REACH 2018: Securing continuity of ingredient supply
Information & Guidance Note to Members
THE ISSUE: Under the REACH Regulation, the registration deadline for phase-in substances manufactured or imported in quantities between 1 and 100 tonnes per legal entity per year is 31 May 2018. Companies using such substances need to ensure that these are registered by their manufacturers or importers before this deadline (unless exempted), and that their cosmetic use is covered in the registration dossier, so that they can continue to use these substances as of 1 June 2018.
THE RISK: Small tonnages of substances are more “vulnerable” than higher tonnages, as some suppliers (manufacturers or importers), especially SMEs, might not be in a position to register all cosmetic ingredients concerned on time and in full. The risk is to see the supply of certain ingredients – in some cases key speciality chemicals – discontinued as of 1 June 2018.
WHAT CAN YOU DO? As a National Association, you should raise awareness within your membership, by reminding it of its potential obligations under REACH, and by informing it of the potential risk. You should also convey the guidance issued by Cosmetics Europe (see Section 2 of this document). As a Company, you should know your portfolio, identify the substances that may be concerned by this registration deadline and open a dialogue with your suppliers regarding their registration intentions and capabilities. Carry out the actions suggested in Section 2. It would also be useful to identify alternative substances and/or sources of supply.
WHAT DOES COSMETICS EUROPE DO? Cosmetics Europe continues to engage in awareness-raising activities aimed to its members. It is also in dialogue with EFfCI, the European Federation of Cosmetic Ingredient Suppliers, IFRA, the International Fragrance Association, and UNITIS, the European Organisation of Cosmetic Ingredients Industries and Services and has requested, via DUCC, that ECHA should reiterate its survey of registration intentions, as carried out before previous registration deadlines. Between July and December 2015, Cosmetics Europe has carried out a survey of its member companies as to the substances they identified as being at risk of not being registered by 31 May 2016. The outcome of this survey was inconclusive due to the low number of responses and was, therefore, not followed by further action.

1. (PRE) REGISTRATION OBLIGATIONS UNDER REACH 1.1 General (pre) registration requirements Regulation (EC) No 1907/2006 (REACH) sets up rules for the Registration, Evaluation Authorisation and Restriction of chemicals. According to the registration process, all manufacturers and importers (M/I) of substances, as such, in mixtures or in articles1, and in quantities exceeding 1 tonne per legal entity per year, have to submit to the European Chemicals Agency (ECHA) a registration dossier, unless an exemption applies, before placing the substances on the EU market. Extended deadlines were granted to “existing” or “phase-in” substances which were pre-registered between 1 June 2008 and 1 December 2008. These substances are subject to registration according to an established calendar, based on their hazard profile and annual tonnage. The dates for the registration of the most hazardous substances and those produced at the highest tonnage levels (100 tonnes/year and above) have already expired. By 31 May 2018 all pre-registered substances manufactured or imported in quantities between 1 and 100 tonnes (per legal entity, per year) must be registered, unless they are exempted (see Annex 1). Otherwise, their manufacture, import and placing on the EU market become illegal and must cease. See the information requirements for registrations in Annex 3.
2. GUIDANCE FOR COMPANIES Depending on the substance, a company can be either:
manufacturer or importer; in this case it may have registration obligations; continuity of supply is in its own hands; or
downstream user; in this case, it does not have registration obligations; continuity of supply is in its supplier’s hands.
Extensive guidance is available from ECHA (see Section 4) for registrants. This document is aimed at helping downstream users ensure, as far as possible, that the substances they use and which need to be registered by 31 May 2018 will continue to be available after this date. They are advised to take the following steps, as soon as possible:
Step 1: Identification of suppliers
a. Draw up the list of your suppliers.
b. Identify those which supply you with substances that may be subject to registration in 2018.
c. Contact these and obtain written confirmation that they will do so before the deadline.

Where such confirmation is obtained, take no further action; however, it might be wise to check again as the deadline approaches. Where this confirmation is not obtained, or is obtained but you are not entirely confident, identify the substances concerned Go to Step 2.
Step 2: Identification of substances For the substances identified above:
a. cross-check your list with the list of substances already registered (available on ECHA’s website: http://echa.europa.eu/information-on-chemicals/registered-substances). Please ensure that such substances are not only registered as intermediates (in which case they do not cover the use in cosmetics).
b. identify those substances on your list which have not been registered
c. eliminate from this list substances which are exempted from registration (see Annex 1)
d. check which of the substances on the resulting list have been pre-registered (see ECHA website: http://echa.europa.eu/information-on-chemicals/pre-registered-substances) and, out of these, which substances indicate 31 May 2018 as the registration deadline
e. by now you would probably have three categories of substances in your portfolio:
i. substances already registered No further action (however, it is advisable to document their registration status ).
ii. substances exempted from registration No further action
iii. substances not yet registered (pre-registered for registration in 2018 and, possibly, substances that are not pre-registered): this is your Working List Go to Step 3.
Step 3: Contacts with suppliers
a. Contact the suppliers of substances on your Working List;
b. Assess their intentions with regard to the registration of those substances on your Working List which they supply;
c. Do your utmost to obtain their commitment, e.g. via a contractual clause.

Step 4: Alternative substances or sources of supply
a. For those substances that you identified as being of interest and important under Step 2, you may wish to investigate possible alternatives, in terms of substances and/or suppliers.
b. On the basis of this, prepare your “Plan B”.
3. LAST MINUTE INFORMATION & GUIDANCE ECHA Webinar ECHA is organising a webinar for registrants on 8 March 2018. The objective is to provide last-minute advice on how to successfully submit Registration dossiers, as well as the opportunity to ask questions directly to ECHA experts. Register here. Late test results Prospective registrants who expect that test results on their substances may not be ready by the 31 May 2018 registration cut-off date, are facing a new deadline in order to be considered as an “exceptional case”. If the test results are not ready, the dossiers can be viewed as an exceptional case if the lab testing contracts were secured before 31 March 2018. However, in the first instance registrants in this predicament need to contact ECHA via an online form before submitting a dossier, so that the agency can provide clear instructions on what to submit. If the required documentation is not submitted, the lead dossier of the joint submission will not pass the completeness check; however, ECHA may grant the registrant a reasonable time period – the so-called ‘second completeness check’ – to complete the dossier, taking into account the need to finalise the missing tests. ANNEX 1: substances exempted from registration requirements Substances exempted from registration are those which are:
listed in Annex IV of the REACH Regulation;
meeting the criteria in Annex V of REACH;
re-imported (if previously registered by an actor in the supply chain)
recovered (if previously registered by an actor in the supply chain)
polymers (note: the exemption does not apply to monomers or other constituents of polymers if the following conditions are met: (i) not previously registered by an actor in the supply chain, (ii) the total quantity of monomer or other constituent is 1 tonne/year or more, and (iii) the monomer or other constituent represents 2% w/w or more of the weight of the polymer);
used in medicinal products for human and veterinary use;
used in foods and feedingstuffs (also when used as additives and flavouring agents).
ANNEX 2: Information requirements for late pre-registrations In order to submit a late pre-registration and to benefit from the extended registration deadline, companies must prove that they are established in the European Community and:
manufacture or import the phase-in substances concerned (on their own or in preparations) for the first time after 1 December 2008, in quantities of 1 tonne per year or more; or
produce or import articles that contain the phase-in substances concerned for the first time after 1 December 2008 in quantities of 1 tonne per year or more, and which are intended to be released under normal and reasonably foreseeable conditions of use.
If the conditions above are fulfilled, the information to be submitted to ECHA, by 31 May 2017, for each substance concerned is the following:
name of substance (as per Annex VI of REACH, section 2)
name and address of the potential registrant and of the contact person

name(s) of substance(s) for which the available information is relevant for the application of QSAR and grouping/read-across (Annex XI, sections 1.3 and 1.5)
The deadlines for doing to are:
at the latest six months after the manufacturing or importing of the substance exceeds the 1 tonne threshold and
at latest by 31 May 2017 (i.e. 12 months before the relevant transitional deadline for registration).
In case a company established in the European Community manufactures or imports a phase-in substance which it has not pre-registered, it will have to cease its activities involving this substance or register it without delay.
ANNEX 3: Information required for registrations The registration of a substance manufactured or imported in quantities between 1 and 100 tonnes per legal entity per year, shall include all of the following information: A. a Technical Dossier including:
the identity of the manufacturer/importer (see section 1 of Annex VI of REACH)
the identity of the substance (see section 2 of Annex VI of REACH)
information on the manufacture and use(s) of the substance (see section 3 of Annex VI of REACH)
the classification and labelling of the substance (see section 4 of Annex VI of REACH)
guidance on safe use (see section 5 of Annex VI of REACH)
study summaries of the information derived from the application of Annexes VII, VIII and XI of REACH
robust study summaries of the information derived from the application of Annexes VII, VIII and XI of REACH, if required under Annex I thereof
an indication as to which of the information has been reviewed by an assessor chosen by the manufacturer or importer and having appropriate experience
proposals for testing where listed in Annex IX
for substances in quantities of 1 to 10 tonnes, exposure information as specified in section 6 of Annex VI
a request as to which of the information in Article 119(2) the manufacturer or importer considers should not be made available to the public in accordance with Article 77(2)(e), including a justification as why publication could be harmful for his or any other concerned party’s commercial interests.
B. A Chemical Safety Report, when required under Article 14 of REACH, in the format specified in Annex I thereof. The relevant sections of this report may include, if the registrant considers appropriate, the relevant use and exposure categories.
