The first hundred days of the Daniel Andrews Government has been characterised by lies,
confusion, excuses and spin.

It has also shown the two faces of Daniel Andrews – one prepared to say anything to win the
election and the other after the election, lying and trying to spin his way out of trouble.

Three days before the election, Daniel Andrews told Victorians that the East West Link contracts
weren’t worth the paper they were written on. But after the election, and under pressure, he
admitted that Victorian taxpayers would be liable for compensation because of his actions.

Also before the election, Daniel Andrews said his proposed West Gate Distributor was “ready to go”.
But after the election, we learn that it is probably years from ready with planning, approvals and land
acquisitions not yet finalised.
The two faces of Daniel Andrews are creating confusion not just for Victorians but also for
international investors who are now concerned about doing business in our great state. That means
we are at risk of losing out on future job-generating projects as well as much needed infrastructure.

And when Daniel Andrews isn’t lying and changing his position and creating confusion, he’s
making excuses.

In only his first 100 days, Daniel Andrews is already making excuses for being unable to deliver
projects that he claimed only days before the election were fully funded and costed. According to
him, the federal government must fund the promises he has made – like the Metro Rail Tunnel, the
West Gate Distributor and level crossing removals.

But what Daniel Andrews and Labor don’t understand is that you cannot create jobs without a strong
economy that attracts investment. You cannot create a strong economy without a strong plan.

The Opposition is united, hungry and relentless in exposing the Andrews Labor Government every
time it makes a decision that fails Victorians. Over the next 3 years and 9 months, I am determined
to prosecute the case for change with a comprehensive plan for a strong economy and a stronger
job market that provides opportunities and prosperity for all Victorians.

    Daniel Andrews has done more damage to the Victorian economy in just his first 100 days than Steve Bracks and John Brumby did in over 11 years.

    With his reckless threat to tear up the $6.8 billion East West Link contract, Daniel Andrews has sent a message to international investors that Victoria is a risky place to do business. In future, major investors will baulk at signing contracts with the Victorian Government. And if investors and major employers do decide to sign a major contract with the Victorian Government, there is a real likelihood they will add a risk premium because of the reputational damage.

    Budget forecast under Labor

    Already, there are signs that business confidence is low and our economy is slowing under Labor. In the Budget Update released on 23 December 2014, surplus forecasts under Daniel Andrews were estimated to be around $1 billion less than under the Coalition and net debt expected to rise to 4.8% to 2018. The Budget Update also forecasted slower economic growth and higher unemployment.

    There are already signs that Victorias Triple A credit rating is at risk, which is bad news for further investment and jobs growth.

    Before the election, Daniel Andrews promised to deliver 100,000 new jobs.

    But under the Andrews Labor Government, unemployment in Victoria has already increased by 3,727 people with reports of more job losses including in regional centres like Ballarat.

    Daniel Andrews reckless decision to try to tear up the East West Link (EWL) contract, has put at risk thousands of more Victorian jobs. The East West Link is the single biggest road project in Australia which could employ up to 6,700

    A bitter pill fordistrict nursesSTAFF at Victorias Royal District Nursing Service are distraught after hearing that about 80 jobs will be cut, the nursing union says.

    The services 14 offices willbe cut to four regional hubs and some client care replaced by video conferencing.

    Victorian general manager Fiona Hearn says the job losses are unavoidable, but promised services would remain unaffected.

    But the nursing union saysthere will be a significant decrease in the number of Grade 4 registered nurse jobs.

    COLES CUTS OFFICE JOBSCOLES is to sack 200 staff from its head office in the latest round of job cuts to hit the state.

    In September, 400 peoplewere cut from the Hawthorn East headquarters.

    Coles remains locked in awar for market share with Woolworths, which has released its cheap, cheap marketing campaign.

    There are already media reports that some local companies have begun to lay off staff because of Daniel Andrews decision. William Adams, a Caterpillar supplier, has advised staff of redundancies as a result of the lost revenue from Labor cancelling this contract.

    Also threatening jobs growth is the fact Labor does not have any shovel-ready projects to generate jobs and relieve congestion.

    Former Bulldogs great andrestaurateur Paul Dimattinahas joined the chorus ofdisgruntled owners, furiousover the Governments deci-sion to make Grand Final Eveand Easter Sunday officialpublic holidays.

    Ive spoken to at least 10friends who own restaurants inthe CBD and they just saidthey wont open because theycant afford the penalty rates,Mr Dimattina said.

    Theres just absolutely nopoint (opening).

    Its very frustrating.

    His four restaurants in Carl-ton, Melbourne and South-bank DiMattinas, IlGambero, Society Restaurantand Blue Train will close onboth of the newly gazettedpublic holidays, putting 50staff out of work for the day.

    Daniel Andrews lied to Victorians about the East West Link contract.

    On the Neil Mitchell program, three days before the election, Daniel Andrews said that the East West Link contract was not worth the paper it was written on and that no compensation was payable.

    Now it emerges that the Andrews Labor Government could have to pay up to $1.2 billion in compensation to the consortia that is contracted to build the Link.

    Daniel Andrews likes to claim that the East West Link contract should not have been signed because he had opposed the project before the election. But the fact is, Daniel Andrews decision to openly oppose the EWL project was only done at the 11th hour. For years before that announcement, Labor had effectively supported stages 1 and 2 of the East West Link project and indeed the Brumby Government of which Daniel Andrews was a senior member commissioned the Eddington review which recommended the East West Link.

    And when then Treasurer Michael OBrien announced the EWL in the May 2013 budget, Daniel Andrews did not say he would tear up the East West Link project. Indeed, for the next 16 months, Daniel Andrews said that the Labor Party wouldnt oppose the East West Link.

    b h i d fi i l h lLabor has indefinitely shelved acomplex legal plan to render theEast West Link contract unen-forceable and will instead rely ona potentially expensive settlementdeal with the consortium to extric-ate itself from the project.

    In the lead-up to last years state

    election, Labor repeatedly claimedthe contract to build the road wasnot worth the paper it is writtenon and could not be entered intosafely.

    To make the case, the then op-position relied on advice from for-mer Federal Court judge Ray Fin-kelstein and administrative law ex-pert Richard Niall, QC. It con-cluded that if Supreme Court ac-

    tion against the project by More-land and Yarra councils were suc-cessful, the contract would beunenforceable.

    Labors plan at the time was tosupport the councils case if it wonthe election, rather than defend theproject. Under those circum-stances, Labor believed the coun-cils legal challenge would be likelyto succeed.

    But since winning the election,Labor appears to have backedaway from the bold plan. It is be-lieved this followed advice from theDepartment of Treasury and Fin-ance confirming the former gov-ernment did in fact have inherentpowers to enter into the contract.

    As revealed inTheAge, Treasuryalso facilitated a separate side let-ter, providing the consortium

    with an assurance it would get itscompensation money even if acourt were to declare any contractinvalid.

    choice but to negotiate with theconsortium, amid speculation thetaxpayer-funded compensation billcould be as high as $1.1 billion.

    Labors EastWestLink plan collapses

    Treasurer Tim Pallas did not ad-dress a series of questions fromThe Age, including whether it re-mained Labors intention to rely onthe councils court action to renderthe contracts invalid by not fight-ing the case, and whether Laborstood by its original legal advice.

    Instead a spokeswoman said:The government is currentlyworking with the East West Con-nect consortium towards a fair andappropriate outcome for Victoriantaxpayers.

    The councils court case wasscheduled to be heard about twoweeks after the state election. Butthe looming battle was deferredafter lawyers acting for the An-drews government asked for moretime. A new hearing date has notbeen set.

    Moreland City Council chief ex-ecutive Nerina Di Lorenzo said thecouncil had a standing resolutionto proceed with the legal action.

    That hasnt changed, she said.A Yarra City Council spokes-

    woman said the matter was cur-rently adjourned. We haventheard from the state governmentat this stage, she said.

    Opposition Leader MatthewGuy saidMr Andrews needed to beup front with Victorians aboutwhether he was lying when he toldvoters he believed the contract wasnot worth the paper it was writtenon. Clearly Labors decision to en-gage in negotiations shows what hesaid before the election and whathe is doing after the election aretwo different things, Mr Guy said.

    The Abbott Government isreluctant to make the political-ly-unpalatable decision to stripthe $3 billion from the Vic-torian Government. If negotia-tions break down, Canberracan recoup the $1.5 billion al-ready paid out by reducingVictorias grants payments.

    MPs from the outer easternsuburbs is looking to capitaliseon voter support for the EastWest Link and will launch apublic campaign within weeksto lobby for its construction.

    Michael Sukkar (Deakin),Alan Tudge (Aston) and TonySmith (Casey) are pushing thecampaign, which seems likelyto include billboards, advertis-ing and social media. MrTudge declined to confirm thecampaign, but said: We arenot giving up the fight.

    By comparison, the East West Link is estimated to take 50,000 vehicles a day off the road and will cost Victorian taxpayers $2 billion.

    And what was trumpeted by Daniel Andrews in 2014 as a shovel-ready project, has now been found to be anything but shovel-ready with planning approvals and land acquisitions not yet finalised.

    complete the planning, design and early works of Melbourne Metro Rail.Yet, Labor promised to budget only $3 billion out of the $9 billion total cost for Melbourne Metro.

    Februarys $40 million announcement is just 0.4% of the total $9,000 million cost of the project.

    The tunnel is proposed to be 8.5km in length. So 0.4% of this length would be just 38 metres of tunnel length.

Hes announced 0.4% of the funding, thats enough for 38 metres of track.Daniel Andrews is really setting a record in Australian politics as being the first Government to not only spend two months re-announcing projects of the former Coalition Government but now he chooses to re-announcing announcements made by the Brumby Government. Its really quite bizarre.

    Daniel Andrews announcement today is a hoax. To provide fast tracking works of $40m that was already budgeted in the last budget, for a project that wont commence for another few years and to establish yet another Government authority, really just shows to Victorians that hes all smoke and mirrors.

    Some key facts on MRT:Claim: Daniel Andrews criticised the Coalition for

    cutting four new stations on the Melbourne Rail Link route.

    Labor has cut three of the Coalitions funded new metro stations. Now, it will not be possible to interchange from South Yarra Station to Labors Melbourne Metro route. The Coalitions Melbourne Rail Link included an underground station interchange at South Yarra.

    Claim: Labor say MRT will have five new stations. It will only have three new stations. CBD

    North is an extension of Melbourne Central Station, and CBD South is an extension of Flinders St Station. Arden Station is proposed to be in the middle of an industrial area.

    Claim: Labor promised a new station at the Royal Childrens Hospital.

    The Melbourne Metro does not provide for a station at the Royal Childrens Hospital. The planned Parkville Station is nearly 1km away from the RCH, and Labors proposed Arden Station is 1.2km away.

    Claim: Labor says an EOI for Melbourne Metro will start in 2016, and has committed only $40 million thus far.

    The Coalitions Melbourne Rail Link was funded with $830m in the 2014-15 budget, with construction starting in 2016.

    Claim: Labor says it needs two years to do immediate planning works, complete development of the Reference Design and undertake detailed site investigations.

    This project has been planned and designed in detail already.

    Claim: Daniel Andrews criticised the Coalitions Melbourne Rail Link, because Pakenham and Cranbourne trains will no longer run through the City Loop.

    Labors Melbourne Metro will have Cranbourne and Pakenham trains only stopping at Flinders St and Melbourne Central. They will not run through the city loop, or stop at Southern Cross, Flagstaff or Parliament.

    In his first 100 days, Daniel Andrews has been caught with his hand in the cookie jar pinching money out of the health and hospital budgets.

    Hes also been caught out as a hypocrite. Before the election, Daniel Andrews when asked about a helipad for Monash Childrens Hospital, said:

    Sick children and their families will not get the services and facilities they were promised and will not get the care and treatment they deserve.

    Budget blunder

    And the Andrews Labor Government announcement that Easter Sunday will be declared a public holiday also threatens to effectively leave a hole in Victorian hospital budgets.

    The effect of declaring Easter Sunday a public holiday will mean that all nurses and other hospital workers who are rostered that day will receive higher penalty rates. That means a large financial cost that is unbudgeted for these hospitals.

    This is just another example of Daniel Andrews not thinking things through before he does something.

    VICTORIAN building siteswill be more dangerous whenmandatory drug and alcoholtesting is removed under aLabor Government plan,builders say.

    The Master Builders As-sociation says safety will becompromised when the StateGovernment rips up rules thathelped rid the industry of illicitdrugs and booze.

    The removal of testingcomes as the Andrews Gov-ernment brings in new rules tobreathalyse parliamentariansreturning from long lunches.

    Radley de Silva, the associ-ations executive director, saiddrug and alcohol abuse was asignificant problem in the con-struction industry.

    Removing mandatory drugand alcohol testing jeopardisesthe safety of every constructionworker on every building siteacross the state, Mr de Silvasaid. If the State Governmentis going to boot out boozy MPsfrom parliament, it should cer-tainly weed out intoxicated,stoned or high workers fromat-risk building sites.

    Blanket drug testing onbuilding sites was introducedin July last year.

    The code was one of the for-mer Liberal Governments sig-nature policies and was aimedat improving safety and reduc-ing building costs.

    Shadow minister for indus-trial relations Robert Clarksaid it was disgraceful thatDaniel Andrews was preparedto put the wishes of hisCFMEU mates ahead of thesafety of ordinary workers.

    Under Daniel Andrews the unions are back in charge. John Pesutto, doorstop, 07/01/15

    In the first 100 days of Daniel Andrews Government, there has been a union blockade at the Aldi construction site in Altona (a project generating hundreds of construction and retail jobs) as well as union threats to disrupt rail and Ventura bus services.

    In March there was the startling revelation that the United Firefighters Union has logged claims for a 30% pay rise and new benefits like 8 hours pay for 21 minutes overtime. All up, the new deal reportedly equals $1.6 billion.

    And in January, in a press release on whooping cough, the Andrews Government announced in the final sentence that they were abolishing the Construction Code Compliance Unit which ensures worker safety and the rule of law on building sites.

    One of the effects of Daniel Andrews decision to abolish the Construction Code Compliance Unit is that workers are no longer required to be drug tested on worksites. So, on the one hand Daniel Andrews says that there is an Ice epidemic, but on the other hand he is failing to protect the safety of workers on construction sites who may be at risk from fellow workers who are under the influence.

    Victorian taxpayers are also already losing out because Daniel Andrews has started to return his union favours. He has already settled with the Ambulance union with an offer that on the face of it matched the former Coalition Governments offer but it also included a number of secret side deals.

    And now, other unions such as the notorious HSU and the CFMEU are preparing to list their demands to Daniel Andrews for hefty pay rises and special benefits. This will cost Victorians money and jobs.

    8 Promised not to sack workers at Port of Hastings.

    9 West Gate Distributor - said it was shovel-ready. They have not done the planning, route alignment, or any required studies.

    10 Melbourne Metro rail tunnel - promised a Railway Station at the Royal Childrens Hospital. Now station planned at Parkville - 1km away.

    11 Melbourne Metro rail tunnel - said Cranbourne & Pakenham services should not be axed from the City Loop - but under his plan, they will be. No stops at Southern Cross, Flagstaff, or Parliament.

    12 Melbourne Metro rail tunnel - Andrews said it made no sense to build a station where no one lived (Fishermans Bend) - but is now planning one at Arden, which is a giant vacant railyard, where no one lives.

    13 Melbourne Metro rail tunnel - said Sunbury services should not be axed from the City Loop - but under his plan, they will be. No stops at Southern Cross, Flagstaff, or Parliament.

    14 Melbourne Metro rail tunnel - said stations should not be axed - but Andrews has axed the South Yarra station from the Metro plans, along with a station at Montague (Fishermans Bend).

    15 Promised to immediately introduce truck curfews on arterial roads in Ivanhoe, Heidelberg, Eltham and Montmorency - not done.

    16 Easter Sunday public holiday - not fully costed. Government health services have not factored higher wages into their budgets, eg. night time nursing staff.
