Whereas, the land, specifications whereof are given in Annexures "A" and"

"B" to this notification, is required for construction of Flyover Express Corridor

from Jehangir Chowk to Rambagh, situated in village Narsingh Garh, Tehsil &

District Sri nagar; and

Whereas, on the basis of the indent placed by the Project Director,

(JKUSDIP) J&K Economic Reconstruction Agency, Kashmir· vide his

o.LJIJILIERAIl 06-1 0 dated: 01-04-2010, notification as required under sub-

section (1) or Section 4 or the J&K Land Acquisition Act (SVT) 1990, was issued

by the Collector Land Acquisition. Economic Reconstruction Agency. Kashmir

vide his o. 090-106/LA/ERA dated: 22-04-20 I0 for land measuring ~5 Kanals

05 Marias and 136 Sft. and vide o. 720-73 7/LA/ERA dated: 11-11-2010 for land

~ measuring 02 Kanals 0 Marias 2q9 Sft.i situated 'at village arsingh Garh, Tehsil

& District Sri nagar; and

Whereas, the Collector Land Acquisition, Economic Reconstruction

Agency, Kashmir vide his Ictter NO.746-748/LA/ERA dated: 24-07-2015 has

reported that the notifications issued by him under section 4 (1) of the J&.K State

Land Acquisition Act, was served upon the interested persons, calling objections

from them to the proposed acquisition; and

Whereas, the report furnished by Collector Land Acquisition Economic

Reconstruction Agency, Kashmir, vide his letter o. referred above, duly endorsed

by Deputy Commissioner, Srinagar vide his o. DCS/LAS/1851/286-287 dated:

01-08-2015 and Divisional Commissioner, Kashmir vide his letter

No.Divcom/LAS-Acq/2048-1II1099 ~ale~5 and Financial

Commissioner (Revenue), J&K vide his No.FC-LS/LA-4402/2015 dated: 11-08-

2015, have been examined and it has been found that report of the Collector Land

Acquisition Economic Reconstruction Agency, Kashmir regarding objections of

interested persons is bas.ed on facts, hence disposed off the same being devoid of

any merit; and

Whereas, the Government is satisfied, that -the land, particulars whereof are

mentioned in Annexure "A" and "B" to this notification, is required [or public

purposes and that there is no alternative but to acquire the said 'Iand for

construction of Fly over Express Corridor from Jehangir Chowk to Rambagh; and

Now. therefore, in pursuance of Section 6 of the l&K State Land

Acquisition Act, Samvat, 1990. it is declared that the land mentioned in Annexure

"A" and "B" to this notification is needed for a public purposes viz. construction

of Fly over Express Corridor from lehangir Chowk to Rambagh;, situated at village

Narsingh Garh, Tehsii & District Srinagar;. Further, the Collector Land

Acquisition Economic Reconstruction Agency, Kashmir, is directed under Section

7 of the said Act to take order for the acquisition of land, specifications whereof".

are detailed in Annexure "A" and "B" to this notification.

The Collector, Economic Reconstruction Agency etc. have recommended

to invoke the provisions of Section 17 of Land Acquisition Act due to urgency

involved in the said acquisition as the public/commuters are facing lot of

discomfort/inconvenience due to the executioli of project. Any delay in the

execution would further the discomfort/inconvenience.

Therefore, in pursuance of Section 17 of the J&K State Land Acquisition

Act, Samvat, 1990, it is ordered that on expiry of fifteen days from the date of

publication of notification under section 9 (2) of the said Act, the Collector Land

Acquisition Economic Reconstruction Agency, Kashmir, will take possession of

the aforementioned land detailed in A'2jf?' and "B" to this notification,

situated at village Narsingh Garh, Tehsil & District Srinagar, required for public

purposes, subject to the fulfilment of conditions prescribed under section 9 (2) and

section l7-A or the .1&K State Land Acquisition Act and Rule 63 of the J&K Land

Acquisition Rules.

However, the Collector shall be responsible for proper title verification of

all types of land involved in the ~case, in" respect of all the interested

persons/rightful claimants in accordance with the relevant laws/rules in force,

while making final award in the case.
