You receiveda Notice dated July 30,2012, requiring that the claim list above be amended due to

excess acres. The amendment was required to be filed within 30 days of the date you receivedthe Notice. As of the date of this letter no amendment has been received. Therefore, the mining

claim listed above has been declared forfeited.

This decision does not relieve you of the liability for reclamation of all areas disturbed by your

activities on land encompassed by your mining claim(s) and/or site(s). After you complete the

reclamation, you must notify the authorized officer of the appropriate surface managing agencyso that the authorized officer may conduct a final site inspection and determine whether you maybe released from liability. If you fail to reclaim the land to the satisfaction of the authorizedofficer, the surface management agency may cite you for noncompliance under its surfacemanagement regulations.

For land administered by the BLM, if you fail to reclaim the land to the satisfaction of theauthorized officer as required in 43 CFR Subpart 3809, the BLM will issue an order ofnoncompliance under 43 CFR 3809.601(a). Ifyou fail to comply with the noncompliance order,the BLM may take further action under 43 CFR 3809.604. Failure to conductreclamation isaprohibited act that may subject you to criminal penalties. See 43 CFR 3809.605(h) and43 CFR 3809.700. If your occupancy has been terminated and you fail to remove structures,material, and equipment, and any personal property in accordance with the regulations in43 CFR 3715.5-1, the BLM may dispose of the property. In accordance with 43 CFR 3715.5-2,you will remain liable for the costs the BLM incurs in removing and disposing of the property.

This decision may be appealed to the Interior Board of Land Appeals, Office ofthe Secretary, inaccordance with the regulations contained in 43 CFR, Part 4 and the enclosed Form 1842-1. If

an appeal is taken, your notice of appeal must be filed in this office (at the above address) within30 days from receipt of this decision. The appellant has the burden of showing that the decisionappealed from is in error.

If you wishto file apetition pursuant toregulation 43 CFR 4.21 (58 FR 4939, January 19, 1993),for a stay of the effectiveness ofthis decision during the time that your appeal is being reviewedby the Board, the petition for a stay must accompany your notice of appeal. Must Amend to Reduce Acreage

On May 21,2012, a notice was issued requiring additional information before the recordation ofyour association placer mining claims could be completed. This office required the filing of:1) A signed and notarized statement from each claimant that they authorized their nanie to be onthe location notices and that they are an actual party to the location of the subject claims, andhave a bona fide interest in the claims. 2) A legal document from each claimant (such as anotarized power o f attorney) showing that the person signing the location notice is the agent orauthorized representative ofthe persons named on the location notice. This office did notreceive this information within the allowed 30 day response period which ended June 29,2012.Therefore, the claim must be amended to reduce the acreage to 20 acres ; if an amendment is notreceived within 30 days of the date the return receipt card is signed, then this claim will bedeclared null and void per the requirement of 43 Code of Federal Regulations (CFR)3832.22(b)(2).

By recording these location notices with BLM you are representing to the United Statesgovernment that you meet the qualitications for locating an association placer claim and that youare not using the names of other persons as dummy locators to locate more than 20 acres perclaim for your own benefit. In accordance with 43 CFR 3830.9, if you file a document that youknow contains false, erroneous, or fictitious information or statements, you may be subject tocriminal penalties under 18 U.S.C. 1001 and 43 U.S.C. 1212. The maximum penalty is 5 yearsin prison and/or a fine of $250,000.

In accordance with 43 CFR 1822.10, all documents required to he filed with the Bureau of LandManagement must contain the applicant's (claimant's) legal name and current address.Additionally, 43 CFR 3833.11 (b)(2) requires that a certificate of location of a mining claim orsite contain the names and current mailing addresses of the locators of the claim. Iii accordancewith 43 CFR 3830.3 an agent may locate mining claims on your behalf as long as they are dulyconstituted and appointed.

Before we can complete the recordation of your association placer mining claims, we will needthe following information:

1) A legal document from each claiinant (such as a notarized power of attorney) showing that theperson signing the location notice is acting on their behalf as their duly constituted and appointedagent or authorized representative; and, 2) A signed and notarized statement from each claimantthat reads: "I (enter claimant's name) authorized and am aware that I am listed as a locator on thelocation notice for AMC Center claim numbers). I have a bona fide interest in these claims and Ilocated the claims independently, for my own self-interest and in good faith. 1 certify that theseclaims have in no way been located for the benefit of a company, corporation, or anotherindividual in order to gain additional acreage they are not entitled to in accordance with the law."

The claimants of the above named mining claim(s) are hereby afforded 30 days from receipt ofthis Notice in which to furnish the requested information. Failure to do so will subject therecordation of these claims to further adjudication which may result in a partial rejection of therecordation and a reduction iii acreage claimed.

11, after reviewing the information in this letter you determine that you do not, in fact, qualify tolocate an association placer mining claim, please relinquish the association placer mining claimsand relocate as an individual placer mining claim under 43 CFR 3832.22(b).

In accordance with 43 CFR 3833.33, you may transfer, sell, or otherwise convey an associationplacer mining claim at any time to an equal or greater number of mining claimants, If you wantto transfer an association placer claim to an individual or an association that is smaller iii miniberthan the association that located the claim you - a) must have discovered a valuable mineraldeposit betore the transfer; or b) upon notice from BLM, you must reduce the acreage of theclaim, if necessary, so that you meet the 20-acre per locator limit. Per 43 CFR 3830.5, adiscovery means that you have found a valuable mineral deposit. Any association placer claimtransferred that does not meet these requirements is not a valid mining claim

2013 Maintenance Fees Due on Claims under a Waiver

A Maintenance Fee Waiver Certification (small miner waiver) was filed for the 2013 assessmentyear for the mining claims listed above. In accordance with 43 CFR 3835.1, to qualify for asmall miner waiver you and all related parties must hold no more than a total of 10 miningclaims or sites nationwide. Since the commencement of the 2013 assessment year, the owner(s)of these mining claims has acquired and now owns in excess of 10 mining claims nationwide,which means they no longer qualify for the small miner waiver.

The Bureau of Land Management records show that James Morris owns 88 active mining claims.

Therefore, in accordance with 43 CFR 3835.20, and Randi Rovetto, Et At., 177 IBLA 257, thewaiver is immediately cancelled and the 2013 Maintenance Fees of $140 per claim per 20 acresare due on the claims listed above. BLM must receive the maintenance fee for these miningclaims on or before September 1, 2013. If we do not receive the fee, the claims will be forfeitedand closed. At that same time (on or before September 1, 2013) the maintenance fees for the2014 assessment year are also due.
