of large sectionsof the population and to the workers in theworkplace who, in addition, are exposed,often unprotected, to hazardous sub-stances.

“[I]ndiscriminate contamination ofrivers and of groundwater has led to adeterioration of the quality of waterresources and to an acute shortage of safedrinking water for millions of people inseveral parts of the country.”

The World Bank in 2007 stated in areport titled ‘Country EnvironmentalAnalysis’: “Rapid economic growth andthe resulting changes in consumption pat-terns are drastically changing the natureand scale of impact on the country’s envi-ronment and natural resources, thus test-ing the carrying capacity of the naturalecosystems upon which much of thecountry’s economic growth depends…The result is a visibly deteriorating envi-ronmental quality in many industrialtownships… highlighting the importanceof stepping up efforts to manage theexternalities of accelerated growth.”

While these studies are less current thanthe Committee report, nothing offered by

the Committee suggests that the environ-mental threats have diminished. Instead,the admittedly high rate of projectapprovals strongly suggests furtherexpansion of these threats. Such apparent-ly irrational conduct from officialsresponsible for protecting a nation’s peo-ple from serious harm demands that weseek an explanation. This is all the morenecessary when the unexplained conductcomes from hard-nosed industrialists whowould surely refuse to invest even a paisain any industrial or technical developmentthat received such poor reviews.

Belief in magic

Puzzled by this behaviour, we areforced to conclude that the members ofthe High Level Committee, the govern-ment officials who are beating this hastyretreat from environmental protection,and the industrialists who support thesechanges share a common delusion. Theyall believe in magic — in one or more ofthe following forms.

First, they apparently believe that anyproject that may generate profits will alsoautomatically avoid any significant envi-ronmental harm.

Second, they apparently believe thatany need for detailed investigation of aproject’s potential for significant environ-mental harm can be avoided by simplyensuring that government officials andmembers of the public stay ignorant of thecauses of harm and the environmentalconsequences of the projects.

Third, where any industrialist or officialhas carelessly sought scientific or techni-cal studies regarding possible harm, therisk can be magically avoided by simplyterminating the studies and ensuring thatall scientific questions raised by the stud-ies are totally disregarded.

Fourth, any risk of serious environmen-tal harm can be avoided by simply dis-couraging or prohibiting members of thepublic, who may understand the risks ofenvironmental harm, from offering anyinformation or participating in any impactassessment or clearance procedures.

troversial land acquisition ordi-nance, Social activist AnnaHazare has written to primeminister Narendra Modi hold-ing that even the fresh ordi-nance issued earlier this monthdid not fulfil the promises hehad made on protecting thefarmers' interests.

"The government has beensaying that the ordinance is inthe interests of farmers. Even inthe new ordinance, issued onApril 3, no amendments havebeen carried out as per thepromises made," Hazare said inthe letter, his aide told PTI.

"By handing over farmers'land to private organisationsand industrialists, farmers'basic rights are being infringedupon," said Hazare, who previ-ously wrote to the PM onMarch 31 over the same issue.

"Despite the government'sclaim that the law favours farm-ers, the provisions of the ordi-

nance amply make it clear thatinjustice is being heaped onthem," Hazare said.

"If this ordinance gets covert-ed into law, generations offarmers who supply foodgrainto the country will getdestroyed. It will also have anadverse impact on food produc-tion," he said.

"Looking at the provisions, itis clear that the ordinance is

against the interests of farmers.People need to be told whetherwe are right or the governmentis right. So, we expect a reply(to this letter) by April 25,"Hazare said.

"How can you take away landwithout farmers' consent? Indiais an agricultural country. Thegovernment must think aboutthe farmers," Hazare said in thisletter to the PM.

Wednesday cleared a proposal totry juvenile in the age group of 16-18 under laws for adults forheinous crimes.

Confirming the news, UnionMinister told mediapersons,"Juvenile Justice Act at has beenapproved by the Cabinet today."

He also said, "Important featureis while recognising rights of ajuvenile in the event he is between16-18 years and the children'scourt comes to a conclusion thatbecause of circumstances of hiscrime and his psychology he hascommitted a heinous crime, it isimportant that he (juvenile) betreated like an adult."

On April 06, 2015, the SupremeCourt had said that there was aneed to re-examine various lawsdealing with juveniles involved inheinous crimes like murder andrape and had asked the govern-ment to see whether necessary

changes could be done to have adeterrent effect. The apex courthad asked Attorney General MukulRohatgi to consult competentauthorities and suggest to itwhether the relevant laws can be"re-looked, re-scrutinized and re-visited" for sending a message tothe society that life of the victimwas equally important under therule of law, as per PTI.

It had said the spurt in involve-ment of minors in heinous crimeslike rape, murder and dacoitystressed the imperative need tomull changes in the JuvenileJustice (Care and Protection ofChildren) Act, 2000.

NEW DELHIThe Supreme Court on

Wednesday asked theCentre to file its responseas to whether it hadapproved the Army's "com-mand exit promotion" poli-cy, which has beenquashed by the ArmedForces Tribunal, meant forofficers of the rank ofColonel and above fromJanuary, 2009.

"Had the DefenceMinistry filed an affidavitbefore the Armed ForcesTribunal (AFT) that it hasapproved the 'commandexit promotion policy'?" abench of justices T S

It asked the DefenceSecretary or a personauthorised by him to file an

affidavit within a weekstating "whether the gov-ernment had accepted therecommendations of theAV Singh Committee

(AVSC) with regard to the'command exit promotionpolicy'".

The bench also said thatthe response of the govern-ment should contain detailsabout the promotion policybeing followed and if theAVSC report was notapproved then whether theMinistry had taken up theissue with the Army or not.

The bench is hearing theappeal of the DefenceMinistry against AFT'sdecision to quash Army's"command exit promotion"policy on the ground that itis violative of Article 14(right to equality) of the

Constitution.The apex court had on

March 25 stayed the March2 decision of AFT to quashArmy's promotion policy.

Some army officers hadclaimed that the new pro-motion policy had adverse-ly affected them as it is"arbitrary" and highlyskewed in favour ofInfantry and Artillery, ascompared to other branch-es of the Army.

Earlier, the court hadasked the Defence Ministryto file its rejoinder to theresponse of the officers onwhose plea AFT hadpassed the order.

LONDONAn Indian-origin millionaire director of

a company in Britain was caught in asupermarket hiding in his bag meat andwine worth 200 pounds (about $300), andhas been awarded by a court 12 months'community service for shoplifting, mediareported on Wednesday.

Ronan Ghosh, 39, was shopping at theTesco outlet in Birmingham, WestMidlands, on February 21 and he onlypaid for the items in his trolley but did notpay for the items he kept in his bag, acourt heard.

The 16 million-pound-a-year turnoverglobal recycling firm's boss was spottedon the store's security cameras stowingaway the expensive items. He wasdetained by a guard and police werecalled, the Daily Mail reported.

Ghosh, who lives in a luxury 550,000-pound house in leafy Solihull, pleadedguilty to theft at the Birmingham CrownCourt.

He claimed in the court that he had vis-ited the store after an argument with hisgirlfriend and he had not intended to stealthe goods.

Charnjit Jutla, the defence lawyer, toldthe court that Ghosh is the director of RGRecycling company that supplies high-value machinery for the recycling indus-try. "It is a global business. It has a yearlyturnover of 16 million pounds," Jutla wasquoted as saying. "It beggars belief as towhy he finds himself in this court. Heaccepts full responsibility for what he hasdone."

Jutla said Ghosh was "disappointedwith himself and shocked and embar-rassed".

The defence lawyer told the court thaton the day in question, Ghosh's father toldhim that his mother had been diagnosedwith skin cancer and that worried him alot. Jutla said there was also a will beingdiscussed within the family which had putconsiderable strain on Ghosh.

The Home Ministrysuspects the SIMI mem-bers' involvement in aseries of incidents in dif-ferent parts of the country,including blasts at theChennai Railway station inMay 2014, the explosion inBijnor and the blast inRoorkee.

open defecation, GujaratChief Minister AnandibenPatel today directed localbodies to impose a fine onthose who defecate in opendespite having toilet facili-ty.

Addressing a function ofdistributing cheques ofgrants to all municipal cor-porations and municipali-ties in Gandhinagar, MsPatel asked local bodies toexpedite the work of com-pletion of building toilets.

"State government has

given sufficient grants tothe local bodies to buildtoilets. However, I noticedthat there are still somedistricts which are lagging.I want all the 8 corpora-tions and 159 municipali-

ties to make sure that thetarget (of building toilets)is achieved by this May,"she said.

The Chief Minister saidonce every house will havetoilet facility, fine will beimposed on those going foropen defecation. On landacquisition processes fordevelopmental works, shesaid local bodies shouldnot be wary about acquisi-tion of land (referring toongoing debate regardingLand Bill) from locals, asit is their responsibility toundertake the works.

Gujarat CM Anandiben Patel directs localbodies to impose fine for open defecation

KATHMANDUAt least 17 Indian pilgrims

including nine women werekilled and 28 others injured onWednesday when a bus carryingthem from Gujarat plunged some100 metres from a mountainhighway in Nepal, officialssaid.

The ill-fated bus with anIndian number plate, carryingaround 45 pilgrims, veered offthe Prithvi highway at Naubisevillage in Dhading district, some75-km east of Kathmandu.

The pilgrims from Gujaratwere returning to Gorakhpur inIndia after a pilgrimage toPashupatinath Temple inKathmandu, Superintendent ofPolice Bishworaj Pokharelsaid.

14 passengers died on the spotwhile three others succumbed totheir injuries shortly after beingtaken to a nearby hospital. Ninewomen and eight men are amongthose killed.

The injured passengers wererushed to Kathmandu for med-ical treatment. The condition offour of them was said to be criti-

cal. Twenty one people are stillin the hospital undergoing treat-ment, according to IndianEmbassy sources. The embassyhas deputed a team comprisingConsular Wing officials to theaccident site to better coordinatethe rescue efforts, the embassysaid in a statement.

Rescue efforts are going on atthe accident site, which liesalong the Tribhuvan Highway,with the help of security person-nel and the local people, he said.

The death toll might rise as thebus was trapped in a gorge likesite and some passenger mighthave been trapped under the bus,Mr Pokharel said.

The famous 5th centuryPashupatinath temple is dedicat-ed to a manifestation of Shivacalled Pashupati (Lord ofAnimals). It attracts thousands ofpilgrims each year, mostly fromIndia.

boats had been seized byIndia and asked for detailson the arrest of eight crewmembers suspected to bePakistani smugglers.

A Pakistani boat wasintercepted off Gujarat'sPorbandar on Monday. TheCoast Guard said 232packets of narcotics, cell-phones and satellitephones were seized. Thenarcotic, suspected to beheroin, is worth Rs. 600crore. "Pakistan HighCommission has formallyapproached the Ministry ofExternal Affairs to sharedetails of seizure of twoPakistani boats and appre-hension of their crewmembers this past week-end as reported by theIndian media," ManzoorAli Memon, PakistaniPress Attache in NewDelhi, said.

Navy sources have saidthat a second suspicious

boat was also spotted thesame night, but neverfound.

Indian officers say satel-lite communication phonesand global positioning sys-tems were "being used toship contraband to anotherboat." But it is not yetknown where the narcoticswere headed and whichboat the Pakistani vesselwas trying to contact. ThePakistani boat is docked atPorbandar for furtherinvestigation.

The authorities had beentracing the movement ofthe boat since April 18,Coast Guard officials saidat a media conference.

Ray Kurzweil, a leading expertin artificial intelligence who joinedGoogle in 2012, told the annualconference of the Society ofAutomotive Engineers that therapidly declining cost of comput-ing power and the advances in arti-ficial intelligence will makeautonomous driving a reality.

Kurzweil told the audience thatautonomous driving, utilizing arti-ficial intelligence, is definitelycoming. "The technology works.It's not far away," said Kurzweil,though he was not prepared to sayjust when self-driving cars willbecome a common sight.

"Google advised me to sharewith you they don't know theanswer... The technology is notgoing to be introduced until it'sready."

The need and value ofautonomous vehicles is clear, hetold hundreds of the industry's topengineers.

"Google cars have gone close toa million miles without incident,"he said.

"Some day an autonomous carwill cause an accident and it willbe big news. But while we've beentalking several people have diedfrom human drivers."

Autonomous cars "are ultimatelygoing to save millions of lives," hesaid, noting that traffic accidentskill 1.2 million people worldwide ayear now.

The idea is to use plug-gable plastic tubes andother structures to con-nect the smartphone's

speaker with its micro-phone.

The device can then becontrolled by acousticallyaltering sounds as theypass through this sys-tem.

Just as a simpleslide whistle or flutecan produce expressivemusic, theseAcoustruments canadd a wide range offunctionality to asmartphone, includingproximity and pressuresensors.

its travel services, withthe acquisition of a travelstartup named Mygola foran undisclosed amount.

The online travel com-pany (specificallyMakeMyTrip Limited) ina press statementannounced that it hadacquired "certain assets"of Mygola.com, andadded the entire Mygolateam is now joiningMakeMyTrip.

The firm says the acqui-sition was done throughits earlier announcedInnovation Fund, whichwas formed to invest instartups or early-stagecompanies in the traveltechnology space.
