0930–1100Fugitives and the law – Interpol Red Notices/extradition Fugitivescaneitherbesuspectsincriminalcasesorindividualswhohavealreadybeenconvictedandsentenced.Usually,fugitivesaredealtwithbythepoliceoraspecialagency(forexampletheUSMarshalintheUnitedStates).Fugitivesmayretainlawyersconcerning conditions for surrender, if they are possible to negotiateorimpose,orobstaclestoarrest,suchasthefugitive’smedicalconditionortheexistanceofimmunityfromarrestorprosecution.Mostoften,however,lawyersdealwithfugitivesinthecontextofextradition.Therelationsbetweenstatesinextraditionmattersarenotalwayssimple,andtheycanraiseanumberofissues,suchasthestates’legalobligations(pursuanttovarioustreaties),politicalasylumorinterference,humanrights,doublecriminalityorjeopardy.ThetopicofextraditionisofparticularinterestinBrazilandLatinAmerica,astheyarehistorically known for a certain degree of leniency in harbouring fugitivesofothercountries(seeforexampletherecentBattisti case).Anotherareaofinterestisthelabellingofindividualsas‘fugitives’byorganisationssuchasInterpol,determiningwhetheranindividualhasbeengivensuchalabel,andcontestingthedesignationof‘fugitive’incircumstanceswhereitmaynotbejustified.

The IBAHRI convened a new task force comprising well-respected lawyers, leading academics, tax experts and development and human rights authorities, to contribute to an innovative report on illicit financial flows, poverty and human rights, which will be written during the course of 2012–2013.
Consultation meetings are central to informing the Task Force and are crucial to supplement the expert research. It is essential that the Task Force receive comments and expert opinion from as wide as possible variety of stakeholders. Participants to the consultation meetings may be acknowledged in the final report, should they wish to be.
