competent authority based on material placed belbre it would decide
on
the timing and period fbr which rnatemity leave ought rote
granted to a cornmissioningrnother who adopts the surrogacy
route.
3. The scrutin)/ rvould be keener and detailed when leave is
soughr by, afemale employee who is the commissioning rnother, of
the pre-naLar stage. I, caser,atemity leave is declined at the
pre-natal stage, the competent authority rvould pass atea-soned
order having regard to the material, if any, praced before it by
trre femareemployee who seeks to avaii maternity leave.
4. In a situation rvhere both the cornmissioning mothcr and thc
srrrrogarclnother are employees, who are otherwise eligible lbr
maternity leave ( one on the groundthat she is a commissioning
mother and the another on the grou,d that she is the
pregnantwoman)' a suitable ad.iustment regarding grant of matemily
leave at the sarre tim,: or.t>therq'ise would be made by the
cornpetent authority.

5. For rhe grant of leave qua pre natal stage and post-natal
period, thecompetent authority would ordinarily grant such teave
except where there are substantial
reasons fot declining a fequest made in that behalf. In this
case as well, the competent
authority will pass a reasoned order.
6. The competent authority ltrr the grant ol this leave would be
the Head of
the Department.
7. These instructions will be eft'ective from the date of
issuc'
