Hairfield Deputy Chief Acquisition Officer and Senior Procurement Executive SUBJECT: Class Deviation from the Federal Acquisition Regulation (FAR) to Remove the Requirement for Best Procurement Approach Determination to Use an Interagency Acquisition 1. Purpose: Implementing class deviation authorized by the Civilian Agency Acquisition Council (CAAC) Chair in CAAC Letter 2018-04. 2. Deviated language: See CAAC Letter 2018-04 attachment. 3. Applicability: The authorized deviation to FAR 17.502-1(a) removing the best procurement approach determination requirement to use an interagency acquisition applies to all new Department of Education requirements solicited on or after the effective date of this Alert. 4. Effective Date: Effective immediately. 5. Expiration Date: This Alert shall remain effective until such a time as Section 875 of the National Defense Authorization Act (NDAA) for Fiscal Year (FY) 2019 (Pub. L. 115-232) is incorporated by final rule into the FAR or until this Alert is otherwise rescinded. 6. Background and Other Details: Section 875 of the NDAA for FY 2019 (Pub. L. 115-232) removes the requirement for a best procurement approach determination to use an interagency acquisition. CAAC Letter 2018-04 authorizes agencies to issue class deviations implementing this provision of the NDAA, pending publication of the formal amendment to the FAR via FAR Case 2018-015. 7. Required Actions and Guidance: ED Heads of the Contracting Activity shall utilize this class deviation when appropriate. 8. Attachment: CAAC Letter 2018-04, dated September 27, 2018 9. SUBJECT: Class Deviation from the Federal Acquisition Regulation (FAR) to Remove the Requirement for Best Procurement Approach Determination to Use an Interagency Acquisition

1. Purpose: Implementing class deviation authorized by the Civilian Agency Acquisition Council(CAAC) Chair in CAAC Letter 2018-04.

2. Deviated language: See CAAC Letter 2018-04 attachment.

3. Applicability: The authorized deviation to FAR 17.502-1(a) removing the best procurementapproach determination requirement to use an interagency acquisition applies to all newDepartment of Education requirements solicited on or after the effective date of this Alert.

4. Effective Date: Effective immediately.

6. Background and Other Details: Section 875 of the NDAA for FY 2019 (Pub. L. 115-232)removes the requirement for a best procurement approach determination to use an interagencyacquisition.
