    The organizers of the 12th Annual Cavalier King Charles Spaniel Beach Party, scheduled thisyear for April 20, 2013, have requested that the City waive fees associated with this annualevent. This is the first waiver request from this group.The waiver request was denied administratively on January 23, 2013 per the policy adopted bythe City Council by Resolution 2012-22. Staff denied the request for the following reasons:

    1) The event is a one day event and Council has never waived fees for a one day event.2) It is well-established and is in its 12th year.3) The event fees have been paid by the organization since the fee schedule was adopted.4) The event generates approximately $4,000 in revenue from ticket sales, which is thendonated to a non-profit organization in Pacific Grove.FISCAL IMPACTThe impact to the City would be $400 for the fees associated with the use ofthe beach. The$200 cleaning deposit for the beach is refundable and is not included in the waiver request.

    APRIL 20, 2013WHEREAS, on July 12, 2011, the City Council adopted Resolution 2011-38,adopting Community Services fees associated with special events in the City; andWHEREAS, these fees, which include the use of Devendorf Park and beach, theclosure of streets, and other miscellaneous event-related fees were meant to more accuratelycover the expenses ofhaving special events in the City; and

    WHEREAS, the organizers of the 12th Annual King Charles Spaniel Beach Partyhave requested that the City waive the $400 in fees associated with its event.

    Request fo r Waiver of Special Event Permit Fee fo r Annual Cavalier King Charles Spaniel Beach PartyPrepared fo r Carmel-by-the-Sea City Council- March 5, 2013

    Background:I began the process to request waiver of the $400. Special Event permit fee on January 2, 2013 well in advance of ourApril 20th event. We have held this party on Carmel Beach fo r many years. Our proceeds go to Animal Friends RescueProject (AFRP) a local non-profit. Attendance has grown exponentially. Last year we had an estimated 300 peoplepart icipate and we recognize the need to adhere to City policies regarding Special Event Permits and Liability Insurance.City staff provided me a copy of the City Council Policy on Event Fee Waivers on January 23, 2013. I fol lowed this policyto the Jetter and submitted packages to the City Administra tor with a copy to the Mayor on January 28, 2013. Myrequest was that I be placed on the March 5th Agenda so that I could address the Council.I was advised by City staff on Thursday , February 28, that I had been given the wrong Fee Waiver Policy and that staffhave the authority to approve fee waivers up to $5,000. My request was denied. Further, I was not on the MarchAgenda, but could appeal to Council during Public Appearances.I strongly believe we meet all of the Council's criteria fo r fee waiver and have followed the guidelines provided. Tosummarize :City Council Policy- Criteria fo r Fee Waiver;

    Economic Impact to Community - 85% of our attendees come from out of town . We es timate that half of themmake Carmel-by-the-Sea a weekend destination and believe that our party cont ributes 100 nights'accommodation during an of f season, non-event weekend. These people also eat in our restaurants and shop inour local stores. As of Friday, March 15t, the Cypress Inn reported that they have booked 39 of 44 rooms for theApril 20th weekend.

    Charitable Contributions to the Community- Proceeds from the event go to Animal Friends Rescue Project ofPacific Grove. This 501(c}3 nonprofit directly benefits the citizens of Carmel by placing animals in new adoptivehomes (312 in Carmel since 2010}. They provide Carmel res idents with any re-homing needs. They do talks inour schools on everything from animal care to career information. They run a community spay/neuter voucherprogram fo r residents who cannot afford to have their animals altered and they also provide opportunities forCarmel youth and adults to volunteer with animals. Last year's party generated almost $5700. most of it fromou t of the area, for this worthwhile local organization.

    Economic impact on the communityThe Cavalier KCS Beach Party has grown exponentially over the past decade. 85% of he attendees are from out oftown. We now attract 300 guests, many from Sacramento, the Bay areas and LA but also as far away as FL, AZ ,WA, NY and NJ. About half of them make Carmelby.the-Sea a destination weekend. We conservatively estimatethat 100 rooms are booked for the event weekend. As of Friday, March 1st 29 of the 34 rooms at the Cypress Innwere booked, a direct result of our Beach Party (two night minimum on Saturdays). Both day and weekend visitorsshop and eat in our many pet friendly stores and restaurants.We intentionally hold the event on the weekend before the Big Sur Marathon so as not to compete for restaurantsand lodging. See emails from Cypress Inn and Visitors Center of the Carmel Chamber included with thissubmission.Last year husband and wife team Dan Merchant and Emily Randolph travelled to Carmel from Arizona with theirtwo Cavaliers in tow to attend the 11th CKCS Beach Party. They subsequently published a children's book titled"It's a King 's Life in Carmel-by-the Sea". It's a delight and the Cavalier KCS Beach Party features prominently,along with glowing descriptions of dog friendly Carmel, its hotels and restaurants. The book is selling well onAmazon, as well as other sites and the authors will be returning in 2013. Attendees will have an opportunity topurchase the book before the party and have their copies signed at the Beach Party. A portion of each book sold willbe donated to Animal Friends Rescue Project (AFRP).

    for residents who cannot otherwise afford to have their animal altered. AFRP also provides opportunities for Carmelyouth and adults to volunteer with animals. The 11th Cavalier KCS Beach Party in 2012 generated over $5600.forthis very worthwhile organization.

    Documentation Required with Waiver Request: Detailed Scope

    The Cavalier KCS Beach Party is normally held on the beach between 9th and 1Oth. The event runs from 1 to 4 PM.This year it will be held on Saturday, April20. Set up begins around 6:30AM. We have a hired crew who for thepast 6 years have delivered tables, food, all party items and clean and rake the beach prior to se t up. They alsobreakdown and clean at 4PM. Two volunteers return to the site the next day and inspect to ensure all garbage fromthe party has been removed and that the garbage/recycling bags left behind in the pickup area on Scenic are still ingood order.Volunteers from AFRP se t up a table to sell raffle tickets and admission to those who did not sign up and pay onlinein advance.Food and beverages are provided as part of the admission. A themed fashion parade is held with winners receivingribbons. The raffle tables generate a lo t of interest. Last year we had 22 prizes (ranging from hotel room stays, toGift baskets and Gift Certificates).We try and take a group photo at around 3:30, but with the vast number Cavaliers and owners this is always achallenge and we seem to end up with as many people taking pictures as those having their pictures taken.We select a theme for every party. Over the years these have included: Hawaiian Luau, Cinco de Mayo, Cowboy,Rock & Roll, Pirates, Scottish and April in Paris. Some of the outfits on both two and four-legged attendees are verycreative. Our theme for 2013 is "A Cavalier Circus".Cavalier King Charles Spaniels are very sweet and loving dogs and not aggressive in the least. Jt is truly aremarkable (and very Carmel-like) experience to see 200+ of hese creatures cavorting on our beautiful sand Beach,tails waving high.

April 21st, 2012Carmel Cavalier party!! nth Annual Cavalier KCS Carmel, CABeach Party Here are the details from the organizer: Dear CavalierKCS friends and families, The long awaited nth Annual CavalierKCS Carmel, CA Beach Party will be held on Saturday, April 21st(from 1-4 PM). This year's theme is "April in Paris". I haveattended this event twice and it's really fun. There wereapproximately 200 Cavaliers in attendance. Some people dresstheir dogs in theme-appropriate costumes. There is a raffle andprizes for costumes. The event benefit some worthy cause -but I'mnot yet sure what the cause will be this year. My 2 Cavaliers and Iwill be in Carmel that weekend - specifically because this event isso much fun.
